Monsieur le président, chers collègues, c'est avec une très grande satisfaction que je vois cette proposition clôturer les débats de cette fin de législature.
Au MR, nous sommes depuis toujours particulièrement sensibles à la situation que vivent les aidants proches au quotidien. Sous la précédente législature, nous avions reconnu et donné une définition au plus proche de la réalité. Mais ce fut sans réellement pouvoir ouvrir des droits spécifiques liés à ce nouveau statut. C'est précisément dans ce contexte que le groupe MR avait, dès le début de la législature, déposé une proposition en ce sens.
Comme vous le savez, le gouvernement actuel travaillait sur ce dossier avant qu'il ne se retrouve en affaires courantes. De nombreux partis avaient déposé des textes visant à améliorer la situation de toutes ces personnes qui décident de mettre entre parenthèses leur vie professionnelle pour prendre soin d'un proche.
D'un commun accord, nous avons décidé de travailler ensemble avec les ministres et les cabinets concernés. Je profite de l'occasion pour remercier le premier ministre, la ministre des Affaires sociales, le ministre des Pensions et le ministre des Classes moyennes pour leur implication dans ce projet.
De mémoire de parlementaire, c'est bien la première fois qu'une proposition qui est le fruit d'un travail collectif arrive sur la table et peut, enfin, se concrétiser, non pas pour nous ni pour notre ego, mais bien pour ces milliers de personnes en attente d'une réelle reconnaissance de leur situation précaire ainsi que de l'amorce d'une ouverture réelle aux droits sociaux.
Ce qui va très concrètement changer pour les aidants proches se résume de la manière suivante.
Au niveau de la définition, sera reconnue comme aidant proche toute personne qui apporte une aide et un soutien continu ou régulier à la personne aidée.
La personne aidée ne devra plus, comme auparavant, être en situation de grande dépendance. Aujourd'hui, on élargit cette aide à toutes les personnes en situation de dépendance et reconnues avec douze points au minimum par le corps médical.
Une simple déclaration sur l'honneur auprès de la mutualité de la personne aidée suffira comme formalité pour être reconnu comme aidant proche.
L'aidant proche qui exerce une activité de salarié pourra suspendre son activité soit entièrement, soit à mi-temps, et ce pour une période d'un mois qui pourra être prolongée jusqu'à six mois, si un arrêté royal délibéré en Conseil des ministres était pris en ce sens.

At MR, we have always been ⁇ sensitive to the situation experienced by close caregivers on a daily basis. During the previous legislature, we had recognized and given a definition of what was closest to reality. But it was not really able to open specific rights related to this new status. It is precisely in this context that the MR group had, from the beginning of the legislature, submitted a proposal in this direction.
As you know, the current government worked on this matter before it got into ordinary affairs. Many parties had filed texts aimed at improving the situation of all those people who decide to put their professional life between parentheses to take care of a loved one.
By mutual agreement, we have decided to work together with the relevant ministers and cabinets. I take the opportunity to thank the Prime Minister, the Minister of Social Affairs, the Minister of Pensions and the Minister of the Middle Class for their involvement in this project.
From the memory of a parliamentary, this is the first time that a proposal that is the fruit of collective work comes on the table and can finally become concrete, not for us or for our ego, but for those thousands of people waiting for a real recognition of their precarious situation as well as the beginning of a real opening to social rights.
What will very concretely change for close caregivers is summarized as follows.
A close assistant shall be recognized as any person who provides continuous or regular assistance and support to the person assisted.
The aided person will no longer, as before, have to be in a situation of great dependence. Today, this aid is extended to all people in dependence situation and recognized with at least twelve points by the medical body.
A simple declaration of honour with the reciprocity of the person assisted will be sufficient as a formality to be recognized as a close assistant.
A close assistant who exercises an activity as an employee may suspend his activity either entirely or part-time, and this for a period of one month, which may be extended up to six months, if a royal decree deliberated in Council of Ministers was taken in this sense.

