Notre collègue Ahmed Laaouej accompagné de MM. Vanvelthoven, Crusnière et Daerden ont déposé un amendement n° 6 pour modifier l'article 11.

Cet amendement vise à régler le problème suivant: le projet de loi n'excluait pas la régularisation au cas où la nature de l'impôt éludé de la période concernée par cet impôt ne serait pas connue. Pour régler le problème de compétence, l'article 11 doit être adapté de telle façon que, pour être régularisés, les revenus des sommes des opérations de TVA et capitaux fiscalement prescrits pour la partie de ceux-ci doivent satisfaire à trois conditions: ne pas avoir été soumis à leur régime fiscal ordinaire, déterminer la nature de l'impôt à laquelle appartiennent les revenus et déterminer précisément la catégorie fiscale des revenus. Ces trois conditions étant remplies, nous pouvons alors dire que les revenus qui n'ont pas été soumis à leur régime fiscal ordinaire et dont la nature est indéterminée ne peuvent pas être régularisés.

Cet amendement à propos duquel mon collègue va vous donner la façon dont il a été reçu, permet d'éviter des pertes de temps et des recours à la Cour constitutionnelle et donc d'apporter plus rapidement des recettes à tous ceux qui les voudront.

Our colleague Ahmed Laaouej accompanied by MM. Vanvelthoven, Crusnière and Daerden submitted an amendment no. 6 to amend Article 11.

This amendment aims to address the following problem: the bill did not exclude regularization in the event that the nature of the evaded tax of the period concerned by that tax would not be known. In order to resolve the issue of jurisdiction, Article 11 must be adapted in such a way that, in order to be regularized, revenues from VAT transactions and capital taxably prescribed for the portion thereof must meet three conditions: not have been subject to their ordinary tax regime, determine the nature of the tax to which the income belongs and precisely determine the tax category of the income. If these three conditions are met, we can then say that incomes that have not been subject to their ordinary tax regime and whose nature is indeterminate cannot be regularized.

                    Monsieur le président, la commission a examiné cet amendement au cours de la réunion de ce jour. Un échange de vues a eu lieu et deux sous-amendements ont été déposés. M. Laaouej et consorts ont déposé un sous-amendement n° 9 visant à exclure également les opérations de TVA de la régularisation de montants susceptibles d'être liés à des infractions déterminées. Mme Smaers et consorts ont déposé un sous-amendement n° 10 visant à prévoir l'obligation pour le déclarant de préciser la période à laquelle l'impôt concerné se rattache.

Nous avons voté sur ces sous-amendements et amendements. Les sous-amendements n° 9 et n° 10 ont été adoptés à l'unanimité. L'amendement n° 6, ainsi amendé, est adopté à l'unanimité. L'article 11, ainsi amendé, est adopté par 15 voix et une abstention. L'ensemble du projet de loi ainsi amendé est adopté par 11 voix contre 5.

                    Monsieur le président, ce dossier aurait pu être the neverending story. Cela fait longtemps qu'il est traité en commission, pour une raison très simple. En effet, ce projet de loi, sur lequel le gouvernement mise très fort pour augmenter ses recettes fiscales, a été introduit voici déjà un certain temps et a fait l'objet de très nombreux échanges, de très nombreux débats en commission. Mais surtout, il a connu un certain nombre de péripéties juridiques, et notamment plusieurs avis du Conseil d'État. Celui-ci a rendu au moins deux avis sur le projet de loi lui-même et une multitude d'avis sur des projets d'amendements.

Mais avant d'aborder cet aspect, il y a d'abord le projet de loi lui-même et sa portée, à savoir une régularisation fiscale. Se pose à nous, législateur, la question de savoir si une régularisation fiscale est aujourd'hui pertinente, compte tenu de l'évolution de l'environnement fiscal européen et international. On voit bien, en effet, depuis différents événements marquants, le dernier étant la crise financière de 2008, une tendance à aller vers plus d'échanges de renseignements.

Bien sûr, entre les pays européens, on songe à la directive Épargne et à l'automaticité des échanges de renseignements s'agissant des revenus financiers. Mais il y a également la dynamique FATCA initiée en particulier par les États-Unis. Les États-Unis eux-mêmes ont bien compris que vis-à-vis de certains territoires coopératifs, rien ne valait le rapport de forces politique. On se rappellera des gains enregistrés, s'agissant des États-Unis, avec la Suisse.

De la même manière, au fur à mesure des révélations qui se succèdent (les Offshore Leaks, les LuxLeaks, mais également récemment les Panama Papers), l'Union européenne veut mettre les bouchées doubles sur l'identification des paradis fiscaux et, en même temps, sur le renforcement de la coopération pour lutter contre le phénomène de l'évasion fiscale internationale, sans compter bien entendu le renforcement de la loi sur le blanchiment. Ces directives doivent d'ailleurs être transposées dans les différentes législations nationales.

La tendance est donc à l'échange de renseignements. La tendance est à la coopération.

This could have been the never-ending story. It has long been discussed in the commission, for a very simple reason. Indeed, this bill, on which the government put very strongly to increase its tax revenues, was introduced some time ago and has been the subject of very many exchanges, very many discussions in committees. But above all, he has experienced a number of legal peripeties, including several opinions of the State Council. He gave at least two opinions on the bill itself and a multitude of opinions on draft amendments.

But before we address this aspect, there is first the bill itself and its scope, namely a tax regularization. For us, legislators, the question arises as to whether a tax regularization is relevant today, given the evolution of the European and international tax environment. We can see, in fact, from various significant events, the last being the financial crisis of 2008, a trend to go towards more exchanges of intelligence.

