Rapporteur Siegfried Bracke

Mr. Speaker, the committee discussed this bill at the meeting of 23 January. This draft law concerns a arrangement by which the Riksdienst für Pensionen is also empowered to collect and collect a contribution of 3,55 % for the financing of the Riksinstitut für Kranken- und Invaliditeitsversicherung. Until today, this was a shared competence of the RVP and the RIZIV. Now that is unified. This is a simplification of regulation. In other words, it is a good thing, because we need simplification. In addition, we will comply with EU Directive 383/2004.

In the committee, we talked about lack of communication, because it is ultimately about thirty thousand people. There was also a discussion about the early implementation of this system. The Minister responded that the communication could indeed be improved and that in the future this communication would be refined.

Important, and that’s why I’m here, is an amendment. A number of members of various political groups have pointed out that this draft creates a problem with border workers. What we now approve allows Belgium to charge a RIZIV and solidarity contribution on pensions paid by other Member States of the European Union to persons covered by the Belgian social security.

People from different groups have pointed out that the purchasing power of border workers is further compromised, because the Dutch government had previously abolished the purchasing power measurement of 33 euros for persons who receive their pension from a Dutch institution but do not live in the Netherlands. For pensioners living in the Netherlands, the purchasing power match was replaced by a tax advantage. Pensioners who do not live in the Netherlands cannot claim this.

The Netherlands was condemned for this discrimination, but has not yet drawn appropriate conclusions. There was an exchange of views on this issue in the committee. The Minister has confirmed the problem and has said that he will once again urge his Dutch colleague to bring this into order.

The draft law was unanimously adopted.

Mr. Speaker, I think that Mr. Bracke’s report gives a very good overview of the discussions in the committee. However, with regard to the KOB (Purchase Power Meeting for Older Taxpayers) and the Dutch problem, I would like to add the following.

As I have already outlined in the committee, I have sent a letter to my Dutch colleague to urge him to some urgency in finding a solution. I will give him this message personally again on occasion.
