                    Volgens mij zou het interessant zijn als de bevoegde minister aanwezig is om meer duidelijkheid te scheppen inzake de retroactieve werking. Terzake lijkt het mij van belang het standpunt van de regering te vernemen. Deze richtlijn wordt te laat omgezet. Normaal gezien had deze omzetting reeds op 8 april moeten plaatsvinden. Ondertussen kan het BIPT overtredingen hebben vastgesteld op deze wetgeving. Het is van groot belang te weten wat het juridische statuut is van deze vaststellingen.

                    Monsieur le président, chers collègues, la commission de l'Infrastructure, des Communications et des Entreprises publiques a consacré trois réunions à l'examen de ce projet, pour lequel l'urgence a été sollicitée, à savoir les 10, 17 et 23 mai derniers. Le projet contient des dispositions tendant à transcrire en droit belge deux directives européennes. La première est celle du 9 mars 1999 concernant les conditions d'agrément des appareils terminaux de télécommunication et la reconnaissance mutuelle de leur conformité: la directive RTTE. Le système d'agrément est remplacé par une procédure de déclaration du fabricant, de laquelle il appert que les appareils qu'il émet sur le marché sont conformes à certaines exigences de base, notamment en matière de sécurité. La deuxième directive du 23 juin 1999 tend à imposer en droit belge la séparation juridique d'un opérateur, qui exploite à la fois un réseau de télécommunications et un réseau câblé de télévision. Cette directive est destinée à stimuler davantage la concurrence dans ce secteur en pleine évolution. En troisième lieu, le projet reprend des dispositions sur le service universel dans le domaine des services postaux, en créant un fonds de compensation calqué sur ce qui existait déjà en la matière dans le domaine des télécommunications. Ces dispositions avaient déjà fait l'objet d'un arrêté royal du 9 juin 1999. Le Conseil d'Etat avait, cependant, annulé ledit arrêté en considérant que l'instauration d'un fonds de compensation pour financer le service universel dans le domaine des services postaux revenait à taxer en quelque sorte les opérateurs. Or, aucune taxation ne peut être imposée si ce n'est par une loi. Certains membres de la majorité ont salué les efforts du gouvernement de rattraper le retard en matière de transcription des directives, même si, en l'occurrence, on utilise pour ce faire la loi de 1991 sur les entreprises publiques, qui n'est peut-être pas l'outil le plus indiqué pour une législation qui organise la concurrence entre opérateurs de télécommunications. M. Yves Leterme du groupe CVP, dont plusieurs amendements ont été adoptés à l'unanimité, ce qui démontre par ailleurs une volonté commune de travailler de manière efficace et constructive en commission, critique les déclarations du ministre en matière de transcription. En effet, la Belgique n'est pas l'élève modèle de l'Europe. La loi entrera en vigueur après la date fixée par les directives. En outre, ce membre déplore qu'on ait inséré dans une loi de tanscription des dispositions relatives aux postes, dont rien n'est dit dans l'exposé des motifs. Enfin, sur le fond, M. Leterme veut faire reconnaître l'idée de corégulation du secteur des opérateurs Télécom dans les textes, en chargeant concrètement l'IBPT et non la justice de sanctionner les infractions. Le ministre des Télécommunications ne s'oppose pas, a priori, à cette idée, mais a précisé qu'elle ferait l'objet d'un projet de loi ultérieur. Les amendements du gouvernement, la plupart des amendements de M. Leterme, tous les articles du projet ainsi que le projet lui-même ont été adoptés à l'unanimité.

