                    Mijnheer de voorzitter, op 2 december 2015, 5 oktober 2016 en 10 mei 2017 kwam de commissie voor de Landsverdediging samen om het voorliggend voorstel van resolutie te bespreken. Op 5 oktober 2016 was er eveneens een hoorzitting met de vertegenwoordigers van het Rekenhof.

De indieners van het voorstel, de heren Van der Maelen en Top van de sp.a, de heer Pirlot van de PS, de heren Hellings en De Vriendt van Ecolo-Groen, de heer Dallemagne van het cdH, de heer Van Hees van de PTB en de heer Maingain van DéFI, van wie er hier drie aanwezig zijn, beogen met het voorstel van resolutie het Rekenhof te belasten met de opvolging van het dossier betreffende de vervanging van de F-16 gevechtsvliegtuigen van Defensie.

De indieners van het voorstel vinden, bij monde van collega Van der Maelen, dat bij elk groot wapenaankoopdossier de grootst mogelijke transparantie moet heersen en dat het dossier van de vervanging van de F-16 gevechtsvliegtuigen te belangrijk is om enkel aan militairen over te laten. Tevens vindt hij dat het Parlement zijn controlerecht niet volledig kan uitoefenen. Hij maakt hierbij de vergelijking met andere landen waar, volgens de spreker, meer openheid heerst op het vlak van aankoopdossiers. Ook zijn fractiegenoot, de heer Top, verwijst in zijn betoog naar andere landen waar meer openheid heerst.

De heer Pirlot, die niet aanwezig is, meldt dat zijn partij er voorstander van is om de F-16 gevechtsvliegtuigen langer in dienst te houden. Daarnaast zegt hij dat hij de resolutie steunt en dat hij niet zou begrijpen waarom het Parlement zo’n minimum aan transparantie niet zou hanteren.

On 2 December 2015, 5 October 2016 and 10 May 2017, the Committee on Land Defense met to discuss the present draft resolution. On 5 October 2016, a hearing was also held with the representatives of the Court of Auditors.

The presenters of the proposal, Mr. Van der Maelen and Top of the sp.a, Mr. Pirlot of the PS, Mr. Hellings and De Vriendt of Ecolo-Groen, Mr. Dallemagne of the CDH, Mr. Van Hees of the PTB and Mr. Maingain of DéFI, three of whom are present here, aim to charge the Court of Auditors with the draft resolution to follow up on the file concerning the replacement of the F-16 combat aircraft of Defence.

The presenters of the proposal consider, according to colleague Van der Maelen, that every large arms purchase dossier should be the most transparent possible and that the file of the replacement of the F-16 fighter aircraft is too important to leave only to the military. He also considers that Parliament cannot fully exercise its control power. He makes the comparison with other countries where, according to the speaker, there is more openness in terms of purchase files. His party friend, Mr Top, also refers in his speech to other countries where more openness prevails.

Mr. Pirlot, who is not present, reports that his party is in favor of keeping the F-16 fighter aircraft in service longer. He also said that he supports the resolution and that he would not understand why Parliament would not use such a minimum of transparency.

                    De heer Hellings, die evenmin aanwezig is, ziet geen reden om afkerig te staan tegenover transparantie of tegenover het betrekken van het Rekenhof. Hij is ook van mening dat, hoewel het dossier nog maar in de beginfase zit, het Rekenhof toch al zou moeten worden ingeschakeld om informatie op te vragen, te analyseren en te interpreteren.

De heer Top is van oordeel dat de aangehaalde bedragen heel sterk uiteenlopen. Daarom is er nood aan een nauwgezette opvolging door het Rekenhof.

Zoals ik al vermeldde, was er op 5 oktober 2016 een hoorzitting, waarvoor het Rekenhof werd uitgenodigd. Jos Beckers, raadsheer van het Rekenhof was aanwezig. Ik citeer hem: “Het Rekenhof controleert enkel a posteriori, dat wil zeggen van zodra verbintenissen worden aangegaan, en komt bijgevolg niet tussen bij de voorafgaande besluitvorming. Uiteraard wordt de nodige omzichtigheid aan de dag gelegd, in het bijzonder bij de eerbiediging van veiligheidsclausules en het omgaan met de toegankelijkheid van de informatie. Ten slotte is er nog de bijzondere commissie voor de Legeraankopen en -verkopen van de Kamer, die in toepassing van het administratief protocol, dat werd gesloten tussen de Kamer en de minister van Defensie, een specifieke controle kan uitoefenen op de aankoopdossiers van Defensie.”

Het Rekenhof meldt ook aan de commissie dat het als instantie niet bevoegd is voor de opvolging en de voorbereiding van aankoopdossiers. De bevoegdheid ter zake ligt bij de Inspectie van Financiën.

