                    Monsieur le président, chers collègues, vous connaissez comme moi les polémiques qui ont été soulevées tant par le processus de désignation que par le plan environnemental de l'organisation du mondial de football 2022 au Qatar.

Selon la Confédération internationale des syndicats, la frénésie de construction en vue de la Coupe du monde de football risque de coûter la vie à au moins 4 000 travailleurs au cours des sept prochaines années si des dispositions ne sont pas prises pour garantir le droit des travailleurs migrants.

Face à cette situation, à la fin du mois de janvier, la Fédération internationale de football association (FIFA) a sommé le Qatar de présenter des mesures concrètes pour améliorer le sort des travailleurs. Le 11 février, le Qatar a annoncé des améliorations.

La proposition de résolution que je vous présente se veut en lien avec des initiatives prises tant au niveau de la Fédération Wallonie-Bruxelles sur le plan sportif qu'au niveau du Parlement européen. Ici, nous nous situons sur le plan diplomatico-politique. Le texte qui vous est soumis aujourd'hui vise à affirmer clairement la position et les inquiétudes sérieuses de la Chambre quant au respect des travailleurs des chantiers de construction pour le Mondial 2022 au Qatar.

Je suis convaincue que le boycott total des événements sportifs est contre-productif. Par ailleurs, ce genre d'événements devrait, à l'inverse, constituer un levier pour promouvoir la dignité humaine, y compris celle des travailleurs. La situation actuelle nous conduit à travailler au cas par cas.

Si le titre de ce texte mentionne la situation au Qatar, la volonté que nous affichons est bien celle d'une approche générale et surtout en amont. À quoi sert-il de s'indigner ex post?

Enfin, ce texte fait un lien essentiel avec les accords commerciaux européens. Nous demandons que, face à de tels marchés potentiels, l'Union européenne utilise ces accords pour un instrument sur le libre-échange capable de générer l'inclusion et la mise en œuvre effective de normes sociales et environnementales élevées et contraignantes. Il s'agit bien d'assurer la protection des droits humains et de l'environnement pour prévenir ici tout risque de dumping social et environnemental via l'insertion de clauses de sauvegarde dans les accords à conclure avec tous les partenaires commerciaux de l'Union européenne.

Je voudrais rappeler trois priorités. Premièrement, le parlement devra être informé de l'ouverture des futurs APPI. Deuxièmement, il faut accompagner les clauses sociales et environnementales de mesures contraignantes, de possibilités d'évaluation et, le cas échéant, de réformes et de modèles de textes pour les résolutions. Troisièmement, il faut absolument qu'une clause soit prévue dans les futurs accords pour que soit préservé le droit des États de réguler.

Mr. Speaker, dear colleagues, you know as I do the controversies that have been raised both by the designation process and by the environmental plan of the 2022 World Cup in Qatar.

According to the International Confederation of Trade Unions (ICU), the construction hurdles for the World Cup in football risk cost the lives of at least 4,000 workers over the next seven years if no measures are taken to guarantee the rights of migrant workers.

Faced with this situation, at the end of January, the International Football Federation Association (FIFA) called on Qatar to present concrete measures to improve the fate of workers. On February 11, Qatar announced improvements.

The resolution proposal I present to you is linked to initiatives taken both at the level of the Federation Wallonia-Brussels at the sport level and at the level of the European Parliament. Here we are situated on the diplomatic-political level. The text submitted to you today aims to clearly affirm the House’s position and serious concerns regarding the respect of construction workers for the 2022 World Cup in Qatar.

I am convinced that the total boycott of sports events is counterproductive. On the other hand, such events should, on the contrary, constitute a lever for promoting human dignity, including that of workers. The current situation leads us to work case by case.

If the title of this text mentions the situation in Qatar, the will we display is indeed that of a general approach and especially in advance. What’s the point of being angry ex post?

Finally, this text has an essential link with European trade agreements. We demand that, in the face of such potential markets, the European Union use these agreements as a free trade instrument capable of generating the inclusion and effective implementation of high and binding social and environmental standards. The aim is to ensure the protection of human rights and the environment in order to prevent any risk of social and environmental dumping through the inclusion of safeguard clauses in agreements to be concluded with all trade partners of the European Union.

I would like to point out three priorities. First, Parliament will have to be informed of the opening of future APPIs. Second, social and environmental clauses must be accompanied by binding measures, evaluation possibilities and, where appropriate, reforms and templates for resolutions. Third, it is absolutely necessary that a clause be provided in future agreements in order to preserve the right of States to regulate.

Il ne suffit pas de la voter demain, mais il faut vérifier aussi si la Belgique a appliqué le point 7 de ce texte, qui demande d'activer dès son entrée en vigueur, l'article 6, § 4 de l'accord de l'Union économique belgo-luxembourgeoise avec le Qatar.

M. le ministre pourrait-il d'ailleurs nous dire quand exactement cet accord entrera en vigueur? Il le dira une autre fois.

Telkens wanneer er een groot kampioenschap in het vooruitzicht is, hebben wij last van kalenderverdriet. Wij hebben hier debatten gevoerd, bijvoorbeeld over Tibet, maar eens dat voorbij was, was alles vergeten en zaten de Tibetanen met de gebakken peren. Hetzelfde gebeurde in verband met Sotsji; eens het voorbij was, was het allemaal gedaan en de Russische beer veroverde zelfs de Krim.

Nu gebeurt het andermaal met Qatar. Het is niet dat ik dat niet steun; daar staat immers geen woord in dat niet juist is. Ik ga er dus voor honderd procent mee akkoord, maar laten wij een beetje minder hypocriet zijn in dergelijke zaken.

Het WK in Qatar werd toegewezen in 2010. In de raad van de FIFA die Qatar had toegewezen, zat op dat moment ook een Belg. Ik heb niet vernomen of die man daarvoor heeft gestemd of niet. De verantwoordelijkheid is in 2010 genomen.

Men weet op voorhand hoe de situatie in dergelijke landen is. Telkens wanneer het om een sportevenement gaat, springt de massa erop. Ongeveer een maand geleden gingen wij naar een soortgelijk Arabisch emiraat. Een prinses met in haar kielzog driehonderd bedrijfsleiders gingen er naartoe om ons land te verkopen, terwijl de omstandigheden inzake mensenrechten daar nog slechter zijn dan in Qatar. Ik heb toen niemand uit de politieke wereld gehoord. Wanneer het echter over sport gaat, is het wel een item. Daarmee heb ik het moeilijk.

Sotsji is voorbij. Eerst riepen de politici en daarna was het afgelopen. Mocht er bijvoorbeeld iemand in de Europese Gemeenschap durven zeggen dat wij, in plaats van visa af te nemen van zes Russische diplomaten, oligarchen zouden verbieden om Europese voetbalclubs te bezitten, dan zou Europa wel op zijn kop staan. Ik heb het er altijd moeilijk mee dat de sport daarvoor wordt gebruikt.

