The Minister explained the objective of the bill.

The tasks of the FANC are listed in Chapter 3 of the Act of 15 April 1994. This Act initially stipulated that the FANC was financed through one-time and annual fees charged to the establishments, activities, authorised persons and services supervised by the FANC.

As a result of a legislative amendment of 15 May 2007, the provisions of the Royal Decree of 24 August 2001 were implicitly repealed to the extent that they concerned annual pay. The amounts of these fees were fixed in the law for the years up to 2013; for the following years these amounts need to be adjusted. In the period prior to 2016, the amounts are increased by 2 % annually to reflect the rising personnel and operating costs.

In the meantime, it was decided to change the schedule. The nuclear reactors of Goal 1 and Goal 2 will be deactivated on 15 February 2015 and 1 December 2015 respectively; this amendment requires an adaptation of the Act of 15 April 1994. The cessation of electricity production does not imply the immediate termination of all operational activities of the power reactor. The involvement of the FANC in the supervision and control of the power reactor will therefore continue during this phase, requiring an adjustment of the base of charge.

At the same time, the amendments to the FANC Act concerning dosimetric supervision and the transfer of this authority from the FOD WASO to the FANC should also be taken into account.

These new contracts imposing taxes on the FANC require, among other things, increased human resources. This increase of the resources requires an adjustment of the financing of the FANC, in particular an increase in the charges imposed on the sector.

Among other things, Mr. Logghe had questions regarding the late treatment of this draft. The Minister pointed out that the text of the preliminary draft should also be sent to the State Council for advice and that the Council was only recently able to give an opinion on this subject due to the many drafts which he had to deal with at the end of the legislative term.

Eventually, the draft was approved by twelve votes in favour with one abstinence. So far the report.
