Mijnheer de voorzitter, ook dit wetsontwerp werd door de Senaat overgezonden en het werd gisteren in de commissie voor de Financiën en de Begroting besproken. Het wetsontwerp strekt ertoe een bepaling uit het Wetboek van Inkomstenbelasting, meer bepaald artikel 442bis, ook in het BTWwetboek op te nemen, bij wijze van een nieuw artikel 93undecies B.
Die bepaling moet de BTW-administratie de mogelijkheid bieden om op een efficiënte wijze de strijd aan te binden met de organisatie van onvermogen in geval bedrieglijke overdracht van een geheel van goederen gebeurt. Om elke poging tot fraude te voorkomen zijn overdrachten van een geheel van goederen in de toekomst pas tegenstelbaar aan de Administratie der Directe Belastingen na afloop van de maand die volgt op die waarin een met het origineel eensluidend afschrift van de akte ter kennis is gebracht van de ontvanger van de woonplaats of van de maatschappelijke zetel van de overdrager. Tijdens die maand kan de belastingadministratie alle nodige maatregelen treffen. Naast die registratieplicht wordt ook de hoofdelijke aansprakelijkheid van de overnemer ingevoerd voor de BTW-schulden van de overdrager tot beloop van het gedrag waartoe hij zich bij overname heeft verbonden.
Om alle problemen inzake tegenstelbaarheid van de overdracht te voorkomen beschikt de overdrager over de mogelijkheid om vooraf van de BTW-administratie een certificaat te bekomen waaruit blijkt dat hij geen belastingschulden heeft. Collega Van Biesen wijst erop dat het eigenlijk logisch is dat de middelen tegen bedrieglijk onvermogen waarover de fiscus op het vlak van inkomstenbelasting beschikt ook zouden gelden op het vlak van de BTW. Bovendien betekent het een vereenvoudiging van sommige administratieve procedures. De artikelen 1 tot en met 3 en het gehele wetsontwerp werden met inbegrip van verbeteringen van legistieke aard eenparig aangenomen in de commissie.

Mr. Speaker, this bill was also transmitted by the Senate and it was discussed yesterday in the Committee on Finance and Budget. The draft law aims to include a provision from the Income Tax Code, more specifically Article 442bis, also in the VAT Code, in the form of a new Article 93undcies B.
That provision should enable the VAT administration to effectively engage in the fight against the organization of insolvency in the event of fraudulent transfer of a set of goods. In order to prevent any attempt to fraud, transfers of a set of goods in the future may only be opposed to the Administration of Direct Taxes after the expiry of the month following that in which a copy of the act consistent with the original has been communicated to the recipient of the place of residence or of the head office of the transferor. During that month, the tax administration can take all necessary measures. Monsieur le président, je vais me permettre de revenir sur un sujet abordé ce matin en m'excusant de ne pas avoir pu intervenir plus tôt.
Je voulais revenir au volet relatif aux éoliennes offshore et plus particulièrement au recours des décisions de la CREG, deux points qui ont déjà fait l'objet de pas mal de discussions ce matin. En effet, ce projet de loi sur lequel nous devons nous prononcer aujourd'hui comporte plusieurs mesures importantes: la mise en oeuvre du tarif dégressif sur la cotisation fédérale pour les grands consommateurs d'électricité, que j'évoquerai en second point, l'instauration d'un cadre favorable aux projets d'investissements sur le parc éolien, par lequel je vais commencer et enfin, l'instauration de la procédure de recours contre les décisions de la CREG.
Il faut peut-être revenir sur le fait que malgré une adoption assez rapide de ces dispositions en commission, elles n'ont pas fait l'objet d'un projet de loi distinct de cette loi mosaïque: cela s'est fait rapidement avec, me semble-t-il, un défaut de concertation, un manque d'avis, notamment de la CREG ou de la Commission européenne. De tels avis nous auraient aidés à produire un texte plus proportionné et meilleur que celui qui nous est présenté aujourd'hui. Je vais expliquer à quels endroits de ce texte résident selon moi les déficiences.
Premièrement, comme je l'ai annoncé, la dégressivité et le nouveau parc éolien offshore. Je pense que le groupe cdH ne doit plus démontrer son attachement à l'énergie verte, à l'énergie éolienne plus particulièrement. Il suffit de traverser la Région wallonne pour se rendre compte que l'action d'André Antoine en tant que ministre de l'Énergie de la Région wallonne a permis une nette avancée dans la production d'énergie éolienne. On ne peut donc pas être taxés d'adversaires de ce type d'énergie.
Deuxièmement, je voulais rappeler le manque d'informations mises à notre disposition dans le cadre de ce dossier.
Je voudrais à présent revenir sur les certificats verts. En effet, on ne connaît toujours pas exactement le statut de ces certificats verts. On connaît simplement le montant du rachat aux producteurs, à savoir 107 euros. On sait également que ces certificats verts — je ne sais pas comment il faudra les appeler — vont envahir le marché et provoquer une diminution des montants. Ils perturberont ce marché alors que ce dernier devait être créé par les Régions, nous semblait-il.
Par ailleurs, nous constatons que ces dispositions ont été prévues expressément et exclusivement pour un projet d'investissement particulier, le projet de consortium C-Power. Cette spécificité nous semble contestable, dans la mesure où elle crée une discrimination entre les sources d'énergie éolienne et au niveau des incitants environnementaux mis en place dans l'ensemble de nos Régions.
En clair, quelles sont les quatre aides spécifiques de ce projet offshore?
1. Le cofinancement du câble de raccordement via le tarif du réseau de transport, à concurrence d'un tiers du coût du câblage, plafonné à 25 millions d'euros. 2. La mise en place d'une tolérance de 30% pour les écarts de production alors qu'il est de 10% pour tout autre type de production. Voilà un bel exemple de discrimination. 3. L'augmentation du prix d'achat des certificats verts par Elia à 107 euros. Le prix est différent. J'ai expliqué le problème des certificats verts et de leur statut au regard des compétences régionales ou fédérales. 4. La mise en place d'une garantie de rentabilité en cas d'interruption du projet équivalente à celle des investissements à long terme présentant des risques similaires.
La première discrimination concerne, me semble-t-il, les autres installations offshore. En effet, ces dispositions ne concernent qu'un type d'installation de production d'énergie éolienne offshore, celles de C-Power. Tout autre type d'installation offshore ne pourrait pas bénéficier de ces mesures.
