Monsieur le président, cette proposition de loi a pour but d'instituer un statut, essentiellement sur le plan civil, des accueillants familiaux en leur permettant d'exercer certains attributs de l'autorité parentale. Ces personnes qui sont amenées, pour diverses raisons, à accueillir un enfant dans leur famille bénéficient désormais d'un cadre légal un peu plus clair. Néanmoins, lorsqu'il est octroyé des droits aux accueillants familiaux, il va de soi que cela ne peut s'opérer au détriment des parents d'origine.
Il convient donc de trouver un équilibre entre les deux parties, tout en gardant évidemment à l'esprit l'intérêt de l'enfant, qui doit primer. En l'occurrence, cet objectif n'est pas complètement atteint. La proposition manque en effet de précisions quant à l'emploi de certains termes, ce qui, dès lors, ne permet pas d'encadrer suffisamment les droits octroyés aux accueillants. De même, des notions essentielles restent floues. Nous l'avions signalé en commission, madame Van Vaerenbergh, au moment où nous parlions de "décisions quotidiennes" que prendront désormais les accueillants familiaux. Cette notion n'a pas trouvé de définition, tout comme celle de "droit de séjour" qu'exerceront ces derniers. Il appartiendra à la jurisprudence de déterminer plus précisément ce que recouvrent ces concepts.
En outre, le texte n'explicite pas les devoirs que les accueillants familiaux devront assumer dès lors qu'ils bénéficient de droits à l'égard de l'enfant. La proposition de loi instaure aussi une situation qui est susceptible de déclencher chez l'enfant un conflit de loyauté entre les deux familles.

Mr. Speaker, this proposal aims to establish a civil status for family hosts by allowing them to exercise certain attributes of parental authority. Those who are forced, for various reasons, to welcome a child into their families now benefit from a slightly clearer legal framework. Nevertheless, when rights are granted to family hosts, it is obvious that this cannot be done at the expense of the original parents.

Furthermore, the text does not explain the duties that family hosts will have to assume as they enjoy rights with respect to the child. The proposal also establishes a situation that is likely to trigger a conflict of loyalty between the two families in the child.

En commission, nous avons déposé des amendements qui répondaient à ces préoccupations, mais ils ont malheureusement été balayés d'un revers de la main sans que le moindre débat ne soit mené. De la même façon, alors que plusieurs acteurs de terrain - notamment des Communautés dont les compétences intéressent la proposition de loi -, ont manifesté leur souhait d'être associés à la réflexion, cela n'a pas été rendu possible.
Toute une série de questions restent par ailleurs en suspens. Quand on délègue une partie de l'autorité parentale et qu'on octroie certains droits à des acteurs comme les accueillants familiaux, il n'est pas normal que les parents d'origine demeurent entièrement présumés responsables de leurs enfants. Cette question essentielle va de pair avec le statut des accueillants familiaux. Il est regrettable que la majorité n'ait pas voulu prendre la peine de la régler.
C'est le cas aussi de questions relatives aux procédures du contentieux de l'autorité parentale. Elles n'ont pas trouvé de réponse claire. Alors que de l'aveu même de certains professionnels du secteur de l'accueil familial, la question du statut civil n'était pas prioritaire, on peut regretter que peu d'initiatives soient prises par le gouvernement afin de permettre aux accueillants familiaux de bénéficier, pour l'enfant qu'ils accueillent, d'une série de congés spécifiques ou de certains avantages fiscaux dont ils bénéficient pour leurs propres enfants. Ce sont pourtant des aspects qui impactent la vie des accueillants et dont la majorité ferait bien de se saisir. On m'a dit que ce serait le cas, mais c'est dommage de ne pas l'avoir fait dans le cadre de ce qui nous occupe aujourd'hui.
Si, en vertu du droit international, l'éloignement d'un enfant ne peut intervenir qu'en dernier recours et que cette mesure doit être la plus temporaire possible, certaines circonstances justifient que l'enfant soit éloigné de sa famille pour grandir dans un univers serein et épanouissant. Il est regrettable encore que la majorité ne s'attaque pas davantage à la fragilisation économique et sociale des familles pouvant parfois être à l'origine d'un placement.

