Mijnheer de voorzitter, onze fractie steunt het wetsontwerp voluit. Het is geheel in de geest van het regeerakkoord, dat wil dat de politie zichtbaarder wordt en het personeelstekort in sommige zones wordt teruggedrongen.
De minister van Binnenlandse Zaken heeft daartoe reeds een resem maatregelen uitgevoerd.
Ten eerste, de algemene reserve van de federale politie werd uitgebreid. Zij ondersteunt de lokale politiezones bij manifestaties die een grotere inzet van mensen en middelen vragen. Wij denken daarbij aan de risicovoetbalwedstrijden.
Ten tweede, het federaal veiligheidskorps staat in voor het vervoer van gedetineerden van en naar de penitentiaire instellingen en voor de bewaking van de hoven en rechtbanken. Op die manier wordt de lokale politie opnieuw ontlast van een erg tijdrovende activiteit.
Ten derde, waar mogelijk, moeten de politiezones samenwerken en zoneoverschrijdende samenwerkingsverbanden sluiten.
Ten vierde, bepaalde, niet strikt politionele opdrachten kunnen worden uitgevoerd door andere partners in de veiligheidszorg. In die optiek werden de bevoegdheden van de privé-bewakingsagenten uitgebreid.
Ten vijfde en ten slotte, de hulpagenten krijgen nu een pak meer bevoegdheden, zodat zij bijstand kunnen verlenen aan de politieambtenaren die op het terrein actief zijn.
Collega's, de hulpagenten worden steeds meer een volwaardige actor in het politiewerk. VLD is dan ook niet doof voor de verzuchtingen van de hulpagenten inzake een naamsverandering. De maatregel heeft voor de overheid geen budgettaire gevolgen, maar respecteert wel de inzet van de hulpagenten, vanaf nu agenten van politie. VLD heeft ook nog een ander amendement ingediend. De bedoeling van het amendement is de agenten van politie uitdrukkelijk bevoegd te maken voor de vaststelling van inbreuken op het gemeentelijk parkeerreglement.
Sedert de inwerkingtreding van de wet van 7 maart 2003 houdende verschillende bepalingen inzake verkeersveiligheid werden het parkeren met beperkte parkeertijd, het betalend parkeren en het bewonersparkeren uit de strafrechtelijke sfeer gehaald. Zelfs al zijn de leden van de politie volgens de bepalingen van de Wegcode bevoegd gebleven om te letten op de naleving van de wetten en reglementen op de politie van het wegverkeer, toch blijkt de wetgever te hebben bedoeld de politie te ontheffen van voormelde materie en derhalve andere personen en instanties daarmee te belasten. Wij denken dan aan gemeentelijke ambtenaren en/of privé-vennootschappen. De bedoeling is de politieambtenaren toe te laten zich op hun kerntaken toe te leggen.
Toch is het raadzaam dat hulpagenten met de materie kunnen worden belast. Het tweede verslag van de commissie ter Begeleiding van de Politiehervorming op Lokaal Niveau ondersteunt het voorstel, conferator de aanbeveling van de commissie dat de hulpagenten het parkeertoezicht zouden kunnen blijven uitoefenen. Bovendien is het aan te bevelen dat de taak duidelijker in het bevoegdheidspakket van de hulpagenten wordt verankerd.

Since the entry into force of the law of 7 March 2003 containing various provisions on road safety, parking with limited parking time, paying parking and residential parking have been removed from the criminal sphere. Even if the members of the police, according to the provisions of the Road Code, remained authorized to monitor the observance of the laws and regulations on the road traffic police, yet it appears that the legislator intended to exempt the police from the aforementioned matter and therefore to tax other persons and bodies with it. We think of municipal officials and/or private companies. The purpose is to allow police officers to devote themselves to their core tasks.
Nevertheless, it is advisable that aid agents can be charged with the matter. The second report of the committee on Assistance of the Police Reform at Local Level supports the proposal, conferator the recommendation of the committee that the assistants could continue to exercise parking control. Furthermore, it is recommended that the task be more clearly anchored in the competence package of the assistants.
The municipalities therefore continue to have the choice to either deploy their own control personnel, or to resort to a surveillance firm, or even to resort to the police assistants of the police zone to which the municipality belongs.
Colleagues, it is clear that VLD is pleased with the bill. It will increase the operational employability of the police services, making the police more visible on the street. "More blue on the streets" is more than a loos credo.

