Monsieur le président, monsieur le ministre, chers collègues, dans le cadre de notre débat de ce jour, j'aborderai deux aspects concernant les compétences de M. le ministre Dewael.
Pour ce qui concerne la sécurité civile, le gouvernement a tenu sa parole d'augmenter le budget de cette division organique et ce, depuis plusieurs années. Le secteur de la sécurité civile, vital pour la sécurité de nos concitoyens, se voit ainsi refinancé de plus de 5% par le fédéral, à votre initiative, monsieur le ministre. Un premier effort avait déjà été consacré l'année dernière. Nous pouvons donc nous réjouir de la constance de l'effort entamé à votre initiative. Nous tenons à vous en féliciter.
Toutefois, les études financières montrent que le coût des ces services, et plus particulièrement des services régionaux d'incendie, est en constante augmentation. Les analyses réalisées par Dexia démontrent que les surcoûts et les augmentations de ces dernières années dépassent largement le cadre d'un accroissement normal des dépenses pour les communes. Or plus de 90% des dépenses pour les services d'incendie sont à charge des communes. Voilà pourquoi l'Union des villes et communes revendique un effort plus important de la part du fédéral pour supporter le coût de ces services.
Monsieur le ministre, vous conviendrez avec nous que cette situation n'est plus tenable compte tenu des finances des communes. On comprendra parfaitement le message qui vous a été adressé: elles ne sont plus prêtes à supporter des coûts supplémentaires dans le cadre du projet de réforme.
Ce n'est pas aujourd'hui le moment de se lancer dans l'analyse de ce projet de réforme; il viendra en temps et en heure. Nous arrivons au bout du travail et nous pouvons nous réjouir que la commission Paulus arrive à des propositions très concrètes. Même si l'on entend occasionnellement des voix discordantes sur l'unanimité annoncée quant aux résultats de cette commission, nous pouvons être persuadés de la qualité des travaux réalisés.
Il conviendrait aussi de rappeler que l'annonce de cette augmentation de 5%, même si nous pouvons nous en réjouir - et nous vous en félicitons encore —, a fait un flop au niveau des services d'incendie, car ils espéraient beaucoup plus. Il vous appartient à présent de dresser un timing très précis de vos démarches futures envers ces services, tout comme il vous appartient de nous annoncer ce que vous comptez entreprendre relativement au financement de ces services. Vous nous avez annoncé et répété à maintes reprises que les surcoûts entraînés par la réforme seraient à charge de l'Etat et non des communes. Cet élément est important.
L'accord de gouvernement prévoit des possibilités alternatives de financement. Je pense ici notamment à l'intervention des sociétés d'assurances.
Faut-il rappeler que ces sociétés ont connu une augmentation de leur chiffre d'affaires pour les contrats "incendie" de plus de 300 millions d'euros en 4 ans alors que la charge "sinistre" n'atteint plus 50% de ce montant? Nous nous interrogeons donc sur la possibilité de solliciter les services d'incendie. Nous essaierons de dégager des moyens supplémentaires dans ce cadre. Nous insistons aussi sur la nécessité d'une plus grande participation de ceux qui génèrent des risques; je pense, par exemple, au transport routier ou par rail.
J'en arrive au deuxième objet de mon intervention, les contrats de sécurité.
Vous le savez, notre parti est attaché à une politique communale de prévention, autrement dit à la pérennité des contrats de sécurité et de prévention. Ceux-ci favorisent une cohabitation harmonieuse de tous les citoyens dans nos communes et ce, quels que soient leur condition sociale et le quartier où ils habitent. Le premier ministre s'en est félicité, il y a quelques semaines, en recevant les acteurs de la prévention. Ces éducateurs, ces travailleurs sociaux font de l'excellent travail. Au regard de ce qui s'est passé en France dernièrement, nous pouvons estimer que nous avons probablement posé les bons choix au bon moment et que les dispositifs mis en place fonctionnent très bien. Nous devons les encourager. Cela nécessite évidemment des moyens.
Quel n'a pas été notre étonnement lorsque nous avons constaté que, cette année, une fois de plus, le budget des contrats de sécurité n'a pas été indexé! Cela signifie que ce dernier a diminué de fait, notamment compte tenu de l'augmentation des frais de fonctionnement, de l'indice des prix et des coûts de personnel. C'est inacceptable. En effet, cela fragilise les dispositifs de prévention de ce secteur alors qu'il a besoin de stabilité et de moyens supplémentaires. Cette absence d'indexation est d'ailleurs contradictoire avec les récentes déclarations positives du premier ministre sur les contrats de sécurité et de prévention et avec l'excellent travail réalisé par les différents acteurs de ce secteur.
Monsieur le ministre, en commission, lors de la discussion du budget, en réponse à une question de mon excellent collègue, André Frédéric, vous vous étiez engagé à revoir à la hausse le budget global des contrats de sécurité ainsi qu'à les étendre. Je souhaiterais savoir quelles sont les échéances précises à ce sujet.
Par ailleurs, je voudrais proposer au gouvernement l'indexation des contrats de sécurité et de prévention lors du prochain ajustement budgétaire. Ce serait mieux que rien! Nous souhaiterions que vous nous confirmiez que l'indexation 2006 des contrats de sécurité est bel et bien prévue. Un rattrapage des années précédentes serait aussi peut-être à envisager.

Mr. Speaker, Mr. Minister, Ladies and Gentlemen, as part of our debate today, I will address two aspects concerning Mr. Speaker’s competence. The Minister Dewael.
