I refer to the written report.

Denis D'hondt MR

Mr. Speaker, Mr. Minister, Ladies and Gentlemen, the subject of this bill relates to one aspect of the legal position of the police staff and is quite simple: to fill a gap in terms of leave prior to retirement.

It follows from Article 42 of the law of 27 December 2000 concerning various provisions relating to the legal position of police personnel that only members of the statutory staff of the gendarmerie and of the judicial police near the prosecutors who pass into the federal police can, under certain conditions, apply for leave prior to retirement.

When reading this provision, it appears that some people do not fall within the scope of this measure, which was ⁇ not wanted. In particular, these are members of the municipal police staff who, pursuant, inter alia, to Article 247 of the Act organising an integrated two-level police service, have been appointed to a position with a mandate to the federal police.

This bill aims to correct this neglect by inserting in Article 42 of the Law of 27 December 2000 a new paragraph as follows: "The prior retirement leave referred to in the preceding paragraph is also applicable to members of the staff of the municipal police appointed before 1 July 2001 to a mandated position at the federal police".

This proposal was unanimously adopted by the Internal Affairs Committee. I would like to thank my colleagues who voted for it and ask you to do the same today.
