Directive 2005/36/EC of 7 September 2005 on the recognition of professional qualifications was to be transposed by 20 October 2007. This Directive provides for simplification and consolidation so that simpler and clearer rules apply to the occupations concerned.

On 10 March 2006, the Council of Ministers adopted a mixed transposition of this Directive, both horizontal and vertical. The horizontal conversion has already taken place with the law of 10 May 2006 and will be abolished with the publication of the law in question. The present draft legislation will only apply to regulated professions that are not subject to a vertical transposition of the Directive. The draft law follows as much as possible the original text of the directive.

Mr Partyka asked whether the relevant professional organisations were sufficiently informed or consulted, whether third-country nationals will be eligible and whether the consumer is adequately protected. The Minister replied that there had been sufficient consultation and cooperation with the relevant professional organisations and that the consumer is protected by the professional qualifications imposed by the Directive, which a person must possess before exercising a profession. The Directive applies only to nationals of the EU Member States as well as those of the three EEA countries and Switzerland as soon as they have transposed the Directive.

Mr Laeremans submitted two technical amendments that were adopted. The bill was unanimously approved.