Regarding civil security, the government has kept its promise to increase the budget of this organic division for several years. The civil security sector, vital for the safety of our fellow citizens, is thus refinanced by more than 5% by the federal, on your initiative, Mr. Minister. A first effort had already been devoted last year. We can therefore welcome the continuity of the effort undertaken on your initiative. We would like to congratulate you.
However, financial studies show that the cost of these services, and more specifically of regional fire services, is steadily increasing. Analysis by Dexia shows that the surplus costs and increases in recent years far outweigh the framework for a normal increase in expenditure for municipalities. More than 90% of the expenditure for fire services is borne by the municipalities. That is why the Union of Cities and Municipalities demands a greater effort on the part of the federal to bear the cost of these services.
Mr. Minister, you will agree with us that this situation is no longer sustainable given the municipal finances. You will fully understand the message that has been sent to you: they are no longer ready to bear additional costs as part of the reform project.
This is not the time to start the analysis of this reform project; it will come in time and time. We are coming to the end of the work and we can look forward to the Paulus committee coming up with very concrete proposals. Even if we occasionally hear discordant voices about the unanimity announced regarding the results of this commission, we can be convinced of the quality of the work carried out.
It would also be worth remembering that the announcement of this 5% increase, although we can look forward to it – and we congratulate you again – made a flop at the level of fire services, as they hoped much more. It is now up to you to set a very precise timing of your future steps towards these services, just as it is up to you to tell us what you intend to undertake in relation to the financing of these services. You have announced and repeatedly repeated to us that the surplus costs incurred by the reform would be borne by the state and not the municipalities. This element is important. by
The government agreement provides for alternative financing possibilities. This includes the intervention of insurance companies. by
Should we recall that these companies have experienced an increase in their turnover for "fire" contracts of more than 300 million euros in 4 years while the "sinister" charge no longer reaches 50% of this amount? Therefore, we ask ourselves about the possibility of applying for fire services. We will try to raise additional resources in this context. I come to the second subject of my speech, security contracts.
You know, our party is attached to a municipal policy of prevention, that is to say, to the durability of security and prevention contracts. These promote a harmonious cohabitation of all citizens in our communes, regardless of their social condition and the neighborhood where they live. The Prime Minister welcomed this, a few weeks ago, by receiving the actors of prevention. These educators, these social workers do an excellent job. Given what has happened in France recently, we can estimate that we have probably made the right choices at the right time and that the devices set up work very well. We must encourage them. What was not our surprise when we found that this year, once again, the security contract budget was not indexed! This means that the latter has actually decreased, in particular due to the increase in operating costs, the price index and personnel costs. This is unacceptable. Indeed, this weakens the prevention arrangements of this sector while it needs stability and additional resources. This absence of indexation is contradictory to the recent positive statements of the Prime Minister on security and prevention contracts and to the excellent work done by the various actors in this sector. by
Mr. Minister, in the committee, during the discussion of the budget, in response to a question from my excellent colleague, André Frédéric, you were committed to revising the overall budget of security contracts and to extend them. I would like to know what the exact deadlines for this matter are.
In addition, I would like to propose to the government the indexation of security and prevention contracts in the next budget adjustment. It would be better than nothing! We would like you to confirm that the 2006 indexation of security contracts is indeed planned. A recapture of previous years may also be considered.

Monsieur le président, monsieur le ministre, chers collègues, depuis plusieurs jours, la presse a révélé au grand public l'histoire d'une jeune journaliste de nationalité mongole et de son fils, que les autorités ont expulsés du territoire belge, et cela après cinq années de vie en Belgique.
Vous n'êtes pas sans savoir que, dans son pays, cette jeune fille et son fils courent un risque. Pourtant, de nombreuses associations de protection des droits de l'homme ainsi que la Fédération internationale des journalistes étaient intervenues en leur faveur pour attirer votre attention afin de démontrer aux autorités compétentes les graves dangers encourus par cette journaliste dans son pays. Je rappelle qu'elle a écrit plusieurs articles dénonçant la discrimination qui règne là-bas.
D'autres problèmes se posent également. Nous pensons ici au suicide d'un ressortissant du Bangladesh dans un centre fermé du Limbourg le jeudi 8 décembre dernier. Il apparaît que cette personne aurait tenté une première fois de mettre fin à ses jours à la suite du refus de sa demande d'asile en novembre dernier. Malheureusement pour lui, aucune assistance psychologique, aucun suivi ne lui auraient été apportés.
Selon les informations dont je dispose, l'Office des étrangers semble avoir changé sa politique en termes de prorogation de l'ordre de quitter le territoire. Dorénavant, une prorogation de l'ordre de quitter le territoire ne sera uniquement accordée que si une date est fixée pour un retour assisté par l'Organisation internationale des migrations. Il faudrait donc comprendre qu'il n'y aurait plus de prorogation pour des personnes qui sont dans l'impossibilité de retourner dans leur pays pour différentes raisons, notamment de guerre ou de sécurité. Ce sera le cas pour des Somaliens à partir du 1 er janvier. Ils ne sauront simplement pas où aller. Vous connaissez la situation de la Somalie, qui n'est pas le seul pays à connaître cette situation de guerre.
Enfin, dois-je vous rappeler la situation inquiétante des nombreux enfants détenus dans les centres fermés. Ils seraient actuellement une soixantaine. Combien d'entre eux passeront les prochaines fêtes enfermés? Le Haut commissariat aux réfugiés des Nations unies vient de réagir fermement contre ce genre de pratiques contraires en de nombreux points à la Convention internationale des droits de l'enfant.
