Ik weet dat het vrijdagavond is, maar we zullen dit belangrijke verdrag vandaag toch bespreken.
Als corapporteur zal ik het hebben over de werkzaamheden in de commissie voor de Buitenlandse Betrekkingen, de heer Deseyn brengt verslag uit over het einde van de bespreking in commissie.
De commissie voor de Buitenlandse Betrekkingen heeft het wetsontwerp op 17 november 2009 besproken, alsook afgelopen maandag en dinsdag. Op de eerste bespreking heeft de toenmalige minister van Buitenlandse Zaken, Yves Leterme, de overeenkomst toegelicht.
In de nasleep van de dramatische gebeurtenissen van 11 september 2001 hebben de Verenigde Staten een wet aangenomen die luchtvaartmaatschappijen verplicht om informatie over hun passagiers ter beschikking te stellen van het Amerikaanse ministerie van Binnenlandse Veiligheid.

Wie de informatie niet ter beschikking stelt, riskeert sancties. Men nam dus het logische besluit om een akkoord te onderhandelen tussen de Unie als een geheel en de Verenigde Staten. De onderhandelingen voor een nieuwe overeenkomst concentreerden zich vooral op de verzoening van de gewettigde strijd tegen het terrorisme, rechtszekerheid voor luchtvaartmaatschappijen en het schenden van de privacy. The interim agreement concluded in October 2006 expired on 31 July 2007. The negotiations for a new agreement focused primarily on the reconciliation of the legitimate fight against terrorism, legal certainty for airlines and breaches of privacy. Zij hadden het moeilijk met het preventief karakter van het verzamelen van de PNR en met de volautomatische verwerking ervan. De combinatie van verschillende passagiergegevens zou tot problemen voor onschuldige passagiers kunnen leiden.
Voorts werd er verwezen naar het advies van de Raad van State, die een aantal fundamentele bezwaren formuleerde.
Er werd dan ook voorgesteld om de privacycommissie te horen.
Enkele collega’s legden er de nadruk op dat de internationale gemeenschap zich natuurlijk moet kunnen beschermen tegen personen die het slecht menen met de vrijheid. Deze overeenkomst zou een goed evenwicht vertonen tussen die noodzaak enerzijds en anderzijds natuurlijk de bezorgdheid over de persoonlijke levenssfeer.
De minister merkte op dat de Europese Commissie in maart en april van volgend jaar een evaluatie van de overeenkomst plant. Ook meende hij dat de rechten van de passagiers erop vooruitgaan in vergelijking met de praktijk van vandaag. België behoort trouwens tot de vijf laatste Europese lidstaten, die de overeenkomst nog moeten ratificeren.
Op onze vergadering van vorige week maandag, 23 november, hielden wij een gedachtewisseling met vertegenwoordigers van de privacycommissie. De privacycommissie heeft echter nog geen officieel standpunt ingenomen. Er werd vastgesteld dat veel van de principes uit de overeenkomst nog niet volledig zijn uitgewerkt en dat de regelingen inzake toezicht op die uitwisselingen en inzake de bescherming van de burgers en de informatie eerder zwak zijn. Er worden zeer veel gegevens verzameld, waardoor de proportionaliteit ter discussie kan worden gesteld. Sinds de jongste bijeenkomst, twee jaar geleden, van de werkgroep Artikel 29, die de gegevensbescherming op Europees niveau bewaakt, is een aantal beloftes van de Verenigde Staten nog steeds niet ingelost.
Daartegenover staat – dit moeten we toch beklemtonen – dat het verdrag de facto al twee jaar geldt. Het is voor de privacycommissie ondenkbaar om een advies uit te brengen dat over de hele lijn negatief is.
De niet-ratificatie zou ertoe kunnen leiden dat vliegtuigmaatschappijen eenvoudigweg uit het Amerikaans luchtruim worden geweerd. Ook voor de burger is een niet-ratificatie niet positief.
De vertegenwoordigers van de privacycommissie vonden wel dat wij de positieve elementen uit de overeenkomst, de evaluatie ervan bijvoorbeeld, moeten activeren en in de praktijk in werking laten treden.
Verschillende collega’s meenden dat een advies van de privacycommissie deel had moeten uitmaken van het wetgevingsdossier. Ook legden zij de nadruk op het belang van de evaluatie van de overeenkomst om ze te verbeteren.
Collega’s, tot hier gaat mijn verslag. Naderhand zal ik nog bekijken of wij ook namens de fractie het woord voeren.

