Mr. Speaker, your committee examined this bill returned by the plenary session at its meeting of 12 April 2007.
This bill was adopted by the Social Affairs Committee at its meeting on 21 March 2007.
However, the current drafting of the bill presents a technical problem.
On 29 March 2007, the House adopted the bill amending the law of 3 July 1967 (document no. 2917). However, this bill currently in the Senate modifies partially the same provisions as the bill under consideration. The entry into force of Bill No. 2917 after that of this bill would have the effect of canceling the effect of Articles 3, 5 and 6 of the latter. However, the provisions governing the entry into force of both projects make this scenario very possible. In order to avoid any risk of interference between the two bills, the President submitted four amendments.
The representative of the Minister of Social Affairs and Public Health approved the amendments submitted by the President.
According to this representative, the most important amendment is amendment no. 4, which prevents the amendments made by this bill from being defeated by the subsequent entry into force of the bill amending the law of 3 July 1967.
From a technical point of view, there would unfortunately be a discrimination between private sector workers and public sector workers during the interval between the entry into force of the two bills. However, this is a one-day interval, necessary to guarantee legal certainty.
Amendments 1 to 4 and Articles 3, 5, 6 and 19 as amended have all been adopted unanimously.
The amended draft law was adopted unanimously.
