Het is niet zonder belang dat wij met dit stuk wetgeving de Belgische wetgeving conform maken met het WIPO-verdrag. WIPO staat voor World Intellectual Property Organisation. Niet alleen conform daarmee, maar ook conform met de actualisering van het EU-octrooiverdrag, betreden wij een tijdperk van harmonisering, dat volledig past in het raam van de belangrijke inspanningen die België tijdens het Europese voorzitterschap heeft geleverd om ervoor te zorgen dat wij in het Avondland in Europa een regio kunnen zijn waar octrooien vlot ingediend kunnen worden en waar innovatie en ontwikkeling het daglicht kunnen zien, zonder in oeverloze administratieve rompslomp gestremd te worden.
Het is niet alleen een formele vereenvoudiging, maar het zal ook de elektronische indiening en behandeling mogelijk maken. Voor de eerste maal sinds 1984 kunnen wij, met de harmonisering en de vereenvoudiging die thans worden doorgevoerd, een doorbraak van die omvang realiseren. Daarom hoop ik dat u massaal dit wetsontwerp met ons zal steunen.

Monsieur le président, monsieur le ministre, chers collègues, je voudrais dire quelques mots sur cet important projet de loi.
Je voudrais revenir sur la discussion que nous avions eue, monsieur le ministre, sur la manière dont notre politique de propriété intellectuelle peut contribuer au développement des technologies vertes, qu'il s'agisse de l'énergie des déchets, du traitement de l'eau. Le groupe Ecolo-Groen! a déposé trois amendements visant à introduire dans notre droit une procédure de traitement accéléré de ces dossiers afin d'obtenir un brevet de manière plus rapide pour les innovations dans le secteur de la protection de l'environnement.
Ces amendements ont été rejetés. Vous avez motivé vos objections par une procédure qui n'est pas très longue en Belgique (en moyenne 18 mois) et qui est assez simple. Vous avez donc estimé que les amendements n'étaient pas pertinents. J'ai rappelé que dans certains pays, notamment aux États-Unis, en Grande-Bretagne, – la réflexion est même en cours au sein de l'Union européenne –, des procédures fast track (des procédures accélérées) d'obtention de brevets pour les technologies environnementales étaient mises en oeuvre. J'ai cité l'exemple notamment de la Grande-Bretagne où le délai d'obtention du brevet est réduit à neuf mois.
Je voulais donc revenir en plénière sur cet élément qui nous semble important. Si on est d'accord de dire que la politique de propriété intellectuelle a une influence sur la diffusion des innovations, sur leur développement, leur mise sur le marché et leur mise à disposition des utilisateurs, on doit aussi admettre que c'est le cas en particulier pour les technologies environnementales.
Je souhaitais donc encourager l'Office de propriété intellectuelle, l'administration et vous-même, monsieur le ministre, à poursuivre les efforts pour que, même en dehors du cadre qui sera voté aujourd'hui, on puisse envisager des expériences concrètes de fast track pour les technologies environnementales. Ne soyons pas les derniers à entrer dans cette voie qui a été empruntée par plusieurs pays. Je souhaite que l'Office de propriété intellectuelle évalue cette procédure en cours dans d'autres pays pour, le cas échéant, l'envisager et la mettre en œuvre en Belgique.

I would like to return to the discussion we had, Mr. Minister, on how our intellectual property policy can contribute to the development of green technologies, whether it is energy from waste, water treatment. The Ecolo-Groen group! has submitted three amendments aimed at introducing in our law a procedure for accelerated processing of these files in order to obtain a patent in a faster manner for innovations in the environmental protection sector.
These amendments were rejected. You motivated your objections with a procedure that is not very long in Belgium (average 18 months) and which is quite simple. He said the amendments were not relevant. I recalled that in some countries, notably in the United States, in Great Britain, – the reflection is even ongoing within the European Union –, fast-track procedures (accelerated procedures) for obtaining patents for environmental technologies were implemented. I cited the example of Britain in particular, where the deadline for obtaining a patent is reduced to nine months.
Therefore, I would like to return to the plenary on this element which we consider important. If one agrees that the intellectual property policy has an influence on the dissemination of innovations, their development, their placing on the market and their making available to users, one must also admit that this is ⁇ the case for environmental technologies.
I would therefore like to encourage the Office of Intellectual Property, the administration and you, Mr. Minister, to continue their efforts so that, even outside the framework that will be voted today, concrete fast track experiments for environmental technologies can be considered. Let us not be the last to enter this path that has been taken by several countries. I would like the Office of Intellectual Property to evaluate this ongoing procedure in other countries to, if necessary, consider it and implement it in Belgium.