Ik apprecieer dat de indieners erkennen dat een sportboycot enkel ten laste is van de sporters. Ik wil echter nogmaals beklemtonen dat wij altijd hypocriet zijn als het over sport gaat, maar dat wij, als het over zaken gaat, zoals in Saoedi-Arabië, die mensen altijd achternalopen. Wij zouden in deze zaken veel beter consequent zijn, mevrouw Vienne.

Mijnheer de voorzitter, ik dank u dat ik kort het woord mocht nemen op deze warme dag.

Whenever there is a big championship in the foreground, we suffer from calendar sadness. We had debates here, for example about Tibet, but once that was over, everything was forgotten and the Tibetans sat with the baked pearls. The same happened in connection with Sochi; once it was over, it was all done, and the Russian bear even conquered Crimea.

This is the case with Qatar. It is not that I do not support it; there is no word in it that is not correct. So I agree with this one hundred percent, but let us be a little less hypocritical in such matters.

The World Cup in Qatar was awarded in 2010. At the time, a Belgian was also in the board of the FIFA that Qatar had assigned. I don’t know if that man voted for it or not. Responsibility was assumed in 2010.

One knows in advance how the situation is in such countries. Whenever it comes to a sporting event, the mass jumps on it. About a month ago we went to a similar Arab Emirate. A princess with three hundred business leaders in her chest went there to sell our land, while the human rights conditions there are even worse than in Qatar. I didn’t hear anyone from the political world. When it comes to sport, it is a matter. This makes it difficult for me.

Sochi is over. First the politicians called out and then it was over. For example, if someone in the European Community dared to say that instead of taking visas from six Russian diplomats, we would prohibit oligarchs from owning European football clubs, then Europe would be in the head. I always find it difficult to use the sport for this purpose.

I appreciate that the petitioners acknowledge that a sports boycott is only due to the athletes. However, I would like to emphasize once again that we are always hypocritical when it comes to sport, but that when it comes to business, like in Saudi Arabia, we always follow those people. We would be much more consistent in these matters, Mrs. Vienne.

                    Mijnheer de voorzitter, ik wens nu al een stemverklaring af te leggen, zodat wij dat morgen niet meer moeten doen.

Eigenlijk sluit ik mij aan bij wat de heer Dedecker zei. Wij steunen de geest van de resolutie die erin bestaat Qatar op te roepen om verandering te brengen in de mensonterende werkomstandigheden waarin arbeiders werken aan de infrastructuur van het WK voetbal. Tegelijk klagen wij aan dat de resolutie diplomatieke middelen waarover men beschikt, verbrandt, namelijk een dreiging tot boycot of een vraag tot verhuizing van het voetbalevenement. Dat zou een ultieme stok achter de deur kunnen zijn ten aanzien van de Qatarese organisatoren. Die instrumenten werden in de resolutie echter niet opgenomen.

Vandaar zullen wij ons onthouden bij de stemming, hoewel wij de geest van de resolutie wel steunen. Wij vinden het bovendien niet nodig dat een regering zich bemoeit met het al dan niet toewijzen van sportevenementen aan bepaalde landen.

                    Mijnheer de voorzitter, mijnheer de minister, collega’s, af en toe is het goed zich af te vragen wat eigenlijk het doel is van een bepaald wetsontwerp. Voorliggend wetsontwerp dat wordt besproken en door deze meerderheid ongetwijfeld in vollen getale zal worden goedgekeurd, heeft een tweeledig doel.

Een eerste doel is het uitstel van de inwerkingtreding van de federale begrotingswetgeving, het is te zeggen de wet van 22 mei 2003 betreffende de organisatie van de begroting en van de comptabiliteit van de federale Staat voor de instellingen van openbaar nut. Het tweede doel is om aan diensten met een kleinere omvang de mogelijkheid te bieden, op voorwaarde dat bepaalde criteria zijn vervuld, gebruik te maken van een boekhoudsysteem waarbij de algemene en de budgettaire boekhouding losstaan van elkaar.

Collega’s, sta mij toe om met betrekking tot het eerste doel op te merken dat het volgens mij onverantwoord is dat, elf jaar na publicatie van een wet en vijf jaar na de start van het eigenlijke systeem Fedcom, het gros van de uitvoeringsbesluiten nog altijd niet genomen is. Ere wie ere toekomt, mijnheer de minister, u probeert een beetje in te halen, maar dat gebeurt schoorvoetend. Vandaag wordt in elk geval een stukje meer toegevoegd aan de uitvoeringsbesluiten met betrekking tot de wet van 22 mei 2003.

Wij staan met die opinie niet alleen. Ik kan het Rekenhof citeren, als volgt: “…dat het uitblijven van de uitvoeringsbesluiten ernstige risico’s meebrengt voor zowel de betrokken actoren als voor de interne en de externe controleur. Het valt niet te verantwoorden dat nagenoeg vijf jaar na de officiële opstart van de nieuwe federale comptabiliteit en Fedcom het boekhoudkundig kader niet volledig juridisch is afgedekt en dat de betrokken actoren nog geen zekerheid hebben over de inhoud van hun opdracht, noch over hun statuut en de eraan gekoppelde functiescheidingen”.

The first objective is to postpone the entry into force of the federal budget legislation, that is, the law of 22 May 2003 on the organization of the federal state budget and accounting for public utility institutions. The second objective is to enable services of a smaller scale, provided that certain criteria are met, to use a accounting system which separates general and budgetary accounts.

With regard to the first objective, I would like to point out that, in my view, it is irresponsible that, eleven years after the publication of a law and five years after the launch of the actual Fedcom system, most of the implementing decisions have still not been taken. Honour who deserves honour, Mr. Minister, you are trying to get in a little bit, but that is happening shell-feeding. Today, in any case, a little more is added to the implementing decisions relating to the Act of 22 May 2003.

We are not alone with this opinion. I can quote the Court of Auditors as follows: “...that the absence of implementing decisions poses serious risks for both the stakeholders concerned and for the internal and external auditor. It is irresponsible that almost five years after the official launch of the new Federal Accounting and Fedcom the accounting framework is not fully covered legally and that the actors concerned still have no certainty about the content of their assignment, nor about their statute and the associated division of functions.”

                    Collega’s, tot daar het Rekenhof, dat trouwens in zijn 170ᵉ boek vraagt om nauwer te worden betrokken bij de voorbereidingen en bij de redactie van wijzigingen aan de wet van 22 mei 2003, evenals bij de totstandkoming van ontwerpen van wet of besluiten die direct of indirect een impact hebben op de compatibiliteit en de bevoegdheden van het Rekenhof. Daarom hebben wij in de commissie het advies van het Rekenhof gevraagd.

