Mr. Speaker, I note that none of the two competent ministers are present, but I will not be difficult to address this as Mr. Bacquelaine is present.
In the current situation, when applying for a driver’s license, a person must download a registration form on the FOD Mobility website. That form is then sent to one of the federations, Flemish or French-speaking, which are responsible for the management and follow-up of the file. This is a case that, to this day, in fact, largely belongs to the federations, some of which are recognized and subsidised by the states.
According to the new law, it will become a federal authority. The Regions must be involved according to the Special Act of 8 August 1980, whatever has happened. The Waals Region and the Flemish Region have expressed their agreement. However, the draft law is a real framework law, which leaves a lot to the King. It will be by royal decree that it will be determined how the exams will be organized. It will also be by royal decree that will be determined in what manner the practical experience required in the future must be demonstrated.
What will happen de facto? We are not aware of the present bill. The draft law leaves everything in the unknown. In any case, I hope for a lasting cooperation with the recognized federations, which now in practice have an important finger in the pot; otherwise we are dealing here with a new phenomenon, a kind of actual hereditary federalization, in which something that now in fact lies with the states, goes in court to the federal government.
I would like to point out that it would be ⁇ illogical if there were no longer cooperation with the federations. The Maritime School has long been a member of the Communities, which must conclude a cooperation agreement on this subject. When I compare the driving license with the driving license, I clearly see how contradictory our competence distribution legislation has become. The driving certificate is still at the federal level, while the training and exam scheme for the driving license has been transferred to the counties since the sixth state reform, as well as the recognition conditions for the examination centers. That is, therefore, a certain contradiction that leads to a rather chaotic division of powers. My group calls for some clear lines to be drawn as soon as possible, and at least in 2019.