In committees, we submitted amendments that responded to these concerns, but unfortunately they were swept away from the back of the hand without any debate being conducted. A number of questions are still pending. When a part of parental authority is delegated and certain rights are granted to actors such as family hosts, it is not normal that the parents of origin remain fully presumed responsible for their children. This essential question goes hand in hand with the status of family hosts. It is regrettable that the majority did not want to take the effort to settle it.
This also applies to matters relating to the proceedings of the dispute of parental authority. They did not find a clear answer. While the issue of civil status was not a priority, it is regrettable that few initiatives are taken by the government to allow family hosts to benefit, for the child they are hosting, from a series of specific holidays or certain tax benefits that they enjoy for their own children. These are, however, aspects that impact the lives of the hosts and of which the majority would do well to grasp. I was told that this would be the case, but it is a shame that we did not do it in the context of what we are currently dealing with.
If, under international law, the removal of a child can only be taken as a last resort and this measure must be as temporary as possible, certain circumstances justify the removal of the child from his family in order to grow up in a peaceful and fulfilling universe. It is also regrettable that the majority does not address the economic and social weakness of families, which can sometimes be the source of an investment.

Mijnheer de voorzitter, beste collega’s, wij mogen vandaag zeer tevreden zijn dat wij uiteindelijk, nadat er tientallen jaren over gesproken werd, pleegzorgers een statuut kunnen geven dat hun rechten en plichten regelt zonder afbreuk te doen aan de belangen van de andere betrokkenen. Het statuut is enorm belangrijk, omdat we de onzekerheid wegnemen die potentiële pleegzorgers er nog steeds van weerhoudt om zorg op zich te nemen voor kinderen die tijdelijk niet in het eigen gezin of zelfstandig kunnen wonen. Voor veel pleegkinderen en pleeggasten is dat een goede oplossing, omdat ze in een pleeggezin de geborgenheid, de warmte en de structuur vinden die ze nodig hebben voor hun ontwikkeling.
Pleegzorg is de voorbije jaren enorm toegenomen. Zo leven op dit ogenblik in Vlaanderen alleen al 5 616 kinderen, jongeren of volwassenen met een beperking in een pleeggezin. Desondanks kunnen we nog steeds twee op drie vragen om een pleeggezin niet positief beantwoorden, omdat er nog steeds een tekort is aan pleeggezinnen. Jaarlijks komen zo nog ongeveer vijfhonderd kinderen of jongeren niet in een pleeggezin terecht. Wij hopen dat het statuut kandidaat-pleegouders alsnog over de brug haalt om die taak op zich te nemen.
Bovendien hebben pleegzorgers vandaag, ondanks het feit dat zij al een hele tijd voor een kind zorgen, geen inspraak in beslissingen, wat vaak tot praktische problemen leidt. Vaak is het wel raadzaam dat pleegzorgers bepaalde beslissingen kunnen nemen.
Zoals gezegd, spreekt men al tientallen jaren over het statuut. Ook in deze legislatuur hebben wij met onderhavig wetsvoorstel al een hele weg afgelegd. We hebben het ingediend in 2014; we hebben hoorzittingen gehouden in het Parlement; we hebben adviezen ingewonnen; we hebben een eerste lezing gehouden; we hebben het advies van de Raad van State ingewonnen en er is overleg geweest met de Gemeenschappen. Dat was nodig, omdat pleegzorg voor het grootste deel tot de bevoegdheden van de Gemeenschappen behoort. Enkel het statuut behoort nog tot de bevoegdheid van het federale niveau. Bovendien is het wetsvoorstel in lijn met de rechtspraak van het Europees Hof voor de Rechten van de Mens en met de aanbevelingen van de Raad van Europa.
Ik meen dus dat wij zeer grondig te werk zijn gegaan en dat wij uiteindelijk tot een zeer evenwichtig geheel zijn gekomen dat rekening houdt met de belangen van alle betrokken actoren, zowel de pleegzorgers als de natuurlijke ouders en de pleegkinderen.

Mr. Speaker, dear colleagues, we can be very pleased today that, after decades of talking about it, we can finally give caregivers a statute that governs their rights and duties without prejudice to the interests of other stakeholders. The statute is extremely important as we remove the uncertainty that still prevents potential caregivers from taking care of children who are temporarily unable to live with their own family or independently. For many nursing children and nursing guests, this is a good solution because in a nursing family they find the security, warmth and structure they need for their development.
Nursing has increased greatly in recent years. Currently, 5,616 children, young people or adults with disabilities live in foster homes in Flanders. Nevertheless, we still cannot answer two out of three questions about a foster family positively, as there is still a shortage of foster families. Approximately 500 children or young people are not in a foster family every year. We hope that the statute will still take candidate-pleegoders over the bridge to take on that task.
Moreover, today, because caregivers have cared for a child for a long time, they do not participate in decisions, which often leads to practical difficulties. Often it is advisable that caregivers make certain decisions.
As I said, we have been talking about the statute for decades. We have already gone a long way with this legislative proposal. We submitted it in 2014; we held hearings in Parliament; we obtained opinions; we held a first reading; we obtained the opinion of the Council of State and there was consultation with the Communities. This was necessary because nursing is largely within the competence of the Communities. The statute remains to the federal level. Furthermore, the bill is in line with the case-law of the European Court of Human Rights and with the recommendations of the Council of Europe.
Therefore, I think that we have worked very carefully and that in the end we have come to a very balanced whole that takes into account the interests of all stakeholders involved, both caregivers, natural parents and caregivers.