Mr. Speaker, dear colleagues, the Committee on Infrastructure, Communications and Public Enterprises has devoted three meetings to the examination of this project, for which the urgency was requested, namely the last 10, 17 and 23 May. The bill contains provisions aiming to translate two European directives into Belgian law. Directive 1999/39/EC of the European Parliament and of the Council of 9 March 1999 concerning the conditions for the approval of telecommunication terminal devices and the mutual recognition of their conformity. The approval scheme shall be replaced by a manufacturer’s declaration procedure, by which the manufacturer asserts that the devices it places on the market comply with certain basic requirements, in particular safety requirements. The second directive of 23 June 1999 aims to impose in Belgian law the legal separation of an operator, which operates both a telecommunications network and a cable television network. This Directive aims to further stimulate competition in this rapidly evolving sector. Thirdly, the project incorporates provisions on universal service in the field of postal services, creating a compensation fund based on what already existed in the field of telecommunications. These provisions had already been the subject of a royal decree of 9 June 1999. The Council of State had, however, annulled that decree by considering that the establishment of a compensation fund to finance the universal service in the field of postal services was equivalent to taxing operators in some way. No tax can be imposed unless it is by law.                     Mijnheer de voorzitter, ik wil in eerste instantie de verslaggever danken voor haar maidenspeech die zij in zeer moeilijke omstandigheden heeft voorbereid. De tekst werd pas gisteren besproken en moest dan nog worden samengevat in een verslag. Ik dank trouwens ook de diensten en het kabinet, die nog hard hebben gewerkt of hebben moeten werken om van de tekst een coherent geheel te maken. Ik geef u een drietal bedenkingen, om daarna even kort op de inhoud van het wetsontwerp in te gaan. Ten eerste, dit is een zeer belangrijk wetsontwerp. Dat blijkt niet uit de aandacht die daaraan werd besteed tijdens de werkzaamheden in de commissie en wellicht ook niet in de plenaire vergadering. Dit is een zeer belangrijk wetsontwerp om minstens twee redenen. Een eerste reden is dat het de toegang tot de markt betreft van radioapparatuur en telecomeindapparatuur. Dit betreft een sector met een groeiende miljardenomzet en die quasi alle consumenten in ons land aanbelangt. Een tweede reden is dat wij in de wet op de overheidsbedrijven met betrekking tot de telecommunicatie eigenlijk via deze wet invoeren dat operatoren die houder zijn van zowel telecominfrastructuur als kabelinfrastructuur, in de toekomst moeten worden opgesplitst in juridisch gescheiden eenheden. Dat betekent dat operatoren als Belgacom die in die situatie zouden belanden, zich juridisch zouden moeten opsplitsen. Gelukkig werd gisteren een amendement van onze hand goedgekeurd waardoor dit wordt verholpen. Een eerste belangrijk element is dus dat dit een heel belangrijk wetsontwerp is, maar de aandacht ervoor vanwege het parlement is eerder ontgoochelend. Ten tweede, dit dossier werd door de regering slecht aangepakt, of minstens niet goed aangepakt. Dat geldt zowel op het vlak van de procedure als op het vlak van de vorm. De minister van Telecommunicatie heeft in het verlengde van andere verklaringen door de regering verkondigd dat hij van België de beste leerling in de Europese klas zou maken, meer in het bijzonder de Europese telecomklas. Dit is het eerste wetsontwerp dat wij mogen bespreken, dat namens de regering werd ingediend door minister Daems van Telecommunicatie. Onmiddellijk zijn er echter belangrijke gebreken. Een eerste belangrijk gebrek is dat de omzetting van de richtlijn inzake de RNTTE-apparatuur te laat zal gebeuren. Normaal moest deze regelgeving in ons land in werking treden op 8 april 2000. In de praktijk zal dit met heel wat vertraging gebeuren en daarvoor is deze regering verantwoordelijk. Immers, de keuze voor omzetting door een koninklijk besluit was haar keuze, maar dat werd in november/december afgeblokt door de Raad van State. Sindsdien zijn nog heel wat weken voorbijgegaan vooraleer uiteindelijk begin april 2000 een wetsontwerp werd ingediend. Een voetnoot hierbij. Deze week hebben wij kunnen vaststellen dat de Europese Commissie een stand van zaken heeft opgemaakt inzake de evolutie van het percentage van Europese richtlijnen die niet tijdig werden omgezet. Daaruit bleek dat wij in het voorjaar van 1998 een achterstand hadden van 7,1%. Die achterstand was in het voorjaar van 1999 vrijwel gehalveerd en bedroeg iets meer dan 3%. Sindsdien is de inhaaloperatie stilgevallen en dit ondanks ronkende verklaringen, ondanks de benoeming van een regeringscommissaris die daar na de dioxinecrisis specifiek voor werd betaald of dat toch minstens als opdracht heeft. Het is belangrijk dat toch eens te onderstrepen. Er is een grote tegenstelling tussen enerzijds, de verklaringen dat wij van ons land de beste leerling van de Europese klas zouden maken en anderzijds, de praktijk. Bovendien, mijnheer de minister, dient gezegd dat de teksten die u hebt ingediend - ik heb het u al gezegd in de commissie, ik heb het u eerder in alle openheid gezegd en herhaal het vanaf de tribune - op zijn minst voor heel wat verbetering vatbaar bleken. Ik herinner mij dat u bij het begin