Mevrouw Claudine Drion heeft in naam van de Agalev-Ecolo-fractie een opmerking gemaakt waarin zij betreurt dat de internationale gemeenschap niet meer doet dan een aantal verdragen over de voedselhulp te sluiten. Net op het moment van de bespreking werd de VNConferentie van de Minst Ontwikkelde Landen hier in Brussel afgesloten. Daar is eens te meer duidelijk gebleken dat ontwikkelingslanden nood hebben aan meer en vooral andere maatregelen om voor een effectieve voedselzekerheid te kunnen zorgen en effectief armoede te kunnen bestrijden en overwinnen. Er wordt aandacht gevraagd voor de bepalingen in artikel 13 van het verdrag, die aangeven dat voedselhulp aan een aantal voorwaarden moet beantwoorden om zo een reële mogelijkheid tot ontwikkeling te betekenen. Zij vraagt meer bepaald dat België de impact van zijn voedselhulpprogramma's zou evalueren zoals ook in punt j van dat artikel wordt gevraagd. Tot slot onderstreept ze dat de verwezenlijkingen van het Belgisch overlevingsfonds duidelijk aangeven dat andere benaderingen mogelijk zijn om voedselzekerheid te verkrijgen.
Met deze opmerking is de overeenkomst unaniem goedgekeurd.

Je rappellerai simplement les trois objectifs de ce projet de loi qui sont, dans le cadre de la libéralisation du marché de l'électricité et du gaz, la mise à disposition de la CREG de fonctionnaires délégués pour la recherche et la poursuite des infractions à la loi, la libéralisation accélérée de la distribution et des producteurs d'électricité et des clients finaux et l'introduction de tarifs réglementés.
Je voudrais dépasser quelque peu le cadre de ce projet qui est important pour tous ceux qui veulent que la libéralisation s'effectue dans des délais les plus rapprochés. La Belgique va évidemment se plier à ces exigences de libéralisation puisque la Commission européenne exige que ce soit fait pour 2005.
Pour les écologistes, il importe que cette libéralisation se combine avec des mesures qui permettent, parallèlement à cette libéralisation, à la fois la régulation des marchés énergétiques en fonction d'impératifs environnementaux et l'encouragement de l'utilisation d'énergies propres.
Cela implique plusieurs choses. D'abord des politiques qui mènent à une réduction de la consommation, quelle que soit la nature de l'énergie utilisée. Les mesures nécessaires pour atteindre cet objectif dépassent évidemment le cadre de ce projet de loi mais, en s'engageant à la fois dans la ratification du protocole de Kyoto et dans le soutien de la Commission européenne qui vient de communiquer un texte relatif au développement durable, le gouvernement belge s'engage, me semble-t-il, à mettre en place tous les outils nécessaires pour atteindre les objectifs visés.
Je profite également de cette intervention pour rappeler que la Belgique dispose également d'un outil, d'un guide d'actions concrètes qui est le plan fédéral de développement durable, et qu'il nous faut valoriser au maximum cet outil.
Il faut ensuite des politiques qui favorisent l'utilisation de produits énergétiques non polluants ou les moins polluants possibles et le gaz naturel fait partie des sources d'énergie à privilégier, aux dépens du mazout et de l'électricité, tant que celle-ci est produite majoritairement par l'énergie nucléaire.
Il faut encore des politiques qui permettent une régulation des moyens et des conséquences économiques de la libéralisation et nous en venons ainsi au contenu de ce projet de loi qui dépasse les exigences de la Commission européenne en ce qui concerne le transport du gaz naturel.
L'exigence européenne est donc de séparer des fonctions de transport, de transit, de distribution et de stockage. Elle exige que la part du coût relative au transport soit différenciée dans les tarifs. Le gouvernement belge va plus loin, notamment en raison du fait qu'en Belgique, il n'existe qu'un opérateur de transport. Une régulation par l'Etat s'avère donc indispensable; l'accès au réseau de transport sera soumis à des tarifs réglementés au lieu que l'on recoure à des négociations commerciales.
Nous espérons, parallèlement à cela, que l'Etat fédéral pourra conclure rapidement des accords avec les régions pour étendre cette réglementation à la distribution. Le prix pour le client final appartient effectivement aux compétences régionales tandis que le niveau fédéral intervient pour les tarifs sociaux. Ces négociations avec les régions sont d'autant plus importantes qu'elles doivent parvenir à un accord pour la constitution d'un fonds social. Ce dernier sera financé par les acteurs du marché du gaz. Il garantira la fonction de service public qui est nécessaire pour contrecarrer les exclusions qui découlent généralement des mécanismes de libéralisation.
Une autre nécessité importante à laquelle répond ce projet de loi est de confirmer le mécanisme actuellement provisoire qui permet de financer la CREG, outil indispensable à la fonction de régulation du marché de l'électricité et du gaz.
Nous espérons enfin que le groupe de travail qui planche sur la question de savoir comment maintenir aux communes les revenus qui leur étaient versés via les dividendes payés par les intercommunales, trouvera rapidement une solution et que ces communes manifesteront un intérêt à devenir des actionnaires, des gestionnaires des réseaux de transport, qu'il s'agisse de l'électricité ou du gaz, de manière à participer aux bénéfices qui résultent de cette activité. Elles devront également veiller à la qualité du service rendu à leurs citoyens.

