Les discussions en commission ont été menées de manière très constructive, ce dont nous nous félicitons également.

Je tiens à préciser que nous avions déposé, en commission, un amendement qui a été adopté et qui visait à adapter la proposition initiale dans la mesure où nous souhaitions que le conjoint aidant ayant une activité accessoire puisse garder le statut précité mais sans exclure cette activité accessoire de la notion d'activité professionnelle. Il me semblait important de le souligner.

                    Mijnheer de voorzitter, mevrouw de minister, collega’s, ik wil het nog even hebben over dit wetsvoorstel dat heel snel werd behandeld in de commissie. Het ging heel vlot, misschien zelfs te vlot: ik vrees dat er te weinig werd nagedacht over de gevolgen.

Op zich is het positief, maar aan de andere kant wordt inzake het statuut van de meewerkende echtgenote in dit wetsvoorstel het mogelijk gemaakt om naast als meewerkende echtgenote ook nog als zelfstandige een activiteit uit te oefenen, weliswaar beperkt tot 3 000 euro per jaar qua inkomsten. In dat geval behoudt men het statuut van meewerkende echtgenote. Wij hebben daar enkele bedenkingen bij. Hier zal nu worden gestemd over een wetsvoorstel waarbij een algemene regel wordt geïnstalleerd ten bate van een heel specifieke en beperkte doelgroep, met name de landbouw. In het wetsontwerp maakt men enkel melding van voorbeelden uit de landbouwsector. Wij hebben in de commissie specifiek naar andere praktijkvoorbeelden uit andere sectoren gevraagd, maar het antwoord hierop bleef uit. Wij gaan er daarom van uit dat dit te beperkt is: wij gaan niet akkoord dat er wetten worden goedgekeurd voor één bepaalde sector. Beter behouden wij het algemeen overzicht.

Voor ons blijft de vraag wat het effect is indien er toch andere sectoren bij zouden worden betrokken. Kunnen die ook meegenieten? Zijn er in het wetsvoorstel waarborgen ingebouwd om te verhinderen dat er oneigenlijk gebruik wordt gemaakt van deze gunstmaatregel? Ook die vragen bleven onbeantwoord. Eigenlijk ligt de lakmoesproef van deze wet in de handhaving. Welke instantie zal zich bekommeren over de controles op het aangegeven bedrag aan zitpenningen? Het mag niet meer dan 3 000 euro zijn, maar betekent dat niet een hele administratieve last met bijkomende administratieve kosten voor de federale overheid voor deze beperkte maatregel?

Wij dachten dat het basisprincipe van deze wet in eerste instantie het bevorderen van de werkgelegenheid of het steunen van het ondernemerschap was, maar wij kunnen ons niet van de indruk ontdoen dat men eigenlijk het maatschappelijk engagement ondersteunt.

It may not exceed 3 000 euros, but does not mean a whole administrative burden with additional administrative costs for the federal government for this limited measure?

We thought that the basic principle of this law was initially the promotion of employment or the support of entrepreneurship, but we cannot get rid of the impression that one actually supports social engagement.

                    Dat is uiteraard prima, maar wij mogen niet vergeten dat maatschappelijk engagement eerder vrijwilligerswerk is en dat geldelijke middelen of monetaire drijfveren daaraan ondergeschikt zouden moeten zijn.

Een volgende opmerking is dat wij de realiteit van vandaag onder ogen moeten zien. Heel wat meewerkende echtgenoten zijn onderworpen aan het volledig sociaal statuut, het maxistatuut, en betalen dus bijdragen zoals een zelfstandige in hoofdberoep.

Meewerkende echtgenoten die geboren zijn vóór 1 januari 1956, zij zijn nu dus 57 en 58 jaar oud, zijn aan een ministatuut onderworpen. Ook zij kunnen, als ze dat wensen, zich vrijwillig onderwerpen aan het volledig maxistatuut van het sociaal statuut der zelfstandigen.

Wij vragen ons af in hoeverre er nu een reële nood is om deze cumul te organiseren. Vandaag hebben heel wat meewerkende echtgenoten in de feiten een sociaal en fiscaal statuut van zelfstandige in hoofdberoep, net omdat ze zich willen verzekeren van een volledige dekking van hun sociale zekerheden.

Ik denk dat u als minister tijdens de bespreking in de commissie ook zelf hebt opgemekt dat de beoogde doelgroep wel zeer beperkt is en ook dalend is in aantal. Is het dan niet beter om de resterende meewerkende echtgenoten gewoon te stimuleren om naar het maxistatuut over te stappen en dus een volledige dekking te krijgen?