La deuxième discrimination de ces dispositions est en rapport avec les autres éoliennes, les éoliennes onshore, qui produisent le même type d'électricité, une électricité tout aussi verte que celle des éoliennes offshore. Cependant, celles-ci ne bénéficient ni de l'aide au raccordement, ni de la garantie totale de l'investissement par le biais des certificats verts, ni surtout de l'élargissement de la marge de tolérance, auxquels j'ai fait référence tout à l'heure.
Le projet de loi instaure également la dégressivité de la cotisation fédérale pour les entreprises, grandes consommatrices d'énergie. Nous avons souligné cette déficience à de nombreuses reprises et incité le gouvernement à agir en cette matière. Enfin, cette mesure décidée il y a environ un an et demi, lors du Conseil des ministres de Gembloux, voit le jour. Cependant, nous remarquons que cette mesure introduit clairement un problème de discrimination, un de plus! En effet, la dégressivité est octroyée aux entreprises bruxelloises alors que cette réduction était promise uniquement aux entreprises qui s'engageaient dans cet accord environnemental mieux connu sous le terme "accord de branche". Or, il n'existe absolument aucun accord de branche au niveau bruxellois. Malgré tout, le gouvernement a décidé d'octroyer la dégressivité aux entreprises bruxelloises également.
Cette discrimination — je tiens à le rappeler — n'a pas échappé au Conseil d'Etat qui note à cet égard: "Force est de se demander si cette différence de traitement qui revient à sortir la diminution de cotisation dans deux Régions et pas dans la troisième, peut se justifier à la lumière de la règle constitutionnelle de légalité de la nondiscrimination." En effet, cette condition particulière n'est pas favorable au soutien des initiatives visant à l'efficacité énergétique et constitue clairement une source de discrimination à l'égard des entreprises des autres Régions qui, elles, se sont engagées à faire des efforts environnementaux et qui se sont obligées à respecter un certain nombre d'engagements environnementaux, alors qu'elles peuvent évidemment bénéficier de l'incitant d'autres entreprises qui, elles, ne sont pas engagées dans cette même politique proenvironnementale et reçoivent ce même incitant. Il y a là un problème de discrimination.
Les articles 55 et 56, concernant la cotisation fédérale, appellent eux aussi certaines remarques.
En effet, nous notons tout d'abord que cette cotisation doit être clairement identifiée comme un impôt. C'est d'ailleurs le Conseil d'Etat qui fait cette remarque. Dès lors, il ne nous semble pas constitutionnel de préciser les modalités d'imposition par arrêté royal, comme le prévoit l'article 21bis, §6.
Ensuite, l'article 55 prévoit que la cotisation fédérale reste soumise à TVA. On conteste cette taxation complémentaire dans la mesure où cette taxation s'apparente à un impôt. Nous ne comprenons pas la raison de cette double imposition. Il s'agit d'un impôt. C'est le Conseil d'Etat lui-même qui le précise. Par ailleurs, le projet de loi prévoit également que ce seront les fournisseurs d'électricité et non plus les gestionnaires des autres transports qui seront dorénavant chargés de prélever la cotisation fédérale. Nous contestons également cette décision. Effectivement, les fournisseurs sont plus proches du consommateur. Par conséquent, ils sont mieux à même d'identifier les caractéristiques de celui-ci.
Cependant, en reportant cette charge administrative vers les entités plus petites, le projet de loi crée une nouvelle barrière à l'entrée envers les nouveaux entrants dans le cadre d'une libéralisation naissante. Cette barrière ne va évidemment pas faciliter la venue de ces nouveaux entrants sur le marché. Les fournisseurs évoluent dans un cadre concurrentiel, ce qui n'est pas le cas du gestionnaire du réseau de transport.
En conséquence, seuls les fournisseurs les plus importants seront à même de mieux supporter cette charge. Nous rappelons, dans ce cadre, que le Conseil général de la CREG a rendu un avis particulièrement intéressant sur l'étude de la "London Economics" qu'il serait judicieux d'étudier au plus près.
En conclusion sur ce point, sur le volet offshore et sur la dégressivité, nous notons que si la volonté du gouvernement de créer un cadre assurant une sécurité juridique approfondie pour ce projet éolien est louable - je dirais même plus nécessaire, voire indispensable - nous sommes nettement moins convaincus par les effets pervers que ce texte risque de créer. Car, il risque de créer cette discrimination envers les producteurs d'énergie éolienne onshore, une discrimination antiécologique envers les entreprises wallonnes et flamandes par rapport aux entreprises bruxelloises, un coût pour le consommateur qui aurait pu être atténué, notamment par la suppression de la TVA ou par un amortissement plus étalé dans le temps du coût du câble et la création de nouvelles barrières à l'entrée pour les fournisseurs d'électricité et une mise à l'écart chronique du régulateur.
J'en viens maintenant au deuxième volet de mon intervention concernant les recours contre les décisions de la CREG. Je voudrais tout d'abord rappeler que la CREG est un office régulateur. Ce n'est pas un gestionnaire de réseau, ce n'est pas un utilisateur de réseau. C'est un régulateur.
Je m'étonne de constater que les décisions de la CREG peuvent faire l'objet d'un recours au Conseil de la concurrence. En effet, il me semble qu'en sa qualité de régulateur, et non de gestionnaire ou d'utilisateur, ses décisions ne doivent pas pouvoir faire l'objet d'un recours auprès du Conseil de la concurrence. Ni de l'IBPT, ni la CBFA ne peuvent voir leurs décisions susceptibles d'un recours auprès du Conseil de la concurrence.
Aujourd'hui, on va créer un système dans lequel certaines décisions peuvent faire l'objet d'un recours auprès du Conseil de la concurrence, d'autres auprès de la cour d'appel de Bruxelles. Je rappelle que l'on a voté, la semaine dernière, la répartition de concurrence entre le Conseil de la concurrence et la cour d'appel de Bruxelles. Toutefois, chacune peut faire l'objet d'une décision du Conseil des ministres qui peut se saisir des dossiers, des décisions de la CREG, et les suspendre. Ce volet suspensif concurrence les autres recours sur le fond, que ce soit auprès du Conseil de la concurrence ou de la cour d'appel. C'est en ce sens que le système inséré aujourd'hui et qui remplace le système selon lequel les décisions de la CREG pouvaient faire l'objet de recours au Conseil d'Etat, ne remplit pas les objectifs que la loi s'était elle-même assignés.
Permettez-moi de passer en revue les objectifs de cette modification.