van de besprekingen einde april 2000 met veel aplomb beklemtoonde dat u de urgentie vroeg voor dit wetsontwerp, maar dat u op het einde van de commissievergadering eigenlijk blij was uitstel te kunnen vragen tot een week later. De week daarna zijn wij dan vertrokken met de bijeenkomst van een werkgroep en die heeft dan uiteindelijk deze week plaatsgevonden. Gisteren hebt u dan moeten vragen dat wij akkoord zouden gaan met een mondeling verslag om dit nog binnen een redelijke termijn te kunnen afhandelen. Het feit dat die omzetting zo laattijdig gebeurt, is vervelend voor onze werkzaamheden en voor het prestige van de regering. Dat prestige krijgt, wat dat luik betreft, een serieuze deuk. Het is ook heel vervelend voor de markt. Dit gaat over een heel belangrijke consumentenmarkt. Sinds 8 april is er de facto in ons land rechtsonzekerheid. Ik vroeg u gisteren wat er nu zal gebeuren met de vaststellingen die het BIPT doet bij niet-naleving van elementen die in deze richtlijnen of in onze wetgeving staan. Die vaststellingen gebeuren sinds 8 april. Wat is het juridisch statuut daarvan? Is er al dan niet een retroactieve werking van de bepalingen van dit ontwerp op die gevallen van toepassing? Gisteren zei u dat dit niet het geval was. Ik vraag mij af of het kan dat in een parlementair verslag een afwijking op de wet wordt voorgesteld. Daarnet werd dit door de voorzitter terecht onderstreept. Er is een artikel in fine dat de inwerkingtreding behandelt, behoudens drie artikelen, met terugwerkende kracht tot 8 april. Wij stelden vast dat er een aantal artikelen instonden rond de postdiensten, maar dat die vergeten waren in de memorie van toelichting en dat u, met betrekking tot de nooddiensten, gisteren in extremis het gelukkig initiatief nam om dit artikel te schrappen uit uw oorspronkelijk ontwerp. Ten eerste, dit gaat over een zeer belangrijke materie. Er is te weinig aandacht voor. Ten tweede, dit is legistiek half werk vanwege de regering die zelf zegt dat ze, op het vlak van de omzetting van de Europese regelgeving, van ons land de modelleerling in de Europese klas wil maken. Een derde opmerking is gericht tot deze Kamer. Mijnheer de voorzitter, mijnheer de minister, collega's, ik heb de indruk dat onze parlementaire procedure, de manier waarop onze werkzaamheden zijn georganiseerd, niet goed aangepast is aan de hoge techniciteit van de regelgeving die met betrekking tot de ICT aan de orde is. De minister heeft er in de loop van de werkzaamheden terecht de nadruk op gelegd en een goed initiatief genomen om uiteindelijk in een werkgroep bijeen te gaan zitten. Vaak ontbreekt het de Kamer aan technische voorbereiding om op een correcte wijze de gevolgen van de voorliggende teksten en amendementen goed in te schatten. We moeten mijns inziens nog eens nadenken over de aanpassing van onze werkzaamheden aan dit soort wetgevingsvelden. Het feit dat daarvoor weinig aandacht is, staat voor de meeste fracties in schril contrast met de verklaringen bij verkiezingen, in allerlei vrije tribunes, dat de Telecomsector en de informatiemaatschappij van cruciaal belang is. De minister heeft daar veel aandacht voor, maar ik stelde toch vast dat daarover, in de commissie, en waarschijnlijk straks ook hier in de plenaire vergadering, door de andere fracties met geen woord is gerept. Over dit belangrijk wetsontwerp werd door de meeste fracties geen woord gezegd. Dit laat ons toe om de grote verklaringen over het belang van de informatie- maatschappij, de grote verklaringen die werden afgelegd door de vertegenwoordigers van die fracties, al dan niet in verkiezingstijd, naar hun juiste waarde te schatten. Wat betreft de parlementaire procedure kunnen we misschien een uitzondering maken naar de onaangepastheid. Ik denk dat de invoering van wetgevingstechnische nota's, een goede innovatie is. Naast deze drie opmerkingen van algemene aard, wil ik heel kort op de inhoud ingaan. Ik zal het debat in commissie, dat voortreffelijk is samengevat door de verslaggever, niet overdoen. Als CVP-fractie kunnen we tevreden vaststellen dat tien amendementen van onze fractie unaniem aanvaard werden. Het siert de regering en meer in het bijzonder de minister van Telecommunicatie, de heer Daems, dat hij daarvoor ook de ruimte heeft gemaakt. Andere regeringsleden kunnen daaraan een voorbeeld nemen. Mijnheer de minister, ik weet dat ik u, door dit te zeggen, niet méér populair maak binnen de regering, maar het is de waarheid en uw verdienste. Er zijn wel nog een aantal punten waar onze meningen duidelijk uiteenlopend blijven. Ik heb het dan in het bijzonder over het cruciale punt van het markttoezicht. Met dit wetsontwerp zullen wij op de markt van radio-apparatuur en telecomeindapparatuur overstappen van een a priori-controle naar een a posteriori-controle. Dat betekent dat producten op onze markt zullen komen zonder dat ze vooraf door bijvoorbeeld het BIPT zijn gecontroleerd op conformiteit met de regelgeving. Bijgevolg zal men, ter bescherming van de positie van de consument, erover moeten waken dat die bescherming even sterk blijft. Wat de handhaving van de regelgeving betreft menen wij dat het wetsontwerp een status quo inhoudt. De vervolging van overtredingen van de regelgeving wordt nog altijd toevertrouwd aan justitie. Volgens ons is dat niet de goede keuze. Rekening houdende met de evolutie van de sector moet er worden overgestapt naar een coregulering en een rolling back van regulering. Er moet minstens meer nadruk worden gelegd op het soepel