Vous l'aurez compris, chers collègues, il s'agit ici d'une avancée majeure pour ces personnes qui attendent cette reconnaissance depuis trop longtemps. Pour l'instant, cela ne concernera que les travailleurs salariés. La même ouverture devra se faire au profit des indépendants. En tout état de cause, la proposition entend aussi évaluer ce nouveau congé thématique d'ici quelques années, afin de pouvoir l'ajuster, le compléter ou le modifier au besoin, en fonction des réalités de terrain.
Ces aidants proches, comme on les appelle, ont une grande valeur, non seulement sur le plan social, mais également d'un point de vue économique. Leur apporter notre soutien était bien plus qu'une nécessité. C'était devenu une obligation morale, que nous remplissons aujourd'hui. Mon groupe et moi-même nous réjouissons de pouvoir apporter notre soutien à ce texte.

Mijnheer de voorzitter, ook ik wil absoluut mijn appreciatie uitdrukken voor het feit dat wij het voorliggend voorstel Kamerbreed kunnen realiseren. Een gemiddelde mantelzorgperiode duurt tien jaar, terwijl wij met de bestaande gemotiveerde tijdskredieten aan zo'n vier jaar of 51 maanden komen. Dat is, gemiddeld gesproken, lang niet voldoende om de mantelzorgperiode te overbruggen, zeker niet in situaties waarin men een kind met een handicap heeft, een jongdementerende partner enzovoort. Het is in elk geval een win-winsituatie, omdat wij met het voorliggend voorstel de combinatie tussen werk en mantelzorg leefbaar houden en betaalbaar en haalbaar maken.
De handen van mantelzorgers zijn bovendien ook gratis handen in de zorg. Als wij die zouden moeten vervangen door verpleegkundigen of verzorgenden, dan wijzen studies uit – ik heb er ook zelf een studie over gemaakt en boeken over geschreven in een vorig leven – dat dit 23 miljard euro per jaar zou kosten. Wij moeten die gratis handen in de zorg dus koesteren.
Daarnaast worden werkende mantelzorgers significant vaker ziek dan werkende niet-mantelzorgers. Ook daar bestaan studies over. Met andere woorden, er zijn terugverdieneffecten wanneer men mantelzorgers en zeker werkende mantelzorgers beter ondersteunt. Het is dus absoluut niet iets wat de staatskas geld kost.
Ik heb bijna vijf jaar geleurd met mijn wetsvoorstel dat stof lag te vergaren en ben dan ook blij dat wij er in lopende zaken in geslaagd zijn een werkgroep op te richten. Dan is het minder belangrijk wie er als eerste indiener op het wetsvoorstel mag staan, als de doorbraak er maar komt, en die is er dus.
Ik sluit mij aan bij mijn collega, die zei dat het absoluut nog niet voldoende is, maar het is in elk geval een eerste heel belangrijke stap, met een uitkering en gelijkgestelde rechten voor het pensioen. Het is dus zeker een stap vooruit.

I agree with my colleague, who said that it is absolutely not enough yet, but it is in any case a very important first step, with a benefit and equal rights for retirement. This is ⁇ a step forward.

Men zou dan ook verwachten dat dit zeer vlot goedgekeurd kon worden in de commissie voor de Volksgezondheid. Vreemde hersenkronkels hebben er echter voor gezorgd dat dit voorstel in de commissie weggestemd werd met zeven stemmen tegen zeven en enkele onthoudingen.
Dat is de reden waarom ik hier vandaag sta met een artikel 88. Zo goed als iedereen in dit halfrond en ook erbuiten is voorstander van het optrekken van de leeftijdsgrens voor het kopen van tabaksproducten tot 18 jaar. Daar zijn ook zeer goede redenen voor. Volgens de Wereldgezondheidsorganisatie is roken immers een van de belangrijkste doodsoorzaken ter wereld die met een goede preventie vermeden kunnen worden.
Die goede preventie begint best vroeg, want rokers beginnen vaak op zeer jonge leeftijd. Uit een onderzoek van de Universiteit Gent blijkt dat de overgrote meerderheid van de jongeren begint te roken op de leeftijd van 16 jaar of vroeger. Vanaf 17 jaar zien we eigenlijk een sterke daling van het aantal beginnende rokers. De Hoge Gezondheidsraad pleit dan ook voor het optrekken van de leeftijdsgrens voor het kopen van tabaksproducten van 16 naar 18 jaar.
Ze hebben ook gelijk. Niet alleen beginnen verstokte rokers vaak op zeer jonge leeftijd, vooral wie jong begint heeft ook een veel grotere kans om op latere leeftijd een verslaving te ontwikkelen. Dat blijkt andermaal uit academisch onderzoek.

