Monsieur le président, nous aurions aimé voter ce texte avec le plus grand des enthousiasmes. Quand on le lit, on est pour. Cependant, ce texte met en évidence une hypocrisie. Il présente ce que l'on souhaite et ce que le gouvernement fait. Monsieur Van den Bergh, vous en riez vous-même! Quand je l'ai lu, je me suis dit que j'allais voter pour.
Je ferai quelques considérations sur les différents points. Le premier point de cette résolution entend continuer à accorder la priorité aux clients dans la politique postale, et prêter attention aux consommateurs et aux petites entreprises. On se demande en quoi la suppression des boîtes rouges est une plus-value pour les clients. Comme l'a clairement rappelé la N-VA en commission, la seule véritable obsession du gouvernement est de faire remonter le cours de l'action.
Au point 2, on nous dit de veiller à la qualité des services postaux et de l'améliorer de manière ponctuelle en formulant des objectifs clairs et des obligations de résultat. On rappellera que le contrat de gestion adopté sous ce gouvernement n'exige pas une réduction chiffrée de l'impact environnemental de bpost, mais un maintien à un certain niveau maximum. À titre de comparaison, le contrat de gestion conclu par le ministre Labille imposait une réduction de 35 % des émissions de CO₂.
Au point 3, il est demandé de veiller à ce que les envois relatifs aux événements familiaux soient distribués à temps. On nous demande d'envoyer les lettres à temps. Je me pose aujourd'hui cette question: quels moyens sont-ils accordés aujourd'hui à bpost pour assurer cette mission très spécifique?
Au point 4, on demande de veiller à ce que les prix soient abordables, basés sur les coûts, non discriminatoires et transparents afin que personne ne soit exclu du marché postal. Belle résolution! Une telle demande va directement à l'encontre de ce qui a été voté ici même voici quelques mois. L'IBPT avait écrit noir sur blanc les conséquences de cette loi: "Le prix du timbre va s'envoler. Il sera encore moins contrôlé qu'auparavant et encore moins basé sur les coûts." Pire, le ministre De Croo a soutenu la récente annonce de bpost qui se propose d'augmenter le prix du timbre pour les envois J+1, un service qui jusqu'à présent était fourni à un prix normal.
Au point 5, on propose de faire en sorte qu'un assortiment qualitatif et complet soit proposé à une distance acceptable, également en dehors des heures de bureau. S'agissant de la distance, cette demande n'en est pas une puisque ce sont des exigences qui ont été réaffirmées dans la loi, à nouveau grâce à un ministre socialiste, M. Labille.

For comparison, the management contract concluded by Minister Labille required a 35% reduction in CO2 emissions.
In paragraph 3, it is requested to ensure that shipments relating to family events are distributed on time. We are asked to send the letters on time. I ask myself today this question: what means are given today to bpost to ensure this very specific mission?
It should ensure that prices are affordable, cost-based, non-discriminatory and transparent, so that no one is excluded from the postal market. Very good resolution! Such a request goes directly contrary to what was voted here even here a few months ago. The IBPT had written black on white the consequences of this law: "The price of the stamp will fly away. It will be even less controlled than before and even less cost-based." Worse, Minister De Croo supported the recent announcement by bpost that it proposes to increase the stamp price for J+1 shipments, a service that until now was provided at a normal price.
In point 5, it is proposed to ensure that a qualitative and comprehensive range is offered at an acceptable distance, also outside of office hours. As far as distance is concerned, this requirement is not one, since these are requirements that have been reaffirmed in the law, again thanks to a socialist minister, Mr. by Labille.

Je reconnais là un certain culot de la part de la majorité de faire une telle demande. L'État, à travers ses administrateurs, s'opposera-t-il au plan de suppression des boîtes aux lettres rouges? Monsieur Cheron, vous qui êtes mon voisin en commission, quand on demande à quelqu'un de jouer le rôle qui peut être le sien mais qui ne l'est pas, autant peut être ne rien lui demander ou de vivre d'espoir. Cette demande est peut être creuse et vide de sens mais j'y serai attentif.
Au point 8, il est question de soutenir les fusions prévues de communes en demandant de prévoir une période transitoire suffisamment longue pour les envois postaux eu égard aux modifications de rues et aux changements collectifs d'adresses qu'entraîneront ces fusions.
Il y aura donc des fusions de communes avant la fusion des zones de police et après la fusion des …
J'aborde le point 9. Je vous rassure, monsieur le président, il n'y en a que 13 et comme vous m'avez donné exceptionnellement la parole, je ne ferai pas de commentaire sur les deux derniers points!
Il est demandé d'évaluer l'aide fédérale à la presse écrite et d'examiner la manière dont l'aide aux médias papier peut être organisée avec davantage de neutralité par rapport aux médias et de perspectives d'avenir au profit d'un journalisme de qualité, tout en prêtant attention aux libraires.
Pour information, cette demande a déjà fait l'objet d'une résolution adoptée sous cette législature. Ma question: la majorité estime-t-elle que le gouvernement n'a pas suffisamment donné suite à la première résolution votée ici à la Chambre?