For environmentalists, it is important that this liberalization is combined with measures that allow, parallel to this liberalization, both the regulation of energy markets according to environmental imperatives and the encouragement of the use of clean energies.
This involves several things. First, policies that lead to a reduction in consumption, regardless of the nature of the energy used. The measures necessary to ⁇ this objective are obviously beyond the scope of this bill, but, by committing itself both to the ratification of the Kyoto Protocol and to the support of the European Commission, which has just communicated a text on sustainable development, the Belgian government seems to be committed, in my opinion, to put in place all the tools necessary to ⁇ the objectives envisaged.
I also take advantage of this intervention to remind that Belgium also has a tool, a guide for concrete actions, which is the federal plan for sustainable development, and that we must maximize this tool.
There is also a need for policies that promote the use of non-polluting or the least possible polluting energy products and natural gas is among the sources of energy to be preferred, at the expense of oil and electricity, as long as it is produced mostly by nuclear energy.
There is still a need for policies that allow the regulation of the means and economic consequences of liberalization and we are thus coming to the content of this bill that goes beyond the requirements of the European Commission with regard to the transport of natural gas.
The European requirement is therefore to separate the functions of transport, transit, distribution and storage. It requires that the share of transport costs be differentiated in the tariffs. The Belgian government goes further, in particular due to the fact that in Belgium there is only one transport operator. State regulation is therefore indispensable; access to the transmission network will be subject to regulated tariffs instead of using commercial negotiations.
We hope, parallel to this, that the federal state will be able to quickly conclude agreements with the regions to extend this regulation to distribution. The price for the end customer actually belongs to the regional competencies while the federal level intervenes for social rates. These negotiations with the regions are all the more important as they need to reach an agreement for the establishment of a social fund. This will be financed by the gas market participants. It will guarantee the public service function that is necessary to counter the exclusions generally resulting from liberalization mechanisms.