inspelen op de realiteit. De handhaving van de regelgeving moet gebeuren op basis van administratieve boetes, veeleer dan verwijzingen naar het parket, wat niet meer is aangepast aan de evolutie van de markt en van de sector. Het feit dat u in uw ontwerp blijvend een beroep doet op het parket om een aantal overtredingen te vervolgen gaat in tegen onze opvatting dat men een einde moet stellen aan de overbelasting van justitie. Wij moeten veeleer vertrouwen hebben in de bedrijfssectoren. Er moet meer nadruk worden gelegd op een goede handhaving vanuit het BIPT. Dat moet ervoor zorgen dat Justitie wordt ontlast inzake de controle en de handhaving van deze regelgeving. Wij betreuren dat u ons amendement op artikel 109quater van de wet van 1991 inzake de overheidsbedrijven niet hebt willen overnemen. Wij hebben evenwel ook nota genomen van uw toezegging - wij hopen dat u ze hier in plenaire vergadering herhaalt - dat u weliswaar dit amendement op dit ogenblik niet aanvaardt, maar dat u bereid bent in een eerstvolgende programmawet de idee die de grondslag vormt van het amendement op artikel 109quater over te nemen. Rekening houdende met uw engagement en het feit dat wij de kans hebben gehad om via onze amendering dit wetsontwerp op ingrijpende wijze te verbeteren, is de CVP-fractie bereid om uw eerste wetsontwerp mee goed te keuren.

I will give you a few concerns, to then briefly go into the content of the draft law. First, this is a very important bill. This is not evident from the attention paid to it during the work in the committee and ⁇  not even in the plenary session. This is a very important bill for at least two reasons. The first reason is that it concerns access to the market of radio equipment and telecommunications terminal equipment. This is a sector with a growing billion-dollar turnover that affects virtually all consumers in our country. A second reason is that we actually introduce in the Telecommunications Public Companies Act through this law that operators who own both telecommunications infrastructure and cable infrastructure should in the future be divided into legally separate units. This means that operators such as Belgacom who would find themselves in this situation would have to legally split themselves. Fortunately, yesterday, an amendment from our hand was adopted to fix this. So a first important element is that this is a very important bill, but the attention to it because of the parliament is rather disappointing. Second, this case was poorly addressed by the government, or at least not properly addressed. This applies both in terms of procedure and in terms of form. The Minister of Telecommunications has announced in the course of other statements by the government that he would make Belgium the best pupil in the European class, more specifically the European telecom class. This is the first bill to be discussed, which was submitted on behalf of the government by Minister Daems of Telecommunications. However, there are significant shortcomings immediately. One of the first major shortcomings is that the transposition of the RNTTE equipment directive will be too late. Normally, this regulation had to enter into force in our country on 8 April 2000. In practice, this will happen with a lot of delay and this government is responsible for it. After all, the choice to be converted by a royal decree was her choice, but that was blocked by the Council of State in November/December. Since then, many weeks have passed before a draft law was finally submitted in early April 2000. A footnote here. This week we have been able to conclude that the European Commission has drawn up a current status on the evolution of the percentage of European directives not transposed in time. It showed that in the spring of 1998 we had a downturn of 7.1%. That downturn had almost halved in the spring of 1999 and was slightly more than 3%. Since then, the collection operation has stopped, and this despite rumbling statements, despite the appointment of a government commissioner who was specifically paid for it after the dioxin crisis, or who has at least been commissioned. It is important to emphasize this. There is a great contradiction between, on the one hand, the statements that we would make our country the best pupil of the European classroom and, on the other hand, the practice. Furthermore, Mr. Minister, it should be said that the texts you submitted – I have already told you in the committee, I have told you before in all openness and repeat it from the tribune – at least proved susceptible to a lot of improvement. I remember that at the beginning of the discussions at the end of April 2000 you emphasized with much applause that you asked for the urgency for this bill, but that at the end of the committee meeting you were actually happy to be able to ask for a postponement until a week later. The week after, we then left with the meeting of a working group and it eventually took place this week. Yesterday you had to ask that we would agree to a verbal report in order to be able to deal with it within a reasonable time. The fact that this conversion takes place so late is annoying to our work and to the prestige of the government. That prestige, as far as this leak is concerned, has a serious deceit. It is also very annoying for the market. This is a very important consumer market. Since April 8, there has been de facto legal uncertainty in our country. I asked you yesterday what will now happen to