Monsieur le président, chers collègues, notre parti et d'autres avaient déposé cette proposition de modification, qui vise à abaisser l'âge du début de l'obligation scolaire à cinq ans, depuis un certain nombre d'années. Grâce au vote qui aura lieu tout à l'heure, ce sera une réalité pour la rentrée scolaire, le 1ᵉʳ septembre 2020. Il importait évidemment que les écoles puissent s'organiser afin que tout se déroule dans des conditions optimales.
Cette avancée est particulièrement importante. Une fréquentation régulière dès le plus jeune âge est le meilleur moyen de développer la sociabilité des enfants, de leur permettre d'intégrer les codes scolaires, et facilitera leur intégration. C'est un outil essentiel au développement, plus spécifiquement pour les enfants qui ne parlent pas le français ou le néerlandais à la maison, ou qui sont plus fragiles sur le plan socioéconomique.
Par ailleurs, des études ont montré que les enfants qui ne fréquentent pas l'école maternelle courent plus de risques de connaître un parcours scolaire plus complexe par la suite. L'abaissement de l'âge de l'obligation scolaire à cinq ans est un outil de promotion et de réussite de nos enfants. C'est donc pour nous une grande avancée. Après toutes ces années sans que nous ayons pu aboutir au niveau du Parlement, ceci est le signe qu'il vaut la peine, chers collègues, de persister et de continuer à se mobiliser.
Nous avons obtenu des avis positifs de la part des différentes Communautés et gouvernements, mais aussi des ministres de l'Enseignement. Ceci a permis de concrétiser cette avancée en commission. Nous terminons la législature avec un vote en plénière et je m'en réjouis. Nous soutiendrons bien évidemment notre texte.

Mr. Speaker, dear colleagues, our party and others had submitted this amendment proposal, which aims to lower the age of commencement of compulsory school to five years, for a number of years. Thanks to the vote that will take place just now, this will be a reality for school return, on September 1, 2020. It was important, of course, that schools could organize themselves so that everything would take place in optimal conditions.
This progress is ⁇ important. Regular attendance from an early age is the best way to develop children’s sociability, enable them to integrate school codes, and will facilitate their integration. It is an essential tool for development, more specifically for children who do not speak French or Dutch at home, or who are more vulnerable socio-economically.
Furthermore, studies have shown that children who do not attend kindergarten are more likely to experience a more complex school path later. Reducing the age of compulsory schooling to five years is a tool for the promotion and success of our children. This is a great advance for us. After all these years without having succeeded at parliamentary level, this is a sign that it is worth, dear colleagues, to persist and continue to mobilise.
We have received positive opinions from various Communities and governments, but also from Ministers of Education. This resulted in this progress in the Commission. We end the legislature with a vote in the plenary and I look forward to it. We will support our text.

Monsieur le président, chers collègues, comme vient de le dire Mme Fonck, le dossier est ancien. J'ai en effet retrouvé dans mes cartons la première proposition de loi que le groupe PS/sp.a avait déposée. C'était en février 2004. Déjà à l'époque, des études démontraient l'importance de la scolarisation précoce et régulière pour lutter contre la reproduction des inégalités sociales et pour favoriser l'intégration de l'enfant dans le groupe d'élèves concerné.
Chers collègues, dans l'intervalle, de nombreuses études ont continué à dresser le même constat. Certains enfants, en particulier ceux issus des milieux précarisés qui ne maîtrisent pas l'une des deux langues nationales, intègrent l'école plus tard et ne la fréquentent pas de manière régulière, ce qui ne permet dès lors pas d'acquérir les codes du système scolaire et une connaissance suffisante de la langue.
En 2015, nous avons déposé une énième proposition de loi pour être plus ambitieux au vu des constats, à savoir l'obligation scolaire à partir de l'âge de trois ans. C'est d'ailleurs une résolution qu'ont votée unanimement nos collègues sénateurs en février 2016. Ils indiquaient qu'il est important que l'obligation scolaire débute à l'âge de trois ans. C'est aussi la position du gouvernement de la Fédération Wallonie-Bruxelles qui est en faveur de l'abaissement de l'obligation scolaire à l'âge de trois ans.
Bien sûr, nous allons nous réjouir de ce premier pas qui s'appliquera dès la rentrée scolaire 2020-2021. Mais que de temps perdu! Je vais regretter que la Communauté flamande ait mis quinze ans pour remettre un avis à ce Parlement sur l'obligation scolaire. C'est beaucoup, quinze ans! Nous l'avons reçu in extremis le 12 février dernier. Quel gâchis! Attendre quinze ans pour essayer de réaliser une meilleure intégration des élèves mais aussi pour lutter contre l'inégalité scolaire, c'est énorme!
Nous restons favorables à l'obligation scolaire dès l'âge de trois ans, mais nous soutiendrons évidemment le petit pas en avant de l'obligation scolaire dès l'âge de cinq ans. C'est donc avec enthousiasme que nous voterons pour cette proposition de loi.