1. La spécialisation de la cour d'appel en ce qui concerne la CREG. Je suis tenté de dire que le Conseil d'Etat avait déjà cette spécialisation. Il était le seul compétent. La spécialisation de la cour d'appel va devoir se faire alors qu'elle existe déjà au niveau du Conseil d'Etat. L'argument n'est donc pas valable, selon moi.
2. L'unification. Ici, je pense clairement que ce n'est pas le cas. Auparavant, seul le Conseil d'Etat était compétent. Maintenant, il y a la cour d'appel et le Conseil de la concurrence. Vous allez sans doute me dire qu'ils traitent des matières différentes. C'est vrai. Toutefois, le Conseil des ministres peut toujours se saisir des dossiers et suspendre des mesures. Par ailleurs, les décisions du Conseil des ministres peuvent elles-mêmes faire l'objet d'un recours. Autrement dit, l'objectif de la simplification ou l'unification ne semble pas être atteint.
3. La rapidité. Il est vrai que le Conseil d'Etat a pour le moins, seraisje tenté de dire, un certain arriéré. En effet, aucune décision n'a encore été rendue par ce dernier.
4. Il est surprenant de constater qu'en raison d'un arriéré au Conseil d'Etat, on modifie ses compétences et on les donne à d'autres juridictions, comme notamment la cour d'appel de Bruxelles qui n'est pas la juridiction de type ordinaire ayant le plus faible arriéré en Belgique. C'est un raisonnement bizarre: on retire des compétences au Conseil d'Etat parce qu'il ne va pas assez vite. Il aurait peut-être fallu prendre le dossier dans l'autre sens et envisager une réforme au sein du Conseil d'Etat en vue de lui permettre de rendre ses décisions dans des délais plus corrects.
J'ajoute que le Conseil de la concurrence enregistre également un arriéré; annuellement, un certain nombre de questions parlementaires déposées à la Chambre soulignent le retard du Conseil de la concurrence dans le prononcé de ses décisions.
5. La sécurité juridique. Elle ne me semble pas être démontrée en l'occurrence. Il a été difficile de bien évaluer la sécurité juridique des décisions du Conseil d'Etat car il n'y en a pas eu mais, ici, je le répète, la sécurité juridique doit être démontrée. En diversifiant les types de mesures qui peuvent être prises et les types de recours qui peuvent être engagés (cour d'appel, Conseil de la concurrence et suspension possible devant le Conseil d'Etat), on diminue la sécurité juridique.
6. Les droits et libertés individuelles en vue de donner à ces juridictions leurs pleines compétences. Cet objectif, qui était peut-être le seul à pouvoir être atteint, a été retiré.
Telles sont, monsieur le ministre, chers collègues, les raisons qui m'ont amené à intervenir à propos de ce dossier. Je pense qu'elles sont suffisamment importantes étant donné l'existence de discriminations et des volets dégressifs et offshore. De plus, il y a également les objectifs qui ne me semblent pas être rencontrés par ces nouvelles dispositions dans la loi mosaïque concernant les recours contre des décisions de la CREG qui voit ses compétences diminuer. C'est récurrent, on commence à en avoir l'habitude mais cela ne va pas dans la bonne direction.

Mr. Speaker, I will allow myself to return to a topic discussed this morning, apologizing for not being able to intervene earlier.
I would like to return to the part concerning offshore wind turbines and more specifically the use of CREG decisions, two points that have already been the subject of a lot of discussions this morning. Indeed, this bill on which we are to speak today contains several important measures: the implementation of the degressive rate on the federal contribution for large electricity consumers, which I will discuss in the second point, the establishment of a favorable framework for wind farm investment projects, which I will start with, and finally, the establishment of the appeal procedure against the CREG decisions.
It may be necessary to return to the fact that despite a fairly rapid adoption of these provisions in committees, they were not the subject of a separate bill from this mosaic law: this was done quickly with, it seems to me, a lack of coordination, a lack of opinion, in particular from the CREG or the European Commission. Such opinions would have helped us to produce a more proportionate and better text than the one presented to us today. I will explain in which parts of this text I think the shortcomings lie.
First, as I announced, the degressivity and the new offshore wind farm. I think the CDH group should no longer demonstrate its commitment to green energy, especially wind energy. It is enough to traverse the Walloon Region to realize that the action of André Antoine as Minister of Energy of the Walloon Region has allowed a clear advance in the production of wind energy. Therefore, we cannot be taxed as opponents of this type of energy.
Secondly, I would like to recall the lack of information made available to us in the context of this file.
I would like to come back to the green certificates. The exact status of these green certificates is not yet known. It is simply known the amount of the repurchase to the producers, namely 107 euros. It is also known that these green certificates — I do not know how they will be called — will invade the market and cause a decrease in amounts. They would disrupt this market while the latter should be created by the Regions, we thought.
Furthermore, we find that these provisions were expressly and exclusively intended for a particular investment project, the C-Power consortium project. This specificity seems to us questionable, in so far as it creates a discrimination between wind energy sources and at the level of environmental incentives implemented in all of our Regions.
What are the four specific subsidies of this offshore project?
1 of 1. Co-financing of the connection cable via the transmission network tariff, at a rate of one-third of the cost of the cable, with a maximum of EUR 25 million. 2 of 2. The introduction of a 30% tolerance for production differences while it is 10% for any other type of production. This is a good example of discrimination. 3 of 3. The increase in the purchase price of green certificates by Elia to 107 euros. The price is different. I explained the problem of green certificates and their status in relation to regional or federal competences. 4 of 4. The establishment of a guarantee of profitability in the event of project interruption equivalent to that of long-term investments with similar risks.
The first discrimination concerns, in my opinion, other offshore installations. These provisions concern only one type of offshore wind power generation plant, C-Power. Any other type of offshore installation could not benefit from these measures.
The second discrimination in these provisions relates to other wind turbines, onshore wind turbines, which produce the same type of electricity, electricity equally green as that of offshore wind turbines. However, they are neither benefiting from the connection aid, nor from the full investment guarantee through green certificates, nor especially from the extension of the tolerance margin, to which I referred recently.
The bill also introduces the degressivity of the federal contribution for companies, major energy consumers. We have repeatedly highlighted this deficiency and urged the government to act on this issue. Finally, this measure decided about a year and a half ago, at the Council of Ministers of Gembloux, is coming to light. However, we note that this measure clearly introduces a problem of discrimination, one more! Indeed, the degressivity is granted to Brussels companies while this reduction was promised only to companies that engaged in this environmental agreement better known as the term "branch agreement". However, there is absolutely no branch agreement at the Brussels level. Nevertheless, the government has decided to grant degressivity to Brussels companies as well.