De grens van 3 000 euro lijkt ons nogal arbitrair vastgesteld te zijn. Wij hebben nergens een gemotiveerde uitleg gekregen waarom dit 3 000 euro is en geen 2 800 euro, 4 000 euro of een ander bedrag. Ook op onze vraag in de commissie werd geen antwoord gegeven.

Ik wil afsluiten met een algemene beschouwing. In dit Parlement moeten wij ons niet bezighouden met wetgeving die de realiteit eigenlijk achterna holt en die bepalingen introduceert waar zich in de realiteit al een evolutie doorzet.

Wij ondersteunen volmondig maatregelen ter creatie van de werkgelegenheid en ter ondersteuning van het ondernemerschap, maar dit gesleutel aan het statuut van een meewerkende echtgenote heeft dat niet tot doel. Het is een gemiste kans om het statuut van de meewerkende echtgenote, dat inderdaad voor verbetering vatbaar is, echt aan te pakken.

I would like to conclude with a general consideration. In this Parliament we should not be concerned with legislation that actually follows reality and introduces those provisions where in reality an evolution is already ongoing.

We fully support measures to create employment and to support entrepreneurship, but this key to the status of a co-working spouse does not have that purpose. It is a missed opportunity to truly address the status of the co-working spouse, which is indeed subject to improvement.

De indieners van het voorliggend wetsvoorstel willen de onrechtvaardigheid wegwerken waarbij 38 000 mensen met het statuut van meewerkende echtgenote geen enkel engagement kunnen opnemen en er zelfs geen vergoeding voor mogen krijgen zonder hun statuut kwijt te spelen. Wij vinden dit totaal onrechtvaardig. Met dit wetsvoorstel willen wij dat opgelost zien.

                    Mijnheer de voorzitter, beste collega’s, sinds januari 2003 is het nieuw sociaal statuut van de meewerkende echtgenote van toepassing. De invoering van dat statuut was een eerste stap in de erkenning van de meewerkende echtgenote.

Sindsdien zijn meewerkende echtgenotes verplicht zich aan te sluiten voor het ministatuut. Zij worden verzekerd voor arbeidsongeschiktheid, invaliditeit en moederschap. Sinds 2005 zijn meewerkende echtgenoten, man of vrouw, geboren na 1955 verplicht zich aan te sluiten voor het maxistatuut. Naast arbeidsongeschiktheid, invaliditeit en moederschap werd het statuut uitgebreid met pensioen, gezinsbijslagen en gezondheidszorg.

Het statuut van de meewerkende echtgenote kan enkel worden verkregen als men de partner is van een zelfstandige en hem effectief helpt op regelmatige basis en minimum 90 dagen per jaar. Men mag daarnaast niet over eigen inkomsten beschikken uit een andere beroepsactiviteit of een vervangingsinkomen hebben. In de praktijk zien wij dat dit laatste element zeer restrictief is.

Het wetsvoorstel staat de meewerkende echtgenote toe om haar statuut te behouden als zij zich maatschappelijk en sociaal wil engageren. In ruil hiervoor ontvangt zij een beperkte inkomst, namelijk 3 000 euro per jaar.

Werknemers die zich sociaal engageren verliezen hun statuut niet, zoals mijn collega daarnet heeft gezegd. Daarom moet dat ook mogelijk zijn voor meewerkende echtgenotes. Het sociaal aspect staat hier duidelijk voorop, niet het winstgevende aspect. Daarom heeft de minister besloten om het bedrag van 3 000 euro bewust laag te houden. Meewerkende echtgenotes kunnen via het wetsvoorstel bijvoorbeeld deelnemen aan een vergadering in een groente- of fruitveiling en hiervoor een zitpenning ontvangen, maar het gaat even goed over de bakkers- of beenhouwersvrouw die een engagement opneemt. Op een totaal van 38 000 meewerkende echtgenotes zijn er immers slechts 10 000 actief in de land- en tuinbouw.

Met het wetsvoorstel wordt een nieuwe stap gezet om het statuut van de meewerkende echtgenote te verbeteren. Naast het voorliggend wetsvoorstel wil CD&V ook ijveren voor een verdere verbetering van het statuut. In de komende maanden willen wij daarover concrete voorstellen formuleren en overleg plannen. De huidige wetgeving leidt voornamelijk op het vlak van de pensioenvorming voor de meewerkende echtgenote tot ongewenste neveneffecten. Wij komen daar later graag op terug.