Mijnheer de minister, ik hoop dat u in de uitvoering alvast iets zult doen met het advies van het Rekenhof. In de commissie hebt u gezegd dat er informeel overleg heeft plaatsgevonden. Misschien kan alles iets formeler worden, want blijkbaar heeft het Rekenhof vorige zomer al een negatief advies gegeven omtrent het tweede deel van de wet, met name de uitzondering voor de diensten met een kleinere omvang.

In dat verband citeer ik uit het rapport van het Rekenhof: “Het Rekenhof meent dat de overeenstemmingstabel geen voldoende waarborg biedt voor de eerbiediging van een van de fundamentele principes van de wet van 22 mei 2003, namelijk de verplichting voor alle diensten van de federale overheid om hun verrichtingen simultaan in de algemene en in de begrotingsboekhouding te boeken op basis van vastgestelde rechten. De door artikel 6 van het wetsontwerp dat voorligt voorziene consolidatie van de verrichting van de diensten in de jaarrekening van de federale Staat, die op basis van vastgestelde rechten wordt opgesteld, kan hierdoor in het gedrang komen.”

Dat werpt natuurlijk een aantal vragen op. Wij hopen dat ons vermoeden onjuist zal blijken te zijn. Ik kan mij echter moeilijk voorstellen dat, als men al zoveel heeft geïnvesteerd in een systeem als Fedcom, men aan een aantal kleinere parastatalen en dergelijke, die ook tot de perimeter behoren, zegt dat zij een andere soort boekhouding mogen voeren en dat alles wordt geregeld via een conversietabel. Men zou kunnen zeggen dat het voor kleinere instanties moeilijker is wegens de hogere administratieve last, maar het tegendeel is waar, mijnheer de minister. Dat weet u ook. Het biedt geen oplossing voor de administratieve lasten. Zij zullen immers een overeenstemmingstabel moeten opstellen tussen hun boekhoudplan en het boekhoudplan van het KB van 10 november 2009 in uitvoering van de wet van 22 mei 2003.

In that regard, I quote from the Court of Auditors’ report: “The Court of Auditors considers that the balance sheet does not provide sufficient guarantee for the observance of one of the fundamental principles of the Act of 22 May 2003, namely the obligation for all services of the federal government to record their transactions simultaneously in the general and in the fiscal accounts on the basis of established rights. The consolidation of the provision of services provided for in Article 6 of the draft law in the federal state accounts, which are drawn up on the basis of established rights, may therefore be jeopardized.”

This, of course, raises a number of questions. We hope that our assumption will prove to be incorrect. However, I can hardly imagine that, if one has already invested so much in a system like Fedcom, one tells a number of smaller parastatals and the like, which also belong to the perimeter, that they are allowed to conduct a different type of accounting and that everything is regulated via a conversion table. It could be said that it is more difficult for smaller bodies because of the higher administrative burden, but the opposite is true, Mr. Minister. You also know. It does not solve the administrative burden. They will be required to draw up a table of matching between their accounting plan and the accounting plan of the KB of 10 November 2009 in implementation of the Act of 22 May 2003.

                    Collega’s, u bent in grote getale aanwezig voor het uiterst interessante debat over de eerste aanpassing van de begroting 2014.

Collega’s, het is misschien belangrijk uw aandacht erop te vestigen dat het over een begrotingsaanpassing en niet over een begrotingscontrole gaat. Wij stellen vast dat door de voorliggende aanpassing de uitgaven van de federale overheid opnieuw met 60 miljoen euro zullen stijgen.

Onverwachte uitgaven zijn inderdaad mogelijk, maar tijdens de bespreking in de commissie bleek uit het antwoord van de minister telkens opnieuw dat de aanpassingen aan de begroting – sommige ervan zijn best wel nodig – door bijkomende ontvangsten zullen worden gecompenseerd.

Dit brengt ons natuurlijk altijd opnieuw tot het hart, de bestaansreden, van de huidige regering-Di Rupo. Een normaal mens zou immers proberen de bijkomende uitgaven te compenseren door extra te besparen. Zo werkt het echter niet in dit land, althans niet op het federale niveau. Hier wordt gewoon doorgegaan met uitgeven. Er worden met bijkomende ontvangsten compensaties gezocht.

Wij hebben vanmiddag allen in de media kunnen vaststellen dat de regering-Di Rupo een geweldig succesvolle begrotingscontrole achter de rug heeft. Alle regeringsleden gaan akkoord. Hoewel het monitoringcomité aangaf dat er een tekort van 45 miljoen euro was, stelt de regering vast dat er een overschot van meer dan 100 miljoen euro is, wat een verschil van 140 miljoen euro betekent. Volgens de heer Vande Lanotte gaat het over zaken die nog niet eens merkbaar zijn in de afrondingsverschillen en dies meer.

Collega’s, feit is – en dit is erg betreurenswaardig – dat de balans van de voorliggende begroting 2014 – ik wijs ter zake niet met de vinger naar de minister van Begroting, van wie ik wil aannemen dat hij eventueel wat verder wou gaan – aangeeft dat het federale tekort in 2014, ondanks meevallers, met nog geen 400 miljoen euro zal dalen.

Colleagues, it may be important to draw your attention to the fact that this is a budget adjustment and not a budget control. We note that as a result of this adjustment, the expenditure of the federal government will again increase by EUR 60 million.

Unexpected spending is indeed possible, but during the discussion in the committee, the Minister’s response repeatedly showed that the adjustments to the budget – some of which are quite necessary – will be compensated by additional revenues.

This, of course, always brings us back to the heart, the reasons for existence, of the current government-Di Rupo. After all, a normal person would try to compensate for the additional expenses by saving extra. However, this does not work in this country, at least not at the federal level. This is just going on with spending. Additional revenue compensation is sought.

We have all been able to see in the media this afternoon that the government-Di Rupo has a remarkably successful budget control behind it. All government members agree. Although the monitoring committee stated that there was a deficit of €45 million, the government notes that there is a surplus of more than €100 million, which means a difference of €140 million. According to Mr Vande Lanotte, this is about things that are not even noticeable in the rounding differences and more.

Colleagues, the fact is – and this is very regrettable – that the balance sheet of the current budget 2014 – I do not point with the finger to the Minister of Budget, of whom I want to assume that he might want to go a little further – indicates that the federal deficit in 2014 will fall by less than 400 million euros, despite incidents.

Colleagues, when we are opposed to the fact that new taxes for one billion euros will be levied in 2014 alone, we know where it is going. The austerity efforts are being transferred to the states and to the future, and thus, colleagues, to yours and to my children.

                    Opnieuw zijn het de eenmalige meevallers, die de begrotingsresultaten moeten verbloemen. Zo herziet de begrotingscontrole 2014 de opbrengsten van de fiscale regularisatie met 101 miljoen euro meer inkomsten tot 532 miljoen euro. U zou dan kunnen zeggen dat u met die meevaller ons tekort verder zouden afbouwen. Niet zo de regering-Di Rupo, die staat klaar om dat extra geld uit te geven.

