Mijnheer de voorzitter, mevrouw de minister, mijnheer de minister, collega's, ik zal verslag uitbrengen namens de commissie voor Volksgezondheid, Leefmilieu en Maatschappelijke Vernieuwing, ook in naam van mijn collega Miguel Chevalier, in verband met het wetsontwerp over de uitvoering van het Protocol betreffende milieubescherming bij het Verdrag inzake Antarctica. De commissie heeft dit wetsontwerp besproken tijdens haar vergaderingen van 18 oktober 2004 en 18 januari 2005.
De heer Bruno Tobback, minister van Leefmilieu en Pensioenen, gaf in zijn inleidende uiteenzetting mee dat het Protocol betreffende milieubescherming bij het Verdrag inzake Antarctica het Protocol van Madrid van 4 oktober 1991 omzet in Belgisch recht, dat sinds 1998 van kracht is.
Het Protocol heeft als doel de globale milieubescherming van Antarctica te verzekeren. Antarctica zal hierdoor een natuurreservaat worden.
Het Protocol bepaalt het volgende. Ten eerste bepaalt het de principes voor de bescherming van het milieu voor de activiteiten in Antarctica. Ten tweede verbiedt het commerciële handelingen met betrekking tot minerale bronnen. Ten derde onderwerpt het alle handelingen aan een voorafgaande milieu-impactevaluatie.
De bijlagen van het Protocol behandelen ten eerste die milieu- impactevaluatie, ten tweede de conservatie van de fauna en flora, ten derde de verwerking en het beheer van afval, ten vierde de preventie van zeevervuiling en ten vijfde het beheer van de beschermde zones.
De uitvoering van het Protocol behoort toe aan 27 landen, waaronder België. Die landen zullen actief deelnemen aan wetenschappelijk onderzoek ter plaatse. Zo zal België onderzoek doen naar, onder andere, klimatologie, glaciologie, oceanografie en biologie. Het was nodig om die bepaling van het Protocol van Madrid om te zetten naar Belgisch recht.
Ik kom aan de kosten. De infrastructuurkosten zullen door privéorganisaties betaald worden. De functioneringskosten van het station, ongeveer 500.000 euro, zullen door de overheid betaald worden.
De uitvoeringswet bevat de vergunningsregels die gelden voor wetenschappelijke en toeristische activiteiten. Aangezien de bescherming van Antarctica slechts voor rekening valt van een beperkt aantal partijen die het verdrag ondertekend hebben, 27 landen dus, kunnen ook andere landen toestemming vragen aan België. De verantwoordelijkheid ligt bij de minister van Leefmilieu, evenals het afleveren van de vergunningen en de controle op de toegestane activiteiten.
Commissievoorzitter Mayeur vroeg tijdens de bespreking dat enkele technische verbeteringen zouden aangebracht worden in de tekst van het wetsontwerp, in overeenstemming met de aanbevelingen van de Raad van State. De heer Mayeur diende daarvoor een amendement in.
Tijdens de stemming werden de artikelen 1 tot en met 4, amendement nr. 1, het geamendeerde artikel 5 en de artikel 6 tot 14 eenparig aangenomen. Daarna werd ook het hele wetsontwerp eenparig aangenomen.

Mr. Speaker, Mrs. Minister, Mr. Minister, colleagues, I will report on behalf of the Committee on Public Health, Environment and Social Renewal, also on behalf of my colleague Miguel Chevalier, on the draft law on the implementation of the Protocol on Environmental Protection to the Antarctic Convention. The committee discussed this draft law during its meetings of 18 October 2004 and 18 January 2005.
Mr Bruno Tobback, Minister of Environment and Pensions, stated in his introductory presentation that the Protocol on Environmental Protection to the Convention on Antarctica translates the Madrid Protocol of 4 October 1991 into Belgian law, which has been in force since 1998.
The Protocol aims to ensure the global environmental protection of Antarctica. Antarctica will become a natural reserve.
The Protocol stipulates the following. First, it sets out the principles of environmental protection for activities in Antarctica. Second, it prohibits commercial acts relating to mineral resources. Third, it shall subject all acts to a prior environmental impact assessment.
The Annexes to the Protocol address, first, the environmental impact assessment, second, the conservation of fauna and flora, third, the treatment and management of waste, fourth, the prevention of marine pollution, and fifth, the management of protected areas.
The implementation of the Protocol belongs to 27 countries, including Belgium. Those countries will actively participate in scientific research on the ground. For example, Belgium will do research in, among other things, climatology, glaciology, oceanography and biology. It was necessary to transpose that provision of the Madrid Protocol into Belgian law.
I come to the costs. Infrastructure costs will be paid by private organizations. The operating costs of the station, about 500,000 euros, will be paid by the government.
The Implementing Act sets out the licensing rules applicable to scientific and tourism activities. Since the protection of Antarctica is only taken into account by a limited number of parties that have signed the treaty, 27 countries, other countries can also ask for permission from Belgium. The responsibility lies with the Minister of Environment, as well as the issuance of the permits and the control of the permitted activities.
Commission President Mayeur asked during the discussion that some technical improvements would be made in the text of the draft law, in accordance with the recommendations of the State Council. Mr Mayeur submitted an amendment.
During the vote, Articles 1 to 4, amendment no. 1, the amended Article 5 and Articles 6 to 14 adopted unanimously. The entire bill was unanimously adopted.