Wat verandert er concreet door het wetsvoorstel?
Ten eerste zullen pleegouders vanaf de eerste dag dagelijkse beslissingen kunnen nemen en dringende en noodzakelijke beslissingen kunnen uitvoeren, bijvoorbeeld over de haarsnit van het kind, het slapen bij een kameraadje of een dringende medische operatie. Pleegzorgers zullen daarover zelf kunnen beslissen. Dat lijkt een evidente zaak.
Ten tweede zullen zij vanaf dag 1 ook overeenkomsten kunnen maken met de ouders om meer bevoegdheden te kunnen uitoefenen, bijvoorbeeld inzake de schoolkeuze of de godsdienst van een kind. Indien zij niet overeenkomen, kunnen zij zich tot de rechter wenden, nadat zij een jaar voor het pleegkind hebben gezorgd en de rechtbank zal dan oordelen, steeds in het belang van het kind.
Wij hebben in het Parlement lang gediscussieerd over de bevoegde rechtbank. Uiteindelijk zijn wij tot een compromis gekomen en hebben wij ervoor gekozen om de familierechter bevoegd te maken, omdat die de natuurlijke rechter is om te oordelen over het ouderlijk gezag. Indien de jeugdrechter om jeugdbeschermingsmaatregelen wordt gevraagd, zal hij oordelen.
Tot slot verandert er nog één belangrijk punt met onderhavig wetsvoorstel: er ontstaat een recht op persoonlijk contact wanneer pleegzorgers gedurende een jaar voor een pleegkind hebben gezorgd, zodat het contact met het pleegkind niet abrupt wordt verbroken wanneer de pleegzorg eindigt.
Die zeer belangrijke punten kunnen echt een verandering brengen in het leven van pleegkinderen, pleegzorgers en natuurlijke ouders. We hebben een stap vooruit gezet. Ons werk is inderdaad nog niet af, mevrouw Özen. Wij moeten bijvoorbeeld zorgen voor de invoering van een pleegzorgverlof voor ouders, zodat pleegouderschap nog aantrekkelijker wordt. Alleszins betekent het een stap in de goede richting.
Ik wil iedereen van de meerderheid bedanken voor de constructieve samenwerking met betrekking tot het wetsvoorstel. Dat geldt ook voor alle oppositiepartijen die het wetsvoorstel straks zullen steunen.

What will change specifically with the bill?
First, from the first day, plea parents will be able to make daily decisions and make urgent and necessary decisions, for example, about the child’s haircut, sleeping with a comrade or an urgent medical surgery. The caregivers will be able to decide for themselves. This seems to be an obvious thing.
Secondly, starting from day 1, they will also be able to make agreements with parents to exercise more powers, for example with regard to the choice of school or the religion of a child. If they do not agree, they can turn to the court after having cared for the adoptive child for one year and the court will then judge, always in the best interests of the child.
We have long debated in Parliament about the competent court. In the end, we reached a compromise and chose to give jurisdiction to the family court, as it is the natural judge to judge on parental responsibility. If the juvenile judge is asked for youth protection measures, he will judge.
Finally, another important point changes with this bill: a right to personal contact arises when foster care providers have cared for a foster child for one year, so that the contact with the foster child is not abruptly interrupted when the foster care ends.
Those very important points can really bring a change in the lives of foster children, foster caregivers and natural parents. We have taken a step forward. Our work is not yet completed, Mrs. Özen. For example, we need to provide for the introduction of parental leave for parents to make parental care even more attractive. Alleszins means a step in the right direction.
I would like to thank everyone from the majority for the constructive cooperation with regard to the bill. This also applies to all opposition parties who will later support the bill.

