Mijnheer de voorzitter, mevrouw de minister, collega's, met het voorliggende wetsontwerp ter bevordering van de werkgelegenheid krijgt het hoofdstuk over de actieve welvaartsstaat van het regeerakkoord een eerste concrete invulling. Ik spreek hier duidelijk over het regeerakkoord, vermits dat de referentiebasis is waarop wij de merites van dit wetsontwerp moeten beoordelen. Hiermee wil ik niet gezegd hebben dat het VLD-werkgelegenheidsplan voor ons zonder meer een vergeetboek moet worden. Integendeel, het blijft voor ons een belangrijk referentiepunt, maar dan wel in het besef dat een partijprogramma en een regeerakkoord per definitie niet hetzelfde zijn. Het eerste is een visie van één partij; het tweede is een compromistekst tussen de visies van verschillende partijen. Mijnheer de voorzitter, mevrouw de minister, collega's, ofschoon het bedrag van de lastenverlaging niet hetzelfde is als datgene dat in het VLD-plan werd naar voren geschoven, kan de voorgestelde maatregel onze goedkeuring wegdragen. Het hoeft ook niet gezegd dat de lastenverlaging voor de VLD een essentieel onderdeel van dit wetsontwerp is, in eerste instantie omdat ze tegemoetkomt aan wat de huidige eerste minister in zijn vorige functie van partijvoorzitter heeft verdedigd, namelijk dat de lastenverlaging geen fetisj mag zijn, maar dat het moet gaan om een substantiële lastenverlaging. Dat is toch het minste wat men kan zeggen van een lastenverlaging met gemiddeld 32 000 frank per werknemer. Bovendien gaat het om een eerste fase in de lasten- verlaging. In het regeerakkoord wordt het vooruitzicht geboden op een herhaling van de maatregel in het derde jaar van de legislatuur indien aan de daartoe gestipuleerde randvoorwaarden is voldaan. De VLD kan zich eveneens verheugen over de verdere lastenverlaging in de social-profitsector. Gezien de groeiende maatschappelijke noden en het arbeidsintensieve karakter van de sector, kan een lastenverlaging, gekoppeld aan jobcreatie, een constructieve bijdrage leveren aan zowel de stijgende behoeften en de kwalitatieve vereisten van de zorgtaken, als de werkloosheidsproblematiek. Evenwel is het van cruciaal belang dat de extra middelen efficiënt worden besteed, zowel op het niveau van de functies als op het niveau van de diverse subsectoren. Gezien de stijgende vereisten inzake professionele kwalificaties en gezien het feit dat ook in de socialprofitsector enkele knelpuntberoepen voorkomen, is de kans op het welslagen van de maatregel ook deels afhankelijk van de mogelijkheden inzake opleiding en permanente vorming. Mijnheer de voorzitter, mevrouw de minister, collega's, de regering bereidt een kaderwet voor die een hergroepering van de bestaande regelingen inzake arbeidstijd bevat. Met het oog op de vereenvoudiging en de overzichtelijkheid lijkt ons dit een wenselijk initiatief. De huidige regelingen zijn vaak op experimentele basis geschoeid en kennen niet altijd evenveel succes. Ik neem het voorbeeld van het offensieve deel van de experimenten inzake de arbeidsduurvermindering, waarop slechts een zeer beperkt aantal ondernemingen heeft ingetekend. Voor de VLD blijft het evenwel belangrijk dat arbeidsduurvermindering moet kunnen, maar dan op vrijwillige basis. Tegen lineaire maatregelen maken wij voorbehoud. Uit de besprekingen is evenwel gebleken dat dit niet aan de orde van de dag is. Mevrouw de minister, wij zijn blij met de beslissing van de regering om de plus-één-, plustwee-, plus-drie-maatregel uit te breiden met de categorie van de uitzendkrachten. De maatregel bevestigt de trend dat de uitzendsector steeds meer fungeert als wervingskanaal voor werkgevers en doorstromingskanaal voor werknemers. Misschien kan deze maatregel voorkomen dat er langer dan noodzakelijk gebruik wordt gemaakt van uitzendarbeid en werkgevers mutatis mutandis sneller geneigd zullen zijn om over te gaan tot een vaste aanwerving. Overigens zijn er in de uitzendsector nog een aantal andere punten waar een versoepeling kan worden overwogen met het oog op de creatie van nieuwe, bijkomende reguliere werkgelegenheid. Ik denk bijvoorbeeld aan de plaats van de uitzendsector in de diensten aan personen of de opheffing van het verbod van uitzendarbeid in de bouwsector. Mevrouw de minister, tot slot zou ik nog een woordje willen zeggen over het startbaanplan of Rosetta-plan. De VLD heeft reeds bij eerdere plenaire besprekingen haar standpunt hierover bekendgemaakt. Daarom zal ik mij beperken tot enkele punctuele aspecten. Allereerst moet Rosetta tegemoetkomen aan de noden in de beide Gemeenschappen van ons land. Jeugdwerkloosheid is een probleem in beide Gemeenschappen, maar relatief gezien in grotere mate in Wallonië. Het is positief dat het plan voorziet in een uitbreiding van de initiële doelgroep, zodat Rosetta ook rekening kan houden met de noden die zich explicieter stellen op de Vlaamse arbeidsmarkt. Met het probleem van de oudere werkloosheid in Vlaanderen in het achterhoofd is het noodzakelijk erover te waken dat er zich geen verdringingseffecten zouden voordoen, zoals dat in het verleden met het jongerenbanenplan is gebeurd. Rosetta mag niet enkel een kwantitatieve finaliteit hebben, maar ook een kwalitatieve. Werkervaring is één ding, maar zij moet ertoe leiden dat jongeren kunnen beschikken over de vereiste kwalificaties zodat zij kunnen beantwoorden aan de reële noden van het bedrijfsleven. In die zin kunnen wij ons erover verheugen dat Rosetta meer is dan een blinde plaatsingsmaatregel en ook in mogelijkheden voorziet voor opleiding en vorming. De tewerkstellingsverplichting blijft immers een heikel punt voor de private bedrijven. Ook wij hebben enige reserves als dergelijke maatregel een te stringent of lineair karakter zou vertonen. Indien men zou kiezen voor een maatregel die onvoldoende wordt door de ondernemingen gedragen, zou het succes ervan reeds bij voorbaat twijfelachtig zijn. Ook de werklozen zouden niet gebaat zijn met een papieren tijger. Daarom vindt de VLD het een goede zaak dat de oorspronkelijke doelstellingen, na overleg met de betrokkenen, zijn bijgestuurd tot een ondergrens van 50 werknemers en een bijkomende streefdoel van 1%. Ook de evaluatiemogelijkheid door de Nationale Arbeidsraad en de Centrale Raad voor het bedrijfsleven kan, indien nodig, problemen detecteren. Ten slotte mogen wij ook niet vergeten dat de maatregel enkele financiële tegemoetkomingen plaatst tegenover de eisen die aan een aantal ondernemingen worden gesteld. Een laatste aandachtspunt hieromtrent betreft de talenkennis. Uit een aantal bedrijfsbezoeken, in het kader van onze dialoog met het maatschappelijk middenveld, hebben wij onthouden dat talenkennis - en vooral het gebrek daaraan - een ernstig probleem aan het worden is. Het gaat dan niet zozeer over de kennis van het Engels, want dat schijnt overal nogal mee te vallen. Vooral de kennis van de tweede landstaal is nog steeds een probleem in Wallonië, maar manifesteert zich thans ook vaker in Vlaanderen. Ook inzake arbeidsmobiliteit kan dit problemen opleveren. Een tekenend voorbeeld is de situatie in Zuid-West-Vlaanderen, waar er een chronisch tekort is aan arbeidskrachten, terwijl in het aangrenzende Henegouwen de hoogste werkloosheid van België heerst. Het zou geen overbodige luxe zijn, mochten in het kader van het Rosetta-plan de nodige inspanningen worden gedaan tot verbetering van de kennis van de tweede landstaal, uiteraard in overleg met de regio's. Het is voor iedereen duidelijk dat de werkloosheid een draak met veel koppen is, die niet met een hauw van één zwaard klein te krijgen is. Daarom moet men inzake werkgelegenheidsbeleid verscheidene sporen volgen. Dit wetsontwerp biedt hiertoe de kans, maar met dat verschil dat in vergelijking met het recente verleden, er thans duidelijke accenten worden gelegd: een lastenverlaging a rato van 24,2 miljard en een startbaanplan. Wij hopen dat de regering in de toekomst blijft kiezen voor duidelijke accenten en werk zal maken van een verdere vereenvoudiging van de reeds bestaande maatregelen van dewelke vriend en vijand zeggen dat zij onoverzichtelijk en overlappend zijn. Mijnheer de voorzitter, mevrouw de minister, collega's, de VLD zal het voorliggende wetsontwerp goedkeuren.