Of course, among European countries, we think of the Savings Directive and the automatic exchange of information concerning financial income. But there is also the FATCA dynamic initiated ⁇  by the United States. The United States itself understood well that with regard to certain cooperative territories, nothing was worth the ratio of political forces. We will remember the gains recorded, in the case of the United States, with Switzerland.

Similarly, with the successive revelations (the Offshore Leaks, the LuxLeaks, but also recently the Panama Papers), the European Union wants to put the double blows on the identification of tax havens and, at the same time, on the strengthening of cooperation to combat the phenomenon of international tax evasion, without counting, of course, the strengthening of the law on laundering. These directives must be transposed into different national laws.

The trend is the exchange of information. The trend is cooperation.

                    Bref, l'étau se resserre. D'abord, en termes de politique fiscale, il apparaît assez incongru de promouvoir une nouvelle régularisation fiscale. C'est la raison pour laquelle elle arrive à contretemps, parce qu'il ne faudrait pas, singulièrement si cette régularisation fiscale est conçue comme permanente, donner le sentiment qu'au fond, il suffit de procéder à de l'évasion fiscale, à de la fraude et de se dire qu'un jour où l'autre, je régulariserai au moment que je choisirai. C'est contre-productif en termes de signal adressé. C'est la raison pour laquelle nous voterons évidemment contre ce projet de loi. Nous l'avons dit depuis le début.

Il y a une donnée supplémentaire qui n'est pas nouvelle mais qui s'est amplifiée depuis la sixième réforme de l'État, c'est le renforcement du fédéralisme fiscal. En 2002, la régionalisation des droits de succession et des droits d'enregistrement était déjà complète. Les Régions étaient déjà compétentes sur certains éléments, notamment les taux. Mais depuis 2002, cette régionalisation est complète en ces matières. Est venue s’ajouter à cela, lors des accords qui ont scellé la sixième réforme de l'État, une régionalisation partielle de l'impôt des personnes physiques.

Évidemment, cela complique l'affaire. Pourquoi? Les gens vont régulariser des capitaux qui n'ont pas été soumis aux droits de succession, cette succession n'ayant pas été déclarée. C'est un peu la figure de l'oncle d'Amérique, mais en l'occurrence, il peut s'agir de l'oncle des Îles Caïman, des Seychelles, ou que sais-je? Ils peuvent aussi régulariser des revenus professionnels qu'une personne a délibérément décidé d'évacuer vers l'étranger. Bref, tout cela recouvre des réalités assez différentes mais qui, d'une manière ou d'une autre, aujourd'hui, se situent à ce point d'intersection des compétences fiscales fédérales et régionales. C'est la raison pour laquelle un projet de régularisation comme celui-ci doit impérativement tenir compte des règles de répartition des compétences entre le fédéral et les Régions en application de la loi spéciale de financement. C'est ce que le Conseil d'État n'a d'ailleurs pas manqué de rappeler très tôt.

Oui, on déplorera que le gouvernement ait fait le choix de ne pas en tenir compte rapidement, immédiatement. Nous n'avons pas manqué, nous, de le rappeler et de dire que si le gouvernement ne changeait pas sa copie, il s'exposerait lui-même à un risque juridique de recours devant la Cour constitutionnelle. J'imagine que de guerre lasse, pour assurer la sécurisation juridique de son projet de loi, le gouvernement a compris qu'il était peut-être utile de tenir compte à la fois de l'apport du travail parlementaire de l'opposition mais aussi et surtout de l'avis du Conseil d'État qui, s'agissant d'un des amendements déposés par l'opposition - et je n'en tire strictement aucune fierté, je répète que c'est un dossier qui aurait pu être réglé, il y a plusieurs mois – a dit que cet amendement-là, en l'occurrence l'amendement 6 qui revoit l'article 11 du projet de loi tel qu'il a été exposé par M. Piedboeuf, était une disposition qui s'imposait.

This obviously complicates the case. Why Why ? People will regularize capital that has not been subject to inheritance rights, this inheritance has not been declared. This is a bit the figure of the Uncle of America, but in this case, it may be the Uncle of the Caiman Islands, the Seychelles, or what do I know? They can also regularize professional income that a person has deliberately decided to evacuate abroad. In short, all this covers quite different realities but which, in one way or another, today, are at this point of intersection of federal and regional tax powers. This is why a regulation project such as this must necessarily take into account the rules for the division of competence between the federal and the Regions under the Special Financing Act. This is what the Council of State has not forgotten very early.

Yes, we will regret that the government has chosen not to take this into account quickly, immediately. We did not fail to recall it and say that if the government did not change its copy, it would expose itself to a legal risk of appeal before the Constitutional Court. I imagine that from a tired war, in order to ensure the legal security of its bill, the government has understood that it might be useful to take into account both the contribution of the parliamentary work of the opposition but also and above all the opinion of the State Council that, in relation to one of the amendments filed by the opposition - and I do not strictly take any pride from it, I repeat that this is a matter that could have been settled, several months ago - said that that amendment, in this case the amendment 6 which revises Article 11 of the bill as it was exposed by Mr. Piedboeuf, was a disposition that was necessary.

Le fédéralisme, c'est cela aussi: la concertation réelle, organisée. Je ne dis pas nécessairement "institutionnalisée". Le comité de concertation existe pour cela. Mais rien n'empêche de créer un groupe de travail permanent.

