                    Mijnheer de voorzitter, collega’s, aan de orde is het wetsvoorstel tot invoering van het elektronisch toezicht als autonome straf, onmiddellijk op te leggen door de feitenrechter of de rechter ten gronde. Dit voorstel werd ingediend door mevrouw Van Cauter. Er werden hierover reeds in januari 2013 heel interessante hoorzittingen gehouden met verschillende actoren van op het terrein.

De door ons gehoorde personen juichten algemeen toe dat werd gezocht naar een oplossing voor de overbevolking in de gevangenissen en naar een diversificatie van de straffen. Zij vonden het positief dat er werd nagedacht over een andere vorm van detentie dan detentie tout court.

Er werden evenwel heel wat opmerkingen geformuleerd en vragen gesteld. Als rapporteur haal ik de belangrijkste aan.

Er werden vragen gesteld inzake het budget, zowel betreffende het materiaal als aangaande de opvolging door justitieassistenten. Er werd gewezen op het belang van de opvolging, onder andere door justitieassistenten. Er werden vragen gesteld over de rangorde van deze straf. Er werden ook vragen gesteld over het al dan niet facultatief karakter van een voorafgaand maatschappelijk onderzoek en over de toegang tot het strafregister. Er werd gevreesd voor net widening, en de vrees werd ook geuit dat dit systeem geen of weinig invloed zou hebben op de gevangenisbevolking. Ook werd de vraag gesteld of er wel voldoende coherentie zou zijn indien de twee sporen zouden blijven bestaan, met name het elektronisch toezicht als autonome straf en als strafmodaliteit. Er werd tevens gewezen op de reeds bestaande wet van 2006 op de externe rechtspositie en er werd aangeraden de vervangende gevangenisstraf zo hoog mogelijk te houden om voldoende ontradend te zijn.

Na deze hoorzittingen volgde een periode van reflectie. Ingevolge de gemaakte opmerkingen werd een vervangend amendement ingediend door mevrouw Van Cauter en consorten, waarmee de indieners nog steeds een volwaardig alternatief voor de traditionele straf willen aanbieden, de strijd tegen de overbevolking willen aangaan en een diversificatie van straffen willen aanbieden.

Het voorstel dat vandaag voorligt, betreft het elektronisch toezicht binnen de rangorde onder de vrijheidsstraf en boven de werkstraf. Het elektronisch toezicht kan worden opgelegd voor feiten met een straf van maximaal een jaar en niet voor alle misdrijven. Er is geen akkoord vereist van de familie of van het slachtoffer, maar wel een raadpleging. De betrokkene zelf moet wel akkoord gaan. De maatschappelijke enquête blijft facultatief. Het elektronisch toezicht als autonome straf kan worden opgelegd voor een minimumperiode van een maand en een maximumperiode van een jaar. Een dag elektronisch toezicht is gelijk aan een dag gevangenisstraf. De straf moet worden uitgevoerd binnen de zes maanden. Er zal nog steeds een gevangenisstraf worden opgelegd als vervangende straf. Een schorsing kan worden gevraagd na een drietal maanden. De inwerkingtreding werd uitgesteld en werd afhankelijk gesteld van de beschikbare mensen en middelen.

However, a lot of comments were made and questions were asked. As a rapporteur, I will address the most important.

Questions were asked on the budget, both on the material and on the follow-up by judicial assistants. It was highlighted the importance of succession, including by judicial assistants. There were questions about the ranking of this punishment. Questions were also raised regarding the optional or non-optional nature of a prior civil investigation and the access to the criminal record. There was fear of just widening, and the fear was also expressed that this system would have no or little impact on the prison population. It was also asked whether there would be sufficient coherence if the two tracks continued, in particular electronic surveillance as an autonomous punishment and as a punishment modality. It also pointed to the already existing 2006 Act on the external legal status and recommended that the substitute prison sentence be kept as high as possible to be sufficiently dissuasive.

After these hearings followed a period of reflection. As a result of the comments submitted, a replacement amendment was submitted by Ms. Van Cauter and consortia, with which the applicants still want to offer a full alternative to the traditional punishment, want to engage in the fight against overpopulation and want to offer a diversification of penalties.

The proposal presented today concerns electronic surveillance within the rank below the prison sentence and above the work sentence. Electronic surveillance may be imposed on offences with a sentence of up to one year and not on all offences. No agreement is required from the family or the victim, but a consultation. The person concerned must agree. The social survey remains optional. Electronic surveillance as an autonomous penalty may be imposed for a minimum period of one month and a maximum period of one year. One day of electronic surveillance is equivalent to one day of imprisonment. The sentence must be executed within six months. A prison sentence will still be imposed as a substitute punishment. A suspension may be requested after three months. The entry into force was postponed and was made dependent on the available people and resources.

                    Mijnheer de voorzitter, collega’s, inzake het standpunt van de N-VA-fractie wil ik eerst en vooral duidelijk maken dat de N-VA zeker niet tegen het elektronisch toezicht is, niet als autonome straf en evenmin als strafmodaliteit. Wij zijn ervan overtuigd dat het elektronisch toezicht inderdaad kan leiden tot een efficiëntere of zinvollere strafuitvoering en dat het kan bijdragen tot de reclassering. Er komt dan tenminste een straf, met een bepaalde vrijheidsbeperking, waarbij de betrokkenen hun werk kunnen behouden, verder kunnen instaan voor hun gezin en de slachtoffers kunnen vergoeden. Het elektronisch toezicht kan een middel zijn tegen de straffeloosheid.

Wij hebben echter een vrees, die wij ook al hebben geuit tijdens de bespreking in de commissie. Onze vrees is dat de oplossing die hier vandaag wordt voorgelegd, alle goede bedoelingen ten spijt, wel mooi is op papier, maar in de praktijk toch niet zo eenduidig en niet zo doeltreffend zal zijn.

Zonder de discussie in de commissievergadering opnieuw te willen voeren, zal ik toch even stilstaan bij onze belangrijkste opmerkingen.

Samen met heel wat andere personen die wij ter zake hebben gehoord, vrezen wij dat er minstens een duaal systeem zal ontstaan met aan de ene kant het elektronisch toezicht als een autonome straf, en aan de andere kant nog altijd de strafmodaliteit die opgelegd wordt door een strafuitvoeringsrechtbank. Daardoor ontstaat er een ongelijk systeem. Een dag elektronisch toezicht komt namelijk overeen met een dag gevangenisstraf als autonome straf. Elke opgelegde dag elektronisch toezicht moet ook volledig worden uitgevoerd, dus wie een jaar elektronisch toezicht opgelegd krijgt, moet dat hele jaar uitdoen. Wanneer het om een strafuitvoeringsmodaliteit gaat, is dat echter niet het geval. Immers, wij weten allemaal dat een veroordeling tot een jaar gevangenisstraf omgezet wordt in drie maanden elektronisch toezicht. Die herleiding gebeurt niet wanneer het om een autonome straf gaat. Er bestaat nog veel meer onderscheid, maar dat element wilde ik zeker aanhalen. Afhankelijk van de modaliteit, kan de straf al dan niet zwaarder uitvallen. Wanneer die twee systemen naast elkaar blijven bestaan, is het beleid niet coherent, want er is geen coherente straftoemeting en strafuitvoering. Die twee systemen doorkruisen elkaar.

Er zijn nog andere verschillen, bijvoorbeeld met betrekking tot de termijnen. Het ene systeem kan worden toegepast voor alle misdrijven, maar het andere niet. De controle-instanties zijn ook verschillend.

Ik heb zonet over een duaal systeem gesproken, maar daarnaast bestaan nog de thuisdetentie en het elektronisch toezicht in het kader van de voorlopige hechtenis, wat alweer door andere instanties wordt opgelegd en gecontroleerd. Er is ook nog het GPS-systeem. Er komt dus een “wildgroei aan elektronisch toezicht”, en dat zijn niet mijn woorden, maar wel die van mevrouw Becq. Die uitspraak kunt u lezen in de Gazet van Antwerpen van vandaag en zij heeft gelijk, haar uitspraak is correct.

Regarding the position of the N-VA group, I would like to make it clear, first and foremost, that the N-VA is ⁇  not against electronic surveillance, nor as an autonomous punishment, nor as a punishment modality. We believe that electronic surveillance can indeed lead to a more efficient or meaningful execution of penalties and that it can contribute to the reclassification. At least one sentence, with a certain limitation of liberty, will be imposed, allowing the persons concerned to retain their work, continue to provide for their families and compensate the victims. Electronic surveillance can be a means against impunity.

However, we have a concern, which we have already expressed during the discussion in the committee. Our fear is that the solution presented here today, despite all good intentions, is beautiful on paper, but in practice it will not be so unambiguous and not so effective.

Without wanting to resume the discussion in the committee meeting, I will still pause on our most important remarks.

Together with many other persons we have heard on this subject, we fear that at least a dual system will arise with on the one hand electronic surveillance as an autonomous punishment, and on the other hand still the punishment modality imposed by a criminal enforcement court. This creates an unequal system. A day of electronic surveillance is equivalent to a day of imprisonment as an autonomous punishment. Each imposed day of electronic surveillance must also be fully performed, so those who are imposed one year of electronic surveillance must spend that whole year. However, when it comes to a punishment enforcement modality, this is not the case. After all, we all know that a sentence to one year imprisonment is converted into three months of electronic surveillance. This reversal does not occur when it is an autonomous punishment. There are many other differences, but that element I would ⁇  like to emphasize. Depending on the modality, the punishment may or may not be heavier. When these two systems continue to coexist, the policy is inconsistent, as there is no coherent punishment and execution. These two systems cross each other.

There are other differences, for example in terms of deadlines. One system can be applied to all crimes, but the other cannot. The control authorities are also different.

I have recently talked about a dual system, but in addition there is still home detention and electronic surveillance within the framework of interim detention, which is again imposed and controlled by other bodies. There is also the GPS system. So there is a “wild growth in electronic surveillance,” and that is not my words, but that of Mrs. Becq. You can read that judgment in the Gazet of Antwerp of today and she is right, her judgment is correct.

                    Bovendien wordt met het voorliggend systeem de strafuitvoeringsrechtbank buitenspel gezet, waarover ik bezorgd ben. Het is destijds een bewuste keuze geweest om strafuitvoeringsrechtbanken op te richten, onder meer na de commissie-Dutroux. Nu worden ze eigenlijk buitenspel gezet en worden hun bevoegdheden afgenomen.

Er is echter meer. Eigenlijk is het voorliggend wetsvoorstel in se niet nodig omdat er al een regeling werd goedgekeurd. Ik was toen nog geen lid van de Kamer, maar in 2006 keurde het Parlement de wet op de externe rechtspositie goed. Artikel 22 van die wet bepaalt perfect een dergelijke regeling. Straffen onder de drie jaar kunnen daardoor gemakkelijk worden omgezet, niet door een gevangenisdirecteur maar via een beslissing. Dat specifiek artikel werd ook door de huidige coalitie opnieuw uitgesteld tot 2015. Nogmaals, de wet dateert van 2006 en zal niet voor 2015 in werking treden.

Wij hadden een dergelijke wettelijke regeling dus al. In plaats van nu een nieuwe wetgeving, een nieuwe regel en een nieuw systeem te creëren, hadden wij dus misschien beter dat artikel 22 in werking laten treden, tenzij de meerderheid er expliciet afstand van wil doen, wat kan. In voorkomend geval kan zij dat echter beter melden en hoeft zij de inwerkingtreding van artikel 22 niet uit te stellen. Zij kan dan desgevallend artikel 22 gewoon afschaffen.

Wij keren nu even terug naar de ratio van voorliggende wetgeving. Ze staat in de memorie van toelichting en is regelmatig herhaald en hernomen. Het doel is nobel en wij kunnen ons daar achter scharen. Inderdaad, het was vooral de bedoeling om de straffeloosheid aan te pakken en om de overbevolking in de gevangenissen tegen te gaan.

Wij hebben hoorzittingen gehouden. Tijdens de hoorzittingen is gesteld dat er weinig of geen impact op de overbevolking in de gevangenissen zal zijn. Immers, zij die het elektronisch toezicht als een autonome straf zullen krijgen, zijn niet de personen die nu in de gevangenis zitten. Het tegendeel is waar. Er is dus wel degelijk een risico van net widening. Dat is trouwens niet alleen mijn mening. U kunt hetzelfde lezen in het verslag van de commissiewerkzaamheden. Ook de heer Brotcorne en de heer Landuyt hebben bevestigd dat het probleem hetzelfde blijft. De ratio of de intentie van voorliggend wetsontwerp zal dus niet werken. De overbevolking zal niet worden aangepakt. Er zal door de regeling geen enkele lege cel bij komen.

Collega’s, deze vaststelling is heel problematisch. Ze maakt immers onmiddellijk ook de afdwingbaarheid van het elektronisch toezicht als autonome straf problematisch, wat ook naar voren is gebracht. De vervangende gevangenisstraf, zoals ze bestaat, moet immers voldoende ontradend zijn, zodat de veroordeelde zeker zijn of haar elektronisch toezicht naleeft. De stok achter de deur ter zake is de vervangende gevangenisstraf. Indien er echter geen extra plaatsen in de gevangenis zijn, wil ik nog wel eens zien wat de vervangende gevangenisstraf zal zijn. Indien een veroordeelde zijn of haar elektronisch toezicht niet naleeft en miskent, is er derhalve geen stok achter de deur, wat heel problematisch is. Er is immers geen plaats in de cellen.

Let us now go back to the ratio of the current legislation. It stands in the memory of explanation and is regularly repeated and retrieved. The goal is noble and we can stand behind it. Indeed, it was primarily intended to address impunity and to counter the overpopulation in prisons.

We held hearings. During the hearings, it was stated that there would be little or no impact on overpopulation in prisons. After all, those who will receive electronic surveillance as an autonomous punishment are not the people who are now in prison. The opposite is true. There is a risk of net enlargement. This is not just my opinion. You can read the same in the report of the committee’s work. Mr. Brotcorne and Mr. Landuyt have also confirmed that the problem remains the same. The ratio or intention of the present bill will therefore not work. Overpopulation will not be addressed. No empty cell will be added.

This conclusion is very problematic. After all, it also immediately makes problematic the enforceability of electronic surveillance as an autonomous punishment, which has also been highlighted. In fact, the substitute prison sentence, as it exists, must be sufficiently deterrent to ensure that the convicted person complies with his or her electronic surveillance. The stick behind the door in this matter is the substitute prison sentence. However, if there are no additional places in the prison, I would like to see what the replacement prison sentence will be. If a convicted person fails to comply with and fails to comply with his or her electronic surveillance, there is therefore no stick behind the door, which is very problematic. There is no place in the cells.

                    Mevrouw Van Cauter, mevrouw de minister, ik blijf zitten met het volgende probleem. U weet dat. De maatschappelijke enquête is enkel facultatief. Wanneer er geen maatschappelijke enquête is, kan men de geweldenaar in het kader van familiaal geweld zijn straf gewoon thuis laten uitzitten. Ik meen dat dit vooral een straf is voor zijn slachtoffers, niet zozeer voor de dader. Daarom is het een gemiste kans dat er niet is beslist tot een verplichte maatschappelijke enquête maar enkel tot een facultatieve.

Een fundamenteel probleem voor deze wet zal het budget vormen. De vraag is herhaaldelijk gesteld. Zal het materiaal wel volstaan? Komt er wel een opvolging door de justitieassistenten? Die zal cruciaal zijn, maar net daarop werd bespaard.

Er is zeer duidelijk gesteld dat de inwerkingtreding van deze wetgeving uitgesteld zal worden tot 2014 of 2015. Waarom? In afwachting van mensen en middelen. Dat is natuurlijk een zwak punt in deze wetgeving, ondanks alle goede bedoelingen.

Samengevat, er komt minstens een duaal en niet-coherent systeem. Men had een keuze moeten maken. Het ene of het andere, maar niet beide. Er is onvoldoende budget, er zijn onvoldoende mensen, er zijn onvoldoende middelen. De impact is dus gekend: er zal niets veranderen aan de overbevolking van de gevangenissen. Nochtans, collega’s van de PS, was dat voor u de essentiële voorwaarde om dit voorstel goed te keuren. Lees het verslag er maar op na. U stemde ermee in onder een aantal voorwaarden en één daarvan was dat er iets zou gebeuren op het vlak van de overbevolking in de gevangenissen. Dat zal echter niet het geval zijn en precies daarom zal deze wetgeving niet afdwingbaar zijn.

Het is natuurlijk mooi om mee uit te pakken. Dat vind ik ook. Alleen gaat het om een lege doos. Als men aan de ene kant iets voorstelt, maar het aan de andere kant onmiddellijk uitstelt, is dat niet fraai. De verpakking is mooi, maar de inhoud kon beter.