Mr. Speaker, Mrs. Minister, colleagues, with the present draft law on the promotion of employment, the chapter on the active welfare state of the government agreement gets a first concrete fulfillment. I speak here clearly about the government agreement, since it is the reference base on which we must assess the merits of this bill. This does not mean that the VLD employment plan must be a forgotten book for us. On the contrary, it remains an important reference point for us, but in the realization that a party program and a government agreement are by definition not the same. The first is a single-party vision; the second is a compromise text between the visions of different parties. Mr. Speaker, Mrs. Minister, colleagues, although the amount of the burden reduction is not the same as that which was pushed forward in the VLD plan, the proposed measure may take away our approval. It is also unnecessary to say that the burden reduction for the VLD is an essential part of this bill, in the first instance because it meets what the current prime minister defended in his previous position as party chairman, namely that the burden reduction must not be a fetish, but that it must be a substantial burden reduction. That is the least that can be said of a burden reduction of an average of 32 000 francs per employee. In addition, it is a first phase in the burden reduction. The government agreement provides the prospect of a repeat of the measure in the third year of the legislature if the frame conditions stipulated for this purpose are met. The VLD can also welcome the further reduction of the burden in the social benefit sector. Given the growing social needs and the labor-intensive nature of the sector, a burden reduction, coupled with job creation, can provide a constructive contribution to both the increasing needs and the qualitative requirements of the care tasks, as well as the unemployment problem. However, it is crucial that the additional resources are used efficiently, both at the level of the functions and at the level of the various subsectors. Given the increasing requirements for professional qualifications and the fact that there are some crippling professions also in the social benefit sector, the likelihood of success of the measure is also partly dependent on the opportunities for training and continuous training. Mr. Speaker, Mrs. Minister, colleagues, the Government is preparing a framework law that includes a reassembly of the existing working time arrangements. In terms of simplification and clarity, this seems to us to be a desirable initiative. Current schemes are often designed on an experimental basis and do not always have the same success. I take the example of the offensive part of the experiments on the reduction of working hours, to which only a very limited number of companies have signed up. For the VLD, however, it remains important that reduction of working hours should be possible, but then on a voluntary basis. We make reservations against linear measures. However, the discussions have shown that this is not on the agenda. We welcome the Government’s decision to extend the plus-one, plus-two, plus-three measures to include the category of emergency forces. The measure confirms the trend that the broadcasting sector increasingly acts as a recruitment channel for employers and a flow channel for workers. This measure may prevent the use of temporary employment for a longer period than necessary, and employers will be more likely to switch to permanent employment, mutatis mutandis. On the other hand, there are a number of other points in the broadcasting sector where easing could be considered in order to create new, additional regular employment. I think, for example, of the place of the broadcasting sector in the services to persons or the abolition of the prohibition of temporary work in the construction sector. Finally, I would like to say a few words about the launch path plan or Rosetta plan. The VLD has already announced its position on this subject in previous plenary discussions. Therefore, I will limit myself to some punctual aspects. First of all, Rosetta must meet the needs of the two Communities of our country. Youth unemployment is a problem in both Communities, but relatively to a greater extent in Wallonia. It is positive that the plan provides for an expansion of the initial target audience, so that Rosetta can also take into account the needs that are more explicitly present on the Flemish labour market. Having in mind the problem of older unemployment in Flanders, it is necessary to ensure that there are no displacement effects, as has happened in the past with the youth employment plan. Rosetta should not only have a quantitative finality, but also a qualitative. Work experience is one thing, but it must enable young people to have the required qualifications to meet the real needs of the business. In that sense, we can be pleased that Rosetta is more than a blind placement measure and also provides opportunities for training and training. The employment obligation remains a delicate issue for private companies. We also have some reservations if such a measure would show too stringent or linear character. If one would choose a measure that is not sufficiently carried out by the undertakings, its success would be doubtful already in advance. Even the unemployed would not benefit from a paper tiger. Therefore, the VLD considers it a good thing that the original targets, after consultation with the stakeholders, have been upgraded to a lower limit of 50 employees and an additional target of 1%. The ability to evaluate by the National Labour Council and the Central Council for Industry can also detect problems if necessary. Finally, we must also not forget that the measure imposes some financial compensation against the requirements imposed on a number of companies. A final point in this regard concerns language knowledge. From a number of business visits, as part of our dialogue with civil society, we have recalled that language skills – and especially the lack thereof – are becoming a serious problem. It is not so much about the knowledge of English, because it seems to be quite common everywhere. Especially the knowledge of the second country steel is still a problem in Wallonia, but is now more common in Flanders. This can also cause problems with labour mobility. A striking example is the situation in South-West Flanders, where there is a chronic shortage of labour, while in the adjacent Henegouwen the highest unemployment rate in Belgium prevails. It would not be unnecessary luxury if the necessary efforts were made to improve the knowledge of the second national language within the Rosetta plan, of course in consultation with the regions. It is clear to everyone that unemployment is a dragon with many heads, which cannot be reduced by a hail of one sword. Therefore, there are several steps to be followed in employment policy. This bill offers the opportunity to do so, but with the difference that compared to the recent past, there are now clear accents: a load reduction a ratio of 24.2 billion and a start-up track plan. We hope that in the future the government will continue to choose clear accents and work to further simplify the already existing measures whose friend and enemy say they are opaque and overlapping. Mr. Speaker, Mrs. Minister, colleagues, the VLD will approve the present bill.

Monsieur le président, madame la ministre, chers collègues, nous nous réjouissons de ce projet de loi qui, cinq mois après la déclaration gouvernementale, traduit concrètement un des objectifs de l'Etat social actif. Le volet emploi des jeunes est particulièrement intéressant car nous savons que le taux de chômage chez les jeunes de 18 à 25 ans est très important. Les jeunes constituent une catégorie vulnérable, d'autant que le manque de perspectives d'avenir les démotive souvent pour les études, qu'ils considèrent comme peu utiles dans le contexte actuel. Cela freine également leur dynamisme. Combien de fois n'avons-nous pas entendu dire que rien ne sert de poursuivre une formation car de toute fac¸on, il n'y a pas d'emploi au sortir des études ou qu'il est impossible de trouver un emploi avant la fin de la période de stage d'attente et l'ouverture du droit aux allocations de chômage? Ce manque d'espoir génère chez les jeunes un sentiment d'inutilité et, parfois, cette désespérance est si grande qu'elle peut conduire à la violence, à la toxicomanie, voire au suicide. Vendredi dernier s'est tenue l'assemblée de la section CPAS de l'Union des villes et communes de Wallonie. A cette occasion, une recherche faite par le service de sociologie générale et de sociologie de la famille de l'Université de Liège a été présentée. Elle nous faisait remarquer que nous étions maintenant parfois, dans certains familles, en présence de trois générations de chômeurs. Cela doit nous faire réfléchir et nous devons le combattre de toutes nos forces. Ce projet de loi visant à la promotion de l'emploi est en réalité, madame la ministre, un véritable projet social. Il permet en effet aux jeunes d'échapper à la fatalité du chômage dès la fin des études. Ce projet est ambitieux puisqu'il veut atteindre 3% de nouveaux travailleurs dans les entreprises occupant plus de 50 personnes. Un objectif supplémentaire vise à atteindre 4% dans les entreprises comptant moins de 50 personnes. Nous espérons que les indépendants et les PME participeront activement à cet effort. Nous sommes cependant conscients que cet effort doit se concilier, tant pour les PME que pour les grandes entreprises, avec les impératifs de compétitivité et de rentabilité. La convention premier emploi millésime 2000 rempla- cera le stage des jeunes du millésime 1983. Il s'agit d'un ensemble de mesures qui ne se superposent pas à d'autres, mais les remplacent dans un but de plus grande efficacité, de plus de souplesse dans les conditions d'accès avec une priorité marquée pour les jeunes les moins qualifiés. L'aspect formation est prévu mais ce n'est qu'une première étape qui pourrait aller vers une meilleure organisation de l'enseignement en alternance, par exemple en favorisant des partenariats entre les entreprises et les établissements d'enseignement. Les perspectives d'un véritable partenariat pourraient passer par la mise à disposition par des entreprises, d'équipements destinés à la formation des jeunes. Des incitants permettraient peut-être de rencontrer cet objectif. N'oublions pas que les entreprises ont principalement besoin de personnel qualifié. Mais il faut toujours garder à l'esprit que les entreprises n'ont pas pour vocation première de pallier les carences d'un système éducatif, notamment dans ses branches technique et professionnelle. Madame la ministre, nous souhaiterions aussi que vous fassiez preuve de vigilance lorsque le gouvernement sera amené à prendre les arrêtés d'exécution de cette loi-cadre, notamment en ce qui concerne les obligations des employeurs publics à qui on devra demander un effort plus que symbolique afin d'éviter toute discrimination vis-à-vis du secteur privé et des charges qui lui sont imposées. Par ailleurs, le gouvernement aura à définir la nature des projets globaux qui répondent aux besoins de la société et qui doivent permettre d'offrir aux jeunes une réelle opportunité de prendre part à la vie active. Ainsi, au-delà de l'aspect formatif, ils pourront s'épanouir dans leur travail tout en rendant service à la collectivité. Monsieur le président, madame la vice-première ministre, chers collègues, le groupe PRL FDF MCC approuvera ce projet de loi.