Dois-je attirer l'attention de l'ensemble de mes collègues sur l'arrivée d'autres dossiers? Vous me direz que la taxe sur les jeux de hasard ne représente que 39 millions d'euros. C'est tout de même 39 millions d'euros, même si ce ne sont pas les 250 millions de la régularisation. Mais quel est l'avantage, pour le gouvernement fédéral ou pour les Régions - qui pourraient empiéter, elles aussi, sur les compétences du fédéral - de faire adopter un texte, un projet de loi, d'ordonnance, de décret, qui ne répondrait pas aux impératifs de la Constitution et de la loi spéciale de financement?

Oui, je me réjouis que vous ayez considéré qu'il était temps de pallier ce déficit juridique. Cela rétablit un cadre équilibré de discussion avec les Régions, qui auront, elles, à déterminer leur position pour la suite des événements.

Je poserai une question de clarification à M. le ministre au sujet des Panama Papers.

But what is the advantage, for the federal government or for the Regions – which could also interfere with the competences of the federal – of making a text, a draft law, an order, a decree, which would not meet the imperatives of the Constitution and of the Special Funding Act?

Yes, I am pleased that you considered it time to curb this legal deficit. This restores a balanced framework of discussion with the Regions, which will have to determine their position for the follow-up of events.

                    Mijnheer de voorzitter, ik wil heel kort een aantal toelichtingen geven bij de redenen waarom wij het wetsontwerp wel omarmen.

Ten eerste, het ontwerp getuigt van een erg grote rechtsduidelijkheid.

Het stop-and-gobeleid, dat in het verleden wel eens is gevoerd, heeft niet onterecht en niet verrassend tot afwijkingen geleid. Het heeft vooral geresulteerd in verschillende behandelingen.

Wie de discussies met de BBI in de Panamacommissie heeft meegemaakt, heeft vastgesteld hoe de verschillen in behandeling door de kantoren wel degelijk een grondslag hadden. Door voorliggend wetsontwerp creëren wij heel duidelijk rechtsduidelijkheid.

Ten tweede, het mag niet worden onderschat hoe ongelooflijk hard er is gewerkt aan een diplomatische oplossing voor de bestaande complexiteit tussen de federale overheid en de Gewesten. Er zijn, ten minste, op dit moment heel grondige en goede gesprekken aan de gang, om een en ander op elkaar te kunnen afstemmen.

Mijnheer Laaouej, u ziet in het wetsontwerp de basis voor meer fiscaal federalisme en afstemming. Dat is niet juist. Ik begrijp en ben het er volledig mee eens dat afstemming noodzakelijk is. Anderzijds moet vereenvoudiging ons uitgangspunt blijven. Op dat vlak kunnen de oplossingen in twee richtingen worden gezocht, niet enkel in de verdere samenvoeging, maar in de vereenvoudiging, om er aldus voor te zorgen dat de lasten worden gelegd waar zij het best op hun plaats zijn.

Tot slot, in tegenstelling tot wat u zegt, mijnheer Laaouej, surft het ontwerp wel degelijk voort op de gangbare trends, met name die naar correcter fiscaal gedrag, die u blijkbaar wenst te ontkennen. Dat zien we aan verscheidene parameters, die vandaag ter beschikking zijn.

Een van die parameters hebben wij trouwens ook in de Panamacommissie gemeten, namelijk het stijgende aantal aankondigingen voor buitenlandse constructies en buitenlandse rekeningen. Belastingplichtigen komen daar vaker mee naar buiten. Er wordt ook duidelijker en transparanter over gecommuniceerd.

De manier waarop voorliggend wetsontwerp is geconcipieerd, zal alleen maar de Schatkist ten goede komen. Een en ander komt vooral ook de eerlijke belastingbetaler ten goede, die een steuntje in de rug krijgt dankzij het kapitaal waarmee men jaren niet heeft gedaan wat men moest doen.

Op die manier werken wij wel aan een fairdere fiscaliteit.

On the other hand, simplification should remain our starting point. On that level, the solutions can be sought in two directions, not only in the further merger, but in the simplification, in order to ensure that the burdens are placed where they are best placed.

Finally, contrary to what you say, Mr. Laaouej, the design really surfs on the common trends, in particular those towards more correct fiscal behavior, which you apparently want to deny. This is evidenced by several parameters that are available today.

One of those parameters we also measured in the Panama Commission, namely the increasing number of announcements for foreign constructions and foreign accounts. Taxpayers are more often out there. It will also be communicated more clearly and transparently.

The way in which the present draft law is conceived will only benefit the Treasury. This is especially beneficial to the honest taxpayer, who gets a little backback thanks to the capital with which one has not done what one ought to do for years.

In this way, we work towards a fairer taxation.

Laaouej, pour qui j'ai beaucoup d'estime, non pas par sa fonction de président, qu'il mène très bien d'ailleurs, mais parce qu'il sait, à la suite de l'ensemble des débats qui ont eu lieu ces dernières semaines et ces derniers mois, qu'au fond, cette régularisation fiscale s'inscrit dans un bon momentum. Pourquoi? Tous les commissaires de cette commission sont évidemment conscients que tant qu'il y aura un seul pays qui reste un paradis fiscal, il pourra toujours y avoir un transfert vers ce pays. Il va de soi que si nous sommes pour l'instant, de manière assez consensuelle pour certains, dans une intention de transparence, il n'en demeure pas moins que beaucoup de pays, voire certains États, maintiendront vraisemblablement ce statut de paradis pour différentes raisons.