Voor onze fractie zijn er alleszins redenen genoeg om zich te onthouden bij de stemming. Wij staan daar niet alleen in, in de commissie heeft collega Becq zich ook onthouden. Ik ben benieuwd naar het stemgedrag van de CD&V-fractie.

Wij willen alleszins een duidelijk systeem, een sluitend systeem, waarbij de strafuitvoeringsrechtbank niet uitgehold wordt en waarbij het elektronisch toezicht geen gevangenisstraf light wordt. Dat ligt vandaag echter niet voor.

Ik wil mijn betoog beëindigen met de woorden van mevrouw Becq. Zij zegt heel duidelijk: “Het voorstel bevat grote gaten.” Ik verwijs naar het desbetreffend artikel, want daarin staat nog veel meer te lezen. En wie ben ik om dat tegen te spreken?

You agreed to it under a number of conditions and one of them was that something would happen in terms of overcrowding in prisons. However, this will not be the case, and that is precisely why this legislation will not be enforceable.

Of course, it is nice to take it out. I also think so. It is just an empty box. If one proposes something on the one hand, but on the other hand delays it immediately, that is not beautiful. The packaging is nice, but the content could be better.

For our group, there are enough reasons to abstain in the vote. We are not alone in this, in the committee colleague Becq has also abstained. I am looking forward to the voting behavior of the CD&V group.

We want a clear system, a closing system, in which the criminal enforcement court is not exhausted and in which electronic surveillance does not become a prison sentence light. However, this is not the case today.

                    Mijnheer de voorzitter, mevrouw de minister, collega’s, in ons huidig strafrecht kennen wij het elektronisch toezicht alleen als een strafuitvoeringsmodaliteit. Met het huidig wetsvoorstel wordt het elektronisch toezicht een op zichzelf staande, volwaardige straf.

Zoals collega De Wit reeds heeft gezegd, zijn wij gestart met een wetsvoorstel dat vanuit onze fractie, onder andere door mevrouw Lahaye-Battheu, werd ingediend. Wij hebben nadien in de commissie hoorzittingen gehouden. Na deze hoorzittingen hebben wij het oorspronkelijk voorstel grondig herwerkt. Voor die herwerking hebben wij een beroep kunnen doen op specialisten ter zake, mensen uit de praktijk. Dankzij hun opmerkingen en suggesties zijn wij gekomen tot de tekst die momenteel voorligt en die vandaag ter stemming wordt voorgelegd. Ik wil al degenen die een bijdrage hebben geleverd bij het tot stand komen van dit wetsvoorstel oprecht bedanken.

Voor de collega’s die de werkzaamheden niet hebben gevolgd, ben ik zo vrij om kort, zonder de details te vermelden, een toelichting te geven over dit nieuwe strafsysteem. Wij schrijven het elektronisch toezicht in het Strafwetboek in als een op zichzelf staande straf. In de hiërarchie van de straffen komt deze straf op de tweede plaats, na de gevangenisstraf en vóór de werkstraf. Wij doen dit omdat de zwaarte van de straf niet alleen van de duur van de strafmaat afhangt, maar uiteraard ook van de impact op de vrijheid.

Het spreekt voor zich dat wij duidelijk omschrijven wat een straf onder elektronisch toezicht precies inhoudt, in welke gevallen zij kan worden opgelegd en wat de toe te passen procedure is. De krachtlijnen zijn de volgende. Deze straf is mogelijk voor feiten die zouden kunnen worden bestraft met een gevangenisstraf van één jaar of minder. Er wordt gekozen voor een ratio van één dag gevangenisstraf die gelijkstaat aan één dag onder elektronisch toezicht. Dit zorgt voor duidelijkheid en vermijdt discussies naderhand over omzettingen wanneer een straf onder elektronisch toezicht niet naar behoren zou worden uitgevoerd.

De vervangende straf is inderdaad de gevangenisstraf, maar vooraleer deze wordt opgelegd, krijgt de veroordeelde uiteraard de kans om te worden gehoord. Het moet de bedoeling zijn – en dit zal prioriteit krijgen – dat, indien een vervangende straf moet worden opgelegd en uitgevoerd, die ook effectief wordt uitgevoerd. Collega De Wit, het tekort aan gevangenisplaatsen was effectief een nijpend probleem, maar u en uw fractie zullen niet willen ontkennen dat in deze legislatuur al een aantal bijkomende plaatsen werden gecreëerd en dat in de loop van dit jaar nog een aantal bijkomende plaatsen zullen volgen, zodat ook effectief uitvoering kan worden gegeven aan dit voorstel.

As colleague De Wit has already said, we have started with a bill submitted by our group, among others by Mrs. Lahaye-Battheu. We subsequently held hearings in the committee. After these hearings, we have thoroughly revised the original proposal. For this rework, we have been able to resort to specialists in the field, people from the practice. Thanks to their comments and suggestions, we have come to the text that is currently ahead and is being put to vote today. I would like to thank all those who have contributed to the creation of this bill.

For the colleagues who have not followed the work, I am so free to give a brief, without giving the details, explanation about this new punishment system. We include electronic surveillance in the Criminal Code as a stand-alone punishment. In the hierarchy of punishments, this punishment comes second, after the prison sentence and before the work sentence. We do this because the severity of the penalty depends not only on the duration of the penalty measure, but of course also on the impact on freedom.

It is obvious that we clearly define what an electronic surveillance punishment exactly means, in which cases it can be imposed and what procedure to be applied. The strength lines are the following. This penalty is possible for acts that could be punished with a prison sentence of one year or less. A ratio of one day of imprisonment equivalent to one day under electronic surveillance is chosen. This provides clarity and avoids subsequent discussions on conversions when an electronic-monitored penalty would not be properly executed.

The substitute punishment is indeed the prison sentence, but before it is imposed, the convicted of course has the opportunity to be heard. It must be the intention – and this will be given priority – that, if a substitute penalty is to be imposed and executed, that is also effectively executed. Colleague De Wit, the shortage of prisons was effectively a big problem, but you and your group will not want to deny that in this legislature a number of additional seats have already been created and that in the course of this year a number of additional seats will follow, so that this proposal can also be effectively implemented.

Om een dergelijke straf ten uitvoer te leggen moeten effectief een aantal mechanismen in gang worden gezet en het zou disproportioneel zijn om dit te doen voor een straf die korter is dan een maand.

Op procedureel vlak wordt voorzien in een maatschappelijke enquête. Deze is effectief facultatief, collega De Wit. Wij hebben tijdens de besprekingen in de commissie duidelijk gemaakt dat dit zo is om nodeloze kosten uit te sparen. U weet zeer goed dat in deze dossiers zeer vaak reeds een moraliteitsonderzoek is gevoerd door de politie, zodat de rechter kan volstaan met het opvragen van bepaalde concrete informatie zonder dat noodzakelijk een maatschappelijke enquête moet worden gevoerd. De rechter die moet oordelen, de rechter ten gronde, beschikt dan over alle nodige informatie om te kunnen beslissen of elektronisch toezicht de meest geschikte straf is. In die gevallen is het echt niet nodig om nodeloos kosten te maken.

De toestemming van de betrokkene is noodzakelijk. Dat is een noodzakelijke voorwaarde om de straf te kunnen opleggen. Dat spreekt ook voor zich. Het is immers een verbintenis die de betrokkene op zich neemt en het is daarom van het grootste belang dat de betrokkene de straf correct inschat en daarbij kennis krijgt van de voorwaarden waaraan hij zich zal moeten houden. De mening van de huisgenoten is belangrijk, zonder dat hen een vetorecht kan worden toegekend. Het opleggen van een straf kan niet afhangen van de wil van derden maar moet bepaald worden door de rechter. Deze zal weliswaar rekening kunnen houden met de mening van de huisgenoten.

Zoals bij de werkstraf, kan de rechter in zijn beslissing rekening houden met de belangen van de eventuele slachtoffers. Ik kom daar straks nog even op terug.

Voor de bepaling van de invulling van de straf onder elektronisch toezicht werd gekeken naar wat er bepaald is voor de werkstraf. Ook daar werd gesteld dat de magistraten de grote lijnen kunnen aangeven en aanwijzingen kunnen geven, maar dat de concrete invulling moet geregeld worden door de bevoegde dienst. Bij de contactname met de betrokkene binnen de zeven dagen nadat men definitief is veroordeeld, kan die toelichting geven over zijn concrete werksituatie. Op dat ogenblik regelt men de concrete invulling van de individueel op te leggen werkstraf.

The choice of imprisonment as a substitute for punishment is logical. On a procedural level, a social inquiry is provided. This is effectively optional, colleague De White. We have made it clear during the discussions in the committee that this is so to save unnecessary costs. You know very well that in these files very often a morality investigation has already been conducted by the police, so that the judge can be enough to request certain concrete information without necessarily having to conduct a social investigation. The judge who is responsible for judgment, the judge on the merits, will then have all the necessary information to decide whether electronic surveillance is the most appropriate punishment. In those cases, it is really not necessary to make unnecessary expenses.

The consent of the person concerned is necessary. This is a prerequisite for imposing the penalty. That also speaks for itself. In fact, it is an obligation that the person concerned assumes and it is therefore of the utmost importance that the person concerned correctly assesses the penalty and thereby becomes aware of the conditions to which he will have to comply. This, by the way, is an usage that also applies to the work penalty and is perceived as good.

The opinion of the households is important, without them being granted a veto right. The imposition of a penalty cannot depend on the will of third parties but must be determined by the judge. This will take into account the opinions of the family members.

As in the case of labour punishment, the judge may take into account the interests of the potential victims in its decision. I will come back to that later.

For the determination of the fulfillment of the sentence under electronic surveillance was looked at what is stipulated for the work penalty. Also there was stated that the magistrates can indicate the broad lines and give directions, but that the concrete fulfillment must be arranged by the competent service. When contacting the person concerned within seven days of a definitive conviction, he may provide an explanation of his concrete work situation. At that moment, the concrete fulfillment of the individual labour punishment is regulated.

                    Tevens werd bepaald dat een systeem van schorsing van de straf onder elektronisch toezicht wordt ingevoerd. Dat betekent zeer concreet dat de betrokkene wordt bevrijd van de elektronische controlemiddelen, maar zich wel dient te houden aan de andere eventueel opgelegde voorwaarden. Daarbij denken we, bijvoorbeeld, aan het behouden van werk en het vergoeden van het slachtoffer. Het initiatief om de schorsing aan te vragen ligt bij de veroordeelde zelf. Tot slot werd tevens bepaald dat de veroordeelde die van de schorsing kan genieten, een proeftermijn heeft die gelijk is aan het strafrestant. Wat u opmerkt, is juist, collega De Wit: het elektronisch toezicht zal als autonome straf bestaan naast de strafuitvoeringsmodaliteit. We hebben het in de commissie besproken: dit hoeft absoluut niet problematisch te zijn. We kennen in ons rechtssysteem gelijkaardige, naast elkaar bestaande regelingen. Daarbij denken we aan de autonome werkstraf, enerzijds, en de maatschappelijke dienstverlening, anderzijds, die in se onder andere voorwaarden gelijkaardige opgelegde uren werk ten behoeve van de gemeenschap zijn. Beide systemen bestaan perfect naast elkaar.

Collega’s, het huidige voorstel grijpt duidelijk in op de straftoemeting, niet op de strafuitvoering. Dit wil zeggen dat het de rechter de keuze laat het elektronisch toezicht op te leggen als hoofdstraf, wanneer de rechter van oordeel is dat dit effectief de meest geschikte straf is. Tijdens de hoorzittingen is zeer duidelijk gebleken dat magistraten soms nog zware gevangenisstraffen opleggen om er zeker van te zijn dat een bepaald gedeelte van de straf wordt ondergaan. Zo komt men tot een oneigenlijke straftoemeting, wat aanleiding geeft tot overbevolking van de penitentiaire inrichtingen, met alle bijhorende gevolgen voor familie, slachtoffers en dergelijke meer. Het zou veel beter zijn dat zij effectief de keuze hebben, rekening houdend met de ernst van de feiten, de persoonlijkheid van de dader en de concrete omstandigheden, om een alternatieve straf als het elektronisch toezicht in bepaalde gevallen te kunnen opleggen.

Het is mijn mening, collega’s, dat wij door het voorleggen van deze tekst, die vandaag hopelijk zal worden goedgekeurd, bijdragen tot het verder diversifiëren van de straffen, waar zoals gezegd duidelijk nood aan is. De straf is nooit een doel op zich, maar een straf moet wel degelijk zijn doel bereiken. Vandaar de keuze voor het elektronisch toezicht.

Colleagues, the present proposal clearly concerns the punishment, not the execution of the penalty. This means that it allows the judge to choose to impose electronic surveillance as the main punishment, when the judge considers that this is effectively the most appropriate punishment. During the hearings, it was very clear that magistrates sometimes still impose severe prison sentences to ensure that a certain part of the sentence is served. Thus, one comes to an inappropriate punishment, which leads to overcrowding of the penitentiary facilities, with all related consequences for family, victims and the like. It would be much better for them to effectively have the choice, taking into account the seriousness of the facts, the person of the perpetrator and the concrete circumstances, to be able to impose an alternative punishment such as electronic surveillance in certain cases.

It is my opinion, colleagues, that by presenting this text, which hopefully will be adopted today, we contribute to the further diversification of the penalties, which, as said, is clearly needed. Punishment is never a goal in itself, but punishment must ⁇  its purpose. Therefore, the choice for electronic surveillance.

Il nous paraît en effet essentiel qu'une peine soit exécutée une fois qu'elle a été prononcée et ce, dans les meilleurs délais. Nous sommes également favorables au bracelet électronique comme peine autonome parce que, si nous pensons qu'une réponse ferme doit être apportée à la délinquance, nous sommes toujours favorables à l'alternative à la prison.

La prison doit, pour le groupe socialiste, rester l'exception et être limitée aux cas où l'enfermement est absolument nécessaire. Le bracelet électronique comme peine autonome offre une alternative à l'enfermement qui permet à la personne condamnée de ne pas être véritablement extraite de la société. Cette peine doit permettre le maintien de la personne dans son lieu de vie, dans son travail et au sein de sa famille. Néanmoins, mon groupe garde quelques craintes quant au fait que le bracelet électronique comme peine autonome puisse avoir comme conséquence de durcir la politique pénale menée et ce, au détriment d'autres peines alternatives que sont le sursis, les amendes, la peine de travail, etc. Il faudra veiller à ce que le mécanisme n'aboutisse pas à l'octroi de peines trop sévères au regard des faits.

Cette peine peut être tentante pour l'exemple ou pour s'assurer que l'on ne se reprochera rien en cas de récidive mais nous ne pensons pas que ce soit opportun en vue du respect indispensable de l'échelle des peines qui, soit dit en passant, devra être revue lors de la prochaine législature. La peine doit en tout cas être juste, mesurée et adéquate. Ce n'est qu'à ce prix que justice est rendue. Nous comptons sur la ministre de la Justice pour rappeler que c'est une peine lourde qui doit être utilisée avec parcimonie lorsqu'il s'avère utile de contrôler la personne et quand aucune autre peine ne semble plus adéquate.

Un accompagnement par le biais d'assistants sociaux devrait être également assuré afin, d'une part, de travailler à l'amélioration de l'insertion, voire l'insertion de la personne dans notre société, et, d'autre part, afin de soutenir le porteur du bracelet électronique pour qu'il puisse exécuter l'entièreté de sa peine sans un retour par la "case prison" qui n'aurait pas dû intervenir. En effet, il s'agit d'une peine difficile à respecter pour le porteur du bracelet électronique comme pour ses proches et un soutien est donc nécessaire pour éviter un emprisonnement qui aurait pu ou dû être évité. On sait qu'il est complexe d'être à la fois libre et soumis à un contrôle strict

Enfin, madame la ministre, il conviendra d'évaluer à moyenne échéance la cohérence de la subsistance du bracelet électronique comme peine autonome ou comme mesure d'exécution de la peine.

This punishment may be tempting for example or to ensure that nothing will be blamed in case of recurrence, but we do not think it is appropriate in view of the indispensable observance of the scale of punishments which, by the way, will have to be revised in the next legislature. The punishment must be fair, measured and adequate. It is only at this price that justice is made. We rely on the Minister of Justice to remind that this is a heavy punishment that must be used with parchment when it turns out to be useful to control the person and when no other punishment seems more appropriate.

An accompaniment through social workers should also be ensured in order, on the one hand, to work on improving the insertion, or even the insertion of the person in our society, and, on the other hand, in order to support the wearer of the electronic bracelet so that he can execute his entire sentence without a return by the "case prison" that should not have intervened. In fact, it is a difficult punishment to respect for the wearer of the electronic bracelet as well as for his relatives and therefore support is necessary to avoid imprisonment that could or should have been avoided. It is known that it is complex to be both free and subject to strict control.

Finally, Mr. Minister, it will be necessary to evaluate in the medium term the consistency of the subsistence of the electronic bracelet as an autonomous penalty or as a measure of execution of the penalty.

