                    Monsieur le président, je suis très heureux de constater que ce texte revient auprès de notre assemblée, après une première tentative au terme de laquelle nous l'avions renvoyé à la commission de la Justice, laquelle l'a quelque peu amendé.

Contrairement à ce que pourrait laisser accroire l'intitulé de la proposition de loi, il s'agit plus exactement de prévoir que, dans tous les modes alternatifs de règlement d'un conflit, en dehors de procédures judiciaires - la médiation, l'arbitrage ou l'expertise -, le libre choix d'un professionnel qualifié puisse aussi être acquis à quiconque souscrit une protection juridique. Le champ d'application est donc étendu au-delà du choix de l'avocat dans une phase judiciaire ou administrative.

Je me réjouis que le texte ait pu recueillir l'unanimité au sein de notre commission.

                    Monsieur le président, chers collègues, nous sommes aujourd'hui amenés à voter une proposition qui a pour objectif d'étendre le libre choix d'un avocat ou de toute personne ayant les qualifications requises par la loi et, ce, pour toutes les phases judiciaires dans le cadre d'un contrat d'assurance protection juridique.

L'assuré a en effet aujourd'hui le choix de son avocat mais ce choix ne concerne pas les modes alternatifs de règlement de conflits. Or, on l'a répété, le libre choix d'un avocat est absolument important dans une société démocratique car il relève d'un droit fondamental, le droit de la défense qui est consacré par la Convention européenne des droits de l'homme en son article 6.

J'espère que cette fois-ci sera la bonne et que les pressions de groupes d'assurance n'auront pas pour effet de changer l'avis de certains groupes politiques. C'est d'ailleurs à la suite de cet incident que la commission a décidé de procéder à des auditions et, au cours de celles-ci, il est apparu clairement que, pour se conformer à la jurisprudence de la Cour de Justice, une clarification législative était nécessaire. Dans son arrêt du 7 novembre 2013, la Cour de Justice de l'Union européenne a précisé que le principe du libre choix, qui est énoncé par l'article 4 de la directive concernant l'assurance protection juridique, a pour but de protéger, de manière large, les intérêts des assurés, de sorte qu'on ne peut admettre une interprétation restrictive.

Le libre choix de l'avocat est donc un principe qui a une portée générale et une valeur obligatoire et l'extension amenée par cette proposition va dans le sens de la jurisprudence européenne.

Si des raisons financières ont été invoquées par des groupes d'assurance, elles ne peuvent bien évidemment prendre le pas sur la consécration d'un droit fondamental qui est le droit de la défense, comme je l'ai rappelé précédemment.

Pour arriver à un compromis avec la majorité, le champ d'application de ce choix a été réduit pour les médiations. Le choix peut être opéré uniquement pour une personne ayant les qualifications requises et non pour l'avocat. Nous regrettons que nous n'ayons pas pu aller plus loin, ce qui aurait permis au justiciable de choisir, soit, un avocat, soit, une personne qualifiée comme médiateur. Nous pensons que le libre choix d'un avocat devrait pouvoir intervenir, dès que les intérêts de l'assuré nécessitent une protection.

Comme je le disais, une intervention législative était nécessaire pour clarifier l'arsenal juridique, de manière à favoriser la sécurité juridique du justiciable.

Mr. Speaker, dear colleagues, today we are supposed to vote on a proposal that aims to extend the free choice of a lawyer or any person with the qualifications required by law to all judicial phases within the framework of a legal protection insurance contract.

The insured now has the choice of his lawyer, but this choice does not concern alternative modes of conflict resolution. However, it has been repeated, the free choice of a lawyer is absolutely important in a democratic society because it falls within a fundamental right, the right of defence, which is enshrined in Article 6 of the European Convention on Human Rights.

I hope that this time will be the right one and that the pressure of insurance groups will not have the effect of changing the opinion of certain political groups. It was also following this incident that the committee decided to conduct hearings and, during those hearings, it became clear that, in order to comply with the case-law of the Court of Justice, a legislative clarification was necessary. In its judgment of 7 November 2013, the Court of Justice of the European Union clarified that the principle of free choice, which is enshrined in Article 4 of the Directive on legal protection insurance, aims to protect, in a broad way, the interests of the insured, so that a restrictive interpretation cannot be admitted.

The free choice of the lawyer is therefore a principle which has a general scope and a mandatory value and the extension brought by this proposal goes in the direction of European case-law.

If financial reasons have been invoked by insurance groups, they can obviously not take the step on the consecration of a fundamental right that is the right of defence, as I recalled earlier.

In order to reach a compromise with the majority, the scope of this choice has been reduced for mediation. The choice can be made only for a person with the required qualifications and not for the lawyer. We regret that we could not go further, which would have allowed the judge to choose either a lawyer or a person qualified as a mediator. We believe that the free choice of a lawyer should be allowed to intervene, as soon as the interests of the insured require protection.

As I said, a legislative intervention was necessary to clarify the legal arsenal, in order to promote the legal certainty of the justiciable.

                    Mijnheer de voorzitter, collega’s, wij zullen deze tekst met veel overtuiging steunen omwille van de redenen die door de vorige spreker al zijn aangehaald. Het is een zeer positieve tekst. Dat zijn de echte quick wins. We spreken in onze commissie vaak over quick wins en de minister heeft daarvoor dikke potpourri’s nodig, terwijl de collega’s soms met heel eenvoudige voorstellen mooie stappen vooruit kunnen zetten in de wetgeving.

Het siert de commissie voor de Justitie ook dat er openheid is. Dat is de cultuur bij ons en ik ben daar heel tevreden over. Er is de cultuur om over de grenzen van meerderheid en oppositie heen elkaars nuchtere, goede teksten te steunen. Ik hoop dat we op die manier verder kunnen werken. Ik wil de heer Brotcorne heel graag feliciteren met zijn voorstel en ik dank ook de meerderheid omdat ze de oppositie de kans geeft om dergelijke teksten goedgekeurd te krijgen. Meer van dat, zou ik zeggen.