Le momentum se justifie d'autant plus qu'il s'inscrit à un moment où le ministre des Finances et le gouvernement ont décidé de prendre un panel de mesures. Il s'agit notamment, et on en a largement parlé en commission Panama, de la taxe Caïman, qui est un moyen permettant également de lutter contre la fraude fiscale. Il y a une série d'autres moyens, comme l'augmentation du cadre des agents de l'ISI, de nouvelles mesures de poursuite de la criminalité sur le web, un ensemble de mesures qui seront prises dans les prochains mois.

Enfin, à la suite d'une publicité de transparence au niveau international, l'insécurité que va ressentir la personne qui a envie de faire amende honorable, l'incitera à le faire dès à présent dans le cadre de cette régularisation.

Je pense donc que c'est un bon moment, c'est une opportunité pour certains avant le choc de la transparence et donc par conséquent, c'est une mesure pleinement justifiée que mon groupe politique et moi-même soutiendrons avec beaucoup de détermination.

La dernière a été votée par le groupe cdH au motif qu'elle était justement la dernière. Trois groupes de la majorité sur les quatre l'ont également votée pour le même motif. C'était la troisième et la dernière. Si le groupe cdH, aujourd'hui, ne vote pas cette nouvelle régularisation, c'est précisément pour ne pas renier la parole du législateur en instituant une nouvelle opération de régularisation après celle qui aurait dû être la dernière. De surcroît, cette nouvelle opération devient permanente et dès lors qu'elle le devient, se pérennise l'infraction elle-même en tout cas dans l'esprit du législateur, ce qui est un très mauvais signal.

Mais manifestement, entendant les propos de M. Scourneau, je mesure à quel point la majorité et le MR, en particulier, restent attachés à ce projet. Cela restera sans doute un des marqueurs de cette majorité, au même titre que le saut d'index. Le saut d'index et la régularisation fiscale sont les deux marqueurs forts de cette majorité. Elle les assumera jusqu'au bout de la législature.

On a donc assisté à un revirement tardif, quelque peu in extremis alors que des signaux d'alarme avaient été lancés depuis le début. En effet, ce n'est pas depuis avant-hier que l'on sait que les dispositions portant notamment sur les impôts de nature indéterminée posent problème.

Dans son premier avis rendu en octobre 2015, le Conseil d'État avait souligné que c'était l'un des gros problèmes de ce projet dans la mesure où il permettait la régularisation de sommes dont la provenance de l'impôt éludé et dont la période imposable n'était pas connue.

Le Conseil d'État a, à nouveau, formulé ce commentaire dans son deuxième avis du mois de décembre. Il y a eu tellement d'avis que j'en ai oublié la date exacte. À cette occasion, le Conseil d'État a rappelé que la régularisation des capitaux pour lesquels l'impôt éludé et la période imposable ne sont pas déterminés crée une violation des règles de répartition des compétences. Octobre 2015, décembre 2015. Il en aura fallu du temps pour que les esprits évoluent et que la majorité se fasse à l'idée qu'il y avait peut-être là un vrai problème de répartition des compétences, comme M. Piedboeuf l'a reconnu dans son rapport oral.

Et c'est le deuxième reproche que je voudrais formuler. Sur le plan juridique, il ne faudrait pas croire que cet amendement voté ce matin règle tous les problèmes. Loin de là! Loin de là! Il y a sans doute un élément de satisfaction. Disons que c'est peut-être à moindre mal. Mais tout de même, des points importants ont été évoqués tout au long de nos travaux et à ma connaissance, ils n'ont pas obtenu une réponse satisfaisante. Des questions se posent notamment par rapport à la législation européenne. Le fait que le prélèvement effectué par l'État de résidence ne soit pas déduit est considéré comme étant en contradiction avec la directive européenne sur l'épargne. Quelle est la réponse du gouvernement et du ministre à cette violation possible de la législation européenne? J'aurais voulu l'entendre ici en séance publique, à défaut de l'avoir entendue dans les débats en commission. De même, l'impossibilité de faire recours peut apparaître comme incompatible avec un arrêt de la Cour constitutionnelle qui décidément, est sur votre chemin tout au long du processus législatif de ce texte. En effet, en date du 19 décembre 2014, la Cour constitutionnelle a considéré que l'impossibilité de faire recours était inacceptable eu égard à la Constitution.

Il y a donc deux incertitudes juridiques: l'une liée à la législation européenne, l'autre liée à cet arrêt de la Cour constitutionnelle.

Et puis, surtout, il y a toujours la subsistance d'une incertitude, d'une insécurité juridique par rapport aux Régions. Il est vrai que l'amendement limite la casse, en quelque sorte, mais je pense qu'il vaudrait mieux aller un pas plus loin, comme vous l'avez d'ailleurs laissé entendre ce matin en commission. Je voudrais à nouveau vous entendre en séance plénière à ce sujet. Dès lors que les compétences sont à ce point imbriquées, le Conseil d'État n'a pas arrêté de dire qu'il fallait un accord de coopération entre l'État fédéral et les Régions. Vous avez réfuté cette analyse. Puis, finalement, ici, in extremis, éclair de lucidité, vous avez admis qu'effectivement, cet accord de coopération était souhaitable et qu'il était en bonne voie.

Si nous déposons des amendements, c'est uniquement sur ce point-là. C'est précisément pour que l'accord de coopération soit inscrit dans la loi de façon à vous permettre de tenir vos engagements. Un propos politique, dans un contexte donné, c'est déjà mieux que rien, mais ce n'est pas totalement rassurant.