Zo hebben wij er onze twijfels bij dat via het elektronisch toezicht het probleem van de overbevolking in de gevangenissen kan worden verholpen. Immers, ook al worden de korte gevangenisstraffen omgezet in elektronisch toezicht, dan nog blijft de gevangenisstraf als stok achter de deur, als mogelijke sanctie behouden als het elektronisch toezicht niet kan worden georganiseerd.

Bovendien vrezen we voor netwinding. Daarbij zal men gemakkelijker kiezen voor elektronisch toezicht, ook al zijn er alternatieve straffen, zoals werkstraffen, mogelijk. Het gevolg is alleen maar meer elektronisch toezicht en geen vermindering van de gevangenisbevolking.

Wij hebben ook herhaaldelijk gevraagd naar de budgettaire impact van het elektronisch toezicht. Wij hebben het dan over de kosten van de elektronische enkelbanden zelf, van het eventueel sociaal onderzoek en van de opvolging van het elektronisch toezicht. Het zijn overigens de Gemeenschappen, met de justitiehuizen, die voor die laatste kosten opdraaien. Jammer genoeg hebben we geen serieuze simulatie van de budgettaire gevolgen gezien.

After all, even if the short prison sentences are converted into electronic surveillance, then still the prison sentence remains as a stick behind the door, as a possible sanction if the electronic surveillance cannot be organized.

Furthermore, we are afraid of netwinding. This will make it easier to opt for electronic surveillance, even though alternative penalties, such as labour penalties, are possible. The result is only more electronic surveillance and no reduction in the prison population.

We have also repeatedly asked about the budgetary impact of electronic surveillance. We are then talking about the costs of the electronic single tyres themselves, of the possible social research and of the follow-up of the electronic surveillance. In addition, it is the Communities, together with the Chambers of Justice, which incur the costs of the latter. Unfortunately, we have not seen a serious simulation of the budgetary consequences.

                    Een andere bezorgdheid van ons, die hier ook is aangehaald, is dat er enerzijds de strafuitvoering is via elektronisch toezicht op verschillende manieren – via een enkelband of een andere manier van elektronisch toezicht – en anderzijds het elektronisch toezicht als autonome straf.

In de hoorzitting werd erop gewezen dat dit tot verwarring zou kunnen leiden. Wij delen die vrees. Soms geven rechters nu zwaardere straffen om er zeker van te zijn dat zij niet kunnen worden omgezet in elektronisch toezicht. Zal er duidelijkheid zijn tussen de keuze voor elektronisch toezicht of voor een korte gevangenisstraf, die dan automatisch wordt omgezet? Het blijft voor ons een moeilijk punt dat beide systemen naast elkaar blijven bestaan, ook omdat het toepassingsgebied van het elektronisch toezicht als autonome straf verschilt van het toepassingsgebied van het elektronisch toezicht als strafuitvoering.

De minister heeft beloofd dat zij haar omzendbrief zou aanpassen aan het huidige systeem van autonome straf. Dat is echter momenteel nog niet gebeurd, waardoor beide systemen naast elkaar blijven bestaan. Dat blijft voor ons een heikel punt.

Ik wil zeker meegeven dat er een poging is gedaan om een gelijkschakeling te krijgen en om die onrechtvaardigheid en ongelijkheid eruit te halen, door met een systeem van schorsing te werken. Dat zal in een aantal gevallen zeker leiden tot een grotere gelijkheid, maar het lost het probleem niet volledig op. Er zijn immers nog andere mogelijkheden.

Er werd daarnet ook gesproken over de toestemming van de huisgenoten. Het is aan het openbaar ministerie om te oordelen over de schorsing, niet aan de probatiecommissie. Die laatste zal eventueel wel later worden ingeschakeld, wanneer het via probatie als autonome straf zou gebeuren. Wij hebben hier toch nog bedenkingen bij.

Ik vat mijn betoog samen. Wij staan principieel achter het elektronisch toezicht als autonome straf. Wij appreciëren ten zeerste de aanpassingen van mevrouw Van Cauter op grond van de besprekingen en de hoorzittingen. Na een aantal vragen werd een serieuze poging gedaan om het voorstel aan te passen. Wij blijven echter toch vragen hebben bij het tweesporenbeleid: wij zijn voor diversificatie, maar hadden die liever op een coherente manier gezien, onder andere via de SURB en de mogelijkheid van artikel 22 van de wet betreffende de externe rechtspositie.

At the same time, the problem of the duration of electronic surveillance as an autonomous penalty or as a penalty execution modality was also addressed, because in this way inequality can be created.

I would like to assure you that an attempt has been made to obtain an equal chain and to remove that injustice and inequality by working with a system of suspension. That will ⁇  lead to greater equality in some cases, but it does not solve the problem completely. After all, there are other possibilities.

There was also discussion about the consent of the households. It is up to the prosecutor to judge the suspension, not to the probation committee. The latter will eventually be activated later, if it would be done through probation as an autonomous punishment. We still have concerns here.

I take my speech together. We principally support electronic surveillance as an autonomous punishment. We highly appreciate the adjustments made by Ms. Van Cauter on the basis of the discussions and the hearings. After a number of questions, a serious attempt was made to modify the proposal. However, we still have questions with the two-track policy: we are for diversification, but would have preferred to see it in a coherent way, including through the SURB and the possibility of Article 22 of the Act on the external legal position.

Au MR, nous partageons cette idée depuis un certain temps. D'ailleurs, Mme Defraigne avait déjà déposé un texte en ce sens. Si nous sommes bien conscients que la surveillance électronique n'est pas nécessairement la panacée, nous devons quand même reconnaître que dans certaines hypothèses, c'est un choix judicieux qui pourrait être fait par le juge. En effet, la surveillance électronique permet au condamné d'éviter le passage par la "case prison" qui reste un lieu criminogène, malgré les efforts qui ont été effectués, notamment les nouvelles prisons avec un encadrement un peu différent. Le condamné pourra continuer à travailler, si cela s'avère possible pour lui, et s'il peut encore travailler, il pourra peut-être indemniser les victimes plus facilement. On peut aussi imaginer que cette peine autonome permettra une réinsertion plus facile car il n'y aura pas un isolement immédiat de la vie en société normale.

Enfin, c'est un moyen supplémentaire de lutter contre la surpopulation carcérale mais c'est aussi une façon de faire en sorte que la peine soit effectivement exécutée.

On n'en a peut-être pas assez parlé, mais cette proposition est rendue concrète grâce à l'évolution des moyens technologiques, qui permettent d'éviter les problèmes techniques de suivi. Cette peine peut donc devenir effective et bien comprise par tous.

Pour le MR, cette peine s'inscrit aussi dans une réflexion plus générale sur l'échelle des peines, qui devra intervenir lors de la prochaine législature. C'est un large débat de société dont nous ne pourrons pas faire l'économie.

Pour ces raisons, notre groupe soutiendra ce texte.

Finally, it is an additional way of fighting prison overpopulation but it is also a way of making sure that the sentence is effectively executed.

We may not have talked about it enough, but this proposal is made concrete thanks to the evolution of technological means, which allow to avoid technical problems of monitoring. This punishment can therefore become effective and well understood by everyone.

For the MR, this penalty is also part of a more general reflection on the scale of penalties, which will have to intervene in the next legislature. It is a broad social debate of which we cannot make the economy.

For these reasons, our group will support this text.

Si le principe de la surveillance électronique est très intéressant et qu'il doit pouvoir répondre au fait que toute sanction doit pouvoir être exécutée, le texte qui nous est soumis aujourd'hui est extrêmement peu clair et risque de mettre à mal le principe en lui-même et de compromettre totalement l'objectif recherché.

Un premier point, dont les collègues ont déjà beaucoup parlé, concerne le risque bien réel d'extension du filet pénal, à savoir l'utilisation de la surveillance électronique plutôt qu'une peine de travail ou qu'une suspension du prononcé ou qu'un sursis.

Je ne pourrais que citer un collègue, malheureusement absent, M. Landuyt. On peut lire dans le rapport qu'il mettait en évidence que l'extension du filet pénal était effectivement un risque bien présent et que cela avait été le cas aussi lors de l'instauration de la peine de travail. Il avait été remarqué que les peines de travail étaient davantage utilisées comme peines en tant que telles plutôt que comme alternatives à des peines privatives de liberté.

Ce texte-ci est aussi révélateur puisque la surveillance est limitée aux infractions sanctionnées dans le Code pénal par des peines d'un an. Dans la pratique, elles sont déjà exécutées via le bracelet électronique. C'était une inquiétude que nous avions au début. Au vu des discussions et des auditions, cette inquiétude est confirmée.

Deuxième point, la question du coût budgétaire. Beaucoup de discussions ont eu lieu en commission à ce sujet. La majorité, et notamment les représentants des ministres, ont répondu qu'il y aura un effet de vases communicants entre la surveillance électronique utilisée comme modalité d'exécution d'une peine et celle instaurée comme peine autonome, et qu'il n'y a donc pas à proprement parler de coût budgétaire supplémentaire à envisager.

Je trouve cette réponse assez légère. À mon sens, la pratique apportera des réponses. Ce n'est pas une inquiétude en l'air. Le risque de ce coût budgétaire n'est évidemment pas sans conséquence.

Troisième point, le suivi des personnes sous bracelet électronique. Je pense notamment au travail mené par les maisons de justice. Comme cela a été dit préalablement par d'autres collègues, ce suivi est fondamental.

Une étude de l'INCC met en évidence que les peines de surveillance électronique sont très lourdes non seulement pour la personne condamnée mais aussi, on l'imagine bien, pour l'entourage, la famille qui vit au rythme de cette détention à la maison.

Si l'impact budgétaire est trop élevé, le risque est évidemment aussi que ce suivi ne soit pas fait correctement et que les effets recherchés par la surveillance électronique soient perdus. D'ailleurs, la pratique actuelle du bracelet électronique met en évidence qu'il y a beaucoup d'échecs à l'application de la surveillance électronique et donc de retours en prison. C'est en effet une peine extrêmement lourde à subir.

The third point is the monitoring of people under electronic bracelet. I think in particular of the work carried out by the houses of justice. As previously stated by other colleagues, this follow-up is fundamental.

A study by the INCC highlights that electronic surveillance penalties are very heavy not only for the convicted person but also, you can imagine well, for the surroundings, the family that lives at the pace of this home detention.

If the budgetary impact is too high, the risk is obviously also that this monitoring is not done properly and that the effects sought by electronic surveillance are lost. By the way, the current practice of electronic bracelet highlights that there are many failures in the application of electronic surveillance and therefore returns to prison. This is indeed an extremely heavy punishment to be endured.

                    J'en arrive ainsi au quatrième point que je souhaitais développer. Il constitue un des grands arguments avancés en novembre 2012, quand nous avons entamé nos travaux, à savoir la lutte contre la surpopulation carcérale.

Les auditions ont rapidement mis en évidence qu'il fallait revoir cette ambition car elle manquait de réalisme. Petit à petit, mes collègues en ont été conscients. Ne soyons pas dupes, cette mesure ne résoudra en rien la surpopulation carcérale. En effet, elle sera utilisée comme peine autonome, et il faudra toujours prévoir un retour en prison en cas d'échec. La réalité met en évidence que les échecs sont nombreux. Elle viendra plutôt remplacer d'autres mesures actuelles, notamment celles relatives aux sursis, aux peines de travail. Cela ne palliera donc pas la surpopulation criante dans nos établissements pénitentiaires, ce que je regrette profondément.

J'aborde, enfin, le dernier point qui a été mis en évidence à l'occasion de nos travaux et encore aujourd'hui, et qui conduira tout le groupe Ecolo-Groen à s'abstenir, madame Becq, sur la proposition de Mme Van Cauter. En effet, se pose la question de la difficile coexistence entre la surveillance électronique comme peine autonome et comme modalité d'exécution de peine. Un risque de flou très important existe entre les différentes personnes qui porteront ce bracelet. Il y a un manque de cohérence criant entre les différents outils existants. On se rend compte que, pour des condamnations pour des faits similaires, des peines feront l'objet de surveillance électronique, mais le nombre de jours sous surveillance électronique sera différent. Il y a également la question des délais, de la mise en œuvre et des différentes institutions qui devront assurer le suivi. Il y a un risque très important d'incompréhension, mais aussi un fort sentiment d'injustice puisque des personnes feront l'objet de peines complètement différentes.

La surveillance électronique est un outil très important et très intéressant qui doit pouvoir être mis en place. Mais le texte tel que rédigé contient beaucoup d'incohérences et suscite beaucoup d'inquiétudes, notamment mises en évidence par les acteurs de terrain lors des auditions. Nous verrons si, dans la pratique, cela peut fonctionner et coexister.

So I get to the fourth point that I wanted to develop. It is one of the major arguments put forward in November 2012, when we started our work, namely the fight against prison overpopulation.

The hearings quickly highlighted the need to re-examine this ambition because it lacked realism. Gradually, my colleagues became aware of this. There is a very high risk of confusion between the different people who will wear this bracelet. There is a lack of coherence between the various existing tools. It is realized that for convictions for similar facts, sentences will be subject to electronic surveillance, but the number of days under electronic surveillance will be different. There is also the question of deadlines, implementation and the different institutions that will have to ensure the follow-up. There is a very high risk of misunderstanding, but also a strong sense of injustice as people will be subject to completely different punishments.

Electronic surveillance is a very important and very interesting tool that should be able to be put in place. But the text as written contains a lot of inconsistencies and raises a lot of concerns, ⁇  highlighted by field actors during hearings. We will see if, in practice, this can work and coexist.

Uit wat hier al besproken werd, hebben wij gemerkt dat het met haken en ogen wordt vastgehaakt aan het strafrecht, zoals het nu bestaat. Dat is echter niet ons hoofdargument.

Ons hoofdargument is dat men vandaag overgaat tot de institutionalisering van de capitulatie voor het gebrek aan cellen. Men hangt die nu vast aan de wet. Vandaar dat wij in de commissie een amendement hebben ingediend. Vandaag hebben wij het heringediend, omdat wij vinden dat het elektronisch toezicht het karakter moet hebben van een maatregel waarmee de veroordeelde aan het einde van de straf opnieuw in de samenleving wordt geïntegreerd. Het mag niet zomaar als een gevangenisstrafvervangende maatregel bekeken worden.

Iemand die een gevangenisstraf uitzit, kan aan het einde van zijn straf volgens ons een enkelband krijgen, maar dat is op de weg terug naar de samenleving. Men moet niet thuis worden gestraft met een enkelband, zoals men vandaag in het strafrecht zal inschrijven.

Om deze reden hebben wij een symbolisch amendement ingediend dat ertoe strekt de wet opnieuw buiten werking te stellen vanaf 30 juni 2014. Op het ogenblik dat het amendement van kracht zou worden, als het aanvaard wordt natuurlijk, zou de wet misschien zelfs nog niet eens van kracht zijn, maar wij willen alleen maar onderstrepen dat de toestand precair is en dat men tot die maatregelen moet overgaan omdat men de gevangenisstraffen niet voldoende kan uitvoeren.

Ik laat alle kritieken van andere partijen voor hun rekening. Hier en daar zou ik er mij wel bij kunnen aansluiten, maar ik zal mij niet uitputten in het becommentariëren van wat wij een juiste kritiek en wat wij een minder goede kritiek vinden. Onthoudt u maar dat het Vlaams Belang als enige tegen het elektronisch toezicht als autonome straf is.

As far as I can see from the debates, we are the only principled opponent of electronic surveillance as an autonomous punishment. From what has already been discussed here, we have noticed that it is attached with heels and eyes to the criminal law, as it exists now. However, this is not our main argument.

Our main argument is that today we are moving toward the institutionalization of capitulation for the lack of cells. They are now attached to the law. We have submitted an amendment to the committee. Today we reintroduced it, because we believe that electronic surveillance should have the character of a measure to reintegrate the convicted person into society at the end of the sentence. It should not be seen as a mere substitute for imprisonment.

Someone who serves a prison sentence may, in our opinion, get a single band at the end of his sentence, but that is on the way back to society. One should not be punished at home with a single belt, as one will inscribe today in the criminal law.

For this reason, we have submitted a symbolic amendment aimed at repealing the law from 30 June 2014. At the time the amendment would come into force, if it is accepted, of course, the law might not even be in force, but we only want to emphasize that the situation is precarious and that one must move to those measures because one cannot adequately execute the prison sentences.

I leave all criticisms from other parties to their account. Here and there I could join myself, but I will not exhaust myself in commenting on what we find a correct criticism and what we find a less good criticism. Remember that the Flemish Interest is the only one against electronic surveillance as an autonomous punishment.

Cette proposition suscite cependant diverses incompréhensions, dont une se situe au niveau de l'écriture du texte.

L'article 7 (nouveau) stipule que "lorsqu'un fait est tel qu'il doit être puni d'une peine d'emprisonnement de 1 an au maximum, le juge peut condamner à titre de peine principale à une peine de surveillance électronique d'une durée égale à la peine d'emprisonnement qu'il aurait prononcée".