Avec d'autres parlementaires, j'ai dépose une proposition de résolution et une proposition de loi afin de trouver une alternative à cette pratique qui nous condamne aux yeux de la communauté internationale.
Par rapport à ces faits, plusieurs questions se posent. En ce qui concerne Mme Tserensodnom et son fils, pourriez-vous faire le point sur leur situation actuelle et leur sécurité en Mongolie?
En ce qui concerne le suicide que j'ai évoqué, ne pensez-vous pas qu'il serait opportun d'enquêter sur ce fait? Qu'en est-il du suivi psychologique des personnes qui se voient refuser l'asile? Enfin, confirmez-vous le changement de la politique de l'Office des étrangers de ne plus proroger les ordres de quitter le territoire dans les cas évoqués précédemment.
Monsieur le ministre, permettez-nous de vous faire part de notre profonde inquiétude pour ces faits cités mais également, de manière générale, nous nous interrogeons sur les conditions d'expulsion et de détention des sans-papiers. Il est urgent, monsieur le ministre, de réagir contre l'accumulation de ces incidents et drames en Belgique, pays démocratique, moderne, ouvert et profondément respectueux des droits de l'homme et de la condition humaine. Je m'étonne que ces cas arrivent maintenant, au moment où le gouvernement s'est mis d'accord sur le statut de protection subsidiaire qui aurait certainement pu être accordé aux personnes que je viens d'évoquer.

Mr. Speaker, Mr. Minister, dear colleagues, for several days, the press has revealed to the general public the story of a young journalist of Mongolian nationality and her son, whom the authorities expelled from Belgian territory, and this after five years of living in Belgium.
You are not without knowing that, in her country, this girl and her son are at risk. Nevertheless, many human rights associations as well as the International Federation of Journalists had intervened in their favour to draw your attention in order to demonstrate to the competent authorities the serious dangers this journalist faces in his country. I recall that she has written several articles denouncing the discrimination that reigns there.
Other problems also arise. We think here of the suicide of a Bangladesh citizen in a closed centre in Limburg on Thursday, December 8, last year. It appears that this person had attempted to put an end to his days for the first time following the refusal of his asylum application last November. Unfortunately for him, no psychological assistance, no follow-up would have been provided.
According to the information I have, the Foreign Office seems to have changed its policy in terms of extending the order to leave the territory. From now on, an extension of the order to leave the territory will only be granted if a date is fixed for a return assisted by the International Organization for Migration. It should therefore be understood that there would no longer be an extension for persons who are unable to return to their country for various reasons, including war or security. This will be the case for Somali citizens from 1 January. They will simply not know where to go. You know the situation in Somalia, which is not the only country that is experiencing this war situation.
Finally, I must remind you of the worrying situation of the many children detained in closed centres. They would be about sixty now. How many of them will spend the next closed holidays? The United Nations High Commissioner for Refugees (UNHCR) has recently reacted firmly against this type of practices that are contrary to the International Convention on the Rights of the Child in many points.
Together with other parliamentarians, I have submitted a resolution and a bill to find an alternative to this practice that condemns us in the eyes of the international community.
In relation to these facts, several questions arise. With regard to Ms. Tserensodnom and her son, could you comment on their current situation and their security in Mongolia?
With regard to the suicide I mentioned, do you not think it would be appropriate to investigate this fact? What about the psychological follow-up of people who are denied asylum? Finally, confirm the change in the policy of the Foreign Office to no longer extend orders to leave the territory in the cases mentioned above.
Mr. Minister, let us express our deep concern for these facts, but also, in general, we ask ourselves about the conditions of expulsion and detention of undocumented persons. It is urgent, Mr. Minister, to react against the accumulation of these incidents and dramas in Belgium, a democratic, modern, open and deeply respectful country of human rights and human condition. I am surprised that these cases happen now, at a time when the government has agreed on the subsidiary protection status that ⁇ could have been granted to the people I just mentioned.

Monsieur le ministre, je souhaitais également vous interroger à propos du cas de Mme Tserensodnom, journaliste mongole qui a été expulsée le 11 décembre dernier. Pouvez-vous me donner des explications quant au contexte de ce cas, qui me semble assez exemplaire de la manière dont ces questions sont traitées en Belgique?
Il faut rappeler que Mme Tserensodnom et son fils de dix ans ont fui la Mongolie et sont arrivés en Belgique en octobre 2000. En mars 2001, ils ont introduit une demande d'asile. Son fils effectuera cinq années primaires à Eupen et ensuite à Verviers, où il résidera avec sa maman. Il sera premier de classe et suivra des cours de musique. La mère et le fils se lieront d'amitié avec les enfants de l'école et les parents.
La demande d'asile de Mme Tserensodnom a été traitée le 21 décembre 2001; elle a été déboutée en recevabilité de sa demande d'asile mais son avocat a introduit un recours en annulation au Conseil d'Etat contre la décision négative du CGRA.
A ce jour, aucune décision n'a été rendue par le Conseil d'Etat alors qu'entre-temps, elle a déjà été expulsée.
Comme mon collègue M. Boukourna l'a signifié, la demande d'asile a été justifiée par sa situation en tant que journaliste, par les faits qu'elle avait eus à connaître dans son pays en sa qualité de journaliste, les écrits qu'elle avait produits et des informations qu'elle avait pu glaner, ainsi que par une attaque dont elle aurait été la cible. En dehors des prises de position d'Amnesty International entre autres, je vous rappelle que la Fédération Internationale des Journalistes (FIJ) faisait savoir que Mme Tserensodnom courait un risque réel si elle retournait en Mongolie dans l'état actuel des choses et vous a adressé un courrier en date du 22 novembre qui donne un élément important. La FIJ vous disait ceci: "Notre requête ne nous paraît pas disproportionnée eu égard aux risques que court Mme Tserensodnom dans son pays d'origine, en particulier dans un État de droit respectueux de la liberté de la presse tel que la Belgique."