This discrimination — I would like to recall — has not escaped the State Council which notes in this regard: "It is necessary to ask whether this difference in treatment, which results in the reduction of contributions in two Regions and not in the third, can be justified in the light of the constitutional rule of legality of non-discrimination." Indeed, this particular condition is not favourable to support initiatives aimed at energy efficiency and clearly constitutes a source of discrimination towards companies from other Regions which, they, have committed to make environmental efforts and are obliged to comply with a number of environmental commitments, while they can obviously benefit from the incentive of other companies, which, they, are not engaged in even this political environment and even receive this incentive. There is a problem of discrimination.
Articles 55 and 56 concerning the federal contribution also call for some remarks.
In fact, we note first of all that this contribution must be clearly identified as a tax. It is the State Council that makes this observation. Therefore, it does not appear to us constitutional to specify the modalities of taxation by royal decree, as provided for in Article 21bis, §6.
Next, Article 55 provides that the federal contribution remains subject to VAT. This supplementary taxation is challenged in so far as this taxation resembles a tax. We do not understand the reason for this double taxation. This is a tax. It is the state council itself that clarifies this. Furthermore, the bill also stipulates that it will be electricity suppliers and not other transport managers who will be responsible for collecting the federal contribution. We also contest this decision. Providers are closer to the consumer. Therefore, they are better able to identify the characteristics of it.
However, by transferring this administrative burden to smaller entities, the bill creates a new entry barrier for new entrants in the context of an emerging liberalization. This barrier will obviously not facilitate the entry of these new enthusiasts into the market. Suppliers evolve in a competitive framework, which is not the case for the transmission system operator.
As a result, only the most important suppliers will be able to better withstand this burden. We remind, in this context, that the General Council of the CREG issued a ⁇ interesting opinion on the study of the "London Economics" which it would be wise to study closely.
In conclusion on this point, on the offshore aspect and on degressivity, we note that while the government’s willingness to create a framework ensuring deep legal certainty for this wind power project is praiseful – I would say even more necessary, or even indispensable – we are significantly less convinced of the perverse effects that this text may create. Because, it risks to create this discrimination against onshore wind energy producers, an anti-environmental discrimination against Wallon and Flemish companies compared to Brussels companies, a cost for the consumer that could have been mitigated, in particular by the abolition of VAT or by a more extensive amortization in the time of the cost of the cable and the creation of new barriers to entry for electricity suppliers and a chronic disengagement of the regulator.
I now come to the second part of my speech concerning appeals against the decisions of the CREG. First of all, I would like to remind you that the CREG is a regulatory office. This is not a network manager, it is not a network user. He is a regulator. by

In this sense, the system introduced today, which replaces the system under which the decisions of the CREG could be appealed to the State Council, does not meet the objectives that the law itself had assigned itself.
Let me review the objectives of this amendment.
1 of 1. The specialization of the Court of Appeal in relation to the CREG. I am tempted to say that the State Council already had this specialization. He was the only competent. The specialization of the Court of Appeal will have to be done while it already exists at the level of the State Council. The argument is therefore not valid, in my opinion.
2 of 2. and the unification. Here, I clearly think that is not the case. Previously, only the State Council was competent. Now there is the Court of Appeal and the Competition Council. You will probably tell me that they are dealing with different subjects. It is true. However, the Council of Ministers can always seize files and suspend measures. It is surprising to observe that due to a delay in the Council of State, its powers are changed and transferred to other courts, such as the Brussels Court of Appeal, which is not the ordinary type court with the lowest delay in Belgium. This is a bizarre reasoning: one withdraws competencies from the State Council because it doesn’t go fast enough. These are the reasons that led me to intervene on this issue. I think they are important enough given the existence of discrimination and downward and offshore components. Die situatie is dat programmawetten met begrotingsgerelateerde maatregelen worden gescheiden van programmawetten met maatregelen die niet begrotingsgerelateerd zijn, dit in tegenstelling tot de vroegere programmawetten van paars en paars-groen, waarin zowat alles werd opgenomen, tot en met volledige wetsontwerpen, wat tot meer en scherp protest heeft geleid bij de Raad van State. Tot daar een positieve vaststelling. De regering heeft de wijziging in het Reglement goed gevolgd en dat is een positieve benadering. Die aanpassing is dus een stap vooruit. De werkwijze van de regering is een stap vooruit.
Dat wil natuurlijk echter niet zeggen dat alle problemen hiermee van de baan zouden zijn. De regering heeft ook voor het wetsontwerp houdende diverse bepalingen een spoedadvies bij de Raad van State en de spoedbehandeling gevraagd overeenkomstig dat fameuze artikel 80 van het Reglement van de Kamer. De weinige collega's die er zijn, 1, 2, 3, 4, 5, 6, 7 collega's van de 150, zullen het wel over een ding eens zijn.

Het is, en ik citeer, "om een aantal anomalieën die gebleken zijn uit de toepassing van de betrokken regelgeving" zo snel mogelijk te kunnen rechtzetten. Ik denk dat die anomalieën iets te maken hebben met de iguanadons van Bernissart. Helaas kunnen wij die anomalieën niet zo vlug rechtzetten als de iguanadons van Bernissart om de heel eenvoudige reden dat onze wetgeving zoveel meer en zoveel langer effect heeft en ook veel levendiger blijft. Het gaat over correcties in programmawetten, ook van de programmawet die eind vorig jaar werd goedgekeurd. Ik moet dit zeggen voor lege banken, maar andermaal is dit reparatiewetgeving. Dat is natuurlijk bijzonder betreurenswaardig.
Het wetsontwerp wordt besproken op een ogenblik dat vele burgers reeds aan een welverdiende vakantie toe zijn. Het zijn burgers die hun zorgen voor enkele weken vergeten zijn. Ze weten echter wel dat de economische toestand van het land slecht is. De werkloosheid neemt toe. Er zijn berichten over herstructureringen van dag tot dag. Ik durf mijn krant niet meer open te slaan en mijn radio 's ochtends niet meer aan te zetten om te vernemen welke sectoren en welke bedrijven onder druk komen te staan. Onze werkgelegenheidsgraad is te laag. Het aantal faillissementen bereikt recordhoogten. U weet dat veel beter dan ik.
Dan komt daar nog bij dat de Belgische brandstofbetaler netto de belangrijkste betaler is van de brandstofprijs. Het gaat dan over hetgeen hij betaalt aan de pomp, zowel voor diesel als voor benzine. Het is natuurlijk een pijnlijk feit. Ik zie dat ook met het cliquetsysteem dat werd uitgevoerd. Ik herhaal nogmaals dat ik twee jaar geleden hier zei: "Fientje komt om haar tientje." Nu heeft heel de regering met dat fameuze cliquetsysteem deze zaak nogmaals vastgelegd.