Collega’s, als we het begrotingsbeleid van de voorbije drie jaar van de regering-Di Rupo even in ogenschouw nemen, dan kunnen we niet anders dan vaststellen dat de balans bijzonder triest is. Voor een afbouw van het tekort met vier miljard euro heeft de regering naast een heel pak eenmalige maatregelen en een aantal besparingen die men met de loep moet zoeken, het land opgezadeld met jaarlijks acht miljard nieuwe belastingen. De regering sluit af met een begrotingstekort van negen miljard euro. Collega’s, als dit land opnieuw vooruit wil, is er nood aan verandering.

Het ontwerp geeft België de gelegenheid om behoorlijke levens- en arbeidsomstandigheden voor zeevarenden aan boord van schepen te waarborgen. Het creëert een systeem om de naleving van de bepalingen van het maritiem arbeidsgedrag van 2006 te controleren. Elk schip dat onder het toepassingsgebied van het ontwerp valt, moet een maritiem arbeidscertificaat en een conformiteitsverklaring voor maritieme arbeid bezitten. De aangehaalde documenten worden afgeleverd na een grondige inspectie van de arbeids- en levensomstandigheden van de zeevarenden aan boord van het schip.

De minister bevestigde op vraag van verschillende parlementsleden dat in het kader van de precertificering reeds 80 % van de vaartuigen van de Belgische vloot geïnspecteerd wordt via gecombineerde inspecties van de verschillende besturen. Daarnaast bevestigde de minister dat de inspecties zo zijn opgevat dat de reders en de bemanning niet nodeloos tijd verliezen en dat er geen extra budget vereist is.

Het ontwerp werd met eenparigheid van stemmen aangenomen.

Collega’s, wij hebben het hier over een wetsvoorstel. U weet dat de wet op de overheidsopdrachten een niet-onbelangrijke wet is voor dit land. Deze wet bepaalt nogal wat economisch gebeuren en bepaalt ook de manier waarop de overheden omgaan met leveranciers van diensten, goederen of bouwwerken en is in die zin dus vrij belangrijk.

Opnieuw blijkt dat de eenvoudige omzetting van artikel 6 van de Richtlijn 2012/27/EU van 25 oktober 2012 en van de Richtlijn 2009/52/EG van 18 juni 2009 een beetje laat was, dat men liever wat aan de wet prutst in plaats van de zaak ten gronde te bekijken en dat men een aantal personen van dit halfrond de opdracht geeft het veld in te trekken met een wetsvoorstel.

Het toffe is dat dit wetsvoorstel een precedent schept voor de parlementsleden. Wij mochten bij de bespreking van dit voorstel in de commissie immers vaststellen dat wij, naast onze eigen fractiemedewerkers die deskundige input kunnen geven, voor onze persoonlijke initiatieven in dit Parlement in de toekomst beroep zullen kunnen doen op de studiediensten van de Kanselarij.

Wat blijkt? Een wetsvoorstel wordt in de commissie ingediend door een aantal commissieleden. Op het ogenblik dat wij in discussie gaan, discussiëren wij echter niet meer met de indieners van het voorstel, maar met de verantwoordelijken van de Kanselarij.

Ik ga ervan uit dat dit niet alleen geldt voor de collega’s van PS, maar dat ieder van ons die vrij technische aangelegenheden bij wijze van wet wil veranderen, in het vervolg beroep kan doen op de diensten van de Kanselarij. Ik heb de indruk dat zij graag ter beschikking staan, al slagen ook zij erin – maar waarschijnlijk zal dat door de grote tijdsdruk zijn – hier en daar een onduidelijkheid te laten staan in de voorstellen die zij zo bereidwillig voor onze volksvertegenwoordigers uitschrijven.

We are talking about a bill. You know that the law on public procurement is a non-insignificant law for this country. This law determines a lot of economic happening and also determines the way in which governments deal with suppliers of services, goods or works and is therefore quite important in that sense.

Again, it turns out that the simple transposition of Article 6 of Directive 2012/27/EU of 25 October 2012 and of Directive 2009/52/EC of 18 June 2009 was a little delayed, that one preferred to take a look at the law rather than the substance of the case, and that a number of persons in this hemisphere were instructed to withdraw the field with a legislative proposal.

The point is that this bill creates a precedent for the European Parliament. In the course of the discussion of this proposal in the committee, we were able to conclude that, in addition to our own group staff who can provide expert input, we will in the future be able to use the study services of the Chancellor’s for our personal initiatives in this Parliament.

What shows up? A draft law is submitted to the committee by a number of committees. However, at the moment we enter into discussion, we are no longer discussing the proposal with the candidates, but with the Chancellors.

I assume that this does not only apply to the colleagues of PS, but that any one of us who wishes to amend freely technical matters by way of law can subsequently resort to the services of the Chancellor. I have the impression that they are happy to be at their disposal, although they also succeed – but probably because of the great pressure of time – to leave here and there an ambiguity in the proposals they so willingly write for our people’s representatives.

                    Wat blijkt immers? Op het ogenblik waarop de regering eigenlijk niets meer moet doen dan het tijdig en rechttoe rechtaan omzetten van een aantal richtlijnen verkiest men toch om daar weer een aantal ideologische – ik weet niet hoe ik ze anders moet noemen – principes aan vast te knopen. Wanneer daar vragen over worden gesteld blijven fatsoenlijke antwoorden uit. Het moet dan gewoon zo zijn. Wij zijn er in elk geval in geslaagd in de commissie één onduidelijkheid weg te werken. Ik dank u trouwens – niet de indieners maar wel de anderen – voor het aanvaarden van een van onze amendementen.

Een tweede onduidelijkheid blijft echter bestaan. Voor het verslag zal ik proberen het in eenvoudige taal uit te leggen.

Dit wetsontwerp regelt de omzetting van een EU richtlijn die eigenlijk tot doel heeft om in het kader van werken die aanbesteed worden door de overheid, een hogere energie-efficiëntie te bekomen. Daar kan uiteraard niemand tegen zijn.

Het bijzondere is dat men het eigenlijk verplicht maakt om alleen rekening te houden met die aanbiedingen die rekening houden met hoge energie-efficiëntieprestaties. Het addertje onder het gras is dat de richtlijn suggereert dit verplicht te maken voor de federale en regionale overheden, maar er wordt niet gesproken over lokale overheden.

Wat blijkt nu bij de omzetting van die richtlijn in Belgische wetgeving? In artikel 5 staat: “De aanbestedende overheden waarop het eerste lid niet toepasselijk is, overwegen wat de door de Koning vast te stellen producten, diensten en gebouwen betreft, uitsluitend de verwerving van producten, diensten en gebouwen met hoge energie-efficiëntieprestaties”. Collega’s, als wij lezen “overwegen uitsluitend gebouwen met hoge energie-efficiëntieprestaties” dan is dat een verplichting. Dat is dus veel meer dan wat de richtlijn zegt.

