Mr. Speaker, Mrs. Minister, colleagues, the present bill relates to the amendment of Article 287ter of the Judicial Code and adheres to the implementation of a protocol concluded with the trade unions. It aims at temporarily suspending the assessment procedure for the staff of the offices and prosecutors of the courts and courts, until the replacement of the entire system.

Why this bill? During the negotiations between the government and the trade unions it became clear that the assessment system as it exists today, in particular a real point system, a special log system that provides little or no added value for the staff members and for the organization of work. That’s why it was agreed to set up a new evaluation system with an emphasis on learning and developing rather than assessing.

What should be done under the new assessment system? The government must, together with the trade unions, set up an evaluation project. For this purpose, the necessary talks began last autumn and are still ongoing today. The obligation to establish an assessment state every two years will now be abolished under the application of this bill. However, there remains one exception. There is still an obligation to draw up an assessment state in four specific cases. I would like to refer to Article 2 of the bill.

By the way, this bill was submitted for opinion to the State Council, which made two comments, which were incorporated into the text. The discussion in the committee did not give rise to significant discussions. Some technical adjustments were made and the correspondence between the Dutch and French texts was also improved in two points. As regards the votes, the draft was approved unanimously in the committee, both articlely and in its entirety. Here is my report, Mr. Speaker.