Nous déposons des amendements pour que l'accord de coopération nécessaire, tel que jugé par le Conseil d'État, soit bel et bien inscrit dans le texte de loi. Cela nous permettrait de conforter et de consolider juridiquement votre projet. À défaut, il restera une épée de Damoclès.

M. Van Biesen nous a dit que M. Vanhengel était finalement devenu raisonnable et qu'il ne mènerait pas un combat jusqu'au-boutiste, jusqu'à la Cour constitutionnelle. Mais cela ne me rassure pas totalement. Je pense que le risque existe et qu'il est toujours bien réel.

Si vous voulez vous prémunir d’une décision de la Cour constitutionnelle, le mieux serait d'accepter, très officiellement et dans la loi, cette nécessité d'un accord de coopération et que vous entriez vraiment dans cette négociation avec les Régions dans le cadre de ce fédéralisme de maturité que notre collègue M. Laaouej appelait de ses vœux et auquel nous aspirons tous.

Monsieur le président, monsieur le ministre, j'en viens à un troisième grief. Il s'agit du questionnement par rapport aux recettes fiscales que vous escomptez de cette opération de régularisation. Depuis le début, le chiffre de 250 millions d'euros est cité. Confirmez-vous ce chiffre?

Objectivement, les derniers éléments liés à la publication du rapport du Comité de monitoring ne plaident pas tout à fait en votre faveur en ce qui concerne la fiabilité et la crédibilité des prévisions budgétaires.

L'objectif de 250 millions d'euros est-il vraiment l'objectif que vous voulez atteindre? À moins que dans le cadre des travaux budgétaires du gouvernement durant cet été, vous ne soyez amené à gonfler la recette possible émanant de cette régularisation en passant peut-être à 500 ou 750 millions. J'ai été un peu indisposé par les propos du collègue Dispa, qui semble dire que c'est un marqueur politique, que les libéraux ont choisi de régulariser ce qui pourrait être une infraction. C'est une esquive intellectuelle assez particulière dans le sens où au même moment, il fait référence à l'article 6 de la loi, qui a été longuement discuté sous le couvert de l'amendement du collègue Laaouej. Cet article reprend spécialement plus d'une vingtaine d'infractions qui ne permettent pas la régularisation. Il va de soi que ce sont des infractions graves, vis-à-vis desquelles on ne pourra jamais transiger.

Notre collègue Dispa semble passer sous silence et exciper ce point qui nous semble particulièrement important. On a parlé de la taxe Caïman; dans le cadre de la commission Panama, on en a beaucoup parlé. Et qu'en a-t-on entendu au fond?

Les personnes qui sont les plus coutumières de ce genre de dispositif légal et les experts ont, tous, reconnu que c'était un système innovant et intéressant.

Enfin, vous évoquez le nombre de cas graves. Vous en citez une trentaine pour une des opérations précédentes. Il n'y en aurait même qu'un seul, il doit être pris en considération comme un cas grave et non pas comme une fraude ordinaire. C'est là la différence entre vous et nous! Vous considérez que rien n'est vraiment très grave et que cette fraude fiscale peut être considérée comme assez ordinaire. Je considère qu'il y a des cas graves qui doivent être considérés comme tels. Je regrette que, par pragmatisme, vous ayez décidé de passer cette distinction par pertes et profits.

Ten eerste, de Raad van State heeft bij herhaling een negatief advies over uw ontwerp uitgebracht, mijnheer de minister. Vandaag is dat in de commissie wellicht opgelost. Ik heb begrepen dat er in de afgelopen dagen en weken informele gesprekken hebben plaatsgevonden met de regio’s en dat die zaak is uitgeklaard. Hopelijk is dat zo. Als u naar het Parlement komt met wetgeving waartegen procedures worden aangekondigd, dan is dat vanuit de optiek van fiscale rechtszekerheid slechte wetgeving. Als de fiscale rechtszekerheid er vandaag komt dankzij amendementen van de oppositie, is het goed dat wij dat hebben gedaan, maar eigenlijk had u dat werk moeten doen, mijnheer de minister.

Wij hebben de meerderheid telkens gevraagd het wetsontwerp inzake regularisatie uit te stellen tot de BBI de onderzoeken effectief heeft gestart. Ik heb gisteren via de pers vernomen dat de BBI in 239 van de zaken een onderzoek gestart is. Misschien kunt u straks wat meer uitleg geven over de manier waarop dat gebeurd is.

Het is een goede zaak dat de BBI daar werk van maakt. Maar het is wel de oppositie die, tegen uw zin, telkens met alle mogelijke proceduremaatregelen onderhavig wetsontwerp heeft vertraagd. Had het aan u gelegen, mijnheer de minister, dan was er geen uitstel gekomen van de bespreking en was het ontwerp intussen al goedgekeurd. U hebt uitstel altijd geweigerd.

Gelukkig heeft de oppositie de procedure opnieuw vertraagd, telkens opnieuw. Als de Belgen die genoemd worden in de Panamadossiers vandaag geen gebruik meer kunnen maken van de regularisatie, waar u blijkbaar trots op bent, is dat enkel en alleen te wijten aan de oppositie. U hebt daar nul verdienste aan. Nul!

U moet niet neen schudden. Telkens wanneer wij in de commissie gevraagd hebben de bespreking uit te stellen, hebt u dat geweigerd. De meerderheid heeft geprobeerd zich te verzetten tegen elk uitstel, dat wij gevraagd hebben.

