                    Monsieur le président, madame et monsieur les ministres, chers collègues, ce dossier n'est pas d'ordre polémique - contrairement aux sujets débattus pendant les questions d'actualité. Ce thème fait consensus. D'autres suivront cet après-midi. Nous ne sommes donc pas dans le même ton.

La présente proposition de résolution a fait l'objet de beaucoup de convergences au sein de la commission. Nous sommes tous partis d'un constat, qui est celui de la vulnérabilité du secteur du commerce des journaux. Chiffres à l'appui, nous avons observé le déclin constant du nombre de librairies dans notre pays. Ce constat n'est pas neuf. Je dois rappeler que, sous la précédente législature, à l'initiative de notre collègue Mme Vanheste, une proposition de résolution de même nature avait aussi été adoptée à l'unanimité. Ce texte avait débouché sur la mise en place d'une commission "Diffuseurs de presse indépendants", rassemblant les éditeurs, distributeurs et diffuseurs, sous l'égide du SPF Économie. C'est un lieu de dialogue et de concertation avec tous les acteurs concernés, dont les résultats sont plutôt mitigés. Nous pouvons, certes, considérer qu'ils ont abouti à certains accords. Mais, d'un autre côté, nous avons aussi dû constater que s'y déroulaient nombre de discussions assez vaines et que la production concrète en termes d'actions pour le secteur était relativement insuffisante.

Néanmoins, Mme Smaers et d'autres collègues ont eu le mérite de relancer le débat et d'en permettre en définitive une actualisation. Nous sommes bien conscients que la réponse au problème posé n'est pas simple et que personne n'a trouvé de recette miracle. Sinon, je pense que nous l'aurions énoncée. En tout cas, nous avons rouvert la discussion. La commission de l'Économie a débattu de ce sujet au moins à cinq reprises, comprenant une séance d'auditions et une autre d'échanges avec M. Peeters, ministre de l'Économie.

This resolution proposal has been the subject of many convergences within the committee. We’ve all started from a finding, which is that of the vulnerability of the newspaper trade sector. Figures to support, we have observed the constant decline in the number of bookstores in our country. This finding is not new. I must recall that, during the previous legislature, on the initiative of our colleague Mrs Vanheste, a proposal for a resolution of the same nature was also unanimously adopted. This text resulted in the establishment of a commission "Independent Press Broadcasters", bringing together publishers, distributors and broadcasters, under the auspices of SPF Economie. It is a place of dialogue and consultation with all relevant stakeholders, whose results are rather mixed. We can, of course, consider that they have resulted in certain agreements. But, on the other hand, we also had to find that there were many rather futile discussions and that the concrete production in terms of shares for the sector was relatively insufficient.

Nevertheless, Ms. Smaers and other colleagues had the merit of reviving the debate and eventually allowing it to be updated. We are well aware that the answer to the problem is not simple and that no one has found a miracle recipe. Otherwise, I think we would have stated it. In any case, we reopened the discussion. The Economic Committee has discussed this issue at least five times, including one hearing session and another exchange session with Mr. Peeters, Minister of Economy.

                    Cela dit, madame Smaers, quand je vois le texte initial et quand je vois le texte finalement adopté, après avoir été amendé en dernière minute, je me dis qu'on a peut-être un peu déforcé le texte de base dans la mesure où le texte initial défendait clairement et sans détour le rôle social des petits marchands de journaux qui permettent la diffusion d'une presse écrite indépendante, c'est-à-dire, finalement, la presse qui a les moyens d'aller chercher l'information plutôt que de la commenter.

Les amendements ont donc un peu modifié la portée du texte. Nous avons approuvé ce dernier, mais, selon moi, ils en ont réduit l'ambition. Autrement dit, c'est un texte un peu plus mi-figue, mi-raisin, qui veut ménager la chèvre et le chou avec des intentions beaucoup plus larges pour que chacun y trouve son compte, mais aussi trop imprécises pour s'attaquer aux vrais enjeux. Par exemple, dans le texte amendé, la presse en ligne est désormais mise sur un pied d'égalité avec la presse écrite. À vouloir aider tout le monde de la même façon, on n'aide plus personne de manière efficace.

Pourtant, nous le savons et nous l'avons dit, la situation est critique comme l'ont rappelé les auditions que nous avons suivies en commission. Le nombre de librairies continue de diminuer. C'est également le cas pour la presse écrite quotidienne qui doit faire face à la diffusion massive en ligne d'informations parfois approximatives avec des sources dont on peut parfois douter de l'indépendance.

Or, on l'a bien dit, la question des libraires est aussi intimement liée à l'état de santé de la presse. Moins il y a de presse, plus il y a de difficultés. C'est, en tout cas, un des aspects du problème. Il faut donc essayer de voir ce dernier dans sa globalité.

Nous avons eu beaucoup de discussions autour du rôle de la Loterie Nationale. La proposition de résolution met à juste titre en évidence son rôle dans ce dossier. Il faut rappeler que cette institution a pu se développer essentiellement grâce au réseau des petites librairies qui sont réparties dans tout le pays. Et aujourd'hui encore, c'est grâce à elles que la Loterie Nationale réalise l'essentiel d'un chiffre d'affaires en hausse constante.

Ici aussi les intérêts convergent. Face à une offre de jeux de hasard en ligne qui essaie parfois de contourner les législations au détriment de la santé des joueurs, les marchands de journaux permettent une canalisation des jeux dans un cadre qui n'encourage pas les comportements excessifs.

The amendments therefore changed the scope of the text a little. We approved the latter, but, in my opinion, they reduced its ambition. In other words, it is a text a little more half-figue, half-raisin, which wants to feed the goat and the cabbage with much broader intentions so that everyone finds their account, but also too inaccurate to tackle the real issues. For example, in the amended text, the online press is now placed on an equal footing with the written press. If you want to help everyone in the same way, you can no longer help anyone effectively.

Yet, we know it and we have said it, the situation is critical as the hearings we followed in committee reminded us. The number of bookstores continues to decrease. This is also the case for the daily written press, which has to deal with the massive online dissemination of information sometimes approximate with sources whose independence can sometimes be doubted.

However, it has been said that the issue of bookmakers is also closely linked to the state of health of the press. The less there is press, the more difficulties there are. This is, in any case, one aspect of the problem. Therefore, we should try to see this in its entirety.