Monsieur le président, monsieur le ministre, chers collègues, voici un dossier qui aura pris le temps de mûrir depuis sa première discussion puisque celle-ci remonte au mois de mars 2015. Le statut des accueillants familiaux est un sujet délicat qui méritait qu'on réfléchisse posément aux préoccupations des acteurs, associations et entités concernés. Un juste équilibre devait être trouvé entre l'intérêt de l'enfant, l'intérêt des familles d'origine et ceux des accueillants familiaux dans le cadre d'un placement.
Comment permettre aux parents d'accueil d'encadrer plus facilement les enfants intégrés chez eux, de faire en sortie que cette intégration dans la famille, qui a déjà son propre mode de vie, puisse se faire tout en garantissant aux parents d'origine la place qui doit rester la leur? Cet équilibre, je pense que nous l'avons trouvé.
Il a été rappelé qu'il fallait également jouer avec les compétences de l'État fédéral et des Communautés.
Je voudrais revenir sur un point en particulier. Un amendement a été déposé et il introduit l'idée que, préalablement au placement en famille d'accueil, un dialogue doit avoir lieu pour qu'un accord soit trouvé entre les parents d'origine et la famille d'accueil pour déterminer la manière dont les parents exerceront leur droit aux relations personnelles avec leur enfant durant le placement. Il est évidemment essentiel que l'enfant garde ce lien et ce dialogue avec sa famille, qu'il est censé réintégrer un jour.
La loi que nous allons voter tout à l'heure prévoit que le dialogue doit se faire obligatoirement, et ce à l'intervention de l'organe compétent en matière d'accueil familial. Afin d'atténuer le caractère inégalitaire de ce dialogue entre personnes n'ayant pas nécessairement le même niveau socioculturel et financier - je pense ici au placement dû à la grande pauvreté -, ATD Quart Monde a attiré notre attention sur le fait qu'il était essentiel que les parents soient épaulés par une personne de confiance. Le fait de déterminer comment le dialogue se fera concrètement et la manière dont les parents d'origine seront épaulés sont des compétences des Communautés. Cela doit encore être concrétisé mais je ne doute pas qu'elles seront réceptives à ces préoccupations légitimes et que la concrétisation se fera de la manière la plus adéquate.
Le maintien du contact entre les parents d'origine et leur enfant, selon leurs souhaits réels et leurs possibilités concrètes, est donc un élément essentiel qui garantira que le lien parental ne sera pas rompu.
Le groupe MR se réjouit que cette proposition de loi donne enfin un statut clair aux accueillants familiaux, qui facilite la gestion quotidienne de la vie familiale des accueillants familiaux ou, devrait-on dire, de la famille accueillante. Nous espérons que ce statut appellera d'autres vocations.

In order to mitigate the unequal character of this dialogue between people who do not necessarily have the same socio-cultural and financial level – I mean here the placement due to great poverty – ATD Quart Monde drew our attention to the fact that it was essential that parents be shouldered by a person of trust. Determining how the dialogue will actually take place and how the parents of origin will be supported are competences of the Communities. This still needs to be realised, but I have no doubt that they will be receptive to these legitimate concerns and that the realisation will be done in the most appropriate way.
Maintaining the contact between the parents of origin and their child, according to their real wishes and their concrete possibilities, is therefore an essential element that will ensure that the parental bond will not be broken.
The MR group is pleased that this bill finally gives a clear status to family hosts, which facilitates the daily management of family life of family hosts or, should we say, of the host family. We hope that this status will call for other vocations.

Ik wil namens onze fractie meegeven dat wij het een zeer evenwichtig voorstel vinden, dat rechtszekerheid creëert voor zowel de ouders, de pleegzorgers als voor het kind zelf. Het statuut voor de pleegzorg is een goede zaak. Hierdoor worden een aantal onduidelijkheden weggewerkt. Wij hopen zo meer kandidaat-pleegouders over de streep te trekken.
Wij doen een oproep aan alle betrokken instanties om iedereen goed te informeren over de nieuwe wettelijke bepalingen en om vooral te werken aan een regeling op maat, die ten goede komt aan de kinderen die in een pleeggezin worden opgevangen.

Mijnheer de voorzitter, mijnheer de minister, collega’s, idealerwijs zouden wij het voorstel niet goed hoeven te keuren. Daarmee wil ik geen afbreuk doen aan het werk dat werd geleverd door de collega’s om te komen tot onderhavige tekst. Ik bedoel hiermee dat er idealerwijs geen kinderen zouden mogen zijn wier zorg thuis niet kan worden gegarandeerd. Jammer genoeg bevinden jongeren zich soms in een moeilijke opvoedingssituatie. Op dat moment moet er worden gezocht naar opvang elders. Gelukkig zijn er heel vaak zorgouders bereid om die kinderen op te vangen.
Als ik goed ben ingelicht, is dat geen uitzondering. Jammer genoeg gaat het in ons land over gemiddeld zowat vijfduizend kinderen. Dat is een aanzienlijk getal. Het is absoluut geen gemakkelijke opdracht voor zorgouders om, al dan niet in samenspraak met de natuurlijke ouders, te zorgen voor een goede omkadering van jongeren die vaak uit een zeer moeilijke situatie komen.
Er is dan ook terecht gezocht naar een statuut, zodat meer zekerheid kan worden geboden aan wie voor die niet altijd gemakkelijke opdracht staat. Die vraag bestaat al lang en is absoluut niet in dovemansoren gevallen, ook niet bij onze fractie.