Mijnheer de voorzitter, mijnheer de minister, collega's, ik acht mij gelukkig deze middag nog tijdig de uitgang gevonden te hebben van de mooie, nieuwe, kleurrijke gevangenis van Hasselt, zodat ik u hier vandaag, deze middag, mondeling verslag kan uitbrengen over een wetsontwerp dat ons van de Senaat heeft bereikt. Dit wetsontwerp onderstreept immers de positieve waarden van solidariteit en betrokkenheid die klaarblijkelijk in onze maatschappij toch nog aanwezig zijn.
Uw commissie voor de Financiën heeft het voorliggende wetsontwerp besproken tijdens haar vergadering van dinsdag 1 februari 2005, wat ook de reden is waarom hier mondeling verslag wordt uitgebracht. Minister Reynders gaf aan dat hem in het verleden reeds herhaaldelijk werd gevraagd om de ophaling en omruiling tegen euro's van muntstukken in Belgische frank ook na 31 december 2004 nog toe te staan, maar dan enkel voor een goed doel. De minister was toen evenwel niet geneigd op dergelijk verzoek in te gaan, omdat zulks hoe dan ook een wetswijziging zou vereisten. Ingevolge de tsunamiramp in Zuidoost-Azië werd die vraag onlangs opnieuw gesteld. Dat initiatief werd gesteund door een aantal senatoren. De minister heeft daarop contact genomen met de Nationale Bank. Deze heeft hem verzekerd dat dergelijke operatie mits een wetswijziging doenbaar was. Het door de Senaat goedgekeurde wetsontwerp bepaalt dan ook dat de tegenwaarde in euro van de aan de loketten van de Nationale Bank of de loketten van De Post ingeruilde muntstukken in Belgische frank op rekening 12-12 moeten worden gestort.
De minister formuleerde vervolgens enkele bemerkingen bij de door de Senaat overgezonden tekst. Hij beklemtoonde eerst en vooral dat de kosten van die operatie ten laste vallen van de schatkist en bijgevolg van de belastingbetaler. Bij de opmaak van de begroting werd immers uitgegaan van de veronderstelling dat alvast een deel van de muntstukken in Belgische frank niet meer tegen euro's zou worden omgeruild. De minister vroeg zich ook af of die eenmalige operatie wel beperkt moest blijven tot een enkel goed doel, namelijk steun aan de slachtoffers van de tsunamiramp. Misschien moest de draagwijdte van de voorgestelde wetswijziging worden uitgebreid tot gelijkaardige, soortgelijke initiatieven zoals bijvoorbeeld de 11.11.11actie. Eventueel zou de wetgever zelfs aan de Koning de bevoegdheid kunnen verlenen om de operatie verder uit te breiden tot nog andere acties voor een goed doel. De minister pleitte er wel voor om die uitbreiding in dat geval te beperken tot die organisaties die nu reeds erkend zijn voor de fiscale aftrekbaarheid van aan hen gedane giften.
Tijdens de algemene bespreking peilde collega de Donnea naar de budgettaire impact van het voorliggend ontwerp. De minister gaf aan dat dit moeilijk precies kon worden geraamd. Alles hangt immers af van de hoeveelheid muntstukken in Belgische frank die de betrokkenen zullen inzamelen. Na de goedkeuring van het voorliggend wetsontwerp hebben zij tot 1 april 2005 de tijd om dergelijke inzamelacties te organiseren. Hij herinnerde er in dat verband aan dat het sinds 1 januari 2005 niet meer mogelijk is muntstukken in Belgische frank in de handel te gebruiken of tegen euro's om te ruilen. Indien het voorliggend wetsontwerp wordt goedgekeurd zal men echter nog tot 1 april 2005 de tegenwaarde ervan in euro voor een goed doel kunnen aanwenden door ze op een van de in het ontwerp vermelde rekeningen te storten.
Een amendement werd ingediend door mevrouw Lahaye-Battheu, de heren Chabot, Massin, Gustin, Van der Maelen, Bogaert, Van Biesen en mijzelf. Dit amendement strekt ertoe het wetsontwerp uit te breiden tot de rekening 11.11. Volgens de meeste indieners kon deze uitbreiding volstaan en was geen verdere uitbreiding nodig.
Bij de artikelgewijze bespreking wil ik nog vermelden dat artikel 1 eenparig werd goedgekeurd. Artikel 2, zoals geamendeerd, werd eenparig goedgekeurd en ook artikel 3 werd goedgekeurd. Het hele geamendeerde ontwerp werd dus eenparig aangenomen. Het spreekt voor zich dat de kamercommissie hoopt dat dit ontwerp met een zelfde samenhorigheids- en solidariteitsgevoel zal worden goedgekeurd. The Minister has contacted the National Bank. He assured him that such an operation was possible provided a legislative change was possible. After the approval of the present draft law, they have until 1 April 2005 time to organize such collection actions. In that regard, he recalled that since 1 January 2005, it is no longer possible to use coins in Belgian francs in trade or to exchange against euros. However, if the draft law in question is approved, it will still be possible until 1 April 2005 to use its equivalent in euros for a good purpose by depositing them on one of the accounts listed in the draft.
An amendment was submitted by Ms. Lahaye-Battheu, Mr. Chabot, Mr. Massin, Mr. Gustin, Mr. Van der Maelen, Mr. Bogaert, Mr. Van Biesen and myself. This amendment aims to extend the bill to account 11.11. According to most applicants, this extension could be sufficient and no further extension was needed.