Par là – et le texte en néerlandais exprime la même idée –, je comprends qu'il s'agit d'un fait punissable d'une peine d'emprisonnement de 1 an au maximum, comme prévu par la loi. Pourtant, l'esprit de tout le travail que nous avons accompli au sujet de cette proposition était qu'il s'agissait de peines punissables de 3 ans ou 5 ans maximum.

Selon ce texte, deux hypothèses sont possibles. La première est qu'il s'agit d'une peine punissable d'un maximum de 5 ans. Dans ce cas, il conviendra de corriger le texte. Sans cela, le texte sera inapplicable. La seconde est que le texte parle d'une peine d'un maximum de 1 an selon le Code. Alors, le texte perd aussi de son sens: la loi prévoit d'ores et déjà que le juge peut prononcer le port du bracelet électronique pour des peines maximales de 1 an d'emprisonnement.

Peut-être s'agit-il d'un problème de toilettage. Sans cela, nous aboutissons à une certaine confusion et incohérence induite par le texte. Si la deuxième hypothèse s'avère telle que je la comprends selon le texte, elle correspond à la situation actuelle, qui prévaut déjà, mais compliquée par le fait que le condamné devra entamer une démarche pour demander la levée du bracelet électronique. Ceci entraînera certainement davantage de manquements à cette condition. Ce serait le retour à la case départ, c'est-à-dire la peine ferme.

Chers collègues, je tenais à partager ces réflexions avec vous et qu'elles soient notées dans les annales. Mes remarques ont pour but d'attirer l'attention sur le fait que, demain, certains juges auront du mal à mettre le texte en application.

This proposal, however, leads to various misunderstandings, one of which lies at the level of writing the text.

Article 7 (new) stipulates that "when a fact is such that it must be punished with a maximum imprisonment of one year, the judge may condemn as the main penalty to an electronic surveillance penalty of a duration equal to the imprisonment penalty he would have pronounced."

Thus – and the Dutch text expresses the same idea – I understand that this is a fact punishable by a maximum sentence of imprisonment of one year, as provided by law. Nevertheless, the spirit of all the work we did on this proposal was that it was punishable punishments of 3 years or 5 years maximum.

According to this text, two assumptions are possible. The first is that this is a punishable sentence of a maximum of 5 years. In this case, the text should be corrected. Otherwise, the text will be inapplicable. The second is that the text speaks of a sentence of a maximum of 1 year according to the Code. Then, the text also loses its meaning: the law already provides that the judge can pronounce the wear of the electronic bracelet for maximum sentences of 1 year of imprisonment.

Per ⁇  it is a toilet problem. Without this, we end up with some confusion and inconsistency induced by the text. If the second hypothesis is as I understand it according to the text, it corresponds to the current situation, which already prevails, but complicated by the fact that the convicted person will have to take a step to request the removal of the electronic bracelet. This will ⁇  lead to more shortcomings to this condition. This would be the return to the starting point, i.e. the firm punishment.

Dear colleagues, I wanted to share these thoughts with you and let them be noted in the annals. My comments are meant to draw attention to the fact that tomorrow some judges will find it difficult to put the text into effect.

Monsieur le président, madame la ministre, chers collègues, la commission des Affaires sociales a examiné le projet de loi présenté par la ministre de la Santé publique et des Affaires sociales, Laurette Onkelinx, au cours de sa réunion du 10 décembre 2013. Ce projet a été adopté à l'unanimité. Il prévoit la suppression de la carte SIS au profit de la carte d'identité électronique et, dans un nombre de cas plus limité, la carte SIS sera remplacée par la carte ISI+. Cette réforme permettra d'identifier le patient et de consulter ses données d'assurabilité sur un réseau sécurisé.

La ministre de la Santé nous a présenté les avantages de l'utilisation de la carte d'identité électronique: identification formelle de l'assuré, consultation des données actualisées d'assurabilité des patients, simplification administrative pour le patient et le prestataire de soins, plus grande protection de la vie privée.

Pour les personnes qui n'ont pas de carte d'identité électronique, c'est-à-dire les enfants de moins de douze ans, les travailleurs frontaliers, les pensionnés qui ont payé des cotisations et qui résident à l'étranger, les étrangers qui payent des cotisations mais qui n'ont pas de carte d'identité, la carte ISI+ sera instaurée et sera gratuite.

À partir du 1ᵉʳ janvier, cette carte ISI+ sera automatiquement délivrée pour chaque nouveau-né. Les cartes SIS périmées d'enfants de moins de douze ans seront remplacées par la carte ISI+. Plus aucune carte SIS ne sera délivrée et l'assuré social ne devra accomplir aucune démarche. Seuls les prestataires de soins qui se seront préalablement identifiés pourront avoir un accès sécurisé aux banques de données des mutualités. Cette identification sécurisée se fera par le biais de la plate-forme eHealth, sur laquelle il est vérifié pour chaque connexion si le prestataire de soins est autorisé à consulter les données en question. Les données d'assurabilité seront actualisées automatiquement.

M. De Croo, Mme Sminate, M. Vercamer et votre serviteur ont exprimé leur satisfaction en ce qui concerne cette réforme. Lors des échanges en commission, M. De Croo s'est notamment interrogé sur le nombre de titulaires de la carte ISI+. Mme Sminate s'est enquise du coût de production de la nouvelle carte et des prestataires qui pourront avoir accès par le biais des eID. M. The Social Affairs Committee examined the bill submitted by the Minister of Public Health and Social Affairs, Laurette Onkelinx, at its meeting on 10 December 2013. As of January 1, this ISI+ card will be automatically issued to every newborn. Aged SIS cards for children under 12 years of age will be replaced by the ISI+. No more SIS cards will be issued and the Social Insurer will not have to take any action. Only care providers who have previously identified themselves will be able to have secure access to mutuality databases. This secure identification will be made through the eHealth platform, on which it is checked for each connection if the health care provider is authorized to consult the data in question. Security data will be updated automatically.

The Minister also acknowledged that the number of holders of an ISI+ card could however be significantly reduced if the Kids-ID was made mandatory from birth.                     Mijnheer de voorzitter, beste collega’s, het wetsontwerp wil diverse bepalingen inzake verkiezingen aanpassen. Het gaat om een aantal technische aanpassingen in verband met de federale verkiezingen. Het is de bedoeling dat deze aanpassingen reeds van toepassing zijn op de eerstkomende federale verkiezingen van 25 mei. Ik schets een aantal belangrijke krachtlijnen van het wetsontwerp.

Dit betekent een belangrijke vooruitgang voor kiezers met een handicap die zich kunnen laten begeleiden door een persoon van hun keuze. Ook zeer interessant is dat de verkiezingsresultaten die tot nu toe werden meegedeeld op het niveau van het kanton nu op het niveau van de gemeente zullen worden meegedeeld. Wij zullen dus meer informatie kunnen krijgen. Op de voordrachtsakte van de kandidaten kan de gebruikelijke en niet-officiële naam van een kandidaat vermeld worden. Ook bestaat de mogelijkheid voor kandidaten van beide geslachten om hun naam aan te vullen met de identiteit van de echtgenoot of echtgenote.

Deze materie werd behandeld tijdens de commissievergadering van 11 december. Er waren amendementen van de heer Arens van cdH en alles werd eenparig goedgekeurd.

Ook namens de N-VA kan ik mij hierbij aansluiten. Wij hebben het ontwerp goedgekeurd en zullen dat vandaag opnieuw doen. Wij hadden echter nog een stap verder willen gaan. Ik verwijs naar een wetsvoorstel van de MR, dat een aantal maanden geleden opnieuw werd ingediend, voor de afschaffing van de devolutieve werking van de lijststem en de afschaffing van de opvolgers. Volgens ons mocht het zelfs die richting uitgegaan zijn, maar dat is misschien iets voor in de toekomst. Hopelijk maakt u daar nog voor de verkiezingen werk van.

Dit wetsontwerp krijgt in ieder geval onze steun.

The draft law is intended to amend several provisions concerning elections. This includes a number of technical adjustments in connection with the federal elections. It is intended that these adjustments will already apply to the upcoming federal elections on 25 May. I will outline a number of key strengths of the draft law.

This means significant progress for disabled voters who can be accompanied by a person of their choice. It is also very interesting that the election results communicated so far at the canton level will now be communicated at the municipal level. So we will be able to get more information. The nomination act of the candidates may include the usual and unofficial name of a candidate. There is also the possibility for candidates of both sexes to supplement their name with the identity of the spouse.

This issue was discussed at the committee meeting on 11 December. There were amendments by Mr. Arens of CDH and all were unanimously approved.

On behalf of the N-VA, I can also agree with this. We approved the draft and will do so again today. However, we would have wanted to go a step further. I refer to a bill proposed by the MR, which was re-submitted a few months ago, for the abolition of the devolving function of the list vote and the abolition of the successors. We think it might even have gone in that direction, but that may be something for the future. Hopefully you will work on this before the elections.

This bill will at least get our support.

                    Monsieur le président, madame la ministre, chers collègues, vous me permettrez de réunir en une seule intervention notre point de vue sur les deux projets touchant à l'organisation des élections du 25 mai prochain.

Tout d'abord, je tiens à souligner l'importance de ces textes. Il serait exagéré, sans doute, de dire que notre système démocratique traverse une période de crise. Nous devons néanmoins bien constater que le nombre de citoyens qui ne se rendent pas aux urnes pour accomplir leur devoir va croissant d'élections en élections. Cela ne peut être que l'expression d'un malaise.

Au contraire des déclarations de certains qui préfèrent casser le thermomètre plutôt que de soigner la fièvre, ces projets vont dans le bon sens. Ils facilitent les opérations de vote et en renforcent la transparence. Dans le même mouvement, même s'ils ne peuvent suffire à rendre aux citoyens un intérêt pour la chose publique, qui dépend surtout de la façon dont les élus s'acquittent du mandat, ces projets participent ainsi à faciliter l'expression pour l'électeur des choix qu'il pose pour notre société.

Ce constat posé, je souhaiterais intervenir sur un point de fond du dossier. Ce sera pour me féliciter de l'attention qui est portée à faciliter la participation des personnes en situation de handicap aux opérations de vote. Certes, j'ai pu exprimer en commission mon inquiétude quant au fait que désormais, les personnes en situation de handicap physique, intellectuel ou sensoriel seraient autorisées à se faire accompagner dans l'isoloir par une personne de confiance plutôt que par le président du bureau de vote.

Ma crainte était que la nouvelle définition ne soit lue d'une manière fort large et ne finisse par englober dans la notion de handicap des problèmes qui ne relèvent pas de la médecine. Je pense notamment aux difficultés rencontrées par certains de nos seniors face aux machines de vote électronique.

Vous m'avez rassurée quant au fait que les personnes qui rencontrent ce type de difficultés resteront de la responsabilité du président de bureau. Cela me paraît essentiel, puisque celui-ci est le seul en mesure d'incarner l'indispensable secret de l'isoloir.

Je tiens d'ailleurs à conclure mon intervention en saluant par avance les présidents de bureau, ces citoyens ordinaires qui au cours de la journée du 25 mai incarneront l'État et la démocratie belges avec rigueur et compétence; ainsi que tous les Belges qui participeront comme assesseurs aux opérations de vote. J'ajouterai aussi tous ces agents communaux qui veilleront au bon déroulement du processus démocratique.

C'est leur dévouement et leur engagement au cours de cette journée qui incarnent le mieux la beauté et l'honneur de notre système électoral. Qu'ils soient d'ores et déjà remerciés du temps qu'ils consacreront à la vie démocratique de notre pays. Je vous remercie de votre attention.

First, I would like to emphasize the importance of these texts. It would ⁇  be exaggerated to say that our democratic system is going through a period of crisis. However, we must note that the number of citizens who do not go to the polls to fulfill their duty is increasing from elections to elections. This can only be an expression of discomfort.

Contrary to the statements of some who prefer to break the thermometer rather than treat the fever, these projects go in the right direction. They facilitate voting operations and enhance transparency. In the same movement, although they cannot be enough to give citizens an interest in the public thing, which depends above all on how the elected people fulfill the mandate, these projects thus participate in facilitating the expression for the voter of the choices he makes for our society.

I would like to comment on a substantial point of the matter. I would like to welcome the attention being paid to facilitating the participation of persons with disabilities in voting operations. Certainly, I was able to express in a committee my concern that from now on, persons with physical, intellectual or sensory disabilities would be allowed to be accompanied in the isolator by a trusted person rather than by the chairman of the voting office.

My fear was that the new definition would be read in a very broad way and would eventually include in the notion of disability problems that do not fall within the scope of medicine. I think in particular of the difficulties encountered by some of our seniors in the face of electronic voting machines.

You reassured me that those who encounter this type of difficulty will remain the responsibility of the chairman of the office. This seems to me essential, since this is the only one capable of embodying the indispensable secret of the isolator.

I would also like to conclude my speech by greeting in advance the Chairmen of the Bureau, those ordinary citizens who during the day of May 25 will embody the Belgian State and democracy with rigour and competence; as well as all the Belgians who will participate as advisors in the voting operations. I will also add all those community agents who will ensure the proper progress of the democratic process.

It is their dedication and commitment during this day that best embodies the beauty and honor of our electoral system. Let them be grateful for the time they will devote to the democratic life of our country. I thank you for your attention.

Nous espérons que nous aurons encore l'occasion d'avancer sur le langage simplifié car il est utile non seulement pour les personnes qui ont des difficultés de compréhension mais aussi pour l'ensemble des citoyens qui reçoivent une convocation de vote, qui reprend notamment toutes les mentions légales, et qui ne comprennent pas directement ce qu'on leur veut. Dans des domaines aussi importants que l'accès au vote, nous espérons qu'il y aura cette volonté de travailler dans un langage le plus simplifié possible.

Madame la ministre, vous m'aviez répondu que ce n'était malheureusement pas possible pour les convocations électorales car l'ensemble du document était totalement figé. Mais comme on sait que dans ce parlement, on peut toucher à tout, j'espère que nous aurons l'occasion de proposer un texte plus simple, qui fait que chacun sera plus à l'aise quand il recevra sa convocation et comprendra tout de suite de quoi il s'agit. Plus généralement, dans énormément de domaines administratifs, on envoie des documents beaucoup trop compliqués aux gens, qui ne perçoivent pas directement de quoi il s'agit.

Since I have not commented on the report, I will repeat what I have said.

The arrangements to make places more accessible seem to us really are going in the right direction. The fact that this is flooded into a law will help move forward.                     Mijnheer de voorzitter, mevrouw de minister, beste collega’s, in dezelfde vergadering van 11 december 2013 werd ook het wetsontwerp tot organisatie van de elektronische stemming met papieren bewijsstuk behandeld. Het is eveneens de bedoeling om de regeling in werking te laten treden tegen de eerstvolgende federale verkiezingen van 25 mei.

In 201 van de 589 gemeenten over het hele grondgebied werd reeds elektronisch gestemd. Er drong zich dus een evaluatie op en een en ander moest worden vervolmaakt. Vandaar werd het voorliggend wetsontwerp uitgewerkt.

Het komt erop neer dat een nieuw elektronisch stemsysteem met een papieren bewijs zal worden gebruikt. De kiezer brengt zijn stem uit. Bij de laatste bevestiging van zijn stem drukt de stemcomputer een papieren bewijsstuk af. Zo kan de kiezer controleren of zijn stem juist werd opgenomen. Uiteraard moet hij dat bewijs teruggeven en wordt het in een urne gedeponeerd. Dat is de inhoud van het wetsontwerp.

Daarop werden een aantal opmerkingen geformuleerd. Collega Logghe wijst op diverse moeilijkheden van het elektronisch stemsysteem in de praktijk, net zoals mevrouw Genot van Ecolo-Groen. De MR betreurt, bij monde van de heer Ducarme, dat men in het Waals Gewest nog niet die weg is ingeslagen. De minister hoopt dat de geesten rijpen en dat er meer uniformiteit komt.

De bespreking werd in dezelfde vergadering volledig afgehandeld. De heer Arens diende amendementen in om de bepalingen in overeenstemming te brengen met de wijzigingen in de wetgeving ten gevolge van de hervorming van de Senaat. Uiteindelijk werd het ontwerp goedgekeurd met twaalf stemmen voor en twee onthoudingen.

De N-VA kan zich bij het ontwerp aansluiten: de gemeentelijke autonomie blijft gewaarborgd. De gemeente kan inderdaad nog steeds beslissen of op haar grondgebied al dan niet elektronisch wordt gestemd. Er is bepaald dat de federale overheid 20 % van de kosten op zich kan nemen. Wij vinden het ook belangrijk dat gevolg werd gegeven aan de aanbeveling van de Raad van State in verband met de begeleiding van gehandicapte personen. Bijgevolg zullen wij ook in de plenaire vergadering het ontwerp steunen.