Il est dit d'accorder une attention particulière au dialogue social et de soutenir une approche basée sur la concurrence en termes d'excellence opérationnelle, d'innovation, de prix et de satisfaction de la clientèle et non sur la concurrence en termes de conditions de travail et de poursuivre la lutte, tous ensemble, contre les faux indépendants dans le secteur postal.

La question qui est posée avec cette résolution est la même que celle qui a été soulevée en commission avec le refus de la majorité d'entendre les organisations syndicales.
On est à quelque temps d'un contrat de gestion très important pour une entreprise publique tout aussi importante. On parle beaucoup de la SNCB, mais il faut également un peu parler de bpost.
En commission, nous avons enregistré l'attitude de la majorité qui a refusé d'organiser des auditions, estimant qu'elles n'étaient pas nécessaires – ce qui n'a pas été le cas pour la SNCB – et malgré la grande qualité de la présidence dont nous disposons en commission de l'Infrastructure.
Cela commençait mal, mais dans l'exposé des motifs du texte déposé par la majorité, on parle précisément de privatisation. CQFD. Existe-t-il un rapport entre les deux? J'ai la faiblesse de croire que oui.

Mijnheer de voorzitter, collega's, ik kan bevestigen dat er een heel goed verslag ter beschikking is, dat u allemaal rustig kunt nalezen.
Wij behandelen nu een ander thema, verkeersveiligheid. Verkeersveiligheid blijft hoog op de agenda staan. Met dit voorstel focussen wij op een groep hardleerse verkeerscriminelen die goed de regels kennen, die herhaaldelijk voor politierechters verschijnen en die zich verdiepen in de wetgeving om bepaalde straffen te ontlopen. Een truc die gebruikt wordt, is bijvoorbeeld: het voertuig waarmee de overtreding wordt begaan, bewust inschrijven op andermans naam, bijvoorbeeld die van de echtgenote of de moeder, of op naam van een of ander bedrijf.
In het jongste wetsontwerp inzake verkeersveiligheid dat hier in de plenaire vergadering werd goedgekeurd in maart, werd de kentekenaansprakelijkheid al ingevoerd, ook voor natuurlijke personen. Op die manier werd opnieuw een belangrijke stap ondernomen om de straffeloosheid van bestuurders tegen te gaan.
Maar het gaat niet enkel om het ontlopen van boetes. In onze verkeerswetgeving is ook voorzien in een straf in de vorm van de inbeslagname van een voertuig, de immobilisering of de verbeurdverklaring van een voertuig. Deze mogelijke straf kon echter nauwelijks worden toegepast door de politierechters door de voorwaarden van de wetgeving. Zo'n verbeurdverklaring was bijvoorbeeld enkel mogelijk indien het voertuig waarmee de feiten werden begaan effectief op naam van de overtreder stond op het moment van de veroordeling. Daar knelde net het schoentje. Vaak werden die voertuigen snel op iemands anders naam ingeschreven, of werden zij verkocht tussen de overtreding en de veroordeling.
Om hier iets aan te doen, hebben wij heel lang gezocht naar de beste oplossing. Een logische stap zou zijn de eigendomsvereiste te schrappen. Dit is natuurlijk niet zo evident, zeker als de derde partij, van wie het voertuig nu is, helemaal niets met de zaak te maken heeft.
Na verschillende debatten en hoorzittingen in de commissie voor de Infrastructuur zijn wij tot een voorstel gekomen dat zo werd geamendeerd dat de rechter een immobilisering of een verbeurdverklaring kan uitspreken voor een voertuig waarvan de eigenaar niet de overtreder is maar bewust of systematisch dat voertuig uitleent aan een bestuurder waarvan hij weet dat die geen rijbewijs heeft, een rijverbod heeft, rijdt onder invloed van drugs of alcohol, enzovoort.