Mr. Speaker, as Ms. Fonck just said, the case is old. In fact, I found in my cartons the first bill that the group PS/sp.a had submitted. It was in February 2004. Already at that time, studies demonstrated the importance of early and regular schooling to combat the reproduction of social inequalities and to promote the integration of the child into the relevant student group.
In the meantime, many studies have continued to draw the same conclusion. Some children, especially those from precarious backgrounds who do not speak either of the two national languages, integrate the school later and do not attend it on a regular basis, which therefore does not allow to acquire the codes of the school system and sufficient knowledge of the language.
In 2015, we submitted another bill to be more ambitious in view of the findings, namely the compulsory schooling from the age of three. This resolution was unanimously adopted by our colleagues senators in February 2016. They pointed out that it is important that compulsory schooling begins at the age of three. This is also the position of the government of the Wallonia-Brussels Federation which is in favor of lowering the school obligation at the age of three.
Of course, we will look forward to this first step that will be applied from the school return 2020-2021. But what lost time! I will regret that the Flemish Community took fifteen years to give this Parliament an opinion on compulsory schooling. That’s a lot, fifteen years. We received it in extremis on February 12 last year. What a waste! Waiting for fifteen years to try to ⁇ a better integration of students but also to fight school inequality is huge!
We remain in favour of compulsory schooling from the age of three, but we will obviously support the small step forward of compulsory schooling from the age of five. Therefore, we will vote with enthusiasm for this bill.

Monsieur le président, parfois, il faut de longues années pour atteindre un résultat. Il aura en effet fallu quinze ans à ce Parlement pour voter l'abaissement de l'obligation scolaire de six à cinq ans. Depuis 1988, l'enseignement est devenu une compétence relevant des Communautés. Cependant, la fixation du début et de la fin de l'obligation scolaire est une compétence fédérale.
Ces dernières années, de nombreux textes ont été déposés avec une variante: le début de l'obligation scolaire a trois ou à cinq ans. Je me rappelle avoir déposé un texte sur ce sujet avec le collègue Maingain il y a de très nombreuses années. Mon groupe avait, dès cette époque, choisi l'option du début de l'obligation scolaire à cinq ans. Les jeunes seraient soumis à l'obligation pendant treize ans contre douze actuellement.
Le Conseil d'État considère que l'imposition de l'obligation scolaire à cinq ans ne semble pas pouvoir être considérée comme une mesure disproportionnée compte tenu du fait que la grande majorité des enfants de cet âge fréquentent déjà l'école maternelle – selon les chiffres, on approche des 98 %.
On a longtemps attendu les avis des Communautés. Ils sont récemment arrivés et sont positifs, à la condition expresse que la loi n'entre en vigueur que pour l'année scolaire 2020-2021. Cette condition a été acceptée dans le débat parlementaire.
Pourquoi faut-il porter l'obligation scolaire à cinq ans? Tout simplement parce que la fréquentation de l'école maternelle est un facteur de réussite pour l'enseignement primaire. Une étude de l'OCDE a montré certaines corrélations entre le nombre d'années passées dans l'éducation préscolaire et les résultats scolaires ultérieurs. Nous nous inscrivons dans un schéma qui assure l'égalité des chances pour tous les enfants. Suivant cette logique, c'est donc un an plus tôt que les enseignants pourront constater quels enfants soufrent d'un retard et pourront veiller à un accompagnement adapté afin d'offrir à chaque enfant les meilleures chances de réussite.
Pour ces raisons, nous voterons en faveur de cette proposition.

Sometimes it takes many years to ⁇ a result. It took 15 years for this Parliament to vote on the reduction of the school obligation from six to five years. Since 1988, teaching has become a competence within the Communities. However, fixing the beginning and end of the school obligation is a federal competence.
In recent years, many texts have been filed with a variant: the beginning of the school obligation is three or five years old. I remember having submitted a text on this subject with colleague Maingain many years ago. My group had, from that time, chosen the option of starting the compulsory schooling at five years. Young people would be subject to the obligation for thirteen years versus twelve currently.
The State Council considers that the imposition of the compulsory schooling at five years does not appear to be considered a disproportionate measure given the fact that the vast majority of children of this age are already attending kindergarten – according to the figures, approaching 98%.
We have long been waiting for the opinions of the communities. They have recently arrived and are positive, on the express condition that the law comes into force only for the 2020-2021 academic year. This condition was accepted in the parliamentary debate.
Why should the obligatory schooling be increased to five years? Simply because attending kindergarten is a success factor for primary education. An OECD study has shown some correlations between the number of years spent in preschool education and subsequent school outcomes. We are part of a scheme that ensures equal opportunities for all children. Following this logic, it is thus a year earlier that teachers will be able to determine which children suffer from a delay and will be able to ensure appropriate accompaniment in order to offer each child the best chances of success.
For these reasons, we will vote in favour of this proposal.