The MR regrets, according to Mr. Ducarme’s opinion, that in the Waals Region this path has not yet been taken. The minister hopes that the spirits will mature and that there will be more uniformity.

The discussion was fully resolved at the same meeting. Mr Arens submitted amendments to align the provisions with the legislative changes resulting from the Senate reform. Eventually, the draft was approved with twelve votes in favour and two abstentions.

The N-VA can join the design: municipal autonomy remains guaranteed. The municipality can still decide whether to vote electronically on its territory or not. It is provided that the federal government can bear 20 % of the costs. We also consider it important that the recommendation of the State Council regarding the guidance of persons with disabilities has been followed. Therefore, we will also support the draft in the plenary session.

                    Monsieur le président, madame la ministre, chers collègues, au XIXᵉ siècle, la révolution industrielle a profondément bouleversé la société; elle a notamment favorisé une mutation de l'approche démocratique et électorale.

Aujourd'hui, au XXIᵉ siècle, c'est une révolution numérique que nous vivons; une révolution que certains qualifient de troisième révolution industrielle et qui modifie profondément nos comportements.

Ce constat vaut aussi pour tout ce qui concerne le rapport des individus envers l'exercice de la démocratie. Ainsi, les citoyens disposent de nouveaux moyens pour s'informer, pour débattre et aussi pour voter.

Sur le plan de l'exercice électoral, cette révolution se traduit par l'émergence de nouveaux moyens de pratiquer le vote.

Le vote automatisé, plus communément dénommé vote électronique est ce que le CRISP définit comme "le procédé permettant à l'électeur d'émettre son suffrage au moyen d'un ordinateur et d'un crayon optique et à déposer la carte magnétique sur laquelle son vote est enregistré dans une urne électronique".

Dans ce domaine, notre pays est considéré comme un pionnier. Souvenons-nous que le vote électronique a été utilisé pour la première fois, à titre d'essai, en 1991. La loi du 11 avril 1994 a fixé le cadre légal de son usage; elle a été modifiée à plusieurs reprises depuis lors.

Depuis ses prémices, le vote électronique a soulevé de nombreuses critiques. La garantie de transparence, la fidélité aux choix de l'électeur et les moyens de contrôle que ce type de vote permet sont d'ailleurs régulièrement replacés au cœur des débats. Ces diverses critiques ont entraîné l'adoption de certaines mesures visant à renforcer le contrôle démocratique sur le bon fonctionnement de ce système de vote.

Le projet que nous sommes amenés à voter aujourd'hui renforce un peu plus les mécanismes garantissant la transparence de l'exercice du vote. En conférant un cadre légal à l'utilisation d'un nouveau système de vote électronique qui sera accompagné d'une preuve papier lors de l'élection de compétences fédérales, cette nouvelle disposition permet d'étendre le principe de contrôle démocratique de ce système de vote en tenant compte de l'évolution des technologies et des nouvelles exigences démocratiques.

Par ailleurs, ce projet répond de manière constructive et pragmatique aux critiques qui étaient formulées à l'encontre du vote automatisé.

À cet égard, je tiens à saluer ma collègue Corinne De Permentier: voilà dix ans, elle déposait une proposition de loi similaire au projet que nous allons voter. Malheureusement, à cette époque, elle devait faire face à certains conservatismes que mes collègues du Parlement wallon doivent encore affronter aujourd'hui, en 2014.

En effet, s'il y a bien un bémol à formuler à l'égard de ce projet, c'est qu'en 2011, le gouvernement wallon a décidé de revenir en arrière et de réinstaurer le vote papier en Wallonie, alors que certaines communes utilisaient parfois depuis vingt ans le système électronique avec une satisfaction totale.

Mr. Speaker, Mrs. Minister, dear colleagues, in the nineteenth century, the industrial revolution profoundly troubled society; in particular, it promoted a change in the democratic and electoral approach.

Today, in the 21st century, it is a digital revolution that we are living; a revolution that some call the third industrial revolution and that profoundly changes our behaviors.

This also applies to everything concerning the relationship of individuals to the exercise of democracy. Thus, citizens have new ways to inform themselves, to debate and also to vote.

On the level of the electoral exercise, this revolution translates into the emergence of new ways of practicing voting.

Automated voting, more commonly referred to as electronic voting, is what the CRISP defines as "the process allowing the voter to issue his vote using a computer and an optical pen and to deposit the magnetic card on which his vote is recorded in an electronic urn."

In this area, our country is considered a pioneer. Electronic voting was used for the first time as a trial in 1991. The law of 11 April 1994 established the legal framework for its use; it has been modified several times since then.

Since its inception, electronic voting has raised many criticisms. The guarantee of transparency, the loyalty to the choices of the voter and the means of control that this type of vote allows are regularly replaced at the heart of the debates. These various criticisms have led to the adoption of certain measures aimed at strengthening democratic control over the proper functioning of this voting system.

The bill we are supposed to vote today strengthens the mechanisms that guarantee the transparency of the exercise of the vote. By providing a legal framework for the use of a new electronic voting system that will be accompanied by paper proof in the election of federal jurisdictions, this new provision extends the principle of democratic control of this voting system, taking into account the evolution of technologies and new democratic requirements.

Furthermore, this project responds constructively and pragmatically to the criticism that was formulated against automated voting.

In this regard, I would like to congratulate my colleague Corinne De Permentier: ten years ago, she filed a bill similar to the bill we are going to vote on. Unfortunately, at that time, it had to face certain conservatisms that my colleagues in the Walloon Parliament still have to face today, in 2014.

Indeed, if there is a good thing to formulate regarding this project, it is that in 2011, the wallon government decided to go back and reinstate paper voting in Wallonia, while some municipalities sometimes used the electronic system for twenty years with total satisfaction.

Chers collègues, ma conception de la modernité n'est pas celle-là. Elle ne consiste pas à un retour vers des pratiques datant d'un autre siècle. Au contraire, j'estime qu'il est nécessaire et indispensable de s'adapter aux évolutions technologiques de notre société. Là où la Wallonie fait, en 2011, le choix d'un retour en arrière, le gouvernement fédéral fait le choix de la modernité et de la transparence. C'est un choix auquel mon groupe se rallie sans la moindre réserve.

Je profite de l'occasion qui m'est offerte à cette tribune pour demander à mes collègues, qui ont certains relais et des contacts auprès des partis de la majorité en Wallonie, de revoir leur copie pour homogénéiser la procédure de vote en 2014.

Madame la ministre, je vous adresse la même demande. En tant que porteuse de ce projet au niveau fédéral, je ne doute pas une seule seconde que vous réussirez à convaincre vos partenaires à la Région wallonne de choisir la modernité plutôt que la désuétude.

C'est ce que l'ensemble des experts à l'époque avaient déjà détecté. On le constate, le vote électronique n'est pas infaillible.

                    Depuis lors, on a essayé de l'améliorer de diverses manières. La dernière tentative est celle qui nous est proposée. Une des grandes critiques du système électronique est que le citoyen a beaucoup moins de possibilités de vérifier ce qu'il a effectivement voté et ce qu'il met dans l'urne.

Le projet "ticketing" a ainsi été développé et de nouveaux problèmes se sont présentés. Malgré les essais effectués et les multiples rapports d'experts disant que le système fonctionnait bien, deux problèmes sont survenus. D'une part, si le président agissait sur son ordinateur, il coinçait certains votes. D'autre part, il y avait le problème du "double clic" sans que l'on ne s'en rende compte. Pour ce problème, des solutions ont été proposées mais ce "double clic" a eu des effets électoraux, dans le sens où les gens votaient pour une liste et puis pour un candidat sans s'en rendre compte, du fait que le candidat était juste en dessous du premier vote et que l'écran était trop sensible. Il y avait pourtant eu des essais et des sociétés ont été payées très cher pour nous dire que le système fonctionnait parfaitement.

À cette occasion, on a même vu le secrétaire d'État en charge de la Modernisation des Services publics, M. Bogaert, dire qu'il souhaitait qu'on en revienne au vote papier. Malheureusement, ce n'est donc pas si simple de dire que l'on est en faveur de la modernité et du vote électronique. Le vote électronique est complexe. Je vous vois tous travailler tous les jours sur vos ordinateurs et gsm. Ce sont des outils extraordinaires mais qui présentent fréquemment des petits ratés. En l'occurrence, la difficulté réside dans le fait que les citoyens sont en droit d'attendre zéro erreur! Ils veulent que leur voix soit entendue et qu'aucun problème ne puisse survenir. Or, on ne peut le leur garantir. De fait, à chaque fois qu'il y a des élections, des petits problèmes sont survenus.

Élections après élections, on propose des textes pour essayer d'améliorer le système, tout en sachant que d'autres problèmes se présenteront.

Pour ce qui est du contrôle démocratique, un effort est fait dans le sens où les citoyens reçoivent un ticket et voient ainsi plus clair. En outre, on a la possibilité de recompter les tickets. Néanmoins, passer par un ordinateur affaiblit très clairement l'emprise du citoyen sur le fait de poser son vote et sur le dépouillement postérieur, qui est par conséquent beaucoup plus centralisé dans les mains des experts.

When it comes to democratic control, an effort is made in the sense that citizens get a ticket and thus see clearer. There is also the possibility to recalculate tickets. Nevertheless, going through a computer very clearly weakens the citizen’s influence on the fact of putting his vote and on the subsequent deprivation, which is therefore much more centralized in the hands of experts.

                    Le troisième problème posé est le coût. Les communes connaissent de plus en plus de difficultés financières. Elles doivent faire face à d'importants besoins, or tous ces systèmes sont très coûteux.

On le voit d'ailleurs depuis plusieurs jours dans le procès entre la Région wallonne et toute une série de communes liégeoises à qui on a envoyé la facture: le vote électronique coûte cher et cette facture se répartit sur plusieurs acteurs. C'est la raison pour laquelle on se demande de plus en plus souvent s'il n'est pas plus sage de repartir vers le vote papier, plus maîtrisé et moins coûteux.

Une autre question se pose à laquelle on n'a pas répondu en commission. Normalement, l'électeur émet un vote pour la Chambre, un vote pour la Région et un vote pour l'Europe. Ici, il va y avoir un petit ticket regroupant les trois votes. On va pouvoir dire qu'une personne X a voté pour le candidat X à la Chambre, pour une autre liste à l'Europe ou encore pour le candidat Y à la Région. Les bulletins de vote deviennent donc plus faciles à tracer car ils reprennent tous les votes de l'électeur. On change ainsi un principe démocratique. Jusqu'ici, les électeurs déposaient leurs votes bulletin par bulletin. On ne savait donc pas faire le lien entre ces différents votes. Désormais, on ne peut plus garantir à l'électeur qu'on ne pourra pas tracer ses votes. Le secret du vote est-il encore garanti?

Imaginons une personne payant une autre pour qu'un certain vote soit émis. On sait vérifier si ce vote a été émis puisqu'on sait vérifier si quelqu'un a voté pour le candidat X à la première élection, un tel candidat à la deuxième élection, un tel autre à la troisième élection. Si ce bulletin n'existe pas, c'est que la personne n'a pas respecté sa promesse!

Ce nouveau système est induit par la machine. C'est difficilement acceptable.

Je n'aime pas cette intrusion technologique dans le système électoral. Je préfère la vieille méthode, simple et efficace, la méthode du vote papier, la méthode qui respecte les citoyens.

Je sais qu'on invoque parfois des arguments stupides en faveur du vote électronique, l'écologie par exemple. Comme si nous allions favoriser l'écologie en optant pour le vote électronique, comme si le fait de produire des machines à voter n'avait aucun coût énergétique! Cet argument ne tient évidemment pas la route. Que ceux qui veulent sauver l'écologie commencent par empêcher l'exploitation du bois des forêts tropicales ou les cultures intensives made in Monsanto, qu'ils commencent par inciter au développement des nouvelles sources d'énergie propres et durables, qu'ils commencent en fait par la racine des problèmes. De grâce, n'invoquons pas cela pour les élections, c'est un peu risible! Si vous le faites, commencez déjà par supprimer les tracts électoraux avec lesquels vous remplissez, à coup de millions d'euros, les boîtes aux lettres de nos concitoyens. Ce serait déjà un premier pas pour la nature.

On utilise souvent l'argument écologique car il n'y a pas d'autres arguments à utiliser. Vous n'allez pas dire que le vote électronique est pratique parce qu'il permet de bien alimenter les soirées électorales à la télévision. Avant, cela prenait du temps de dépouiller. Aujourd'hui, avec un petit coup de baguette magique, on a le résultat qui tombe tout juste pour l'émission de la soirée électorale. Comme par hasard! J'imagine que c'est une coïncidence!

Ne cherchons pas d'excuse, dans un pays comme la Belgique, où tous les partis ont décidé de s'entendre pour squatter le pouvoir. On a même décidé de faire les élections régionales et fédérales en même temps. On a fait en sorte que ce soit toujours comme ça; donc, on a déjà déterminé que le gouvernement fédéral ne tomberait plus jamais. C'est pratique, c'est logique! Dans de telles conditions, avec des gens qui ont décidé de conserver le pouvoir, le vote électronique vous plaît! Cela vous permet de manipuler le résultat des élections comme bon vous semble! Avec le vote électronique, plus personne ne pourra vérifier les résultats. Tout est dans un ordinateur.

La presse et la télévision se sont déjà emparées de ce débat houleux autour du vote électronique et les inquiétudes, les questions, les risques demeurent. Rien n'a changé, malgré les débats.

You won’t say that electronic voting is convenient because it makes it possible to feed the election evenings on television. Before, it took time to get rid of it. Today, with a little magic stick, we have the result that just falls for the broadcast of the election evening. As by chance! I think this is a coincidence!

Let us not seek excuses, in a country like Belgium, where all parties have decided to agree to squat the power. The federal and regional elections were held at the same time. We have made sure that it is always so; therefore, we have already determined that the federal government will never fall again. It is practical, it is logical. Dois-je rappeler qu'un informaticien néerlandais à réussi à se procurer une machine utilisée pour le vote électronique en France et qu'il a prouvé devant les caméras d'i>Télé que c'était un jeu d'enfant de pirater la puce installée à l'intérieur de cette console?

D'ailleurs, beaucoup de personnes militent contre ces ordinateurs de vote. Mais une fois de plus, à vos yeux, ces gens n'existent pas. Ce sont des conspirateurs, des personnes qui ne réfléchissent pas convenablement, qui inventent des histoires. Nous avons l'habitude, nous le savons: ces personnes sont toujours stigmatisées.

Dans quelques années, et je ne plaisante pas, étant donné l'extrême passivité due à la complicité des médias-mensonges du peuple belge par rapport aux mesures antidémocratiques que vous prenez à longueur de temps, vous proposerez peut-être un projet de loi qui permet au citoyen de ne plus aller voter. Ben oui! On sait très bien, n'allez pas voter. C'est pratique, parfois.

Si on demandait l'avis de la population par référendum, je mets ma main à couper qu'elle ferait savoir qu'elle n'a aucune confiance dans ce système de vote électronique. Et elle a bien raison de ne plus vous faire confiance!

Bien entendu, vous ne lui laissez pas le droit de choisir. Il en va de même pour tout le reste puisqu'il est stipulé à l'article 3 qu'il revient au Roi, par arrêté délibéré en Conseil des ministres, de choisir où sera appliqué le vote électronique et les conditions générales d'agrément qui garantissent la fiabilité et la sécurité du système ainsi que le secret du vote. Le Roi, ce même Roi qui fréquente, depuis des années, ce groupe élitiste et secret qu'est le Bilderberg. On devrait lui faire confiance! Il y a de quoi rire! Vous voudriez qu'on lui fasse confiance! Le peuple et l'élite sont deux sphères aux intérêts diamétralement opposés. Mais encore faut-il que les gens se réveillent pour comprendre ce qui leur arrive.

Vous dites également que l'entretien et la conservation du matériel seront assurés par les communes qui gèrent leurs biens en bon père de famille. Si c'est comme les voiries, cela promet!

Que pensera le citoyen quant à la fiabilité de ces machines le jour des élections? Pensez-vous sincèrement que le citoyen a encore une once de confiance envers son gouvernement et ses méthodes, envers le déroulement du vote électronique? Le droit de regard du citoyen se voit amoindri. C'est plus confus. C'est moins transparent. Cela joue le jeu des politiciens menteurs et manipulateurs. Cela va de soi!

Bien sûr, pour calmer les esprits, vous avez prévu un système où le vote électronique est confirmé par l'impression d'un document papier. Ce faisant, l'argument écologique tombe! Une fois que le citoyen aura validé son vote sur l'écran, il devra plier en deux la feuille qui sera imprimée. Puis, il sera invité à se diriger vers l'urne pour y déposer son vote. Les preuves papier seront, ensuite, mises dans une enveloppe scellée – on vous fait confiance – et gardées bien au chaud.