Monsieur le président, monsieur le ministre, chers collègues, comme l'a rappelé M. De Padt dans son excellent rapport, ce projet de loi a été adopté par la commission de l'Intérieur à l'unanimité tant il constitue une avancée intéressante. Le projet de loi clarifie le rôle et les compétences des auxiliaires de police que nous appellerons dorénavant "agents de police". En effet, la commission a convenu qu'il était bon de faire évoluer les situations; comme il n'y a plus actuellement d'agents de police, les auxiliaires porteront maintenant cette appellation, ce qui renforce leur titre mais également leurs missions sur le terrain.
Quelles sont les principales améliorations apportées à la fonction?
Les agents de police obtiennent la plénitude de leurs compétences en matière d'infractions au Code de la route, ce qui confirme des dispositions que nous avions adoptées antérieurement.
Les agents de police pourront assister les inspecteurs de police lors de missions policières régulières. Les dispositions que nous voterons donneront plus de sécurité juridique aux actes posés par ces agents, tout en rappelant que l'assistance prêtée par les agents de police s'effectuera toujours sous la responsabilité du fonctionnaire de police qui l'a demandée.
Les agents auxiliaires de police jouiront d'une compétence sur l'ensemble du territoire, ce qui permettra d'engager ces agents dans des actions interzonales et favorisera ainsi la coopération entre zones de police. On sait combien cette coopération est importante et intéressante par les synergies possibles dans certaines sous-régions.
En termes de statut, le projet de loi consacre la primauté de l'engagement statutaire des agents de police et limitera leur engagement contractuel selon certaines conditions précises. Cela contribuera évidemment à pérenniser leur emploi, mais surtout à assurer une plus grande stabilité dans les missions qu'ils sont appelés à effectuer au bénéfice de la population au jour le jour.
J'ai également bien noté que les zones de police peuvent engager des agents de police en utilisant les moyens dégagés par le Fonds des amendes.
Enfin, désormais, la police fédérale pourra aussi recruter des agents de police, ce qui constitue un progrès permettant d'étoffer certains services, notamment la police technique et scientifique.
Le groupe socialiste se réjouit que le projet de loi reprend les éléments importants de la proposition de loi déposée par MM. Charles Picqué et Claude Eerdekens, en juin 2004. J'ai eu le plaisir de reprendre ce texte avec ma collègue Talbia Belhouari.
Les dispositions légales que nous allons adopter amélioreront le travail des agents de police en clarifiant leurs missions à la fois pour eux-mêmes, pour les zones de police mais aussi pour les citoyens.
Je souhaite vous faire partager quelques réflexions complémentaires.
En 1995, il y a dix ans, le Comité P avait consacré un chapitre de son rapport annuel à une analyse de la situation des auxiliaires de police. A ma connaissance, il n'y a rien eu depuis et il serait intéressant de disposer d'une photographie de la situation. En effet, les zones de police ont toutes besoin de personnels auxiliaires disposant de prérogatives leur permettant d'exercer efficacement leurs missions, notamment la répression des incivilités et l'exercice des sanctions administratives, ce qui suppose, dans certains cas, de demander la carte d'identité, de retenir la personne, de saisir les objets du délit.
Je pense que le texte que nous allons adopter constitue un pas en avant important.
L'idéal est, bien entendu, l'engagement d'agents de police mais ces derniers ont un coût et certaines zones plus désargentées doivent se contenter d'APS, ce qui est loin d'être satisfaisant. A ce propos, je vous rappelle les dernières recommandations formulées par le Comité P sur ces auxiliaires de prévention.
Le prochain débat devra porter sur la nécessaire clarification du statut, du recrutement, de la formation, des missions et des compétences de ces autres auxiliaires de la police que sont les APS, tels les gardiens de parcs, les agents de sécurité qui perçoivent les redevances de parking, les surveillants habilités, etc. Je pense qu'il faudra également ouvrir le débat en ce qui les concerne.
Les conditions de recrutement des agents de police sont moins restrictives que celles des inspecteurs, ce qui permet l'engagement de personnes à faibles qualifications et de personnes issues des communautés allochtones. Cela représente pour nous un élément de réalisation de la police de proximité ou police communautaire.
En outre, la fonction d'agent de police peut être un sas pour l'accession de ces personnes à la fonction d'inspecteur. Il conviendra d'être particulièrement attentif à cela. Vous connaissez notre préoccupation à permettre une diversité au sein des services de police.
Je souligne enfin qu'il est heureux de constater le souci permanent d'améliorer le cadre général du fonctionnement de notre police. La semaine dernière, nous avions déjà voté un texte en ce qui concerne l'évaluation du personnel. In terms of the statute, the bill enshrines the primacy of the statutory commitment of police officers and will limit their contractual commitment under certain precise conditions. This will, of course, contribute to sustain their employment, but above all to ensure greater stability in the tasks they are called to carry out for the benefit of the population on a daily basis.

The next debate will focus on the necessary clarification of the status, recruitment, training, tasks and skills of these other police auxiliaries that are the APS, such as park guards, security officers who collect parking fees, authorized supervisors, etc. I think it will also be necessary to open the debate as regards them.
The conditions of recruitment of police officers are less restrictive than those of inspectors, allowing the involvement of low-skilled persons and persons from immigrant communities. This represents for us an element of realization of the neighborhood police or community police.
In addition, the role of police officer can be a sass for the accession of these persons to the role of inspector. Particular attention should be paid to this. You know our concern to allow for diversity within the police services.
Finally, I would like to emphasize that he is pleased to see the continuing concern to improve the overall framework of our police operation. Last week, we already voted on a text regarding the evaluation of staff. Today, it is another step forward that allows the extensive police reform, initiated some time ago, to continue to evolve.