There are four proposals on the agenda regarding smoking and the sale of tobacco products. These proposals have been extensively discussed in the committee and I will therefore limit myself to what our group considers most important. I would like to extend this not only because it is a bill from us, but also because we find this a very important topic.
It is actually bizarre that this discussion still needs to be carried out, because the majority of the parties has the increase of the age for buying tobacco products just in the party program. It would be expected that this could be quickly approved in the Public Health Committee. However, strange brain cramps have caused this proposal to be rejected in the committee with seven votes against seven and a few abstentions.
That is why I am here today with Article 88. Almost everyone in this hemisphere and beyond is in favour of raising the age limit for buying tobacco products up to 18 years. There are also very good reasons for this. According to the World Health Organization, smoking is one of the leading causes of death in the world that can be avoided with proper prevention.
That good prevention begins quite early, because smokers often start at a very young age. A study from the University of Ghent shows that the vast majority of young people start smoking at the age of 16 or earlier. From the age of 17, we actually see a sharp decline in the number of starting smokers. The High Health Council therefore advocates for raising the age limit for buying tobacco products from 16 to 18 years.
They are also right. Not only do non-smokers often start at a very young age, especially those who start young are also much more likely to develop addiction at a later age. This is demonstrated again by academic research.

Uit de laatste VAD-leerlingenbevraging blijkt bovendien dat jongeren tussen 16 en 18 jaar aangeven vrij gemakkelijk aan tabak te kunnen geraken. Bij jongeren onder 16 jaar zakt dit van 8 op 10 naar 4 op 10. Natuurlijk mag de invloed van peer pressure van hun vrienden niet worden onderschat. Deze vrienden spelen uiteraard een rol bij het aanleveren van sigaretten en andere tabaksgerelateerde producten. "Zij doen de perceptie van de jongeren over de algemene rookprevalentie in de populatie stijgen en helpen zo een norm te creëren waarin roken aanvaard is." Dat besluit dezelfde studie van de UGent.
Ons wetsvoorstel werd in de commissie voor de Volksgezondheid, zoals daarnet reeds gezegd, nipt weggestemd. Dit was enkel mogelijk door de tegenstem van CD&V. Heel jammer dat hier niemand van CD&V aanwezig is. CD&V is nochtans een partij die zelf een resolutie had ingediend voor het optrekken van deze leeftijdsgrens. Wij twijfelen er niet aan dat dit geen principiële tegenstem was, maar eerder een stem uit loyauteit aan de regeringspartner Open Vld. Het is immers algemeen geweten dat vooral minister De Block gekant is tegen het optrekken van de leeftijdsgrens.
Men zou kunnen zeggen dat deze plotse loyauteit CD&V siert, maar dit gaat helaas ten koste van de gezondheid van onze jongeren. Ondertussen blijft België zowat het enige land in de Europese Unie dat de leeftijdsgrens voor het kopen van tabaksproducten nog niet heeft opgetrokken naar 18 jaar, ondanks het feit dat daarvoor een erg breed draagvlak bestaat en in talrijke landen deze leeftijdsgrens reeds werd opgetrokken naar 21 jaar.
Het mag duidelijk zijn dat wij op dit vlak geen voortrekkersrol spelen.
Beste CD&V-Parlementsleden en collega's van de MR, ik kijk naar u. In uw partijprogramma staat een goed standpunt, want er staat dat u voorstander bent van het optrekken van de leeftijdsgrens voor het kopen van tabaksproducten naar 18 jaar.