We have had a lot of discussions about the role of the National Lottery. The draft resolution rightly highlights its role in this matter. It should be remembered that this institution was able to develop mainly thanks to the network of small bookstores that are distributed throughout the country. And even today, it is thanks to them that the National Lottery realizes most of a constantly rising turnover.

Interests also converge. Faced with an online gambling offer that sometimes tries to bypass legislation at the expense of gamblers’ health, newspaper retailers allow for the channeling of games in a framework that does not encourage excessive behavior.

                    Partant de ces constats, on peut s'interroger sur la politique d'investissement de la Loterie Nationale qui tend à privilégier ses activités en ligne au détriment du réseau physique.

En dehors de ce contexte économique, je voudrais rappeler que les marchands de journaux sont encore un des rares lieux où se croisent nos concitoyens quelle que soit leur origine ou leur classe sociale. C'est un élément à ne pas sous-estimer dans une société toujours plus marquée par la division.

En conclusion, le groupe socialiste soutiendra cette proposition de résolution. Malgré le fait que les amendements en déforcent sans doute l'intention initiale, la proposition garde le mérite de porter notre attention sur une situation qui dépasse les enjeux économiques.

L'enjeu principal est en fait que notre société démocratique a besoin d'une presse indépendante forte et relayée par un réseau de distribution aussi large que possible.

M. le ministre Peeters n'est pas là mais le parlement, par cette résolution, formule des recommandations au gouvernement. Nous avons ouvert des pistes et attendons, bien entendu, qu'il les transpose en actions concrètes en faveur des libraires de notre pays. La loi prévoit aussi que nous pourrons en faire une évaluation chaque année. C'est une bonne chose. On ne se reposera pas sur nos lauriers et on reviendra sur la question.

C'est pourquoi nous soutiendrons le texte de la présente résolution.

Based on these findings, one can question the investment policy of the National Lottery that tends to favor its online activities to the detriment of the physical network.

Outside of this economic context, I would like to remind you that newspaper merchants are still one of the few places where our fellow citizens meet, regardless of their background or social class. This is an element not to be underestimated in an increasingly divided society.

In conclusion, the Socialist Group will support this resolution. Despite the fact that the amendments surely reinforce the original intention, the proposal ⁇ ins the merit of focusing our attention on a situation that goes beyond economic challenges.

The main challenge is, in fact, that our democratic society needs a strong independent press, relayed by a broad distribution network as possible.

by Mr. Minister Peeters is not present, but Parliament, by this resolution, makes recommendations to the government. We have opened up paths and we are, of course, waiting for him to translate them into concrete actions for the bookmakers of our country. The law also stipulates that we will be able to make an assessment each year. That is a good thing. We will not rest on our lauriers and return to the matter.

We will therefore support the text of this resolution.

                    Mijnheer de voorzitter, collega’s, de zorgwekkende situatie van de zelfstandige dagbladhandelaars vormde de aanleiding voor de indiening van onderhavig voorstel van resolutie in 2015. Er is een hele evolutie waar te nemen in het dossier op het vlak van aandacht voor en ondersteuning van de dagbladhandelaar.

Eerst was er in de vorige legislatuur de installatie van een commissie Onafhankelijke Dagbladhandel bij de Federale Overheidsdienst Economie. Wij kregen echter heel wat berichten dat er in die commissie toch niet werd gewerkt, zoals men had verhoopt. De situatie voor de dagbladhandelaars is nog verergerd.

In 2010 waren er in ons land nog 3 376 dagbladhandelaars, terwijl hun aantal medio 2016 is teruggevallen tot nog slechts 2 461. Uit de hoorzittingen, die in de commissie werden georganiseerd na de indiening en de behandeling van het voorstel, hebben wij geleerd dat de sector vandaag onder grote druk staat. De sectororganisaties hadden het over de teruglopende verkoop, de zeer kleine marges, waardoor er geen reserves zijn voor nieuwe investeringen, en de werklast, die veel tijd kost. De sector wordt bovendien getroffen door een toenemende concurrentie op heel het traditionele assortiment van pers, tabak en kansspelen, de belangrijkste activiteiten van de dagbladhandelaar.

Met het voorstel van resolutie uit 2015 hebben wij geprobeerd de sector en de problemen waarmee hij wordt geconfronteerd, onder de aandacht te brengen. Op die manier willen wij zuurstof en slagkracht geven aan die sector.

In 2014 is er een overlegorgaan Onafhankelijke Dagbladhandel opgericht bij de FOD Economie. Verschillende actoren, waaronder de dagbladhandelaars, maken er deel van uit, net als uitgevers en distributeurs. Voor de dagbladhandels zijn dat belangrijke partners.

Mr. Speaker, colleagues, the worrying situation of the self-employed newspaper dealers led to the submission of this proposal for a resolution in 2015. There is a whole evolution to be observed in the dossier in terms of attention and support for the newspaper dealer.

First, in the previous legislature there was the installation of a committee Independent Journal Trade at the Federal Public Service Economy. However, we received a lot of reports that there was no work in that committee, as was expected. The situation for newspaper traders has worsened.

In 2010, there were still 3,376 daily newspaper traders in our country, while their number fell to only 2,461 in mid-2016. From the hearings, which were organized in the committee after the submission and consideration of the proposal, we learned that the sector is now under great pressure. The sector organisations talked about the declining sales, the very small margins, which leaves no reserves for new investments, and the workload, which takes a lot of time. The sector is also affected by increasing competition across the entire traditional range of press, tobacco and gambling, the main activities of the daily newspaper dealer.

With the 2015 proposal for a resolution, we tried to bring attention to the sector and the challenges it faces. In this way, we want to give oxygen and impact power to this sector.

In 2014, an independent newspaper trade consultative body was established with the FOD Economie. Various actors, including the newspaper dealers, are part of it, as are publishers and distributors. For newspapers, these are important partners.

                    Uit de hoorzittingen in de commissie is, ten eerste, gebleken dat het overlegorgaan maar beperkte resultaten boekt, omdat de partners in het overlegorgaan geen concrete engagementen opnemen.