Mijnheer De Padt, op het einde van uw betoog had u het over meer blauw op straat. Ik hoop dat u nog niet te veel met de gemeenteraadsverkiezingen in Geraardsbergen bezig bent en dat u daarmee toch meer politie op straat bedoelde.
Mijnheer de minister, de uitbreiding van de bevoegdheden van de hulpagenten, die voortaan ook agenten zullen genoemd worden, werd reeds herhaaldelijk aangekondigd. Dit verwondert ons enigszins aangezien het ontwerp uiteindelijk ook in de commissie eenparig werd aangenomen. Er waren eigenlijk geen problemen te verwachten. Er bestond en bestaat dus ook een grote eensgezindheid rond dit punt. Het heeft alleen toch wel lang geduurd alvorens de regering met een ontwerp naar het Parlement kwam. Ik weet wel dat het gebeurd is in juni 2005, maar het heeft dan toch nog wel wat geduurd voordat het werd behandeld. Het zijn nochtans dit soort van wijzigingen die onze politiediensten meer slagkracht moeten geven en de beschikbaarheid van het politiepersoneel moeten verhogen. Ze zullen dat ook wel doen.
Ik wil ook nog eens benadrukken dat wij het amendement van de heer De Padt, om van hulpagenten agenten te maken, mee hebben ingediend en ondertekend. Het ontwerp biedt immers ook een aantal positieve bijdragen. Voortaan zullen de agenten kunnen ingezet worden met betrekking tot de verkeershandhaving, hoewel dat vroeger ook al het geval was, maar nu is er zeker duidelijkheid daarover. Ze zullen ook bijstand kunnen verlenen aan politieambtenaren bij diverse van hun taken, maar wel steeds onder het gezag van die ambtenaar. Het ontwerp bevestigt ook dat de agenten lid zijn van het operationeel kader van de politiediensten, maar dat ze geen politieambtenaren zijn en dus slechts een beperkte politiebevoegdheid zullen genieten. Ze kunnen een persoon of een voertuig ophouden en hierbij dwang gebruiken. Dit kan alleen bij heterdaad. Ze zullen inzetbaar worden in hetzelfde territoriale gebied als de politieambtenaren, wat in het verleden reeds heel wat moeilijkheden heeft opgeleverd.
Ik heb toch enige bedenkingen van onzentwege. Tijdens de bespreking in commissie hebben wij er tevens op gewezen dat enige omzichtigheid rond het functioneren van die agenten toch geboden is. Zij beschikken voortaan over meer bevoegdheden en zij kunnen in bepaalde gevallen ook dwang gebruiken, niettegenstaande zij geen politieambtenaren zijn. Voor de gewone man in de straat kan dit verwarrend overkomen. Laat ons ook niet vergeten dat de agenten niet gewapend zijn. Er zal toch een zeker spanningsveld ontstaan tussen ongewapend optreden en extra bevoegdheden en taken. We zullen dit nauwlettend in het oog moeten houden. Ik denk dan ook dat er voldoende rekening zal moeten gehouden worden met dit feit bij de opleiding en dat er in de toekomst misschien toch wel de nodige verweermiddelen moeten ter beschikking gesteld worden.
Wij zijn dan ook tevreden dat de minister zich ermee akkoord verklaarde om een jaar na de inwerkingtreding van de wet de werking van de agenten te evalueren. Persoonlijk denk ik dat men toch niet anders zal kunnen dan toch nog tot een zekere bewapening van de agenten over te gaan. De belangrijkste vragen hierbij zijn zeker of de agenten hun bevoegdheden niet te buiten zijn gegaan en of hun integriteit door de uitbreiding niet in het gedrang is gekomen. Uiteraard zullen wij de minister te gepasten tijde aan het engagement van de interpellatie herinneren.
Mijnheer de minister, ik kan u wel zeggen dat onze fractie het ontwerp en ook alle amendementen heeft gesteund en dat straks ook bij de stemming zal doen.

They will also be able to assist police officers in various of their duties, but always under the authority of that official. The draft also confirms that the agents are members of the operational framework of the police services, but that they are not police officers and therefore will only enjoy a limited police authority. They can stop a person or a vehicle and use force to do so. This can only be done in heterosexuality. They will be able to be deployed in the same territorial area as the police officers, which has already caused many difficulties in the past.
However, I have some doubts about the unknown. During the discussion in the committee, we also pointed out that some caution around the functioning of these agents is still necessary. They will now have more powers and can also use coercion in certain cases, even though they are not police officers. For the ordinary man on the street, this can happen confusingly. Let us also not forget that the officers are not armed. However, there will be a certain field of tension between unarmed action and additional powers and tasks. We will have to keep a close eye on this. I therefore think that this fact will need to be sufficiently taken into account in the training and that in the future, ⁇ , the necessary defence resources should be made available.
We are therefore pleased that the Minister agreed to evaluate the functioning of the agents one year after the entry into force of the law. Personally, I think that one will not be able to do anything but move to a certain arms of the officers. The main questions here are certain whether the agents have not exceeded their powers and whether their integrity has not been compromised by the expansion. Of course, we will remind the Minister at the appropriate time of the commitment of the interpellation.
Mr. Minister, I can tell you that our group has supported the draft and also all amendments and will do so later in the vote.