In de federale regering, die gisteren twee jaar aan de slag was, is de indruk gewekt dat het goed gaat met de economie van ons land, met de tewerkstelling, met de begroting en dat de mensen zich niet te veel zorgen hoeven te maken. Dat is natuurlijk een ongelooflijk holle boodschap die men moet brengen aan al degenen die wel hun job verliezen, die zien wat de grote impact is van een schrijnende economie. Bovendien moet ik u nog zeggen dat de begrotingscontrole vorige week ogenschijnlijk zonder al te grote problemen werd afgerond.
Mijnheer de voorzitter, mijnheer de minister, of u het graag hoort of niet, u bent de enige gekozen vertegenwoordigers. Mijnheer de voorzitter, u bent de gekozen vertegenwoordiger en de minister werd nadien verkozen op het uitvoerende niveau van de Franstalige collega's en van Wallonië in het Parlement. Zonder de hulp van Vlaanderen, namelijk zonder de betaling van de gevorderde heffingen in het Aquafindossier, zou het plaatje er totaal anders hebben uitgezien. Nu werden andermaal nieuwe inkomsten aangeboord. De regering maakt het zich wel belangrijk door uit te gaan van een groei van 1,5%, terwijl wij weten dat de groei maar 1% en de facto een nulgroei is.
Mijnheer de minister, mijnheer de voorzitter, collega's, de komende maanden zullen cruciaal zijn voor de regering en voor de economische toestand van ons land. Het is eigenaardig dat wij daarover in deze discussie op zo weinig interesse kunnen rekenen. Iedereen weet evenwel dat er knopen zullen moeten worden doorgehakt in het eindeloopbaandebat en in het werkgelegenheidsdebat.
Ik heb een déjà vu-gevoel. Ik herinner mij de nieuwjaarsbrief die de collega's Vande Lanotte en Vandenbroucke hebben geschreven op 1 januari 2004. Daarin schreven ze dat er belangrijke knopen moesten worden doorgehakt. Het resultaat is dat minister Vandenbroucke minister is geworden in de Vlaamse regering en dat minister Vande Lanotte in september 2005 de regering zal verlaten om voorzitter van sp.a te worden.
Ik geef voor een keer PS-voorzitter Di Rupo gelijk. Na de mislukking in het DHL-dossier en na de mislukking in het B-H-V-dossier kan de huidige regering zich geen derde mislukking veroorloven. Ik hoop eerlijk gezegd, samen met mijn partij, dat het wel mislukt. Dat zal u ons wel niet ten kwade duiden. Er is trouwens veel kans dat de regering ook in dat dossier zal mislukken. Ik geef u dus rendez-vous eind september-begin oktober 2005.
Mijnheer de voorzitter, de Kamer is er nog niet uitgeraakt wanneer de regering met haar verklaring naar het Parlement zal komen. Ik ben heel tevreden dat mevrouw Vautmans hier in ons midden is. Als uit één mond riep zij in 2004 namelijk uit dat de Grondwet moest worden veranderd en dat de Kamers van rechtswege moesten samenkomen in september. Wij mochten zeker niet te veel vakantie nemen. Ik heb alleen maar vastgesteld dat de regering en in de eerste plaats haar eigen partij helemaal niet happig is om naar hier te komen op de door haar vooropgestelde datum.
Mevrouw Vautmans, de heer Daems heeft u op de Conferentie van voorzitters in de wind gezet. Hij heeft mij trouwens laten uitschijnen dat uw voorstel geen kans meer maakt om te worden goedgekeurd.
Eerlijk gezegd, ik zou het liever hebben. Ik wil een heruitgave van 21 september 2004. Dat was een bijzonder leuke dag. De minister kondigde immers aan dat hij naar het Parlement zou komen met een oplossing voor B-H-V, voor DHL en voor het eindeloopbaandebat. Mijnheer de voorzitter, beste collega's, ik wil nog een korte uiteenzetting houden over de accijnzen op kolen, cokes en bruinkool.
Via de programmawet van 27 december 2004 werd richtlijn 2003/96EG omgezet in de Belgische wetgeving. Voornoemde richtlijn staat toe dat de lidstaten verlaagde tarieven voor accijnzen toekennen voor energieproducten en elektriciteit. Men gaat die mogelijkheid nu uitsluiten voor kolen, cokes en bruinkool, terwijl men in het kader van de ecologische doelstellingen via de programmawet van 27 december 2004 wel voorzag in een differentiatie van tarieven. Zo werd voorzien in lagere tarieven met betrekking tot de bijzondere accijns op kolen, cokes en bruinkool voor zakelijk gebruik in het kader van bedrijfsactiviteiten. Ook landbouw en vrije beroepen kwamen daarvoor in aanmerking.
Ten eerste gold de maatregel energie-intensieve bedrijven, namelijk bedrijven met een energiefactuur groter dan of gelijk aan 3% van de productiewaarde of met een totale energiebelasting die ten minste 0,5% bedraagt van de toegevoegde waarde, met een overeenkomst of een vergunning "milieudoelstelling". Ten tweede gold die voor andere bedrijven met een overeenkomst of een vergunning "milieudoelstelling". De bijzondere accijns bedroeg respectievelijk 4,3263 euro per 1.000 kilo en 6,4895 euro per 1.000 kilo. Voor de bedrijven die het lagere tarief niet genoten, lag het tarief op 8,6526 euro per 1.000 kilo. Wat men met het voorliggende wetsvoorstel doet, is dat verlaagd tarief met betrekking tot de lagere bijzondere accijns schrappen, zogezegd met het oog op het voeren van een coherent milieubeleid.