With this proposal, we focus on a group of hard-learned road offenders who know the rules well, who repeatedly appear before police judges and who delve into the legislation to escape certain penalties. A trick used is, for example: the vehicle with which the infringement is committed, deliberately register on someone else’s name, for example that of the spouse or mother, or on behalf of a certain company.
In the latest draft law on road safety, which was approved here in the plenary session in March, the mark liability was already introduced, also for natural persons. In this way, another important step was taken to counter the impunity of drivers.
It is not just about avoiding fines. Our traffic legislation also provides for a penalty in the form of seizure of a vehicle, immobilization or declaration of seizure of a vehicle. However, this possible punishment could hardly be applied by the police judges by the conditions of the legislation. Such confiscation was, for example, only possible if the vehicle using which the facts were committed was effectively in the name of the offender at the time of the conviction. There was just the shoe. Often, those vehicles were quickly registered on someone else’s name, or they were sold between the offence and the conviction.
In order to do something about this, we have been looking for the best solution for a long time. A logical step would be to eliminate the ownership requirement. This, of course, is not so obvious, especially if the third party, of whom the vehicle is now, has absolutely nothing to do with the case.
After several debates and hearings in the Infrastructure Committee, we have come to a proposal amended so that the judge can issue an immobilization or a confiscation declaration for a vehicle whose owner is not the infringer but consciously or systematically leases the vehicle to a driver whom he knows does not have a driving license, has a driving ban, drives under the influence of drugs or alcohol, and so on.

In die omstandigheden begaat immers ook de eigenaar van het voertuig een verkeersovertreding. Het is verboden daaraan mee te werken. Vandaar dat we op die manier een belangrijke rol toebedelen aan het openbaar ministerie. Dit laatste zal de rol krijgen om te onderzoeken of de eigenaar al dan niet te goeder trouw handelde. De eigenaar riskeert enkel een verbeurdverklaring indien effectief bewezen kan worden dat hij ervan op de hoogte was dat de bestuurder de regels systematisch aan zijn laars lapte.
Een ander element dat als probleem uit de hoorzitting naar boven kwam, was dat de voorwaarde om een rijverbod van zes maanden te hebben voor een verbeurdverklaring, ruim hoog lag en dit beter naar drie maanden zou worden gebracht. Ook dat aspect nemen we mee in het voorliggende wetsvoorstel.
Uiteindelijk hebben we het wetsvoorstel nog geamendeerd met enkele artikelen ter verbetering van de wegverkeerswet zoals hier in maart goedgekeurd. Er zaten enkele onduidelijkheden in. Ik verwijs bijvoorbeeld naar artikel 4 waarin een aantal verduidelijkingen wordt aangebracht met betrekking tot de termijnen bij het bevel tot betalen. Ik verwijs naar de artikelen 6 en 7 waarin de procedure wordt bepaald voor de bepaling van de kentekenaansprakelijkheid, iets wat in het wetsontwerp niet was meegenomen. Belangrijk ook is dat de herhalingstermijn voor de bestraffing van recidive wordt verduidelijkt. U herinnert zich misschien dat er een aantal weken geleden wat te doen was: een aantal advocaten had een achterpoortje gevonden in de recidiveregeling, omdat er werd gerekend van veroordeling tot veroordeling. Slimme advocaten kunnen die veroordelingen natuurlijk een tijd voor zich uit schuiven, maar daar hebben we een antwoord op gevonden in artikel 2 van het voorliggende wetsvoorstel.
Dit wetsvoorstel kent een lange geschiedenis, voor en achter de schermen. Het was technisch niet altijd heel gemakkelijk, maar we zijn tot een goed compromis gekomen, met dank aan de collega's om daaraan mee te werken. Met dit wetsvoorstel geven we de politierechters opnieuw een goed instrument in handen, namelijk hen raken in hun mobiliteit door eventueel de wagen verbeurd te verklaren.