We do not doubt that this was not a principled opposition vote, but rather a vote of loyalty to the government partner Open Vld. After all, it is generally conscious that especially Minister De Block is opposed to raising the age limit.
One could say that this sudden loyalty is glorifying CD&V, but this is unfortunately at the expense of the health of our young people. Meanwhile, Belgium remains almost the only country in the European Union that has not raised the age limit for buying tobacco products to 18 years, despite the fact that there is a very broad level of support for this, and in numerous countries this age limit has already been raised to 21 years.
It should be clear that we do not play a leading role in this area.
Dear CD&V Members of Parliament and colleagues of the MR, I look at you. Your party program has a good position because it states that you are in favour of raising the age limit for buying tobacco products to 18 years.

Monsieur le ministre, chers collègues, il aurait été délicat de ne pas intervenir sur un point aussi important que celui du tabac et de la lutte contre le tabagisme, qui doit évidemment rester un objectif prioritaire en matière de santé publique.
Je crois qu'il importe de rappeler que nous avons travaillé dans ce domaine au cours de cette législature, même si nous n'avons pas été jusqu'à exclure l'utilisation du tabac, ce qui n'était pas le but. Pour rappel, une directive antitabac est entrée en vigueur. Nous l'attendions depuis longtemps et elle a finalement vu le jour sous cette législature. Elle contient un certain nombre de mesures primordiales en matière de lutte contre le tabagisme, dont voici trois exemples spécifiques: la réglementation sur la cigarette électronique, l'apposition de plus grands avertissements sanitaires sur les produits à base de tabac et l'interdiction des cigarettes au menthol.
Par ailleurs, cette législature a vu aussi l'élargissement du remboursement des médicaments prescrits pour le sevrage tabagique – un élément fondamental –, l'augmentation du nombre de contrôleurs au sein du SPF Santé publique, et donc le renforcement des contrôles relatifs à l'interdiction de fumer.
Il est bien de prendre un certain nombre d'initiatives mais encore faut-il faire vérifier si la législation est bien mise en application et respectée. Un effort considérable a été fourni en cours de législature en vue de relever les accises et le prix du tabac, en misant sur des accises spécifiques.
L'écart de prix entre les cigarettes et le tabac à rouler a été largement réduit. Il faut également signaler que l'augmentation des accises a eu les effets suivants sur le prix des paquets: le prix moyen pondéré d'un paquet de 50 grammes de tabac à rouler a été porté de 5,51 euros en 2014 à 8,35 euros en 2018, soit une hausse de 52 %. Le prix moyen pondéré d'un paquet de cigarettes est passé de 5,31 euros en 2014 à 6,08 euros en 2018, soit une hausse de 15 %.
Des accises supplémentaires, dont nous avons beaucoup discuté dans le cadre du tax shift, ont ainsi été perçues pour un montant de l'ordre de 700 à 720 millions d'euros.

Mr. Minister, it would have been delicate not to intervene on a matter as important as that of tobacco and the fight against smoking, which of course must remain a priority in public health.
I think it is important to recall that we have worked in this area during this legislature, although we have not been up to excluding tobacco use, which was not the goal. The smoking directive has entered into force. We have been waiting for it for a long time and it finally came into being in this legislature. It contains a number of key anti-smoking measures, including three specific examples: regulation on e-cigarettes, greater health warnings on tobacco products and a ban on menthol cigarettes.
In addition, this legislature has also seen the expansion of the refund of prescribed medicines for smoking cessation – a fundamental element –, the increase of the number of controllers within the SPF Public Health, and thus the strengthening of the controls on smoking prohibition.
A number of initiatives are to be taken, but it is still necessary to check whether the legislation is properly implemented and complied with. A considerable effort has been made during the legislature to raise excise duties and tobacco prices, with specific excise duties.
The price gap between cigarettes and tobacco has been greatly reduced. It should also be noted that the increase in excise duties has had the following effects on the price of packages: the weighted average price of a pack of 50 grams of rollable tobacco was raised from 5.51 euros in 2014 to 8.35 euros in 2018, an increase of 52%. The weighted average price of a pack of cigarettes fell from 5.31 euros in 2014 to 6.08 euros in 2018, an increase of 15%.
Additional excise duties, which we talked a lot about as part of the tax shift, were collected for an amount ranging from €700 million to €720 million.

