According to Article 2 of the Law of 21 November 1989 on the compulsory insurance of liability in respect of motor vehicles, motor vehicles are admitted to traffic on public roads only if the civil liability to which they can give rise is covered by an insurance contract that meets the provisions of this law and whose effects are not suspended.

Only the application for the registration of the vehicle, which is subject to the proof of the vehicle’s insuredness, can verify compliance with this provision. However, until now, cyclomotors were not subject to this registration obligation and therefore easily escaped any verification as to whether or not to subscribe to this insurance.

The PS, by submitting in June 2004 a proposal for a resolution which was attached to the text we are discussing today, wanted to meet four objectives.

1 of 1. Prevention and deterrence of insurance fraud, which can have terrible consequences on the lives of families affected by such dramas.

2 of 2. The fight against road insecurity through speed controls that are equivalent to what exists for cars.

3 of 3. The fight against the debridation of this type of vehicle, which regularly puts young drivers in danger, especially those who do not realize the danger they encounter by driving cyclomotors not designed for this at tips at 80 or even 110 kilometers per hour.

4 of 4. Theft of these vehicles.

Thus, at the PS, like our colleagues reformers, we advocate for the registration of cyclomotors, because we believe that it is a non-negligible tool that can help make our roads safer.

In the hope that you will join these objectives, my group will vote in favour of this resolution.

The number of two-wheel motor vehicles on our roads is constantly increasing. As of 1 August 2006, the fleet of motorcycles covering all motorcycles running at a speed of more than 40 km/h – i.e. all motorcycles and most motorcycles – amounted to 357,764 units. This represents an increase of 4% compared to 2005. The motorcycle fleet grew from 277,000 vehicles in 2000 to 359,000 in 2006. In other words, we see a 25% increase in six years. The motorcycle fleet has tripled between 1980 and 2006.

The increase in the number of two motorized wheels shows the importance of taking these users into account in the road safety policy. We must also give these vehicles a central place in a comprehensive policy to improve mobility.

In terms of mobility, the two motorized wheels constitute an alternative to the problem of saturation on our roads and a major asset in a sustainable mobility perspective. My colleagues and myself have submitted various bills and resolutions to ensure the safety of the two motorized wheels. These include, among other things, the arrangement of the railways, the place of the motorcycle on the road, the use of the corridors reserved for buses and the cycling license.

This resolution proposal is part of this movement of parliamentary initiatives. Our initial proposal was aimed at enhancing the safety of the two motorized wheels, to offer the driving of a cyclomotor from the age of 16 after successful theoretical test, to allow holders of a B car license to drive a motorcycle of 125 cm3 and less than 11 kg/W and to provide for the obligation to register cyclomotors.

by Mr. The Minister has taken a royal decree – probably convinced of the relevance of our proposal – containing measures for both motorized wheels. This royal decree follows the second measure we proposed. I am delighted. In fact, it provides for the possibility for holders of a B license for more than two years of driving, to drive a motorcycle of 125 cm3 and less than 11 kg/W. This proposal, adopted in the Infrastructure Committee, is therefore no longer aimed at but one measure, namely the registration of cyclomotors.

Currently, the lack of registration of these vehicles and the wear of the helmet make it impossible to identify their driver. As a result, various problems arise. For example, in the case of a speed breach, it is not possible to identify the offender. In this regard, we are aware of the existence of trafficked mobile phones. In addition, during a flight, we cannot find the trace of the vehicle. Finally, we cannot control whether the driver is insured or not. This situation leads to a sense of impunity in some.

We believe that the road safety of cyclist drivers also goes through their accountability. The lack of registration of these vehicles is a brake. However, the registration obligation represents real advantages in terms of identification and control. We believe, like the representative associations of motorcyclists, that in the future the driver of a registered motorcycle should also adopt a more responsible behavior. He will become more aware of the importance of his actions.

This registration also has the advantage of combating non-insurance through cross-checks of the files of the DIV and those of insurance companies. A positive impact is also expected at the level of cyclomotor flights that would become less easy. I therefore welcome the adoption of this proposal for a resolution and hope that we can continue to work in this direction.