The latter will be given the role to investigate whether the owner acted in good faith or not. The owner risks a confiscation declaration only if it can be effectively demonstrated that he was aware that the driver systematically laid the rules on his arm.
Another element that emerged as a problem from the hearing was that the condition to have a six-month driving ban for a confiscation declaration was quite high and this would better be brought to three months. This aspect is also included in the present bill.
Finally, we have amended the bill with some articles to improve the road traffic law as approved here in March. There were some uncertainties. For example, I refer to Article 4, which provides a number of clarifications concerning the deadlines attached to the payment order. I refer to Articles 6 and 7, which provide for the procedure for determining the liability of the trademark, which was not included in the draft law. It is also important to clarify the repeat period for the punishment of recidive. You may remember that a few weeks ago there was something to do: some lawyers had found a backdoor in the recidive scheme, because it was counted from conviction to conviction. Smart lawyers can, of course, shift those convictions away from them for a while, but we have found an answer to that in Article 2 of the present bill.
This bill has a long history, before and behind the scenes. Technically it was not always very easy, but we have come to a good compromise, thanks to the colleagues for working on it. We have found a good balance between the right of ownership, which we do not want to touch too hard, and a good approach to road offenders on our roads. A good, appropriate approach to it is very important. We know the stories of people who were repeatedly banned from driving and who continued to drive, whose driving license was withdrawn while they didn’t even have it. For such drivers we cannot be strict enough. With this bill we give the police judges once again a good tool in their hands, namely to hit them in their mobility by possibly declaring the car confiscated.

Mijnheer de voorzitter, mevrouw de minister, collega's, iedereen zal het ermee eens zijn dat we op het vlak van verkeersveiligheid in ons land nog een tandje mogen bijsteken, al hebben verschillende ministers hun verantwoordelijkheid genomen. Zo wordt er op Vlaams niveau heel veel geïnvesteerd in weginfrastructuur. Kruispunten worden conflictvrij gemaakt en zwarte kruispunten worden versneld aangepakt, terwijl ook minder populaire maatregelen worden genomen. Zo werd de maximumsnelheid op gewestwegen teruggebracht naar 70 en werd de rijopleiding hervormd. Toch blijven de ongevallenstatistieken zeer hoog.
We hebben ons doel, een daling van het aantal verkeersdoden, nog lang niet bereikt. Sommige bestuurders blijven de weg onveilig maken, omdat ze het vertikken te leren uit hun fouten. Ze blijven rijden zonder rijbewijs of onder invloed. Een recent fenomeen is dat van de trouwstoeten. Daardoor ontstaan ronduit gevaarlijke verkeerssituaties, omdat de chauffeurs alle rijvakken op een snelweg blokkeren. We moeten daartegen kunnen optreden.
Een harde kern van verkeerscriminelen blijft met het gevoel zitten dat ze de dans te gemakkelijk kunnen ontspringen, bijvoorbeeld omdat ze steevast rondrijden met de wagen van iemand anders. Daar kan de federale wetgever wel iets aan doen. Sinds 2016 is hier in de Kamer een meerderheidsresolutie inzake de aanpak van vluchtmisdrijven gestemd. Daarin werd de regering gevraagd om werk te maken van een aantal kleinere concrete maatregelen waarmee de pakkans verhoogd wordt. Intussen hebben wij de oprichting van een databank van rijbewijzen en de invoering van het alcoholslot goedgekeurd.
Een andere manier om de toenemende verkeerscriminaliteit degelijk aan te pakken, is de uitbreiding van de immobilisering en de verbeurdverklaring, wat met de tekst die ter stemming ligt, wordt voorgesteld. Bij immobilisering wordt het gebruik van het voertuig tijdelijk verhinderd, bijvoorbeeld door het gebruik van een wielklem. Bij verbeurdverklaring verliest de bestuurder het eigendomsrecht van het voertuig waarmee hij het misdrijf heeft gepleegd.

Mr. Speaker, Mrs. Minister, colleagues, everyone will agree that in the field of road safety in our country we can give a tooth, even though several ministers have taken their responsibilities. At the Flemish level, a lot is invested in road infrastructure. Crusades are made conflict-free and black crusades are accelerated, while less popular measures are also taken. For example, the maximum speed on coastal roads was reduced to 70 and the driving training was reformed. Nonetheless, the accident statistics remain very high.
We have not yet achieved our goal of reducing the number of road deaths. Some drivers continue to make the road unsafe because they learn from their mistakes. They continue to drive without a driving license or under influence. A recent phenomenon is that of the wedding shoots. This leads to dangerous traffic situations, as drivers block all the driving lines on a highway. We must be able to act against it.
A hard core of traffic criminals remains with the feeling that they can escape the dance too easily, for example because they are constantly driving around with someone else’s car. The federal legislature can do something about this. Since 2016, a majority resolution on tackling flight crimes has been voted here in the House. In it, the government was asked to work on a number of smaller concrete measures to increase the chances of package. In the meantime, we have approved the establishment of a database of driving licenses and the introduction of the alcohol lock.
Another way to effectively address the increasing traffic crime is to extend the immobilization and the confiscation declaration, which is proposed with the text under vote. In case of immobilization, the use of the vehicle is temporarily prevented, for example by the use of a wheel clamp. In case of confiscation, the driver loses the right of ownership of the vehicle with which he committed the crime.

