The present bill relates to the transmission of Directive 2009 of the European Parliament and of the Council of 23 April 2009.
It aims to make mandatory the insurance of the owner of a ship against maritime claims for ships flying the flag of a Member State of the European Union and also for other ships making stops in a port of a Member State of the European Union. Provisions concerning the inspection of insurance documents and also the possibility of expelling an uninsured vessel from European waters could allow victims of damage to benefit from better protection.
These two projects, unanimously approved in the Infrastructure Committee, also include a number of complementary provisions, useful for overseeing the compliance of the directive by ships.
The effective implementation of these rules will not require additional financial or human resources. We are therefore in accordance with the Directive which had to be transposed by 1 January 2010.