De meerderheid, bij monde van de heer Klaps, de heer Ducarme, de heer Van Mechelen en mezelf, treedt het Rekenhof daarin bij. Zij meent dat er momenteel al veel transparantie is met betrekking tot het dossier in kwestie en tot soortgelijke dossiers, namelijk via de commissie voor de Legeraankopen en -verkopen.

Bovendien is het RfGP publiek beschikbaar op de website van de minister.

De meerderheid geeft aan het voorstel van resolutie daarom niet te zullen steunen.

Daarna werd tot de stemming overgegaan. Het voorstel van resolutie werd verworpen met zeven stemmen voor en drie stemmen tegen.

Mijnheer de voorzitter, ik hoop dat ik binnen mijn tijdsbestek ben gebleven.

Mr. Hellings, who is also absent, sees no reason to discourage transparency or the involvement of the Court. He also believes that, although the file is still in its early stages, the Court of Auditors should already be involved in requesting, analyzing and interpreting information.

Mr Top considers that the amounts cited vary greatly. Therefore, a close follow-up by the Court of Auditors is necessary.

As I mentioned earlier, a hearing was held on 5 October 2016, to which the Court of Auditors was invited. Jos Beckers, chairman of the Court of Auditors, was present. I quote him: “The Court of Auditors only audits a posteriori, that is, as soon as commitments are made, and therefore does not interfere with the preliminary decision making. Of course, the necessary caution is displayed, in particular in compliance with security clauses and dealing with the accessibility of the information. Finally, there is also the Special Commission for Army Purchases and Sales of the Chamber, which, in application of the administrative protocol, which was concluded between the Chamber and the Minister of Defense, can exercise a specific control over the purchase files of Defense.

The Court of Auditors also informs the Commission that it, as an authority, is not competent for the follow-up and preparation of purchase dossiers. The competence in this area lies with the Financial Inspectorate.

The majority, by the consent of Mr. Klaps, Mr. Ducarme, Mr. Van Mechelen and myself, joins the Court of Auditors. She considers that there is already a lot of transparency in relation to the file in question and to similar files, namely through the Committee on Army Purchases and Sales.

In addition, the RfGP is publicly available on the Minister’s website.

Therefore, the majority will not support the motion for a resolution.

Then the vote was passed. The draft resolution was rejected by seven votes in favour and three votes against.

                    Mijnheer de voorzitter, beste collega's, Defensie en transparantie, het is vandaag geen goed huwelijk. Niet alleen over internationale missies maar ook over aankoopdossiers moeten we transparanter zijn.

Collega's, we hebben het hier vandaag wel over het aankoopdossier van de eeuw. Het is dan ook stuitend dat dat eens te meer niet in volledige transparantie kan worden afgehandeld. De regering vindt het nodig om in tijden van besparingen 15 miljard belastinggeld uit te geven aan peperdure vliegtuigen. Dan vragen wij op zijn minst openheid en transparantie. Elke burger heeft het recht om te weten waar zijn belastinggeld naartoe gaat en of het goed besteed wordt. Transparantie kan daarvoor zorgen.

In discussies over transparantie wordt er nogal vaak geschermd met het argument dat er veel gevoelige informatie voorhanden zou zijn. Het lijkt ons echter nogal sterk dat alle toegezonden informatie bedrijfsgeheimen zou betreffen. Iedereen moet minstens toegang hebben tot het financiële plaatje van de vier vliegtuigconstructeurs – er is er intussen één afgevallen – die hun informatie doorsturen. Het gaat hier tenslotte over een miljardenaankoop.

Defence and transparency, it is not a good marriage today. We need to be more transparent not only on international missions but also on purchasing files.

Today we are talking about the acquisition dossier of the century. It is therefore shocking that this again cannot be dealt with in full transparency. The government considers it necessary to spend 15 billion tax money on pepper-hard aircraft in times of austerity. Then at least we ask for openness and transparency. Every citizen has the right to know where his tax money goes and whether it is well spent. Transparency can ensure this.

In discussions about transparency, the argument that there would be a lot of sensitive information is often covered. However, it seems to us quite strong that all information transmitted would relate to business secrets. Everyone should at least have access to the financial picture of the four aircraft manufacturers – one has since fallen – who transmit their information. After all, we are talking about a billion-dollar purchase.

                    Met deze resolutie willen wij dat het Parlement zijn verantwoordelijkheid neemt en het Rekenhof belast met het onderzoek naar het financiële plaatje dat door de verschillende constructeurs wordt geschetst.

Het Rekenhof gaf zelf aan dat het controles kan uitvoeren op beslist beleid. Er is dus, als u goed hebt geluisterd naar het verslag, al een wijziging. Op vandaag kunnen wij spreken van beslist beleid, want de RfGP is intussen rondgestuurd.

