Monsieur le président, il faut se féliciter de la diligence avec laquelle la commission du droit commercial et, aujourd'hui, l'assemblée plénière nous ont permis d'avancer dans l'examen de ces propositions d'amendement.
Cela nous permettra d'arriver à temps pour que le nouveau Code des sociétés, voté sous la législature précédente mais qui entrera en vigueur le 6 février prochain, puisse être amendé de façon technique en vue d'assurer les concordances indispensables et d'apporter des corrections d'ordre linguistique. Et surtout pour que ces amendements puissent être publiés et prendre effet en même temps que le Code des sociétés.
Il reste cependant un danger: si une évocation devait être opérée par le Sénat, nous risquerions, si la procédure n'était pas suivie très attentivement, de ne plus nous trouver dans les délais pour permettre l'entrée en vigueur de ces amendements en même temps que la loi sur le Code des sociétés. Monsieur le président, je demanderai donc de rester particulièrement attentif à cette concordance en cas d'évocation par le Sénat.
Je tiens à remercier la Chambre parce que je constate avec plaisir que c'est la seconde proposition émanant d'un membre de l'opposition qui a été adoptée - et j'espère encore cette fois - à l'unanimité par notre assemblée.

Mijnheer de voorzitter, beste collega's, wij moeten ons toch wel bewust zijn van het bijzonder belang van dit dossier. Gisteren — het was eigenlijk vannacht — heb ik op deze tribune ten overstaan van de vier of vijf resterende collega's gezegd dat de nieuwe federale politie vanaf 1 januari start in, vanuit democratisch oogpunt, onverantwoorde omstandigheden. Daarnet heb ik u duidelijk gemaakt dat de meerderheid van deze Kamer een volmacht heeft gegeven aan de regering om vrij te kunnen beschikken over het budget van de federale politie. Er zal dus geen enkele begrotingscontrole meer zijn van het Parlement op de 47 miljard frank, zijnde de middelen van de federale politie. Men zal verschuivingen kunnen doen binnen dit budget zonder enige tussenkomst van de Kamer van Volksvertegenwoordigers. Gedaan met de begrotingscontrole van het Parlement op het begroting van de federale politie!
Vervolgens bleef er nog het nationaal veiligheidsplan als instrument voor het Parlement om het veiligheidsbeleid van de regering te controleren. We hebben echter moeten vaststellen dat in het nationaal veiligheidsplan het essentiële element voor deze controle ontbreekt, namelijk de toebedeling van de mensen en de middelen, kortom van de capaciteit, ten overstaan van de prioriteiten die de regering heeft gesteld. Deze capaciteitsverdeling is in dit federaal of nationaal veiligheidsplan niet terug te vinden, zodat wij met dit Parlement niet kunnen controleren welke middelen de regering inzet om de veiligheidsprioriteiten te realiseren. Wat dus heel concreet betekent dat het Parlement geen enkele controle kan uitoefenen op het veiligheidsbeleid van de regering, dat wordt uitgeoefend en uitgevoerd door de federale politie. Er is dus geen begrotingscontrole en geen controle op het beleid. Er rest slechts het toezicht en de controle van de magistratuur op deze federale politie. Dat is een belangrijke conclusie van de parlementaire onderzoekscommissie Dutroux.
Wat heeft men nu gedaan? Men heeft de aanstelling van deze magistraten volkomen gepolitiseerd door ze te laten gebeuren via een in Ministerraad overlegd ministerieel besluit. Dit is een novum in de geschiedenis van onze democratie, een historisch precedent. Voor het eerst kon niet alleen een koninklijk besluit, maar ook een ministerieel besluit in de Ministerraad worden overlegd. Dit is nog nooit gebeurd in de geschiedenis van het Parlement en ik roep de grondwetspecialisten tot getuige.
En dit novum, mijnheer de voorzitter, voltrekt zich onder uw voorzitterschap.
De bevoegdheid van de Ministerraad strekt zich meer specifiek uit tot de aanduiding van de magistraten die toezicht zullen uitoefenen op de federale politie. Concreet betekent zulks dat dit historisch precedent, dit novum, moet dienen als legitimatie van een politiek compromis binnen de regering en de regeringspartijen, houdende de aanstelling van de magistraten die toezicht zullen houden op de federale politie.
Collega's, dit is niet alleen een onvoorstelbaar precedent, het is de totale verloochening van wat kamerbreed in het Octopusakkoord werd goedgekeurd, met name een objectieve benadering van de benoeming en de aanstelling van de magistraten. Het is bovendien de absolute verloochening van de conclusies van de parlementaire onderzoekscommissie Dutroux, die door allen werden goedgekeurd en waarbij uitdrukkelijk werd gesteld dat de federale politie autonoom noch eigenmachtig mag optreden, maar, onder meer, onder het onafhankelijk toezicht moet staan van magistraten.
Dit onafhankelijk toezicht wordt vandaag dode letter door de politieke aanduiding van deze magistraten die trouwens de voorboden zijn van het federaal parket.