Mijnheer de minister, het is toch bizar dat u nu op tafel gaat staan om te zeggen dat u ervoor gezorgd hebt dat de in de Panamadossiers genoemde Belgen geen gebruik zullen kunnen maken van de regularisatie.

Avant tout, je tiens à rappeler que, depuis plusieurs mois, se tient au sein de notre parlement la commission spéciale Panama Papers. Cette commission, mise en place après un énième scandale de fraude fiscale, permettra à notre assemblée d'appréhender les mécanismes d'évasion et de fraude auxquels certaines banques et citoyens belges ont été mêlés.

Nous aurions évidemment souhaité, dans le cadre d'un débat constructif, que le gouvernement attende les conclusions de cette commission spéciale Panama Papers avant de procéder à ce vote.

En ce qui concerne le sort des fraudeurs et la lutte contre la fraude fiscale, avec ce mécanisme, cette fois-ci permanent, le gouvernement autorise les fraudeurs à régulariser leurs actifs, leur patrimoine. En d'autres termes, moyennant un accroissement d'impôts dont les taux peuvent être critiqués, et j'y reviendrai, les fraudeurs pourront obtenir un blanc-seing et rapatrier leur patrimoine dissimulé à l'étranger, et ce, en toute quiétude.

Il est vrai, je vous l'accorde, que ce mécanisme existait déjà sous l'ancien gouvernement. À la différence, toutefois, qu'il n'avait rien de permanent. Après la troisième DLU, le gouvernement précédent a dit: "Stop!". Seule subsistait la possibilité de régulariser auprès de l'Inspection spéciale des impôts, ce qui a permis d'enrôler près de 125 millions en impôts sur les revenus de 2015.

À l'heure où l'étau continue à se resserrer sur les paradis fiscaux et les fraudeurs, le choix du gouvernement continue à poser question.

Pour ce qui est des taux appliqués, permettez-moi également de revenir là-dessus. Je viens d'évoquer le risque d'une hausse de la fraude fiscale. Pourquoi? Les taux de majoration prévus dans le projet de loi sont trop faibles. Dans le cadre de revenus non prescrits: majoration de 20 points. Dans le cadre de capitaux fiscalement prescrits: majoration de 36 points. En d'autres termes, pour l'entrée en vigueur de cette nouvelle législation, on reprend les mêmes taux que dans le cadre de la DLU ter, et on recommence.

Toutefois, je salue le fait qu'en 2020, les majorations atteindront 25 % pour les revenus non prescrits et 40 % pour les capitaux prescrits.

In other words, by means of an increase in taxes whose rates can be criticized, and I will return to it, fraudsters will be able to get a white-seing and repatriate their hidden assets abroad, and this, in all quietness.

It is true, I admit to you, that this mechanism already existed under the former government. However, the difference is that there is nothing permanent. After the third DLU, the previous government said: "Stop!".                     Ce gouvernement prétendait être celui qui allait représenter la nouvelle transparence fiscale. En effet, depuis le 1ᵉʳ janvier 2015, la taxe Caïman est entrée en vigueur. On l'a abordé plusieurs fois en cette séance, le risque d'un recours de la Région bruxelloise contre ce projet de loi conduira inévitablement à une insécurité juridique évidente. Si cette hypothèse de recours se confirme, je rappelle que c'est la deuxième fois que le gouvernement de la Région bruxelloise intente un recours contre le fédéral, le premier étant contre le survol des avions au-dessus de Bruxelles.

Si je salue les deux initiatives régionales bruxelloises, je constate à nouveau que le gouvernement, en cas de désaccord avec ces deux Régions (bruxelloise et wallonne) décide de passer en force en négociant un accord de coopération avec la seule Flandre. J'espère que cela n'est pas dû à un hasard.

Vous comprendrez aisément que, pour les raisons précitées par mes collègues dans l'opposition, mon groupe ne soutiendra pas ce projet ne responsabilisant aucunement les comportements frauduleux, voire pire, encourageant la fraude fiscale. Nous nous posons par ailleurs des questions quant à la pertinence du rendement des 250 millions (cela a été abordé ici précédemment) alors qu'il manque 2,4 milliards au budget! Quel rendement peut-on donc espérer?

You will easily understand that, for the reasons mentioned by my colleagues in the opposition, my group will not support this project by in no way holding accountable fraudulent behaviors, or worse, encouraging tax evasion. We also ask ourselves questions about the relevance of the return of the 250 million (this was discussed here earlier) while there is a lack of 2.4 billion in the budget!                     Monsieur le président, comme certains collègues qui m'ont précédé, je ne reviendrai pas en long et en large sur le volet institutionnel du projet en discussion dont on a encore débattu, tout à l'heure, en commission des Finances.

Je tiens simplement à attirer l'attention sur le fait qu'une fois de plus, ce projet démontre, après les cinq premières réformes, que la sixième réforme de l'État ne fonctionne pas ou fonctionne avec de très grandes difficultés.

Par ailleurs, on peut constater qu'en matière fiscale, il est toujours très difficile de faire passer un projet tellement la répartition "folle" des compétences pose problème.

Je voudrais également revenir sur le fond du dossier. Sans revernir sur treize années d'histoire fiscale, je souhaiterais replacer le texte à l'examen dans le processus de l'amnistie fiscale tel qu'il se présente en Belgique et rappeler que, finalement, on se retrouve face à l'histoire d'une amnistie unique qui est devenue répétitive avant de devenir permanente. Je résume ici en une phrase le texte dont question.