They had difficulties with the preventive nature of the collection of PNRs and with its fully automated processing. The combination of different passenger data could lead to problems for innocent passengers.

The Minister noted that the European Commission plans to review the agreement in March and April of next year. He also argued that the rights of passengers are improving compared to today’s practice. Belgium is among the last five EU member states to ratify the agreement.
At our meeting last week Monday, November 23, we held an exchange of views with representatives of the Privacy Committee. However, the Privacy Committee has not yet taken an official position. It was found that many of the principles contained in the agreement have not yet been fully developed and that the arrangements for monitoring those exchanges and for the protection of citizens and information are rather weak. A lot of data is being collected, thus challenging proportionality. Since the latest meeting, two years ago, of the Article 29 Working Group, which monitors data protection at European level, a number of U.S. promises have still not been fulfilled.
On the contrary, we must emphasize that the treaty has been in effect de facto for two years. It is unthinkable for the Privacy Commission to issue an opinion that is negative across the line.
The non-ratification could result in airlines being simply banned from the US airspace. Even for the citizen, a non-ratification is not positive.
However, the representatives of the Privacy Committee believed that we should activate the positive elements of the agreement, for example its evaluation, and put them into effect in practice.
Several colleagues believed that an opinion of the Privacy Committee should have been part of the legislative dossier. They also emphasized the importance of the evaluation of the agreement in order to improve them.
Ladies and gentlemen, here is my report. We will see if we will speak on behalf of the group.

Mijnheer de voorzitter, wij hebben op 24 november een derde commissievergadering aan deze thematiek gewijd. De heer Moriau van de PS-fractie was de mening toegedaan dat de PNR-overeenkomst potentieel gevaarlijk is, maar de uiteenzetting van de privacycommissie heeft hem er echter van overtuigd dat het geen optie is om haar niet goed te keuren. Hij heeft ook gesproken over de noodzaak van een spoedige evaluatie en benadrukt dat het advies van de privacycommissie rijkelijk laat komt.
Collega de Donnea heeft zich daar bij aangesloten. Hij was verbijsterd dat de privacycommissie het nagelaten had het Parlement in te lichten over de werkzaamheden.
Daarna heeft er zich ook een debat ontsponnen over de samenwerking tussen dit huis en de privacycommissie. Misschien dat een reglementswijziging zich opdringt.
Collega Geert Versnick, voorzitter van de commissie, kon daarmee instemmen. Hij verwees ook naar de brief van de privacycommissie, die moet bewijzen dat deze pas laat is opgetreden.
Collega Dallemagne trok twee conclusies uit de uiteenzetting van de privacycommissie. Ten eerste valt er zowel op de tekst van de overeenkomst als op de praktische toepassing van de erin vervatte regelingen heel wat aan te merken. Hij stelde ook vast dat België als het ware veroordeeld is tot de ratificatie van het verdrag. Net zoals bij vorige sprekers had hij het ook over de controlemechanismen en het evenwicht die in de tekst gegarandeerd moeten zijn.
Ikzelf heb in navolging van de collega’s ook gezegd dat het geen goede zaak zou zijn mocht de voorliggende overeenkomst niet worden geratificeerd want er zijn natuurlijk terechte bekommernissen omtrent de bescherming van de persoonlijke levenssfeer. Toch ben ik van oordeel dat het geheel evenwichtig is en dat het nog altijd beter is met dit akkoord in te stemmen dan helemaal geen juridisch kader te hebben en bijgevolg volledig overgeleverd te zijn aan de eenzijdige imperatieven van de Verenigde Staten.
De staatssecretaris voor Mobiliteit, de heer Etienne Schouppe, die toen namens de regering optrad, legde uit dat de overeenkomst van 2007 voor de betrokken passagiers een vooruitgang ten opzichte van het akkoord van 2004 betekent. Het gaat met andere woorden over een evenwichtiger akkoord en het is ook van uiterst groot belang voor de bilaterale relaties tussen de EU en de Verenigde Staten. Bovendien, zo heeft beklemtoonde de heer Schouppe, mag men de commerciële belangen van de luchtvaartmaatschappijen, maar ook die van de luchthavens, in deze niet uit het oog verliezen. Hij wees er ook op dat er wederzijds engagementen zijn geweest, dat het niet zomaar het eenzijdig opleggen van een tekst was en dat er door de EU waarborgen zijn ingebouwd voor de burger, wat precies de grote meerwaarde was van de inbreng van de Europese Unie.

