Mijnheer de voorzitter, collega’s, ik weet dat het laat is maar ik doe een poging.
Beeld u het zich even in. De afgelopen maanden stelde de politie een twintigtal processen-verbaal op. U vraagt om hulp en steun, u roept om bescherming, maar meer dan vaststellen van de feiten kan de politie voor u niet doen. Sinds u van uw vrouw aan het scheiden bent, is zij onherkenbaar veranderd. Meermaals slaat zij het huis kort en klein. Tot zij het ultieme wraakmiddel heeft gevonden: uw vrouw dreigt ermee uw gezamenlijke kinderen te vermoorden. U bent ten einde raad. U trekt naar hotels. Naar een gezinspark. U doet alles om uw kinderen in veiligheid te stellen. En dan wordt uw vrouw opgenomen in een psychiatrisch ziekenhuis. Even rust. Even veilig. Maar het ziekenhuis ontslaat uw vrouw en brengt u daarvan niet op de hoogte. Vier uur later is uw 4-jarig zoontje dood. En daarna is het de beurt aan uw 8-jarige dochter, maar door de ingenomen medicatie valt de mama in slaap, en als bij wonder ontsnapt het meisje aan een gruwelijke dood. Vanuit de gevangenis dreigt uw vrouw nog steeds.
Dit zou een angstaanjagend fictieverhaal kunnen zijn maar het is helaas echt gebeurd. Het overkwam Kim Vanhauwaert, stichter van de vzw Bescherm de Kinderen. Het is een ontroerend verhaal, collega’s, dat niet alleen mijzelf maar ook een aantal andere collega’s gegrepen heeft.
Bij deze gelegenheid wil ik Kim Vanhauwaert bijzonder bedanken voor de bewonderenswaardige reactie die hij had. Hij heeft een vzw opgericht die onder meer tot streefdoel had de wet van 26 juni 1990 inzake de persoon van de geesteszieke aan te passen.
Wij hebben daar gehoor aan gegeven. Het resultaat is dat wij vandaag, hopelijk unaniem zoals in de commissie voor de Justitie, dit wetsvoorstel zullen goedkeuren.
De aangepaste wet zal de naaste familie beter betrekken bij de opvolging van geesteszieken. Zo wordt de vrederechter verplicht de naaste familie te horen voor een verzoek tot opname. Alle beslissingen, bijvoorbeeld opname of nazorg, moeten ook voorafgaandelijk aan de familie worden meegedeeld zodat die zich kan voorbereiden. Onder meer minderjarige kinderen zullen op die manier beter worden beschermd.

This could be a terrifying fiction story, but unfortunately it really happened. Kim Vanhauwaert, founder of the organization Protect the Children. It is a touching story, colleagues, which has captured not only me, but also a number of other colleagues.
On this occasion, I would like to thank Kim Vanhauwaert especially for his admirable response. He established an association aiming, among other things, to amend the law of 26 June 1990 on the person of the mentally ill.
We have listened to it. The result is that today, hopefully unanimously as in the Justice Committee, we will approve this bill.
The amended law will better involve the nearest family in the succession of mentally ill people. For example, the peace judge is obliged to hear the nearest family for a request for admission. All decisions, such as admission or follow-up care, should also be communicated in advance to the family so that it can prepare. In this way, underage children will be better protected.

Concreet zal de vrederechter verplicht een aantal personen uit de dichte familie van de zieke moeten horen over het verzoek tot opname. Vandaag is dat optioneel. Het gaat, naast de verzoeker, om de echtgenoot of degene die wettelijk samenwoont met de zieke of er een feitelijk gezin mee vormt. Wanneer het een minderjarig kind is, wordt ook de andere ouder of de persoon die voor het kind zorgt, gehoord, ook al betreft het heel vaak de ex-partner van de geesteszieke. Ook de wettelijke vertegenwoordigers, meestal de ouders of de voogd van de minderjarige zieke, worden gehoord.
Dankzij de hoorplicht krijgt de rechter een zo ruim mogelijk zicht op de situatie, wat de beslissingen alleen maar ten goede kan komen. Die verplichting mag echter, dit begrijpen wij ook, niet onnodig tot vertragingen leiden. Vandaar werd erin voorzien dat binnen de 10 dagen na de indiening van het verzoekschrift tot opname in ieder geval een oordeel zal moeten volgen. Het is ook belangrijk dat, indien de wet er komt, alle betrokkenen ook verplicht ingelicht zullen worden over de genomen beslissingen.
Collega’s, dankzij deze twee maatregelen zullen de naasten beter betrokken worden bij rechterlijke beslissingen en bij het lot van de geesteszieke en zijn minderjarige kinderen. Dat is belangrijk. Het is een kleine stap vooruit, maar voor heel veel gezinnen kan die ongetwijfeld het verschil maken. Ik dank u voor uw unanieme steun.