Het overleg moet dan ook voort actief worden ondersteund. In het voorstel van resolutie vragen wij ook om het convenant en het huishoudelijk reglement van de commissie te herzien, zodat zij naast een overlegplatform een meer resultaatgerichte commissie wordt, waarin ieder lid duidelijke en resultaatgerichte engagementen opneemt.

Ten tweede, uit de hoorzittingen bleek ook dat er geen gelijk speelveld bestaat voor de bezorging van kranten en tijdschriften. Zoals ook al in onze aanvankelijke tekst aangekaart werd, krijgt bpost federale steun in de vorm van subsidies als dienst van algemeen economisch belang voor de bezorging van dagbladen bij abonnees thuis. Dat ervaren de dagbladhandelaars als oneerlijk. Het is dan ook heel belangrijk dat in het voorstel van resolutie gevraagd wordt om te onderzoeken hoe er een level playing field kan worden gecreëerd voor zowel de thuisbezorging bij de abonnee als de verkoop in de dagbladhandel van de kranten en dagbladen, opdat dagbladhandelaars niet langer meer oneerlijke concurrentie hoeven te ervaren.

Voorts pleiten wij ook voor meer transparantie in de federale steun aan de geschreven pers. Wij vragen om die federale steun aan de media, inclusief nieuwe digitale dragers, te evalueren en daarbij na te gaan hoe de ondersteuning medianeutraler en toekomstgericht kan worden georganiseerd. De dagbladhandel moet inderdaad inzetten op toekomstgerichte activiteiten.

In de hoorzittingen werd ook de vraag behandeld of de commissie voor de verkoop van kansspelen die de dagbladhandelaars krijgen, nog realistisch is. De bedragen zouden volgens de minister bevoegd voor de Nationale Loterij wel als realistisch kunnen worden aangemerkt. De marges voor de dagbladhandelaar werden aangepast, conform een nieuwe beheersovereenkomst met de Nationale Loterij.

Second, the hearings also showed that there is no equal playing field for the delivery of newspapers and magazines. As already mentioned in our initial text, bpost receives federal support in the form of subsidies as a service of general economic interest for the delivery of newspapers to subscribers at home. The newspaper traders see this as unfair. It is therefore very important that the proposal for a resolution asks to examine how to create a level playing field for both the home delivery of the subscriber and the sale in the daily trade of newspapers and newspapers, so that newspaper dealers no longer have to experience unfair competition.

We also call for greater transparency in federal support for the written press. We ask to evaluate that federal support to the media, including new digital carriers, and to examine how support can be organized more media-neutral and future-oriented. The newspaper trade should indeed focus on future-oriented activities.

The hearings also addressed the question of whether the commission for the sale of gambling that the newspaper dealers receive is still realistic. According to the Minister responsible for the National Lottery, the amounts could be considered realistic. The margins for the newspaper dealer were adjusted in accordance with a new management agreement with the National Lottery.

                    Niettemin moet de federale regering oog blijven hebben voor de evolutie van de situatie van dagbladhandels. Zij moet ook de Nationale Loterij daarop blijven wijzen, telkens de situatie van een dagbladhandelaar negatief zou worden beïnvloed.

Tot slot moet na de recente overname van AMP door bpost erop worden toegezien dat de bijna-monopoliepositie in de distributie, die wij ook hebben aangekaart, geen aanleiding zal geven tot machtsmisbruik ten aanzien van de dagbladhandelaars. De Belgische Mededingingsautoriteit, bij wie door de sector klacht werd ingediend, moet in dat dossier een belangrijke rol spelen.

Collega’s, zelfstandige dagbladhandelaars spelen in ons economisch en ook sociaal weefsel, waarnaar onze collega en voorzitter van de commissie voor het Bedrijfsleven ook heeft verwezen, een belangrijke, waardevolle rol. Zij vormen een belangrijk ontmoetingspunt in heel wat dorpskernen. Zij vormen een belangrijke schakel in het pluralisme van de pers. Zij helpen ook mee de verkoop van kansspelen te kanaliseren. Buiten de digitale kanalen blijft het belangrijk dat een breed verkoopnetwerk voor de promotie en toegankelijkheid van kranten, tijdschriften en loterijproducten voor een breed publiek blijft bestaan.

Daarom willen wij voor de sector een belangrijke stap vooruit zetten. Wij zullen inderdaad, zoals door de commissievoorzitter is aangegeven, jaarlijks een gedachtewisseling houden met en een rapportage krijgen van de commissie Onafhankelijke Dagbladhandel, om te evalueren of er met de ondersteuning van de sector van de dagbladhandel nu resultaatgerichte voortgang wordt geboekt.

That is why we want to take an important step forward for the sector. Indeed, as indicated by the Chairman of the Commission, we will conduct an annual exchange of views and receive a report from the Independent Journal Trade Committee to assess whether progress is now achieved with the support of the newspaper trade sector.

I am pleased that after the discussion and the hearings in the committee, our proposal for a resolution was finally unanimously approved.

Over de dagbladsector hebben wij al verschillende keren gedebatteerd in de commissie voor het Bedrijfsleven. Ondanks die uitgebreide debatten in de commissie over de aanhoudende moeilijkheden van de dagbladhandelaars, is het probleem jammer genoeg nog lang niet opgelost.

Het Parlement buigt zich al geruime tijd over de sector van de zelfstandige dagbladhandelaars. Bij de bespreking van mijn vorige voorstel van resolutie inzake de distributie van dagbladen en tijdschriften, in 2013, zijn wij tot de conclusie gekomen dat de sector moest diversifiëren ter compensatie van de verliezen die hij lijdt door de dalende verkoop van kranten en tijdschriften.

De vraag is echter of dat wel haalbaar is. De tabakswaren, die nu verkocht worden in de krantenwinkels, worden duurder, en de consument wordt steeds meer aangestuurd niet meer te roken. Dus ook die verkoop zal stagneren. De kansspelen, die ook door dagbladhandelaars verkocht worden, dreigen een beetje dezelfde weg op te gaan als de kranten en weekbladen. De commissies op kansspelen zijn voor velen niet meer zo hoog als vroeger, door nieuwe contracten. Bovendien is er nu meer concurrentie van onlinekansspelen.

The Parliament has been focusing on the sector of independent newspaper traders for a long time. When discussing my previous draft resolution on the distribution of newspapers and magazines, in 2013, we came to the conclusion that the sector must diversify to compensate for the losses it suffers from the declining sales of newspapers and magazines.

