                    Mijnheer de voorzitter, omdat het hier over een belangrijke materie gaat, wil ik een aantal zaken zeggen.

Het voorliggend wetsvoorstel kadert in de strijd tegen de parentale kinderontvoeringen, ontvoeringen door ouders.

Uit cijfers van Child Focus blijkt dat er in 2016 nog 390 gevallen van kinderontvoeringen zijn geweest. Bovendien valt jaar na jaar een stijging vast te stellen. In 2017 behandelde de stichting 10% meer dossiers dan het jaar voorheen. Ook binnen de Europese Unie is er jaarlijks sprake van ongeveer 1 800 gevallen van kinderontvoeringen.

De vakantieperiode staat voor de deur en het is vooral in deze periode dat wij met dergelijke gevallen worden geconfronteerd, waarbij een van de ouders het kind meeneemt naar het buitenland en daarna nooit meer terugkeert. Het contact tussen het kind en de andere ouder wordt verbroken en in veel gevallen ziet de ouder het kind nooit meer terug. Dit zorgt voor schrijnende situaties. De parentale kinderontvoeringen doen zich vooral voor binnen de Europese Unie – Frankrijk blijft wat dat betreft de koploper –, maar ook buiten de EU-lidstaten. In dergelijke gevallen is het soms een ellenlange en heel complexe procedure om het kind terug te brengen naar België en in veel gevallen lukt dat zelfs nooit. De voorbije dagen en weken hebben heel wat mensen mij gecontacteerd en hun situatie beschreven. Vaak gaat het om heel schrijnende situaties.

Het wetsvoorstel voorziet in een aantal wijzigingen. Er wordt heel concreet gewerkt op de aflevering en/of de ongeldigverklaring van de identiteitsbewijzen van het kind. Zo zal door de wijziging van artikel 374/1 van het Burgerlijk Wetboek de familierechtbank bij ernstige vrees voor een parentale kinderontvoering reisbeperkingen voor dat kind kunnen opleggen door in te grijpen op de Belgische paspoorten, reisdocumenten en identiteitskaarten. Dit kan door de uitreiking te voorkomen of de bruikbaarheid van reeds afgeleverde documenten en identiteitskaarten te verhinderen door ze ongeldig te verklaren en in te trekken, met name van paspoorten, reisdocumenten voor niet-Belgen, en ook te seinen in het centraal bestand van de identiteitskaarten.

Since this is an important issue, I would like to say a few things.

The present legislation framework in the fight against parental child abductions, abductions by parents.

Child Focus figures show that there were 390 more cases of child abductions in 2016. In addition, an increase can be observed year after year. In 2017, the foundation handled 10% more files than the previous year. About 1,800 cases of child abductions occur annually in the European Union as well.

The holiday period is at the doorstep and it is especially in this period that we are faced with such cases, in which one of the parents takes the child abroad and then never returns again. The contact between the child and the other parent is broken and in many cases the parent never sees the child again. This creates awkward situations. Parental child abductions occur mainly within the European Union – France remains the leader in this regard – but also outside the EU Member States. In such cases, it is sometimes a long and very complex procedure to bring the child back to Belgium and in many cases it can never even succeed. Over the past few days and weeks, many people have contacted me and described their situation. Often these are very difficult situations.

The bill includes a number of amendments. Very concrete work is being done on the delivery and/or invalidation of the child’s identity documents. Thus, by amending Article 374/1 of the Civil Code, the family court will be able to impose travel restrictions on that child in case of serious fear of a parent’s child kidnapping by interfering with Belgian passports, travel documents and identity cards. This can be done by preventing the issuance or by preventing the usability of documents and identity cards already delivered by declaring them invalid and withdrawing them, in particular passports, travel documents for non-Belgians, and also by signing them into the central file of identity cards.

                    De maatregel voorzien in artikel 374/1, lid 1, geldt natuurlijk niet voor de aflevering van identiteitskaarten voor minderjarigen boven de 12 jaar, want die identiteitskaarten moeten volgens de wetgeving verplicht uitgereikt worden op grond van de inschrijving in het bevolkingsregister. Of een ouder daarmee al dan niet uitdrukkelijk akkoord gaat, is bijgevolg niet van toepassing. De geldigheid van die identiteitskaart kan wel beperkt worden tot het grondgebied van België, zoals voorzien in lid 2. Na een beslissing van de rechter, meer bepaald de familierechter, zal de griffier de beslissing bezorgen aan de gemeente waar het kind is ingeschreven, aan de FOD Binnenlandse Zaken en ook aan de FOD Buitenlandse Zaken.

Collega's, ik wil even benadrukken dat het niet de bedoeling is dat een eenzijdige of onvoorziene reactie van een ouder de reisplannen van de andere ouder met het kind of de reisplannen van het kind alleen op de helling zet. Het komt de familierechtbank toe erover te oordelen of het bezwaar van een van de ouders in kwestie terecht is. Er moet dan ook sprake zijn van een ernstige vrees vooraleer het een minderjarige niet toegelaten wordt om naar het buitenland te reizen.