Wij stellen dan ook voor dat het Rekenhof onmiddellijk hierbij wordt betrokken. Ik citeer graag, zoals de rapporteur dat daarnet deed, de heer Beckers van het Rekenhof: "Wij kunnen verslag uitbrengen over de voorbereiding van de aankoop."

Maar dat moeten we natuurlijk vragen, collega's.

Andere landen tonen nochtans dat het wel kan. Ik heb het voorbeeld gegeven van Canada en Nederland, die hun rekenkamers van bij de aanvang erbij hebben betrokken.

Daar is transparantie de regel. Volgens de meerderheid hier kan het blijkbaar niet. De meerderheid probeert zich te verdedigen door de Inspectie van Financiën uit te roepen tot het groot controleorgaan. Met alle respect, en wij twijfelen niet aan de deskundigheid van de Inspectie van Financiën, maar dat is een controleorgaan van de uitvoerende macht, met andere woorden van de regering.

De Inspectie van Financiën is geen instrument van het Parlement en geeft advies in de commissie voor de Legeraankopen en -verkopen, alweer achter gesloten deuren.

With this resolution, we want Parliament to take its responsibility and charge the Court of Auditors with the examination of the financial picture drawn by the various constructors.

The Court of Auditors itself stated that it can carry out checks on determined policies. Therefore, if you have listened carefully to the report, there is already an amendment. Today, we can talk about definitely policy, because the RfGP has been sent around.

We therefore propose that the Court of Auditors be involved immediately. I would like to quote, as the rapporteur who just did, Mr. Beckers of the Court of Auditors: “We can report on the preparation of the purchase.”

That is what we need to ask, colleagues.

Other countries have shown that it is possible. I have given the example of Canada and the Netherlands, which have involved their calculation chambers from the beginning.

Transparency is the rule. According to the majority here, it is obviously not possible. The majority tries to defend itself by proclaiming the Financial Inspectorate as the major audit body. With all respect, and we do not doubt the expertise of the Financial Inspectorate, but that is a control body of the executive power, in other words the government.

The Financial Inspectorate is not an instrument of the Parliament and advises in the Committee on Army Purchases and Sales, again behind closed doors.

                    Het Parlement kan wel een opdracht geven aan het Rekenhof, als instrument van de wetgevende macht. Wij willen een onafhankelijke controle om een open en eerlijk debat te kunnen garanderen.

Bovendien, collega’s, is het belangrijk om op te merken dat de Inspectie van Financiën vandaag over 42 medewerkers beschikt. Deze staan zowel ten dienste van de federale overheid als van de Gemeenschappen en de Gewesten. Het Rekenhof daarentegen heeft ongeveer vijfhonderd medewerkers. De kans op nog meer specialisatie en deskundigheid in dit dossier is dan ook veel groter wanneer wij het Rekenhof erbij betrekken.

Collega’s, andere beleidsniveaus in dit land bewijzen nochtans dat het wel kan. Ik geef een voorbeeld. Inzake de Oosterweelverbinding rapporteert het Rekenhof op regelmatige wijze aan het Vlaams Parlement over de voortgang van het dossier. Het Vlaams Parlement voelt blijkbaar beter de vraag naar transparantie aan dan de meerderheid in deze Kamer.

Ik kan alleen maar vaststellen dat deze meerderheid een besluitvorming achter gesloten deuren verkiest. Intussen sleurt zij echter wel de toekomstige generaties mee in een gevaarlijk en onhaalbaar budgettair avontuur. Onze kinderen en kleinkinderen zullen de factuur van de vervanging van de F-16’s betalen.

Collega’s, ik hoop dat de meerderheid zich nog bezint vooraleer dit voorstel tot openheid gewoon weg te stemmen.

In addition, colleagues, it is important to note that the Financial Inspectorate currently has 42 employees. These are both at the service of the federal government and of the Communities and the Regions. The Court of Audit, on the other hand, has about five hundred employees. The possibility of even more specialization and expertise in this dossier is therefore much greater when we involve the Court of Auditors.

Other political levels in this country, however, prove that it can. I will give an example. Regarding the Oosterweel connection, the Court of Auditors regularly reports to the Flemish Parliament on the progress of the case. The Flemish Parliament apparently feels the demand for transparency better than the majority in this House.

I can only conclude that this majority prefers decision-making behind closed doors. Meanwhile, however, it is dragging future generations into a dangerous and unattainable budgetary adventure. Our children and grandchildren will pay the bill for the replacement of the F-16.

Colleagues, I hope that the majority will still reflect before voting away from this proposal for openness.