Dat leidt tot een hoogst bevreemdende vaststelling. Het voeren van een coherent milieubeleid leidt ertoe dat men de differentiatie van de tarieven ten voordele van ondernemingen die zich ertoe verbonden hebben milieudoelstellingen te realiseren, opnieuw afvoert. Het gaat dus, collega's, om opnieuw een belastingverhoging die te elfder ure en sluiks door het Parlement wordt geloodst. Het valt te hopen dat men er ditmaal in slaagt het wetsvoorstel tijdig door het Parlement te loodsen — ik neem aan dat dat vandaag nog gebeurt — en te publiceren, zodat men de toepassing van niet-gepubliceerde wetten kan vermijden. Dat is in het verleden al vaker gebeurd. De regering slaagt er dus in om, als het een belastingverhoging betreft, die sneller aan de pomp te laten toepassen dan ze in het Staatsblad verschijnt. Het is een beetje als met de Daltons die sneller schieten dan hun schaduw. De regering slaagt er dus in, als het om een belastingverhoging of accijnsverhoging gaat, beste technici die ik daar zie op de eerste verdieping, die sneller toe te passen aan de pomp dan ze in het staatsblad verschijnt. Waar is de rechtszekerheid en het behoorlijk bestuur als ondernemingen worden meegedeeld dat maatregel X recht geeft op een verlaging, maar als zes maanden later — mogelijks hebben bedrijven ondertussen bepaalde investeringen gedaan of engagementen genomen — de maatregel opnieuw wordt afgevoerd? Het principe van goed bestuur wordt eens te meer met voeten getreden. Vanaf januari voert men een verlaging van de bijzondere accijnzen in en laat men ondernemingen in de waan dat ze hiervoor in aanmerking komen als ze bijdragen tot de verwezenlijking van milieubeschermingsdoelstellingen, al dan niet goedgekeurd maar wel aangekondigd. Resultaat in de realiteit is totale verwarring. Hoe is het mogelijk dat deze regering ondernemingen in de waan laat dat ze in aanmerking komen indien ze bijdragen tot de verwezenlijking van milieubeschermingsdoelstellingen of een grotere energie-efficiëntie om nadien koudweg de bijzondere accijnzen te verdubbelen in het geval van energie-intensieve bedrijven of met 25% te verhogen voor de andere bedrijven. Mijnheer de minister, op hoeveel bedrijven heeft het wetsontwerp betrekking? Het is een belangrijke vraag, mijns inziens. Hoeveel sectoren zijn in het geding? Werd met de ondernemingen overleg gepleegd? Wat was de uitkomst van het overleg? Wat is de geraamde meeropbrengst van deze regeling?
Hier raak ik een hallucinant punt aan. In elke eerste kandidatuur Economie aan de universiteit leert men dat voor elk voorstel een budget nodig is zodat men weet waarover men spreekt. Spreekt u over 5 miljoen euro, mijnheer de minister, of over 10,15,20 of 30 miljoen? Over hoeveel miljoen euro gaat het? We hebben dit in de commissie behandeld. Niemand, ook de bevoegde staatssecretaris niet, wist bij benadering over hoeveel miljoen euro het gaat. Ik roep mijn collega die hierover terecht het woord heeft genomen tot getuige. Niemand wist het antwoord. Wat is dan de definitie van behoorlijk bestuur? In de commissie doet een zeer gewaardeerd professor Economie een voorstel, maar hij moet het antwoord schuldig blijven op de vraag over hoeveel geld het gaat. De staatssecretaris weet het niet. Niemand weet over hoeveel geld het gaat hoewel het een dringend en - zo neem ik aan - belangrijk voorstel is.
Volgende vraag, mijnheer de minister. Ik verwacht écht concrete antwoorden, zoniet moet ik erop terugkomen. Hoeveel bedrijven hebben reeds een aanvraag ingediend tot het bekomen van een vergunning energieproducten en elektriciteit door de administratie der Douane en Accijnzen in toepassing van het KB van 3 juli 2005 houdende maatregelen voor de toepassing van bepaalde verlaagde tarieven inzake accijnzen om het verlaagd tarief te bekomen van artikel 419 J van de programmawet van 27 december 2004.
Hoeveel bedrijven hebben daarvoor een aanvraag ingediend? Ik herhaal deze vraag omdat ik zie dat u nota's neemt.
De tweede vraag is wat het budget is voor deze maatregel. Over hoeveel miljoen euro spreken wij hier? Op hoeveel ondernemingen heeft dit betrekking? Is er overleg geweest met de ondernemingen? Hoeveel sectoren zijn hier in het geding?
Collega's, ik kom thans tot de bedrijfsvoertuigen. Ik verwijs naar het artikel dat zorgt voor een omkering van de bewijslast voor de inning van de solidariteitsbijdrage op bedrijfsvoertuigen die worden ingezet voor privé-vervoer. De regeling gaat in vanaf 1 juli.
Als een bepaalde bijdrage bestaat, mag deze natuurlijk niet worden ontdoken. De grond van de zaak echter is dat begin dit jaar een nieuwe last voor de bedrijven werd ingevoerd onder het mom van een milieumaatregel, maar met de bedoeling de begroting rond te krijgen. De bepaling in het huidige voorstel vermeldt zelfs de milieudoelstelling niet meer. Het gaat dus alleen over een financiële maatregel. Indien het enkel om een milieudoelstelling ging, had men tegelijkertijd in een evenwaardige daling van de lasten op arbeid moeten voorzien. Ook dat is niet gebeurd, mijnheer de minister. Die koppeling is nooit gemaakt. Ook deze maatregel zal er de facto toe leiden dat de lasten voor bedrijven opnieuw, beste VLD'ers, in globo stijgen.
Ook al is het rechtvaardig dat iedereen op dezelfde manier wordt behandeld, deze maatregel heeft van bij de aanvang de concurrentiekracht van onze bedrijven niet bepaald ondersteund, om het zeer eufemistisch te zeggen. Ook in deze begrotingscontrole, waar dit wetsvoorstel uiting van is, zien we opnieuw geen maatregelen om de werkgelegenheid te versterken, de economische groei aan te zwengelen of te investeren in de toekomst. Dit is ook af te meten aan het vertrouwen van de ondernemers in deze federale regering. Slechts 8,6 procent van de deelnemers aan de poll, beste VLD'ers en MR's — voor zover u aanwezig bent — meent dat de federale regering nu beter presteert dan zes maanden geleden. Een overweldigende 59,5 procent vindt dat ze het slechter doet.
Het is opnieuw een maatregel die niet positief is voor het bedrijfsleven en opnieuw de facto een extra last legt op het bedrijfsleven. De vraag is waar dit gaat eindigen. Moeten wij eerst een tewerkstellingsgraad hebben, collega's, van 55 procent — ook in Vlaanderen — alvorens er iets gebeurt voor de bedrijven of zou het interessant zijn vooraf de koers te wijzigen? Opnieuw komen de bedrijven en in het bijzonder, collega's, de KMO's in de verdrukking.
Opnieuw zijn het degenen die nog zorgen voor werkgelegenheid en degenen die nog investeren in bedrijfsvoertuigen die worden geviseerd. Het is een straatje zonder einde. De VLD stond erbij en keek ernaar. Ook vandaag heerst er opnieuw een oorverdovende stilte. De banken zijn leeg bij de VLD.

