Monsieur le président, chers collègues, la proposition de loi à l'examen n'est pas une bonne proposition car elle renverse complètement la logique de la législation de 1971 concernant le travail du dimanche.
Le fondement de la législation du travail est de protéger les travailleurs et, dans ce cas, de garantir le respect du repos dominical. Il s'agit ici d'un acquis social ou plutôt d'un "conquis" (venant du mot conquête) social.
Aujourd'hui, la majorité de droite plutôt que de limiter et de réglementer les exceptions au repos dominical veut étendre le travail le dimanche en permettant l'ouverture des magasins tous les dimanches dans les centres touristiques et stations balnéaires.
En 2014, la Cour de cassation a rendu un arrêt selon lequel la loi doit être respectée par les entreprises. Autrement dit, les magasins dont question ne peuvent être ouverts que pendant treize dimanches en dehors de la saison touristique. D'où cette proposition de loi qui introduit un changement législatif selon lequel les limitations au repos du dimanche s'appliquent au niveau du travailleur individuel plutôt qu'au niveau de l'entreprise. En conséquence, les grands magasins pourront ouvrir tous les dimanches de l'année via une rotation de personnel, ce qui sape le droit au repos dominical pour de nombreux travailleurs et crée une spirale de concurrence vers le bas avec des conditions de travail de plus en plus mauvaises et une flexibilité orientée profit des entreprises. Mais il est vrai qu'avec cette majorité de droite, on a l'habitude de ce genre de déconstruction des acquis ou "conquis" sociaux de ce pays.
À ce propos, je voudrais citer les représentants des travailleurs qui ont émis un avis négatif au Conseil national du Travail. Je cite un extrait de cet avis: "C'est le mouvement ouvrier qui a imposé le repos du dimanche tout comme l'ensemble de la législation relative au temps de travail. Il ne faut pas sous-estimer l'importance du repos du dimanche, de permettre que, dans une société, l'immense majorité des citoyens puissent passer, au même moment, leur temps libre prévu légalement. Cela contribue au maintien de la cohésion sociale. De même, le caractère collectif du repos du dimanche apporte précisément une pose obligatoire dans la semaine offrant aux travailleurs la possibilité de faire des choses qui ne sont pas possibles d'autres jours, comme rendre visite à la famille, rencontrer des amis, assister à une compétition sportive, etc.

Mr. Speaker, dear colleagues, the bill under consideration is not a good proposal because it completely reverses the logic of the 1971 law on Sunday Work.
The basis of labour legislation is to protect workers and, in this case, to guarantee the observance of Sunday rest. This is a social achievement, or rather a social "conquest" (from the word conquest).
Today, the right-wing majority, rather than limiting and regulating exceptions to Sunday rest, wants to extend work on Sundays by allowing stores to open every Sunday in tourist centers and resorts.
In 2014, the Court of Cassation ruled that the law must be complied with. In other words, the stores in question can only be open for thirteen Sundays outside of the tourist season. Hence this bill that introduces a legislative change according to which the restrictions on Sunday rest apply to the individual worker rather than to the company. As a result, major stores will be able to open every Sunday of the year via staff rotation, undermining the right to Sunday rest for many workers and creating a downward competitive spiral with increasingly poor working conditions and flexibility-oriented profit for companies. But it is true that with this right-wing majority, we are accustomed to this kind of deconstruction of the social acquired or “conquered” of this country.
In this regard, I would like to quote the workers’ representatives who have issued a negative opinion to the National Labour Council. I quote an excerpt from this opinion: “It is the workers’ movement that has imposed Sunday rest as well as the whole legislation on working time. We must not underestimate the importance of Sunday rest, of allowing in a society the vast majority of citizens to spend their legally planned free time at the same time. This contributes to ⁇ ining social cohesion. Similarly, the collective nature of Sunday rest brings precisely a mandatory pose in the week offering workers the opportunity to do things that are not possible other days, such as visiting family, meeting friends, attending a sports competition, etc.

Les organisations syndicales mentionnent encore: "En outre, la proposition de loi en question n'intervient pas à la demande des partenaires sociaux sectoriels concernés. Ni les organisations des employeurs ni les organisations des travailleurs n'ont jamais formulé une telle demande dans une commission paritaire. Les membres représentant les organisations de travailleurs estiment dès lors que l'on ne peut garder aucune demande émanant des secteurs concernés en vue d'adapter le cadre légal et réglementaire."
Vous l'aurez compris, nous voterons contre cette proposition de loi qui entraîne un recul social pour de nombreux travailleurs qui ont de plus en plus de difficultés à trouver un équilibre entre leur travail et leur vie privée et – j'ajoute cela par rapport au débat sur les pensions – que l'on veut faire travailler encore plus longtemps dans leur carrière.