Co-working spouses can, for example, participate in a meeting in a vegetable or fruit dealer through the bill and receive a seat penny for this, but it is equally true for the baker or bone-working woman who takes a commitment. In fact, out of a total of 38 000 cooperating spouses, only 10 000 are active in agriculture and horticulture.

The bill is a new step in improving the status of the cooperating spouse. In addition to the present bill, CD&V also wants to strive for a further improvement of the statute. In the coming months we want to formulate concrete proposals on this subject and plan consultations. The current legislation leads to undesirable side effects mainly in the field of pension formation for the co-working spouse. We will be happy to return to that later.

                    Mijnheer de voorzitter, met deze wet wil men een DNA-databank voor vermiste personen invoeren, met de nodige waarborgen voor de privacy, wat belangrijk is. Deze wet schrijft zich ook in de filosofie van de nieuwe DNA-wet in. Tot daar geen probleem.

Dit is een wetsvoorstel van senator Faes, dat reeds in de Senaat werd goedgekeurd en in de Kamer werd hernomen na amendering door de regering, zij het in overleg met senator Faes, wat ten zeerste wordt geapprecieerd. Als het goed is, zeggen wij het ook. Er was een constructieve houding en dat kunnen wij alleen maar fijn vinden.

Dit voorstel werd gedragen door meerderheid en minderheid, wat aantoont dat dit een belangrijk voorstel is met een belangrijke insteek.

Waarom is deze databank voor vermiste personen zo belangrijk? Iedereen zal zich nog wel de verdwijning in 1996 van Liam Vanden Branden herinneren, toen amper twee jaar. Zulke pijnlijke momenten van hoop, ongerustheid en vrees kunnen nu worden vermeden. Dankzij deze databank kan men nu in alle discretie nakijken of het al dan niet om een vermiste persoon gaat. Men moet de familie, die bang en ongerust is, niet langer verontrusten.

Dat is het belang van dit wetsontwerp. Het is goed dat dit er eindelijk is.

That is the importance of this bill. It is good that this is finally there.

                    Mijnheer de voorzitter, mevrouw de staatssecretaris, uiteraard zijn wij voor de uitbreiding van DNA-onderzoek voor het opsporen van vermiste personen. Dat staat buiten kijf.

Deze week ontstond evenwel een andere discussie in de media, waarover ik het even wil hebben. Het ging om DNA-onderzoek en al wat de toekomst zal brengen. Daar gaat het in feite om. Opmerkelijk is de uitspraak van de procureur-generaal bij het hof van beroep van Antwerpen, de heer Liégeois, in verband met het verzamelen van DNA bij baby’s, dus vanaf de geboorte. Ik vind het een moedige uitspraak, maar het is ook een belangrijk signaal dat bewijst hoe wanhopig degenen zijn die misdrijven moeten aanklagen in onze samenleving.

Ik deel ook niet de hysterie die bij sommigen heerst, onder andere bij het Europees Hof voor de Rechten van de Mens in Straatsburg, dat lustig wordt gepapegaaid door sommigen in dit Parlement.

Ik huldig evenmin het gratuite bigbrotherargument dat overal wordt aangehaald zodra men het heeft over het verplicht verzamelen van het DNA van baby’s. Laat het duidelijk zijn dat ik het verzamelen van DNA-materiaal bij baby’s zal relativeren.

Mevrouw de staatssecretaris, als wij even stilstaan bij alles wat bewust of onbewust, gewild of ongewild, opzettelijk of toevallig wordt verzameld — ik bedoel gefilmd, geregistreerd, opgenomen via alle mogelijke media in deze samenleving, door personen of instanties, dikwijls veel onbetrouwbaarder dan overheden of nationale overheden — dan zouden wij niet meer buiten moeten komen. Laat dat duidelijk zijn. En zelfs al zouden wij niet meer buiten komen, al wat wij zelf op het internet gooien wordt verzameld. Big brother schuilt volgens mij dus niet in het opvolgen, registreren of in opslagen van al wat er gebeurt in deze wereld — of het op elektronische wijze gebeurt, wat zeer belangrijk is, of op een andere wijze – maar in het gebruik en het misbruik daarvan. Daar zit big brother!