Mr. Speaker, Mrs. Minister, dear colleagues, we welcome this bill that, five months after the government declaration, concretely translates one of the objectives of the active social state. The youth employment aspect is ⁇ interesting because we know that the unemployment rate among young people aged 18 to 25 is very high. Young people are a vulnerable category, especially since the lack of future prospects often dismotivates them for studies, which they consider to be useless in the current context. This also reduces their dynamism. How many times have we not heard that it is useless to pursue training because, in any case, there is no employment after graduation or that it is impossible to find employment before the end of the waiting period and the opening of the right to unemployment benefits? This lack of hope generates in young people a sense of uselessness and, sometimes, this despair is so great that it can lead to violence, to drug addiction, and even suicide. Last Friday was held the assembly of the CPAS section of the Union of cities and municipalities of Wallonia. On this occasion, a research conducted by the Department of General Sociology and Family Sociology of the University of Liège was presented. She made us notice that we were now sometimes, in some families, in the presence of three generations of unemployed. This must make us think and we must fight it with all our forces. This draft law aimed at promoting employment is in reality, Mrs. Minister, a real social project. It allows young people to escape the fatality of unemployment from the end of their studies. This project is ambitious as it aims to reach 3% of new workers in companies employing more than 50 people. An additional target is to reach 4% in companies with less than 50 employees. We hope that self-employed and SMEs will actively participate in this effort. However, we are aware that this effort must be reconciled, both for SMEs and large companies, with the imperatives of competitiveness and profitability. The first Millennium Employment Convention 2000 will replace the Millennium Youth Internship of 1983. This is a set of measures that do not overlap with others, but instead replace them in order to be more efficient, more flexible in access conditions with a marked priority for the least qualified youth. The training aspect is planned but this is only a first step that could go towards a better organisation of alternating education, for example by fostering partnerships between ⁇ and educational institutions. The prospects for a genuine partnership could go through the provision by companies of equipment for the training of young people. Incentives may help to meet this goal. Let’s not forget that ⁇ primarily need skilled personnel. But it must always be kept in mind that companies do not have as their primary vocation to address the deficiencies of an educational system, ⁇ in its technical and professional branches. Mr. Minister, we would also like you to be vigilant when the government is forced to take the rulings implementing this framework law, in particular with regard to the obligations of public employers, from whom a more than symbolic effort will be required to avoid any discrimination against the private sector and the charges imposed on it. In addition, the government will have to define the nature of global projects that meet the needs of society and that should provide young people with a real opportunity to participate in the working life. Thus, beyond the formative aspect, they will be able to flourish in their work while serving the community. Mr. Speaker, Mrs. Deputy Prime Minister, Ladies and Gentlemen, the PRL Group FDF MCC will approve this bill.

Mijnheer de voorzitter, mevrouw de minister, collega's, mijn fractie is van oordeel dat dit wetsontwerp een nieuwe belangrijke stap is in de uitvoering van de belangrijke afspraken die in het federaal regeerakkoord zijn vastgelegd. Sta me toe het wetsontwerp dat we vandaag bespreken te bestempelen als de weerspiegeling van het regeerakkoord en eigenlijk ook van het gevoerde werkgelegenheidsbeleid van de voorbije jaren. Dit wetsontwerp bevat belangrijke maatregelen met betrekking tot de lastenverlaging en arbeidsherverdeling, alsook belangrijke engagementen op het vlak van het doelgroepenbeleid. Dit zijn sporen die de voorbije jaren werden uitgetekend naar aanleiding van diverse regeerakkoorden en wetsontwerpen. Een belangrijke vernieuwing is de idee van de startbanen. Wij zijn daar bijzonder gelukkig mee. De discussie hierover was immers bijzonder moeilijk, zowel binnen als buiten het parlement. De SP ziet daarmee het eerste punt van haar kiescontract gerealiseerd. Het ontwerp is bijna de letterlijke weergave van wat wij hebben bepleit, ook in de aanloop naar 13 juni 1999. Daarmee krijgen jonge mensen de garantie dat zij door het arbeidsmarktbeleid niet vergeten worden, want dat gevaar dreigt, zeker als de situatie op de arbeidsmarkt beter wordt. Gelukkig is de situatie veel beter dan een aantal jaren geleden. Men dreigt dan echter wel eens te vergeten hoe verschrikkelijk jeugdwerkloosheid kan zijn en wat dat voor de jongeren betekent. De startbaanidee is ook belangrijk omdat België daarmee op een concrete wijze gevolg geeft aan een kritiek die Europa al sedert jaren formuleert. Wij worden op de vingers getikt omdat wij inzake langdurige werkloosheid te weinig preventief optreden. Het blijft ook vandaag nog een harde vaststelling dat heel wat mensen met een lagere scholing die de schoolbanken verlaten een grote risicogroep vormen voor die langdurige en structurele werkloosheid. De sterkte van die startbanen is de koppeling tussen opleidings- en vormingsinstellingen en de garantie om aan de slag te kunnen geraken. Ik heb er naar aanleiding van de bespreking van de beleidsbrief van de minister - maar ook vroeger in de plenaire vergadering - al op gewezen dat het organiseren van een goed samenspel tussen de diverse beleidsniveaus een van de moeilijkste opdrachten is voor een federale minister van Arbeid. Ik heb daarbij ook een oproep gedaan tot een coöperatief federalisme waarbij eenieder vanuit zijn bevoegdheid aan hetzelfde touw trekt en hetzelfde doel nastreeft. Het verheugt mij dan ook vast te stellen dat het thans voorliggende wetsontwerp een federaal kader vormt dat de Gewesten maximaal kunnen invullen op het vlak van bemiddeling, opleiding en vorming. Ik meen dat de minister er met dit wetsontwerp in geslaagd is alle betrokkenen aan het werk te zetten. Toch zal het nog noodzakelijk zijn om tijdens de komende weken en maanden op zoek te gaan naar duidelijke samenwerkingsakkoorden met die Gemeenschappen zodat een en ander op alle echelons effectief in werking kan worden gezet. Met dit ontwerp neemt de regering op zeer korte termijn twee fundamentele werkgelegenheidsinitiatieven. Een eerste initiatief werd hier vorige week besproken en goedgekeurd, met name de verhoging van de minimumlonen. Dit is een bijzonder ontwerp in het kader van de problematiek waarmee we worden geconfronteerd. Heel veel structureel werklozen voelden immers geen arbeidsprikkel meer in de laagste looncategorieën. Vandaag wordt het tweede wetsontwerp ter bevordering van de werkgelegenheid voorgelegd. Welnu, mevrouw de minister, dit is een goed ritme om vol te houden. Het regeerakkoord bevat immers een aantal bijkomende engagementen waarvan de concrete uitwerking niet te lang mag uitblijven. Tijdens de bespreking van het voorliggend ontwerp is de commissie lang blijven stilstaan bij de vraag of het een goede zaak is alles te zetten op de strijd tegen de jeugdwerkloosheid en of men niet beter de langdurig werklozen en de 55-plussers extra kansen kon bieden. Voor de SP is het zonneklaar dat beide categorieën even veel aandacht verdienen. Daarom moet men dringend werk maken van de eindeloopbaanproblematiek. Op dit ogenblik overleggen de sociale partners over belangrijke dossiers inzake de eindeloopbaan- problematiek en de werkloosheidsvallen. We moeten de resultaten afwachten en bestuderen zonder in een processie van Echternach verzeild te geraken. Er zullen knopen moeten worden doorgehakt. De eindeloopbaanproblematiek is, ons inziens, bijzonder belangrijk. De regering zal initiatieven moeten uitwerken om de lage activiteitsgraad van de 55-plussers te verhogen. Mevrouw de minister, om de werkloosheidsvallen weg te werken, heeft de regering niet alleen de minimumlonen verhoogd maar ook gezorgd voor startbanen. Alhoewel dit een stap in de goede richting is, moet u de engagementen van uw beleidsnota realiseren. De SP dringt aan op concrete voorstellen om de werkloosheidsvallen verder weg te werken. U zult bijzondere aandacht moeten besteden aan de honderdduizenden - meestal vrouwen - die onvrijwillig deeltijds werken. De complexiteit van de werkloosheidsreglementering inzake de aanvullende uitkering uit de werkloosheid maakt het dikwijls onmogelijk meer uren te werken.