Het voorliggende wetsvoorstel voorziet in de uitbreiding van die twee maatregelen. Wij hebben er heel lang over gepraat en heel lang naar oplossingen gezocht, omdat onze fractie zich niet kon vinden in het initiële voorstel om de eigendomsvereiste volledig op te heffen. Wij zijn samen met de andere fracties uiteindelijk tot een compromis gekomen, waarbij eigenaars die te goeder trouw hun wagen ter beschikking hebben gesteld, niet het slachtoffer worden van wat de dader heeft uitgespookt, terwijl wij de personen kunnen treffen die te kwader trouw zijn en wetens en willens hun wagen ter beschikking stellen van iemand die niet mag rijden.
Een eigenaar die op de hoogte is van het feit dat de bestuurder geen geldig rijbewijs kan voorleggen of die weet dat de bestuurder onder invloed is, kon al een verkeersboete worden opgelegd, maar de politierechter kon de wagen zelf niet in beslag nemen. Het is nu aan het openbaar ministerie om te onderzoeken of de eigenaar van het voertuig te goeder trouw of te kwader trouw was. Het heeft dan nog altijd de vrijheid al dan niet tot dagvaarding over te gaan. Met andere woorden, het openbaar ministerie krijgt hierin een belangrijke rol.
Voorts zal de verbeurdverklaring voortaan ook mogelijk zijn, zoals de heer Jef Van den Bergh al heeft aangegeven, bij een verval van het recht tot sturen van drie maanden in plaats van zes maanden.
De politierechters zullen dus meer middelen krijgen in verband met de verbeurdverklaring en de immobilisering. Zij krijgen bij het arsenaal om hardleerse verkeersovertreders aan te pakken, waarover zij nu al beschikken, nog meer mogelijkheden.
Wij hopen natuurlijk dat zij die in alle wijsheid zullen gebruiken. Wij hebben daar vertrouwen in. Het is niet in elk geval dat zij de verbeurdverklaring moeten uitspreken, maar wel in de gevallen waarvoor het nodig is.
Ten slotte werd de tekst in commissie geamendeerd om enkele technische reparaties op te nemen in de wet tot verbetering van de verkeersveiligheid. De belangrijkste betroffen de verjaringsregels voor gekruiste recidive. Met de voorgestelde tekst lossen wij het probleem op waarbij tot nu toe een specifieke zware overtreding tot vrijspraak leidde, omdat de verjaring niet goed was geregeld.

The present legislation provides for the extension of these two measures. We have talked about it for a very long time and have been looking for solutions for a very long time because our group could not find itself in the initial proposal to completely abolish the ownership requirement. We, together with the other factions, eventually reached a compromise in which owners who have made their cars available in good faith do not become the victims of what the perpetrator has spotted, while we can hit the persons who are in bad faith and knowingly and willingly make their cars available to someone who is not allowed to drive.
A owner who is aware of the fact that the driver cannot present a valid driving license or who knows that the driver is under influence could already be imposed a traffic fine, but the police judge could not seize the car itself. It is now up to the prosecutor to investigate whether the owner of the vehicle was in good faith or in bad faith. Therefore, it still has the freedom to go to call or not. In other words, the public prosecutor has an important role in this.
Furthermore, as Mr Jef Van den Bergh has already pointed out, the declaration of confiscation will also be possible from now on, in the event of an expiry of the right to send for three months instead of six months.
The police judges will therefore be given more resources in connection with the confiscation declaration and immobilization. They are given with the arsenal to deal with hard-learned traffic offenders, which they already have, even more possibilities.
We hope, of course, that they will use them in all wisdom. We have confidence in that. It is not in any case that they must make the confiscation declaration, but in the cases where it is necessary.
Finally, the text in the committee was amended to include some technical repairs in the law on improving road safety. The main concerned the ageing rules for cross recidive. With the proposed text, we resolve the problem where so far a specific serious infringement resulted in acquittal, because the limitation was not properly arranged.