Mijnheer de voorzitter, collega’s, in het licht van de bespreking die we gevoerd hebben over het wetsontwerp betreffende de procedure inzake de indiening van de Europese octrooiaanvragen, is het naar mijn mening toch nodig even ons betoog en ons amendement toe te lichten.
Het gaat namelijk over een heel belangrijke kwestie. We spreken over het octrooi of patent dat voor vele ondernemingen een belangrijk instrument is, hetzij om vast te leggen welke octrooiaanvragen ze hebben gerealiseerd, hetzij om hun innovatie-inspanningen te richten op basis van bestaande octrooien.
In ons land vindt slechts 10 % van de export plaats op basis van sterke patenten, terwijl dat voor de andere Europese landen ongeveer 20 % bedraagt. De waarde van een innovatieve onderneming wordt dus in grote mate bepaald door haar octrooirechten. Indien een bedrijf een verkeerd gerichte inspanning zou leveren, kan dat verhoogde kosten en tijdverlies met zich meebrengen. We moeten er dus voor zorgen dat de drempel om een octrooi te verwerven en te bestuderen voor KMO’s zo laag mogelijk ligt.
Het Europees octrooi zou sowieso beschikbaar zijn in het Engels, Duits en Frans, indien daarover een akkoord tot stand komt binnen de versterkte samenwerking in Europa. Die regeling biedt dus wellicht soelaas voor de Franstalige ondernemers in België. Om een vlotte toegang tot de Europese databank te verzekeren, is het noodzakelijk dat ruim 70 miljoen Europese octrooidocumenten ook in het Nederlands kunnen worden geraadpleegd. De Vlaamse KMO’s, collega’s, mogen niet in de kou blijven staan.
De N-VA staat dus achter het wetsontwerp, maar heeft in de commissie een belangrijk amendement ingediend, dat voorziet in een vertaalapplicatie naar het Nederlands. Ik citeer kort uit ons amendement: “De Dienst voor de Intellectuele Eigendom stelt tal van technologische diensten ter beschikking die de automatische vertaling van octrooi-informatie mogelijk maken en de verleende Europese octrooien dienen onder gelijke voorwaarden – een zeer belangrijke bepaling – geraadpleegd te kunnen worden in alle nationale talen.”
In ons amendement komen dus twee aspecten aan bod.

In the light of the discussion we have held on the draft law on the procedure for the submission of European patent applications, it is, in my opinion, necessary to explain our discussion and our amendment.
This is a very important issue. We are talking about the patent or patent that is an important tool for many companies, either to record which patent applications they have realized or to focus their innovation efforts on the basis of existing patents.
In our country, only 10 % of exports are based on strong patents, while for other European countries that is about 20 %. Thus, that arrangement may provide soil for the French-speaking entrepreneurs in Belgium. To ensure smooth access to the European database, it is necessary that more than 70 million European patent documents can also be consulted in Dutch. The Flemish SMEs, colleagues, should not remain in the cold.
The N-VA therefore supports the bill, but has submitted an important amendment in the committee, which provides for a translation application into Dutch. I quote briefly from our amendment: “The Intellectual Property Office provides a number of technological services that enable the automatic translation of patent information and the granted European patents should be able to be consulted under equal conditions – a very important provision – in all national languages.”
Therefore, our amendment addresses two aspects.