The trade union organizations further mention: “In addition, the bill in question does not intervene at the request of the relevant sectoral social partners. Neither employers’ organizations nor workers’ organizations have ever made such a request in a parity committee. The members representing workers’ organisations therefore consider that no request from the sectors concerned can be retained for the purpose of adapting the legal and regulatory framework.”
You will understand, we will vote against this bill that leads to a social downturn for many workers who are increasingly struggling to find a balance between their work and private life and – I add this in relation to the pension debate – that they want to work even longer in their careers.

Monsieur le président, dans le fond, la proposition de loi dont nous débattons et que nous voterons aujourd'hui, a été, au fil de son parcours, extrêmement remaniée. Sa version originale, celle déposée par les différents collègues, était totalement imbuvable. Et cela parce que, devant une prétendue modification de la législation sur le travail du dimanche qui n'aurait touché que les zones touristiques, elle touchait en fait les articles 13 à 17 de la loi de 1971 sur le travail et, dès lors, le travail dominical dans tous les secteurs. Cela ne concernait donc pas uniquement les zones touristiques.
Le Conseil national du Travail s'était prononcé et s'était positionné sur la proposition de loi initiale. Soyons clairs! Si vous vous étiez obstiné dans la version initiale de la proposition de loi, je ne l'aurais jamais votée puisqu'elle mettait à mal une approche équilibrée de la conciliation vie professionnelle/vie privée.
Vous avez décidé de réduire largement la portée de cette proposition de loi. C'est le moins que l'on puisse dire! Autant il est vrai qu'elle clarifie les choses quant à la manière dont il faut entendre la limitation du nombre de dimanches au niveau des travailleurs et, singulièrement, afin que le comptage se fasse pour chaque travailleur individuel, autant pour le reste, la proposition de loi, telle qu'elle subsiste aujourd'hui, ne vise plus que les zones touristiques et stations balnéaires avec le plafond des trente-neuf dimanches par année civile.

Mr. Speaker, in essence, the bill we are debating and we will vote today, has been, in the course of its course, extremely remodelled. His original version, the one submitted by the various colleagues, was totally unbearable. Compte tenu du fait que cette proposition de loi imbuvable au départ a été largement amputée et remaniée, compte tenu du fait qu'elle ne dépasse pas trente-neuf dimanches par année civile pour chaque travailleur individuel et que, par ailleurs, le Roi aura comme mission de clarifier ce qu'il entend par les stations balnéaires, les stations climatiques et les centres touristiques ainsi que les conditions de reconnaissance, nous voterons positivement ce tout petit reliquat de proposition de loi qui reste par rapport à une proposition initiale qui, elle, était inacceptable.
Le ministre de l'Emploi n'est pas là mais je me permettrai quand même de dire combien on a un souci dans la législation de notre pays. En effet, au niveau de la reconnaissance des centres touristiques, les critères ne sont pas les mêmes selon qu'on se fait reconnaître par le SPF Économie ou par le SPF Emploi. On se retrouve d'ailleurs aujourd'hui avec des zones touristiques qui sont soit reconnues au niveau du SPF Emploi et du SPF Économie, soit qui ne le sont que d'un des deux côtés, le plus souvent au niveau du SPF Économie. Je pense qu'il y aurait un travail sérieux à faire en matière de révision de la législation pour qu'on évite demain, lors de nouvelles demandes ou lors d'installations de nouveaux commerces, des situations ubuesques où un magasin peut ouvrir mais où, en même temps, il n'y a aucun membre du personnel qui peut y travailler, ce qui est évidemment un non-sens en matière de législation.

Given that this draft law was initially largely amputed and remodelled, given that it does not exceed thirty-nine Sundays per calendar year for each individual worker, and that, in addition, the King will have the task of clarifying what he meant by resorts, climatic stations and tourist centers as well as the conditions of recognition, we will vote positively for this very small remnant of the draft law which remains in relation to an initial proposal which, in itself, was unacceptable.
The Minister of Employment is not there, but I will allow myself to say how much we have a concern in the legislation of our country. Indeed, at the level of recognition of tourist centres, the criteria are not the same depending on whether one is recognized by the SPF Economy or by the SPF Employment. We find ourselves today with tourist areas that are either recognized at the level of SPF Employment and SPF Economy, or that are only recognized on one side, most often at the level of SPF Economy. I think there would be a serious work to be done in the revision of the legislation so that we avoid tomorrow, when new requests or when installing new shops, unnecessary situations where a store can open but, at the same time, there is no staff member who can work there, which is obviously a nonsense in matters of legislation.