the findings that the BIPT makes in case of non-compliance with elements contained in these guidelines or in our legislation. These findings have been taking place since April 8. What is its legal status? Is or is there a retroactive effect of the provisions of this draft applicable to those cases? Yesterday you said this was not the case. I wonder if it is possible that a parliamentary report proposes a derogation from the law. This was rightly underlined by the President. There is an article in fine that deals with the entry into force, with the exception of three articles, with retroactive effect until 8 April. We found that there were some articles coming around the postal services, but that they were forgotten in the explanatory memory and that you, with regard to the emergency services, yesterday in extremis took the happy initiative to remove this article from your original design. First, this is about a very important matter. There is too little attention. Second, this is legistically half-work because the government itself says that, in terms of transposing European regulations, it wants to make our country the model learner in the European class. A third note is addressed to this Room. Mr. Speaker, Mr. Minister, Colleagues, I have the impression that our parliamentary procedure, the way our work is organized, is not well adapted to the high technical level of regulation concerning ICT. The Minister has rightly emphasized it during the course of the work and has taken a good initiative to eventually sit together in a working group. Often the Chamber lacks technical preparation to properly assess the effects of the present texts and amendments. In my opinion, we need to reflect on adapting our work to this type of legislative fields. The fact that there is little attention to this is in sharp contrast for most political groups with the statements made at elections, in all kinds of free tribunes, that the telecommunications sector and the information society are of crucial importance. The Minister has a lot of attention to this, but I have noted that in the committee, and probably later here in the plenary session, the other groups have not spoken a word about it. About this important bill, the majority of the groups did not say a word. This allows us to estimate the great statements about the importance of the information society, the great statements made by the representatives of those groups, whether or not at the time of the election, by their proper value. With regard to the parliamentary procedure, we may be able to make an exception to the inadaptation. I think the introduction of legislative notes is a good innovation. In addition to these three general comments, I would like to briefly address the content. I will not exaggerate the discussion in the committee, which has been excellently summarized by the reporter. As a CVP group, we are pleased to conclude that ten amendments from our group were unanimously accepted. It honors the government and more in particular the Minister of Telecommunications, Mr. Daems, that he has also made room for this. Other government members can take an example. Mr. Minister, I know that by saying this, I do not make you more popular within the government, but it is the truth and your merit. However, there are a number of points where our opinions remain clearly divergent. I am speaking in particular about the crucial point of market surveillance. With this bill, we will move from a priori control to a posteriori control in the market of radio equipment and telecommunications terminal equipment. This means that products will come on our market without being previously checked by the BIPT for compliance with the regulations. Consequently, in order to protect the position of the consumer, it will be necessary to ensure that that protection remains equally strong. As regards the enforcement of the regulation, we believe that the bill contains a status quo. The prosecution of regulatory violations is still entrusted to justice. We believe that is not the right choice. Taking into account the evolution of the sector, there should be a transition to co-regulation and a rolling back of regulation. At least more emphasis should be placed on the smooth response to reality. Enforcement of regulations should be based on administrative fines, rather than references to the prosecutor’s office, which is no longer adapted to the evolution of the market and the sector. The fact that you in your draft permanently appeal to the prosecutor’s office to prosecute a number of violations is contrary to our view that we should end the overload of justice. Instead, we need to have confidence in business sectors. More emphasis should be placed on good enforcement from the BIPT. This should ensure that Justice is relieved of the burden of monitoring and enforcement of these regulations. We regret that you did not want to accept our amendment to Article 109quater of the Act of 1991 on Public Companies. However, we have also taken note of your commitment – we hope you will repeat it here in the plenary session – that although you do not accept this amendment at the moment, you are willing to incorporate the idea that is the basis of the amendment on Article 109quater in a subsequent program law. Taking into account your commitment and the fact that we have had the opportunity to improve this bill in a profound way through our amendment, the CVP group is prepared to approve your first bill.