Mijnheer de voorzitter, mijnheer de minister, collega's, dit wetsontwerp regelt de toekenning van een toelage voor de aanschaf van huisbrandolie voor de verwarming van een privé-woning.
Op zichzelf is dat een goede maatregel in een periode van stijgende energieprijzen.
Toch hebben wij twee punten van kritiek bij dat wetsontwerp. Ten eerste hebben wij kritiek op de concrete aanpak en uitwerking van dat dossier. Het tweede punt van kritiek heeft betrekking op de financiering.
Het ontwerp wordt vandaag, op 9 februari, aan de plenaire vergadering voorgelegd. Aan de commissie voor de Financiën werd het voorgelegd op 25 januari. Nochtans slaat het wetsontwerp op een welbepaalde periode, die eindigt op 31 december 2005. Het geeft uitvoering aan een beslissing die de regering genomen heeft in september 2005.
In de programmawet van 27 december 2005 werd reeds een gedeelte van de wettelijke regeling behandeld. Het ware dan ook correct geweest als dat wetsontwerp in dezelfde vergadering behandeld zou zijn geweest. Aan het advies van de Raad van State kan het niet gelegen hebben, want dat werd reeds bezorgd op 30 november.
Vervolgens kom ik tot de financiering.
De financiering was normaal gesproken geen probleem. Volgens de informatie die aan de commissie voor de Financiën werd verstrekt door staatssecretaris Jamar, zouden de meerinkomsten voor de federale overheid voor 2005 ingevolge de gestegen energieprijzen en ingevolge de belastingverhogingen 550 miljoen euro hebben bedragen. Minister Reynders heeft daar een andere opvatting over, want hij spreekt over 250 miljoen euro. Wij wachten nog altijd op de nota van de inspectie Financiën om de juiste toedracht te kennen.
Hoe dan ook, zowel in de berekening van de heer Jamar als in de berekening van de heer Reynders, met een minimumbedrag van 250 miljoen euro, was het duidelijk dat het bedrag voldoende was om de tegemoetkoming ten aanzien van de burger te financieren.
Nochtans heeft de regering een lening aangegaan, dan nog wel een lening bij de private sector. Die lening is er gekomen ingevolge de begrotingsproblematiek die hier algemeen gekend is. Voor de afsluiting van de begroting 2005 heeft de regering een aantal noodmaatregelen toegepast.
Ik noem bijvoorbeeld de effectisering voor een bedrag van 500 miljoen euro, de overname van de pensioenfondsen van de haven van Antwerpen voor 236 miljoen euro en de verkoop van openbare gebouwen waarvan het totale bedrag nog niet gekend is. Vorige week hebben we nog wel gesproken, mijnheer de minister, over het dossier Les Dolimarts waar een gebouw werd verkocht aan 550.000 euro, terwijl de totale kosten voor de Belgische Staat 6,5 miljoen euro beliepen. Dat betekent dat men een gebouw heeft verkocht aan 10% van de totale kosten waaraan men blootgesteld is geweest. Er is de overname van het NMBS-pensioenfonds voor 295 miljoen euro, er is de storting van De Post van 20 miljoen euro: zo kunnen we voortgaan met een aantal operaties die er zijn geweest einde 2005.
Toch heeft men moeten vaststellen dat ondanks al deze maatregelen, men toch te maken had met een deficitaire begroting voor 2005. Men heeft dan andere maatregelen moeten toepassen als het doorschuiven van facturen, men heeft de manuele inkohiering van de vennootschapsbelasting die was voorzien voor 2006 in 2005 moeten doen voor nog eens 160 miljoen euro, maar ondanks al deze kunstgrepen bleek het resultaat nog altijd niet voldoende. Men werd dan verplicht een lening aan te gaan voor de financiering van deze tegemoetkoming en dit bij de private sector. Deze lening werd ook aangegaan, voorzitter, zonder machtiging van dit Parlement. De problematiek van deze lening werd voldoende aan bod gebracht door collega's Bogaert en De Crem in de commissie voor de Financiën. Ik denk niet dat het nodig is hier nog op terug te komen, maar het is evident dat deze lening bij de privé-sector een vorm is van onbehoorlijk bestuur. Onder deze omstandigheden kunnen wij natuurlijk dit wetsontwerp, dat oorspronkelijk een goede intentie had, niet goedkeuren. Wij zullen ons dan ook onthouden.
Tot slot, mijnheer de minister, zou ik toch nog graag eens de vraag stellen naar de nota van de Inspectie van Financiën die u hebt toegezegd. De heer Gustin zal het ook gemerkt hebben bij de voorbereiding van deze vergadering: in het verslag zegt u tweemaal uitdrukkelijk aan de leden van de commissie voor de Financiën dat u een nota van de Inspectie van Financiën zult bezorgen aan de leden van dit Parlement, zodat zij eindelijk inzicht kunnen krijgen in de bijkomende ontvangsten die de Belgische Staat heeft geboekt in 2004 en 2005 ingevolge de stijging van de olieprijzen, onder meer van de BTW. Dit geldt ook voor de verschillende belastingverhogingen die er zijn geweest in de jaren 2003, 2004 en 2005. Immers, collega's, ondanks de stijgende energieprijzen heeft deze regering het nodig geacht om de belastingen op een aantal energieproducten nog te verhogen in 2004 en 2005. Wij zouden graag de details kennen van deze cijfers. De minister heeft die al herhaaldelijk beloofd, maar wij wachten nog altijd op het rapport van de Inspectie van Financiën. Misschien kan de minister er dadelijk iets over vertellen.

Mr. Speaker, Mr. Minister, colleagues, this bill regulates the granting of a subsidy for the purchase of home fuel oil for the heating of a private home.
In itself, this is a good measure in a period of rising energy prices.
However, we have two points of criticism to this bill. First, we criticize the concrete approach and development of this dossier. The second point of criticism relates to financing.
The draft will be submitted to the plenary session today, February 9. It was submitted to the Finance Committee on 25 January. However, the draft law covers a specified period, which ends on 31 December 2005. It implements a decision taken by the government in September 2005.