The start-up idea is also important because Belgium thus concretely follows a criticism that Europe has formulated for years. We are being ticked on the fingers because we are taking too little preventive action on long-term unemployment. It remains a hard conclusion today that a large number of people with a lower education who leave the school banks constitute a large risk group for that long-term and structural unemployment. Mijnheer de voorzitter, mevrouw de minister, collega's, de wijze waarop het voorliggende wetsontwerp door de Kamer wordt gejaagd is tergend en onverantwoord. De commissie voor de Sociale Zaken heeft de definitieve documenten niet of zeer laat ontvangen. Bovendien moesten de algemene en de artikelsgewijze bespreking en de stemming op dezelfde dag plaatsvinden. Het moest en het zou. De amendementen werden zelfs niet naar de andere landstaal vertaald. We hebben slechts enkele uren de tijd gehad om het verslag na te lezen. Dit kan natuurlijk ook een middel zijn om de oppositie aan te manen iets minder aan de tekst te werken, minder opmerkingen te maken en minder amendementen in te dienen. Dan heeft men niet zoveel tijd nodig om de verslagen na lezen. Gelet op het belang dat de voorzitter aan het parlementaire werk hecht, denk ik niet dat dit in zijn bedoelingen lag. Ook op wetgevend vlak valt er over dit wetsontwerp heel wat te zeggen en ook in de toekomst zal het nog tot discussie aanleiding geven. De Raad van State werd gevraagd om een dringend advies binnen een periode van drie dagen uit te brengen. De Raad van State heeft in zijn advies dan ook gesteld dat hij zich niet ten gronde kon uitspreken. De diensten van de Kamer, die ik tijdens de vorige regeerperiode heb leren waarderen vanwege het degelijk werk dat ze ook bij het aanpassen van regeringsteksten leveren, hebben ditmaal zelfs niet de tijd gekregen om de teksten grondig na te lezen. Dit bleek tijdens de besprekingen in de commissie en zal ook in plenaire vergadering blijken. Hierdoor loopt de tekst van dit wetsontwerp op meerdere punten mank, niet alleen wat het taalgebruik betreft, maar ook op wetgevend vlak. Tijdens de bespreking in de commissie heeft de CVPfractie vanuit de oppositie op deze mankementen gewezen; we hebben ook zelf verbeteringen voorgesteld. Men zal dus niet kunnen zeggen dat we niet hebben gepoogd ons steentje bij te dragen aan het enigszins fatsoeneren van deze tekst. Het merendeel van de amendementen die door de meerderheidspartijen werden ingediend strekte ertoe het wetsontwerp tekstueel en op wetgevend vlak bij te schaven. In feite waren de meerderheidsamendementen regeringsamendementen, verpakt als meerderheidsamendementen teneinde te vermijden dat een advies moest worden gevraagd aan de Raad van State. De haast waarmee de regering en onze collega's van de meerderheid dit wetsontwerp door de Commissie voor Sociale Zaken hebben gejaagd en de onverantwoorde werkwijze waarbij dit wetsontwerp reeds vandaag in plenaire vergadering wordt behandeld, verhinderen degelijk parlementair werk. Er worden wetten afgeleverd die op hun wetgevende benen wankelen. Dit zal vandaag nog blijken. Ik voorspel dan ook dat de Senaat nog heel wat werk zal hebben aan deze tekst. Ik doe dan ook een beroep op u, voorzitter, om in de toekomst dergelijk kunst- en vliegwerk te vermijden. Het gaat in tegen het principe van het degelijk wetgevend werk en tegen het respect voor de parlementsleden en het parlementair werk, of dit nu wordt geleverd door leden van de oppositie of van de meerderheid. Was die haast en snelheid nu noodzakelijk? Via de media weten we reeds langer dan vier maanden dat de minister van Werkgelegenheid startbanen, toen nog onder de naam Rosetta-plan, wou en zou invoeren. De regering had dus tijd genoeg om degelijk wetgevend werk te doen. Blijkbaar was de minister van Werkgelegenheid de plaats en de rol van de sociale partners en het sociaal overleg in ons land bij het tot stand komen van reglementeringen en wetgeving inzake de werking van de arbeidsmarkt vergeten. Misschien was ze zelfs niet op de hoogte. De sociale partners steigerden voor het Rosetta-plan, zeker voor de eerste versie ervan. Mede onder hun druk werd de dirigistische aanpak - is dat de nieuwe politieke cultuur? - afgezwakt tot de tekst die ter stemming voorligt. Het zou tijd- en energiebesparend zijn geweest mocht de minister in de plaats van via de media de startbanen af te kondigen, onmiddellijk overleg hebben gepleegd met de sociale partners en misschien, waarom ook niet in het kader van de nieuwe politieke cultuur, met het parlement, in casu de commissie voor de Sociale Zaken. In het gejaag en de snelheid werd het helemaal hallucinant als op het einde van een drukke dag in de commissie, wij aanbelandden bij de bespreking van en de stemming over het laatste artikel. Wellicht omdat de regering dit amendement - mevrouw de minister, ik zou het in uw plaats ook niet hebben gedurfd - zelf niet durfde in te dienen, werd dit overgelaten aan de meerderheidsfracties. Deze dienden zonder gêne een amendement in dat ertoe strekt niet op 1 januari, maar pas op 1 april 2000 de startbanen te laten ingaan. Vermits de startbanen zowat de hoofdbrok van dit wetsontwerp ter bevordering van de werkgelegenheid vormen, was door dit uitstel tot 1 april 2000 geenszins de urgentie vereist voor de behandeling ervan. Men heeft dus de commissie voor de Sociale Zaken nodeloos voor slecht werk doen opdraaien. Dankzij de opmerkzaamheid van de CVP-fractie werden toch een aantal onvolkomenheden in dit wetsontwerp weggewerkt. Wij zien het als federale wetgever nog altijd als onze democratische plicht, ook vanuit de oppositie, mee te werken om degelijk wetgevend werk af te leveren. Degelijk parlementair en wetgevend werk moet primeren op de mediacultuur en de haast om snel te willen scoren, om snel een pluim op de hoed te kunnen steken, om een politiek palmares te kunnen bijeenschrijven. Deze rege- ring heeft, tot haar scha en schande, al enkele keren moeten vaststellen dat mediatiek en snel niet ongestraft samengaan met efficiënt. Deze wet zal de geschiedenis niet halen omwille van het gedegen wettelijk werk, noch omwille van de inhoud. Zo kom ik tot de inhoud van dit wetsontwerp. Het soortelijk gewicht van deze kaderwet is bijzonder laag. Drie vierde wordt ingenomen door de startbanen. De andere onderdelen zijn eerder intentieverklaringen dan nieuwe en concrete voorstellen. In het kader van de structurele lastenvermindering heeft de CVP steeds vooropgezet dat de loonlasten voor onze ondernemingen tot het gemiddelde van onze belangrijkste concurrentiepartners moeten worden gebracht. De CVP heeft de aanzet tot de politieke realisatie hiervan gegeven. Wij verwachten dat deze regering - en wij zullen er haar aan herinneren - tijdig de concrete resultaten inzake bijkomende tewerkstelling als gevolg van deze bijkomende structurele lastenverlaging aan het parlement zal voorleggen. Tijdens de bespreking in de commissie voor de Sociale Zaken diende de CVP een amendement in om ook de non-profitsector te laten meegenieten van de verhoogde structurele lastenverlaging. Wij blijven daarmee trouw aan onze visie die wij tijdens de vorige legislatuur concreet gestalte hebben gegeven. Het gegoochel met de cijfers zowel vanwege de regering als vanwege de meerderheidspartijen over meer en minder of gelijk zijn wij stilaan beu. Zowel Agalev als de SP, bij monde van de heren Wauters en Bonte, hebben verklaard dat er slechts een miniem verschil bestaat tussen datgene dat de non-profitsector krijgt en datgene wat de profitsector toebedeeld krijgt als loonlastenverlaging. De cijfers tonen aan dat de non-profitsector vanaf het tweede kwartaal van 2000 slechts dezelfde of een iets geringere loonkostenverlaging zal krijgen dan de profitsector. Zelfs indien deze verlaging niet echt kleiner is dan die van de profitsector, zal de non-profitsector vanaf het tweede kwartaal van 2000 de extra stimulans die zij de vorige legislatuur had gekregen ten opzichte van de commerciële sector vanaf 1999 moeten missen. De CVP blijft ervoor ijveren om de non-profitsector bijkomende middelen te geven omdat wij menen dat deze sector er recht op heeft. In de eerste plaats wordt elke frank loonlastenverlaging door de non-profitsector rechtstreeks omgezet in bijkomende tewerkstelling. Op die manier worden er ook tewerkstellingskansen geboden aan laaggeschoolden. Bovendien komt bijkomende tewerkstelling in de non-profitsector de kwaliteit van het leven en de optimalisering van de zorg ten goede, omdat zij leidt tot meer en betere verzorging en dienstverlening en tot het verlichten van de hoge werkdruk bij het verzorgend en dienstverlenend personeel. De CVP is uiteraard voorstander van een dergelijke invulling van het begrip actieve welvaartsstaat. Blijkbaar is dit slechts ijdele hoop. Arbeidsduurvermindering met behoud van loon is een oude socialistische wens. Juicht kameraden en burgers van dit land want het offensieve deel van deze eis, de arbeidsduurvermindering tot 32 uur met compenserende aanwervingen wordt verlengd! Normaal gezien komen enkel maatregelen die succesvol zijn, in aanmerking om te worden verlengd. Tot nu toe is voor het offensieve deel één dossier goedgekeurd en zijn er twee dossiers waarvan de procedure aan de gang is. Deze kaderwet bevat een klein, maar niet onbelangrijk punt over de sleepvaartsector. Tijdens de bespreking hebben wij de minister op de opmerking van de Raad van