However, the question is whether this is feasible. The tobacco products, now sold in newspaper stores, are becoming more expensive, and the consumer is increasingly instructed to stop smoking. The question arises whether other products can be sold. But not every store has the opportunity and space to sell other products.

Il s'agit de vérifier que la concertation, au sein de la commission des diffuseurs de presse indépendants, peut fonctionner, même si, en trois ans, les choses ont été difficiles et qu'il n'y a pas eu d'avancées majeures. Il faut donc booster cette concertation, peut-être avec des suggestions, pour y parvenir.

Il est donc crucial que le gouvernement prenne cette proposition de résolution au sérieux et s'engage à résoudre les problèmes dans les deux années à venir. Il ne s'agit pas seulement de faciliter la concertation mais d'y prendre une part active et de démontrer des résultats tangibles.

Pour conclure, je voudrais vous dire que les commerces de journaux sont des magasins de quartier par excellence. C'est l'avenir du commerce de détail qui est là derrière et dont on parle maintenant. Il faudra voir comment faire pour d'autres secteurs.

J'espère véritablement, en ce qui me concerne, que la concertation portera également ses fruits et sera une source d'inspiration. Il faut continuer à croire qu'il faut laisser place à la concertation, à la discussion et ne pas avoir recours de suite à l'option réglementaire.

Dans tous les cas, il est clair que nous soutiendrons la proposition. Mais, que les choses soient claires, il ne s'agit pas pour nous de soutenir la promotion des ventes de produits de tabac ou de jeux de hasard au-delà de ce qui est fait. Leaving from margin to other, beyond the logic of maximizing our own profit, is one of the points on which we must focus our attention, centered on people: as cdH, I am ⁇  sensitive to it.

The role of the State is to ensure that the strength ratio is not used to crush the margins of other actors and that the relations between the economic actors are sustainable. This resolution also contains a request made to the government, beyond the report that was mentioned. It is about verifying that the consultation, within the committee of independent press broadcasters, can work, even if, in three years, things have been difficult and there have been no major advances. Therefore, we need to boost this concertation, ⁇  with suggestions, to ⁇  this.

It is therefore crucial that the government takes this resolution proposal seriously and commits to resolving the problems within the next two years. It is not just about facilitating consultation, but about taking an active part and demonstrating tangible results.

To conclude, I would like to tell you that newspaper stores are neighborhood stores by excellence. It’s the future of retail trade that’s behind and that’s what we’re talking about now. We will have to see how to do it for other sectors.

I truly hope, as far as I am concerned, that the consultation will also be fruitful and will be a source of inspiration. We must continue to believe that it is necessary to leave room for consultation, discussion and not to use the regulatory option as a result.

In any case, it is clear that we will support the proposal. But, let things be clear, it is not for us to support the promotion of the sale of tobacco products or gambling beyond what is done. We believe, however, in the ability of press distributors and bookstores to ensure control, more precisely, of the sale of these products, in particular to prevent a number of minors from accessing them. There too, let us recall the social role of bookmakers in this difficult profession of selling newspapers, selling press and other products that can be put on sale to develop their business!

Het vertrekt van een algemene probleemstelling, namelijk dat de tewerkstellingsgraad van mensen met een handicap in ons land reeds jaren zeer laag is, ook in vergelijking met de andere landen in Europa. Dan hebben wij het zowel over de werkloosheid, 28 % van de mensen met een handicap ten opzichte van 9 % van de andere mensen, als over de tewerkstellingsgraad, 40,7 % is de tewerkstellingsgraad voor mensen met een handicap ten opzichte van een gemiddelde in de EU van 47,3 %, in Frankrijk is dat zelfs 52 %, in Zweden zelfs 66 %. Wij lopen daar reeds jaren ver achter.

Een tweede, meer specifiek probleem is dat het streefcijfer van 3 % tewerkstelling voor personen met een handicap in federale overheidsdiensten, dat een van de oplossingen moet zijn om die tewerkstellingsgraad omhoog te krijgen, reeds jaren niet gehaald wordt. Omwille van de stigmatisering durven of willen zij zich niet outen als iemand met een handicap. Op die manier zijn zij niet in de cijfers opgenomen, maar zijn zij wel aan het werk.

Soms zijn er ook fysische factoren, zoals bijvoorbeeld gewoon al de mobiliteit. Heel veel ambtenarendiensten bevinden zich in Brussel. Vooral voor mensen met een fysische beperking die wat verderaf wonen en die in Brussel moeten geraken, is dat een heel groot probleem.

Dat zijn dus een aantal objectief remmende factoren.

Bovendien is er duidelijk ook een doelgroep die beperkingen heeft qua inzetbaarheid en jammer genoeg vaak ook qua scholing.

Ondanks een aantal natrekbare inspanningen van verschillende diensten blijft men dus heel ver van het streefcijfer verwijderd.

Dit wetsontwerp wil daaraan geen totale oplossing geven maar wel een stukje van de oplossing, door voor het streefcijfer van 3 % toe te laten dat door de federale overheidsdiensten een deel wordt uitbesteed. Zij besteden dan werk uit aan maatwerkbedrijven en laten dat meetellen voor het behalen van het streefcijfer.

This bill is not intended to provide a total solution, but rather a piece of the solution, by allowing for the target of 3 % that the federal public services outsource a part. They then spend work on tailor-made companies and let that count for achieving the target.

Hoe zal men dit dan berekenen? Er zijn twee manieren. Ofwel kijkt men naar het aantal uitbestede uren of werkdagen. Ofwel kijkt men naar de financiële waarden van het contract, die men dan omzet naar VTE’s, op basis van de gemiddelde loonkosten van de overheidsdienst die de uitbesteding doet.

Wij hebben in het wetsvoorstel bewust een maximum van 1 % ingeschreven, om te vermijden dat men volledig omschakelt naar het uitbesteden van werk en dat men geen moeite meer doet om mensen met een beperking rechtstreeks bij de federale overheidsdienst te werk te stellen.

Wij hebben dit ook optioneel gemaakt. Het is een bijkomende mogelijkheid, een bijkomend alternatief, om mensen met een beperking aan het werk te krijgen.