Pour rappel, en 2003 était votée la DLU, à savoir la déclaration libératoire unique – je dis bien unique – à laquelle le PTB, qui n'était pas encore représenté au parlement, était déjà opposé. Si je me réfère à la classification Scourneau, à l'époque, le PTB faisait déjà partie des bons dans la mesure où il s'opposait déjà à l'amnistie fiscale alors que le MR faisait déjà partie des mauvais qui la défendaient. À l'époque, c'était M. Didier Reynders, alors ministre des Finances, qui portait le projet.

Pourquoi étions-nous déjà opposé à ce projet en 2003? Parce qu'il ne s'agit ni plus ni moins qu'un incitant à la fraude qui, à court terme, fait rentrer de l'argent dans les caisses, mais qui, à long terme, génère une perte budgétaire bien plus importante.

À l'époque, en 2003, un membre du CD&V avait qualifié l'opération DLU "d'opération de blanchiment à grande échelle". Aujourd'hui, il est membre de ce gouvernement. Comme on ne le voit pas beaucoup, parfois, on se demande s'il en est vraiment membre, mais je peux vous le confirmer. Il s'agit de Pieter De Crem. C'est lui qui avait déclaré cela en 2003: "opération de blanchiment à grande échelle". Vous entendez bien! Il s'agissait de la DLU n° 1. Ce n'était pas permanent. À l'époque, c'était unique. Il n'empêche…

L'auteur du projet de l'époque, Didier Reynders expliquait en 2005, deux ans après la DLU: "Ce n'est de toute façon pas à refaire. Pas question, en effet, de donner un mauvais signal du genre "fraudez sans retenue durant quelques années et vous aurez ensuite la possibilité de régulariser votre situation"". Voilà, on était déjà contre cette amnistie unique, mais il se fait que, quelques mois après avoir déclaré que ce n'était de toute façon pas à refaire, le ministre Reynders en 2006 fait une DLU bis. C'est un paradoxe: on fait une nouvelle opération, un bis, d'une mesure qui est unique. Pour rappel, dans DLU, U est mis pour "unique".

En 2013, on continue! Dans DLU,le U est mis pour "universel" sans doute. On ne s'arrête pas là! Vient ensuite la DLU ter. De nouveau, un membre du CD&V fait une déclaration choc: "C'est la dernière fois que cette possibilité d'amnistie sera proposée." Voilà, on en est à la troisième mouture mais, cette fois-ci, c'est la "der des der". C'est encore un CD&V qui fait une déclaration en ce sens, le ministre des Finances de l'époque, Koen Geens.

C'est une petite parenthèse. Je ne veux pas accabler le CD&V, mais vous voyez quand même l'évolution: en 2003, opération de blanchiment à grande échelle, en 2013, c'est la "der des der", et puis, aujourd'hui, opération de régularisation permanente! L'évolution est assez cocasse, si on pouvait en rire, ce qui n'est malheureusement pas le cas! En 2016, nous arrivons à la DLU quater mais permanente. En même temps, c'est une bonne nouvelle. On peut se dire que c'est effectivement la dernière, vu qu'elle est permanente et qu'il n'y en aura plus d'autres après. La consolation est maigre. On passe, en effet, à une étape supérieure. On amplifie l'incitant à frauder, puisque le fraudeur sait qu'il aura l'éternité devant lui pour régulariser sa situation! Il peut donc frauder des années durant. Il saura qu'il pourra régulariser sa situation quand il le voudra, quand cela l'arrangera! C'est évidemment un problème assez important.

"Opération de blanchiment à grande échelle" disait Peter De Crem à l'époque. Effectivement, cela pose aussi un problème réel en termes de blanchiment. C'est l'ancien responsable de la CTIF, M. Delepière, qui le mentionnait. Je le cite: "Rien de mieux qu'une régularisation fiscale pour blanchir l'argent du crime organisé." C'est ce qu'il déclarait, il y a quelque temps. Effectivement, l'un des problèmes constatés, c'est que la CTIF fait probablement son travail avec les moyens dont elle dispose mais qu'au niveau de la justice, il n'y a pas de suivi. Il n'y a presque aucun dossier de blanchiment qui arrive au tribunal. On a donc une impunité assez importante.

La question des pénalités pose évidemment problème puisque, ici, il est vrai qu'on peut dire que par rapport à d'autres opérations, les pénalités sont peut-être un peu plus élevées, mais on reste dans des pénalités très gentilles de l'ordre de 20 à 25 %. Cela reste en tout cas en dessous des 50 % qui sont dus en cas d'intention frauduleuse dans le Code des impôts. Cela reste très en dessous de la pénalité qui frappe le petit fraudeur ordinaire, celui qui prend le bus sans payer et qui doit payer, par rapport au prix du billet, une pénalité de 5 000 %. On est évidemment très loin de cela. Surtout, on échappe au pénal. C'est d'ailleurs dans ce sens-là que le PTB a introduit un amendement pour enlever cette possibilité d'échapper aux poursuites pénales à partir du moment où l'on applique cette régularisation. Pour rappel, Al Capone a pu être mis en prison, pour cause de fraude fiscale. On peut dire qu'en Belgique, Al Capone aurait échappé à la prison!

I would also like to return to the substance of the matter. Without going back on thirteen years of tax history, I would like to bring the text back to consideration in the process of tax amnesty as it occurs in Belgium and remind that, finally, we find ourselves facing the history of a single amnesty that has become repetitive before becoming permanent. I would like to summarize in one sentence the text I am talking about.