                    Uw interpretatie klopt, mijnheer de voorzitter. Dat probleem is dus meteen van de baan. Ik zal vrij kort antwoorden want wij hebben dit wetsontwerp uitgebreid behandeld in de commissie. Ik zal enkele elementen van algemene aard toelichten. Allereerst wil ik toegeven dat wij deze richtlijn met ruim een maand vertraging omzetten. Ik heb evenwel een lijstje gemaakt van de richtlijnen waarvan de omzetting te laat was, maar die ondertussen zijn bijgewerkt. Het gaat over tien verschillende richtlijnen met in totaal elf bepalingen. Als wij vandaag dit wetsontwerp goedkeuren, zullen er van die elf bepalingen tien definitief zijn afgehandeld. Ik zal ze even opsommen. Het gaat over de richtlijnen 95/62, 97/33, 97/51, 90/388, 98/61, 90/388, 97/66, 99/64, 99/50 - op de laatste twee heeft dit wetsontwerp betrekking - en het koninklijk besluit van 10 januari 1992 inzake de radiodiffusie dat bij wet moest worden bekrachtigd. Het eerste cijfer geeft het jaar weer waarin de richtlijn werd uitgevaardigd. U merkt dus dat er nog twee richtlijnen van 1990 bij waren. Gezien wij inmiddels via koninklijke besluiten of via een wet - zoals terzake gebeurde - de zaken hebben omgezet, werden tien van de elf richtlijnen afgehandeld. De elfde richtlijn betreft de regularisatie van speciale tarieven voor de pers, waarrond heel wat te doen was, en dat ik via een koninklijk besluit wou regelen, maar dit werd niet aanvaard door de Raad van State. Desondanks zal deze materie binnenkort door de Kamer worden behandeld en men kan er aldus van uitgaan dat de personeelsleden van het betrokken departement erg hun best hebben gedaan. Dat neemt echter niet weg dat de termijn met ongeveer anderhalve maand werd overschreden. De enige verschoning - al doet dat geen afbreuk aan de laattijdigheid is dat ik deze richtlijn wel degelijk heb omgezet via een koninklijk besluit, maar dat de Raad van State het niet aanvaardde en de indiening van een wetsontwerp eiste. Voorts dank ik alle leden, zowel van de bevoegde commissie als van deze plenaire vergadering, voor het feit dat zij het ermee eens waren dat men zich terzake zou beperken tot een mondeling verslag, hetgeen ons toeliet de timing te handhaven. Inderdaad, de behandeling van de materie werd met een week uitgesteld, maar het eindpunt bleef ongewijzigd aangezien iedereen het eens was met een mondeling verslag. Mijnheer de voorzitter van de commissie, wat betreft de parlementaire procedure bij de behandeling van deze ontwerpen werd een poging ondernomen om een onderscheid te maken tussen het technische en het beleidsmatige aspect en daarin zijn wij behoorlijk goed geslaagd. Misschien ware het aangewezen de zaken nog een beetje te verfijnen, zulks in overleg met de voorzitter van de Kamer, die gevoelig is voor afwijkingen aan de traditionele werkwijze bij de behandeling van wetsontwerpen. Dit liet ons evenwel toe de vereiste snelle timing te handhaven en te kunnen doorwerken aan de beleidsaspecten. De toepassing van de parlementaire procedure waarbij een gescheiden behandeling mogelijk is, is erg belangrijk; immers, anders zouden er wellicht uren zijn voorbijgegaan aan zuivere procedurewerkzaamheden, zoals stemmingen, artikelsgewijze besprekingen, behandeling van amendementen, hetgeen weinig productief is. In het commissieverslag kwamen heel wat elementen reeds uitvoerig aan bod die ik hier niet meer zal aanhalen. Wel wens ik nog een woord te zeggen over het concept van regulering, autoregulering of coregulering. In de commissie deed ik een toezegging, met name het fameuze amendement 109 quater, dat terzake werd ingediend en onder meer op dit luik betrekking heeft, te behandelen samen met de programmawet die nog vóór het zomerreces zal worden besproken, uiteraard behoudens onvoorspelbare gebeurtenissen. De huidige houding van Groot-Brittannië en van België inzake regulering in de telecomsector, gaat naar de coregulering dat wordt gedefinieerd als de markt de regulering zelf te laten uitwerken. Wanneer de doelstellingen van de markt in strijd zijn met het algemeen belang of het specifiek belang van een overheid gaat men over naar coregulering waarbij operatoren, consumenten en overheid in een driehoek worden samengebracht. Het is mijn bedoeling om dit dan effectief via een koninklijk besluit of eventueel een wet aan te passen. Dat is volgens mij de weg die moet worden gevolgd. Dat is trouwens meteen de reden waarom ik die toezegging heb gedaan en waarom ik het amendement uit het pakket haal. Dit amendement werd met andere woorden niet aanvaard omdat ik er wellicht nog een aantal elementen zal aan toevoegen. Mijnheer de voorzitter, het verheugt mij dat het werk in verband met de richtlijnen zo goed als afgerond is. Uiteraard moeten nog een aantal akkefietjes worden geregeld, maar vanaf nu zullen wij ons meer kunnen toespitsen op nieuwe beleidselementen omtrent de gsm's van de derde generaties en de bundeling van de local loop in welk verband thans een marktonderzoek wordt verricht. Dat zijn bijzonder belangrijke elementen voor de vrijmaking van de telecommarkt. En, in de rand daarvan, lijkt de vertaling van de coregulering als concept in de wetgeving, mij een goede evolutie. Het verheugt mij dat het wetsontwerp in de commissie unaniem werd goedgekeurd; dat maakt trouwens meteen duidelijk dat iedereen het eens is over de richting die terzake moet worden gevolgd, met name het volgen van de Europese richtlijnen. Dat is ook de richting die de regering, alsook de hele oppositie, uitgaat wat betreft de regelgeving inzake de telecommarkt. Immers, de vrijmaking van de markt kan slechts ten goede komen van de prijs en de kwaliteit voor de consument.