Staat aangaande het risico op eventuele kritiek van de Europese Commissie op de steun die het wetsontwerp aan de sleepvaartsector geeft, gewezen. De CVP heeft a priori niets tegen deze maatregel. In het verleden hebben sommige maatregelen ons echter zure oprispingen bezorgd omdat Europa in onvoldoende mate werd betrokken bij de beslissingen. De minister antwoordde hierop dat ze de maatregelen inmiddels heeft voorgelegd aan de Europese Commissie. Wij herhalen dat het beter was geweest het antwoord van Europa af te wachten alvorens de wet ter stemming aan het parlement voor te leggen. De minister heeft in de commissie voor de Sociale Aangelegenheden beloofd het antwoord te zullen bezorgen aan onze commissie. Het systeem van de startbanen is het koninginnenstuk van dit wetsontwerp. Zolang men ons geen andere teksten voorlegt, blijf ik erbij dat de startbanen niets anders zijn dan afgestofte stages. Helaas moeten alle nobele verklaringen over administratieve vereenvoudiging en transparantie wijken opdat ook in de zogezegde nieuwe politieke cultuur elke minister zijn of haar plan zou kunnen ontwerpen. Indien dit niet het geval was, zouden de positieve punten van het systeem van de startbanen probleemloos kunnen worden ingeschreven in de huidige stagewetgeving. Dit zou ons het voordeel hebben opgeleverd dat een bekende tewerkstellingsmaatregel kon blijven voortbestaan. Wij hadden dan geen nieuwe administratieve rompslomp moeten creëren en de positieve punten van de startbanen hadden correct kunnen worden ingepast in de stagewetgeving. De meeste nieuwigheden die het startbaanplan bevat ten overstaan van de huidige stagewetgeving onderschrijven wij ten volle. Wij steunen de volwaardige arbeidsovereenkomst die in de plaats van een stageovereenkomst wordt aangeboden, hoewel het verschil niet zo groot is. Dit kon echter ook binnen de stagewetgeving worden gerealiseerd. Wie zou de CVP zijn om zich ertegen te verzetten dat het loon van 90% op 100% wordt gebracht? Laten we echter duidelijk zijn. In de groeiperiode van de stages, van 1983 tot nu, werden in zeer veel paritaire comités en ondernemingen collectieve arbeidsovereenkomsten gesloten die reeds terecht een loon van 100% toekenden. Zoals dat voor veel wetten geldt, kon echter ook voor de stagewetgeving na een rijpingsperiode van een aantal jaren wat intussen op het terrein gegroeid was in de wet worden veralgemeend. Voorts wordt ook een vorm van opleiding ingeschreven in het startbaanplan. Samen met een aantal partijen die nu tot de meerderheid behoren, hebben wij in de vorige legislatuur reeds onderstreept dat toegang van jongere werklozen tot de arbeidsmarkt in Vlaanderen vrijwel onmogelijk wordt als dit niet gepaard gaat met de nodige opleiding en begeleiding. Voor ons is dit dus geen probleem maar in de aanzet hiertoe werd reeds voorzien in de huidige stagewetgeving. Mevrouw de minister, wij zeggen niet neen tegen de toegevoegde waarde van de startbanen in vergelijking met de huidige stagewetgeving. Wij merken echter wel op dat dit alles zeer eenvoudig via de stagewetgeving gerealiseerd kon worden, zonder daar veel poeha rond te maken. Wat nu aan de orde is, ligt duidelijk dichter bij de stagewetgeving dan het startbaanplan of het Rosettaplan zoals u dat aanvankelijk via de media bekendgemaakt hebt. Het zou wellicht moeilijker zijn geweest om dat Rosetta-plan in te passen in de stagewetgeving dan datgene wat nu voorligt, nu ook de sociale partners zijn gehoord.

During the discussion in the Social Affairs Committee, the CVP submitted an amendment to allow the non-profit sector to also benefit from the increased reduction of structural burden. Thus, we remain faithful to our vision, which we gave concrete form during the previous legislature. The bullshit with the numbers both because of the government and because of the majority parties about more and less or equal we are still tired. The figures show that from the second quarter of 2000, the non-profit sector will only receive the same or slightly lower reduction in wage costs than the profit sector. Even if this reduction is not really less than that of the profit sector, from the second quarter of 2000 the non-profit sector will have to miss the additional incentive it had received in the previous legislature compared to the commercial sector from 1999. The CVP continues to strive to provide additional resources to the non-profit sector because we believe that this sector has a right to it. First, every frank reduction in wage burden by the non-profit sector is directly converted into additional employment. This also provides employment opportunities for low-skilled people. Additional employment in the non-profit sector also contributes to the quality of life and the optimisation of care, as it leads to more and better care and services and to the alleviation of the high workload of the care and service staff. The CVP is of course in favour of such a fulfillment of the concept of active welfare state. Apparently, this is only idle hope. Reducing working hours with maintenance of wages is an old socialist desire. Congratulations to comrades and citizens of this country because the offensive part of this requirement, the reduction of working hours to 32 hours with compensatory hiring is extended! Normally only successful measures are eligible to be extended. So far, one file has been approved for the offensive part and there are two files for which the procedure is ongoing. This framework law contains a small, but not insignificant point on the tractor sector. During the discussion, we pointed out to the Minister the comment of the Council of State regarding the risk of any criticism by the European Commission on the support that the bill provides to the tractor sector. The CVP has a priori nothing against this measure. In the past, however, some measures have caused us to suck because Europe was insufficiently involved in the decisions. The Minister responded that she has already submitted the measures to the European Commission. We repeat that it would have been better to wait for Europe’s response before submitting the law to the parliament for voting. The Minister has promised in the Social Affairs Committee to provide the answer to our committee. The system of the start-up tracks is the queen-in-thing of this bill. As long as we are not presented with other texts, I continue to admit that the starting jobs are nothing but dusted stages. Unfortunately, all noble statements about administrative simplification and transparency must be discarded so that even in the so-called new political culture each minister could design his or her plan. If this was not the case, the positive aspects of the system of start-up tracks could be easily incorporated into the current internship legislation. This would have given us the advantage that a well-known employment measure could continue to exist. We should not have created a new administrative burden and the positive points of the start-up tracks could have been correctly incorporated into the internship legislation. Most of the innovations that the start-up road plan contains in the face of the current stage legislation, we fully endorse. We support the full-time employment contract offered instead of an internship agreement, although the difference is not so big. However, this could also be achieved within the stage legislation. Who would be the CVP to oppose bringing the 90% wage to 100%? However, let us be clear. During the growth period of the internships, from 1983 to now, in very many parity committees and enterprises collective agreements were concluded which already rightly granted a salary of 100%. However, as with many laws, after a maturing period of several years, what had grown in the field in the meantime could also be generalized in the law for the stage legislation. Together with a number of parties that now belong to the majority, we have already emphasized in the previous legislature that access of younger unemployed to the labour market in Flanders becomes virtually impossible if this is not accompanied by the necessary training and guidance. We do not say no to the added value of the start-up jobs compared to the current internship legislation. However, we note that all this could be realized very easily through the stage legislation, without much poeha around it. What is now in question is clearly closer to the stage legislation than the start-up plan or the Rosetta Plan as you initially announced it through the media. It might have been more difficult to incorporate that Rosetta plan into the internship legislation than what is now ahead, now that the social partners have also been heard.

Wij moeten echter vaststellen dat er in dit land in de loop der jaren een groep van werklozen tot stand is gekomen, die ofwel nog nooit heeft gewerkt, ofwel slechts voor zeer korte duur. Wat dit laatste betreft, denk ik dan aan uitzendarbeid of proefperiodes. Dan ga ik de discussie over de leeftijdsgrens nog uit de weg, namelijk of het om minder dan vijfentwintigjarigen dan wel om minder dan dertigjarigen gaat. Zoals ik in de commissie reeds heb gezegd, is het in de toekomst nodig voor deze groep onmiddellijk in te grijpen, zonder dat deze mensen maanden in de werkloosheid verzeild geraken. Dat is dan ook mijn kritiek op deze wetgeving. Voor de zoveelste keer laat men degenen die in het verleden niet aan boord geraakten, in de kou staan.