Il y a eu une décision de l'Office, suivie par celle du CGRA et un recours toujours pendant. Certaines des objections soulevées me semblent pourtant être pertinentes dans l'examen de ce dossier. Par ailleurs, Mme Hana Tserensodnom a introduit une demande de séjour basée sur l'article 9, alinéa 3, le 3 août 2005. Alors qu'aucune décision n'avait été rendue ni par le Conseil d'État ni par l'Office des étrangers au sujet de sa demande de séjour et alors que cette dame et son enfant résidaient en Belgique depuis près de cinq ans sans poser le moindre problème, elle est arrêtée par la police et conduite le jour même avec son fils au centre fermé de Melsbroek pour être transférée par la suite au 127bis où elle a séjourné avec son enfant pendant quatre mois. On retrouve la problématique de l'enfermement des enfants puisque ce petit garçon a passé quatre mois dans un centre fermé, ce qui me semble exemplatif de la situation.
La demande de régularisation a été rejetée le 7 novembre 2005 et son avocat en est avisé sans connaître la motivation du refus. Une seconde demande de régularisation est introduite le 23 novembre 2005 basée essentiellement sur les problèmes de santé de l'enfant: il est atteint d'un purpurin rhumatoïde qui le contraindra à un séjour de deux mois à l'hôpital et à six mois de chaise roulante. Il doit subir régulièrement des examens rénaux pour éviter d'aboutir à une insuffisance rénale grave. La demande se basait également sur l'intégration de la mère et de l'enfant au fil de leur séjour de cinq ans en Belgique, démontrée à suffisance dans leur dossier.
Monsieur le ministre, sans vouloir m'immiscer dans une décision qu'il ne me revient pas de prendre, mais que je peux commenter, des questions peuvent se poser sur ce cas et je souhaiterais que vous m'apportiez des éclaircissements sur les points suivants.

Parallèlement, votre administration s'empresse d'expulser une journaliste qui n'a pas eu accès à ce recours effectif et qui, de surcroît, est ressortissante d'un Etat où les journalistes sont persécutés de manière notoire.

Estimez-vous normal de procéder à l'expulsion d'une personne en demande de permis de séjour sans qu'il ait été statué sur sa demande, alors que des motifs médicaux et humanitaires sont invoqués et sans que la Cour de cassation ait pu examiner son pourvoi? Entre-temps, elle a pu le faire, mais elle a, comme à son habitude, relevé un défaut d'intérêt dans ce dossier. Néanmoins, la question porte sur le fait qu'il n'ait pas été statué sur la demande de permis de séjour (article 9, alinéa 3).
4. Ne serait-il pas grand temps de réfléchir sérieusement à la question du droit de séjour des personnes victimes des lenteurs de procédure? Dans le cas qui nous préoccupe, le dossier est à l'examen depuis cinq ans.

Ms. Tserensodnom and her 10-year-old son fled Mongolia and arrived in Belgium in October 2000. In March 2001, they filed an asylum application. His son will complete five primary years in Eupen and then in Verviers, where he will reside with his mother. He will be first in class and will take music lessons. Mother and son will be bound by friendship with school children and parents.
Mrs Tserensodnom’s application for asylum was handled on 21 December 2001; she was dismissed as admissible to her application for asylum but her lawyer brought an annulment appeal before the State Council against the negative decision of the CGRA.
So far, no decision has been made by the State Council, while in the meantime, she has already been expelled.
Like my colleague Mr. Boukourna meant it, the application for asylum was justified by her situation as a journalist, by the facts she had to know in her country as a journalist, the writings she had produced and information she had been able to gather, as well as by an attack of which she would have been the target. In addition to Amnesty International’s positions, I would like to remind you that the International Federation of Journalists (FIJ) was telling you that Ms. Tserensodnom was at real risk if she returned to Mongolia in the current state of affairs and sent you a letter dated November 22, which gives an important element. The FIJ told you this: “Our request does not seem disproportionate in view of the risks that Mrs. Tserensodnom carries in her country of origin, in particular in a rule of law respecting the freedom of the press such as Belgium.”
There was a decision of the Office, followed by that of the CGRA and an appeal still during. However, some of the objections raised appear to me to be relevant in the examination of this case. Furthermore, Ms. Hana Tserensodnom lodged a residence application based on Article 9(3) on 3 August 2005. While no decision had been made by either the State Council or the Office of Foreigners regarding her application for residence and while this lady and her child had resided in Belgium for almost five years without causing any problem, she is arrested by the police and taken the same day with her son to the closed centre of Melsbroek to be subsequently transferred to 127bis where she stayed with her child for four months. We find the problem of the imprisonment of children since this little boy spent four months in a closed center, which I think exemplifies the situation. by
The application for regularization was rejected on 7 November 2005 and his lawyer was notified without knowing the reasons for the refusal. A second application for regularization is introduced on 23 November 2005 based mainly on the child’s health problems: he is affected by a rheumatoid purpurin that will force him to a two-month hospital stay and six months in a wheelchair. He should regularly undergo renal examinations to avoid leading to severe renal failure. The request was also based on the integration of the mother and child during their five-year stay in Belgium, sufficiently demonstrated in their file. by

Monsieur le président, monsieur le ministre, dans le cadre du budget 2006, le groupe MR soutiendra avec conviction le projet du ministre de l'Intérieur. Je voudrais exprimer ici la position du groupe MR au sujet des principales thématiques mises en évidence dans la note de politique générale du ministre.