I myself, following the colleagues, also said that it would not be a good thing if the present agreement was not ratified because there are, of course, legitimate concerns regarding the protection of the private sphere. Nevertheless, I believe that the whole is balanced and that it is still better to agree to this agreement than to have no legal framework at all and therefore be fully surrendered to the unilateral imperatives of the United States.
The State Secretary for Mobility, Etienne Schouppe, who then acted on behalf of the government, explained that the 2007 agreement for the passengers concerned represents a progression from the 2004 agreement. In other words, it is a more balanced agreement and it is also of great importance for the bilateral relations between the EU and the United States. Furthermore, as Mr Schouppe stressed, the commercial interests of the airlines, as well as those of the airports, must not be overlooked. He also pointed out that there have been mutual commitments, that it was not just the unilateral imposition of a text and that EU guarantees have been built for the citizen, which was precisely the great added value of the European Union contribution.

Mijnheer de voorzitter, ik wil eerst de beide verslaggevers bedanken voor hun verslag.
Mijnheer de eerste minister, het moet blijkbaar zeer snel gaan. U hebt nog maar pas het vertrouwen gekregen van de meerderheid in dit Parlement en reeds moet dit wetsontwerp worden goedgekeurd. Er is haast bij. Ik herinner mij nog goed dat u een tijdje geleden nogal verveeld was met het uitstel, toen mijn fractie het advies van de privacycommissie vroeg.
Wat ligt er voor? Ons land moet het akkoord ratificeren dat de overdracht regelt van passagiersgegevens door Europese luchtvaartmaatschappijen aan de Verenigde Staten. Als we dat niet doen, dreigen we ons de toorn van de Verenigde Staten op de hals te halen en stellen we onze luchtvaartmaatschappijen misschien inderdaad aan bepaalde sancties bloot.
Dit akkoord reguleert immers een bestaande praktijk, die voor de Verenigde Staten nogal belangrijk is. De Amerikaanse inlichtingendiensten willen immers zicht krijgen op de persoonsgegevens van alle passagiers op vliegtuigen die het Amerikaanse luchtruim binnendringen. Op basis van die gegevens wordt dan voor elke passagier een automatische berekening gemaakt van het terrorismerisico dat die passagier vertegenwoordigt.
Het gaat om een geïnformatiseerde, statistische berekening van het terrorismerisico van een passagier. Op basis van zo’n statistische berekening mocht een vliegtuig van Air France op weg naar Mexico op 19 augustus jongstleden het Amerikaanse luchtruim niet binnenvliegen. Er was blijkbaar een calculatie gebeurd waaruit bleek dat een van de passagiers toch een risico op terrorisme vertegenwoordigde.
Collega’s, mijnheer de eerste minister, heren ministers, de man in kwestie bleek geen terrorist te zijn maar een mensenrechtenactivist; iemand die actief is in bepaalde organisaties en die als zodanig gecatalogeerd staat, maar die door de automatische geïnformatiseerde statistische berekening bestempeld werd als potentieel terrorist.
Collega’s, als wij dit akkoord goedkeuren, als ons land dit akkoord ratificeert, stellen wij ons bloot aan dergelijke mechanismen. Dan zullen dergelijke zaken in de toekomst nog voorkomen. Dat is een eerste bedenking.
Fundamenteel meen ik dat vanuit het oogpunt van de bescherming van de persoonlijke levenssfeer dit akkoord bijzonder problematisch is. Niet alleen wij van Ecolo-Groen! zeggen dat, de verslaggevers hebben er ook al op gealludeerd. Ook de Raad van State en de juridische dienst van het Europees Parlement benadrukken het zeer problematische karakter ervan wat de privacy betreft.
De Raad van State stelt als voorwaarde voor de overdracht van dergelijke gegevens dat er sprake moet zijn van een zwaarwegend algemeen belang. In de analyse zegt de Raad van State dat dit zwaarwegend algemeen belang niet aanwezig is of niet kan worden aangetoond. De Raad van State wijst ook op de bijzonder lange bewaartermijn van deze gegevens, te weten een actieve bewaring van zeven jaar en een passieve bewaring van acht jaar. Dat maakt in het totaal gedurende vijftien bewaring van deze gegevens. Er is geen enkel zicht, en er is geen enkele controle mogelijk, inzake eventuele derde partijen of derde landen aan wie de Verenigde Staten die persoonsgegevens kunnen doorspelen.
De juridische dienst van het Europees Parlement formuleerde een aantal bezwaren in dezelfde zin in een nogal omstandige analyse.
Het was op mijn initiatief dat de Kamercommissie voor de Buitenlandse Betrekkingen aan de alarmbel trok en niet zonder meer overging tot de goedkeuring van dit wetsontwerp maar het advies opvroeg van de privacycommissie. Geconfronteerd met alle bezwaren — bezwaren die ook in de documenten van het parlementaire dossier staan — meen ik dat het advies vragen van de privacycommissie een zeer terechte stap was. Pas maandag jongstleden hebben wij een aantal mensen van de privacycommissie gehoord. Wij hebben onder andere de heren Willem De Beuckelaere en Bart De Schutter gehoord. Hun opmerkingen waren in het licht van het voorgaande eigenlijk zeer kritisch. Zij zetten een aantal zaken op een rijtje wat de bescherming van de privacy betreft.
Het akkoord, zo stellen zij, is zwak opgebouwd wat de bescherming en het toezicht op de privacy betreft. Zij merken ook op dat heel wat bepalingen al in uitvoering zijn en dat dit problematisch verloopt.
Er is onder meer sprake van een controlemechanisme dat geïnstalleerd zou moeten worden. Zij stellen echter vast dat in die twee jaar het controlemechanisme nog niet operationeel is.

