                    Mijnheer de voorzitter, ik was niet van plan een uiteenzetting te houden omdat ik meende dat onze rapporteur verslag zou hebben uitgebracht van een van de meest interessante besprekingen die ik heb meegemaakt in de jaren dat ik in dit Parlement zetel. Er zou eindelijk, na meer dan 160 jaar, een officiële Nederlandse vertaling komen van een wet uit 1844. We moesten echter vaststellen dat de Nederlandse vertaling fouten tegen het Nederlands bevatte. Ik moet eerlijk zeggen dat wij ons heel erg hebben geamuseerd in de commissie. Ik kwam op een bepaald ogenblik zelfs tot de conclusie dat de vertaling van dit wetsvoorstel waarschijnlijk per dictafoon was doorgegeven door een WestVlaming. Uit de gebruikte woorden kon men afleiden dat ze op dictaat werden getypt. We hebben ons goddelijk geamuseerd.

Het is echter triestig dat men na meer dan 160 jaar de hoogdringendheid vraagt en al in de titel taalfouten maakt. Collega's, om het met de woorden van Gezelle te zeggen "De Vlaamse taal is wonderzoet voor wie haar geen geweld aandoet." Het is toch met enige bitterheid dat wij vaststellen dat men na meer dan 160 jaar nog niet in staat is een klein wetje te vertalen in foutloos Nederlands.

Mr. Speaker, I did not intend to hold a presentation because I thought that our rapporteur would have issued a report on one of the most interesting discussions I have experienced in the years I have been in this Parliament. There would finally, after more than 160 years, come an official Dutch translation of a law from 1844. However, we had to find that the Dutch translation contained errors against Dutch. I must be honest that we have had a lot of fun in the committee. At one point I even came to the conclusion that the translation of this bill was probably transmitted by dictaphone by a WestFlaming. From the words used, one could deduce that they were typed on dictates. We have divine fun.

However, it is sad that, after more than 160 years, one asks for the high urgency and already makes language errors in the title. Colleagues, to say it with the words of Gezelle "The Flemish language is miraculous sweetness for those who do not inflict violence on it." It is, however, with some bitterness that we establish that after more than 160 years, one is still unable to translate a small word into errorless Dutch.

                    Mevrouw D'hondt, uw citaat herinnert mij aan een historische aangelegenheid. Op een bepaald ogenblik wou een bepaalde strekking in ons land een eigen taal ontwikkelen. Die strekking was van West-Vlaamse oorsprong en de dichter-priester die u citeerde, lag aan de basis ervan. De reden daarvoor was het feit dat Vlamingen en meer bepaald West-Vlamingen enige moeite hadden de bijbel in de Noord-Nederlandse taal te lezen. Misschien bevatte het DNA van degene die de vertaling dicteerde daar nog sporen van.

                    Monsieur le président, monsieur le ministre, chers collègues, notre commission a examiné le présent projet de loi le 12 janvier 2005.

M. le vice-premier ministre et ministre de l'Intérieur a exposé le présent projet de loi qui vise à réformer la procédure devant la commission permanente de recours des réfugiés. En tant que juridiction administrative, elle traite des recours introduits contre les décisions par lesquelles le commissaire général aux réfugiés et apatrides rejette une demande d'asile comme non fondée.

Cette réforme est menée dans le souci de permettre à cette commission de rendre des décisions dûment motivées dans un délai raisonnable. Elle entend réduire, pour le demandeur d'asile, les retards et les incertitudes liés à une procédure lourde et complexe.

Elle s'articule autour de la règle du traitement des requêtes par un magistrat siégeant seul. Toutefois, elle préserve la possibilité pour celui-ci de renvoyer l'affaire devant un collège de trois magistrats s'il apparaît - à l'examen de la requête ou lors du traitement du recours - que cette affaire pose des questions de principe, telle une dérogation à une jurisprudence constante ou l'émergence d'un débat juridique fondamental.

Dans le souci de préservation de la qualité des décisions, de nouvelles conditions de recrutement plus sévères seront applicables à ces magistrats. Ces derniers devront avoir un âge de 35 ans accomplis, être licenciés ou docteurs en droit et justifier d'une expérience utile de cinq ans en droit des étrangers. Une exception à ces conditions est toutefois prévue afin de permettre à la seule magistrate du corps actuel, non titulaire d'une licence en droit, de continuer de siéger. L'expérience spécifique qu'elle a acquise dans cette fonction, qu'elle exerce depuis de nombreuses années, et celle qu'elle a acquise précédemment auprès du Haut-Commissariat aux réfugiés justifient amplement une telle exception.

Dans la discussion générale, M. Arens fait remarquer que l'ensemble des dossiers en souffrance sont pendants devant les chambres francophones de cette juridiction. Il s'informe des intentions du gouvernement en vue de compléter les places vacantes au sein de ces chambres francophones. Par ailleurs, il estime que, même avec des cadres complets et le recours à des magistrats uniques, la commission permanente de recours des réfugiés ne sera pas en mesure de résorber l'arriéré. Il plaide aussi en faveur de l'extension des cadres et des moyens de cette commission.