Als deze startbanen succes kennen, zullen wij in Vlaanderen inderdaad vrij vlug aan de tweede en derde schijf van deze jongeren toe zijn. Wat Wallonië en Brussel betreft, zal dit echter niet zo zijn. Spijtig genoeg is de groep van recent afgestudeerden daar nog veel groter, zodat wie al jaren achter het net vissen, ook in de toekomst het nakijken wordt gegeven. Dat ik gelijk heb, wordt bewezen door het feit dat deze startbanen met als vertrekdatum 1 april 2000 voor de eerste drie maanden, namelijk van april tot juli, wel vooruitzichten bieden. Het plan moet starten, er moet volk zijn om te kunnen beginnen. Degenen die in juli worden uitgesloten, mogen nu van april tot einde juni meewerken om het startbaanplan op gang te brengen. Dit is niet correct ten overstaan van die groep. Als men dus vraagt, mijnheer Bonte, of wij er iets tegen hebben dat men onmiddellijk met deze startbanen begint, zegt ik nee. Men zou deze mensen bijna de dag na hun inschrijving als werkzoekende positief moeten begeleiden. Daarmee heb ik geen moeite. Wij moeten hier de voor- en de nadelen van het begeleidingsplan niet opsommen. Ik vind het echter een menselijke - ik zeg nog niet politieke - vergissing de groep die om allerlei redenen niet aan de bak is gekomen, opnieuw uit de boot te laten vallen. Wij hebben een amendement ingediend om deze groep toch nog in het plan op te nemen, maar wij hebben het jammer genoeg niet gehaald. Wij zullen zien wat ervan komt. Ik herhaal nog eens, als Vlaming zou ik mij daarover minder zorgen moeten maken, dat ook deze groep die mij na aan het hart ligt, op korte termijn in aanmerking moet kunnen komen. Collega's, wij hebben een aantal amendementen ingediend. Een paar ervan werd met succes door ons verdedigd en door de minister aanvaard. De meeste amendementen werden echter het lot beschoren om meerderheid tegen oppositie te worden afgekeurd. Ik zal deze amendementen in de algemene bespreking niet toelichten. Een groot deel ervan hebben wij opnieuw ingediend in de plenaire vergadering, omdat ze geen tekstverbeteringen inhouden en evenmin tot doel hadden de datum van inwerkingtreding met twee dagen uit te stellen. Het zijn amendementen ten gronde, die zullen moeten toelaten deze wet op wetgevend vlak iets meer in evenwicht te brengen, zodat ze zonder kleerscheuren van toepassing kan worden. Mijnheer de voorzitter, mevrouw de minister, collega's, wij hadden eigenlijk verwacht - ik heb er geen moeite mee om dit toe te geven - dat deze kaderwet de invulling zou zijn geworden van een aantal maatregelen die wij reeds via de media aangekondigd kregen. Dit is niet het geval geweest, hoewel het een unieke gelegenheid was om te getuigen van snelheid en tegelijk efficiëntie. Het voorliggende wetsontwerp bevat een aantal positieve punten die ik niet wens te negeren, maar het koninginnenstuk waaraan dit wetsontwerp werd opgehangen en dat wij met haast en te grote spoed door de Commissie en door deze plenaire vergadering moesten jagen, had mits beter en langer overleg, bijgestuurd kunnen worden. De zin voor realiteit heeft de bovenhand gehaald. Ik houd hier dus zeker geen pleidooi voor het Rosetta-plan in zijn oorspronkelijke vorm. Mijnheer Bonte, ik heb willen zeggen dat men het initiële startbaanplan had kunnen ophangen aan de stagewetgeving. Men had zich de moeite kunnen besparen om alles te herschrijven, wat trouwens niet goed is gebeurd. Il conviendra dès lors de s'assurer que les efforts sur l'augmentation nette d'emplois soient bien réels et que des outils d'évaluation sérieuse et paritaire soient mis en place. Pareille évaluation est déjà organisée pour le Maribel social et prévue pour les emplois jeunes. Il faudra examiner avec la même attention l'ensemble des aides et, particulièrement, la réduction des charges structurelles bénéficiant principalement au secteur privé, qui se monte à près de 90 milliards pour l'an 2000. Il conviendra aussi de veiller à compenser les pertes occasionnées par les exonérations de sécurité sociale pour ne pas mettre en péril l'équilibre budgétaire de la sécurité sociale ni les principes de solidarité qui l'animent et les principes de gestion paritaire du système. Outre les aides au secteur privé, deux autres problématiques ont retenu l'attention du gouvernement: le nonmarchand et le chômage des jeunes. Pour le nonmarchand, le montant consacré au Maribel social est augmenté de fac¸on significative, mais ne répond pas encore suffisamment aux besoins de ce secteur. ECOLO-AGALEV est particulièrement attentif aux évolutions de ce secteur, car il répond prioritairement aux demandes de la population. Des efforts doivent être réalisés à terme pour y apporter des réponses budgétaires proportionnelles à l'importance du secteur en matière d'emploi. Pour les jeunes, bon nombre de collègues ont précédemment évoqué les problématiques du contrat d'emploi jeune et je pourrai donc être bref. Les demandeurs d'emploi, en particulier les moins qualifiés, sont visés par le plan, qui semble d'ailleurs constituer une bonne réponse. Mais il appartiendra au service de l'emploi de se montrer particulièrement vigilant pour éviter, comme dans le stage des jeunes, que les dérogations à l'obligation d'embauche n'amènent que la moitié des emplois escomptés. En outre, un renforcement des mesures d'accompagnement des jeunes les plus déstructurés et les moins qualifiés s'impose car, pour une catégorie du public, l'emploi n'apparaît pas comme la première réponse à apporter. Il ne faudrait pas que le droit au travail devienne une obligation de travail: cela serait préjudiciable tant pour le jeune que pour l'employeur. Un contrat présuppose le libre consentement des deux parties. - Président: M. Jean-Pol Henry, premier vice-président Enfin, d'autres pistes sont ouvertes dans le débat sur les lignes générales de la politique de l'emploi, pistes qui mériteraient un autre prolongement. J'en cite trois. La première, c'est l'aménagement et la réduction du temps de travail. Une somme de 200 millions est prévue au budget; elle sera largement insuffisante si l'on veut faire la promotion d'expériences collectives. Nous attendons donc avec impatience la loi-cadre prévue pour le printemps. Un deuxième point est le nouveau contrat ALE; c'est un héritage du passé, mais il entre en application le 1er janvier 2000. Il contrevient à la législation générale sur le contrat de travail. Il s'agira donc de se pencher rapidement sur une formule qui valoriserait mieux l'emploi dans de véritables services de proximité. Enfin, la mise à disposition de main-d'oeuvre fait l'objet aujourd'hui d'une pression importante de la Fédération des entreprises de Belgique (FEB), dans le cadre des négociations avec les partenaires sociaux et le gouvernement. Nous souhaitons opposer à ce qui est en fait une demande de flexibilité accrue la proposition inscrite dans la déclaration gouvernementale de développer les groupements d'employeurs. Nous n'en trouvons pas encore de trace dans votre projet de promotion de l'emploi. Madame la ministre, votre mission n'est pas simple. Il n'existe ni remède miracle ni potion magique qu'il suffirait d'agiter avant emploi pour régler le chômage structurel. Nous nous réjouissons cependant du plan de promotion de l'emploi du gouvernement. ECOLO-AGALEV soutiendra donc, sans réserves autres que celles qui viennent d'être évoquées, le projet de loi déposé parce qu'avec sa réussite, la vie de milliers de sans-emploi pourrait être changée. Nous resterons néanmoins très attentifs aux effets produits par les incitants à l'embauche et nous invitons le gouvernement à mettre en place tous les outils d'évaluation nécessaires. Nous réitérons aussi notre confiance dans le dialogue avec les partenaires sociaux sur tous ces sujets.