Nous avons également ratifié le protocole pour éliminer le commerce illicite des produits du tabac, qui entrera en vigueur en Belgique le 23 mai 2019. La mise en œuvre du paquet de cigarettes neutre est sur les rails. Il a fallu se référer à un certain nombre d'expériences au niveau européen, voire mondial, mais nous arrivons à cette mesure.
Nous avons également approuvé en commission la fin de la vente des cigarettes dans les distributeurs automatiques. Ce texte est cependant notifié à la Commission européenne car, comme vous le savez, un certain nombre de décisions qui sont prises ici en Belgique doivent également être notifiées au niveau de l'Europe. Nous complétons donc aujourd'hui cet arsenal de mesures par une interdiction fédérale de fumer en voiture en présence d'enfants.
L'ensemble des mesures ne remplacera évidemment jamais l'éducation à la santé. L'éducation reste le vecteur fondamental et premier pour pouvoir faire comprendre aux jeunes et aux moins jeunes que fumer reste nocif et extrêmement dangereux. Pour ce faire, l'information doit être diffusée particulièrement au sein des familles, les parents devant aussi prendre leurs responsabilités.
Par ailleurs, j'insiste évidemment sur les actions au niveau des écoles, des universités, des mouvements de jeunesse et des clubs de sport. Ce week-end, j'ai eu l'occasion d'aller dans un club sportif en Hollande suivre une compétition internationale. J'ai constaté que le tabac était interdit autour des terrains et dans les clubhouses, y compris l'alcool. Il s'agissait d'une compétition pour les jeunes de moins de 16 ans. La Belgique devrait prendre exemple sur ces initiatives qui ne peuvent aller que dans l'intérêt de la santé de nos enfants. Il faut informer et sensibiliser aux risques sanitaires liés à une consommation du tabac. Pour ce faire, il faudra intensifier les campagnes.
Monsieur le ministre, monsieur le président, chers collègues, voilà les différentes informations que je souhaitais encore donner aujourd'hui car le tabac reste un élément à combattre au quotidien. Par nos initiatives, je pense que nous y arriverons. Je vous remercie.

We also ratified the Protocol to Eliminate Illegal Trade in Tobacco Products, which will enter into force in Belgium on 23 May 2019. The implementation of the neutral cigarette package is on track. We have had to refer to a number of experiments at the European and even global level, but we are reaching this point.
We also approved in commission the end of the sale of cigarettes in automatic distributors. This text is, however, notified to the European Commission because, as you know, a number of decisions that are made here in Belgium must also be notified at European level. So today we are supplementing this arsenal of measures with a federal ban on smoking in the car in the presence of children.
These measures will never replace health education. Education remains the fundamental and first vector to make young people and young people understand that smoking remains harmful and extremely dangerous. To do this, the information must be spread especially within the families, the parents must also take their responsibilities.
In addition, I obviously insist on actions at the level of schools, universities, youth movements and sports clubs. This weekend I had the opportunity to go to a sports club in the Netherlands to attend an international competition. I found that tobacco was prohibited around the grounds and in clubhouses, including alcohol. It was a competition for young people under the age of 16. Belgium should take an example in these initiatives that can only go in the interest of the health of our children. Information and awareness about the health risks associated with tobacco consumption should be raised. In order to do this, the campaigns will need to be intensified.
Mr. Minister, Mr. President, dear colleagues, this is the different information that I would like to give today as tobacco remains an element to be combated on a daily basis. Through our initiatives, I think we will succeed. I thank you.