En outre, il fait remarquer que le recours à des magistrats uniques mettra en péril l'unité de la jurisprudence et propose la création d'une assemblée générale et d'une conférence des présidents de chambres afin d'assurer cette unité.

M. Anthuenis rappelle les efforts gouvernementaux en vue de maîtriser le problème de l'asile et accorde le soutien de son groupe au présent projet.

M. Van den Bergh met en exergue la nécessaire adaptation de la loi de 1980 sur l'accès au territoire, le séjour, l'établissement et l'éloignement des étrangers. Il souligne que le présent projet ne résoudra pas les problèmes d'arriérés à la commission permanente de recours des réfugiés, ni au Commissariat général aux réfugiés et apatrides, ni au Conseil d'Etat, et il évoque le risque qui en découle d'une nouvelle procédure de régularisation.

Il propose de regrouper la présente réforme avec celle du Conseil d'Etat. Il insiste, par ailleurs, sur l'avis du Conseil d'Etat qui demande au législateur de justifier le principe du magistrat unique à la lumière d'un éventuel contrôle par la Cour d'arbitrage. Il précise que les arrêts précédents de la Cour d'arbitrage portent seulement sur la procédure actuellement appliquée, et non sur le principe du magistrat siégeant seul en tant que règle générale.

Il considère qu'un premier examen par une chambre à trois magistrats qui renverrait éventuellement à un membre siégeant seul répondrait mieux aux observations du Conseil d'Etat. A côté d'un élargissement des compétences du magistrat unique, il suggère d'affecter plus de moyens à cette commission permanente de recours, par exemple en créant des chambres temporaires.

Il se pose ensuite les questions de savoir si la procédure proposée prévoit encore la possibilité d'entendre les intéressés et si les dossiers déjà introduits seront terminés suivant la nouvelle procédure. Enfin, M. De Man évoque l'exigence d'une ancienneté de dix ans au barreau pour plaider devant le Conseil d'Etat, qui avait été mentionnée lors des discussions sur la réforme de celui-ci.

Le ministre répond que les mesures prises par le gouvernement précédent ont permis de limiter l'afflux des demandeurs d'asile. Il estime par ailleurs que la situation actuelle rend une réforme radicale de la loi de 1980 particulièrement difficile et qu'une telle réforme n'offrirait pas nécessairement plus de garanties que le système actuel.

En ce qui concerne les retards dans les procédures, il apporte les précisions suivantes.

En ce qui concerne l'Office des étrangers, seules les régularisations individuelles posent encore problème. Le nouveau commissaire général aux réfugiés et aux apatrides devrait déterminer les moyens et la politique qu'il entend affecter à cet effet. Le projet de réforme du Conseil d'Etat prévoit la création de chambres temporaires chargées de résorber en trois ans le retard accumulé. De plus, puisque cette réforme est toujours en phase de concertation, il n'est pas indiqué d'attendre qu'elle intervienne pour y joindre le présent projet.

Le présent projet de loi contribuera à résorber les retards au niveau de la commission permanente de recours des réfugiés. Les cadres, tant d'expression française que néerlandaise, seront complétés et des juristes spécialisés y seront adjoints en appoint.

En inversant la méthode de travail actuellement appliquée plutôt que d'étendre le cadre de la commission permanente de recours des réfugiés, comme l'imposerait le maintien de la procédure actuelle, il répond donc aux intentions du gouvernement de désengorger les organes existants et non d'en créer de nouveaux.

Pour ce qui concerne le principe du juge unique à la commission permanente de recours des réfugiés, il précise que la Cour d'arbitrage en a déjà accepté le principe dans ses arrêts 80 et 100/2002. Bien que les arrêts en question portent sur une procédure qui n'est pas parfaitement identique à celle proposée dans le présent projet de loi, le même raisonnement a présidé à son élaboration.

Pour ce qui concerne la création d'une assemblée générale et d'une conférence des présidents de chambres, le ministre déclare que cela sera réglé par arrêté royal.

Concernant le projet d'imposer une condition d'ancienneté aux avocats qui plaident devant le Conseil d'Etat, le ministre précise que celui-ci a été abandonné.

La discussion des articles 2, 3 et 4 n'a fait l'objet d'aucune observation. Celle des articles 2bis et 2ter introduits par les amendements n°2 et n°3 de M. Joseph Arens, le premier visant à instaurer une assemblée générale au sein de la commission permanente de recours des réfugiés et le second à instituer une conférence des présidents de chambres au sein de cette même commission, s'est soldée par un retrait des amendements sur engagement du ministre à traiter ces questions par voie d'arrêtés royaux.

L'ensemble du projet a été adopté à l'unanimité après les corrections techniques.

by Mr. The Deputy Prime Minister and Minister of the Interior presented this bill which aims to reform the procedure before the Permanent Refugee Appeal Commission. As an administrative court, it deals with appeals brought against decisions by which the Commissioner-General for Refugees and Statelessness rejects an asylum application as unfounded.