La carte d'identité électronique a fait l'objet de nombreux débats en commission de l'Intérieur. Monsieur le ministre, mon groupe vous a interrogé à diverses reprises sur ce sujet. Aujourd'hui, nous pouvons nous montrer satisfaits des garanties financières et organisationnelles offertes aux communes, ainsi que du succès global de l'entreprise. Ceci alors que, sur le fond, nous soutenons résolument l'entreprise et nous nous réjouissons des développements futurs qu'elle rend possible.
Le timing a par ailleurs été considérablement accéléré au profit du citoyen. Il y a donc lieu de vous féliciter pour la gestion de ce dossier.
Quelques questions ponctuelles m'apparaissent pourtant devoir être posées. Elles concernent l'idée suggérée dans la note de politique générale de l'an dernier d'augmenter le nombre d'informations sur la carte d'identité électronique.
Le ministre parlait du permis de conduire ou de la carte SIS. Ces projets ne se retrouvent plus dans la note de 2006. A priori, dans un souci de simplification administrative, ils paraissaient pourtant intéressants. Pour rappel, une proposition de Richard Fournaux propose l'ajout des données relatives au don d'organes et du groupe sanguin. Moi-même, j'ai déposé une proposition visant à intégrer le permis de conduire sur la carte d'identité électronique.
Monsieur le ministre, j'aimerais donc connaître votre position sur ces deux initiatives.
Pour ce qui concerne les élections, et toujours par rapport à la modernisation des services proposés aux citoyens, je voudrais revenir sur le vote automatisé.
Comme vous le savez, le groupe MR soutient ce dispositif en n'oubliant jamais qu'il doit aider les citoyens et non lui compliquer la vie. Oui, dès lors, au maintien du vote automatisé, mais sans doute convient-il, ainsi que le prévoit l'accord de gouvernement, que l'électeur soit informé par un fascicule accompagnant la lettre de motivation du déroulement exact du scrutin électronique. Cela n'avait pas été fait en 2004.
Il me paraît également important, alors qu'on réfléchit au remplacement du matériel, de relayer ici les attentes de mes collègues bruxellois. Les élections régionales bruxelloises proposent plus de 89 candidats au choix des électeurs. Il est un fait que les petits écrans actuels peinent à remplir cette tâche, et ce au détriment de l'égalité entre les candidats. Je crois vraiment que des solutions ad hoc doivent être proposées aux communes bruxelloises.
Dans le dossier du vote des Belges à l'étranger, monsieur le ministre, vous annonciez l'an dernier votre intention de remédier aux maladies infantiles de la législation de référence. Le groupe MR a déposé une proposition en ce sens. Il faudra en discuter avant le prochain scrutin fédéral et, pourquoi pas, élargir la réflexion au vote des Belges depuis l'étranger pour les régionales.
J'en viens à la réforme attendue de la procédure d'asile. Le contentieux des étrangers mérite une solution; vous en esquissez une dans votre note de politique générale. Du reste, je pense qu'elle fait l'objet d'un avant-projet de loi qui a reçu un accord du gouvernement.
Quel est le timing de ce dossier? Il importe aujourd'hui d'avancer dans ce dossier tant la procédure d'asile actuelle, de par son inertie, ne permet plus de répondre avec la célérité voulue aux candidats. Elle complique également largement la bonne application de l'ensemble de nos législations administrant les droits et obligations des étrangers.
Nous soutenons par ailleurs vos engagements relatifs à la lutte contre les mariages blancs et la fraude en matière de regroupement familial. Votre récente circulaire invitant les officiers d'état civil à échanger des informations en matière de tentative de mariage de complaisance était attendue. Nous avons voté votre dernier projet en la matière. Il faudra cependant aller plus loin dans la perspective de la nouvelle logique de la procédure d'asile.
En ce qui concerne la sécurité civile, je voudrais rappeler l'effort budgétaire qui a cours depuis l'an dernier. Nous attendons désormais les conclusions définitives de la commission Paulus ainsi que l'analyse des risques. Le financement de la réforme sera au centre de nos préoccupations. On ne pourra rééditer des approximations qui ont cours dans le système actuel de contribution.
Enfin, nous nous réjouissons de voir remises sur le métier les dispositions relatives aux critères d'activation du fonds des calamités. Ceci a été demandé à diverses reprises par mon groupe. Il est clair que le fonctionnement actuel du fonds prévoit des critères d'intervention peu en accord avec la typicité des phénomènes microclimatiques, qui se répandent de plus en plus fréquemment sur le pays. En substance, on sait que deux critères doivent être respectés. D'une part, le phénomène doit être exceptionnel au sens des chiffres retenus par la station IRM et, d'autre part, les dégâts doivent s'élever à plus de 1.250.000 euros. Dans le cas de microphénomènes, il arrive que les stations de mesure enregistrent des chiffres fort différents de ceux recueillis sur les lieux des événements. Le montant des dégâts pose également problème dans la mesure où le chiffre en vigueur est difficilement accessible pour des petites communes rurales isolées. Nous reviendrons en commission sur l'état d'avancement de vos travaux en cette matière.

This is the anticipated reform of the asylum procedure. Foreign dispute deserves a solution; you sketch one in your general policy note. In other words, I think it is the subject of a preliminary bill that has received government approval.