Ik hoor collega Özen net zeggen dat de definitie die wij vandaag voorleggen en die meer rechtszekerheid zou moeten brengen, absoluut niet duidelijk zou zijn, wat voor haar fractie de reden is om zich te onthouden of zelfs tegen te stemmen. Dat heeft mij wel wat verwonderd, want in een eerste beweging is getracht om echt een zeer strikte definitie op te stellen, met enerzijds het recht op materiële bewaring en, anderzijds, het recht op de juridische bewaring. De materiële bewaring komt onmiddellijk bij de zorgouders terecht, de juridische bewaring gaat na verloop van tijd, als er niet onmiddellijk zicht is op een terugkeer naar het natuurlijk gezin, geleidelijk van de natuurlijke ouders naar de zorgouders. Dat was een moeilijke oefening, want wanneer men zich casuïstisch een aantal voorbeelden voor de geest haalt, blijkt dat het niet zo eenvoudig is om een strikte definitie op te stellen die in alle omstandigheden toepasbaar is. De Raad van State oordeelde ook om dat niet te doen en dus zijn wij wijselijk teruggekeerd naar de situatie die wij kennen, waarbij natuurlijke ouders niet meer samenleven maar wel gezamenlijk het ouderlijk gezag uitoefenen.
Wat de inhoud van het voorliggend wetsvoorstel betreft, kan ik mij aansluiten bij de uitstekende uiteenzetting die door de collega al is gegeven. Het is bijna zoals thuis dat wij het hebben willen regelen. Wij hopen dat in vele gevallen de zorgkinderen heel vaak en hopelijk zo snel mogelijk kunnen terugkeren naar dat milieu, dat er een contact kan blijven met ouders die toch geruime tijd voor hen hebben gezorgd, dat iedereen weet waar zich aan te houden en dat het leven voor degenen die uit een moeilijke situatie komen, dankzij de nieuwe wettekst toch wat makkelijker wordt. That was a difficult exercise, because when one takes a number of examples for the mind casuistically, it turns out that it is not so easy to draw up a strict definition that is applicable in all circumstances. The State Council also decided not to do so, and so we have wisely returned to the situation we know, where natural parents no longer live together but jointly exercise parental authority.
As regards the content of the present bill, I can agree with the excellent explanation already given by the colleague. It is almost like at home that we have wanted to arrange. We hope that in many cases the caregivers can very often and hopefully as soon as possible return to that environment, that there can be a contact with parents who have cared for them for a while, that everyone knows what to stick to and that the life for those who come out of a difficult situation, thanks to the new legislation, however, becomes a little easier. That is our contribution.

Il a bien travaillé vis-à-vis des membres du parti Ecolo-Groen, de manière à ce que nous puissions suivre et réfléchir ensemble à propos de ce dossier.

Je sais que cette échéance préoccupe certaines associations, particulièrement les travailleurs sociaux qui oeuvrent aux côtés des familles les plus fragiles, les plus pauvres, celles qui ont la plus faible capacité de se faire entendre ou d'assumer leur rôle. Nous devons garder cette question ouverte. Je suis incapable - je pense que nous le sommes tous - de dire si un an est une période trop courte, si une période de trois ans est préférable, trop courte ou trop longue au vu des situations vécues sur le terrain.
J'espère que les effets de cette loi, son application et le ressenti des familles pourront être régulièrement évalués. Si l'accompagnement des familles est correctement effectué, cette question ne devrait pas se poser.

Quand on sait qu'une partie du succès de cette loi dépend de la qualité de l'accompagnement, qui ressortit à la compétence d'un autre niveau de pouvoir, il est difficile d'avoir des certitudes ou des exigences au niveau fédéral. D'où la nécessité de travailler ensemble dans les mois à venir.
Nous allons donc soutenir cette loi et tenter d'évaluer au mieux son exécution.
Cela dit, je ne peux m'empêcher de faire ici le lien avec la nécessité de lutter contre la pauvreté, de lutter contre la fragilisation socio-économique de toute une série de familles.
Il est clair que cet aspect ne figure pas dans la proposition de loi à l'examen. Il n'en reste pas moins que, si on participe à la dégradation des conditions de vie des familles les plus faibles, certaines d'entre elles se retrouveront dans l'impossibilité d'assumer leur rôle. Des mesures fiscales, des mesures relatives aux disponibilités en termes de temps et de congés doivent donc aussi être prises pour aider ces familles à remplir leur rôle au quotidien.
J'espère donc que ce gouvernement acceptera de compléter ce dispositif par des politiques sociales et d'emploi évidemment beaucoup plus vastes.
Enfin, j'ai beaucoup interrogé les acteurs du secteur que je connais puisque, dans une vie antérieure, j'ai eu l'occasion de fréquenter les familles d'accueil. Les travailleurs du secteur du placement familial m'ont fait savoir qu'il est important de trouver des familles d'accueil et de les garder, une fois qu'elles ont accepté d'entrer dans cette démarche, sachant que les familles d'accueil sont, aujourd'hui, confrontées à des situations de plus en plus difficiles en raison de la dégradation de la situation socio-économique de nombre de familles d'origine. Selon eux, il serait également intéressant d'offrir un cadre qui permette de baliser la manière d'établir la relation entre les deux familles ainsi que la manière dont le service d'accompagnement ou de placement familial peut venir s'insérer dans cette relation.
La position inégalitaire entre les deux familles est un point qui reste à surveiller, mais nous ne manquerons pas de suivre et d'évaluer la situation afin de voir si des modifications doivent être introduites dans la loi. En effet, une loi peut toujours être modifiée pour aller vers un mieux.