I thank you. In accordance with the commitments made in the Government Declaration, significant efforts are being made in the budget to promote employment. ECOLOAGALEV welcomes these initiatives by recalling that today, in addition to the 360,000 people registered as complete unemployed and compensated job seekers, ⁇ 600,000 other people have no or more real employment contracts. The total amount of reductions in social charges is raised this year to 130 billion, that is, twice the amount devoted to this position in 1998. It will therefore be necessary to ensure that efforts to increase net jobs are real and that serious and equal assessment tools are put in place. Such assessment is already organized for the Social Maribel and is planned for young jobs. All aid and, in particular, the reduction of the structural burden benefiting mainly the private sector, which amounts to almost 90 billion by the year 2000. It will also be necessary to ensure that the losses caused by exemptions from social security fees are compensated so as not to jeopardize the budgetary balance of social security, the principles of solidarity underlying it and the principles of parity management of the system. In addition to aid to the private sector, two other issues have caught the attention of the government: non-market and youth unemployment. For the non-market, the amount devoted to the social Maribel has increased significantly, but does not yet sufficiently meet the needs of this sector. Employment seekers, especially the less qualified, are targeted by the plan, which appears to be a good response. But it will be up to the Employment Service to be ⁇ vigilant to avoid, as in the youth internship, that derogations from the employment obligation bring only half of the expected jobs. Furthermore, it is necessary to strengthen measures to accompany the most disstructured and less skilled youth because, for a category of the public, employment does not appear to be the first response to be given. The right to work should not become a labor obligation: it would be detrimental to both the young and the employer. A contract presupposes the free consent of both parties. The President: Mr. Jean-Pol Henry, First Vice-President Finally, other paths are open in the debate on the general lines of employment policy, paths that would deserve another extension. I cite three. The first is the planning and reduction of working time. A sum of 200 million is provided in the budget; it will be largely insufficient if we want to promote collective experiences. Therefore, we look forward to the Framework Law planned for spring. A second point is the new ALE contract; it is a legacy from the past, but it comes into force on 1 January 2000. It is contrary to the general legislation on the employment contract. It will therefore be a matter of looking quickly at a formula that would better value employment in real proximity services. Finally, the availability of labour is now subject to significant pressure from the Federation of Businesses of Belgium (FEB), as part of the negotiations with the social partners and the government. We would like to oppose what is actually a demand for increased flexibility to the proposal contained in the government statement to develop employer groups. We do not yet find any trace of this in your employment promotion project. Your mission is not easy. There is no miracle remedy or magic potion that would be enough to shake before employment to settle structural unemployment. However, we welcome the government’s employment promotion plan. ECOLO-AGALEV will therefore support, without reservations other than those just mentioned, the bill deposited because with its success, the lives of thousands of unemployed could be changed. However, we will remain very attentive to the effects of employment incentives and we call on the government to put in place all the necessary evaluation tools. We also reiterate our confidence in the dialogue with the social partners on all these topics.

Mijnheer de voorzitter, mevrouw de minister, collega's, het voorliggende wetsontwerp heeft tot doel het pakket tewerkstellingsmaatregelen te versterken en efficiënter te maken en een aantal nieuwe initiatieven te nemen uit te voeren. Vooreerst wens ik duidelijk te zeggen dat wij onze steun verlenen aan de bijkomende structurele lastenverlaging ten bedrage van 24,2 miljard frank en eveneens aan de intentie van de regering om de bestaande reglementering inzake de sociale Maribel te vereenvoudigen en transparanter te maken. Het hoofddoel van de maatregel - het scheppen van bijkomende werkgelegenheid - kan aldus via een volledige herinvestering van de middelen die vrijkomen ingevolge lastenverlagingen, beter tot zijn recht komen. Het is de bedoeling een aantal tewerkstellings- maatregelen, zoals het plus één-plus-twee, plus-drieplan, aan te passen. In dat verband wens ik op te merken dat het tijd is om alle bestaande tewerkstellingsmaatregelen- en plannen, aan een grondige evaluatie te onderwerpen en na te gaan of de resultaten van alle maatregelen wel overeenstemmen met de oorspronkelijke doelstellingen. Immers, een inflatie op dat vlak zal de transparantie en de efficiëntie op de arbeidsmarkt zeker niet bevorderen. In dat verband zal ik trouwens uw aandacht vestigen op een aantal perverse neveneffecten die het gevolg kunnen zijn van een dergelijk gesubsidieerde tewerkstelling. Ten eerste, het mogelijke nul-effect, wat inhoudt dat ondernemingen, ook zonder overheidssteun, sowieso personen aanwerven als het productieproces dit vereist. Ten tweede, het substitutie-effect, waarbij de onderneming enkel en precies tot die aanwervingen overgaat die leiden tot belastingverlaging, terwijl de vacatures anders door andere personen zouden zijn ingevuld. In dat verband is het overigens verre van ondenkbaar dat laaggeschoolden in de plaats van hooggeschoolden worden aangeworven voor functies die eigenlijk beter worden uitgevoerd door de laatste categorie. Dit komt de efficiëntie van de organisatie van de individuele bedrijven en van de economie in het algemeen zeker niet ten goede en kan bovendien nefast zijn voor de kwaliteit van de arbeid. Fundamenteel is dan ook de opmerking dat de voorbije jaren reeds tal van banenplannen uit de grond werden gestampt, waarvan het resultaat eerder teleurstellend bleek te zijn. In dat verband citeer ik volgende passage uit een vrije tribune, van Marc Andries van de studiedienst van het VEV: Sinds het uitbreken van de werkgelegenheidscrisis in de jaren zeventig en er in ons land en in heel Europa tal van banenplannen voor jongeren werden gelanceerd waarvan het succes sterk moet gerelativeerd worden... . De OESO komt op dat vlak tot het besluit dat de meeste banenplannen niet erg succesvol waren. Welnu, het lijkt mij ondenkbaar dat de regering niet op de hoogte zou zijn van dergelijke analyses of er geen rekening mee zou houden. Ondanks dit alles, stellen wij vast dat er een nieuw banenplan wordt gecreëerd op maat van de jongeren en vooral op maat van Wallonië. De startbanen of het plan-Onkelinx krijgt heel wat aandacht in het wetsontwerp. Zij zijn echter - gelukkig - een sterk afgezwakte vorm van het oorspronkelijke Rosetta-plan van minister Onkelinx, dat terecht veel deining veroorzaakte in de sector omwille van het centralistische en dirigistische karakter ervan. Deze maatregel, op maat geknipt voor de Waalse werkloosheid, hield geen rekening met de sociaal-economische realiteit in Vlaanderen en de verschillende gewesten. Het plan werd dan ook terecht afgeschoten, niet alleen door de sociale partners, maar door bijna alle partijen in dit halfrond. Slechts nadat premier Verhofstadt het dossier naar zich toe trok, zijn minister terugfloot en het plan ernstig afzwakte, verminderde de kritiek vanwege de sector. Wij zijn echter van mening, en zullen die houding in de toekomst niet wijzigen, dat ook dit afgezwakte plan vooral tegemoetkomt aan de verzuchtingen in Wallonië. In Wallonië is één jongere op drie werkloos, terwijl dat cijfer in Vlaanderen heel anders is, namelijk één op tien. Men heeft uit het verleden dus blijkbaar geen lessen getrokken. Ik verwijs in dat verband nog maar eens naar de moeilijkheden die zijn gerezen bij de implementatie van het federale begeleidingsplan. Dit plan verplichtte de gewestelijke arbeidsbemiddelingsdiensten om met elke jongere die zes maand werkloos is, een overeenkomst te sluiten over zijn begeleiding, opleiding en inschakeling in het arbeidsproces. De VDAB heeft in Vlaanderen de grootste moeite om de bewuste doelgroep te bereiken, daar deze in ons gewest nu eenmaal beperkt is. Nu wil men de bedrijven verplichten om voor een bepaald percentage van het personeelsbestand werknemers in dienst te nemen die tot bijna dezelfde categorie behoren. Zoals reeds gezegd, is de jeugdwerkloosheid vooral een Waalse aangelegenheid. Men kiest dus voor een Belgische oplossing om aan een Waals probleem tegemoet te komen, zoals het VEV terecht opmerkte. Om alsnog de schijn te wekken dat men rekening houdt met de regionale verschillen, heeft men dan het cascadesysteem ingevoerd. Er zijn in eerste instantie de startbanen bedoeld voor jongeren onder de 25 jaar die nog geen zes maand de school hebben verlaten, nadien komen alle jongeren onder de 25 jaar. De volgende groep zijn de jongeren onder de dertig jaar en de Koning kan bovendien nog nieuwe categorieën in het leven roepen wanneer dit noodzakelijk zou zijn. In Vlaanderen zal de overschakeling van de ene groep tot een veel ruimere groep vlug een feit zijn, waardoor de absurde situatie kan ontstaan dat er zoveel voor de regeling in aanmerking zullen komen dat het nuleffect ten volle zal spelen. Bovendien kan men zich afvragen in welke mate de jongeren van de derde en eventueel volgende categorie nog jongeren zijn die passen in de bedoeling van het startbaanplan, namelijk de tewerkstelling zo vlug mogelijk laten aansluiten bij de studies. Dit bewijst eens te meer dat het niet langer houdbaar is om voor Vlaanderen en Wallonië eenzelfde sociaal, economisch en werkgelegenheidsbeleid te voeren. Dat is niet goed voor Vlaanderen, maar evenmin voor Wallonië. Dit vraagt een gedifferentieerde aanpak die door de Gewesten en de Gemeenschappen moet worden opgezet. De totale overheveling van deze bevoegdheden naar de Gemeenschappen en de Gewesten is dan ook in eenieders belang. Zo ontstaan homogene bevoegdheidspakketten waarbij opleiding en tewerkstelling beter op elkaar kunnen worden afgestemd en waarbij in de verschillende gewesten zelf kan worden bepaald voor welke specifieke doelgroep bijzondere maatregelen moeten worden genomen. Zo zou men in Vlaanderen de inspanningen beter kunnen concentreren op de omvangrijke groep van oudere werklozen want dat is in Vlaanderen een groter