What is the timing of this case? It is important today to move forward in this matter as the current asylum procedure, due to its inertia, no longer allows to respond with the desired speed to the applicants. It also greatly complicates the proper application of all of our laws governing the rights and obligations of foreigners.
We also support your commitments to combat white marriages and family reunification fraud. Your recent circular inviting civil status officers to exchange information on complacency marriage attempt was expected. We have voted for your latest proposal on this subject. However, it will need to go further in the perspective of the new logic of the asylum procedure.
Regarding civil security, I would like to recall the budget effort that has been ongoing since last year. We are now awaiting the final conclusions of the Paulus committee and the risk analysis. The financing of the reform will be at the center of our concerns. It will not be possible to re-edit approximations that are ongoing in the current contribution system.
Finally, we are pleased to see the provisions relating to the criteria for activation of the calamity fund returned to the profession. This has been asked several times by my group. It is clear that the current functioning of the Fund provides for intervention criteria not in accordance with the typicity of microclimate phenomena, which are spreading more and more frequently across the country. In essence, we know that two criteria must be met. On the one hand, the phenomenon must be exceptional in the sense of the figures held by the IRM station and, on the other hand, the damage must amount to more than 1.250.000 euros. In the case of microphenomena, it happens that the measurement stations record very different figures from those collected at the venue of events. The amount of damage is also problematic as the current figure is hardly accessible for small, isolated rural municipalities. We will return to the committee on the state of progress of your work on this subject.

Mijnheer de voorzitter, collega's, eerst wil ik een woord van lof uiten ten aanzien van de rapporteur, omdat wij, denk ik, over een uitstekend verslag beschikken. Er zijn heel wat vragen gesteld in de commissievergadering, die ik allemaal in de commissievergadering beantwoord heb. Ik had aangekondigd dat ik een aantal vragen via het verslag zou beantwoorden. Enkele punten zijn nu, in de plenaire vergadering, opnieuw naar voren gekomen. Ik zal ze systematisch, in volgorde van de vraagstelling, beantwoorden.
Mevrouw Schryvers heeft opnieuw de aandacht gevestigd op de noodzaak om de fiscale aftrekbaarheid in te voeren voor veiligheidsinvesteringen voor particulieren. Ik heb in de commissie geantwoord dat het huidige systeem voor zelfstandigen effectief voorziet in een interessante fiscale aftrekbaarheid, maar dat het tot mijn spijt nog te weinig wordt toegepast in de praktijk. Ik denk dat het er dus op aankomt, nadat wij de fiscale aftrekbaarheid voor zelfstandigen verhoogd hebben, om misschien de maatregel nog beter te promoten. In dat verband heb ik ook een beroep gedaan op de zelfstandigenorganisaties, opdat zij hun leden misschien nog meer zouden informeren.
Ik ben er voorstander van om hetzelfde te doen voor de particulieren. Daarvoor is er geen bijkomend geld nodig, mevrouw Schryvers, want fiscale aftrekbaarheid kost niets aan mijn begroting. Fiscale aftrekbaarheid is natuurlijk wel ten laste van de rijksmiddelen, en daar knelde het schoentje, omdat de meningen nogal uiteenlopen over de juiste budgettaire impact. Om die reden hebben wij bij de opmaak van de begroting gezegd dat wij de maatregel opnieuw zouden bespreken bij de begrotingscontrole, om na te gaan wat precies het effect van het systeem op de ontvangsten zou zijn, inzonderheid de minderontvangsten. Maar in 2006 kost ze niets. Zelfs al voeren we die maatregel in, in 2006 is er geen budgettair effect. Nadien, uiteraard, eens dat die maatregel op kruissnelheid zal komen, moeten wij dat kunnen kaderen in een budgettair meerjarenperspectief.
De discussie terzake, die wij in de commissievergadering hebben gevoerd, is ook gekoppeld aan de vraag van collega Maene over de indexering van de preventiecontracten. Die maatregel kost wel geld en is ook om die reden, wegens het budgettair impact, verschoven naar de begrotingscontrole.
Toen wij het minidebat hebben gehouden over de rellen die in Frankrijk hebben plaatsvonden en in erg veel mindere mate in ons land, heb ik mijn lof niet onder stoelen of banken gestoken ter attentie van de vele straathoekwerkers die erin geslaagd zijn, op een heel inventieve manier, te voorkomen dat die vonk zou overslaan.
Ik denk dus dat wij aanpassingen moeten doorvoeren aan de preventiecontracten. We moeten ze niet alleen, budgettair gezien, indexeren. Ik denk dat het nuttig zou zijn om bijvoorbeeld de preventiecontracten te laten lopen over een langere looptijd. In het systeem van vandaag moeten de contracten jaarlijks worden verlengd. Ik denk dat enig meerjarenperspectief terzake ook wel op zijn plaats zou zijn.
Een langere looptijd voor de preventiecontracten en misschien ook minder betutteling voor de steden en gemeenten, zijn dus nuttig, want ik meen dat er vandaag zodanig veel voorwaarden worden opgelegd, dat sommige gemeentelijke ambtenaren vooral bezig zijn met het invullen van papieren en formulieren ter attentie van mijn departement. Ook de indexering van de contracten komt terug bij de begrotingscontrole.