Pourquoi ne pas permettre un comptage des voix papier après le vote, parallèlement au dépouillement électronique? Cela permettrait peut-être de veiller au bon fonctionnement du système. Finalement, savons-nous si ce système fonctionne? On ne l'a jamais testé!

Do you honestly think that the citizen still has an ounce of confidence in his government and its methods, in the course of electronic voting? The right of view of the citizen is diminished. It is more confusing. It is less transparent. This plays the game of liars and manipulators politicians. This is of course!

Of course, to calm the minds, you have planned a system where electronic voting is confirmed by printing a paper document. In doing so, the ecological argument falls! Once the citizen has validated his vote on the screen, he will have to fold in two the sheet that will be printed. He will then be invited to go to the urn to vote there. The paper evidence will then be placed in a sealed envelope – we trust you – and kept warm.

Why not allow a paper counting of votes after voting, in parallel with electronic deprivation? This may help ensure the proper functioning of the system. Finally, do we know if this system works? It has never been tested!

Déjà, vous n'avez même pas la compétence intellectuelle pour me comprendre!

L'article 17 nous dit que c'est au ministre de l'Intérieur ou à son délégué qu'il incombe d'élaborer les logiciels électoraux et de publier, dans la semaine qui suit le jour de l'élection, ce dit logiciel sur le site internet du ministère de l'Intérieur. Pourquoi ne pas le publier une semaine plus tôt, afin de permettre à ceux qui le désirent d'étudier son fonctionnement?

Vous parlez également d'un certain collège d'experts permanents et d'un collège d'experts non permanents. Ces experts élus pour cinq ans sont des spécialistes en informatique et sont désignés par les quatre parlements régionaux et par le parlement fédéral. Donc, ils ne sont pas désignés démocratiquement. Ils ne sont pas non plus tirés au sort. Ce ne sont pas des citoyens en qui on pourrait avoir confiance. Non, ces 14 experts, qui doivent également avoir des compétences en droit, sont-ils fiables? Je me le demande. J'ai des doutes. Je peux être parano, mais il me semble qu'il se passe de nombreuses choses étranges un peu partout dans nos institutions. Et moi, j'ai le droit, et même le devoir, de me poser des questions sur le déroulement de ce type de vote. En dehors de ces experts, il n'est nullement prévu un contrôle de la part des citoyens dans tout ce processus.

Par ce système, vous êtes donc parvenus à retirer au citoyen tout contrôle sur les élections. Vous volez nos libertés, vous faites honte à la démocratie.

Alors qu'aucun citoyen n'entre en compte dans les étapes de contrôle des votes, les experts ont quant à eux, comme mentionné à l'article 25, la quasi-totalité des tâches qui consistent à contrôler le bon déroulement des élections. C'est bien pratique! Je suis persuadé qu'il faudra un peu de temps, mais le citoyen se rendra compte un jour qu'il s'est fait gruger; une fois de plus.

L'alinéa 3 de ce même article nous stipule que "les experts sont tenus au secret". Ah, le secret! "Toute violation de ce secret sera sanctionnée conformément à l'article 458 du Code pénal".

Vous ne vous rendez pas compte que nous en avons ras-le-bol de vos secrets, ras-le-bol de ces mensonges et de ces cachotteries. Nous voulons de la transparence. Les socialistes, vous avez compris? Transparence. Peut-être ne connaissez-vous pas le mot puisque vous ne l'appliquez pas, vous ne la pratiquez pas depuis des années au pouvoir. Je me demande si ce n'est pas lorsqu'on a quelque chose à cacher.

J'invite les concitoyens à prendre connaissance de la méthodologie que vous préconisez en lisant ce projet de loi organisant le vote électronique, avec preuve papier. S'ils ont le courage d'aller jusqu'au bout, étant donné la lourdeur du jargon utilisé et les mentions récurrentes aux différents règlements et dispositions légales existantes, etc., ils s'apercevront qu'ils n'ont aucune place dans le processus électoral. Ni concernant le contrôle de la fiabilité de ce système ni concernant le contrôle des scrutins finaux.

Si, je les comprends après avoir découvert au long de ces quatre années passées à vos côtés le mépris que vous pouvez avoir pour le peuple et la démocratie. Je suis un accident de la démocratie, comme l'a si bien dit M. Flahaut. Et j'en suis fier, monsieur Thiéry. C'est peut-être la seule chose intelligente que M. Flahaut ait dite durant cette législature. Et c'est lourd de sens.

Si je suis toujours en vie d'ici là, oserait-on me laisser être réélu quand on voit l'acharnement médiatique dont je suis victime. Il y a pourtant de nombreux Belges debout avec moi – bien que maintenant, ils soient assis en salle de projection – qui attendent un véritable changement dans ce pays, des Belges qui attendent d'autres élus, des élus qui portent un discours de vérité, de sincérité, sans les tabous que vous vous fixez, pour bénéficier de représentants plus justes, plus à l'écoute et faisant preuve de bonne volonté.

Cette frange de la population mérite d'être entendue, d'être respectée et d'être représentée, même si je crains que le vote électronique n'ait que pour seul et unique but de vous permettre de manipuler le résultat des élections pour mieux vous garantir votre place au soleil, mais surtout pour préserver ce système que vous défendez parce qu'il vous nourrit mais qui pourtant est à bout de souffle.

Je voterai donc contre ce projet qui retire au citoyen son droit élémentaire de contrôle des élections. Je ne peux pas accepter de cautionner un système dans lequel le pouvoir en place est juge et partie.                     Mijnheer de voorzitter, collega’s, mevrouw de minister, het voorliggend wetsontwerp heeft de hervorming van de Raad van State als voorwerp. De aanleiding voor deze hervorming was de kritiek die de Raad van State de laatste jaren heeft moeten ondergaan. Het ging dan om kritiek over de doeltreffendheid van de administratieve rechtspraak. Ook het kort geding en bepaalde maatregelen worden vaak als overdreven formalismen ervaren. De macht van de Raad van State om een akte nietig te verklaren, werd soms als onevenredig gezien ten opzichte van de onregelmatigheden die werden gesanctioneerd.

Tegen die achtergrond werd in het regeerakkoord in een hervorming voorzien. Ik citeer: “Om beter aan de concrete bekommernissen te beantwoorden, zal de regering, in het belang van de rechtszoekenden en de bestuurlijke overheden, in samenwerking met de Raad van State voorstellen doen die de rechtspleging voor de afdeling Bestuursrechtspraak van de Raad van State verbeteren, onderzoeken en goedkeuren.”

Een tweede deel van het regeerakkoord betrof de mogelijkheid voor de Raad van State om een uitspraak te doen over de privaatrechtelijke gevolgen van een nietigverklaring. Dit punt heeft geleid tot de instelling van een schadevergoeding tot herstel, met inachtneming van alle omstandigheden van openbaar en particulier belang. Dit werd in het kader van de staatshervorming reeds aangenomen.

De hervorming die in dit wetsontwerp wordt voorgesteld, is volgens de minister een kwalitatieve hervorming, omdat zij voornamelijk het de Raad van State mogelijk moet maken de rechterlijke toetsing van de wettigheid te verfijnen door arresten te wijzen waarin andere maatregelen worden bevolen dan enkel de nietigverklaring zonder meer.

De bestuurlijke lus zal het voor de overheid mogelijk moeten maken een kleine onwettigheid te herstellen na afloop van een debat op tegenspraak en onder toezicht van de Raad van State.

Er zijn ook andere maatregelen die ertoe strekken de procedure bij de Raad van State te verbeteren door de toegang tot dit hoge rechtscollege te vergemakkelijken, of door het voor de Raad van State mogelijk te maken zich te concentreren op de grond van de zaak in plaats van op onnodige formalistische onregelmatigheden.

Ten slotte werden ook de organisatie en de bevoegdheid van de Raad van State herzien.

Enkele wetsvoorstellen werden bij dit wetsontwerp gevoegd. De voorzitter heeft ze ondertussen opgenoemd. Ik meen dat de indieners van deze wetsvoorstellen straks hun toelichting zullen geven.

Het is wel heel belangrijk dat deze hervormingen vrijwel unaniem werden gesteund. Het wetsontwerp werd in de commissie aangenomen met 15 stemmen voor en 1 onthouding. De toegevoegde wetsvoorstellen werden hierdoor zonder voorwerp.

Ik ga nu over tot de uiteenzetting namens mijn fractie.

A second part of the governmental agreement concerned the possibility for the State Council to take a decision on the private law consequences of a cancellation. This point has led to the establishment of a compensation for damage to recovery, taking into account all circumstances of public and private interest. This has already been adopted in the framework of the state reform.

The reform proposed in this draft law is, in the opinion of the Minister, a qualitative reform, since it must primarily enable the State Council to refine the judicial review of legality by designating judgments ordering measures other than merely the cancellation without a doubt.

The administrative loop should enable the government to repair a minor irregularity after the conclusion of a debate on contradiction and under the supervision of the State Council.

There are also other measures aimed at improving the procedure at the State Council by facilitating access to this High Court, or by allowing the State Council to focus on the substance of the case rather than on unnecessary formalist irregularities.

Finally, the organization and competence of the State Council were also revised.

Several bills were attached to this bill. In the meantime, the President has mentioned them. I think the authors of these bills will submit their explanations soon.

It is very important that these reforms were supported almost unanimously. The bill was adopted in the committee with 15 votes for and 1 abstinence. The proposed legislation was therefore without object.

                    De voorliggende hervormingen waarover zal worden gestemd, zijn fundamenteel en broodnodig. De Raad van State is hiervoor zelf vragende partij. De voornaamste goede nieuwigheden die in het ontwerp aan bod komen, zijn voornamelijk dat er een betere afstemming zal zijn tussen de procedure bij de Raad van State en de bemiddeling, waarbij de verjaringstermijn om de Raad van State te vatten wordt geschorst wanneer men een beroep doet op de ombudsman. Ook komt er een vereenvoudiging van de voorwaarden voor rechtspersonen voor toegang tot de Raad van State, waarbij onder andere een advocaat niet meer moet bewijzen de vertegenwoordiger te zijn van een rechtspersoon: hij krijgt het weerlegbaar vermoeden de advocaat te zijn van die rechtspersoon.

Ook de invoering van het belang bij het middel en het voorkomen dat de nietigverklaring wordt uitgesproken op grond van een onregelmatigheid, terwijl deze geen enkel praktisch gevolg heeft voor de situatie van de verzoeker, zijn eveneens verbeteringen. Ook zijn er wijzigingen aan de uitvoering van arresten, is er de injunctiebevoegdheid en is er ook voorzien in een dwangsom.

De belangrijkste wijziging is volgens ons de bestuurlijke lus: een tussenarrest waarbij wordt vermeld hoe de tekortkoming kan worden rechtgezet. Indien de bestuurlijke overheid instemt met de rechtzetting, laat ze dit natuurlijk onmiddellijk schriftelijk weten.

Ten slotte is er een vereenvoudiging van interne procedures, bijvoorbeeld voor de aanwerving van griffiers. Men denkt erover de achterstanden weg te werken door de maatregel om personeel te kunnen aanwerven en uit te breiden, te verlengen.

Aan de hand van cijfers die de minister in de Senaat had gegeven, hebben wij in de Kamercommissie verder gedebatteerd over de oorzaak waarom er zo’n verschil is inzake werklast tussen de Franstalige kamers en de Nederlandstalige kamers. De minister had daarvoor een objectieve verklaring: aan Franstalige zijde zijn er meer geschillen inzake vreemdelingen dan er moeten worden behandeld aan Nederlandstalige zijde. Bovendien is er aan Nederlandstalige zijde een decreet waardoor alle bouwgeschillen werden weggenomen bij de Raad van State en aan een ander rechtscollege werden toevertrouwd.

The introduction of the interest in the plea and the avoidance of annulment on the basis of an irregularity, while this does not have any practical effect on the situation of the applicant, are also improvements. There are also changes to the execution of judgments, there is the power of injunction and there is also a penalty.

The main change is, in our opinion, the administrative loop: an interim arrest indicating how the deficiency can be corrected. If the administrative authority agrees with the correction, it shall, of course, immediately notify it in writing.

Finally, there is a simplification of internal procedures, for example for the hiring of officers. It is considered to remove the lags by extending the measure for recruiting and expanding personnel.

On the basis of the figures given by the Minister in the Senate, we have further debated in the Chamber Committee the reason why there is such a difference in workload between the French-speaking chambers and the Dutch-speaking chambers. The Minister had an objective explanation: on the French-speaking side there are more disputes concerning foreigners than should be dealt with on the Dutch-speaking side. In addition, the Dutch-speaking side has a decree by which all construction disputes were removed from the Council of State and entrusted to another jurisdiction.

                    Logischerwijze volgt dan de vraag of de voorliggende hervorming ook invloed zal hebben op de achterstand van de Franstalige kamers. De minister bevestigde dat de achterstand wordt weggenomen, zeker inzake het contentieux van vreemdelingen, door het aanwerven van bijkomend personeel. Vooral opmerkelijk was het voortschrijdend inzicht van de minister dat men ook aan Franstalige zijde, in het Waals Gewest, nadenkt over het creëren van een nieuwe administratieve rechtbank voor bouwvergunningen. Wat goed werkt in Vlaanderen, wordt dus aan Franstalige zijde overgenomen.

Wij hadden ook een wetsvoorstel dat samengevoegd is, met als voorwerp de controverse rond de herziening van artikel 195 van de Grondwet, waarbij men de Grondwet eenmalig kan wijzigen in de loop van een zittingsperiode.

Ons voorstel was dat de Raad van State zou tussenkomen als garantie voor een correcte en degelijke Grondwetsherziening, want er heerst bij prominente rechtsgeleerden een juridische discussie over deze techniek. Deze discussie kan niet worden beslecht omdat er geen enkele instelling ter zake is die een eindadvies kan formuleren. De Raad van State, afdeling Wetgeving, mag immers niet over Grondwetteksten adviseren.

Met ons voorstel werken wij die lacune weg. Wij stelden voor dat de Raad van State de bevoegdheid zou worden gegeven om zich uit te spreken over voorstellen en ontwerpen tot herziening van de Grondwet. Daarbij is het de bedoeling dat de Raad van State nagaat of de Grondwettelijke herzieningsprocedure wel degelijk correct werd gevolgd. Door de Raad van State in te schakelen kan bijgevolg worden gegarandeerd dat de regelgevende teksten van een hoog niveau zijn en dat elke discussie over de wettelijkheid van een Grondwetherziening wordt beslecht.

De minister vond dat dit wetsvoorstel niet toegevoegd diende te worden, maar wij waren het daarmee niet eens. Wij zijn van oordeel dat, als men de organisatie van de Raad van State fundamenteel wijzigt, men ook de bevoegdheden voor discussie vatbaar kan stellen.

Wij zullen het voorliggend wetsontwerp mee goedkeuren, want het is een goed wetsontwerp. Toch hebben wij een amendement opnieuw ingediend, waarvan ik hoop dat de collega’s het nauwgezet zullen lezen. Het ligt ondertussen op de banken.

Het gaat om een technische materie. Misschien was de aandacht in de commissie al wat verslapt op het moment dat wij het hebben ingediend, maar het amendement kan nu opnieuw worden goedgekeurd. U kunt dat in alle rust bestuderen. Ik hoop de collega’s hiervan te kunnen overtuigen.

In dit amendement vragen wij om de adviezen van de Raad van State jaarlijks te bundelen in een bulletin van adviezen van de Raad van State.

De verantwoording hiervoor vinden wij in het feit dat het advies van de afdeling Wetgeving in regel verplicht is voor alle ontwerpen van wet, decreten en ordonnanties en behalve in het geval van hoogdringendheid voor alle ontwerpen van KB, terwijl dit advies facultatief is voor wetsvoorstellen.

De adviezen van de Raad van State worden dus niet systematisch gepubliceerd. Alleen adviezen bij voorontwerpen van wet, decreten en ordonnanties en ontwerpen van reglementair besluit, waarbij een verslag aan de Koning of aan de gemeenschap- of gewestregering wordt gepubliceerd, moeten verplicht worden bekendgemaakt.

The Minister considered that this bill should not be added, but we did not agree with it. We believe that if one fundamentally changes the organization of the Council of State, one can also make the powers subject to discussion.

We will approve the bill because it is a good bill. Nevertheless, we have submitted an amendment again, which I hope colleagues will read carefully. In the meantime, it is on the banks.

In this amendment, we request that the opinions of the Council of State be bundled annually into a Bulletin of opinions of the Council of State.

The responsibility for this lies in the fact that the opinion of the Department of Legislation is, as a rule, mandatory for all draft laws, decrees and ordinances and except in cases of high urgency for all drafts of KB, while this advice is optional for bills.

Therefore, the opinions of the State Council are not systematically published. Only opinions on preliminary draft laws, decrees and ordinances and draft regulatory decrees, in which a report is published to the King or to the community or regional government, are mandatory.