Your interpretation is correct, Mr. President. This problem is immediately out of the job. I will answer quite briefly because we have discussed this bill extensively in the committee. I will explain some elements of a general nature. First of all, I would like to admit that we are transposing this Directive with more than a month of delay. However, I have made a list of the directives which were late to transpose, but which have been updated in the meantime. It consists of ten different directives with a total of eleven provisions. If we approve this bill today, ten of those eleven provisions will be finally settled. I will list them for a moment. These are Directives 95/62, 97/33, 97/51, 90/388, 98/61, 90/388, 97/66, 99/64, 99/50 — the latter two are concerned by this draft law — and the Royal Decree of 10 January 1992 on broadcasting, which had to be ratified by law. The first digit represents the year in which the Directive was issued. There were two directives from 1990. Since we have now translated things through royal decrees or through a law – as in this case – ten of the eleven directives were handled. The eleventh directive concerns the regularization of special tariffs for the press, around which there was much to do, and which I wanted to settle through a royal decree, but this was not accepted by the Council of State. Nevertheless, this matter will soon be dealt with by the Chamber and it can therefore be assumed that the staff members of the department concerned have done their best. However, the deadline was exceeded by approximately one and a half months. The only change – though that does not affect the delay – is that I have indeed transposed this directive through a royal decree, but that the Council of State did not accept it and demanded the submission of a draft law. I am also grateful to all the members, both of the committee responsible and of this plenary session, for agreeing to limit the subject to an oral report, which allowed us to maintain the timing. Indeed, the treatment of the matter was delayed by a week, but the end point remained unchanged as everyone agreed to a verbal report. Mr. Speaker of the Committee, as regards the parliamentary procedure in the examination of these drafts, an attempt was made to distinguish between the technical and the political aspects, and in this we have been quite successful. Per ⁇  it would be appropriate to refine the affairs a little more, in consultation with the chairman of the Chamber, who is sensitive to deviations from the traditional method of handling bills. This, however, allowed us to maintain the required quick timing and to continue working on policy aspects. The application of the parliamentary procedure, which allows for a separate treatment, is very important; otherwise, there might have been hours of purely procedural work, such as voting, article-based discussions, examination of amendments, which is unproductive. In the committee report, many elements have already been discussed in detail, which I will not repeat here. However, I would like to say another word about the concept of regulation, self-regulation or co-regulation. In the committee, I made a commitment, in particular the famous amendment 109 quater, which was submitted in this regard and relates, among other things, to this leak, to deal with the program law that will be discussed before the summer break, of course, except for unpredictable events. The current position of Britain and Belgium on regulation in the telecommunications sector, goes to the co-regulation which is defined as the market to let the regulation develop itself. Where the market objectives are in conflict with the general interest or the specific interest of a public authority, it is transitioned to co-regulation which brings together operators, consumers and government in a triangle. I intend to amend this then effectively through a royal decree or possibly a law. I think that is the path that must be followed. That is why I made this commitment and why I remove the amendment from the package. In other words, this amendment was not accepted because I may add a few additional elements to it. Mr. Speaker, I am pleased that the work on the directives is almost completed. Of course, there are still a number of shuttles to be arranged, but from now on we will be able to focus more on new policy elements regarding third-generation GSMs and the bundling of the local loop in which context a market research is currently being carried out. These are especially important elements for the liberalization of the telecommunications market. And, on the edge of that, the translation of coregulation as a concept in legislation seems to me a good evolution. I am pleased that the draft law was unanimously approved in the committee; that, by the way, makes it immediately clear that everyone agrees on the direction to be followed in this matter, in particular the following of the European directives. This is also the direction the government, as well as the entire opposition, is taking in regards to the regulation of the telecommunications market. After all, the liberation of the market can only benefit the price and quality for the consumer.

De minister heeft een opsomming van niet-omgezette richtlijnen gegeven. Hij verwees hierbij naar de eerste twee cijferposities in de referentie van de richtlijnen. Hij verklaarde dat die cijfers op het jaartal betrekking hebben. Mijnheer de minister, een richtlijn uit bijvoorbeeld 1995 moet het jaar nadien niet noodzakelijk zijn omgezet. U kunt dat lezen in handboeken over Europees recht. De richtlijn stipuleert meestal zelf de omzettingstermijn en die verschilt van richtlijn tot richtlijn. Een richtlijn uit 1990 moet niet automatisch in 1991 worden omgezet, en dat ze nu nog niet is omgezet hoeft geen schande te zijn.