Mijnheer de voorzitter, collega’s, wanneer hebt u voor het laatst een wetsvoorstel goedgekeurd dat efficiënt, resultaatgericht en kostenbesparend is en tegelijkertijd de rechtszekerheid verhoogt? Dat is een eeuwigheid geleden, maar vandaag kunt u dat nog eens doen.
Alle gekheid op een stokje, de roep van de Dienst Invorderingen om een betere procedurele aanpak van de invorderingen klinkt al een tijdje. Onlangs hebben wij, samen met de administratie en met de medewerking van een aantal mensen op het terrein, een lijst kunnen samenstellen met ongeveer 35 redenen waarom in bepaalde gevallen de invordering van belastingen wordt bemoeilijkt.
Wij kunnen die grosso modo in vier categorieën indelen. Ten eerste, redenen van praktische aard, waarvan wij eentje vandaag zullen aanpakken met de procedure van de brieven. Ten tweede, fraude die zeer moeilijk opvolgbaar is, bijvoorbeeld de onvermogendheid waar een aantal mensen zich in nestelen. Er is ook de opvolging van bepaalde dossiers. Een voorbeeld daarvan is het ontbreken van een digitaal register van beroepsverboden. Er zijn ook bepaalde barrières die wettelijk zijn opgebouwd, namelijk de beslagbaarheid in het buitenland van bepaalde inkomsten die ook de overheid ter beschikking stelt. Op dit moment hebben wij, samen met mijn fractie, omtrent al die verschillende redenen en categorieën van bemoeilijkingen rond invorderbaarheid verschillende wetsvoorstellen gemaakt.
Ook inzake de praktische procedurekwesties hebben wij geluisterd. Vandaag liggen twee ingrepen voor. Ten eerste, het op orde zetten van de procedure van de tenuitvoerlegging. Wij zorgen ervoor dat de belastingplichtige duidelijk op voorhand weet wanneer er een tenuitvoerlegging zal gebeuren. Ten tweede, een veel efficiënter briefbeheer door het afschaffen van het aangetekend schrijven dat wij vandaag nog steeds sturen als herinneringsbrief. In navolging van collega Van Mechelen in Vlaanderen zetten wij die procedure nu stop.
Er worden jaarlijks zo’n 250 000 herinneringsbrieven verzonden door de personenbelastingen.

When was the last time you passed a bill that was efficient, result-oriented and cost-efficient while at the same time increasing legal certainty? It was an eternity ago, but today you can do it again.
All madness on a stick, the call of the Recovery Service for a better procedural approach to recovery has sounded for a while. Recently, we, together with the administration and with the collaboration of a number of people on the ground, have been able to draw up a list of approximately 35 reasons why, in some cases, the collection of taxes is difficult.
We can grossly divide them into four categories. First, reasons of a practical nature, one of which we will address today with the procedure of the letters. Second, fraud that is very difficult to track, for example, the incapacity in which a number of people settle. There is also the follow-up of certain files. One example is the lack of a digital register of occupational prohibitions. There are also certain barriers that are legally built up, namely the seizability abroad of certain incomes that the government also makes available. At present, together with my group, we have drafted various legislation on all these different reasons and categories of difficulties surrounding recovery.
We also discussed practical procedural issues. Today there are two interventions. First, the ordering of the implementation procedure. We ensure that the taxpayer knows clearly in advance when an enforcement will take place. Second, a much more efficient letter management by abolishing the registered writing that we still send today as a reminder letter. Following colleague Van Mechelen in Flanders, we now stop this process.
Approximately 250,000 reminders are sent annually by the taxpayers.