Je vais être particulièrement bref étant donné que le rapport réalisé par Mme Roppe est très complet. Je tiens à le souligner car c'est un rapport oral et qui démontre la volonté de la Chambre d'aller vite et d'éviter ainsi un retard dans les mesures à prendre. Ce projet nous vient du Sénat et nous l'avons amendé. Il est vrai que dans cette opération particulière, si la monnaie n'est pas rentrée, le bénéfice intégral est pour l'État. Si on prolonge la possibilité de rapporter cette monnaie, on peut réaliser une opération en faveur d'institutions, plus particulièrement ici l'opération "tsunami 12-12", à la suite d'une catastrophe et ce afin d'y apporter une contribution financière.
Évidemment, on peut toujours se dire qu'il s'agit d'une diminution de recettes pour les caisses de l'État mais ce n'en est pas une à proprement parler puisque, de toute façon, c'est de l'argent que le Belge délaisse au profit de l'État en renonçant à sa conversion en euros. On peut donc dire que l'effet est particulièrement marginal pour l'État mais que c'est malgré tout le signe d'une redistribution des richesses au profit de personnes ayant subi une catastrophe.
À cette occasion, on peut se poser une question. Je me réjouis d'avoir vu l'ensemble des groupes politiques présents en commission des Finances marquer leur accord à ce sujet en signant l'amendement. En effet, nous sommes préoccupés par le sort des victimes d'une catastrophe, nous sommes préoccupés par les pays victimes de la catastrophe mais nous avons aussi d'autres préoccupations quant à ce qui peut se passer dans les pays du tiers-monde qui subissent la faim, la sécheresse, la guerre civile, l'exploitation, sans pour autant être médiatisés.
Nous tous qui avons signé cet amendement, dont je ne revendique pas la paternité, nous pouvons être fiers de cette démarche que nous accomplissons, de ce geste que nous posons et qui est légèrement différent de la démarche d'un État relativement puissant dans le monde — il est bon de le souligner. Une personnalité - le bras droit du président de cet État - se permet de dire qu'il y trouve un intérêt, que c'est une opportunité pour lui d'aller soutenir les pays d'Asie du SudEst après la catastrophe. Notre démarche est d'un autre type et il est important de le dire. Il est important d'accomplir ce type de démarche d'autant plus que cela n'entraîne pas de conséquences particulières pour les finances de l'État. C'est ce que je tenais à souligner aujourd'hui.

I am pleased to have seen all the political groups present in the Committee on Finance sign their agreement on this subject by signing the amendment. Indeed, we are concerned about the fate of the victims of a disaster, we are concerned about the countries victims of the disaster but we also have other concerns about what can happen in the third world countries that suffer from hunger, drought, civil war, exploitation, without yet being mediated.
All of us who have signed this amendment, of which I do not claim paternity, can be proud of this approach we are doing, of this gesture we are making and which is slightly different from the approach of a relatively powerful state in the world — it is good to emphasize it. A personality – the right arm of the president of this state – allows itself to say that there is an interest in it, that it is an opportunity for him to go to support the countries of Southeast Asia after the disaster. Our approach is of a different type and it is important to say that. It is important to carry out this type of approach especially since it does not have any particular consequences for the state finances. This is what I wanted to emphasize today.

Mijnheer de voorzitter, ik wijs u op het uitstekende verslag van collega mevrouw Roppe, die dat zoals steeds heel precies gedaan heeft.
CD&V steunt het voorstel volmondig. Wij hebben het geapprecieerd dat senator Wouter Beke het initiatief heeft genomen. Hij heeft onmiddellijk over alle partijgrenzen heen iets kunnen opbouwen, dat hopelijk toch enkele miljoenen euro zal genereren om de betrokken regio te ondersteunen.
Het amendement kwam een klein beetje als een verrassing. Maar goed, wij hebben ook dat willen steunen in de commissie, omdat wij in daar nog altijd in dezelfde sfeer bleven. Boven alle partijpolitiek uit meenden wij het te moeten steunen. Er is ook een aantal positieve argumenten daarvoor.
Tot zover, voorzitter, beste collega's, mijn interventie. Wij vinden het een zeer goed initiatief en wij zijn bovendien zeer blij dat het, los van alle partijpolitieke grenzen, zo snel goedgekeurd kan worden in de Kamer en in de Senaat.