                    Mijnheer de voorzitter, mijnheer de minister, mevrouw de minister, collega's, wij willen twee opmerkingen maken over enerzijds de procedure en anderzijds ten gronde. Mijnheer de voorzitter, wij hebben in de commissie, betreffende de procedure, opgemerkt dat de regering een spoedbehandeling vraagt waarbij ze op de bepalingen van artikel 80 van de Grondwet een beroep doet. Het beheerscomité van de RJV en RVA hebben respectievelijk op 14 juli 1999 en 3 september 1999 advies gegeven. De regering liet deze mogelijkheid tot wetgevend werk acht maanden liggen en beroept zich nu op de hoogdringendheid. Dit is ons inziens niet correct ten overstaan van de werkzaamheden van de Kamer. Ten gronde is de CVP het grondig eens met de responsabilisering van werkgevers die op een niet-correcte wijze gebruik maken van het instrument tijdelijke werkloosheid om economische redenen. Tijdelijke werkloosheid mag niet afglijden naar structurele werkloosheid, verdoken seizoenarbeid of deeltijdse arbeid. Wij zijn het echter niet eens met de door de regering in dit wetsontwerp gehanteerde criteria om onrechtmatig gebruik te bepalen. Mijnheer de minister, wij hebben dit reeds in de commissie gezegd. Na goedkeuring van dit wetsontwerp zal door de werkgevers een extra bijdrage van 60 frank per werknemer per werkloosheidsdag moeten worden betaald voor iedere werkloosheidsdag boven de 10%. De goedkeuring van dit wetsvoorstel betekent concreet dat op gemiddeld 220 werkdagen reeds vanaf de 23ste werkloosheidsdag wordt geoordeeld dat de tijdelijke werkloosheid om economische redenen onterecht wordt gebruikt. De minister antwoordde mij dat bijvoorbeeld voor de kledingnijverheid 479 van 826 ondernemingen gemiddeld 43 500 frank extra bijdrage zullen moeten betalen na goedkeuring van dit wetsontwerp. In de bouwnijverheid zullen 6 981 van de 26 175 ondernemingen gemiddeld 13 116 frank moeten betalen. Mijnheer de voorzitter, mevrouw de minister, mijnheer de minister, collega's, ik vrees dat de goedkeuring van dit wetsontwerp niet zozeer de responsabilisering zal bevorderen dan wel, gezien de gehanteerde criteria, zal leiden tot de vermindering van de buffer aan werknemers met een contract van onbepaalde duur die de bedrijven in dienst houden en dat deze in tijdelijke contracten of uitzendarbeid zullen worden omgezet. Dit is geen goed wetgevend werk. Wij hadden deze responsabilisering graag goedgekeurd indien meer realiteitszin aan de dag was gelegd in het bepalen van de drempel inzake het onverantwoord gebruik van de tijdelijke werkloosheid om economische redenen. De CVP-fractie zal om deze redenen niet tegen de responsabilisering stemmen omdat ze haar genegen is, maar zal zich onthouden omdat deze regering geen blijk geeft van voldoende terreinkennis in het hanteren van de criteria.

Mr. Speaker, we have noted in the Committee, regarding the procedure, that the Government is asking for an urgent procedure in which it invokes the provisions of Article 80 of the Constitution. The Governing Committee of the RJV and RVA delivered opinions on 14 July 1999 and 3 September 1999. The government left this possibility for legislative work out for eight months and now appeals to the high urgency. This is not correct in view of the work of the House. Basically, the CVP fully agrees with the obligation of employers to use the temporary unemployment instrument improperly for economic reasons. Temporary unemployment should not be reduced to structural unemployment, temporary work or part-time work. However, we do not agree with the criteria used by the government in this bill to determine illegal use. We have already said this in the committee. After approval of this bill, employers will have to pay an additional contribution of 60 francs per employee per day of unemployment for every day of unemployment exceeding 10%. The approval of this bill means that on an average of 220 working days already from the 23th day of unemployment, it is judged that the temporary unemployment is being misused for economic reasons. The minister replied that, for example, for the garment industry, 479 of the 826 companies will have to pay an additional contribution of an average of 43,500 francs after the approval of this bill. In the construction industry, 6,981 of the 26,175 companies will have to pay an average of 13,116 francs. Mr. Speaker, Mrs. Minister, Mr. Minister, colleagues, I fear that the adoption of this bill will not so much promote the responsibilisation or, given the criteria used, will lead to the reduction of the buffer for employees with an indefinite contract employed by the companies that will be converted into temporary contracts or temporary employment. This is not a good legislative work. We would have approved this responsibilisation if more realism had been shown in determining the threshold for the irresponsible use of temporary unemployment for economic reasons. For these reasons, the CVP group will not vote against the responsibilisation because it likes it, but will abstain because this government does not demonstrate sufficient field knowledge in handling the criteria.