In het wetsvoorstel hebben wij ook een element van rechtszekerheid opgenomen. In de toekomst zal een duidelijkere lijn worden getrokken vanaf wanneer er beslag gelegd kan worden. Er kan beslag worden gelegd 30 dagen na de verzending van de brief. Die 30 dagen gaan in drie dagen na het verzenden van de brief.
Er kwam slechts één punt van kritiek vanuit de oppositie, namelijk dat wij voor deze wet hebben samengewerkt met de administratie. De scheiding der machten werd daarbij in vraag gesteld. Dat is natuurlijk nonsens. Als wetgevende macht hebben wij het systeem van de prejudiciële vragen. De wetgevende macht mag natuurlijk ook niet blind zijn voor wat er zich op het terrein afspeelt. Een goed participatief proces om tot goede, kwalitatieve wetgeving te komen, komt ons allen alleen maar ten goede.

Wij sluiten ons aan bij het voorstel, omdat we de nieuwe formulering belangrijk vinden. Waarover gaat het? Met het voorstel moeten problemen inzake adoptie wanneer koppels, in casu holebikoppels, worden opgelost. Overigens waren de problemen al minder prangend geworden en zelfs gedeeltelijk verholpen dankzij een vorig wetgevend initiatief, dat ik destijds mee heb uitgeschreven, met name de wet op de meemoeders.
Onze fractie heeft – dit mag ik wel zeggen – een belangrijke bijdrage geleverd aan de actualisering van de wetgeving inzake adoptie, in casu de opgelegde voorwaarden. Met de tekst krijgt de rechter de mogelijkheid om desgevallend tegen de wil in van een ouder adoptie mogelijk te maken. We hebben daarbij precieze voorwaarden gesteld, het juridisch kader verduidelijkt en wettelijke samenwoners en feitelijke samenwoners die drie jaar samenwonen, erin mee opgenomen.

Je vous remercie pour ce travail qui va permettre à toutes ces personnes de remplir leur rôle de parents vis-à-vis d'enfants avec qui ils partagent de grands morceaux de vie.

Monsieur le président, cette proposition de loi est de celles qui devraient emporter l'assentiment du plus grand nombre, tant beaucoup d'entre nous en partagent l'objectif. Elle aborde la reconnaissance prénatale d'un enfant par des parents non mariés. Il apparaît que, si la législation reste muette à cet égard, les services de l'État civil de plusieurs communes du Royaume appliquent d'autorité des règles énonçant, par exemple, qu'on ne peut pas faire de déclaration avant six mois de grossesse. La proposition vise à autoriser la reconnaissance prénatale par un parent non marié dès qu'une attestation médicale établit cette grossesse.
Même si le texte ne devait pas soulever de contestation, Mme Ôzen, du PS, a émis une observation. Elle s'inquiétait en effet de savoir si ce type de législation n'allait pas accorder un statut à l'enfant à naître et mettre en péril les critères légaux permettant l'avortement dans le respect d'un certain délai. Les commissaires qui se sont prononcés en faveur de ce texte, et je tiens à le rappeler ici, ont considéré qu'il ne fallait pas amalgamer les deux situations, puisqu'il s'agissait de deux questions totalement distinctes. Bien comprise, la proposition permet la reconnaissance prénatale dès la reconnaissance médicale de l'enfant – sans autre interprétation possible.
Le texte a été adopté à l'unanimité, moins l'abstention de Mme Özen.

The Commissioners who voted in favour of this text, and I would like to recall it here, considered that the two situations should not be amalgamated, since they were two completely separate issues. Well understood, the proposal allows prenatal recognition from the medical recognition of the child – without any other possible interpretation.

Comme vous le savez, la présente proposition de loi vise à uniformiser une pratique qui, bien que mise en place dans de nombreuses administrations communales, ne correspond pas au prescrit de la loi sur la reconnaissance prénatale par les couples non mariés. Comme vous le savez aussi, cela prend effet lorsque les enfants sont nés et viables. L'unique objectif de cette proposition est de remettre les citoyens sur un pied d'égalité en faisant en sorte qu'en matière de filiation, un enfant égale un enfant, sans qu'il n'y ait de disparité selon la commune de naissance.
Aujourd'hui, de nombreuses administrations exigent un délai de six mois de grossesse avant la reconnaissance prénatale; d'autres ne l'exigent pas. Un tour d'horizon d'une quarantaine d'administrations du pays a permis de s'en rendre compte. Chers collègues, il me paraît nécessaire de revenir sur deux éléments très importants: d'abord, sur la nécessité de cette modification du Code civil; ensuite, comme l'a rappelé en commission notre collègue Christian Brotcorne et comme je l'ai déjà dit, sur le fait qu'il ne faut pas donner à ce texte une portée qu'il n'a pas.
En ce qui concerne la nécessité de cette proposition, je voudrais remercier le gouvernement et, particulièrement, M. le ministre de la Justice, que j'avais questionné à ce propos il y a deux ans, pour leur soutien à la proposition.

