The Committee on Economic Affairs examined this draft law at the meeting of 11 October 2006. The draft law aims to adapt the law of 22 April 1958 on the statute of the National Orchestra of Belgium and the law of 19 April 1983 on the establishment of a public institution to the current employment of both institutions.

According to those two laws, the musicians and artists working at those institutions are subject to the language legislation and should be classified in language frameworks. The musicians and artists of both institutions are now attracted by their musical and artistic talents, with neither mother tongue or language knowledge nor nationality taken into account. Therefore, the classification in language frames is obsolete.

Consequently, the bill stipulates that Article 43 of the Laws on the Use of Languages in Administrative Affairs, coordinated on 18 July 1966, no longer applies to the artistic staff of the National Orchestra of Belgium and of the Royal Muntschouwburg.

Hence the confusion with the bills with which I started. It is a draft by Minister Verwilghen.

During the discussion of the bill, colleague Simonne Creyf drew attention to a possible problem resulting from the repeal of article 11 of the law of 22 April 1958, ⁇ ining the statute of the National Orchestra of Belgium. According to colleague Creyf, the abolition of that article could in fact lead to the conclusion that from now on only Belgians can be admitted to the National Orchestra of Belgium. It therefore raised the question of whether Article 11 should not be formulated differently.

The Minister clarified and emphasized that Article 10 of the Constitution only covers public offices, and that musicians and artistic functions are not covered. Article 10 of the Constitution therefore does not constitute any obstacle for the National Orchestra of Belgium to recruit non-Belgians. Both institutions covered by the bill recruit musicians and artists on the basis of their musical and artistic qualities and not on the basis of their language knowledge or nationality.

Finally, Mr. Speaker, colleagues, all articles and the entire bill were unanimously adopted by the committee.

The Flemish Belang cannot agree with the draft law concerning the language cadres at the National Orchestra of Belgium and the Royal Muntschouwburg. The Government does not want to apply Article 43 of the Law on the Use of Languages in Administrative Affairs to the artistic functions, so that they fall out of the language distribution.

We understand, of course, the specific situation of the two institutions, namely the fact that there are quite a few internationally renowned musicians working, who do not have our nationality. However, this does not, in our opinion, exclude the fact that the language framework must apply to employees who have our nationality. It is therefore perfectly defensive that people who do not have the Belgian nationality are kept outside the language distribution. However, people with Belgian nationality who work for a public institution, on the other hand, are always classified in a language group. As a Belgian, one always belongs to a language role. It should not be different for them, too. Therefore, we propose to amend the proposed Article 10 and Article 16 in that sense. In this way, the administrative functions for which the actual linguistic framework applies and the artistic functions for which the holders have Belgian nationality remain net.

Now, in order to give some content to the language framework, one could assume that the work volume, which in the opinions of the VCT is the criterion for determining the distribution size, is determined by the number of artistic functions. In fact, one can assume that the administrative staff, the non-artistic functions, the personal files of the artistic staff members represent. In this way, the distribution of Dutch-Franstaligen within the artistic functions can contribute to the distribution in the language frameworks within the administrative functions. In short, that is why we submitted two amendments.