Mr. Prime Minister, it must be done very quickly. You have just gained the confidence of the majority in this Parliament and this bill must already be approved. There is a hurry. I remember very well that you were quite bored with the delay some time ago when my group asked the opinion of the Privacy Committee.
What is there for? Our country must ratify the agreement governing the transfer of passenger data by European airlines to the United States. If we do not do so, we threaten to take the anger of the United States on our throat and we may indeed subject our airlines to certain sanctions.
After all, this agreement regulates an existing practice, which is quite important for the United States. The U.S. intelligence services want to see the personal data of all passengers on aircraft entering the U.S. airspace. On the basis of those data, an automatic calculation of the terrorist risk represented by that passenger is then made for each passenger.
It is an informed, statistical calculation of the terrorism risk of a passenger. Based on such a statistical calculation, an Air France aircraft on its way to Mexico on August 19 was forbidden to enter U.S. airspace. Apparently, a calculation was made that showed that one of the passengers still represented a risk of terrorism.
Colleagues, Mr. Prime Minister, Mr. Ministers, the man in question turned out to be not a terrorist but a human rights activist; someone who is active in certain organizations and who is cataloged as such, but who was labeled as a potential terrorist by the automated informed statistical calculation.
Colleagues, if we approve this agreement, if our country ratifies this agreement, we expose ourselves to such mechanisms. Such things will be avoided in the future. That is a first consideration.
Basically, I consider this agreement to be ⁇ problematic from the point of view of the protection of privacy. Not only we from Ecolo-Green! That said, the reporters have already alluded to it. The State Council and the Legal Service of the European Parliament also highlight its very problematic nature in terms of privacy.
The State Council sets as a condition for the transmission of such data that there must be a prevailing public interest. In the analysis, the State Council says that this serious public interest is not present or cannot be demonstrated. The State Council also points out the ⁇ long retention period of these data, namely an active retention of seven years and a passive retention of eight years. This allows for a total of fifteen periods of storage of these data. There is no view, and there is no control possible, of any third parties or third countries to whom the United States may transmit such personal data.
The Legal Service of the European Parliament formulated a number of objections in the same sense in a rather circumstantial analysis.
It was on my initiative that the Chamber Committee on Foreign Relations pulled the alarm bell and not without question went to the approval of this draft law but requested the opinion of the privacy commission. Faced with all the objections — objections which are also in the documents of the parliamentary dossier — I think that seeking the opinion of the Privacy Committee was a very justified step. Only last Monday we heard a number of people from the privacy commission. We have heard, among others, the gentlemen Willem De Beuckelaere and Bart De Schutter. Their comments were actually very critical in the light of the above. They set out a number of issues regarding the protection of privacy.
The agreement, they say, is poorly structured in terms of protection and supervision of privacy. They also note that many provisions are already implemented and that this is problematic.
There is, among other things, a control mechanism that should be installed. However, they note that during those two years the control mechanism is not yet operational.

Als we dit akkoord zomaar goedkeuren, dan lopen we eigenlijk in een netjes geplaatste val. Het is een val want in naam van de strijd tegen het terrorisme en in naam van de strijd tegen de inperking van onze vrijheden gooien we net onze vrijheden en onze fundamentele rechten overboord. We staan dus op het punt om toe te geven met een meerderheid in het Parlement. We lopen eigenlijk in de val en we hollen onze eigen democratie uit. Mag ik alstublieft vragen om hier toch even bij stil te staan? Er zijn alternatieven mogelijk. Laten we een signaal geven. We hoeven hier niets goed te keuren waarvan we zelf allemaal goed beseffen dat het op het vlak van privacy zeer, zeer problematisch is.