Ten eerste, dat alle landstalen, dus ook het Nederlands, ingeschreven worden en, ten tweede, dat de digitale toegankelijkheid ook verhoogd wordt.
Voor de Vlaamse KMO’s is het belangrijk dat de Nederlandse vertaalmodule gekoppeld wordt aan de Europese databank Espace.net. Die Nederlandse vertaalmodule is noodzakelijk opdat onze KMO’s hun positie op de internationale markt kunnen handhaven. Niet alleen de taal, maar ook de toegankelijkheid van deze Europese databank wordt in ons amendement onderstreept.
Het wetsontwerp dat de regering op 15 oktober heeft ingediend, houdt volgens ons hiermee niet voldoende rekening. De N-VA is van mening dat de dienstverlening van de Dienst van de Intellectuele Eigendom verder uitgebouwd moet worden, uitgerust moet worden met een online vertaalapplicatie en dat wordt ook in ons amendement voorzien.
Collega’s, raar, maar het amendement werd uiteindelijk goedgekeurd, Vlamingen versus Franstaligen, die zich hebben onthouden. Onze fractie is verheugd dat het amendement en de motivatie op de goedkeuring van alle Vlaamse partijen konden rekenen. Wij betreuren echter de reactie van de Franstalige collega’s. Enkel en alleen omdat het amendement ingediend werd door de N-VA heeft dit tot achterdocht geleid en bijwijlen zelfs lichte paranoia. In de plaats van het amendement op zijn merites te beoordelen en het belang van alle landstalen te erkennen in dit wetsontwerp, hebben de Franstalige partijen zich onthouden. Voor de Nederlandstalige ondernemers werd die steun niet gegund. Het is blijkbaar bon ton om mee te doen aan de Bartofobie of de N-VA-fobie en te schieten op de auteur, in de plaats van de inhoud te lezen.

Mijnheer de voorzitter, collega’s, heren ministers, het octrooirecht maakt al jaren het onderwerp uit van besprekingen in de commissie voor het Bedrijfsleven.
Het Vlaams Belang heeft daarin steeds het respect voor de taalwetten verdedigd en het gebruik van het Nederlands, zowel in de octrooiaanvraag, mijnheer de minister, als bij het octrooi zelf. U zult zich dat zeker herinneren. Ik heb daarover verschillende mondelinge vragen gesteld.
Geachte collega’s, het Vlaams Belang heeft zich niet tegen dit wetsvoorstel verzet. Naar aanleiding van dit wetsvoorstel ben ik in de commissie voor het Bedrijfsleven nog tussenbeide gekomen, meer bepaald naar aanleiding van de kwestie van het vestigen van de datum van de octrooiaanvraag. U herinnert zich dat. Het indienen van de beschrijving of een deel van de octrooiaanvraag mocht in uw wetsontwerp in elke mogelijke taal gebeuren, als er achteraf een vertaling op kosten van de octrooiaanvrager zou gebeuren.
Het dossier is maar volledig als de vertaling is gebeurd. Dat hebt u verklaard in de commissie voor het Bedrijfsleven. Ik herhaal uw woorden: “Het dossier zal pas worden behandeld na vertaling. De volledige octrooiaanvraag moet worden vertaald. De kosten zijn voor rekening van de aanvrager.” U hebt verder ook verklaard: “De aanvraag na een bepaalde tijd moet in een van de landstalen worden vertaald, teneinde de wetten op het gebruik van de talen in bestuurszaken in acht te nemen.”
Mijnheer de minister, dit waren voor ons belangrijke garanties, die dan nog werden aangevuld met het amendement van de N-VA met betrekking tot de automatische vertaalmachine van de Europese Commissie, een amendement waar alle Vlaamse partijen zich achter hebben geschaard.
Het valt dan ook zeer te betreuren, en het tekent de kracht van de nieuwe meerderheid die aan het komen is, dat de Franstalige partijen zich tegen dit amendement hebben verzet. U was erbij, mijnheer de minister. U hebt dat betreurd, samen met ons.

It is therefore very regrettable, and it signals the strength of the new majority that is coming, that the French-speaking parties have opposed this amendment. You were there, Mr. Minister. You regretted that, along with us.