Dat verhindert een systematische studie van de adviezen van de Raad van State. Een dergelijke studie is belangrijk omdat veel leerstukken uit het grondwettelijk recht door de Raad van State worden geschreven.

In concreto stellen wij dus voor om een artikel 5bis in te voegen in de gecoördineerde wetten van de Raad van State, waarin de jaarlijkse publicatie van alle adviezen van de afdeling Wetgeving van de Raad van State geïntroduceerd wordt.                     Monsieur le président, madame la ministre, chers collègues, je ne reprendrai pas dans le détail les éléments contenus dans le projet: vous en avez déjà eu écho via le rapport. Je présenterai plutôt une analyse critique; j'en ai fait part à la ministre et aux collègues en commission, mais, malheureusement, elle n'a pas eu l'occasion d'être suffisamment développée et suivie du fait d'une volonté manifeste d'avancer rapidement dans ce projet de loi.

Déjà, au Sénat, tout devait aller vite. D'ailleurs, à la limite, les collaborateurs de la ministre ont eux-mêmes été surpris de la rapidité des travaux; la demande d'audition de divers acteurs concernés n'a pas été acceptée. Cette problématique existe pourtant depuis nombre d'années et rien ne justifiait donc cette précipitation.

L'objectif de ces réformes serait louable et positif à condition de permettre une amélioration de la fonction du Conseil d'État comme rempart pour le justiciable contre un État arbitraire. Or la présente réforme penche plus vers une réforme en faveur de l'administration, c'est-à-dire qui vise à éviter à tout prix l'annulation pure et simple d'un acte, sans réelle contrepartie pour le justiciable; celui-ci n'est donc pas mieux protégé grâce à cette réforme.

Les réformes imaginées par le projet de loi ne répondent pas à l'objectif d'une correction plus rapide du préjudice causé, mais il s'agit plutôt d'une réforme en faveur de l'administration: pouvoirs d'injonction, d'indications, boucles administratives, soit des procédures possibles afin d'éviter une annulation pure et simple tellement décriée par l'administration, car mettant parfois à mal ou retardant certains grands projets.

Par contre, les compensations au justiciable, c'est-à-dire des facilités pour les personnes morales, une amélioration de la procédure de référé avec abandon du préjudice grave irréparable et, en partie, la répétibilité des honoraires d'avocat (elle peut présenter un double tranchant), ne font pas le poids par rapport aux avantages attribués aux administrations par cette réforme.

Lors des discussions en commission, Ecolo-Groen aurait voulu joindre d'autres dimensions de réformes nécessaires, également attendues depuis longtemps, relatives au Conseil d'État.

Parmi ces réformes, épinglons la possibilité pour les associations d'ester en justice.

Mr. Speaker, Mrs. Minister, dear colleagues, I will not go back in detail to the elements contained in the draft: you have already echoed them through the report. I will rather present a critical analysis; I have informed the minister and colleagues in the committee, but, unfortunately, it did not have the opportunity to be sufficiently developed and followed because of a clear will to move forward quickly in this bill.

At the time, everything had to go quickly. Moreover, at the limit, the minister’s employees themselves were surprised by the speed of the work; the request for hearing from various stakeholders involved was not accepted. This problem, however, has existed for many years and therefore nothing justified this precipitation.

The objective of these reforms would be praiseful and positive provided that it would allow an improvement in the function of the State Council as a fence for the justiciable against an arbitrary state. But the present reform tends more toward a reform in favor of the administration, that is, which aims to avoid at all costs the pure and simple cancellation of an act, without real compensation for the justiciable; this is therefore not better protected through this reform.

The reforms envisaged by the bill do not meet the objective of a faster correction of the damage caused, but rather it is a reform in favor of the administration: mandatory powers, indications, administrative loopholes, or possible procedures to avoid a pure and simple cancellation so much denied by the administration, because sometimes damaging or delaying some large projects.

On the other hand, the compensation to the justiciable, i.e. facilities for legal persons, an improvement of the referred procedure with the abandonment of irreparable serious damage and, in part, the repeatability of lawyer fees (it may have a double cut), do not have the weight compared to the benefits granted to the administrations by this reform.

During the discussions in the committee, Ecolo-Groen would have wanted to join other dimensions of necessary reforms, also long-awaited, relating to the State Council.

Among these reforms, let us pinpoint the possibility for associations to be in court.

À cette occasion, nous avons eu non pas le plaisir, mais la surprise d'assister à une espèce de partie de ping-pong entre la Chambre et le Sénat de la part des représentants des partis de la majorité. À la Chambre, il nous a été dit que les textes allaient être travaillés au Sénat. Au Sénat, les travaux ont été postposés; il a été dit qu'il fallait des auditions et, finalement, il n'y a pas eu d'avancement sur ce texte.

J'espère qu'il y aura réparation et une véritable avancée sur ce texte. Vous reconnaîtrez que la manière dont les travaux se sont déroulés autour du texte déposé concernant la réforme du Conseil d'État ne nous incite pas à la confiance.

Monsieur le président, je déposerai au nom de notre groupe des amendements réintroduisant la possibilité pour les associations d'ester en justice. Cela est prévu d'une manière rationnelle et prudente.

Nous disons que ces associations doivent agir en vue de la défense d'un intérêt collectif. Elles doivent remplir des conditions telles que jouir d'une personnalité juridique depuis au moins un an. L'association concernée doit montrer qu'elle poursuit de manière régulière, effective et durable des activités en rapport avec son objet social et qu'elle agit en justice dans le cadre de son objet social en vue d'assurer la défense d'un intérêt collectif en rapport avec cet objet.

Nous espérons que celles et ceux qui, tant à la Chambre qu'au Sénat, disent qu'ils trouvent important ce droit d'ester en justice pour les associations, soutiendront cet amendement.

Nous nous permettrons de réintroduire encore quelques autres amendements que j'avais déposés aussi en commission. Les réponses ou les interactions obtenues de la part de la ministre ou de ses collaborateurs ne nous ont pas permis de nous sentir rassurés. Surtout, elles n'ont pas apporté de solution aux problèmes posés.

Parmi ces amendements, il se trouve une amélioration vraiment indispensable au niveau de la réforme du Conseil d'État, à savoir l'inscription de la publication des avis de la section de législation du Conseil d'État.

Pourquoi sommes-nous revenus? Pourquoi sommes-nous si étonnés que cet amendement n'ait pas été accepté? En 1997, la publication des avis de la section administration a été intégrée. En 2008, le Sénat a adopté une proposition de loi qui visait à rendre obligatoire la publication des avis de la section de législation.

We have requested that this proposal be analyzed at the same time as the bill. On this occasion, we had not the pleasure, but the surprise of attending a kind of ping-pong game between the House and the Senate by representatives of majority parties. In the House, we were told that the texts would be worked out in the Senate. In the Senate, work was postponed; it was said that hearing was needed and, in the end, there was no progress on this text.

I hope there will be correction and real progress on this text. You will acknowledge that the way the work has been carried out around the deposited text concerning the State Council reform does not inspire us to trust.

Mr. Speaker, I will submit amendments on behalf of our group to reintroduce the possibility for associations to appear in court. This is planned in a rational and cautious manner.

We say that these associations must act in order to defend a collective interest. They must meet conditions such as enjoying legal personality for at least one year. The association concerned must demonstrate that it regularly, effectively and sustainably pursues activities related to its social object and that it acts in court in the context of its social object in order to ensure the defence of a collective interest in relation to that object.

We hope that those who, both in the House and in the Senate, say that they find important this right to be in court for associations, will support this amendment.

We will be able to reintroduce some other amendments that I had also submitted in the committee. The responses or interactions obtained from the minister or his collaborators did not allow us to feel reassured. Especially, they did not provide a solution to the problems posed.

Among these amendments is a truly indispensable improvement at the level of the State Council reform, namely the entry of the publication of the opinions of the Legislative Section of the State Council.

Why have we returned? Why are we so surprised that this amendment has not been accepted? In 1997, the publication of the opinions of the administration section was integrated. In 2008, the Senate adopted a bill aimed at making the publication of the legislative section’s opinions mandatory.

Depuis l'insertion dans la Constitution d'une disposition qui accorde à chacun le droit de consulter tout document administratif, il est devenu possible de demander à consulter les avis de la section de législation du Conseil d'État qui sont détenus par une autorité administrative, mais cette démarche est compliquée et non automatique.

Par ailleurs, la section administration du Conseil d'État a jugé, dans l'arrêt GERFA de 1996, qu'un avis de la section de législation était un élément obligatoire de la procédure d'élaboration d'un arrêté réglementaire et qu'il devait, dès lors, être intégré dans le dossier administratif qui est présenté par l'autorité dans le cas où cet arrêté fait l'objet d'une demande en annulation devant le Conseil d'État.

En conclusion, plusieurs professeurs estiment que le principe de la confidentialité des avis ne peut plus être considéré comme allant de soi de la part du Conseil d'État, mais que, néanmoins, une modification explicite de la loi est nécessaire pour que le Conseil d'État respecte cette obligation et ne considère pas que ses avis peuvent être gardés dans la confidentialité tant qu'il n'y a pas d'obligation législative.

Il aurait été normal et démocratique d'accepter ces amendements et de prendre le temps de les travailler. Ce ne fut pas le cas. Par conséquent, nous les redéposons en séance plénière aujourd'hui.

Une autre dimension qu'il aurait été intéressant de joindre à une réforme du Conseil d'État – ce qui ne se fait pas tous les trois mois – était celle de l'instauration d'un quota de femmes au sein du Conseil d'État. À cet égard, nous redéposons l'amendement, car aucun argument ou élément ne justifiait que nous renoncions à compléter cette réforme par cette disposition. Notre amendement ne concerne pas le fonctionnement du Conseil d'État mais sa composition, qui doit être la plus paritaire possible selon nous, les institutions de la justice devant, en effet, montrer l'exemple.

Notre amendement prévoit la présence d'au moins 40 % de membres de sexe différent au sein de l'auditorat et au sein du bureau de coordination du Conseil d'État. Les conseillers d'État sont, au moins pour moitié, nommés par les membres de l'auditorat et du bureau de coordination. On peut donc en déduire que si une présence équilibrée des sexes est assurée au sein de l'auditorat et au sein du bureau de coordination, il sera plus aisé d'assurer une même présence équilibrée des sexes parmi les conseillers.

Since the insertion in the Constitution of a provision that grants everyone the right to consult any administrative document, it has become possible to request to consult the opinions of the legislative section of the State Council which are held by an administrative authority, but this approach is complicated and not automatic.

Furthermore, the Administrative Section of the State Council ruled, in the 1996 GERFA judgment, that an opinion of the Legislative Section was a mandatory element of the procedure for the preparation of a regulatory decree and that it should, therefore, be incorporated into the administrative file that is submitted by the authority in the event that that decree is the subject of a request for annulment before the State Council.

In conclusion, several professors believe that the principle of confidentiality of opinions can no longer be considered as self-evident by the State Council, but that, nevertheless, an explicit modification of the law is necessary for the State Council to comply with this obligation and does not consider that its opinions can be kept confidential as long as there is no legislative obligation.

It would have been normal and democratic to accept these amendments and take the time to work on them. This was not the case. Therefore, we are putting them back to the plenary session today.

Another dimension that would have been interesting to add to a reform of the State Council – which is not done every three months – was the introduction of a quota of women in the State Council. In this regard, we re-submit the amendment, because no argument or element justified that we renounced supplementing this reform with this provision. Our amendment does not concern the functioning of the State Council but its composition, which should be as paritary as possible in our opinion, the institutions of justice should, indeed, be the example.

Our amendment provides for the presence of at least 40% of members of different sexes in the audit board and in the Coordination Office of the State Council. At least half of the State Councillors shall be appointed by the members of the Audit Committee and the Coordination Bureau. It can therefore be deduced that if a gender-balanced presence is ensured within the auditory and within the coordination office, it will be easier to ensure a gender-balanced presence among the counselors.

                    Un quatrième amendement que nous déposerons aujourd'hui en séance plénière me permet d'expliquer des éléments, pour nous insuffisants, dans la réforme proposée par la ministre: la limitation du champ de la boucle administrative, de manière à protéger le justiciable. Il est important d'éviter de préjudicier un tiers si on recourt à la boucle administrative.

Cette boucle consiste à offrir au Conseil d'État la possibilité de proposer à l'auteur de l'acte attaqué de modifier son acte. Si l'autorité publique décide de corriger l'acte vicié, les parties peuvent faire connaître leur position suite à cette correction. Si la correction du vice est satisfaisante, le recours sera donc rejeté. Dans le cas contraire, l'acte attaqué ou, le cas échéant l'acte à refaire, sera annulé. Par ailleurs, le Conseil d'État sera autorisé à dire dans son arrêt ce qu'il faut modifier. Cela signifie que la boucle administrative permettra surtout de maintenir dans l'ordonnancement juridique, un acte qui serait illégal mais dont l'illégalité pourrait être corrigée. Cela paraît superflu.

De nombreuses questions sont restées sans réponse.

L'objet de la correction à apporter n'est pas clairement défini dans le texte. Qu'en sera-t-il des vices non décelés par le requérant et des vices d'ordre public?

L'identité de l'auteur de la correction pose également question. Le projet de loi laisse entendre qu'il ne s'agirait pas nécessairement de l'auteur de l'acte attaqué.

La ministre a indiqué que la boucle administrative s'inspirait du modèle hollandais, or plusieurs différences importantes existent entre les deux systèmes. Il n'est donc pas possible d'affirmer que la boucle administrative belge aura des effets positifs similaires à ceux constatés aux Pays-Bas. En effet, la boucle administrative hollandaise est un instrument permettant la résolution finale d'un conflit alors que la boucle administrative belge n'est qu'un instrument parmi d'autres pour tenter d'éviter une annulation pure et simple d'un acte administratif. La boucle hollandaise peut être appliquée pour tous les vices invoqués ou mis en lumière alors que le projet de loi limite l'utilisation de celle-ci par le Conseil d'État à quelques vices mineurs. Le Conseil d'État hollandais ordonne à l'administration de corriger son acte à travers la boucle administrative, ce qui permet de mettre un point final à la cause, alors que le Conseil d'État belge ne pourra qu'inviter l'administration à corriger son acte par un arrêt intermédiaire, avant de se prononcer définitivement.

A fourth amendment that we will submit today at the plenary session allows me to explain elements, for us insufficient, in the reform proposed by the minister: the limitation of the scope of the administrative loop, in order to protect the justiciable. It is important to avoid harming a third party if the administrative loop is used.

This loop consists in offering the State Council the possibility to propose to the author of the contested act to modify his act. If the public authority decides to correct the vicious act, the parties may make known their position following this correction. If the correction of the defect is satisfactory, the appeal will therefore be rejected. Otherwise, the contested act or, where applicable, the act to be re-made, will be cancelled. In addition, the State Council will be allowed to say in its decision what needs to be amended. This means that the administrative loop will primarily allow to maintain in the legal order, an act that would be illegal but whose illegality could be corrected. This seems superfluous.

Many questions remain unanswered.

The purpose of the correction to be made is not clearly defined in the text. What about the vices not detected by the applicant and the vices of public order?

The identity of the author of the correction is also questionable. The bill suggests that he would not necessarily be the author of the contested act.

The minister said the administrative loop was inspired by the Dutch model, but there are several significant differences between the two systems. Therefore, it is not possible to assert that the Belgian administrative loop will have positive effects similar to those seen in the Netherlands. Indeed, the Dutch administrative loop is an instrument enabling the final resolution of a conflict while the Belgian administrative loop is only an instrument among others to try to avoid a pure cancellation of an administrative act. The Dutch loop can be applied for all vices invoked or exposed while the bill limits the use of it by the State Council to a few minor vices. The Dutch Council of State orders the administration to correct its act through the administrative loop, which allows to put a final point to the cause, while the Belgian Council of State will only be able to invite the administration to correct its act by an interim decision, before making a final judgment.

Par exemple, si le recours est rejeté, en cas de correction de l'acte vicié par l'administration, le justiciable qui a introduit le recours se verrait imposer le paiement de l'indemnité de procédure. Afin d'éviter cela, Ecolo-Groen a redéposé un amendement pour que, dans ce cas, les frais de la procédure soient à charge de l'administration en faute.

En outre, dans la version hollandaise, comme je le disais, tout à l'heure, il est prévu que la mise en œuvre de la boucle ne peut porter atteinte aux droits des tiers. Cette condition n'est pas reprise dans le projet de loi à l'examen. Il n'est pas stipulé clairement que les tiers disposeront d'un nouveau recours contre la décision corrigée ou contre la nouvelle décision. Même s'il s'agit de détails, d'éléments moins ou peu importants – j'en réfère ici à l'argument avancé par la ministre –, nous considérons qu'il faut ajouter cette condition d'application à la boucle administrative.

