Mr. Speaker, dear colleagues, the bill we are putting to the vote today aims, on the one hand, to solve simply a very concrete problem encountered on our roads by the police services and, on the other hand, to establish legislative coherence, taking into account previous reforms.
Today, crossing the C23 sign by drivers of vehicles intended or used for the transport of goods is a first-degree offence. This means that it is punished with a fine of 58 euros in case of immediate collection, an amount not negligible but apparently insufficient for some road charters. Indeed, it would seem that many prefer to pay the fine and take the risk, for the driver, but also for the local population, of taking inappropriate roads for such vehicles, essentially to save time. By increasing the amount of the fine, therefore, the competitive advantage of committing this type of infringement is eliminated.
This bill is part of the logical sequence of a law passed in the previous legislature for the same reasons, but for panel C21. Therefore, we do here only to ensure the coherence of the criminal system of the road.
Finally, I take advantage of this tribune to remind you that the illegal crossing of the C23 panel is no less serious than that of the C21 panel. These two panels refer to different risks, but the consequences of their non-compliance are no less serious. If the C21 panel refers to risks related to the weight of the vehicle, the C23 panel refers to risks related to the volume of the vehicle, regardless of its load. For example, a C21 panel will be used to prohibit the crossing of a bridge, while instead a C23 panel will be used for a narrow or curved road or even a dangerous descent.
In either case, these behaviors directly endanger the safety of people, as has already been seen in the case of extremely serious accidents. Thus, they should be considered as third-degree offences.