This reform is carried out in order to enable this committee to make duly motivated decisions within a reasonable time. It aims to reduce, for the asylum seeker, the delays and uncertainties related to a heavy and complex procedure.

It is articulated around the rule of the processing of requests by a judge sitting alone. However, it preserves the possibility for the latter to refer the case to a panel of three magistrates if it appears — during the examination of the application or during the examination of the appeal — that that case raises questions of principle, such as a derogation from a constant case-law or the emergence of a fundamental legal debate.

In order to preserve the quality of decisions, new stricter recruitment conditions will apply to these magistrates. The latter must have reached the age of 35 years, be licensed or doctors in law and prove a useful experience of five years in foreign law. However, an exception to these conditions is provided in order to allow the sole magistrate of the current body, not holding a license in law, to continue to sit. The specific experience she has acquired in this position, which she has held for many years, and that she has previously acquired with the High Commissioner for Refugees, fully justify such an exception.

In the general discussion, Mr. Arens points out that all the cases in suffering are pending before the French-speaking chambers of this jurisdiction. He is informed of the intentions of the government in order to fill the vacancies within these French-speaking chambers. Furthermore, he believes that even with comprehensive cadres and the use of single magistrates, the permanent refugee appeal commission will not be able to resolve the backdrop. It also calls for the extension of the frameworks and resources of this commission.

Furthermore, it notes that the use of single magistrates will jeopardise the unity of jurisprudence and proposes the creation of a general assembly and a conference of chamber presidents in order to ensure that unity.

by Mr. Anthuenis recalls the government’s efforts to control the asylum problem and grants his group’s support for this project.

by Mr. Van den Bergh highlights the necessary adaptation of the 1980 law on the access to the territory, residence, establishment and removal of foreigners. It emphasizes that the present draft will not solve the problems of backwardness to the Permanent Refugee Appeal Commission, the General Commissioner for Refugees and Stateless Persons, or the State Council, and it evokes the risk arising from a new procedure of regularization.

He proposes to combine this reform with that of the State Council. He also insists on the opinion of the State Council that asks the legislator to justify the principle of the single magistrate in the light of a possible control by the Arbitration Court. It specifies that the previous decisions of the Arbitration Court refer only to the procedure currently applied, and not to the principle of the magistrates sitting alone as a general rule.

He considers that a first examination by a three-member Chamber, which would eventually refer to a single-seated member, would better respond to the observations of the State Council. In addition to expanding the powers of the single magistrate, it suggests that more resources be allocated to this permanent appeal committee, for example by creating temporary chambers.

The question then arises whether the proposed procedure still provides for the possibility of hearing the interested parties and whether the files already filed will be completed following the new procedure. Finally Mr. De Man evokes the requirement of a ten-year term in the bar to advocate before the State Council, which had been mentioned during discussions on the reform of it.

The Minister replies that the measures taken by the previous government have allowed to limit the influx of asylum seekers. He also believes that the current situation makes a radical reform of the 1980 law ⁇  difficult and that such a reform would not necessarily offer more guarantees than the current system.

As regards delays in procedures, it makes the following clarifications.

As far as the Foreign Office is concerned, only individual regularizations are still a problem. The new Commissioner-General for Refugees and Stateless Persons should determine the means and policy he intends to allocate for this purpose. The draft reform of the State Council provides for the creation of temporary chambers responsible for removing the accumulated delay in three years. Furthermore, since this reform is still in the negotiation phase, it is not appropriate to wait for it to intervene to join the present project.

This bill will contribute to addressing the delays at the level of the Standing Refugee Appeal Commission. The cadres, both French and Dutch, will be completed and specialized lawyers will be assisted in appointment.

By reversing the current working method rather than extending the framework of the Permanent Refugee Appeal Commission, as would be required by ⁇ ining the current procedure, it thus responds to the government’s intention to decompose existing bodies and not to create new ones.

As regards the principle of a single judge in the Permanent Refugee Appeal Commission, it specifies that the Arbitration Court has already accepted the principle in its judgments 80 and 100/2002. Although the judgments in question concern a procedure that is not completely identical to the one proposed in this bill, the same reasoning presided over its elaboration.

With regard to the establishment of a general assembly and a conference of chamber presidents, the Minister declares that this will be settled by royal decree.

Regarding the project to impose a condition of old age on lawyers who plead before the Council of State, the minister specifies that it has been abandoned.

The discussion of Articles 2, 3 and 4 was not the subject of any observation. Articles 2bis and 2ter introduced by amendments no. 2 and no. 3 of M. Joseph Arens, the first to establish a general assembly within the Permanent Refugee Appeal Commission and the second to establish a conference of chamber presidents within the same commission, concluded with a withdrawal of the amendments on the Minister’s commitment to address these issues through royal decrees.

The whole project was adopted unanimously after the technical corrections.