As a reminder, in 2003 the DLU was voted, i.e. the single liberatory declaration – I say very unique – to which the PTB, which was not yet represented in parliament, was already opposed. If I refer to the Scourneau classification, at the time, the PTB was already part of the bonds to the extent that it already opposed tax amnesty while the MR was already part of the bad ones who defended it. At the time, it was Mr. Didier Reynders, then Minister of Finance, who carried the project.

Why were we already opposed to this project in 2003? Because it is neither more nor less than an incentive to fraud that, in the short term, makes money return to the cash, but that, in the long term, generates a much larger budget loss.

The incentive to fraud is amplified, since the fraudster knows that he will have eternity ahead of him to regularize his situation! They can cheat for years. He will know that he will be able to regulate his situation when he will, when it will fix it! This is obviously a quite important problem.

“A large-scale whitening operation,” said Peter De Crem at the time. In fact, this also poses a real problem in terms of laundering. This is the former head of the CTIF, Mr. Delepière, who mentioned it. I quote him: "Nothing better than a tax regularization to wash money from organized crime." Indeed, one of the problems found is that the CTIF probably does its work with the means it has available but that at the level of justice, there is no follow-up. There are almost no money laundering cases coming to court. There is a very high level of impunity.

The question of penalties obviously poses a problem since, here, it is true that it can be said that compared to other operations, the penalties are ⁇  a little higher, but we remain in very gentle penalties of the order of 20 to 25%. This remains in any case below the 50% that are due in case of fraudulent intent in the Tax Code. This remains well below the penalty that strikes the small ordinary fraudster, the one who takes the bus without paying and who must pay, in relation to the price of the ticket, a penalty of 5,000%. Of course, we are very far from that. Especially if they escape the penalty. It is also in this sense that the PTB introduced an amendment to remove this possibility of escaping criminal prosecution from the moment that this regularization is applied.                     Je terminerai par cette conclusion: ce projet de régularisation fiscale permanente s'inscrit dans une politique fiscale qui permet aux plus riches et aux grandes sociétés d'échapper à l'impôt. Cette régularisation s'intègre dans une fusée à six étages servant à échapper à l'impôt quand on est riche ou qu'on est une grande société multinationale.

Le premier étage de la fusée, ce sont les lois sur mesure, comme celles dont on a discuté ce matin: les fonds immobiliers, la taxe Diamant, les déductions pour brevets, toutes ces lois qui sont faites sur mesure pour un secteur économique particulier.

Deuxième étage de la fusée: tout le système des rulings. D'un côté, on a le "prêt-à-taxer" pour le contribuable ordinaire, mais de l'autre, pour des secteurs particuliers qui ont des entrées au Service des décisions anticipées, des arrangements peuvent avoir lieu.

Le troisième étage de cette fusée est l'absence de lutte volontariste contre la fraude fiscale.

Le quatrième, c'est la régularisation fiscale permanente dont nous discutons actuellement.

Le cinquième étage est également l'œuvre du ministre Geens quand il était ministre des Finances: c'est la transaction pénale, qui permet à des diamantaires ou à des Chodiev d'échapper à la justice.

Le sixième étage, ce sont les procès, comme celui de la KB Lux et d'autres, où de grands fraudeurs échappent aux sanctions à l'issue d'un procès de procédure particulièrement fastidieux, où tout est fait pour mettre des bâtons dans les roues et empêcher la condamnation de ces grands fraudeurs.

Voilà un système fiscal qui permet à certains d'échapper à l'impôt. Cette régularisation fiscale permanente s'inscrit parfaitement dans ce processus.

                    Monsieur le président, le collègue Van Hees a toujours des grands noms comme références: Lénine, Staline, Al Capone. Heureusement que dans notre pays, plus personne n'est envoyé en prison pour vente de bières, sinon nos estimés collègues auraient quelques soucis!

Cela étant, il est toujours fallacieux de présenter le système de régularisation fiscale comme un système incitant à la fraude fiscale. C'est un système assorti de sanctions très lourdes; elles peuvent s'élever jusqu'à 40 %.

Monsieur Van Hees, c'est comme si, parce que vous pouvez payer une contravention pour excès de roulage, vous étiez invité à dépasser les limites de la vitesse tolérée. Évidemment, c'est faux! Ce n'est pas de cette manière que fonctionne le système. La sanction, c'est 40 % à payer sur des montants qui auraient été détournés et pour les causes que nous connaissons.

S'il y a une sanction, il n'y a pas une incitation et il n'y a pas un plaisir à être sanctionné! Ne présentez pas ce système comme une incitation! C'est une présentation fallacieuse et intellectuellement malhonnête.

Voor mij is het absoluut een raadsel hoe een geheel van dergelijke maatregelen, waarvan ik er maar enkele genoemd heb en die nog moeten worden aangevuld met maatregelen die in voorbereiding zijn, ook maar enigszins op een logische verdedigbare manier gerijmd kan worden met de stelling dat fiscale fraude geen belangrijke prioriteit zou zijn. Het tegendeel is waar.

De regularisatie die wij nu voorstellen, met al haar kenmerken, maakt onderdeel uit van een driehoek kaaimantaks, regularisatie en antifraudemaatregelen, die logisch en coherent is. Die is overigens ook logisch in de internationale context, waar enerzijds langs diverse zijden de druk toeneemt en anderzijds de mazen van het net dichtgaan. Net daarom zijn wij ervan overtuigd dat de drie maatregelen elkaar wederzijds zullen versterken en tot goede resultaten zullen leiden op het vlak van fraudebestrijding, rechtszekerheid en het kanaliseren van kapitalen naar de reële economie en de jobcreatie.