Monsieur le président, monsieur le ministre, chers collègues, je m'attacherai simplement à un point de ce dossier. Cette méthode n'était, selon moi, pas la meilleure, même si j'ai donné un argument à M. le ministre, en lui révélant que j'avais tiré avantage de la situation, puisque, à titre personnel, j'ai bénéficié d'une remise. Cependant, j'aurais préféré que les mesures financières prises dans ce cadre aient un impact plus social et qu'elles soient réparties de façon plus équitable.
Je voudrais insister sur un point très épineux, à savoir l'exclusion évidemment volontaire des collectivités dans ce projet de loi. La motivation est assez simple: la mesure vise les particuliers, à l'exception des personnes qui résident dans des structures collectives, tels les centres d'accueil d'enfants, les écoles, les maisons de repos et pour lesquels il faut entamer des discussions avec les Communautés, voire les Régions. Mais il n'y a aucune intervention directe et on invoque pour cela un problème de compétence: le fédéral n'est pas concerné.
Pour en revenir à la réalité, l'augmentation du mazout a des conséquences sur la vie de chaque personne, où qu'elle se trouve: dans une habitation privée ou en structure collective d'accueil comme l'école ou l'hôpital. Par conséquent, il n'y a pas lieu d'opérer des divisions au niveau de nos citoyens. Ils sont tous concernés, quelle que soit leur qualité.
Quelles sont les raisons qui amènent l'État à consentir un effort en faveur des particuliers? D'une part, les aider par rapport à la hausse des produits pétroliers et, d'autre part, appliquer une espèce de loi de retour: la TVA sur les produits pétroliers a augmenté en raison de l'augmentation de leur prix. Par conséquent, l'État ayant gagné davantage sur ce plan redistribue aux personnes qui, achetant et utilisant ces produits, dépensent plus en TVA. C'est dire si les structures collectives sont concernées!
Hier, le ministre des Affaires sociales a été interpellé par mon collègue Drèze, parce que les prix des séjours dans les maisons de repos ont augmenté pour intégrer le surcoût des produits pétroliers. Le Conseil d'État avait bien souligné ce problème de non-respect de l'égalité des Belges devant la loi: selon que l'on séjourne dans des structures collectives ou dans une habitation privée, le traitement est différent. Le Conseil d'État, après avoir relevé les propos du délégué du gouvernement, avait mis en évidence que l'éventualité de voir un caractère invariable du forfait de séjour à payer n'était pas généralisable.
On ne peut exclure que l'exploitant de la structure collective d'hébergement augmente les frais de séjour réclamés en fonction de la variation des prix du pétrole.
Il importe que le mécanisme projeté soit revu, disait le Conseil d'État, pour couvrir cette deuxième hypothèse, sans quoi la loi violerait les articles 10 et 11 de la Constitution. En effet, les personnes contraintes d'opter pour ce type d'hébergement en raison de leur état (maladie chronique, personnes âgées ou handicapées) constituent les catégories de citoyens à l'égard desquelles un traitement différencié ne saurait se concevoir, d'autant qu'on ne peut présumer qu'elles seraient mieux en mesure de faire face à cette charge financière accrue.
La réponse apportée par le gouvernement ne me paraît pas suffisante lorsque, par une pirouette, on se contente de dire qu'en raison de la formulation de la notion d'ayant droit, qui diffère de celle soumise à l'avis du Conseil d'État, et par l'effet du mécanisme de calcul de l'intervention, l'avis du Conseil d'État quant à l'inclusion des résidents des structures collectives n'est pas suivi. Ce problème existe et, en ce qui concerne les écoles, on nous dit qu'il relève de la compétence des Communautés, qu'il n'y a pas d'incidence directe et que, de toute façon, la Communauté bénéficie de l'augmentation des recettes de la TVA. Cette réponse ne me paraît pas non plus justifiable dans la mesure où chacun sait que, lorsqu'on parle de dotation TVA pour le financement des Communautés, cela n'a rien à voir avec la TVA; cela fait partie de notre situation un peu surréaliste: la dotation TVA est liée à d'autres critères que les recettes TVA. La seule chose qui a une incidence est l'effet indirect lié à l'inflation mais cela n'entre pas vraiment dans cette logique.
Bien que l'on soit en accord avec la logique de ce projet de loi, à savoir qu'il faut aider nos concitoyens car ils font face à des dépenses supplémentaires liées à l'évolution du coût du pétrole et que, par ailleurs, il s'agit d'une redistribution des recettes supplémentaires que l'État tire de la TVA, l'exclusion des structures collectives n'est cependant pas raisonnable ni justifiée et plonge un certain nombre de personnes dans une situation plus difficile. En effet, demain, une augmentation des frais pourrait être réclamée aux malades et aux élèves, comme cela se passe déjà dans les maisons de repos. Il faut donc aller plus loin dans cette logique en étendant automatiquement la mesure aux personnes qui sont à l'école, dans les maisons de repos et dans des hôpitaux. C'est la raison pour laquelle notre groupe s'abstiendra sur ce projet de loi.