Mijnheer de voorzitter, collega's, na vele jaren is er inderdaad eindelijk een beslissing genomen in het nu voorliggend wetsvoorstel. Volgens de info die mij werd bezorgd door collega's met heel wat meer jaren op de teller in het halfrond, gaat dit wetsvoorstel al bijna vijftien jaar mee. Met sp.a hebben wij dat altijd van dichtbij opgevolgd, want wij kunnen niet ontkennen dat er in de afgelopen vijftien jaar heel wat veranderd en geëvolueerd is. De noden en de zorgen zijn niet meer dezelfde en uiteraard is ook onze samenleving veranderd. Daarom zijn wij ervan overtuigd dat wij een stapje verder moeten durven te zetten. De Fransen hebben dat reeds ingezien.
Collega's, wij kunnen niet achterblijven. Om die reden zullen wij het amendement dat wij in de commissievergadering hebben ingediend, in deze plenaire vergadering opnieuw indienen. Wij willen met ons amendement nog een stap verder gaan, want wij stellen voor om de leerplichtleeftijd van vijf jaar op drie jaar vast te leggen. Daartoe hebben wij de volgende redenen.
Vandaag is gemiddeld nog 5 % van de kinderen tussen drie en vijf jaar in België niet ingeschreven in het kleuteronderwijs. In absolute cijfers spreken wij over om en bij de vijftienduizend kinderen, wat overeenkomt met het inwonersaantal van heel wat gemeenten in België. Ik meen te mogen stellen dat dit geen laag aantal is.
Wij willen ook vermijden dat die vijftienduizend kinderen een taal- en leerachterstand oplopen nog voordat zij naar het eerste leerjaar gaan. Ter info, het aantal jongeren dat zonder diploma het secundair onderwijs verlaat, ligt dramatisch hoog. Laten wij niet vergeten dat de kleuters van vandaag de ouders van morgen zijn. De kinderarmoede is in ons land in de afgelopen jaren enkel gestegen. In België wordt momenteel gemiddeld 15 % van de kinderen geboren in armoede. Voor ons speelt het onderwijs een cruciale rol in de strijd tegen kinderarmoede. Daarom is het van primordiaal belang dat wij zo vroeg mogelijk de toegang tot onderwijs faciliteren.
Het is onze verantwoordelijkheid om ter zake het goede voorbeeld te tonen, ondanks het gegeven dat de adviezen omtrent ons voorstel eerder negatief waren. Uitzonderlijke omstandigheden, waarbij ik naar de 15 % kinderarmoede verwijs, vereisen nu eenmaal uitzonderlijke oplossingen. Dat willen wij nu net bereiken met ons amendement: wij creëren een hefboom in de strijd tegen kinderarmoede om te vermijden dat het aantal kinderen dat in armoede geboren wordt nog verder zou stijgen.

After many years, a decision has finally been made in the current bill. According to the information provided to me by colleagues with a lot more years on the counter in the hemisphere, this bill has been around for almost fifteen years. With sp.a, we have always followed this closely, because we cannot deny that in the last fifteen years a lot has changed and evolved. The needs and concerns are no longer the same and of course our society has changed too. Therefore, we are convinced that we must dare to take a step further. The French have already understood this.
My colleagues, we cannot be left behind. For this reason, we will re-submit the amendment we submitted at the committee meeting at this plenary session. We would like to go a step further with our amendment, as we propose to fix the compulsory school age from five years to three years. For this we have the following reasons.
Today, on average, 5 % of children between three and five years of age in Belgium are not enrolled in preschool education. In absolute figures we are talking about and among the fifteen thousand children, which corresponds to the number of inhabitants of many municipalities in Belgium. I can say that this is not a low number.
We also want to prevent those fifteen thousand children from experiencing language and learning lags even before they enter the first school year. For information, the number of young people who leave secondary education without a diploma is dramatically high. Let us not forget that today’s kindergartens are tomorrow’s parents. Child poverty has only increased in our country in recent years. In Belgium, on average, 15% of children are born in poverty. For us, education plays a crucial role in the fight against child poverty. Therefore, it is of the utmost importance to facilitate access to education as early as possible.
It is our responsibility to be a good example in this regard, despite the fact that the opinions about our proposal were previously negative. Exceptional circumstances, where I refer to the 15% child poverty rate, require exceptional solutions. This is what we now want to ⁇ with our amendment: we create a lever in the fight against child poverty to prevent the number of children born in poverty from increasing further.

Monsieur le président, chers collègues, si l'âge de l'obligation scolaire est fixé à 6 ans, 95 à 99 % de nos enfants fréquentent déjà l'enseignement maternel à l'âge de 5 ans. Des chiffres positifs lorsqu'on connaît les retombées positives de la scolarisation des enfants avant l'école primaire obligatoire, aussi bien aux niveaux cognitif, linguistique, social et sociétal.
Toujours est-il que les enfants qui ne sont pas scolarisés avant l'âge de 6 ans et ceux, beaucoup plus nombreux qui, bien que scolarisés, ne fréquentent pas l'école régulièrement, sont issus de milieux sociaux particulièrement défavorisés. Au lieu de les aider à mettre le pied à l'étrier, le système actuel renforce en réalité les inégalités entre eux et les autres enfants.
Ces chiffres doivent être mis en parallèle avec une tendance à retarder l'âge d'entrée à l'école maternelle au-delà de 3 ans. Une étude consacrée à l'inégalité d'accès à l'école maternelle montre que les enfants qui libèreraient leur place en crèche dès l'âge de 2 ans et demi l'occupent plus longtemps parce qu'ils seraient plus rarement autorisés à entrer en maternelle. Les familles supportent donc plus longtemps le coût des crèches alors que l'école est gratuite.
C'est pour cette raison qu'après les législatives de 2014, mon groupe a redéposé sa proposition de loi visant à abaisser l'âge d'obligation scolaire de 6 à 3 ans. Nous suivions ainsi notamment une résolution du Conseil Supérieur de la Santé recommandant aux parents d'inscrire leurs enfants dès l'âge de 2 ans et demi. Nous avons été le premier parti à déposer un texte en la matière sous cette législature, mais aussi le seul à proposer l'abaissement de l'âge d'obligation scolaire à 3 ans. C'est donc avec joie que nous avons vu d'autres partis déposer des textes visant le même but, même si je regrette le peu d'ambition des textes qui n'envisagent l'abaissement qu'à 5 ans. Un abaissement progressif année après année jusqu'à 3 ans était tout à fait possible.
Nous sommes nombreux à reconnaître les effets positifs d'une scolarisation précoce. La petite enfance est un moment crucial pour l'acquisition du langage et des aptitudes nécessaires à la vie quotidienne telles que la coopération, l'autonomie, la créativité, la résolution des difficultés. Une enquête nationale française a d'ailleurs conclu que chaque année passée en école maternelle permet de réduire la probabilité de redoublement de la première année d'école primaire, en particulier pour les enfants issus de milieux défavorisés.