En effet, selon moi, ce traité n'offre pas de garanties suffisantes et contient des dispositions imprécises. Certes, la menace terroriste ne doit pas être sous-estimée. Mais il ne peut verser dans des dérives qui consistent à vouloir absolument tout contrôler, au risque de mettre en péril les fondements mêmes de la démocratie.
L'enregistrement des données personnelles doit pouvoir aller de pair avec un traitement efficace et transparent de celles-ci, mais il faut garder un équilibre et, surtout, cela ne doit pas se transformer en big brother universel. En effet, les données concernées sont: des renseignements concernant l'agence de voyage ayant effectué la réservation; l'itinéraire du déplacement (étapes éventuelles, connexions); les vols concernés; les groupes de personnes reprises sous une même réservation; les contacts du passager (numéro de téléphone, etc.); l'orientation sexuelle; les tarifs accordés, les détails de paiement (carte bancaire); les réservations d'hôtel ou de voiture; les services demandés à bord (numéro de place, repas casher, hallal, végétarien, assistance médicale); le statut frequent flyer.

Et surtout, dans la pratique actuelle, les dispositions de l'accord sont bel et bien mises en œuvre sans la protection, minimale peut-être, mais sans la protection bien précisée dans cet accord. Donc, le danger est encore plus immense.
C'est la raison pour laquelle, à la lumière de tous ces éléments, nous voterons du bout des doigts l'adoption de cet accord par pur pragmatisme et réalisme. En effet, il vaut mieux adopter cet accord que de laisser le flou permettre tout et n'importe quoi. L'essentiel doit, dès lors, porter sur des garanties juridiques en termes de protection de droits fondamentaux des citoyens. À cette fin, nous souhaitons qu'une attention particulière soit portée à l'évaluation de l'accord. Lors de nos discussions en commission, le ministre des Affaires étrangères a précisé que la Commission européenne prévoit une évaluation de l'accord en mars ou avril de l'année prochaine.
Je plaide donc activement pour que, dès la mise en place de la nouvelle Commission européenne, notre gouvernement et notre parlement puissent concrètement veiller à ce que cette évaluation aboutisse. J'insiste sur le terme "concrètement", car l'accord prévoit un examen à intervalles réguliers par l'Union européenne et le département de la Sécurité intérieure des États-Unis, mais il n'en précise pas les modalités pratiques. That is why, in the light of all these elements, we will vote with all our fingers for the adoption of this agreement by pure pragmatism and realism. Indeed, it is better to adopt this agreement than to let the vague allow everything and anything. The main point must therefore be the legal guarantees in terms of the protection of the fundamental rights of citizens. To this end, we would like to pay particular attention to the evaluation of the agreement. During our discussions in the committee, the Minister of Foreign Affairs specified that the European Commission plans to evaluate the agreement in March or April of next year.
I therefore actively advocate that, as soon as the new European Commission is set up, our government and our Parliament can effectively ensure that this evaluation results. I insist on the term “concrete”, as the agreement provides for a periodic review by the European Union and the Department of Homeland Security of the United States, but it does not specify the practical arrangements. Which Commissioner, for example, will be responsible for this assessment? How will we proceed?
Knowing that this agreement was signed in 2007 and that, in practice, it already produces its effects, whether we want it or not, it is therefore urgently necessary to put this dossier on the European table, in order to be able to draw the conclusions in light of all the concerns we experience.

The system works; a fellow citizen was confronted with it since one of our fellow citizens on his way to Latin America, passing over American airspace, saw his plane forced to be deviated. This proved to be very problematic for all passengers due to time loss and missed correspondence. The event has resulted in economic losses, an argument that comes into account in these discussions.
Did this man have anything to blame? Did he have weapons? Did he prepare an attack plan? and no. He was able to get out completely free from the plane and return in the other direction via another plane. For the United States, however, this gentleman, given the algorithm of the data in their possession, from various databases, was suspicious. It is doubtful though that they cannot read each sheet one by one and that they therefore use mathematical systems. Obviously, a mathematical system can have failures.
What have we done, we Belgium, to stop the failure of these mathematical systems against one of our fellow citizens, to allow him to take back that plane and discuss this issue?