Wat is de argumentatie daarvoor? Vele van die uitbestede taken zijn kortlopende en eenvoudige taken, die geschikt zijn voor mensen van niveau D of voor mensen met bepaalde beperkingen. Ik heb reeds gezegd dat die maatwerkbedrijven gespecialiseerde begeleiding, gespecialiseerde begeleiders in huis hebben en de expertise hebben om met die mensen te werken.

Er bestaat ter zake ook Europese en Belgische regelgeving die voorziet in de mogelijkheid bepaalde opdrachten van de overheid bij voorrang of zelfs exclusief uit te besteden aan bedrijven die gespecialiseerd zijn in werken met mensen met een handicap.

Wij zien in de praktijk dat dit systeem bijna niet gebruikt wordt. Slechts 0,02 % van de omzet wordt uitbesteed aan dergelijke bedrijven. Er is dus nood aan sensibilisering en stimulering om dit systeem en deze regelgeving beter te gebruiken.

Deze maatregel werd als doelstelling opgenomen in het regeerakkoord. Wij hebben ook gekeken naar andere landen. Frankrijk is bijvoorbeeld een land dat dit systeem vaak gebruikt. Gelukkig zien wij dat het daar niet leidt tot een vermindering van de rechtstreekse tewerkstelling van mensen met een handicap in overheidsdiensten. Het is duidelijk een en-enverhaal, iets wat wij ook hier willen proberen te bereiken.

We also made this optional. It is an additional opportunity, an additional alternative, to get people with disabilities to work.

What is the argument for this? Many of those outsourced tasks are short-term and simple tasks, suitable for people of level D or for people with certain limitations. I have already said that those tailor-made companies have specialized guidance, specialized guides at home and have the expertise to work with those people.

There are also European and Belgian regulations that provide for the possibility to outsource certain public contracts by priority or even exclusively to companies specialising in working with people with disabilities.

In practice, this system is almost unused. Only 0.02% of the turnover is outsourced to such companies. Therefore, there is a need for awareness and incentives to better use this system and this regulation.

This measure was included as a goal in the government agreement. We also looked at other countries. France, for example, is a country that often uses this system. Fortunately, we see that this does not lead to a reduction in the direct employment of people with disabilities in public services.                     De doelstelling is dus om in concreto, in de praktijk, tot een netto verhoging van de tewerkstelling van mensen met een beperking te komen en die rekening houdt met een nieuwe economische context, ook de context van de ambtenarij en die daar op die manier een moderne oplossing aan wil geven, zij het – ik heb het al gezegd – gedeeltelijk.

Is er dan geen risico dat dit zal leiden tot minder directe tewerkstelling van mensen met een beperking in die overheidsdiensten? Dat risico is er zeker. Dat wil zeggen dat een maatwerkbedrijf mensen met een beperking fysiek binnen de locatie van de overheidsdienst te werk komt stellen.

Op voorstel van mevrouw Fonck van de oppositie werd ook een artikel ingevoegd waarbij elk jaar geëvalueerd wordt hoeveel mensen met een beperking alle overheidsdiensten tewerkstellen aan de ene kant en hoeveel zij al uitbesteden aan maatbedrijven aan de andere kant.

We hebben dus een nulmeting en kunnen dus kijken of die wet de doelstelling haalt om netto tot meer tewerkstelling te komen, zodat het dus geen loutere vervanging wordt.

Dat geeft in een notendop de rationale en modaliteiten van de wet weer. Ik wens hier nog eens uitdrukkelijk alle partijen uit meerderheid en oppositie te danken. Het was een mooi voorbeeld van samenwerking over de partijgrenzen en meerderheid en oppositie heen. Niet alle partijen hebben dit goedgekeurd in de commissie maar de meeste wel, ook van de oppositie. Ik kan alleen hopen dat we ook Ecolo-Groen vandaag nog overtuigd krijgen om dit voorstel mee goed te keuren.

It was a beautiful example of cooperation across party boundaries and across majority and opposition. Not all parties have approved this in the committee but most have, including from the opposition. I can only hope that Ecolo-Groen will be persuaded today to approve this proposal.

                    Monsieur le président, madame la ministre, chers collègues, je pense que M. Spooren a bien résumé l'objectif et les modalités de la proposition de loi qui nous est présentée. Bien entendu, l'intégration des personnes handicapées au travail est un défi pour notre société. C'est un défi pour tous. C'est aussi une obligation internationale mentionnée dans l'article 27 de la Convention des Nations unies sur les droits des personnes handicapées.

Nous pensons que les pouvoirs publics doivent montrer l'exemple. On peut évidemment débattre de la question de l'emploi des personnes handicapées dans le secteur privé. Je pense que notre pays devrait faire plus et mieux aussi dans ce domaine-là. Mais commençons par montrer l'exemple à chaque niveau de pouvoir. Cela a été rappelé: depuis 2007 est en vigueur un quota de 3 % de personnes en situation de handicap employées dans les administrations fédérales. Malheureusement, depuis toutes ces années, nous ne parvenons pas à atteindre ce quota.

Monsieur Spooren, vous avez bien expliqué l'objectif; 1 % sera évalué spécifiquement. Nous avons débattu de tout cela. C'était vraiment une des conditions. Il ne faut pas que ce soit une manière de compter les personnes autrement. Il faut qu'il s'agisse bien, à terme, d'engagements supplémentaires. Nous y serons attentifs.

Vous avez aussi indiqué en commission que ce système fonctionne bien en France. Il est donc positif de le mettre en œuvre chez nous, au niveau fédéral. Cela peut bien entendu aussi être débattu au niveau des Régions. Je crois que cela existe déjà en Région wallonne pour les organismes d'intérêt public.

L'objectif, nous le partageons. Tous les partis le partagent. Des nuances peuvent être faites sur les modalités. Il s'agit finalement d'améliorer à terme la proportion de personnes handicapées dans la fonction publique fédérale. On dit 3 %, mais c'est un minimum. Cela pourrait être plus, en tenant compte des réserves que vous avez évoquées. Certaines personnes ne souhaitent pas se déclarer comme personnes handicapées. Il faut tenir compte de cette liberté.

Seuls les marchés qui seront externalisés à partir de l'entrée en vigueur de la loi seront pris en compte dans le calcul, et pas les anciens contrats. Il ne s'agit pas d'un calcul sur des choses existantes. Il s'agit bien de donner quelque chose de supplémentaire. Cela a été confirmé en commission et cela nous a pleinement rassurés.