This is why, after the 2014 legislative elections, my group re-presented its bill aiming to lower the age of compulsory schooling from 6 to 3 years. In particular, we followed a resolution of the Higher Health Council recommending that parents enroll their children from the age of two and a half. We were the first party to file a text on this subject in this legislature, but also the only one to propose the lowering of the age of compulsory schooling to 3 years. So it is with joy that we have seen other parties submit texts aimed at the same goal, although I regret the little ambition of the texts that consider lowering it only to 5 years. A gradual decrease from year to year to 3 years was quite possible.
Many of us recognize the positive effects of early schooling. Early childhood is a crucial time for the acquisition of language and skills necessary for everyday life such as cooperation, autonomy, creativity, and problem solving. A French national survey has also concluded that each year spent in preschool reduces the likelihood of doubling of the first year of primary school, especially for children from disadvantaged backgrounds.

Au plus tôt les enfants sont scolarisés, au mieux peut-on les prendre en charge si nécessaire en cas de trouble du langage et de la parole, d'orientation spatio-temporelle et de troubles psychomoteurs.
L'école joue ici pleinement son rôle de prévention, de conseil et de soutien auprès des parents, tout en donnant un maximum de chances à l'enfant d'aborder le cycle primaire avec succès. Il est évident que plus les capacités d'attention sont mobilisées tôt, plus les acquisitions des élèves en primaire sont facilitées.
Cette mesure aura aussi pour effet d'accélérer l'intégration des enfants en bas âge issus de l'immigration, puisqu'un enseignement précoce leur permet de maîtriser les bases, en particulier le langage de l'enseignement parcouru, étape essentielle d'un parcours scolaire et professionnel réussi et émancipatoire.
Deuxièmement, le fait de socialiser et stimuler les enfants dès le plus jeune âge par l'organisation des services d'accueil et de structures scolaires a des retombées positives. L'éducation des jeunes enfants représente un réel bien public et apporte des avantages en termes de santé, de développement cognitif, social et affectif qui favorisent également le rapport aux autres et la cohésion sociale.
Troisièmement, l'impact budgétaire d'une telle mesure est tout à fait à relativiser. Comme le souligne le Conseil d'État, la mesure proposée ne devrait pas avoir d'incidence déraisonnable sur les Communautés chargées d'organiser l'enseignement et d'assurer sa gratuité. En effet, une très grande partie des enfants concernés, même dans le groupe d'âge de 3 à 4 ans, sont déjà scolarisés et ce de manière gratuite. C'est d'ailleurs pour cette raison que la France a décidé d'abaisser l'âge de l'obligation scolaire de 6 à 3 ans et ce dès la rentrée scolaire de 2019.
J'ajoute enfin que les investissements réalisés dans l'enseignement seront toujours bénéfiques à la société en termes de santé et d'économie. L'enseignement constitue en effet la clé de nombreux problèmes sociétaux.
Par conséquent, mon groupe soutiendra bien évidemment l'abaissement de l'âge de l'obligation scolaire à 5 ans, tout en regrettant qu'un consensus n'ait pas pu être trouvé sur un âge qui aurait accentué les effets positifs d'une scolarisation précoce, à savoir 3 ans. Il est regrettable que le chemin emprunté par la France ne l'ait pas été par la Belgique. J'ose espérer que cet abaissement à 5 ans ne constitue qu'une étape d'un processus qui vise, à long terme, à rendre obligatoire les trois années de l'enseignement maternel.
J'attire également l'attention des Communautés sur le besoin d'accompagner cet abaissement de l'âge d'obligation scolaire d'une véritable politique d'encouragement afin que la fréquentation des écoles pour les 3-4 ans soit nettement revue à la hausse.