Workers in the family placement sector have told me that it is important to find and retain host families once they have agreed to enter this approach, knowing that today host families are facing increasingly difficult situations due to the deterioration of the socio-economic situation of many home families. According to them, it would also be interesting to offer a framework that allows to mark the way to establish the relationship between the two families as well as how the service of accompaniment or family placement can come to fit into this relationship.
The unequal position between the two families is a point that remains to be monitored, but we will continue to follow and evaluate the situation to see if changes need to be introduced in the law. In fact, a law can always be changed to get better.

Monsieur le président, monsieur le ministre, chers collègues, nous ne sommes pas dans le même registre que tout à l'heure. Preuve s'il en est qu'on peut travailler en commission de la Justice, en restant soi-même et en posant parfois les bonnes questions.
Madame Van Vaerenbergh, depuis de nombreuses années, on essaie de trouver un statut pour les accueillants familiaux, parce qu'ils demandent un statut légal pour leur permettre de vivre plus facilement, plus sereinement l'accueil des enfants qui sont placés chez eux. Voilà de nombreuses années que le législateur examine, recule, n'ose pas, parce que l'équilibre est difficile à trouver entre ce que souhaitent ces parents d'accueil, l'intérêt de l'enfant qui est concerné par le placement et la nécessité de comprendre aussi l'intérêt des parents d'origine (parents biologiques), tout en sachant que le placement a toujours pour finalité le bien de l'enfant, avec la possibilité, si c'est conforme à son intérêt, de réintégrer sa famille d'origine.
Il importe donc d'être prudent car si, dans les statuts, on modifie, de manière trop radicale, l'état des personnes ou les droits qui vont de pair, cela peut parfois entraîner des situations qui ne sont pas heureuses.
Alors, oui, madame Van Vaerenbergh – j'ai dit trois fois "non" précédemment, je vais donc essayer de dire trois fois "oui" maintenant –, ce texte a eu un parcours un peu difficile, un peu chaotique. Reconnaissons-le! Entre le texte d'origine et le texte sur lequel nous allons nous accorder aujourd'hui, il y a un monde de différence. Je pense que les auteurs le reconnaîtront et l'admettront.
Il a fallu au départ être assez prudent. On utilisait des termes comme "parents nourriciers". On utilisait des termes qui n'avaient plus de sens d'ailleurs dans notre Code civil, tels que "droit de garde matériel", "droit de garde juridique". On avait omis la dimension communautaire du projet et du dossier. Je pense que nous avons été bien inspirés de solliciter à la fois des auditions et, surtout, d'envoyer le texte au Conseil d'État, puisque cela nous a permis, au retour du Conseil d'État, de voir apparaître un texte nettement plus acceptable, nettement mieux écrit, qui faisait la part des choses entre les intérêts que je viens de rappeler.
Ce statut est effectivement attendu par les accueillants familiaux. Jouer ce jeu, c'est accepter un enfant qui n'est pas le sien et essayer de lui donner le meilleur environnement, en étant confronté, au quotidien, à des difficultés surgissant lorsqu'il faut signer un bulletin, marquer son accord pour une nuit chez un ami ou pour un départ à l'étranger durant un week-end, ou encore inscrire un enfant à un stage de vacances. Si l'on est systématiquement arrêté par des problèmes de cet ordre-là, cela ne rend pas les choses faciles. La loi qu'on nous propose aujourd'hui permettra de sortir de ces situations de non-droit, de simplifier les procédures, de reconnaître la place des parents d'accueil et de leur faciliter la vie, comme je l'ai dit.
Il est important de rappeler et de préciser à cette tribune, dans le cadre de nos travaux, que les parents biologiques (d'origine), gardent bien évidemment la compétence de prendre des décisions importantes relatives à la santé, à l'éducation, à la formation, aux loisirs et aux choix religieux ou philosophiques, sauf, dit le statut, en cas d'extrême urgence. Dans ce cas, il y aura toujours une possibilité de recourir à un magistrat qui appréciera. La proposition de loi mentionne aussi, en son article 387quinquies, et cela me paraît essentiel, l'importance de l'autorité parentale, le respect des principes de base de l'éducation, la surveillance de l'éducation de leur enfant, et le droit, durant le placement, bien évidemment, au maintien des relations personnelles.
Ce qui est intéressant dans le texte, c'est que les accueillants familiaux et les parents d'origine peuvent s'entendre et régler entre eux toutes les dispositions concernant l'accueil par une convention. Cette convention est libre, mais encadrée par les organes compétents en matière d'accueil familial. C'est la dimension communautaire dont nous parlions tout à l'heure. Cette convention ne peut pas dépasser la durée de l'accueil fixée par les organes de placement ou d'accueil. Elle pourra être homologuée par le tribunal de la famille si cela s'avère nécessaire. Je trouve que c'est une excellente disposition dans la proposition de loi. Cette possibilité de convention favorise la communication entre les familles. On imagine que, s'il y a une meilleure communication, l'intérêt de l'enfant est ainsi mieux servi.
L'intervention des organes compétents en matière d'accueil familial permet aussi d'être rassurés quant à l'encadrement des parents qui ne bénéficient pas toujours de la capacité de rédiger ce type de convention, pour que leurs intérêts minimaux soient quand même pris en compte.