En commission, nous avons aussi souligné que cette loi ne dispense pas les pouvoirs publics fédéraux de continuer à être proactifs en la matière. Cette mesure va apporter une plus-value, mais elle ne permettra pour autant peut-être pas d'atteindre le quota. Elle ne nous exempte pas d'autres efforts. Il faut d'autres efforts, il faut d'autres initiatives pour atteindre l'objectif.

The goal, we share it. All parties share it. Nuances can be made on the modes. Ultimately, it is about improving the proportion of persons with disabilities in the federal public service. They say 3% but that’s a minimum. This could be more, taking into account the reservations you mentioned. Some people do not want to declare themselves as disabled people. This freedom must be taken into account.

Only the contracts that will be outsourced from the entry into force of the law will be taken into account in the calculation, and not the old contracts. This is not a calculation on existing things.                     J'ai déjà parlé de l'évaluation séparée. L'évaluation par le Conseil supérieur national des Personnes handicapées nous donnera également des indications sur l'efficience du nouveau mécanisme à l'avenir, dans le temps. Ce n'est pas un objectif en soi, mais un objectif de moyens.

J'en termine avec une petite parenthèse sur l'actualité. Mardi, nous avons entendu la note d'orientation de Mme la secrétaire d'État pour les personnes handicapées. Aujourd'hui a lieu le vote sur cette proposition de loi. Nous avons entendu l'exposé de la secrétaire d'État sur la note d'orientation. Nous avons commencé le débat sans le terminer; il est reporté à la semaine prochaine. Mais nous avons lu que Mme Demir fait de l'intégration et de la mise à l'emploi des personnes handicapées une priorité, ce qui est en soi une bonne chose. Elle nous dit vouloir supprimer les obstacles entravant les personnes en situation de handicap voulant aller vers l'emploi. J'ai donc profité du débat qui n'est pas terminé, vous l'avez entendu monsieur Spooren, pour dire que la revendication majeure du secteur, le premier obstacle, c'est ce que le secteur appelle "le prix du travail". C'est vraiment la revendication du Conseil supérieur et des Personnes handicapées. Cette suppression avait été timidement annoncée en début de législature par Mme Sleurs. Elle allait essayer de faire des efforts pour supprimer, en tout ou en partie, le prix du travail. Finalement, deux ans après, elle est venue nous dire: "J'ai posé la question et on m'a dit non, il n'y a pas d'argent." C'était un peu oublié.

Nous verrons  bien le résultat ici, mais on sait que le fond du problème, monsieur Spooren, est cette loi de 1987. Elle est dépassée et antinomique avec la mise au travail des personnes en situation de handicap, avec son système complexe d'abattements, les plafonds qui sont trop bas, etc.

Mme Demir l'écrit au début de sa note: il n'y a pas de moyens financiers. Elle donne déjà des limites aux efforts qu'elle pourrait essayer de faire. Je vais donc vous demander d'être notre interprète auprès de la secrétaire d'État et au sein de la majorité. Vous connaissez le secteur du handicap, monsieur Spooren, donc vous savez que c'est important. Puissiez-vous être notre interprète pour convaincre les collègues de la majorité qu'il faut travailler à la réforme de cette loi, qui est entièrement dépassée, sur la question du travail comme sur d'autres questions. Il faut le faire. Nous avons une proposition de loi. Nous sommes ouverts au dialogue et nous espérons que l'on avancera, encore durant cette législature, dans ce dossier.

Ms Demir writes it at the beginning of her note: there are no financial means. It already puts limits on the efforts it might try to make. Therefore, I will ask you to be our interpreter with the Secretary of State and within the majority. You know the disability sector, Mr. Spooren, so you know it’s important. Cette proposition n'a pas vocation à apporter une solution définitive, mais a, au moins, le mérite d'apporter une pierre à l'édifice et de marquer un pas dans la bonne direction en offrant davantage de possibilités aux entreprises de travail adapté pour collaborer avec les services publics fédéraux.

Comme cela a déjà été souligné, toutes les opportunités doivent être saisies. C'est dans ce sens que notre groupe soutient ce dossier depuis ses premiers jours, notamment par la voix de notre collègue Stéphanie Thoron, qui est excusée, cosignataire de la proposition.

Ces derniers ne me conduisent absolument pas à revoir les critiques fondamentales du groupe Ecolo-Groen à l'égard de la proposition de loi à l'examen.

Vous dites que le texte apporte une solution moderne permettant aux personnes handicapées de travailler et de travailler au sein de la société. Mais, aujourd'hui, qu'est-ce qu'une solution moderne? Ce n'est pas de revenir au développement des entreprises de travail adapté, aux ateliers protégés d'antan. Pour les personnes handicapées, une solution moderne est une solution qui leur permet de partager les mêmes espaces que les autres dans le cadre de leur travail, de la vie sociale, de la vie culturelle, de la vie quotidienne. C'est leur permettre d'accéder aux lieux où les personnes qui n'ont pas de handicap travaillent. C'est cela qu'elles attendent et c'est cela qui est compris dans la Convention des Nations unies qui fait état d'inclusion des personnes handicapées. En effet, le terme intégration a été abandonné pour être remplacé par le terme inclusion.

Ce que vous nous proposez, ce n'est pas une solution aux problèmes que vous avez bien identifiés qui empêchent effectivement les personnes handicapées de travailler dans le milieu économique privé et dans la fonction publique. Ce que vous amenez, c'est une solution qui n'apporte pas les réponses aux problèmes que vous avez identifiés.

On a décidé de diminuer le nombre de fonctionnaires; ce faisant, on diminue automatiquement le nombre de personnes handicapées susceptibles de travailler en tant que tels. La réponse ne doit pas consister à faire travailler plus de personnes dans les entreprises de travail adapté.

Trop peu de personnes handicapées s'inscrivent aux tests du Selor et parviennent à franchir les différentes étapes. À ce niveau, des solutions doivent également être apportées pour rendre accessibles les épreuves du Selor.

Mardi, Mme Demir a proposé de favoriser des stages permettant les rencontres, de tester les compétences et de franchir ainsi une première étape. Il s'agit là d'une réponse à une difficulté rencontrée pour accéder au travail dans la fonction publique. Ce n'est pas de dire qu'on va les faire travailler ailleurs, dans des endroits spécifiques.