Early childhood education represents a real public good and brings benefits in terms of health, cognitive, social and emotional development that also fosters relationship with others and social cohesion.
Thirdly, the budgetary impact of such a measure is quite relativising. As the State Council points out, the proposed measure should not have an unreasonable impact on the Communities responsible for organizing and ensuring the free of charge of education. Indeed, a very large proportion of the children concerned, even in the age group of 3 to 4 years, are already enrolled in school and this is free of charge. For this reason, France has decided to lower the age of compulsory schooling from 6 to 3 years from the start of school in 2019.
Finally, I would add that investments made in education will always benefit society in terms of health and economy. Education is the key to many social problems.
Therefore, my group will obviously support the reduction of the age of compulsory schooling to 5 years, while regretting that a consensus could not be found on an age that would have accentuated the positive effects of early schooling, namely 3 years. It is regrettable that the path taken by France was not taken by Belgium. I dare hope that this reduction to five years is only a step in a process that aims, in the long run, to make the three years of maternal education compulsory.
I also draw the attention of the Communities to the need to accompany this reduction of the age of compulsory schooling with a true policy of encouragement so that the attendance of schools for the 3-4 years is clearly revised upwards.

Ook al zijn wij het principe genegen, wij hadden toch enkele bezorgdheden over de effecten. Ten eerste, gelet op het feit dat artikel 24 van de Grondwet bepaalt dat er levensbeschouwelijk onderricht moet worden gegeven in geval van leerplichtonderwijs, heeft de Vlaamse regering in haar advies de uitdrukkelijke voorwaarde gesteld dat de verlaging van de leerplichtleeftijd niet als gevolg mag hebben dat er levensbeschouwelijk onderricht moet worden gegeven in het kleuteronderwijs.
De inwerkingtreding, vanaf 2020-2021, houdt daar effectief rekening mee. Enerzijds kunnen de Gemeenschappen zich hierdoor voorbereiden op de inwerkingtreding en de nodige maatregelen nemen met het oog op voldoende omkadering voor de vijfjarigen. Anderzijds geeft het ons de mogelijkheid in de komende jaren de Grondwet op dat punt aan te passen, zodat het advies van de Vlaamse Gemeenschap gerespecteerd kan worden.
Als wij dat niet doen, zou de regeling – Vlaams minister van Onderwijs Crevits heeft daar een aantal cijfers over gegeven – in Vlaanderen 20 miljoen euro aan meerkosten betekenen. Dat bedrag zou voor de Franse Gemeenschap niet gek veel verschillen, gelet op het feit dat de kleuterparticipatie in Vlaanderen vandaag een stukje groter is dan in de Franse Gemeenschap.

Dat mag ons niet beletten om het voorstel uit te voeren, noch betekent de kostprijs dat wij ons ertegen zullen verzetten. Wij zijn al lang voor de verhoging van de kleuterparticipatie in het onderwijs. Daarvoor heeft de Vlaamse regering trouwens ook al heel specifieke maatregelen genomen. Er zijn op dat vlak al heel veel stappen gezet. In Vlaanderen bedraagt de kleuterparticipatie voor vijfjarigen trouwens 99 %.
Wij moeten ook aandacht hebben voor het feit dat een verlaging van de leerplichtleeftijd niet automatisch betekent dat de betrokken kleuters ook naar school moeten. Er is nog altijd een verschil tussen leerplicht en schoolplicht. Er moet dus in de komende jaren worden opgevolgd of het aandeel van thuisonderwijs vergroot.
De regeling voldoet aan de vraag van de Gemeenschappen. Ik meen dat het goed is om hen op dat vlak een aantal zaken te laten bepalen. Zij moeten uiteindelijk het onderwijs organiseren, aangezien zij hoofdzakelijk daarvoor bevoegd zijn, terwijl slechts het aspect van de leerplicht hier nog zweeft. Zolang wij in dit Huis hiervoor bevoegd zijn, moeten wij daarvoor onze verantwoordelijkheid nemen en voor de Gemeenschappen beslissingen nemen. Het zou uiteraard veel logischer zijn, mocht de leerplicht op termijn terechtkomen bij de Gemeenschappen. Op die manier kunnen zij het organiseren op de manier die zij zelf wensen. Misschien leidt dat wel tot kortere doorlooptijden op dat vlak?
De Raad van State heeft er in zijn advies heel specifiek aan herinnerd dat wij de betreffende maatregel niet zomaar konden nemen, zonder er de Gemeenschappen bij te betrekken. Ik meen dat dat absoluut van belang is.
Collega's, concluderend, wij zullen absoluut voor het voorstel stemmen, want het is en blijft een mogelijkheid om de kleuterparticipatie aan het onderwijs te ondersteunen. De kennis van het Nederlands in Vlaanderen is immers van zeer groot belang.

Colleagues, concluding, we will definitely vote for the proposal, because it is and remains an opportunity to support preschool participation in education. Knowledge of Dutch in Flanders is of great importance.

Onze fractie zal het voorstel absoluut goedkeuren, maar binnen het kader dat ik heb geschetst. Wij verwachten dus dat er in de komende tijd nog stappen kunnen worden gezet, zodat de omkadering klopt en wij de kosten voor het verplichte levensbeschouwelijke onderricht kunnen vermijden. Tijdens de debatten had ik alvast de indruk dat daar in de Kamer niemand op zat te wachten en dat het absoluut moest gaan over kleuterparticipatie en veel minder over de levensbeschouwelijke vakken.