Ik treed degenen bij die waarschuwen voor big brother in wat wordt gebruikt en misbruikt. Daar moeten wij voor opletten. Er zijn waarborgen en controles nodig. Ik meen dat de wet van 1992 op dit ogenblik voldoende waarborgen en controles biedt. Wij weten niet wat er in de toekomst nog allemaal gaat gebeuren, allicht is deze wet nog te beperkt en zal ze nog moeten worden uitgebreid. Wij zullen moeten opletten voor wat er in de toekomst allemaal gebeurt, zodat al wat bepaalt wat wij zijn, wie wij zijn en wat wij bezitten, niet zomaar overal te grabbel wordt gegooid om te worden gebruikt en misbruikt.

This week, however, there was another discussion in the media, which I would like to talk about. It was about DNA research and everything that the future will bring. That is actually what it is about. Remarkable is the ruling of the Attorney General at the Court of Appeal of Antwerp, Mr. Liégeois, in connection with the collection of DNA from babies, i.e. from birth. I think it’s a brave ruling, but it’s also an important signal that proves how desperate those who have to sue crimes in our society are.

Nor do I share the hysteria that prevails in some, including at the European Court of Human Rights in Strasbourg, which is jokingly popped by some in this Parliament.

Neither do I comply with the free bigbrother argument that is cited everywhere when it comes to compulsory collection of baby DNA. Let it be clear that I will relegate the collection of DNA material in babies.

Mrs. Secretary of State, if we stop for a moment with everything that is collected, consciously or unconsciously, intentionally or unintentionally, intentionally or accidentally – I mean filmed, recorded, recorded through all possible media in this society, by individuals or bodies, often far more unreliable than governments or national authorities – then we should not go out. Let it be clear. And even if we don’t come out anymore, everything we throw out on the internet is collected. Big brother, I think, does not consist in tracking, recording or storing everything that happens in this world – whether it happens electronically, which is very important, or otherwise – but in using and misusing it. I am grateful to Attorney General Liégeois for his statement that someday ⁇  all DNA needs to be collected. There is nothing unethical about it, there is no problem with it. By collecting DNA, medical science with nanotechnology can even save lives in the future. So we must dare to look a little further, we must indeed dare to accept the progress.

I want to break a lan today. Therefore, today I want to defend Attorney General Liégeois not politically – he must do it himself – but legally. Juridically, it will one day be a fact that all DNA is collected. Wij willen niet meer dat de politie van één tot zeven miljard moet tellen, vooraleer ze een crimineel kan oppakken. Wij willen efficiënte methodes om de misdaad te bestrijden.

Daarom is het voorliggend wetsontwerp een goed ontwerp, omdat het vermiste personen helpt opsporen. Daarom zal het in de toekomst ook een goed wetsontwerp zijn dat bepaalt dat criminelen kunnen worden opgepakt dankzij het feit dat hun DNA ooit werd geregistreerd, zelfs bij hun geboorte. Daar is niets fout mee.

Wij moeten dat stukje vrijheid durven op te geven. Er zijn veel ergere, nefastere en perfidere instanties dan de huidige overheden – en ik noem de huidige Belgische overheid – die nu al materiaal op het internet gebruiken en die wij vandaag moeten counteren.

Ik hoop dat wij die in de toekomst allemaal zullen kunnen counteren en dat wij criminelen op basis van hun DNA zullen kunnen oppakken. De samenleving zal daarvan beter worden.

Ik breek vandaag een lans voor degenen die zeggen dat wij DNA-materiaal in de toekomst zullen moeten gebruiken om criminelen op te pakken. Al wie het daarmee eens is, is een mens van de toekomst en niet van het verleden.

I hope that in the future we will be able to count them all and that we will be able to pick up criminals based on their DNA. Society will get better.

I am breaking a lance today for those who say we will need to use DNA material in the future to catch up criminals. Anyone who agrees with this is a man of the future, not of the past.

Minister Turtelboom, ik bedank u nu alvast om straks op mijn vragen te antwoorden.

In het wetsontwerp dat de staatssecretaris in de commissie heeft voorgesteld, legt hij effectief de vinger op de wonde inzake de stijging van het aantal arbeidsongeschikten. Dit jaar hebben wij de kaap van 700 000 bereikt, waarvan 400 000 mensen primair arbeidsongeschikt zijn en 300 000 invalide. Heel terecht heeft de staatssecretaris daarover zijn bezorgdheid geuit. Hij zegt dat het daarom ook hoog tijd werd om dienaangaande maatregelen te nemen. Omdat ik daarmee absoluut akkoord ging, was ik heel benieuwd naar de maatregelen die genomen zouden worden.