Mijnheer de voorzitter, ik denk dat ik daarmee de essentie van het wetsvoorstel heb toegelicht. In de commissie hebben wij een zeer constructieve bespreking gehouden. Ik hoop dat de stemming straks ook zeer constructief zal verlopen en dat alle fracties dit voorstel steunen zodat er komaf gemaakt wordt met de ontvoering van kinderen door ouders.

The measure provided for in Article 374/1, paragraph 1, does not, of course, apply to the delivery of identity cards for minors over 12 years of age, since those identity cards must be issued under the legislation on the basis of the entry in the population register. Whether or not a parent expressly agrees to this is therefore not applicable. However, the validity of that identity card may be limited to the territory of Belgium, as provided for in paragraph 2. After a decision of the court, in particular the family court, the secretary will forward the decision to the municipality where the child is registered, to the FOD Internal Affairs and also to the FOD Foreign Affairs.

Colleagues, I would like to emphasize for a moment that it is not intended that a one-sided or unexpected reaction from one parent will only hinder the other parent’s travel plans with the child or the child’s travel plans. It is up to the family court to judge whether the objection of one of the parents in question is correct. There must therefore be a serious fear before a minor is not allowed to travel abroad.

I think I explained the essence of the bill. We held a very constructive discussion. I hope that the vote will be very constructive and that all groups will support this proposal in order to stop the abduction of children by parents.

                    Monsieur le président, chers collègues, le texte qui nous est soumis cet après-midi répond à une situation malheureusement fréquente, à savoir le rapt d'un enfant emmené illicitement à l'étranger par l'un de ses deux parents. Si nous ne pouvons pas faire grand-chose pour empêcher la détérioration de relations humaines au point que l'un des parents veuille disposer à sa guise, et de manière illégitime – je le rappelle – de la garde exclusive des enfants, nous pouvons, toutefois, et nous devons faire tout ce qui est en notre pouvoir, pour empêcher cette intention de se réaliser.

Je pense important de rappeler que ce type d'abus, commis par l'un des deux parents, ne limite pas ses effets désastreux aux enfants et à l'autre parent. Il s'étend aussi à l'entourage de l'enfant: ses amis, ses camarades de classe, les voisins, les grands-parents; cela sans compter la violation des valeurs de notre État de droit et des décisions de justice que constituent de tels actes.

Je ne reviendrai pas sur les détails de la proposition, puisque mon collègue M. Yüksel vient de le faire. Pour le groupe MR, il nous semble heureux que la nouvelle loi permette aux autorités compétentes d'intervenir soit sur le passeport, soit sur le document de voyage, soit sur la carte d'identité belge de l'enfant mineur et ce, soit de façon préventive en refusant la délivrance dudit document, mais aussi de manière curative, en permettant au tribunal de la famille d'ordonner l'invalidation et le retrait du passeport ou du document de voyage ou bien de limiter la validité du document d'identité belge.

Pour nous, il s'agit d'un texte équilibré, qui est réalisable en pratique et qui, finalement, réaffirme deux évidences. D'abord, le droit des deux parents sur l'éducation de leurs enfants et le droit de l'enfant lui-même à ne pas être un simple instrument de la volonté abusive de l'un de ses deux parents. Ensuite, l'importance du respect du fond des décisions prises par les cours et tribunaux, en particulier pour ce qui concerne des questions familiales.

Par conséquent, pour nous, ce texte est bienvenu. Merci! Nous l'avons soutenu en commission, tel qu'amendé. Nous le soutiendrons donc en séance plénière.

Mr. Speaker, dear colleagues, the text submitted to us this afternoon responds to a unfortunately common situation, namely the abduction of a child illegally taken abroad by one of his or her parents. If we cannot do much to prevent the deterioration of human relations to the point where one of the parents wishes to dispose of the exclusive custody of the children as he or she wishes, and in an unlawful way – I recall it – we can, however, and must do everything in our power to prevent this intention from happening.

I think it is important to remember that this type of abuse, committed by one of the parents, does not limit its disastrous effects to the children and the other parent. It also extends to the child’s surroundings: his friends, classmates, neighbors, grandparents; not to mention the violation of the values of our rule of law and the rulings of justice that constitute such acts.

I will not return to the details of the proposal, as Mr. Yüksel just did it. For the MR group, we are pleased that the new law allows the competent authorities to intervene either on the passport or on the travel document or on the Belgian identity card of the minor child, either in a preventive way by refusing to issue that document, but also in a curative way, allowing the family court to order the invalidation and withdrawal of the passport or travel document or to limit the validity of the Belgian identity document.

For us, this is a balanced text, which is feasible in practice and ultimately reaffirms two obvious things. First, the right of both parents to the upbringing of their children and the right of the child himself not to be a mere instrument of the abusive will of one of his two parents. Next, the importance of respecting the merits of decisions taken by courts and courts, in particular with regard to family matters.

This text is therefore welcome. thank you ! We supported it, as amended. We will support it in the plenary session.