C'est peut-être le moyen de faire des liens dans les débats parlementaires.
Pour ce qui concerne l'obligation scolaire à cinq ans, je pense que les conséquences sont gérables pour les Communautés. Je viens d'écouter presque religieusement M. Wollants. Certes, M. Si les futurs membres de cette Chambre veulent aller plus loin dans l'obligation scolaire, ils ne devront pas oublier la loi de financement de 1989 parce que là, les conséquences matérielles seraient très importantes pour les Communautés.
Je termine sur l'aspect positif. Même si cela a pris des années, je pense que c'est une étape importante pour les Communautés et surtout pour les élèves et pour la lutte contre les inégalités. On sait en effet qu'elles se forment déjà à partir de cinq ans. Plus on ira dans le sens d'une intégration dès la maternelle pour la langue de l'apprentissage, mieux on combattra ces inégalités.

Mijnheer de voorzitter, beste collega's, het N-VA-verhaal over de bescherming van handelaars gaat terug tot 2014. Onze eerste bezorgdheid was eigenlijk de rechtspositie van de landbouwer. Al te vaak bleek dat de landbouwer geconfronteerd werd met oneerlijke handelspraktijken, praktijken die de eerlijke mededinging te buiten gingen.
Via het ketenoverleg deed men wat men kon, maar dat bleek niet voldoende. Een echte publieke stok achter de deur was nodig. Wij vonden die stok achter de deur in het mededingingsrecht. Hoewel dat op Europees niveau is bepaald, bleek het toch een hiaat te bevatten, in die zin dat misbruik van een absolute machtspositie bestraft kon worden, maar misbruik van een relatieve machtspositie niet.
Het Europees recht liet de lidstaten vrij om dit zelf op te nemen in hun rechtsorde. Een communicatie van de Europese Commissie bevestigde dit. Dat was dan ook de oplossing waar de N-VA naar zocht. Zij bood een stok achter de deur zonder evenwel de nodige souplesse eigen aan onze contractvrijheid, die de regio grote rijkdom heeft geschonken, te fnuiken. Bovendien zou de regeling gelden voor alle economische activiteiten en niet enkel voor activiteiten in de agrovoedingsketen. Immers, misbruiken komen overal voor. Deze wet zal dus breder toepasbaar zijn.
Het grote voordeel van het mededingingsrecht was dat niet alleen ervaring geput kon worden uit het Duitse voorbeeld, waar deze regeling al vijftig jaar bestaat, maar dat het toezicht op de regels berust bij een onafhankelijke toezichthouder, zijnde de Mededingingsautoriteit. Hierdoor zouden mogelijk politiek gemotiveerde en door ministers geïnitieerde rechtsvorderingen onmogelijk zijn. Deze zouden immers het investeringsklimaat van ons land kunnen schaden.
In de commissie hebben wij hieraan gewerkt. Door de verschillende fracties werden adviezen in verband met dit voorstel ingewonnen, en er werd een interessante hoorzitting met experts georganiseerd. Zij leerden ons dat ons voorstel juridisch bijgeschaafd kon worden. Dat hebben wij dan ook graag gedaan. Ons motto was immers traag tot een goede regeling komen, veeleer dan snel tot een slechte, waarvan overigens niemand beter wordt.

She offered a sticks at the door, but not the necessary flexibility inherent in our freedom of contract, which has given great wealth to the region. Furthermore, the scheme would apply to all economic activities and not only to activities in the agro-food chain. Abuse is everywhere. This law will be more broadly applicable.
The great advantage of competition law was that it could not only draw experience from the German example, where it has existed for fifty years, but that the supervision of the rules rests with an independent supervisory authority, namely the Competition Authority. This would potentially make political-motivated and ministerial-initiated lawsuits impossible. This could damage the investment climate in our country.
We have worked on this in the committee. The various political groups received opinions on this proposal, and an interesting hearing with experts was organised. They taught us that our proposal could be legalized. We have therefore liked to do so. After all, our motto was slowly to get to a good arrangement, rather than quickly to a bad one, of which, by the way, no one gets better.