When questions are asked, decent answers remain out. It just has to be so. At least we managed to remove one uncertainty in the commission. I would like to thank you – not the applicants but the others – for accepting one of our amendments.

However, a second uncertainty remains. Before the report, I will try to explain it in simple language.

This draft law regulates the transposition of an EU directive which actually aims to ⁇  higher energy efficiency in the context of works submitted by the government. Of course, no one can oppose this.

The special thing is that one actually makes it mandatory to only take into account those offers that take into account high energy efficiency performance. The add-on under the grass is that the directive suggests making this mandatory for federal and regional governments, but there is no talk about local governments.

What is the result of the transposition of this Directive into Belgian legislation? Article 5 states: “The contracting authorities to which paragraph 1 does not apply shall consider, as regards the products, services and buildings to be determined by the King, exclusively the acquisition of products, services and buildings with high energy efficiency performance”. Colleagues, if we read “consider only buildings with high energy efficiency performance” then that is an obligation. That is much more than what the directive says.

                    De richtlijn had het over het aanmoedigen van lokale overheden. U zult als lokale overheid maar gezegend zijn met een oud gebouw hier of daar waaraan u op vraag van de brandweer een aantal brandwerende werken moet uitvoeren. Op het ogenblik dat u begint, wordt u met dit nieuwe element in de wet geconfronteerd. De mensen die op het lokale niveau actief zijn, wens ik dan ook heel veel succes bij het uitvoeren of het naleven van deze wetgeving.

Collega’s, de kwestie lijkt futiel, maar is het niet. Het schept immers opnieuw verwarring in een wet die, zoals ik in mijn inleiding heb aangegeven, zo enorm belangrijk is voor een aantal economische contacten tussen overheden en leveranciers, zijnde het bedrijfsleven. Op dat ogenblik leiden dergelijke onzorgvuldigheden tot onzekerheid en tot evenveel rechtszaken.

Er is dus in elk geval één grote winnaar van deze wijziging, met name de advocaten. Zeg niet dat ik niet heb gewaarschuwd.

Wij zullen ons in elk geval onthouden.

                    Monsieur le président, chers collègues, deux objectifs sont rencontrés dans cette proposition de loi rédigée en parfaite collaboration avec les services de la chancellerie. Il s'agit ici d'une proposition essentiellement technique, vous en conviendrez.

Le premier objectif est de transposer partiellement la directive européenne relative à l'efficacité énergétique. Cette transposition est urgente étant donné que sa date ultime est fixée au 5 juin 2014. Il s'agit ainsi de transposer l'article 6 de la directive, qui oblige les États membres à veiller à ce qu'au moins les gouvernements centraux acquièrent des produits, des services et des bâtiments à haute performance énergétique.

L'application de la directive offre toutefois une certaine souplesse au pouvoir adjudicateur, notamment lorsque les performances en matière d'efficacité énergétique sont difficilement réalisables d'un point de vue budgétaire et économique.

Le second objectif est la transposition d'une directive prévoyant des normes minimales concernant les sanctions et les mesures à l'encontre des employeurs de ressortissants de pays tiers en séjour irrégulier. Cette disposition oblige dès lors les États membres à prévoir une clause permettant d'exclure de l'accès aux marchés publics les entreprises qui ont occupé des ressortissants de pays tiers en séjour illégal et ce pour une durée maximale de cinq ans.

Durant la présentation de cette proposition en commission, il a été tenu compte des remarques d'Ecolo et de la N-VA, que je remercie pour leurs contributions, afin de donner une habilitation au Roi pour imposer une durée maximale d'application de l'exclusion et de fixer les modalités à respecter en la matière. La durée de l'exclusion ne peut en aucun cas excéder cinq ans.

Mr. Speaker, my colleagues, two objectives are met in this bill drafted in perfect collaboration with the Chancellor’s services. This is basically a technical proposal, and you will agree with it.

The first objective is to partially transpose the EU Energy Efficiency Directive. This transposition is urgent as its deadline is 5 June 2014. Article 6 of the Directive requires Member States to ensure that at least central governments purchase high-energy products, services and buildings.

However, the implementation of the Directive provides certain flexibility for the contracting authority, in particular where energy efficiency performance is difficult to ⁇  from a budgetary and economic point of view.

The second objective is the transposition of a Directive laying down minimum standards on sanctions and measures against employers of illegally staying third-country nationals. That provision therefore requires Member States to provide for a clause excluding from access to public procurement undertakings which have employed illegally staying third-country nationals for a maximum period of five years.

During the presentation of this proposal in the committee, the observations of Ecolo and the N-VA were taken into account, to whom I thank for their contributions, in order to empower the King to impose a maximum duration of application of the exclusion and to set the modalities to be met in this regard. The duration of the exclusion may in no case exceed five years.

                    Mijnheer de voorzitter, wij zullen onderhavig wetsontwerp steunen, al is het maar, omdat het een formele erkenning inhoudt van de mantelzorgers, wier rol in onze samenleving vandaag niet mag worden onderschat. Integendeel, wij kunnen die niet genoeg onderstrepen.

Wanneer men weet dat tegen 2020 het aantal 80-plussers met 25 % zal toenemen, beseft men dat ook de nodige zorg zal toenemen en dan niet alles via voorzieningen geregeld zal kunnen worden. Wij zullen dan meer dan ooit een beroep moeten doen op mantelzorgers, familie, buren en vrienden. Wij noemen dat de vermaatschappelijking van de zorg, een nieuwe evolutie, waarmee wij rekening zullen moeten houden. De mantelzorgers spelen daar een zeer belangrijke rol in.

De nieuwe wet brengt geen gevolgen met zich voor de mantelzorgers die erkend worden. Het gaat veeleer om een symbolische erkenning. Wij van CD&V zijn ook niet meteen vragende partij voor een mantelzorgstatuut, dat aanleiding kan geven tot professionalisering van de mantelzorg. Het eigene van mantelzorg is precies dat zij kosteloos, onbaatzuchtig en spontaan plaatsvindt, zonder betaalde prestaties. Volgens ons mag dat niet in het gedrag komen. Laat mantelzorg zijn wat het is, het kan niet de bedoeling zijn dat zij geprofessionaliseerd wordt.

Wat wij wel willen, is het volgende.

Ten eerste, willen wij dat de mantelzorger beter beschermd wordt. Dat kan bijvoorbeeld doordat erkende mantelzorgers een goede verzekering kunnen sluiten.

Ten tweede, lijkt het ons belangrijk dat men de mantelzorger vooral ondersteuning en vorming aanbiedt, zodat hij zijn vrijwilligerswerk op een nog betere manier kan opnemen. Dat kan ook een versterking inhouden van het netwerk van de onthaal- en opvangcentra, aanvullende thuiszorg, oppasdiensten en dergelijke meer. Ook de vakantiestelsels, de fiscaliteit en dergelijke moeten wij beter afstemmen op de noden van de mantelzorger.