Mr. Speaker, dear colleagues, I would like to make another brief explanation on the excise duties on coal, cocks and brown coal.
By the Program Law of 27 December 2004, Directive 2003/96/EC was transposed into Belgian legislation. The Directive allows Member States to grant reduced rates for excise duties on energy products and electricity. This possibility is now to be excluded for coal, coke and brown coal, while, within the framework of the ecological objectives, a differentiation of tariffs was provided by the Programme Act of 27 December 2004. For example, lower rates were provided in relation to the special excise taxes on coal, cocks and brown coal for commercial use in the context of business activities. Agriculture and free professions were also eligible for this.
First, the measure applied to energy-intensive companies, i.e. companies with an energy invoice greater than or equal to 3% of the production value or with a total energy tax of at least 0.5% of the added value, with an agreement or permit "environmental objective". Secondly, for other companies with an agreement or license, it was a “environmental objective”. This has happened more often in the past. So the government succeeds, if it is a tax increase, to have the pump be applied faster than it appears in the Official Gazette. It’s a bit like the Daltons who shoot faster than their shadow. So the government succeeds, when it comes to an increase in taxes or an increase in excise taxes, the best technicians I see there on the first floor, which apply to the pump faster than it appears in the state newspaper. From January, a reduction in special excise duties will be introduced and companies will be pretended to be eligible if they contribute to the achievement of environmental protection objectives, whether approved or not, but announced. The result in reality is total confusion. How is it possible that this government misleads companies to be eligible if they contribute to the achievement of environmental protection objectives or greater energy efficiency to subsequently double the special excise duties in the case of energy-intensive enterprises or increase by 25% for the other enterprises. How many companies does the bill cover? This is an important question, in my opinion. How many sectors are in question? Have there been consultations with the companies? What was the outcome of the consultation? What is the estimated surplus income of this scheme?
Here I touch a hallucinating point. In every first candidacy in Economics at the university, one learns that every proposal requires a budget so that one knows what one is talking about. Are you talking about 5 million euros, Mr. Minister, or about 10,15,20 or 30 million? How many million euros is it? We discussed this in the committee. Nobody, not even the competent state secretary, knew approximately how many million euros it was. I call my colleague who rightly took the word on this subject as a witness. No one knew the answer. What is the definition of good governance? In the committee, a highly regarded professor of economics makes a proposal, but he must remain guilty of the answer to the question of how much money it is about. The Secretary of State does not know. No one knows about how much money it’s going on even though it’s an urgent and – I suppose – important proposal.
The next question, Mr. Minister. I expect concrete answers, otherwise I will have to come back to them. How many companies have already submitted a application for obtaining a permit for energy products and electricity by the Administration of Customs and Accises in application of the KB of 3 July 2005 concerning measures for the application of certain reduced rates on excise duty in order to obtain the reduced rate of article 419 J of the Program Act of 27 December 2004.
How many companies have submitted an application for this? I repeat this question because I see you take notes.
The second question is what the budget is for this measure. How many million euros are we talking about? How many companies is this concerned? Has there been consultation with the companies? How many sectors are in question?
Now, I am going to the commercial vehicles. I refer to the article which provides for the reversal of the burden of proof for the collection of the solidarity contribution on commercial vehicles used for private transport. The regulation comes into effect from 1 July.
If a particular contribution exists, it should, of course, not be discarded. The basis of the case, however, is that at the beginning of this year a new burden for the companies was introduced under the auspices of an environmental measure, but with the intention of getting the budget around. The provision in the present proposal does not even mention the environmental objective. It is only a financial measure. If it was only an environmental objective, it would have also been necessary to provide for an equivalent reduction in the burden of labour. This has not happened, Mr. Minister. That link has never been made. Also this measure will de facto cause the burden for companies again, dear VLD’s, to rise globally.
Although it is fair that everyone is treated equally, this measure has not ⁇ supported the competitiveness of our companies from the beginning, to say very euphemistically. Even in this budgetary control, which is the reflection of this bill, we again see no measures to strengthen employment, to force economic growth or to invest in the future. This can also be measured by the entrepreneurs’ confidence in this federal government. Only 8.6 percent of polling participants, top VLDs and MRs — insofar as you are present — believe that the federal government is performing better now than it was six months ago. An overwhelming 59.5 percent think they are doing worse.
It is again a measure that is not positive for business and again de facto imposes an additional burden on business. The question is where this will end. Should we first have an employment rate of 55 percent — also in Flanders — before anything happens to the companies or would it be interesting to change the rate in advance? Again, the companies, and in particular, colleagues, the SMEs, are in the tribulation.
Again, they are those who still provide employment and those who still invest in commercial vehicles that are being fished. It is a street without end. The VLD stood there and looked at it. Even today there is a silent silence. The banks are empty with the VLD.

Monsieur le président, je vais répondre brièvement à quelques questions posées en relation avec mes compétences. Ensuite, ma collègue Mme Laruelle répondra en lieu et place de M. Reynders.
En ce qui concerne les véhicules de société, je constate qu'on entre dans un débat d'ordre caricatural. Le souci n'était évidemment pas d'étudier la question d'un point de vue strictement économique mais de la placer dans une perspective d'équilibre du financement de la sécurité sociale.
Quelle est la situation? Nous entendons certains de nos excellents collègues du CD&V — je souligne le mot "excellent" parce que je le pense — dire qu'il faut diversifier les sources de financement de la sécurité sociale. Pourquoi? Pour éviter que le seul facteur de production qui alimente aujourd'hui la sécurité sociale soit le facteur de production "travail". Je crois que nous sommes tous d'accord sur le fait qu'il faut réfléchir aux autres facteurs de production ou à la consommation pour diversifier le panier de financement de la sécurité sociale.
Dans ce contexte, on parle de financement alternatif de manière générale. On parle notamment de la réforme du coût du travail. On envisage d'utiliser des facteurs de substitution comme un prélèvement sur la TVA — ce qui a déjà existé dans le passé et qui est aujourd'hui pérennisé —; on imagine une alimentation par le biais des accises, via d'autres modes de consommation ou encore liée à la pollution de l'air. Ces exemples sont régulièrement donnés, non seulement par des membres du CD&V mais aussi par d'autres parlementaires, tous partis confondus.