Dat de regering-Michel I kort daarop werkte aan een wetsontwerp rond de B2B-bescherming, konden wij alleen maar toejuichen. Dat betekende immers dat de problematiek een hogere politieke prioriteit had gekregen en dat een beter draagvlak voor een oplossing zou gevonden worden.
Dat brengt ons tot vandaag. Het wetsontwerp kan door de val van de regering het levenslicht niet meer zien, maar kent als het ware zijn wedergeboorte onder de vorm van een omvangrijk amendement.
Uit het bereikte resultaat blijkt dat de hoorzittingen een interessante voedingsbodem waren. Niet alleen wordt het misbruik van economische afhankelijkheid gesanctioneerd, maar ook wordt verduidelijkt welke bedingen en praktijken in een contractuele relatie echt niet door de beugel kunnen en desnoods van overheidswege gesanctioneerd moeten worden. Ter zake moet onder de overheid overigens niet alleen de Mededingingsautoriteit of de Economische Inspectie worden begrepen; het kan net zo goed een rechter zijn. De ontworpen bepalingen zijn van openbare orde. Niemand kan ervan afwijken. De rechter moet ze ambtshalve inroepen. Door het werk van de regering-Michel I zal hij dat overigens ook kunnen doen wanneer het probleem hem via een collectieve vordering bereikt. Ook dat werd door de regering met de N-VA mogelijk gemaakt.
Collega's, u kunt zich afvragen of voorliggend wetsvoorstel perfect is. Het zou naïef zijn op deze vraag bevestigend te antwoorden. Geen enkele regeling zal ooit perfect zijn; misbruiken zullen altijd voorkomen, net zoals regels altijd zullen kunnen worden bijgeschaafd.
De materie zal aandachtig moeten worden opgevolgd. Het is dan ook goed dat wij in de wet een verplichte evaluatie hebben opgenomen. Tevens is het aangewezen dat zowel de Mededingingsautoriteit als de FOD Economie richtlijnen uitvaardigt die bedrijven en rechtspractici duidelijk moeten maken hoe zij de nieuwe regels in de praktijk moeten aanwenden.
Ik geef een paar concrete voorbeelden.
Incoterms zijn door de Verenigde Naties opgestelde regels die het transportrecht regelen. Honderden bedrijven maken er dagelijks gebruik van. Er zou dan ook moeten worden verduidelijkt dat de regels als lex specialis buiten de scope van het wetsvoorstel vallen.

Colleagues, you may wonder whether the present bill is perfect. It would be naive to answer this question affirmatively. No arrangement will ever be perfect; abuses will always occur, just as rules will always be applied.

It is also appropriate that both the Competition Authority and the FOD Economie issue guidelines that should make it clear to companies and legal practitioners how to apply the new rules in practice.
I will give a few concrete examples.
Incoterms are United Nations rules that regulate the right of transport. Hundreds of companies use it every day. It should therefore be clarified that rules such as lex specialis fall outside the scope of the bill.

Monsieur le président, notre groupe était désireux de mettre en place une législation visant à mieux protéger les indépendants et les PME dans le cadre des relations inter-entreprises et à lutter contre les pratiques déloyales et les abus de dépendance économique. Nous visions en particulier les petits producteurs dans le secteur agroalimentaire mais aussi d'autres métiers comme les garagistes ou les indépendants dans le secteur automobile, qui font souvent face au rouleau compresseur des grandes marques à l'étranger.
Dans notre esprit, une telle législation doit également profiter de manière indirecte au consommateur. C'est pourquoi nous avons introduit l'an dernier une proposition de loi visant deux objectifs: d'une part, permettre à l'Autorité belge de la Concurrence d'agir en cas d'exploitation abusive par une entreprise ou un groupe d'entreprises de l'état de dépendance économique d'une entreprise cliente ou d'un fournisseur et, d'autre part, permettre aux entreprises qui sont en état de dépendance économique et qui subissent des pratiques restrictives de leur partenaire commercial d'introduire une action devant les tribunaux ordinaires.
Notre proposition s'inspire de ce qui existe en France et qui crée un pouvoir pour le ministre de l'Économie d'agir en cessation contre de tells pratiques déloyales.
Je souligne qu'un travail important a été réalisé en commission. Nous avons réalisé des auditions, nous avons rencontré des organisations et institutions ainsi que des universitaires. Finalement, le texte consensuel qui a été adopté cadre parfaitement avec ce que notre groupe réclamait. Le texte élargit les pouvoirs de l'Autorité belge de la Concurrence lorsqu'il y a manifestement un abus de la part d'un opérateur mais que cet opérateur n'a pas une position dominante. Le texte offre également aux indépendants et petites entreprises des droits comparables à ceux des consommateurs pour mieux se défendre contre les pratiques déloyales, agressives ou trompeuses de grandes entreprises.
Un petit bémol: les services financiers des banques et assurances sont exclus du champ d'application des dispositions en matière de clauses abusives. C'est pour nous un point d'attention. Il faudra y remédier, notamment pour mieux défendre les agents indépendants face aux bancassureurs.
Quoiqu'il en soit, nous pensons que ces mesures vont apporter une bouffée d'oxygène aux indépendants et aux petites et moyennes entreprises qui subissent trop souvent des abus de domination ou des pratiques déloyales de leur partenaire commercial dominant.

Mr. Speaker, our group was eager to introduce legislation to better protect self-employed persons and SMEs in business relations and to combat unfair practices and abuse of economic dependence. We specifically targeted small producers in the agri-food sector but also other professions such as garage owners or self-employed workers in the automotive sector, who often face the compressor roll of major brands abroad.
In our mind, such legislation must also indirectly benefit the consumer. That is why we introduced a bill last year aimed at two objectives: on the one hand, allowing the Belgian Competition Authority to act in case of abuse by a company or group of companies of the state of economic dependence of a client or supplier and, on the other hand, allowing companies that are in a state of economic dependence and who are subject to restrictive practices from their business partner to bring a lawsuit before ordinary courts.
Our proposal is inspired by what exists in France and which creates a power for the Minister of Economy to act with cessation against unfair practices.
I would like to point out that a lot of work has been done in the committee. We conducted hearings, we met with organizations and institutions as well as academics. Finally, the consensus text that was adopted fits perfectly with what our group demanded. The text extends the powers of the Belgian Competition Authority when there is obvious abuse on the part of an operator but that operator does not have a dominant position. The text also gives independent ⁇ and small ⁇ rights comparable to those of consumers to better defend themselves against unfair, aggressive or deceptive practices by large companies.
A small drawback: banking and insurance financial services are excluded from the scope of the provisions on unfair clauses. This is a point of attention for us. This needs to be addressed, in particular to better defend independent agents against bank insurers.
In any case, we believe that these measures will bring a blow of oxygen to self-employed individuals and small and medium-sized enterprises who too often suffer from abuse of dominance or unfair practices from their dominant business partner.