Ten derde, moeten de mantelzorgers, die zich spontaan inzetten, ook kunnen rekenen op de formele zorg. Zij moeten een zorggarantie krijgen, in de vorm van zelfstandige verpleegkundigen, thuiszorg, verzorgenden, huisartsen en dergelijke meer.

Ten vierde, moet er voor mantelzorgers een duidelijker informatieaanbod komen, zodat zij niet alles zelf moeten uitzoeken. Nu moeten zij dikwijls op zoek gaan naar informatie over tegemoetkomingen en dergelijke. Dat moet beter ondersteund worden, via de ziekenfondsen, via de mantelzorgverenigingen, via de OCMW’s. Er moet een soort informatieconsulent zijn die de mantelzorgers wegwijs maakt in alle mogelijke praktische, administratieve en financiële zaken.

Mr. Speaker, we will support this bill, even if it is, because it constitutes a formal recognition of the caregivers, whose role in our society today cannot be underestimated. On the contrary, we cannot emphasize them enough.

Let mantel care be what it is, it may not be the intention of it being professionalized.

What we want is the following.

First, we want the caregiver to be better protected. This can be done, for example, because certified caregivers can make a good insurance.

Second, it seems to us important that the caregiver is primarily provided with support and training so that he can incorporate his volunteer work in an even better way. This could also include strengthening the network of reception and reception centers, supplementary home care, nursing services and the like. Also the holiday systems, the taxation and the like, we need to better align with the needs of the caregiver.

Third, caregivers, who are spontaneously engaged, should also be able to rely on formal care. They should receive a care guarantee, in the form of self-employed nurses, home care, caregivers, general physicians and the like.

Fourth, there must be a clearer offer of information for caregivers so that they do not have to find out everything themselves. Now they often have to look for information about benefits and the like. This should be better supported, through the health funds, through the mantel care associations, through the OCMWs. There must be a kind of information consultant that guides the caregivers in all possible practical, administrative and financial matters.

                    Monsieur le président, monsieur le secrétaire d'État, le projet qui nous est soumis aujourd'hui est une initiative positive qui permettra d'avoir un ancrage légal de la reconnaissance des aidants proches pour l'avenir. Toutefois, force est de constater que sa portée est minimale car il n'accorde qu'une reconnaissance symbolique, que nous ne sous-estimons pas, mais ne propose aucun statut aux personnes qui rentreraient dans son champ d'application. Ce texte ne répond d'ailleurs que partiellement aux revendications du secteur. Un travail de préparation considérable avait pourtant été fourni avec les associations concernées. Ce texte n'aborde pas les conséquences dans les domaines sociaux et juridiques.

L'assistance envers un patient, une personne malade ou dépendante se manifeste souvent par une présence régulière de l'entourage, des soins et du réconfort. Le handicap, la vieillesse, la maladie sont des aléas de la vie qu'il est parfois difficile d'assumer seul. La personne en souffrance doit pouvoir se faire aider. Quoi de plus naturel que de recevoir l'aide d'un proche parent ou d'amis? Il arrive souvent que cette personne proche sacrifie sa profession pour se libérer du temps et le consacrer à la personne nécessitant son aide. Il n'est pas rare de tout abandonner: sa profession, les droits et les protections sociaux y afférents, pour se consacrer à son proche.

C'est pourquoi nous plaidons pour instaurer un véritable statut social de l'aidant proche afin de lui assurer la garantie de droits sociaux lorsqu'il consacre son temps à aider. Nous voulons lui offrir une protection dans les domaines des soins de santé, du chômage, des allocations familiales et de la pension. Celui qui doit interrompre ses activités professionnelles pour s'occuper d'un proche malade ne peut valoriser cette période pour ses droits à la pension. C'est injuste et nous voulons supprimer cette injustice.

Monsieur le secrétaire d'État, chers collègues, le groupe MR soutiendra ce projet de loi parce qu'il s'agit d'une initiative positive, d'une première étape qui permettra d'avoir un ancrage légal de la reconnaissance des aidants proches pour l'avenir.

Assistance to a patient, a sick or dependent person is often manifested by a regular presence of the surrounding, care and comfort. Disability, old age, illness are life difficulties that are sometimes difficult to assume alone. The suffering person must be able to get help. What can be more natural than getting the help of a close relative or friends? It often happens that this close person sacrifices his profession to free up time and devote it to the person who needs his help. It is not uncommon to abandon everything: his profession, the rights and social protections associated with it, to devote himself to his loved one.

That is why we advocate for the establishment of a real social status of the close assistant in order to ensure the guarantee of social rights when he devotes his time to help. We want to offer them protection in the areas of health care, unemployment, family allowances and pensions. A person who has to interrupt his professional activities in order to take care of a close sick person cannot value this period for his pension rights. This is unfair and we want to eliminate this injustice.

Mr. Secretary of State, dear colleagues, the MR group will support this bill because it is a positive initiative, a first step that will allow to have a legal anchor of the recognition of close carers for the future.

                    Monsieur le président, monsieur le secrétaire d'État, chers collègues, le travail sur la reconnaissance de droits pour les aidants proches est un sujet que nous examinons en notre qualité d'écologistes depuis des années. Nous attendions donc un résultat au niveau fédéral depuis très longtemps.

Ce projet de loi s'est basé sur une étude menée en collaboration avec des associations d'aidants et donc de parents de personnes handicapées, de personnes ayant des maladies graves, de personnes en situation de dépendance. Nous aurions ainsi voulu que le projet de loi déposé par le gouvernement non seulement identifie un aidé – les caractéristiques de la personne qui a besoin d'aide – et un aidant – la personne qui, dans une relation de confiance, apporte une aide dans la gestion de sa vie quotidienne et au niveau des soins – mais prévoie également que cette personne qui, soit ne travaille pas, soit cesse de travailler pour remplir cette tâche, puisse préserver des droits essentiels, dont le droit à l'allocation de chômage, même si elle ne répond pas aux obligations de disponibilité sur le marché du travail. Il en va de même pour la personne qui bénéficie d'un revenu d'intégration et pour la personne qui arrête de travailler à temps partiel ou à temps plein qui devrait conserver toute une série de droits, relatifs notamment à sa pension.

Hélas, ce projet ne rencontre pas ces droits que nous attendions! Certes, reconnaître l'existence et dénommer ces personnes, sans toutefois leur accorder un statut est un premier pas. Aucune des propositions sur la table ne demandait un réel statut, mais des maintiens de droits. On reconnaît enfin l'existence de la relation entre un aidant et un aidé, mais on n'y assortit aucun droit.