Between the original text and the text on which we will agree today, there is a world of difference. I think the authors will recognize it and admit it.
We had to be quite cautious at first. Terms such as “feeding parents” were used. Terms were used that no longer had meaning elsewhere in our Civil Code, such as "material custody right", "legal custody right". The community dimension of the project and the file was omitted. I think we were well inspired to request both hearings and, above all, to send the text to the Council of State, since this allowed us, upon the return of the Council of State, to see appear a much more acceptable text, clearly better written, which made the share of things among the interests I just recalled.
This status is actually expected by family hosts. To play this game is to accept a child who is not his and try to give him the best environment, being confronted, on a daily basis, with difficulties arising when signing a bulletin, signing his agreement for a night with a friend or for a trip abroad during a weekend, or even enrolling a child in a holiday internship. If one is systematically stopped by problems of that order, it does not make things easy. The law we are proposing today will allow us to come out of these situations of non-right, to simplify procedures, to recognize the place of the host parents and to facilitate their lives, as I said.
It is important to remind and clarify to this tribune, as part of our work, that biological parents (of origin), of course, retain the competence to make important decisions relating to health, education, training, leisure and religious or philosophical choices, except, says the statute, in cases of extreme urgency. In this case, there will always be a possibility to resort to a judge who will appreciate. The bill also mentions, in its article 387quinquies, and this seems to me essential, the importance of parental authority, the respect of the basic principles of education, the supervision of the education of their child, and the right, during the placement, of course, to maintain personal relations.
What is interesting in the text is that family hosts and parents of origin can agree and settle with each other all the provisions concerning the reception by a convention. This convention is free, but framed by the bodies competent in matters of family welfare. This is the European dimension we were talking about. This agreement may not exceed the duration of the reception established by the placement or reception bodies. It may be approved by the family court if necessary. I think this is an excellent provision in the bill. This possibility of convention promotes communication between families. Imagine that if there is better communication, the child’s interests are thus better served.
The intervention of the competent bodies in the field of family welfare also allows to be reassured about the guidance of parents who do not always benefit from the capacity to draft this type of convention, so that their minimum interests are still taken into account.