What are the reasons that lead the state to consent to an effort in favour of individuals? On the one hand, help them in relation to the rise of petroleum products and, on the other hand, apply a kind of return law: VAT on petroleum products has increased due to the increase in their price. Therefore, the state that earned more on this plan redistributes to people who, buying and using these products, spend more in VAT. That is, if the collective structures are involved!
Yesterday, the Minister of Social Affairs was arrested by my colleague Drèze, because the prices of stays in holiday homes have increased to include the surplus cost of oil products. The Council of State had well highlighted this problem of non-respect for the equality of Belgians before the law: depending on whether one stays in collective structures or in a private home, the treatment is different. The State Council, having taken up the statements of the government delegate, had pointed out that the possibility of seeing an invariable character of the residence package to be paid was not generalizable.
It cannot be excluded that the operator of the collective accommodation structure increases the claimed accommodation costs in accordance with the fluctuation of oil prices.
It is important that the projected mechanism be revised, the State Council said, to cover this second hypothesis, otherwise the law would violate articles 10 and 11 of the Constitution. Indeed, those persons who are forced to opt for this type of accommodation because of their condition (chronic illness, elderly or disabled persons) constitute the categories of citizens for whom a differentiated treatment cannot be conceived, in particular since it cannot be presumed that they would be better able to cope with this increased financial burden.
The answer given by the government does not seem sufficient to me when one merely says that because of the formulation of the notion of entitled, which differs from that submitted to the State Council’s opinion, and by the effect of the mechanism of calculation of the intervention, the State Council’s opinion on the inclusion of residents of collective structures is not followed. This problem exists and, as far as schools are concerned, we are told that it falls within the competence of the Communities, that there is no direct impact and that, in any case, the Community benefits from the increase in VAT revenues. This answer also does not seem justifiable to me, since everyone knows that when it comes to VAT allocation for the financing of the Communities, it has nothing to do with VAT; it is part of our somewhat surreal situation: VAT allocation is linked to other criteria than VAT revenues. The only thing that has an impact is the indirect effect associated with inflation, but it does not really fit into this logic.
Although we agree with the logic of this bill, namely that we must help our fellow citizens because they face additional expenses related to the evolution of the cost of oil and that, in addition, it is a redistribution of the additional revenues that the State draws from VAT, the exclusion of collective structures is nevertheless not reasonable or justified and plunges a number of people into a more difficult situation. Indeed, tomorrow, an increase in fees could be demanded from the sick and students, as is already happening in the rest homes. It is therefore necessary to go further in this logic by automatically extending the measurement to those who are at school, in rest homes and in hospitals. That is why our group will abstain from this bill.

Monsieur le président, monsieur le vice-premier ministre, étant donné la brève intervention de mes collègues de l'opposition, je serai également très brève.
D'abord, je voudrais dire toute ma satisfaction de voir ce projet aboutir devant cette assemblée, à la suite de ce que je qualifierai d'un assez large consensus au sein de la commission des Finances.
Ce, malgré quelques péripéties portant tantôt sur des intérêts d'avance d'une convention de préfinancement — largement critiquée mais qui a finalement abouti avec une seule abstention sur le projet lui-même —, tantôt sur d'autres questionnements, fort intéressants au demeurant, qui ont été reproduits aujourd'hui devant vous par nos collègues de l'opposition: ils concernent l'équilibre budgétaire ou l'intervention d'autres niveaux de pouvoir dans la question qui nous occupe. À certains moments, on est même allé jusqu'à se poser des questions sur la reconduction du mandat des membres du Conseil supérieur des Finances.
Je voudrais à présent recadrer brièvement ce projet en vous rappelant que c'est dès le début du mois de septembre que le gouvernement, souhaitant à l'époque réagir à l'évolution inquiétante des prix de l'énergie, décida de l'instauration d'une série de mesures. En matière de chauffage, l'intervention envisagée a porté tant sur le fuel domestique, le gaz que l'électricité, et ce, au profit des particuliers.
Comme le rappelait d'ailleurs le ministre des Finances, c'est à l'allègement de la facture de 4 millions de ménages que le gouvernement a entendu s'atteler par le biais de diverses mesures. La Belgique devient ainsi, tout en respectant son équilibre budgétaire, j'y insiste, le seul pays européen à avoir pris l'initiative de mesures sociales mettant en oeuvre, au profit des particuliers concernés, des aides appropriées visant à l'allègement de la facture de chauffage.
Ce projet traduit donc un des volets de la décision gouvernementale du 9 septembre 2005. Il organise aussi au profit du citoyen une intervention de l'État fédéral dans la facture des particuliers pour l'acquisition du gasoil destiné au chauffage d'une habitation privée. Le montant de cette allocation s'élève à 17,35% du prix de la fourniture du gasoil de chauffage. Il est toutefois limité à la partie du prix qui excède 0,5 euro le litre et pour les fournitures livrées durant la période allant du 1 er juin au 31 décembre 2005. Je ne m'étendrai pas sur les détails qui concernent les fournitures effectuées à partir du 1 er octobre 2005 et à partir du 1 er juin 2005 jusqu'au 30 septembre 2005, et qui suivent un régime différencié.
J'interviendrai enfin en insistant beaucoup sur la qualité des bénéficiaires. Mes chers collègues, monsieur le vice-premier ministre, qui sont les bénéficiaires de cette mesure?
Dans la définition des bénéficiaires de la loi, l'accent a été mis sur le fait que les personnes qui occupent une habitation privée en vertu d'un droit réel immobilier ou d'un droit personnel, qui est le contrat de louage d'immeuble, et en sont les ayants droit sont les bénéficiaires de cette mesure.
Bien entendu, c'est cette catégorie de personnes qui se trouve directement confrontée à la hausse des prix du gasoil de chauffage. Rien qu'en ce qui concerne le gasoil, c'est donc 1.250.000 ménages qui bénéficient de cette aide temporaire, bien sûr, mais ô combien précieuse pour les plus démunis auxquels elle s'adresse.
Je terminerai cette brève intervention en disant que nous suivrons les autres mesures annoncées en faveur des ménages et que nous saluons le geste conséquent de l'État fédéral qui est de 10 millions d'euros, le gouvernement s'étant engagé, envers les collectivités dont les écoles dépendent au premier chef, à régler le problème de la hausse du coût de l'énergie pour ces collectivités.
Voilà en bref ce que je voulais dire par rapport à ce projet. J'ai sabré quelques éléments certes importants mais de détail car j'estime que c'est sur le plan des principes qu'il faut insister.