Mevrouw Schryvers heeft ook vragen gesteld over de hervorming van de Civiele Veiligheid. Laat mij duidelijk zijn, er is vorig week nog een vergadering geweest van de commissie-Paulus. De finaliserende vergadering zal plaatsvinden op 3 januari. Op 20 januari is er een laatste vergadering, waarin de commissie haar werkzaamheden zal afsluiten en waarin mij het rapport van de commissie-Paulus tot hervorming van de Civiele Veiligheid zal worden bezorgd. Er waren inderdaad nog een paar ontbrekende elementen. Ik verwijs naar de nulmeting, waarvan sprake. Uiteraard moeten ook de risicoanalyse en de rapportage van de universiteiten nog aan het rapport worden toegevoegd.
Collega's, ik heb in de commissie uitdrukkelijk betoogd dat wij niet alleen werken aan een fundamentele hervorming, maar dat wij intussen ook de brandweer en de Civiele Veiligheid meer middelen toekennen. Wij doen dat in het kader van wat ik altijd een soort van tweesporenbeleid genoemd heb. Bij de fundamentele hervorming pas ik op om niet opnieuw in de fouten van het verleden te vervallen met betrekking tot de politiehervorming en om ze misschien toch niet al te snel door het Parlement te jagen. Ik wil een voldoende draagvlak bij de burgemeesters, bij de steden en gemeenten, want zij moeten in belangrijke mate deze hervorming mede dragen.
Ik heb in de commissie gezegd dat de financiering en de meerkosten van die hervorming een verantwoordelijkheid van de federale overheid zijn. Ik heb er echter ook aan toegevoegd dat er tussen de gemeenten grote discrepanties zijn in wat de gemeenten respectievelijk uitgeven aan brandweer en Civiele Veiligheid in het algemeen. Daarom is de nulmeting noodzakelijk. Er zijn vandaag grote discrepanties. Als elke burger recht heeft op een service inzake Civiele Veiligheid, dan is het ook niet meer dan normaal dat de verschillende gemeentebesturen terzake ongeveer dezelfde inspanning leveren. Het gaat niet langer op dat sommige gemeenten daaraan geen geld geven, omdat een aangrenzende gemeente het wel zal doen. Wij moeten de lat gelijkleggen.
Als wij zien dat vandaag 90% van de kosten van de brandweer nu al gedragen wordt door de steden en gemeenten, dan moeten wij twee zaken doen. Ten eerste, de meerkosten van de hervorming in een meerjarenplan laten dragen door de federale overheid. Ten tweede, ik meen dat wij van de gelegenheid moeten gebruikmaken om de rekeningen van de verschillende gemeentebesturen ook eens naast elkaar te leggen en de spreekwoordelijke lat gelijk te leggen.
In afwachting van de fundamentele hervorming — het zou niet verantwoord zijn om daar nog een aantal maanden en misschien zelfs een paar jaar over te doen — gebeuren er nu al budgettaire inspanningen op het vlak van de Civiele Veiligheid. U kent de bedragen voor de investeringen. Na de verhoging vorig jaar, in het jaar 2005 dus, met 3,5 miljoen euro, hebben wij voor volgend jaar opnieuw 5 miljoen euro uitgetrokken voor investeringen.
Dat geeft in het jaar 2006 een totaal bedrag aan vastleggingkredieten voor materieel, van 16,2 miljoen euro. Dat is een eerste voorbeeld.
Een tweede voorbeeld betreft de opleidingen. Ik heb gezegd dat er volgend jaar 1 miljoen euro meer zou zijn voor opleidingen, wat voor 2006 opnieuw een stijging betekent van 66.000 euro.
We hebben het ook gehad over het Kenniscentrum.
Mijnheer de voorzitter, wij volgen met andere woorden twee sporen. Een eerste spoor is de hervorming ten gronde. Ik wil dat de gemeentebesturen na de verkiezingen van volgend jaar de kans krijgen om zich uit te spreken. Ik denk dat we gelegitimeerde besturen nodig hebben. We kunnen dat echter niet afhandelen vóór de gemeenteraadsverkiezingen. Ten tweede, moeten we budgettair een tandje bijsteken omdat er gedurende jaren te weinig werd geïnvesteerd in de brandweer. Dat is de reden waarom ik het leeuwendeel van de jaarlijkse verhoging die mij in het regeerakkoord werd toegewezen, elk jaar opnieuw reserveer voor de civiele veiligheid.

When we held the mini-debate about the riots that took place in France and in much less extent in our country, I did not place my praise under chairs or benches to the attention of the many street corner workers who managed, in a very inventive way, to prevent that spark from passing through.
So I think we need to make adjustments to the prevention contracts. We should not index them alone, budgetarily seen. I think it would be useful to have prevention contracts run over a longer term, for example. In the current system, contracts should be renewed annually. I think a multi-year perspective on this issue would be appropriate.
A longer term for the prevention contracts and ⁇ even less burden for the cities and municipalities, are therefore useful, because I think that so many conditions are imposed today that some municipal officials are mainly engaged in filling out papers and forms for the attention of my department. The indexation of contracts also comes back to budgetary control.
Ms. Schryvers also asked questions about the civil security reform. Let me be clear, there was another meeting of the committee-Paulus last week. The final meeting will take place on 3 January. On 20 January there will be a final meeting, in which the committee will conclude its work and in which I will be delivered the report of the committee-Paulus on civil security reform. There were indeed a few missing elements. I refer to the zero measurement, which is mentioned. Of course, risk analysis and university reporting should also be added to the report.
Colleagues, I have explicitly argued in the committee that we are not only working on a fundamental reform, but that in the meantime we are also allocating more resources to firefighters and civil security. We do this within the framework of what I have always called a kind of double-track policy. In the fundamental reform, I take care not to fall again into the mistakes of the past concerning the police reform and ⁇ not to hunt them too quickly through the Parliament. I want sufficient support from the mayors, from the cities and municipalities, because they must contribute significantly to this reform.