J'en arrive, enfin, à un dernier élément qui nous semble important. Selon nous, il faut obliger le Conseil d'État à examiner tous les moyens invoqués plutôt qu'un seul, s'inspirant ainsi du texte wallon créant un Conseil des contentieux en matière d'urbanisme, et plus particulièrement l'examen de la requête. C'est la raison pour laquelle nous avons redéposé un amendement.

Monsieur le président, nous souhaiterions que ces amendements soient pris en compte et soutenus par les membres de ce parlement. En effet, il s'agit d'outils permettant non seulement un fonctionnement plus démocratique et plus efficace de nos administrations, mais surtout une meilleure relation entre les citoyens et l'administration.

Finally, in the Netherlands, the vicious act corrected by a new act is cancelled. The appeal therefore results in the annulment of the act while the administrative loop to the Belgian, even if it allows a correction of the vicious act, rejects the appeal brought, which could have problematic consequences in terms of procedural costs to be paid by the justiciable and therefore access to justice.

What does the citizen gain from the creation of the administrative loop established through this reform of the State Council? For Ecolo-Groen, it is above all a new instrument among others in favor of the administration in order to avoid the cancellation of an act rather than in favor of improving or accelerating the procedure before the Council of State. However, the text could easily be improved in order to better protect the entitled to an advantage granted to the administration. For example, if the appeal is rejected, in case of correction of the act vicious by the administration, the justiciable who filed the appeal would be imposed the payment of the procedural compensation. In order to avoid this, Ecolo-Groen has resubmitted an amendment so that, in this case, the costs of the proceedings will be borne by the faulty administration.

In addition, in the Dutch version, as I said recently, it is provided that the implementation of the loop cannot infringe the rights of third parties. This requirement is not included in the bill under consideration. It is not clearly stated that third parties will have a new appeal against the corrected decision or against the new decision. Even if these are details, less or less important elements – I refer here to the argument put forward by the minister – we consider that this condition of application should be added to the administrative loop.

Finally, I would like to come to a last point that I think is important. In our view, it is necessary to force the Council of State to examine all the remedies invoked rather than one, thus inspired by the Wallon text creating a Council of Disputes in Urban Planning, and more ⁇  the examination of the petition. That is why we have submitted an amendment.

We would like these amendments to be taken into account and supported by the members of this Parliament. In fact, these are tools that allow not only a more democratic and efficient functioning of our administrations, but above all a better relationship between citizens and the administration.

                    Monsieur le président, madame la vice-première ministre, comme l'intervenante précédente, je déplore les conditions dans lesquelles la Chambre a été amenée à travailler sur cet important projet de loi. La réflexion sur l'organisation et les compétences des juridictions administratives, et plus particulièrement du Conseil d'État, méritait un moment de débat plus large et à tout le moins des consultations juridiques plus poussées auprès de toutes les autorités concernées.

Un peu comme avec la réforme du pouvoir judiciaire, on a le sentiment que la volonté du gouvernement est de proposer une réforme, qui a certes déjà fait l'objet de débats académiques auprès d'un certain nombre d'intervenants, mais de mener cette réforme tambour battant, parce que, tout simplement, il y a eu une sorte de pression émotionnelle liée à des affaires qui se sont déroulées au Nord du pays. Tout à coup, ce fut l'émotion à la suite de deux arrêts du Conseil d'État prononcés dans des affaires qui, si elles n'étaient pas négligeables, ne revêtaient pas une gravité particulière. Il s'agissait, d'une part, de la démission d'office d'un agent communal à Anvers, qui a donné lieu à un arrêt d'annulation du Conseil d'État et, d'autre part, d'un permis d'urbanisme pour l'extension d'une ligne de tram. Il est vrai que le Conseil d'État a statué plusieurs années après l'introduction de la requête, comme c'est malheureusement trop souvent le cas. Ces affaires ont donc justifié que tout à coup, on fasse émerger un projet de loi qui emporte, à mon sens, une plus grande insécurité juridique que la réponse adéquate au réel problème du délai dans lequel statue généralement le Conseil d'État.

Si le Conseil d'État a un tel arriéré, il faut peut-être d'abord se demander si ce dernier dispose des moyens humains, c'est-à-dire en magistrats et membres du personnel, pour traiter les affaires dans des délais plus diligents et ensuite, s'il n'y a pas lieu de le décharger d'un certain nombre de contentieux, ou en tout cas d'avoir une réflexion sur l'organisation de juridictions administratives de premier degré. On l'a fait, par exemple, pour le contentieux des étrangers. Il y a sans doute matière à le faire pour d'autres types de recours contre des actes administratifs correspondant à l'exercice de certaines compétences, que ce soit notamment tous les actes administratifs de la fonction publique, qui génèrent un lot important de recours devant le Conseil d'État.

Et plutôt que d'avoir une réflexion sur une nouvelle hiérarchie des juridictions administratives, leur indépendance et leur statut pour garantir notamment une totale impartialité, on nous présente de fausses solutions de procédure dans le cadre de l'examen des recours en annulation par le Conseil d'État.

Mr. Speaker, Mrs. Deputy Prime Minister, like the previous speaker, I regret the conditions under which the House was brought to work on this important bill. The reflection on the organization and competence of the administrative courts, and in particular of the Council of State, deserved a time of broader debate and at least more intense legal consultations with all relevant authorities.

A little like with the reform of the judiciary, one has the feeling that the will of the government is to propose a reform, which has ⁇  already been the subject of academic debates with a number of speakers, but to lead this reform drum beating, because, simply, there was some sort of emotional pressure related to the affairs that took place in the north of the country. Suddenly, it was the emotion following two rulings of the Council of State issued in cases which, if not negligible, were not of particular gravity. It was, on the one hand, the resignation of an official municipal officer in Antwerp, which gave rise to an annulment decision of the State Council and, on the other hand, an urban planning permit for the extension of a tram line. It is true that the State Council ruled several years after the petition was introduced, as is unfortunately too often the case. Those cases therefore justified the sudden emergence of a bill which, in my opinion, carries a greater legal uncertainty than the adequate answer to the real problem of the time within which the State Council normally decides.

If the State Council has such a backwardness, it may be necessary first to ask whether the latter has the human resources, i.e. magistrates and staff members, to handle matters in more diligent timeframes and then, if there is no reason to discharge it from a certain number of litigation, or in any case to have a reflection on the organization of administrative courts of first instance. This was done, for example, for the dispute of foreigners. There is ⁇  substance to do so for other types of appeals against administrative acts corresponding to the exercise of certain powers, whether in particular all administrative acts of the public service, which generate a large lot of appeals before the Council of State.

And instead of having a reflection on a new hierarchy of administrative courts, their independence and their status to ensure in particular total impartiality, we are presented with false procedural solutions in the context of the examination of annulment appeals by the State Council.

Je suis un fervent partisan de mettre fin au régime dérogatoire qui veut que le Conseil d'État, pour des raisons historiques, relève, notamment pour son mode de fonctionnement et son organisation, de l'autorité du gouvernement, le pouvoir exécutif qui lui sert de soutien administratif. Je crois qu'il est temps d'avoir la volonté de dire que l'importance des missions du Conseil d'État, qui doit garantir par son impartialité la crédibilité de son fonctionnement, justifient que les juridictions administratives soient inscrites au sein du pouvoir judiciaire, ce qui aurait l'avantage de créer aussi des niveaux de recours et des contrôles in fine de légalité par la Cour de cassation qui seraient bien utiles dans certains cas. Le professeur Michel Leroy, professeur de contentieux administratif à l'Université libre de Bruxelles et magistrat au Conseil d'État, rappelle dans la dernière édition (2008) de son Contentieux administratif que – je cite – "en ce qui concerne les nominations au Conseil d'État, la première condition non écrite et souvent tue est politique. Chaque place est attribuée à un parti déterminé, selon un partage approximativement aligné, avec quelques décalages, sur leur représentation dans les assemblées fédérales. Les conseillers ne doivent pas nécessairement être membre du parti, et encore moins le rester après leur nomination, mais ils doivent en avoir le soutien. Seuls échappent à cette contrainte ceux qui sont présentés à l'unanimité par l'assemblée générale …" avec, d'ailleurs, ce paradoxe que les recours contre un arrêté portant nomination d'un conseiller d'État relèvent de la section du contentieux administratif du Conseil d'État, ce qui, malgré les conclusions favorables au système à la suite d'un arrêt de la Cour constitutionnelle en 2011, ne manque pas de soulever des interrogations concernant un risque de confusion d'intérêts.

Je crois donc qu'il faut avoir une réflexion pour renforcer l'indépendance des magistrats du Conseil d'État. On sait d'ailleurs que l'appartenance politique ou le passage de certains d'entre eux dans des cabinets ministériels a donné lieu à des contestations de leur jurisprudence par la suite, lorsqu'ils étaient conseillers d'État. Nous n'aurions sans doute pas aujourd'hui la jurisprudence de certaines chambres flamandes du Conseil d'État si la nomination des magistrats du Conseil d'État se faisait selon des modes présentant une plus grande indépendance.

Like others, I am in favour of placing administrative courts within the judiciary. I am a fervent supporter of ending the derogatory regime that requires that the State Council, for historical reasons, falls, especially for its way of functioning and its organization, under the authority of the government, the executive power that serves as its administrative support. Professor Michel Leroy, professor of administrative contentious at the Free University of Brussels and magistrate at the State Council, recalls in the last edition (2008) of his Administrative Contentious that – I quote – “in regard to appointments to the State Council, the first unwritten condition and often kills is political. Each seat is assigned to a particular party, according to an approximately aligned distribution, with some variations, on their representation in the federal assemblies. Councillors do not necessarily have to be members of the party, and much less remain members of the party after their appointment, but they must have the support of the party. Only those who are presented unanimously by the General Assembly escape this constraint ... with, in addition, this paradox that the appeals against a decree appointing a State Councillor fall within the section of the administrative litigation of the State Council, which, despite the conclusions favorable to the system following a decision of the Constitutional Court in 2011, does not fail to raise questions regarding a risk of confusion of interests.

Therefore, I believe that there needs to be a reflection to strengthen the independence of the magistrates of the State Council. It is also known that political membership or the passage of some of them into ministerial cabinets gave rise to disputes of their jurisprudence subsequently, when they were state councillors. We would ⁇  not have today the jurisprudence of some Flemish chambers of the State Council if the appointment of the magistrates of the State Council were made according to modes with greater independence.

Je cite: "Si, au sein de la même institution peuvent exister des formations administratives et contentieuses, l'impartialité proscrit une organisation permettant à un juge de connaître du contentieux d'un dossier sur lequel il a rendu un avis comme conseiller et, plus généralement, elle s'oppose à ce qu'une même personne aborde deux fois un dossier à deux titres différents". À juste titre, les barreaux francophones citaient une large jurisprudence tant de la Cour européenne des droits de l'homme que d'autres juridictions, comme la Cour de justice de l'Union européenne, et une abondante doctrine dans ce sens.

C'est donc l'instauration d'un système qui risque de se révéler périlleux. En effet, supposons que le Conseil d'État puisse effectuer ce travail avec toute la rigueur voulue. Que se passe-t-il si, après avoir donné suite à l'invitation du Conseil d'État, par un arrêt intermédiaire, de corriger l'acte administratif qui présente un vice de procédure, notamment, à l'examen ultérieur, au moment de la délibération, le Conseil d'État doit constater que d'autres moyens, en ce compris des moyens soulevés d'office, des moyens d'ordre public, justifient l'annulation?

On aura alors créé une apparence de sécurité juridique à la suite de l'invitation faite pour néanmoins arriver in fine à l'annulation de l'acte. À mon sens, cette confusion suscitera plus d'interrogations que de certitudes juridiques.

If, within the same institution, administrative and contentious formations may exist, impartiality prohibits an organization allowing a judge to know the contentious of a case on which he has given an opinion as a counselor and, more generally, it opposes that the same person addresses a case twice with two different titles. Rightly, the French-speaking bars cited a broad jurisprudence from both the European Court of Human Rights and other courts, such as the Court of Justice of the European Union, and an abundant doctrine in this regard.

It is therefore the establishment of a system that risks to prove dangerous. Indeed, let us assume that the State Council can carry out this work with all the rigor desired. What happens if, after having responded to the invitation of the State Council, by an interim decision, to correct the administrative act which presents a procedural defect, in particular, in the subsequent examination, at the time of deliberation, the State Council must establish that other means, including the remedies raised on its own, the remedies of public order, justify the cancellation?

There will then be created an appearance of legal certainty following the invitation made to nevertheless arrive in final to the cancellation of the act. In my opinion, this confusion will raise more questions than legal certainty.

Je pense entre autres au problème des effets modulés dans le temps d'un arrêt rendu sur requête attaquant un acte administratif à titre individuel. À quel moment le préjudice naît-il et justifie-t-il que le Conseil d'État se prononce sur l'indemnisation, dès lors qu'il y a une conséquence éventuellement différée de l'effet juridique de l'arrêt du Conseil d'État? C'est un problème! Le Conseil d'État aura-t-il alors vidé totalement son pouvoir d'appréciation sur la demande d'indemnisation? C'est un autre problème.

Une fois de plus, on a créé une confusion des genres et il eût été préférable de laisser la pleine compétence aux juridictions du pouvoir judiciaire, dès lors qu'on n'a toujours pas une logique de juridiction administrative au sein du pouvoir judiciaire, pour se prononcer sur le contentieux de l'indemnisation parce que l'appréciation du préjudice à la suite d'un arrêt du Conseil d'État se fait souvent de manière plus précise et le préjudice est parfois apprécié différemment que la seule constatation de l'illégalité de l'acte attaqué par les juridictions du pouvoir judiciaire.

Once again, a gender confusion has been created and it would have been better to leave full jurisdiction to the courts of the judiciary, since there is still no logic of administrative jurisdiction within the judiciary, to decide on the litigation of the compensation because the assessment of the damage following a judgment of the Council of State is often done more accurately and the damage is sometimes assessed differently than the mere finding of the illegality of the act attacked by the courts of the judiciary.

Vous oubliez aussi – et ce n'est pas anodin – que la répétibilité des honoraires d'avocats est quand même un élément très important pour les justiciables également ainsi que le régime d'injonction en matière d'astreintes qui sera amélioré.

Notre projet, équilibré selon moi, présente des avancées tant d'un côté que de l'autre.

En ce qui concerne les éléments dont vous avez parlé, je ne vois aucune objection à des initiatives législatives que l'on analysera avec intérêt en ce qui concerne tant l'action en intérêt collectif que la publication des arrêts. Je tiens à répéter que les actes législatifs sont rendus publics par la publicité lorsqu'on dépose un projet de loi et quoi qu'il arrive, lorsqu'on se retrouve devant le Conseil d'État, il y a de toute façon une obligation d'accès à l'avis qui a été rendu sur un arrêté royal qui pourrait faire l'objet d'un recours en annulation. La capacité d'accessibilité est relativement large, mais je suis disposée, le cas échéant, à analyser une proposition de loi en la matière.

You are also forgetting – and it is not unnecessary – that the repeatability of lawyer fees is still a very important element for prosecutors as well as the system of injunction in matters of penalty that will be improved.

Our project, balanced in my opinion, shows progress both on one side and on the other.

Regarding the elements of which you have spoken, I see no objection to legislative initiatives that will be analyzed with interest in both the action in the collective interest and the publication of judgments. I would like to repeat that legislative acts are made public by publicity when a draft law is deposited and whatever happens, when one finds himself before the State Council, there is in any case an obligation of access to the opinion that was given on a royal decree that could be the subject of an annulment appeal. The accessibility capacity is relatively wide, but I am willing, if necessary, to analyze a bill on this subject.

En l'espèce, le temps manquait et ce n'est pas l'option qui a été choisie. En revanche, il est vrai qu'on a permis, par souci de coordination, de rapidité et d'efficacité, l'indemnisation en équité au Conseil d'État, ce que plusieurs avocats et acteurs judiciaires demandaient. C'est donc une petite part de compétence du judiciaire qui est donnée au Conseil d'État, de manière très prudente.

Comme je viens de le dire à Mme Gerkens, je voudrais insister sur le fait que le Conseil d'État n'est pas le conseiller de l'administration. Il ne fait que relever une irrégularité qui, ne changeant pas le sens de la décision, peut être corrigée, ce qui évite un certain nombre d'effets pervers, parfois à d'autres types de citoyens. On connaît quelques cas malheureux.

Je persiste donc à penser que ce projet est équilibré, qu'il est largement soutenu et souhaité. Toute proposition de loi pourra évidemment être analysée au-delà de ce vote.

There are some unfortunate cases.

So I continue to think that this project is balanced, that it is widely supported and desired. Any proposed legislation can be analyzed beyond this vote.

Ce faisant, il ne faut pas réintroduire la possibilité de faire un procès dans le procès. Néanmoins, je ne parviens pas à comprendre l'intégration de termes selon lesquels lorsque l'on corrige un acte vicié, cela ne peut porter préjudice à un tiers.