C'est dans cet esprit que nous examinons ce texte portant sur l'abus de position dominante. Les mesures introduites par ce texte auront un impact positif sur les relations contractuelles et permettront d'atteindre les objectifs suivants: encourager la liberté d'entreprendre, renforcer le droit de la concurrence, rétablir les rapports de force déséquilibrés vers des rapports égaux, dénoncer les abus de certaines entreprises et fournisseurs, soutenir les indépendants et PME.
En effet, un des points d'attention de ce texte est de protéger les PME. Celles-ci se trouvent souvent contraintes à accepter des conditions contractuelles et cela en raison d'abus de position venant d'entreprises oligopolistiques. Ce déséquilibre contractuel n'est pas sans conséquence pour ces PME puisqu'à terme et dans certains cas, il peut conduire l'employeur à la perte de son entreprise. Dorénavant, ceux qui continueront à user de clauses abusives ou qui se rendront coupables d'abus de dépendance économique seront sanctionnés.
Chers collègues, je tiens aussi à rappeler que cette démarche législative n'est pas propre à notre pays. Différents États membres de l'Union européenne, dont l'Allemagne, l'Autriche, la France et l'Italie, ont aussi décidé d'aborder cette problématique et de recourir à de nouvelles législations pour y remédier.
Pour mon groupe, l'amélioration de la protection des entreprises et particulièrement des PME est une priorité absolue, raison pour laquelle nous soutenons ces mesures et vous invitons à voter en faveur de ce texte.

One of the main objectives of this document is to protect SMEs. These are often forced to accept contractual terms and conditions due to abuse of position from oligopolistic companies. This contractual imbalance is not without consequences for these SMEs since in the long run and in some cases, it can lead the employer to the loss of his business. From now on, those who continue to use abusive clauses or who become guilty of abusing economic dependence will be punished.
I would also like to remind you that this legislative approach is not proper to our country. Different Member States of the European Union, including Germany, Austria, France and Italy, have also decided to address this problem and to use new legislation to address it.
For my group, improving the protection of ⁇ and especially SMEs is an absolute priority, which is why we support these measures and invite you to vote in favour of this text.

Wij waren reeds een aantal jaren vragende partij om naast deze voor consumenten ook een degelijke bescherming te kunnen bieden aan ondernemingen, vooral aan kleinere ondernemingen wanneer zij handelen met grote ondernemingen.
De relatie tussen ondernemingen wordt soms gekenmerkt door een onevenwicht in het nadeel van één onderneming, vaak de kleine onderneming met heel wat minder macht dan de andere. Soms is het ook moeilijk opboksen tegen grote leveranciers, die de economische afhankelijkheid van kleine zelfstandigen gebruiken of misbruiken. Zeker dan is deze B2B-bescherming een belangrijke stap vooruit voor vele kleine zelfstandigen.
In het voorstel is de Belgische Mededingingsautoriteit aangeduid om te kunnen optreden tegen ondernemingen die de economische afhankelijkheid misbruiken tegenover andere ondernemingen. Daarnaast pakt het voorstel ook onevenwichtige contracten en agressieve en misleidende marktpraktijken aan.
Het voorstel en de vraag naar een goede B2B-bescherming gaat reeds mee van in het begin van deze legislatuur en stond ook in de beleidsbrieven van minister Peeters. Minister Peeters heeft een regeling voorbereid en uitgeschreven die tot in de puntjes werd overlegd, zowel met de sector van de grote ondernemingen als met deze van de kleine ondernemingen.
Nu wij aan het einde van de legislatuur gekomen zijn en ondertussen in lopende zaken zijn, hebben wij het werk dat minister Peeters en zijn kabinet hadden verricht meegenomen in de vorm van amendementen op het voorstel van N-VA. Zo hebben wij samen verder gewerkt aan een voorstel van N-VA om tot een mooi werkstuk te komen, en kunnen wij die B2B-bescherming voor ondernemingen eindelijk invoeren.

In the proposal, the Belgian Competition Authority is designated to be able to take action against companies that abuse their economic dependence on other companies. The proposal also addresses unbalanced contracts and aggressive and misleading market practices.
The proposal and demand for a good B2B protection has been present since the beginning of this legislature and was also included in the policy letters of Minister Peeters. Minister Peeters has prepared and issued a regulation that has been discussed to the end, both with the sector of the large enterprises and with the sector of the small enterprises.
Now that we have reached the end of the legislature and are in progress, we have taken into account the work that Minister Peeters and his cabinet had done in the form of amendments to the proposal of N-VA.