Mr. Speaker, Mr. Deputy Prime Minister, given the brief intervention of my opposition colleagues, I will also be very brief.
First, I would like to express my satisfaction to see this project result in this assembly, following what I will call a fairly broad consensus within the Finance Committee.
This, despite a few peripeties sometimes on advance interests from a pre-financing agreement — widely criticized but ultimately resulting in a single abstinence on the project itself —, sometimes on other questions, very interesting by the way, which have been repeated today before you by our opposition colleagues: they concern the budget balance or the intervention of other levels of power in the issue that concerns us. At some times, we even went so far as to ask questions about the renewal of the mandate of the members of the Supreme Council of Finance.
I would now like to briefly outline this project by reminding you that it was from the beginning of September that the government, wishing at the time to react to the worrying evolution of energy prices, decided to introduce a series of measures. In terms of heating, the intervention envisaged focused on both domestic fuel, gas and electricity, and this, for the benefit of individuals.
As the Minister of Finance recalled, it is to ease the bill of 4 million households that the government has heard through various measures. Belgium thus becomes, while respecting its budget balance, I insist, the only European country to have taken the initiative of social measures implementing, for the benefit of the individuals concerned, appropriate aid aimed at easing the heating bill.
This project thus translates one of the parts of the government decision of 9 September 2005. It also organises for the benefit of the citizen an intervention of the federal state in the invoice of individuals for the purchase of gasoline for the heating of a private home. The amount of this allowance is 17.35% of the price of the supply of heating gasoline. It is, however, limited to the part of the price that exceeds EUR 0.5 per litre and for supplies delivered during the period from 1 June to 31 December 2005. I will not extend to the details concerning supplies made from 1 October 2005 and from 1 June 2005 to 30 September 2005 and which are subject to a differentiated regime.
Finally, I will speak with a lot of emphasis on the quality of the recipients. Dear colleagues, who are the beneficiaries of this measure?
In the definition of beneficiaries of the law, the emphasis has been placed on the fact that persons who occupy a private home under a real property right or a personal right, which is the property lease contract, and are the right recipients are the beneficiaries of this measure.
Of course, it is this category of people who are directly confronted with the rising prices of heating gasoline. In terms of gasoline alone, therefore, it is 1.250,000 households that benefit from this temporary aid, of course, but oh how precious for the poorest to whom it addresses.
I will conclude this brief speech by saying that we will follow the other measures announced in favour of households and that we welcome the consequent gesture of the federal state which is 10 million euros, the government having committed, towards the communities whose schools depend primarily, to settle the problem of the rising cost of energy for these communities.

Demotte nous a dit qu'il n'est concerné que pour les soins. Je lui ai répondu hier que les soins ne se faisaient pas dans le jardin, sous la neige, mais qu'ils se faisaient dans la maison de repos. S'il intervient pour les hôpitaux en ce qui concerne les soins, il doit intervenir pour les maisons de repos pour la partie soins.
Pour la partie habitation, je ne peux m'expliquer que, pour une personne âgée par exemple de 70 ans, selon qu'elle habite chez elle, elle obtient une intervention du fédéral et selon qu'elle habite collectivement avec d'autres personnes dans une maison de repos, il n'y a plus d'intervention du fédéral.

Er was eenparigheid in de commissie betreffende de artikelen 1, 2, 3 en 4. Betreffende artikel 5 was er een opmerking van de CD&V'er Carl Devlies waarbij hij verwees naar diverse opmerkingen van de Raad van State. De Raad van State had opgemerkt dat de circulaire rechtsgrond miste en dat die strijdig is met de beginselen van de hiërarchie van de rechtsnormen. De minister heeft hierop als antwoord gegeven dat de terugwerkende kracht bedoeld is om alle eventuele gevallen van betwisting die zich sinds die datum zouden kunnen hebben voorgedaan, te dekken. Het ging voornamelijk over de datum van inwerkingtreding van het wetsontwerp. Het artikel werd uiteindelijk aangenomen met 9 stemmen voor en 4 onthoudingen, zoals ook het geheel van het wetsontwerp.