You say that the text brings a modern solution that allows people with disabilities to work and work within the society. But what is a modern solution today? This is not a return to the development of adapted work companies, to the protected workshops of the past. For people with disabilities, a modern solution is a solution that allows them to share the same spaces as others in the context of their work, social life, cultural life, everyday life. This allows them to access places where people who do not have a disability work. This is what they expect and this is what is included in the United Nations Convention that states the inclusion of persons with disabilities. In fact, the term integration was abandoned to be replaced by the term inclusion.

What you offer us is not a solution to the problems that you have well identified that actually prevent disabled people from working in the private economic environment and in the public service. What you bring is a solution that does not bring the answers to the problems you have identified.

The decision was made to reduce the number of civil servants; by doing so, the number of persons with disabilities likely to work as such is automatically reduced. The answer should not be to make more people work in companies with suitable work.

Too few people with disabilities enroll in the Selor tests and manage to pass the different stages. At this level, solutions must also be provided to make the Selor tests accessible.

On Tuesday, Ms. Demir proposed to promote internships allowing meetings, to test skills and thus take a first step. This is a response to a difficulty encountered in accessing work in public service. This does not mean that they are going to work elsewhere, in specific places.

Je trouve cela incroyable que l'on identifie les raisons pour lesquelles on n'arrive pas à rencontrer les objectifs fixés de 3 % de membres de la fonction publique qui souffrent d'un handicap, tout en apportant des solutions qui ne sont pas adéquates pour résoudre les problèmes constatés. Cela ne veut pas dire que nous sommes contre le recours  intensifié à la sous-traitance utilisant les clauses sociales. Évidemment, nous le soutenons. Cependant, cela ne doit pas remplacer une partie de l'obligation d'engagement au sein de la fonction publique.

Les clauses sociales existent déjà maintenant. Nous avons adopté une loi qui émet des critères plus sévères et plus ambitieux notamment pour l'attribution des marchés publics. Il y a là une volonté de renforcer les clauses sociales et environnementales. Cet élément peut jouer en faveur de cette sous-traitance. Il aurait peut-être fallu rendre obligatoires les clauses sociales dans la passation de marchés publics par les organes publics de l'État. Nous aurions augmenté l'utilisation des entreprises de travail adapté et des autres entreprises qui emploient des personnes en difficulté.

À nouveau, il s'agit d'une dynamique complémentaire, différente et parallèle à celles des quotas dans la fonction publique. Et je ne vois pas en quoi développer la sous-traitance va stimuler l'engagement supplémentaire de personnes handicapées au sein de la fonction publique. Le lien ne se fera pas. Si cela fonctionne dans d'autres États qui utilisent plus que nous les clauses sociales, tant mieux. Nous pouvons nous fixer cet objectif, mais il ne doit pas remplacer l'obligation d'engagement.

Le seul élément positif de cette proposition, qui a été rajouté, est l'évaluation après un an par le Conseil supérieur national des Personnes handicapées.

I find it incredible that we identify the reasons why we fail to meet the targets set for 3% of public servants with disabilities, while providing solutions that are not adequate to solve the problems identified. This does not mean that we are against the increased use of social clauses in subcontracts. Of course, we support it. However, this should not replace a part of the obligation to engage in public service.

Social clauses already exist. We have adopted a law that sets stricter and more ambitious criteria, in particular for the award of public procurement. There is a desire to strengthen social and environmental clauses. This element can play in favour of this subcontracting. It might have been necessary to make social clauses mandatory in public procurement by public bodies of the state. We would have increased the use of suitable work companies and other companies that employ people in difficulty.

Again, it is a complementary dynamic, different and parallel to that of quotas in the public service. And I do not see how the development of subcontracting will stimulate the additional engagement of people with disabilities within the public service. The link will not be made. If this works in other states that use more social clauses than we do, the better. We can set ourselves this goal, but it should not replace the obligation of commitment.

The only positive element of this proposal, which has been added, is the evaluation after a year by the National Higher Council of Persons with Disabilities.

Quand on lit leur avis, leurs questions, leurs critiques, on s'aperçoit que leur opinion est conforme à ce que je vous dis en ce moment. Ils se trouvent face à une situation insoluble et à un gouvernement qui avait juré en 2014 qu'il n'imposerait pas le respect des 3 % puisque - comme je l'avais alors indiqué –, la déclaration gouvernementale, en l'occurrence celle de M. Vandeput, prévoyait d'alléger l'obligation de 3 % via le recours pour un tiers à de la sous-traitance en entreprise de travail adapté. Cet organe et les organisations représentatives des personnes handicapées sont donc confrontés à un gouvernement qui avait promis cela et, à présent, à une proposition de loi qui réitère cette promesse. Dès lors, ils ne peuvent que vous soumettre des critiques et des interrogations, puisqu'ils ne sont pas à la manœuvre pour orienter les vrais choix.

Pour toutes ces raisons, notre groupe va s'opposer à votre proposition de loi. En parallèle, il se montrera particulièrement attentif à ce qu'une évaluation ait bien lieu et veillera au respect des quotas par les administrations. Je me rappelle que nous avions travaillé naguère sur ce sujet en commission des Affaires sociales, que nous avions suggéré de contraindre les administrations à engager sur la base de quotas et qu'à défaut, il leur serait impossible de recruter d'autres membres du personnel. Il s'agissait, d'une certaine manière, de les forcer à respecter cette obligation. Il en avait été discuté sous de précédents gouvernements, mais sans que cela fût suivi d'effets. Malheureusement, il faut bien se rendre compte qu'en l'absence de pouvoir contraignant et de services d'accompagnement visant à soutenir les fonctionnaires, les directions des administrations et les travailleurs souffrant d'un handicap, on stagne et on se heurte à un manque d'ambition.

At the same time, it will pay particular attention to the proper conduct of an assessment and ensure that the administrations comply with the quotas. I remember that we had previously worked on this issue in the Social Affairs Committee, that we had suggested forcing the administrations to engage on a quota basis and that otherwise they would not be able to recruit other staff members. It was, in a way, to force them to comply with that obligation. It had been discussed in previous governments, but with no effect. Unfortunately, one must realize that in the absence of binding powers and accompanying services aimed at supporting officials, management officers and disabled workers, one is stagnating and faced with a lack of ambition.

