Like all the members present, I believe that we must fight terrorism. However, we are sometimes concerned about the price being paid as part of this anti-terrorist struggle. Certain fundamental rights, inherent in a democratic country, sometimes seem to us threatened.
The proposed protocol here brings some improvements to the original text – I mean the refusal of extradition in case of threats of torture or death penalty. We welcome this progress. However, the text takes on a much too broad definition of terrorism in our view, which promotes harmful deviations, as clearly demonstrated by the report of the Committee T, which is responsible for monitoring anti-terrorism laws. This report was presented yesterday and has caused a lot of echoes in the media today.
Therefore, this Protocol does not guarantee fundamental rights. We already do not respect this text, since the government has recently tried to deliver Bahar Kimyongür to Turkey, which continues to practice torture, and several reports have denounced it.