Dans le cadre de l'exposé introductif par l'auteur principal, Mme Turtelboom a expliqué que la loi du 29 juin 1981 établissant les principes généraux de la sécurité sociale des travailleurs salariés prévoit que les véhicules affectés au transport collectif de travailleurs ne donnent pas lieu au paiement de cotisations de solidarité. Cette exonération se limite cependant aux véhicules de la catégorie N1 au sens de l'arrêté royal du 15 mars 1968 portant règlement général sur les conditions techniques auxquelles doivent répondre les véhicules automobiles, leurs remorques, leurs éléments, ainsi que les accessoires de sécurité.
Certaines entreprises utilisent cependant à la même fin des véhicules appartenant à la catégorie M1 au sens du même arrêté royal. Les auteurs de la proposition estiment qu'il convient de traiter de la même manière tous les véhicules affectés au transport collectif de travailleurs. La proposition de loi à l'examen étend donc l'exonération à tous les véhicules affectés à ce transport, tout en fixant d'une manière plus claire les conditions qui donnent droit à cette exonération. Les véhicules de type M1 sont en effet susceptibles, plus que ceux de la catégorie N1, de faire l'objet d'un usage privé. Il convient donc de veiller à éviter les abus.
Dans le cadre de la discussion générale, Mme Greta D'hondt, coauteur, a rappelé que son groupe s'est toujours opposé au prélèvement d'une cotisation de solidarité liée à la mise à disposition de voitures de société. Néanmoins, la législation actuelle est tellement inadaptée à la réalité du terrain qu'il est urgent de la corriger. C'est pourquoi l'intervenante soutient également la proposition de loi. Par ailleurs, l'oratrice salue le ministre des Affaires sociales et de la Santé publique dont la souplesse a permis de dégager le compromis nécessaire à la proposition de loi à l'examen.
M. Bultinck se joint aux commentaires de Mme D'hondt. Le groupe de l'orateur n'est pas favorable à la perception d'une cotisation sociale liée aux voitures de société. Néanmoins, il ne convient pas de s'opposer à une proposition de loi qui permet d'améliorer la législation existante, même si celle-ci reste contestable, selon lui, sur le plan des principes.
Le ministre des Affaires sociales et de la Santé publique, M. Demotte, a souscrit au contenu de la proposition de loi à l'examen. Celle-ci traduit, selon lui, correctement le souhait des partenaires sociaux des secteurs concernés. En réponse à la demande formulée par les auteurs dans les développements de leur proposition de loi, le ministre a adressé deux notes de service.
Dans la première note, il exprime le souhait que, lors des contrôles relatifs à la cotisation de solidarité en cause, les services d'inspection confrontés à la problématique d'utilisation de véhicules de transport collectif de travailleurs dont le trajet commence et se termine au domicile du travailleur chargé de la conduite, suspendent provisoirement leurs constatations dans l'attente de la promulgation de la loi issue de la proposition à l'examen.
Dans la seconde note, le ministre demande que, si à l'occasion d'un contrôle effectué après la promulgation de la loi, les services constatent que le véhicule affecté au transport collectif de travailleurs répond bien aux conditions déterminées par la loi pour ne pas être soumis à la cotisation de solidarité prévue par l'article 38, le véhicule soit considéré comme non soumis à la cotisation de solidarité pour la période qui est antérieure à la promulgation de la loi.
Le ministre prendra en outre contact avec les partenaires sociaux afin de déterminer la procédure d'identification de tous les véhicules appartenant à la catégorie M1 et affectés au transport collectif des travailleurs. A la suite de cela ont eu lieu la discussion des articles et les votes. La commission s'est accordée à l'unanimité pour soutenir ladite proposition de loi.

Vehicles of type M1 are in fact more likely, than those of category N1, to be the object of private use. Therefore, it should be taken care to avoid abuses.
As part of the general discussion, Greta D'hondt, co-author, recalled that her group has always opposed the collection of a solidarity contribution related to the provision of public cars. Nevertheless, the current legislation is so inadequate to the reality of the ground that it is urgently necessary to correct it. Therefore, the speaker also supports the bill. Furthermore, the speaker congratulates the Minister of Social Affairs and Public Health whose flexibility has enabled to unlock the necessary compromise for the legislative proposal under consideration.

Nevertheless, it is not appropriate to oppose a proposal of law that allows to improve existing legislation, even if it remains challenging, according to him, from the point of view of principles.
Minister of Social Affairs and Public Health, Mr. Demotte, has subscribed to the contents of the bill to be examined. It correctly reflects the wishes of the social partners of the sectors concerned. In response to the request made by the authors in the developments of their bill, the Minister sent two service notes.
In the first note, it expresses its wish that, during the checks relating to the solidarity fee in question, the inspection services facing the problem of the use of collective transport vehicles of workers whose journey begins and ends at the home of the driver, temporarily suspend their findings pending the promulgation of the law arising from the proposal under consideration.
In the second note, the Minister asks that, if on the occasion of a check carried out after the promulgation of the law, the services find that the vehicle used for the collective transport of workers satisfies well the conditions determined by the law to not be subject to the solidarity contribution provided for in article 38, the vehicle shall be considered not subject to the solidarity contribution for the period that precedes the promulgation of the law. by
The Minister will also contact the social partners to determine the procedure for identifying all vehicles belonging to category M1 and dedicated to the collective transport of workers. The discussion of articles and voting followed. The committee agreed unanimously to support the aforementioned bill.
