                    Monsieur le président, chers collègues, la commission des Affaires sociales a examiné le présent projet de loi lors de sa réunion du 4 mai 2004. Le ministre des Affaires sociales et de la Santé publique, M. Demotte, a déclaré que le projet visait à concrétiser l'avis 1448, rendu le 13 novembre 2003 par le Conseil national du travail reflétant l'accord des partenaires sociaux.

Si depuis le 1 er janvier 2003, la déclaration immédiate de l'emploi est effectivement généralisée, l'article 13 de l'arrêté royal du 5 novembre 2002 prévoyait que pour certains secteurs confrontés à différentes techniques, notamment les secteurs des entreprises horticoles et de l'industrie hôtelière engageant des travailleurs occasionnels, la déclaration dite Dimona ne devenait obligatoire qu'à partir du 1 er janvier 2004. L'évaluation du Conseil national du travail a néanmoins fait apparaître que ces secteurs se trouvent toujours dans l'impossibilité d'effectuer ladite déclaration et propose, par conséquent, d'envisager un dernier report d'un an, sachant que l'ONSS travaille actuellement à la mise au point d'un procédé adapté et que la déclaration prévue pour la fin du mois de juin sera ensuite soumise au Conseil national du travail.

Bien que ce projet n'ait pas généré de commentaires sur le fond, Mme Greta D'hondt a souhaité soulever la problématique sur la forme relative à la publication au Moniteur belge d'une loi qui n'avait pas encore été soumise au Parlement. Faisant référence à une question posée sur le sujet par M. Courtois et à la réponse de la ministre de la Justice, lors d'une réunion de la commission de la Justice du 26 avril 2004, Mme D'hondt souhaitait entendre les explications du ministre des Affaires sociales et de la Santé publique et le questionner également sur les mesures prises pour éviter que ce précédent ne se renouvelle.

Le ministre a déploré l'erreur qui résultait d'un malheureux concours de circonstances, a précisé qu'il allait ordonner une enquête interne et qu'un renforcement des procédures de contrôle était dorénavant prévu. L'article 1 er fut adopté par 11 voix et 2 abstentions. Les articles 2 et 3 furent adoptés à l'unanimité.

The Social Affairs Committee examined this bill at its meeting on 4 May 2004. Minister of Social Affairs and Public Health, Mr. Demotte, stated that the project was aimed at concretizing Opinion 1448, issued on 13 November 2003 by the National Labour Council, reflecting the agreement of the social partners.

While the immediate declaration of employment is effectively generalized since 1 January 2003, Article 13 of the Royal Decree of 5 November 2002 provided that for certain sectors facing different techniques, in particular the sectors of horticultural enterprises and the hotel industry employing occasional workers, the so-called Dimona declaration became mandatory only from 1 January 2004. However, the assessment of the National Labour Council has shown that these sectors are still unable to make the said declaration and therefore proposes to consider a last one-year postponement, being aware that the ONSS is currently working on the development of an appropriate process and that the declaration scheduled for the end of June will then be submitted to the National Labour Council.

Although this project has not generated any comments on the subject matter, Mrs Greta D'hondt wanted to raise the problem regarding the form relating to the publication in the Moniteur belge of a law that had not yet been submitted to Parliament. Referring to a question asked on the subject by Mr. Courtois and to the reply of the Minister of Justice, at a meeting of the Justice Committee on 26 April 2004, Mrs D'hondt wished to hear the explanations of the Minister of Social Affairs and Public Health and also to question him about the measures taken to prevent this precedent from repeating itself.

The minister deplored the error resulting from an unfortunate match of circumstances, said that he would order an internal investigation and that a reinforcement of the control procedures was from now on planned. Article 1 was adopted by 11 votes and 2 abstentions. Articles 2 and 3 were adopted unanimously.

                    Misschien was er een tijd - ik wil niet voor oud-strijder doorgaan - waar de rapporteurs gevraagd werd het verslag zelf te schrijven met de pen. Dat was zo in de jaren 1968 tot ongeveer 1974 of 1975. Daarna werd het door de rapporteur verbeterd en in het algemeen werd het dan, desgewenst, door hem of haar voorgelezen. Men moet natuurlijk ook geen verslag naar voren brengen enkel voor het plezier om het te doen.