Ik zal niet verwijzen naar alles wat er in de commissie is gezegd maar ik ga kort even in op het amendement. De regering heeft zich bij monde van mij achter het amendement geschaard. Het amendement zegt duidelijk dat het gaat over een Europees systeem dat binnen ons Europees voorzitterschap is opgestart, met name het Europees octrooibureau dat zal zorgen voor automatische vertaling, onder meer ook naar het Nederlands. Het is belangrijk dat dit gebeurt omdat wij op die manier ook steun kunnen krijgen van heel wat lidstaten in het dossier van het eengemaakt EU-octrooi.
U weet dat wij met ons voorzitterschap in dat dossier een heel belangrijke doorbraak hebben gerealiseerd. Vandaag zijn er maar liefst twaalf landen die uitdrukkelijk de versterkte samenwerking steunen. Dat zal na nieuwjaar behandeld worden in het Europees Parlement en dan opnieuw op de Europese Raad komen. Ik meen dat wij dan uiteindelijk een Europees patent zullen bekomen. Aan dat patent is dan ook de automatische vertaling gekoppeld, ook naar het Nederlands.
In die zin meen ik dat het amendement terecht is en dat het door de voltallige regering, in al haar geledingen, wordt gesteund.

Mijnheer de voorzitter, mijnheer de minister, collega’s, het voorliggend wetsontwerp zet de richtlijnen 2008/8/EG, 2009/69/EG en 2009/162/EU van de Raad van de Europese Unie geheel of gedeeltelijk om in intern fiscaal recht.
De omzetting van de richtlijn 2008/8/EG van de Raad van 12 februari 2008, tot wijziging van de richtlijn 2006/112/EG, wat betreft de plaats van een dienst, heeft enkel betrekking op artikel 3 van deze richtlijn en betreft de plaatsbepaling van diensten die bestaan in het verlenen van toegang tot culturele, artistieke, sportieve, wetenschappelijke, educatieve vermakelijkheid of soortgelijke activiteiten en van toegang tot samenhangende diensten.
De tweede omzetting is de omzetting van de richtlijn 2009/162/EU van de Raad van 22 december 2009 tot wijziging van enkele bepalingen van de richtlijn 2006/112/EG betreffende het gemeenschappelijk stelsel van belasting over de toegevoegde waarde. Deze omzetting beoogt drie zaken.
Ten eerste, wil men de bijzondere regeling die van toepassing is op de invoer en de plaats van belastingheffing op leveringen van aardgas uitbreiden tot eender welk op het grondgebied van de Gemeenschap gesitueerd aardgassysteem of eender welk op een dergelijk systeem aangesloten net.
Ten tweede, beoogt men de specificiteit van de voorrechten en immuniteiten van de Europese Gemeenschappen te benadrukken als rechtsgrondslag voor de vrijstelling van btw verleend aan de Gemeenschappen en aan sommige instanties en organen van de Gemeenschappen.
Ten derde, wil men de regels inzake aftrek beperken wanneer de uitgaven met betrekking tot onroerende goederen en bedrijfsmiddelen die toebehoren aan het vermogen van de onderneming van de belastingplichtige, omdat zij niet uitsluitend voor zijn economische activiteit worden aangewend.
De laatste omzetting is de gedeeltelijke omzetting van de richtlijn 2009/69EG van de Raad van 25 juni 2009 tot wijziging van de richtlijn 2006/112EG betreffende het gemeenschappelijke stelsel van belasting over de toegevoegde waarde wat betreft belastingfraude bij invoer. Deze richtlijn legt een aantal minimumvoorwaarden vast voor de toepassing van de vrijstelling van de btw bij invoer van goederen die na invoer worden geleverd aan of overgebracht naar een belastingplichtige in een andere lidstaat.
Voormelde richtlijnen moeten in intern recht worden omgezet met uitwerking op 1 januari 2011. Bij de algemene bespreking van dit wetsontwerp waren er vooral tussenkomsten bij artikel 3. Uit dit artikel blijkt dat de levering van elektriciteit geen accijnsgoed is voor de btw. Bij de artikelen 6 en 12 van het wetsontwerp waren er ook een aantal bemerkingen.
Een aantal commissieleden, zoals collega’s Arens, Bogaert, Gerkens en ikzelf, merkten op dat de herziening van de btw-aftrek van bedrijfsmiddelen wel zeer complex is. De memorie beperkt zich door weer te geven dat het gaat om een eenvoudige technische aanpassing, terwijl er een hele technisch-juridische problematiek achter schuilt. De vraag was dan ook hoe de belastingadministratie hiermee zal omgaan. Het is voor gedecentraliseerde diensten niet altijd duidelijk hoe een nieuwe fiscale wetgeving moet worden geïnterpreteerd. De nieuwe regeling treedt al in werking vanaf 1 januari 2011.
De staatssecretaris benadrukte dat de belastingadministratie instructies zal ontvangen voor de toepassing van de nieuwe regeling, vervat in artikel 45, § 1quinquies van het btw-Wetboek. Het is van belang dat de lokale belastingdiensten zo snel mogelijk duidelijke instructies krijgen over hoe deze nieuwe regels moeten worden geïnterpreteerd.
Daarnaast werd ook de vraag gesteld waarom België gebruik maakt van de keuzemogelijkheid in de richtlijn om het recht op aftrek niet alleen te beperken tot de onroerende goederen, maar deze ook toe te passen op een roerend bedrijfsmiddel behorend tot het vermogen van de onderneming, dat zowel voor economische als andere doeleinden wordt aangewend. Deze vraag bleef feitelijk onbeantwoord.