En commission, j'ai évidemment défendu l'octroi de ces droits. J'ai entendu un secrétaire d'État expliquer les limites auxquelles il était parvenu dans les négociations gouvernementales. J'ai entendu des parlementaires de la majorité réclamer l'octroi de certains droits et regretter qu'ils ne soient pas joints au projet de loi.

En conséquence, je me suis permis aujourd'hui de déposer trois amendements relatifs à deux sujets sans incidence budgétaire. Dès lors, je ne vois aucune raison de les refuser. Deux amendements stipulent simplement que la personne reconnue comme aidante ne devra pas se montrer disponible sur le marché du travail aussi longtemps que ce statut d'aidant lui est reconnu.

Mr. Speaker, Mr. Secretary of State, dear colleagues, the work on the recognition of rights for close caregivers is a topic that we have been examining as environmentalists for years. Therefore, we have been waiting for a result at federal level for a long time.

This bill was based on a study conducted in collaboration with associations of caregivers and therefore parents of people with disabilities, people with serious diseases, people in dependence situation. We would have thus wished that the bill submitted by the government not only identifies a aided – the characteristics of the person who needs help – and a caregiver – the person who, in a relationship of trust, provides assistance in the management of his daily life and at the level of care – but also provides that that person who either does not work or ceases to work to fulfill this task can retain essential rights, including the right to unemployment allowance, even if he does not meet the obligations of availability on the labour market. The same applies to the person who benefits from an integration income and to the person who stops working part-time or full-time, who should retain a whole range of rights, in particular relating to his pension.

Unfortunately, this project does not meet the rights we expected! Certainly, acknowledging the existence and naming these persons without granting them a status is a first step. None of the proposals on the table demanded a real status, but maintenance of rights. Finally, the existence of the relationship between a caregiver and a caregiver is recognised, but there is no right to it.

In the committee, I obviously defended the granting of these rights. I heard a secretary of state explain the limits he had reached in government negotiations. I have heard members of the majority parliament call for the granting of certain rights and regret that they are not attached to the bill.

As a result, today I have been able to submit three amendments on two subjects with no budgetary impact. I see no reason to refuse them. Two amendments simply stipulate that the person recognized as a caregiver will not have to be available on the labour market as long as this status as a caregiver is recognized to him.

D'une manière plus globale, j'aurais également voulu dire, concernant cette matière complexe de la relation entre un aidant et un aidé, qu'il faut situer cette avancée dans un contexte où les pouvoirs publics, tous niveaux de pouvoir confondus, s'engagent à développer au maximum les services à la disposition de ces personnes qui se retrouvent en situation de dépendance. Il est exclu que la reconnaissance d'un aidant ou une aidante remplace des services et qu'on se retrouve avec des personnes qui ne travaillent pas ou qui arrêtent de travailler tout simplement parce que les services mis en place par la collectivité sont défaillants.

Un autre élément important est repris dans le projet. Dans notre proposition, c'était un élément vraiment capital: c'est que plusieurs personnes puissent assumer ce rôle d'aidant auprès de la personne aidée. Aujourd'hui, on se rend compte qu'en général, c'est une femme qui arrête de travailler pour s'occuper de son enfant, de son parent, de son frère ou de sa sœur. La personne qui fait cela et qui arrête totalement de travailler sort du milieu professionnel et dès lors aussi de son environnement social. Dès lors, il y a non seulement discrimination et charge sur un des membres de la famille ou d'un ménage, mais aussi perte de lien social et isolement.

Par ailleurs, je voudrais insister sur un élément d'importance pour nous, mais qui n'est pas repris dans le projet de loi, c'est qu'aidants et aidés doivent pouvoir construire une relation en sachant ce qu'ils font. Parfois, on se lance dans une relation d'aidant et d'aidé parce qu'on veut bien faire, parce qu'on pense qu'on n'a pas d'autre solution, ou parce que c'est vraiment un choix de vie qu'on fait à un moment donné.

On se rend compte que cette relation n'est pas toujours facile. C'est une relation entre deux personnes qui sont dans des situations différentes; parfois, on peut assister à des situations de maltraitance aussi bien de l'aidé que de l'aidant. Dès lors, il nous semblait utile que cette relation soit accompagnée par des associations qui regroupent, forment et informent les aidants proches.

It is excluded that the recognition of a caregiver or caregiver replaces services and that you find yourself with people who are not working or who stop working simply because the services set up by the community are failing.

Another important element is reflected in the project. In our proposal, this was a really crucial element: it is that several people can assume this role of assistant with the person helped. Today, we realize that in general, it is a woman who stops working to take care of her child, parent, brother or sister. The person who does this and who stops working completely leaves the professional environment and therefore also his social environment. Therefore, there is not only discrimination and burden on one of the members of the family or a household, but also loss of social bond and isolation.

Furthermore, I would like to insist on one element of importance for us, but which is not included in the bill, is that assistants and assisted must be able to build a relationship knowing what they are doing. Sometimes you get into a relationship of help and help because you want to do well, because you think you have no other solution, or because it is really a life choice that you make at a given moment.

We realize that this relationship is not always easy. It is a relationship between two people who are in different situations; sometimes, one can witness situations of abuse both of the assisted and the assistant. Therefore, it seemed useful for us that this relationship should be accompanied by associations that gather, train and inform close caregivers.

                    Je n'ai pas déposé d'amendement à cet égard, car cela ne semblait pas urgent. Nous savons que la reconnaissance d'associations d'aidants repose sur plusieurs compétences et que les Régions ont aussi un rôle à jouer en ce domaine. En tout cas, il importe que les mutuelles reconnaissent les caractéristiques d'une personne à aider ainsi que le statut d'aidant. De la sorte, une association pourrait encadrer et offrir des formations régulières. Elle apporterait aussi un soutien lorsque la relation est difficile ou quand on ne sait plus très bien comment réagir face à l'autre.

Monsieur le président, ce texte représente un premier pas, certes modeste, mais nécessaire. Nous regrettons l'absence d'un minimum de droits associés à cette reconnaissance de l'aidant proche. Je vais donc déposer trois amendements afin qu'ils soient soumis au vote demain.

                    Monsieur le président, monsieur le ministre, chers collègues, lorsque ce projet est venu en commission, il y a une quinzaine de jours, le secteur des aidants proches a salué ce moment comme une victoire ou, en tout cas, comme un moment historique. Cela a d'ailleurs été présenté comme tel par la présidente de l'Association francophone des Aidants proches. Ce texte était attendu depuis très longtemps et il sera soutenu, je l'espère largement, par cette assemblée. Je ne sais pas si le vote sera unanime mais tous les groupes se sont prononcés en faveur de ce projet.