De oplossing voor dat groot maatschappelijk probleem blijkt een naamsverandering te zijn, meer bepaald een naamsverandering van de commissie die de arbeidsongeschikten beoordeelt. Meermaals heb ik in de commissie gevraagd wat het voordeel daarvan is. Hoe zal het aantal van 700 000 arbeidsongeschikten verminderen door een naamsverandering van een commissie? Op die vraag heb ik geen antwoord gekregen, dus misschien komt het antwoord wel van u, mevrouw de minister.

Een andere maatregel die de regering zal nemen om dat probleem aan te pakken, is de gegevensdoorstroming tussen de adviserend geneesheren en het RIZIV, dus eigenlijk tussen de ziekenfondsen en het RIZIV. Ik probeer dat te begrijpen, maar met alle goede wil van de wereld vraag ik mij af hoe die informatiedoorstroming dan in het verleden plaatsvond.

Ik vind het een heel rare gang van zaken, maar als u mij belooft dat de antwoorden komen, zet ik mijn betoog voort.

In 2015 zal een databank opgericht worden die het RIZIV moet toelaten om over informatie te beschikken omtrent arbeidsongeschikten. Ik vind dat ontstellend om te lezen en om van de staatssecretaris te horen dat het RIZIV vandaag niet in staat is om over die informatie te beschikken. Ik begrijp absoluut niet hoe in het verleden het beleid gevoerd werd omtrent die problematiek. Ik vind het dan ook heel begrijpelijk dat de groep van arbeidsongeschikten jaar na jaar toeneemt.

I find it a very strange course of affairs, but if you promise me that the answers will come, I will continue my argument.

In 2015, a database will be established that will allow RIZIV to have information about disabled persons. I find it troubling to read and to hear from the Secretary of State that RIZIV today is unable to dispose of that information. I do not understand how in the past the policy was conducted on this issue. I find it very understandable that the group of unemployed increases year after year.

                    Monsieur le président, madame la ministre, chers collègues, je tiens à intervenir brièvement au sujet de la ratification par la Belgique du Statut de l'Agence internationale pour les énergies renouvelables. Cette organisation existe déjà depuis 2010. La Belgique n'y est malheureusement qu'observatrice alors que la plupart des pays dont ceux des Nations unies en font partie.

Cette Agence a pour objectif d'encourager l'adoption plus large et plus généralisée ainsi que l'utilisation durable de toutes les formes d'énergies renouvelables. Ses activités sont axées sur les conseils, les stratégies, mais aussi le transfert de connaissances et de technologies ainsi que sur les actions de renforcement des capacités. Cela concerne le champ entier des énergies renouvelables, à savoir la bioénergie, la géothermie, l'énergie hydroélectrique, l'énergie des océans, le solaire et l'éolien.

À l'heure actuelle et au moment où l'on assiste à une véritable transition dans les modes de production d'énergies, il était indispensable que la Belgique ne soit plus seulement un observateur, mais puisse réellement participer et bénéficier de ces échanges de technologies, de connaissances, et de conseils stratégiques pour le développement des énergies renouvelables.

Les Régions wallonne, bruxelloise et flamande ont déjà ratifié ce Statut. Pour notre part, nous devions le faire avant le 18 décembre prochain – je suppose que l'on ne nous tiendra pas rigueur pour ces quelques jours de retard – afin que notre pays puisse être membre actif à partir de janvier 2014. Il était donc urgent, monsieur le président, qu'après le Sénat, la Chambre se prononce en faveur de cette adhésion.

I would like to speak briefly on the ratification by Belgium of the Statute of the International Agency for Renewable Energies. This organization has existed since 2010. Unfortunately, Belgium is only an observer, while most countries, including those of the United Nations, are part of it.

The Agency aims to encourage wider and wider adoption and sustainable use of all forms of renewable energy. Its activities are focused on advice, strategies, but also knowledge and technology transfer as well as capacity-building actions. This covers the entire field of renewable energy, namely bioenergy, geothermal energy, hydropower, ocean energy, solar and wind.

At this time and at a time when we are witnessing a real transition in the modes of energy production, it was indispensable that Belgium was no longer just an observer, but could actually participate and benefit from this exchange of technologies, knowledge, and strategic advice for the development of renewable energies.

The Flemish, Brussels and Walloon regions have already ratified the Statute. For our part, we had to do so before December 18 – I suppose we won’t be held tight for those few days of delay – so that our country can become an active member from January 2014. It was therefore urgent, Mr. Speaker, that after the Senate, the House should vote in favour of this membership.