Par contre, à l'instar de Mme Gerkens qui y a fait allusion à l'instant, j'ai une certaine réticence que j'ai développée en commission. Ce sont les professionnels de l'aide à la jeunesse et les travailleurs de terrain d'ATD Quart Monde qui ont attiré notre attention sur cette situation. Tant dans la convention que dans l'article 387octies nouveau, il est question de déléguer certaines décisions importantes relevant de l'autorité parentale après un an. Cela gêne un peu les praticiens de terrain des organisations représentatives comme ATD Quart Monde.
Il est difficile d'apprécier si cette délégation doit être élargie. On peut d'ailleurs se réjouir que dans le texte, désormais, il est question de "délégation" et non de "transfert" de l'autorité parentale. Cette terminologie est bien plus adaptée. Peut-on considérer qu'après un an de placement, une extension du champ de la compétence ou de l'autorité parentale accordée à la famille d'accueil peut être décidée? Faut-il un délai ou n'en faut-il pas?
En commission, j'avais déposé un premier amendement visant à supprimer le délai; et ensuite, un sous-amendement visant à établir le délai à trois ans. Cela me permettait de penser qu'on offrait davantage de garanties. Je vais redéposer aujourd'hui – avec votre groupe, madame Gerkens, si vous le souhaitez, et j'espère, avec d'autres groupes également - l'amendement fixant le délai à trois ans.
Je m'en suis expliqué en commission, le champ de la disposition vaut autant pour le placement volontaire que pour le placement qui peut être qualifié d'involontaire. Le code et les textes prévoient déjà des dispositions qui permettent de trouver des solutions.
Je finirai par dire que je vote en faveur de cette proposition. Laissez-moi expliquer mes raisons! L'enjeu est important. Nous avons consacré des années à trouver les solutions. La solution est là! Je pense que cela vaut la peine d'essayer d'expliquer à tous ceux qui auraient encore des réticences la raison pour laquelle, malgré ces réticences, nous finirons par voter le texte.
Dans l'hypothèse d'un placement volontaire, la famille d'accueil peut déjà, aujourd'hui, s'adresser au tribunal de la jeunesse pour déterminer l'étendue de ses droits sur l'enfant. Fallait-il prévoir un délai? La question est posée. Lorsque le placement n'est pas volontaire, il y a aussi dans notre arsenal juridique actuel la possibilité de pallier l'absence des parents d'origine. La déchéance parentale existe. Le système plus coercitif a l'avantage d'éviter une confrontation directe entre les parents accueillants et la famille d'origine.

Finally, I will vote in favour of this proposal. Let me explain my reasons. The issue is important. We have spent years trying to find solutions. The solution is here! I think it is worth trying to explain to all those who would still have reluctance the reason why, despite these reluctance, we will end up voting the text.
In the event of a voluntary placement, the host family can already, today, address the youth court to determine the extent of its rights on the child. Should there be a deadline? Selon moi, les lois en vigueur et le texte présent comportent des outils permettant d'étendre l'autorité parentale après un an. Une telle extension permettrait peut-être à certains d'apprécier à sa juste valeur notre présent travail.
J'en viens à ma deuxième crainte. Malgré l'amélioration du texte, qui a été permise par les discussions en commission, le recours au juge – qu'il s'agisse du tribunal de la famille ou du tribunal de la jeunesse – est peut-être un peu trop simple. Une plus grande judiciarisation de certains cas ne constitue pas toujours la meilleure formule. Aussi leur est-il conseillé de s'assurer, dans la mesure de leurs possibilités, parce qu'ils continueront à répondre des actes posés par leur enfant.
J'estimais qu'une telle attitude n'était pas très cohérente ni très normale. C'est pourquoi je considère que, pour la durée temporaire du placement, il convient de déplacer la responsabilité sur le parent d'accueil de manière à éclaircir cette situation. Le représentant du ministre nous a alors dit qu'une telle éventualité ferait ou faisait l'objet d'une négociation plus large. Vous avez répondu à une recommandation du Conseil de l'Europe qui demandait que soit élaboré un statut juridique pour les familles d'accueil.
En ce qui concerne la reconnaissance du rôle social, affectif, économique des familles d'accueil, c'est une innovation majeure. Je félicite donc franchement les auteurs et tous ceux qui ont contribué à l'élaboration de cette proposition de loi. Elle est d'autant plus intéressante que vous avez pu dépasser ce qui malheureusement caractérise trop souvent les relations entre parents et familles d'accueil, à savoir une conception conflictuelle des relations. Trop souvent, les intermédiaires professionnels devaient jouer le rôle de conciliateurs. Certes, il ne faut pas exclure leur rôle, au contraire – vous avez d'ailleurs reconnu la nécessité de les associer à l'élaboration d'une convention entre les parents et la famille d'accueil –, mais vous avez clairement favorisé la concertation, la médiation, la participation, l'entente et, finalement, la conclusion d'une convention entre parents et accueillants familiaux.

Cela aurait aussi apporté une sécurité juridique et aurait éventuellement évité des controverses dans l'exécution de la convention, le tribunal pouvant parfois requalifier des termes ou apporter une précision utile. L'expérience nous amènera peut-être à revoir certains aspects.
On n'a pas abordé les conséquences fiscales dans cette proposition de loi. Soit dit en passant, c'est un vrai chantier car un nouvel équilibre doit être trouvé en matière d'obligations et de déductibilité fiscales selon le rapport des responsabilités ou des interventions entre parents et accueillants familiaux.
Honnêtement, je suis favorablement impressionné par cette avancée législative qui me semble être totalement novatrice dans notre droit familial et qui fera certainement l'objet d'études très poussées de la part des spécialistes en la matière.
Monsieur le président, j'attire votre attention sur le fait qu'il est souhaitable d'apporter une petite correction légistique. Ce sera ma modeste contribution à l'élaboration de cette proposition.