C'est certainement une première étape qui consiste en une procédure pour une reconnaissance sociale de ces personnes qualifiées d'aidants proches. Nos amis québécois les appellent les aidants naturels. On dit aussi que ces aidants sont un peu surnaturels car ce sont des personnes qui donnent beaucoup d'elles-mêmes pour leurs proches, pas nécessairement pour un membre de la famille. Il y a aussi beaucoup de solidarité, de générosité dans ces actions. On sait par ailleurs qu'un grand nombre de familles sont sous la pression du quotidien, qui occupe 24 h / 24 parfois. Ces personnes attendent une reconnaissance sociale mais aussi un statut qui les aide dans la vie de tous les jours, dans leurs relations avec les autorités, les administrations.

Monsieur le ministre, vous engagez ici une dynamique législative importante, à nos yeux irréversible. Vous avez ouvert une porte qui ne se refermera pas. Les aidants proches sont en voie de reconnaissance grâce à ce projet de loi. Bien entendu, derrière, il y a tout un travail qui débutera durant la prochaine législature pour concrétiser et voir comment décliner, dans les relations avec la sécurité sociale, les parastataux sociaux, cette aide que la société doit apporter à ces personnes qui en ont réellement besoin, qui sont parfois réellement épuisées.

On l'a encore vécu ce matin. Aujourd'hui, c'est la Journée mondiale de l'autisme. Vous étiez ce matin en dialogue avec le secteur et les familles concernées par cette problématique.

Tout le secteur était en attente de ce projet de loi, d'un signal du parlement. Ce signal, nous allons le donner aujourd'hui.

Ces personnes sont très nombreuses, si on ne se limite pas à une définition trop restrictive de la notion temporelle de l'activité consacrée par nos concitoyens à l'aide et au soutien d'une personne en situation de grande dépendance. Ils sont aussi très nombreux par rapport à leur appréciation personnelle ou affective de ce qu'ils considèrent être une situation de grande dépendance ou simplement comme une situation de grande détresse physique et/ou psychique.

We saw it again this morning. Today is World Autism Day. You were in dialogue this morning with the industry and the families involved in this issue.

The whole sector was waiting for this bill, a signal from parliament. This is the signal we are going to give today.

These people are very numerous, if not limited to a too restrictive definition of the temporal notion of the activity devoted by our fellow citizens to helping and supporting a person in a situation of great dependence. They are also very numerous in relation to their personal or emotional appreciation of what they consider to be a situation of great dependence or simply as a situation of great physical and/or psychological distress.

                    Notre groupe veut, en tout cas, rendre hommage à toutes ces personnes. Nous demandons que l'arrêté royal qui déterminera "les personnes de grande dépendance" – ce sont les termes retenus dans ce projet de loi – ne fasse pas l'objet de polémiques entre experts avec, in fine, un arbitrage budgétaire sur ceux qui seraient reconnus en situation de grande dépendance et ceux qui ne seraient pas reconnus comme tels.

Toujours est-il que, pour l'avenir, notre groupe a trois exigences pour que l'aidant proche, enfin reconnu, ne vienne dédouaner la société de ses responsabilités. Ainsi, la responsabilité engagée de l'aidant proche ne peut être ni une entrave à sa vie professionnelle et familiale, ni une fonction contraignante, ni une décision définitive, une personne pouvant décider de stopper cette fonction. Ces trois principes doivent se trouver au cœur d'un projet qui articule adéquatement la liberté du citoyen, la liberté de chacun avec les connaissances et les exigences d'un encadrement collectif qui respecte une aide librement consentie, mais qui pose des exigences fondamentales par rapport à la prise en charge de la grande dépendance.

Chers collègues, il va de soi que le groupe socialiste soutiendra avec enthousiasme le projet qui nous est présenté aujourd'hui.

Ik meen dat het voor de Kamer evident is dat wij verder inzetten op het beschermen van minderjarigen tegen allerlei manieren om hen te benaderen via het internet en hen zo te beschermen tegen pedofilie. De voorgestelde wetgeving is goed en wij hebben ze dan ook ondersteund.

Ik wil alleen maar een waarschuwing uiten: de kwaliteit van de wetgeving is niet altijd wat ze zou moeten zijn. De intenties zijn wel altijd goed, maar de kwaliteit laat soms wel wat te wensen over.

Grooming is het benaderen via het internet met het oog op een ontmoeting waarbij ook daden worden gesteld. Cyberlokking gaat enkel over het communiceren.

U moet weten, collega’s, dat op dat communiceren net zo zware straffen staan als op grooming. Het evenwicht lijkt mij hier dan ook zoek. De vork van strafmaat is groot. Ook het slachtoffer wordt anders omschreven. Bij het ene gaat het enkel om minderjarigen onder de 16, terwijl het hier gaat om andere minderjarigen. De poging van het ene kan al het misdrijf zijn van het andere. Er is een heel groot spanningsveld tussen beide misdrijven.

Ik wil de vergadering er toch op wijzen dat dit in de praktijk voor problemen kan zorgen, dat zal aanleiding geven tot casuïstiek. Ik heb daarover vragen gesteld in de commissie, maar heb daarop geen antwoorden gekregen.

Het lijkt mij hoe dan ook belangrijk om ter zake alert te zijn, want de voorgestelde wetteksten zullen in de toekomst misschien moeten worden aangepast, wil men ze in de praktijk goed werkbaar maken. Ik wou dat het halfrond toch nog even meegeven, mijnheer de voorzitter.

I think it is obvious for the Chamber that we are further committed to protecting minors from all kinds of ways of accessing them via the Internet and thus protecting them from pedophilia. The proposed legislation is good and we have therefore supported them.

I just want to make a warning: the quality of legislation is not always what it should be. The intentions are always good, but the quality sometimes leaves something to be desired.

Grooming is the approach through the Internet with a view to a meeting in which also actions are made. Cyberblocking is just about communicating.

You should know, colleagues, that that communication is punished as severely as grooming. The balance seems to be sought here. The penalty rate is large. The victim is also described differently. One concerns only minors under the age of 16, while this concerns other minors. The attempt of one can be all the crime of the other. There is a very large field of tension between the two crimes.

However, I would like to point out to the meeting that this can cause problems in practice, which will give rise to casuisticism. I have asked questions about this in the committee, but I have not received any answers.

In any case, it seems to me important to be alert in this regard, as the proposed legislative texts may need to be adjusted in the future in order to make them workable in practice. I would like to give the half-circle a moment, Mr. Speaker.

                    Mijnheer de voorzitter, collega’s, de minister heeft in de eerste plaats getracht om met het voorliggend ontwerp de afstemming te realiseren van twee wetten die zich allebei min of meer in hetzelfde kader bevinden, namelijk de wet op de verontreiniging en de wet op het mariene milieu.

Daar is een heel proces aan voorafgegaan om ervoor te zorgen dat in de praktijk alle diensten mee aan tafel zitten, zowel op het federale als op het gewestelijke vlak, zodat de bestraffing ook effectief kan worden.

In de commissie werden enkele vragen ter verduidelijking gesteld, met name over de interpretatie van bepaalde elementen. De minister heeft daar uitvoerig op geantwoord. Het project is dan ook aangenomen.