Voorzitter, ik kom ter zake met mijn commentaar op het wetsontwerp.Ten eerste, onze situatie inzake aardgas. Ik vertel niets nieuws als ik zeg dat wij geen bronnen hebben, maar wij beschikken evenmin over betekenisvolle opslagcapaciteit. Dat wil zeggen dat onze afhankelijkheid van het buitenland zeer groot is.
Dat is een eerste probleem.
Het tweede probleem zijn de piekmomenten, bijvoorbeeld bij een strenge winter. Wij zullen dan een beroep moeten doen op piekinstallaties in het buitenland, wat ons ook veel geld zal kosten. Die zeer grote afhankelijkheid doet ons de vraag stellen naar de Belgische strategie terzake. Is er een strategie inzake gas of aardgas? Ik denk dat wij eerst en vooral een beleid moeten voeren om pieken in het verbruik te vermijden. Die pieken zijn juist bijzonder kostelijk en vormen een probleem bij de bevoorrading. Vervolgens moeten wij meer contracten sluiten die onderbreekbaar zijn. Op dit ogenblik zijn er reeds, maar ik denk dat wij daar nog verder heen moeten evolueren. Bovendien is een beter beheer van de vraag naar gas nodig. Ook moeten wij ons vragen durven stellen over het vervoer van gas naar streken waar de penetratie gering is. Wij moeten opnieuw het probleem durven stellen en bespreken van diversificatie van de bronnen.
Volgens mij ontbreekt elke strategie op deze punten en dat is jammer, want zonder beleid zijn wij overgeleverd aan een aantal grote operatoren op de aardgasmarkt. Wij zijn van hen afhankelijk zowel wat de prijs van het gas betreft als de hoeveelheid en de zekerheid van levering.
Het tweede punt is de openstelling van de gasmarkt. Die gebeurt te traag. In zekere zin kan ik daarvoor begrip opbrengen en dat volgen, precies omwille van onze kwetsbaarheid en onze afhankelijkheid van het buitenland, want die nopen tot voorzichtigheid.
Toch mogen wij de factor concurrentie niet vergeten. Als wij zo traag de markt openstellen - samen met Frankrijk zijn wij zowat de slechtste Europese leerling - zullen onze prijzen hoog blijven. Zonder concurrentie is er geen druk op de prijzen en dat speelt ten nadele van zowel de commerciële als de industriële bedrijven, de dienstensector, de distributie en de kleine verbruiker.
Mijnheer de staatssecretaris, gisteren konden wij in De Standaard lezen dat u het jammer vindt dat de stroomprijzen in België nog steeds zo hoog zijn en nog altijd niet zijn gedaald. Ik heb hier in zowat al mijn uiteenzettingen hierover al op gewezen, maar het verschil is natuurlijk dat wij er slechts op kunnen wijzen en dat u degene bent die daarin mee verantwoordelijkheid draagt.
Het derde punt betreft de gereglementeerde prijzen. Wij zijn daar voorstander van, want zij leiden tot grotere transparantie. Wij onderschrijven uw politiek terzake.
Het vierde punt betreft de splitsing van Distrigaz. Het wetsontwerp voorziet niet in splitsing of bundeling van enerzijds de aankoop en verkoop en anderzijds de vervoerfunctie. U hebt er altijd naar verwezen dat de Europese richtlijn hierin evenmin voorziet. Wij weten dat die richtlijn en het feit dat de unbundeling daarin niet is opgenomen, voortvloeien uit het feit dat de lidstaten daarover geen akkoord hebben kunnen bereiken. Op dit ogenblik wordt die zaak wel herbekeken op Europees vlak. Wij blijven voorstander van volledige splitsing. Op dit ogenblik is er nog wel een zekere controle via, onder meer, de participatie van de gemeenten. De grote rol die het buitenland hier speelt doet ons de voorkeur geven aan volledige splitsing, ook omdat de gasdoorvoer een zeer belangrijke activiteit is in België.
Ik kom thans tot mijn vijfde punt, de coherentie tussen Vlaanderen en Wallonië. In het Vlaams decreet wordt voorzien in een hogere openingsgraad, waarvan evenwel nog maar enkele honderden bedrijven kunnen genieten. Ook het tempo verschilt. Al die verschillende openingsgraden en tempo's leiden niet tot een coherent geheel, zeker ten aanzien van onze partners en van de operatoren op het terrein.
Via overleg zou men terzake tot eenvormigheid moeten kunnen komen. Het overleg met de gewesten bestaat reeds - in dat verband werd reeds verwezen naar de interministeriële conferentie - maar slechts partieel, hoewel volgens mij een permanent en grondig overleg nodig is.
De aardgassector is erg belangrijk, zowel voor de elektriciteitsproductie als voor de huishoudens en het beleid dat terzake wordt gevoerd is volgens ons onvoldoende. Rekening houdend met de internationale markt moeten wij de concurrentie maximaal laten spelen. Dat is de enige weg naar de lagere prijzen waarvoor u weliswaar pleit, mijnheer de staatssecretaris, maar waartoe in uw beleid weinig initiatieven te merken zijn.

Without competition, there is no pressure on prices, which is detrimental to both commercial and industrial enterprises, the service sector, the distribution sector and the small consumer.

At the moment, there is still some control through, among other things, the participation of the municipalities.