I said in the committee that the financing and additional costs of that reform are a responsibility of the federal government. However, I have also added that there are large discrepancies between the municipalities in what the municipalities spend on firefighters and Civil Safety in general. Therefore, zero measurement is necessary. There are major discrepancies today. If every citizen is entitled to a civil security service, it is also not more than normal that the different municipalities make approximately the same effort in this regard. It no longer matters that some municipalities do not give money for it, because a neighboring municipality will do so. We need to equalize the lat.
If we see that today 90% of the costs of firefighters are already borne by the cities and municipalities, then we need to do two things. First, the additional costs of the reform in a multiannual plan should be borne by the federal government. Secondly, I think that we should take advantage of the opportunity to put the accounts of the various municipal governments side by side and to equalize the proverbial lat.
In anticipation of the fundamental reform — it would not be appropriate to spend a few months and maybe even a few years — budgetary efforts are already taking place in the field of Civil Security. You know the amounts for the investment. Following the increase last year, in 2005, i.e., by 3.5 million euros, we have again allocated 5 million euros for investment for next year.
That gives in 2006 a total amount of commitment credits for equipment, of 16.2 million euros. This is a first example.
A second example is the training. I said that next year there would be 1 million euros more for training, which for 2006 means another increase of 66,000 euros.
We also talked about the Knowledge Center.
In other words, we follow two tracks. The first step is fundamental reform. I want the municipal governments to have the opportunity to speak after the next year’s elections. We need legitimate governments. However, we cannot deal with this before the municipal elections. Secondly, we need to cut a tooth on budget because over the years too little has been invested in firefighters. That’s why I reserve the lion’s share of the annual increase that was allocated to me in the government agreement again every year for civil security.

De studie om het rijbewijs effectief te integreren zal eerstdaags worden aangevat. Inzake het opnemen van bijkomende gezondheidsgegevens zijn er problemen gerezen in de privacycommissie. Dan is er het wetsvoorstel dat uw fractie heeft ingediend over het stemrecht voor Belgen in het buitenland. Als de commissie dit op de agenda plaatst, kunnen we dat bespreken. U weet dat daarover geen politieke afspraken bestaan in de regering: dit is een parlementair initiatief, dat we te gepasten tijde in de commissie kunnen behandelen.
U hebt nog gevraagd naar de timing inzake de hervorming van de asielprocedure. Op 23 december komen de ontwerpen voor de Ministerraad en zullen ze uiteraard verstuurd worden naar de Raad van State. Mevrouw Galan, we zullen alleszins een overgangsfase nodig hebben. Om de procedure met de nieuwe Raad voor vreemdelingenbetwistingen operationeel te maken hebben we nog wel enige tijd nodig. In afwachting hebben we een overgangsfase nodig, waarin zowel de Vaste Beroepscommissie als de Raad van State een extra injectie aan middelen en mankracht moeten krijgen om de dossiers uit het verleden af te werken.
Duizenden dossiers inzake vreemdelingen wachten bij de Raad van State op een behandeling. Wij kunnen de procedure niet hervormen en die laten liggen. In een overgangsfase zullen wij dus een extra injectie nodig hebben van mankracht en van middelen om die achterstand weg te werken, zowel op het niveau van de Raad van State als op het niveau van de Vaste Beroepscommissie.

Mijnheer de voorzitter, mijnheer de minister, collega's, de commissie voor de Landsverdediging heeft het wetsontwerp houdende aanpassing van de algemene uitgavenbegroting voor het begrotingsjaar 2005, met betrekking tot Landsverdediging, besproken in haar vergadering van 7 december laatstleden. De minister zette in zijn inleiding uiteen dat het wetsontwerp betrekking heeft op een aantal technische bepalingen. Er wordt een tweede aanpassing van de algemene uitgavenbegroting voor het jaar 2005 doorgevoerd die enkele interne overdrachten binnen de begroting van het departement bevat, zonder dat er bijkomende kredieten worden aangevraagd. Het betreft dus aanpassingen van interne kredietmiddelen. Deze middelen moeten dienen om de bijkomende kosten, voortvloeiend uit de stijging van de energieprijzen, het hoofd te kunnen bieden. Deze kredieten worden ook aangewend voor personeelsuitgaven voortvloeiend uit een aantal loopbaanhervormingen en een vervroegde indexsprong. Ten slotte zijn deze interne kredietverschuivingen ook nog noodzakelijk om het negatief rekeningsaldo van de buitengewone rekenplichtigen van het departement te dekken alsook om aan een recente veroordeling als gevolg van een dossier uit de jaren tachtig, te kunnen tegemoetkomen. Sommige krediettransfers moeten ten slotte toelaten dat de leveranciers van het departement Landsverdediging tijdig worden betaald.
Tijdens de algemene bespreking werd kort een aantal vragen om verduidelijking gesteld, door zowel collega's uit de meerderheid als uit de oppositie. Voor de specifieke interventies, mijnheer de voorzitter, zou ik graag verwijzen naar het geschreven verslag.

Mr. Speaker, Mr. Minister, colleagues, the Committee for Lands Defense has discussed the draft law concerning the adjustment of the general expenditure budget for the financial year 2005, in relation to Lands Defense, in its meeting of 7 December last year. The Minister explained in his introduction that the draft law covers a number of technical provisions. A second adjustment of the general expenditure budget for the year 2005 is carried out, which includes some internal transfers within the department’s budget, without requiring additional appropriations.