The bill transposes, in whole or in part, the Directives 2008/8/EC, 2009/69/EC and 2009/162/EU of the Council of the European Union into domestic tax law.
The transposition of Council Directive 2008/8/EC of 12 February 2008 amending Directive 2006/112/EC as regards the location of a service relates only to Article 3 of that directive and relates to the location of services consisting of providing access to cultural, artistic, sports, science, educational entertainment or similar activities and access to interconnected services.
Council Directive 2009/162/EU of 22 December 2009 amending certain provisions of Directive 2006/112/EC on the common system of value added tax. This conversion aims at three things.
First, it aims to extend the special regime applicable to imports and the place of taxation on natural gas supplies to any natural gas system located within the territory of the Community or to any network connected to such a system.
Second, it aims to highlight the specific nature of the privileges and immunities of the European Communities as the legal basis for the exemption from VAT granted to the Communities and to certain bodies and bodies of the Communities.
Third, it is intended to limit the rules on deduction when the expenditure relating to real estate and business assets belonging to the assets of the taxpayer’s undertaking, because they are not used exclusively for his economic activity.
Council Directive 2009/69/EC of 25 June 2009 amending Directive 2006/112/EC on the common system of value added tax in respect of import tax fraud. This Directive lays down a number of minimum conditions for the application of the exemption from VAT on imports of goods delivered after import to or transferred to a taxable person in another Member State.
These Directives should be transposed into national law with effect from 1 January 2011. During the general discussion of this draft law, there were mainly interventions in Article 3. This article shows that the supply of electricity is not an excise good for VAT. Articles 6 and 12 of the draft law also included a number of observations.
A number of committee members, such as colleagues Arens, Bogaert, Gerkens and myself, noted that the revision of the VAT deduction of business assets is very complex. The memory limits itself by reflecting that it is a simple technical adjustment, while behind it lies a whole technical-legal problem. The question is how the tax administration will deal with this. For decentralized services, it is not always clear how new tax legislation should be interpreted. The new system comes into effect from 1 January 2011.
The Secretary of State stressed that the tax administration will receive instructions for the application of the new scheme, contained in Article 45, § 1quinquies of the VAT Act. It is important that local tax authorities receive clear instructions as soon as possible on how these new rules should be interpreted.
In addition, it was also asked why Belgium uses the option provided for in the Directive to limit the right of deduction not only to the real estate, but also to apply it to a movable asset belonging to the assets of the undertaking, which is used for both economic and other purposes. This question actually remained unanswered.