                    Monsieur le président, madame la ministre, chers collègues, tout comme en commission, nous soutiendrons cette proposition puisque toute avancée en matière d'emploi des personnes handicapées dans les services publics fédéraux doit être accueillie favorablement.

Madame Gerkens, par rapport à vos propos, je souligne que le Conseil supérieur national des Personnes handicapées (CSNPH) retient le caractère positif de la mesure qui vise à améliorer l'emploi de façon globale en cherchant d'autres moyens que les recrutements classiques. Le CSNPH a d'ailleurs relevé une série de questionnements et de réflexions que je trouve importants. Il faudra évidemment y répondre et j'y reviendrai.

Je l'ai dit à plusieurs reprises, il peut y avoir des effets pervers. Le meilleur exemple est une administration qui atteindrait le quota des 3 % et qui aurait déjà recours à la sous-traitance dans des entreprises de travail adapté et qui, demain, pourrait intégrer cette sous-traitance dans son quota, sans même devoir justifier d'une diminution du nombre de travailleurs porteurs d'un handicap, qu'elle occupe directement. Cela ne va pas parce que ce type de dispositif ne peut en rien offrir aux autorités publiques l'opportunité de se dédouaner de leurs obligations en la matière. Les pouvoirs publics, plus encore que tous les autres, et singulièrement les SPF, doivent clairement donner l'exemple.

Par rapport à ce risque, j'ai proposé en commission qu'on puisse suivre et évaluer la situation de manière attentive, en refaisant le point rapidement sur les chiffres avec le secteur et avec le Conseil supérieur national des Personnes handicapées pour remettre les choses en place si ces déviances interviennent.

Mr Gerkens, in relation to what you have stated, I would like to point out that the National Higher Council for Persons with Disabilities (CSNPH) notes the positive nature of the measure, which aims to improve employment overall by seeking other ways than conventional recruitment. Furthermore, the CSNPH raised a number of questions and reflections that I find important. Of course, we will have to answer this question, and we will come back.

I have said it many times, there can be some negative effects. The best example is an administration that would reach the 3 per cent quota and that would already have recourse to outsourcing in companies of suitable work and that, tomorrow, could incorporate that outsourcing into its quota, without even having to justify a decrease in the number of disabled workers it directly employs. This is not because this type of arrangement can in no way offer public authorities the opportunity to waive themselves from their obligations in this regard. The public authorities, even more than all others, and especially the SPFs, must clearly set an example.

In relation to this risk, I have proposed in the committee that the situation can be closely monitored and assessed, by quickly reviewing the figures with the sector and with the National Higher Council of Persons with Disabilities to put things in place if these deviations occur.

Je considère que c'est une clé majeure de facilitation à la mise à l'emploi des personnes porteuses d'un handicap.

Nous souhaitons d'autant plus soutenir cette proposition de loi que nos mandataires ont récemment pris une initiative similaire pour les communes bruxelloises. Nous attendons une avancée importante pour l'emploi des personnes handicapées à Bruxelles, où les entreprises de travail adapté occupent déjà quelques 18 000 personnes, dont beaucoup ne sont pas en capacité de trouver un autre emploi.

Nous attendons également beaucoup de cette initiative fédérale. Il serait intéressant de faire, à moyen terme, une évaluation de ce type d'approche et de vérifier si des initiatives complémentaires doivent être prises. Cela ne dispense pas les services publics de poursuivre leurs efforts pour accueillir des personnes handicapées en leur sein.

                    Monsieur le président, il ressort du rapport d'évaluation de la Commission d'accompagnement pour le recrutement de personnes avec un handicap (CARPH) que le taux d'emploi des personnes handicapées a diminué dans les services publics pour la première fois en cinq ans. Ce taux était de 1,45 % en 2014 contre 1,54 % en 2012. C'était déjà très éloigné du quota de 3 % prévu dans l'arrêté royal du 6 octobre 2005.

Les causes de cette diminution sont très claires: les réductions de personnel, le recours accru à la sous-traitance, la diminution des fonctions correspondant à des niveaux de formation inférieurs; en bref, la politique d'austérité de ce gouvernement mène à une diminution du taux d'emploi de ce groupe-cible.

Le PTB se réjouit évidemment de la volonté de ce parlement d'augmenter le taux d'emploi des personnes handicapées, mais on craint que le recours à la sous-traitance ne mène à revoir à la baisse les ambitions en matière d'emploi de ces personnes au sein des services publics. Il aurait été préférable de rechercher des pistes permettant d'augmenter concrètement leur taux d'emploi.

Le PTB propose d'instaurer un quota homogène de 5 % de personnes handicapées dans toutes les administrations ainsi que dans tous les organismes chargés d'une mission publique. En juillet 2016, nous avons introduit une proposition visant cet objectif au parlement de la Région de Bruxelles-Capitale. Pour appliquer ce quota, il faut aussi se donner les moyens nécessaires, ce qui n'est pas possible dans le cadre d'une politique d'austérité.

Pour ces raisons, chers collègues, nous ne pourrons soutenir la proposition en question.

The assessment report of the Accompanying Commission for the Recruitment of Persons with Disabilities (CARPH) shows that the employment rate of persons with disabilities has declined in public services for the first time in five years. This rate was 1.45% in 2014 against 1.54% in 2012. This was already very far from the 3% quota provided for in the royal decree of 6 October 2005.

The reasons for this decrease are very clear: personnel cuts, increased use of subcontracting, the decrease in functions corresponding to lower levels of training; in short, the austerity policy of this government leads to a decrease in the employment rate of this target group.

The PTB clearly welcomes the Parliament’s desire to increase the employment rate of persons with disabilities, but it is concerned that the use of subcontracts will lead to a downward revision of the employment ambitions of these persons in public services. It would have been better to look for ways to actually increase their employment rate.

The PTB proposes to introduce a homogeneous quota of 5% of persons with disabilities in all administrations as well as in all bodies responsible for a public mission. In July 2016, we submitted a proposal aimed at this goal to the Parliament of the Brussels-Capital Region. To apply this quota, we must also give ourselves the necessary resources, which is not possible within the framework of an austerity policy.