In het begin van deze week trok ik aan de alarmbel. Ik vroeg aan de voorzitter van de Kamer om de bijzondere commissie samen te roepen, die belast is met de begeleiding van het Comité-P. Dat is immers onze laatste strohalm als extern controleorgaan op de federale politie. Morgen zal de bijzondere commissie vergaderen en de enige mogelijkheid die ons nog rest is het Comité-P de opdracht te geven om binnen dit democratisch vacuüm die laatste strohalm te nemen, met name het organiseren van een kwalitatief sterke controle op deze federale politie.
Gezien de omstandigheden en het groot risico dat ons bedreigt, zou de minister van Justitie de start van de federale politie moeten afblazen. Inderdaad, als behoeder van de rechtsstaat kan een minister van Justitie een dergelijk risico niet nemen. Sta mij toe u hierop te wijzen, heren van de regering.

Dat impliceert een democratisch tekort. Uiteindelijk is er nog een derde tegenmacht. Dat is een gerechtelijk toezicht op de algemene en de bijzondere werking van de politie. Dat alles was het tegenwicht voor de geïntegreerde politie op twee niveaus. Een aantal mensen vond dat er voldoende tegenmacht moest bestaan als er één politie overblijft.
Het resultaat is dat er geen gerechtelijk toezicht tot stand komt. De meerderheid betwist dat niet. I would like to remind you that when we drafted a new model for the police, we were not looking at a unity police – as when lapsus was stated in the policy note of the minister – but an integrated police on two levels. We paid special attention to the opposition. In a democracy there is no power without opposition. Police was, in our opinion, authority-dependent of the administrative government, of the two ministers and at the local level of the mayor. The police should be democratically controlled. At the local level, this must be done by the municipal or intercommunal police council. At the federal level, however, the commission for the police does not attend. This implies a democratic deficit. Finally, there is a third opponent. This is a judicial supervision of the general and special operation of the police. All this was the counterweight for the integrated police on two levels. Some people thought that there should be enough counter-power if there is only one police left.
As a result, there is no judicial supervision. The majority does not dispute that. Moreover, it also assumes that these duties are not judicial, that these members of the Prosecutor’s Office are appointed by the Government, that they carry out police duties there, that they are in no hierarchical connection with the Prosecutor’s Office and that they are in no hierarchical connection with the College of General Prosecutors. Integendeel, de eerste onderzoekscommissie heeft in haar verslag van 1990 zeer duidelijk gesteld dat men de positie van het openbaar ministerie moest herzien. Dat is hier aan de orde. Het is dus niet de vraag in hoeverre de minister daar enige invloed op zal hebben. In het strafbeleid zullen prioriteiten worden vastgesteld en dat strafbeleid moet door de politiediensten worden toegepast.

Ik heb u gezegd dat ik consequent was en bleef en al wat ik hier heb verdedigd, ligt volledig in de lijn van de visie die wij altijd hebben verdedigd. Desbetreffend hebben wij geen enkele afwijking ten overstaan van een visie die hier werd aangenomen.
Ten tweede, het moet toch ook gezegd worden, want wij spreken hier niet academisch maar politiek, wanneer in het voorstel van collega Bourgeois de optie werd genomen om plots de magistraten van het openbaar ministerie onder het college te plaatsen, was het voor mij zeer duidelijk dat die optie in strijd was met wat in het voorstel was verwerkt voor het toekomstige federaal parket. Daar werd de discussie dus reeds op voorhand uitgelokt. Toen het voorstel voor de eerste keer in de Kamer werd besproken heb ik u hier, vanop deze tribune gezegd, dat ik geen hypotheek wenste te leggen op de toekomst wanneer men nu deze magistraten in een andere functie wilde plaatsen dan wat uiteindelijk mijn benadering was van de functie van een federaal parket.
Ten derde, de Senaat heeft inderdaad de woorden met betrekking tot het advies van het college van procureurs-generaal weggelaten, maar u hebt de minister gehoord. Ik noteer en acteer dat hij, zoals het met zoveel woorden in de wettekst staat, namelijk dat elke magistraat zal moeten beantwoorden aan de voorwaarden die later moeten worden geëist van kandidaten voor het federaal parket, inderdaad adviezen vraagt. Het profiel als dusdanig zit er dus in. Het is een ministerieel besluit, geen benoeming. U weet welke consequenties in een benoeming zouden zitten. Het kon geen koninklijk besluit zijn.