Dans le même temps, on constate des défaillances. Un des défaillances évidentes dans le mode de financement de la sécurité sociale, c'est que des éléments constitutifs du revenu ne sont pas, en tant que tels, identifiés comme, par exemple, les véhicules mis à disposition. Ceux-ci constituent un avantage assimilable — d'ailleurs, le banc patronal ne le conteste pas — à des salaires dans des formes différentes. Jusque là, nous ne sommes pas en désaccord.
Certains me mettent en garde, en répétant inlassablement le couplet classique des socialistes qui domineraient les libéraux, sur le fait qu'on n'entend pas les libéraux dans ce gouvernement. Quand je les entends, je retiens mes cris! Aujourd'hui, je tiens à le dire publiquement: soyons sérieux! Le problème se pose en termes d'enrôlement de certaines cotisations sociales qui ne sont pas aisément identifiables.
Prenons le cas des voitures de société. Nous avons la preuve aujourd'hui que certaines sociétés n'avaient pas déclaré l'ensemble des véhicules soumis à la législation. Des contrôles exercés, il ressort que certaines sociétés n'avaient déclaré qu'un seul véhicule alors que 60 véhicules auraient dû l'être!

One of the obvious shortcomings in the method of financing social security is that components of income are not, as such, identified as, for example, the vehicles made available. Some warn me, repeating tirelessly the classical couplet of the socialists who would dominate the liberals, about the fact that liberals are not heard in this government. When I hear them, I hold my screams. Today, I want to say it publicly: Let’s be serious! The problem arises in terms of recruiting certain social contributions that are not easily identifiable.
Let’s take the case of car companies. We now have evidence that some companies did not report all the vehicles subject to the legislation. From the checks carried out, it appears that some companies had only ⁇ one vehicle, while 60 vehicles should have been!
It is the demonstration of the existence of a problem, also recognized on the employer’s bank at a given time. When we crossed their information (the DIV) with ours (in secu), we recognized that there were corrections to be made. Mais à l'analyse de ce dernier, il ressort que la demande de cette entreprise n'est pas recevable. Cela signifie que l'adoption de cette proposition ne lèsera aucune entreprise, vu qu'une seule demande a été introduite pour bénéficier de cette réduction et qu'elle n'est pas recevable.
En ce qui concerne la question de M. Devlies de ce matin sur l'article 115, il faut dire que la prise en charge de ce dispositif au niveau du ministère des Finances en lien avec l'ONSS était une demande des partenaires sociaux.
Une bonne collaboration entre les administrations est en place et fonctionne très bien. L'objectif du projet vise à ce qu'une décision d'une des deux administrations n'ait pas d'impact sur l'autre. M. Devlies disait lui-même qu'il n'était pas pertinent, en cas d'action en justice sur la base d'une décision, qu'une autre action soit retardée en attendant la première décision.

De daaropvolgende bepalingen hebben betrekking op de alternatieve financiering van de sociale zekerheid. Er wordt een aantal maatregelen voorgesteld om het financiële evenwicht in het globale beheer van de sociale zekerheid te waarborgen. Daarbij werden in het bijzonder drie maatregelen genomen. Ten eerste, de meerwaarde die op 31 december 2004 geboekt werd van het onroerend patrimonium van de Rijksdienst voor Pensioenen wordt overgedragen naar het globaal beheer. Ten tweede, de rijksbijdrage verschuldigd voor de renten ingegaan voor 1 januari 1994 wordt ten laste gelegd van het wettelijke kapitalisatiestelsel. Ten slotte, ook de indexering van de renten wordt ten laste genomen door het kapitalisatiestelsel.
In de algemene bespreking nam vooral collega Goutry het woord. Hij vroeg zich vooral af of de voorgestelde maatregelen wel structurele maatregelen zijn. De alternatieve financiering zou namelijk neerkomen op een geleidelijke verschuiving van lasten op arbeid naar andere lasten, maar ze zou geen structureel karakter vertonen en dus problematisch zijn.
De voorzitter van de commissie, de heer Bonte, heeft, in antwoord daarop, eraan herinnerd dat de alternatieve financiering van de sociale zekerheid sinds 1993 uitgebouwd werd en uitgebreid werd tot financieringsbronnen zoals energie en verbruik, een aspect waarvoor hij, net als collega Goutry, gepleit heeft. Het zou kunnen dat de door het wetsvoorstel voorgestelde maatregelen geen structureel karakter hebben, maar het is juist een van de taken van het sociaal overleg, dat collega Bonte net zoals collega Goutry steunt, om via dat overleg te komen tot meer structurele oplossingen inzake de financiering van de sociale zekerheid.
De maatregelen die thans voorgesteld worden met dit wetsvoorstel geven uitdrukking of uitvoering aan het streven van de indieners om de begroting van de sociale zekerheid niet te laten ontsporen in afwachting van meer structurele oplossingen die door de sociale partners aangereikt zullen worden.
Ten slotte had collega Goutry nog een aantal punctuele vragen die aan bod kwamen bij de artikelsgewijze bespreking.

I would like to report on Articles 5 to 14 of the bill containing various provisions, submitted on 12 July 2005. As you know, in the plenary session last week on Thursday, it was decided to deal with this bill with urgency.
The Social Affairs Committee met on Friday 8 July. During this meeting we discussed Articles 5 to 14, which deal with pensions and social affairs.
Despite the agreement in the plenary session on the procedure for this bill, Mr Goutry nevertheless expressed his amazement at this sudden parliamentary initiative. Therefore, in his own way, he has spoken to the members of the committee for a long time about the procedure. Then the bill was initiated by Mr. Charles Michel, who had joined the bill, by signing it.
In his introduction, he clarified that the provisions on pensions are primarily aimed at abolishing the voluntary insured scheme, since that scheme has already been largely abolished by earlier laws and what remains of it has gone unused.
The following provisions relate to alternative financing of social security. A number of measures are proposed to ensure the financial balance in the overall management of social security. In particular, three measures were taken. First, the surplus value recovered on 31 December 2004 from the real estate of the Riksdienst für Pensionen is transferred to the global management. Secondly, the state contribution due for the interests incurred before 1 January 1994 is charged to the legal capitalization system. Finally, the indexation of interest rates is also borne by the capitalization system.
In the general discussion, especially colleague Goutry took the floor. He asked whether the proposed measures are structural measures. The alternative financing would, in fact, constitute a gradual shift from labour burdens to other burdens, but it would not have a structural character and would therefore be problematic.
The Chairman of the Committee, Mr. Bonte, in his response, recalled that the alternative financing of social security has been expanded since 1993 and has been expanded to finance sources such as energy and consumption, an aspect that he, like colleague Goutry, has advocated.