En conclusion, je tiens à remercier l'ensemble des collègues qui ont saisi l'importance des aspects de ce que je viens de vous présenter. Pour le groupe MR, je tiens à saluer le fait que cette proposition a presque récolté l'unanimité des votes en commission.
Enfin, puisque la question de la portée de cette proposition de loi a été réglée et surtout parce qu'un enfant doit être égal à un enfant en Belgique, et ce aussi en matière de filiation, que les parents soient originaires de Jemeppe-sur-Sambre, Sambreville, Aiseau-Presles, Ostende ou Ixelles, j'invite nos collègues qui se sont abstenus à soutenir aujourd'hui cette proposition de loi qui a pour seul objectif de consacrer le principe majeur de l'égalité des citoyens devant la loi.

D'accord, il y a une insécurité juridique et des pratiques administratives différentes d'une commune à l'autre. Vous avez donné des exemples pratiques. Il faut y mettre fin. Mais nous n'intervenons dans le bon sens ni sur le fond, ni sur la forme, puisque le moyen choisi est contestable. Vous savez comme moi que pour contrer une pratique administrative, une circulaire suffirait à harmoniser les pratiques. Faire une loi est complètement inutile. Il s'agit d'une erreur de méthodologie légistique et d'une utilisation de la loi à des fins administratives.
Si la loi ne prévoit pas de délai, la politique de certaines administrations communales n'apparaissait pas absurde, puisqu'elles requièrent un délai de six mois qui correspond de fait au délai de 180 jours requis par l'article 80 bis du Code civil concernant la reconnaissance des enfants nés sans vie. C'est peu ou prou la limite actuelle de viabilité, soit 25 semaines depuis la conception.
Cette proposition constitue une menace qui pèse à nouveau, comme les propositions de loi sur les enfants nés sans vie, sur les droits des femmes en Belgique. Cette reconnaissance de parents s'inscrit dans un processus dangereux. Il s'agit d'abord d'une reconnaissance implicite du fœtus, puisqu'on donne la possibilité à un parent de reconnaître l'enfant à naître dès les premiers jours de la grossesse. This is little or enough of the current limit of viability, which is 25 weeks from the design.
This proposal represents a threat that weighs again, as do the proposals for a law on unborn children, on the rights of women in Belgium. This recognition of parents is part of a dangerous process. This is primarily an implicit recognition of the fetus, since it gives a parent the opportunity to recognize the unborn child from the first days of pregnancy. What is the next stage?

Mijnheer de voorzitter, collega’s, in 2006 werd de elektronische identiteitskaart voor kinderen jonger dan 12 jaar, de gekende kids-ID, ingevoerd. Dit document wordt gebruikt om de identiteit te bewijzen van de houder en maakt het reizen in België en andere EU-landen mogelijk.
De kids-ID bevat ook dure certificaten die kunnen gebruikt worden om een beveiligde online-omgeving te creëren, maar die toepassingen worden, mijns inziens, nauwelijks gebruikt. Daarbij komt dat de kaart slechts drie jaren geldig is, dit in tegenstelling tot de elektronische identiteitskaart voor volwassenen. Hierdoor loopt de kostprijs natuurlijk op.
Nieuwe technologische toepassingen kunnen mogelijk een invloed hebben op de verschijningsvorm van de kaart zelf en kunnen eventueel ook de levensduur, en daarin geloven wij, ervan verlengen. Bovendien kunnen zo absoluut ook kosten bespaard worden. Ook een snellere behandeling van alle aanvraagprocedures voor de kids-ID is volgens ons mogelijk. Wij hebben daaromtrent ook voorstellen gedaan. Aangezien de kids-ID niet verplicht is, zou de aanvraag van de kaart volgens ons ook gemakkelijker en sneller kunnen gebeuren.
Het gaat om heel wat zaken die voorliggen die door meerderheid en oppositie gesteund worden. Vandaar deze resolutie. Als de stemming vandaag plaatsvindt en positief is, hopen wij dat de minister zich achter deze resolutie kan scharen en de nodige initiatieven hiervoor kan nemen.

There are many issues that are being supported by the majority and the opposition. Hence this resolution. If the vote takes place today and is positive, we hope that the Minister can support this resolution and take the necessary initiatives to do so.