probleem dan de jongerenwerkloosheid. Statistisch gezien bestaan die oudere werklozen niet. Ze tellen letterlijk en figuurlijk niet meer mee. Dit verklaart mede de frustratie bij deze categorie die zich meer en meer in de steek gelaten voelt. Door dit startbaanplan wordt hun positie op de arbeidsmarkt er niet bepaald beter op. Er zal immers ongetwijfeld een verdringingseffect optreden. Er zouden meer maatregelen moeten worden genomen om deze groep opnieuw in te schakelen in de arbeidsmarkt, zoniet gaat onschatbare ervaring verloren of wordt ze niet meer gebruikt. Bovendien zijn er in bepaalde sectoren of voor bepaalde beroepen nu reeds tekorten die niet door jongeren kunnen worden ingevuld omdat zij niet over de nodige vorming of opleiding beschikken. Het Vlaams Blok is er dan ook van overtuigd dat er vooral op het vlak van de vorming aanzienlijke inspanningen moeten worden geleverd zodat er op de vraag van de arbeidsmarkt efficiënter kan worden ingespeeld. Het is niet door de bedrijven te verplichten om jongeren in dienst te nemen dat men voor dit soort problemen een oplossing biedt. Wij zijn het met Tony Vandeputte van het VBO dan ook eens dat jobs niet bij wet kunnen worden gecreëerd. Dit startbaanplan legt de particuliere sector wel omlijnde verplichtingen op, namelijk 3% van het personeelsbestand, terwijl men voor de overheid alles wel bij koninklijk besluit zal regelen. De overheid zou toch het goede voorbeeld moeten geven. Deze verplichting zal in de praktijk in het grote deel van de gevallen leiden tot tijdelijke startbanen - en dat is zeker niet de bedoeling waardoor jongeren na een jaar werk opnieuw in de werkloosheid terechtkomen en blijven omdat ze niet over de vereiste opleiding beschikken. Een vraaggerichte aanpak biedt dan ook meer uitzicht op duurzame en structurele tewerkstelling dan een centralistische, dirigistische aanpak. Het Vlaams Blok betreurt dat dit wetsontwerp onvoldoende aandacht besteedt aan mogelijkheden om langere tijd uit de arbeidsmarkt te treden voor de opvoeding van de kinderen. De keuzevrijheid van het gezin wordt op dit ogenblik sterk beperkt door de grote financiële gevolgen ervan. De meeste gezinnen kunnen zich een dergelijke keuze niet veroorloven. Een meer gezinsvriendelijk beleid is dringend nodig. Het Vlaams Blok zal het wetsvoorstel tot invoering van het opvoedersloon opnieuw indienen. Dit voorstel biedt de gezinnen de mogelijkheid uit de arbeidsmarkt te treden voor de opvoeding van de kinderen. Het financieel verlies blijft beperkt. Met ons wetsvoorstel willen we de gezinnen de absolute keuzevrijheid geven om te kiezen tussen werken of opvoeding van de kinderen. Mijnheer de voorzitter, mevrouw de minister, het Vlaams Blok is en blijft voorstander van een gedecentraliseerd en flexibel tewerkstellingsbeleid dat helemaal gestuurd wordt door de Gemeenschappen en de Gewesten. Een dergelijk tewerkstellingsbeleid komt beter tegemoet aan de regionale noden en kiest resoluut voor een vraaggerichte aanpak in de plaats van een dirigistische aanpak met verplichte opleidingen en aanwervingen die het vrije ondernemerschap bemoeilijken. Mijnheer de voorzitter, het Vlaams Blok zal het voorliggende wetsontwerp niet goedkeuren.

Mr. Speaker, Mrs. Minister, colleagues, the present bill aims to strengthen and make the package of employment measures more efficient and to implement a number of new initiatives. First of all, I would like to make it clear that we support the additional structural burden reduction of 24.2 billion francs as well as the Government’s intention to simplify and make more transparent the existing regulations on the social Maribel. The main objective of the measure – creating additional employment – can thus be better achieved by fully reinvesting the resources released as a result of burden reductions. It is intended to adjust a number of employment measures, such as the plus one plus two, plus three plan. In this context, I would like to point out that it is time to undergo a thorough evaluation of all existing employment measures and plans and to verify whether the results of all measures correspond to the original objectives. After all, inflation at that level will ⁇ not promote transparency and efficiency in the labour market. In that context, I will, by the way, draw your attention to a number of perverse side effects that may result from such subsidised employment. First, the possible zero-effect, which means that companies, even without government aid, in any case hire people if the production process requires it. Second, the substitution effect, in which the enterprise only and precisely moves to those recruitments that lead to tax reduction, while the vacancies would otherwise have been filled by other persons. In that regard, it is far from unthinkable that low-skilled persons are recruited instead of high-skilled persons for functions that are actually performed better by the latter category. This ⁇ does not benefit the efficiency of the organization of the individual enterprises and of the economy in general, and can also be detrimental to the quality of labour. It is therefore fundamental to note that in recent years many employment plans have already been struck off the ground, the outcome of which appeared to be rather disappointing. In this regard, I quote the following passage from a free tribune, by Marc Andries of the Study Service of the VEV: Since the outbreak of the employment crisis in the 1970s, in our country and throughout Europe, numerous employment plans for young people have been launched, the success of which must be highly relative... and . In this regard, the OECD comes to the conclusion that most employment plans were not very successful. Well, it seems unthinkable to me that the government would not be aware of such analyses or would not take them into account. Despite all this, we note that a new job plan is being created tailor-made to the youth and especially tailor-made to Wallonia. The start-up tracks or the plan-Onkelinx gets a lot of attention in the bill. However, they are – fortunately – a heavily weakened form of the original Rosetta plan of Minister Onkelinx, which rightly caused a lot of depression in the sector because of its centralist and dirigist character. This measure, tailored to the Wallish unemployment rate, did not take into account the socio-economic reality in Flanders and the various regions. The plan was therefore rightly rejected, not only by the social partners, but by almost all parties in this hemisphere. Only after Prime Minister Verhofstadt drew the file to himself, his minister floated back and the plan severely weakened, decreased criticism due to the sector. However, we are of the opinion, and will not change this attitude in the future, that this weakened plan also addresses in particular the aspirations in Wallonia. In Wallonia, one in three young people are unemployed, while in Flanders that figure is very different, namely one in ten. Apparently, no lessons have been learned from the past. In this context, I would like to refer once again to the difficulties that have arisen in the implementation of the federal supervisory plan. This plan required the regional employment intermediation services to conclude an agreement with every young person who has been unemployed for six months on his guidance, training and involvement in the labour process. The VDAB in Flanders has the greatest difficulty in reaching the conscious target group, since it is limited in our region. Now, it is intended to require companies to employ workers for a certain percentage of the workforce that belong to almost the same category. As already mentioned, youth unemployment is primarily a Walloon issue. Therefore, a Belgian solution is chosen to address a Waals problem, as the VEV correctly noted. To make it seem that the regional differences are taken into account, the cascade system has been introduced. Initially, the start-up jobs are intended for young people under the age of 25 who have not left school for six months, then all young people under the age of 25 will come. The next group are young people under the age of thirty, and the King can also create new categories if necessary. In Flanders, the switch from one group to a much wider group will soon become a fact, leading to the absurd situation that so many will be eligible for the scheme that the zero effect will play in full. Furthermore, it can be questioned to what extent the young people of the third and possibly next category are still young people who fit the purpose of the start-up career plan, namely to allow employment to be incorporated into the studies as soon as possible. This proves once again that it is no longer sustainable to pursue the same social, economic and employment policies for Flanders and Wallonia. This is not good for Flanders, but neither for Wallonia. This requires a differentiated approach to be adopted by the Regions and the Communities. The total transfer of these powers to the Communities and the Regions is therefore in the interests of all. This creates homogeneous competence packages that allow for better coordination between training and employment and allow the different regions themselves to determine for which specific target group special measures should be taken. In Flanders, for example, efforts could be better concentrated on the large group of older unemployed, as this is a bigger problem in Flanders than youth unemployment. Statistically, these older unemployed do not exist. They no longer count literally and figuratively. This explains the frustration in this category that feels more and more abandoned. This start-up career plan will ⁇ not improve their position in the labour market. After all, there will undoubtedly be a displacement effect. More measures should be taken to reintegrate this group into the labour market, otherwise invaluable experience will be lost or ceased to be used. In addition, in certain sectors or for certain professions, there are already shortages that cannot be filled by young people because they do not have the necessary training or training. The Flemish Bloc is therefore convinced that significant efforts should be made, especially in the field of training, in order to respond more efficiently to the demand of the labour market. It is not by obliging companies to hire young people that a solution to this type of problem is offered. We agree with Tony Vandeputte of the VBO that jobs cannot be created by law. This start-up plan imposes limited obligations on the private sector, namely 3% of the workforce, while for the government everything will be arranged by royal decree. Government should be a good example. This obligation will in practice in the vast majority of cases lead to temporary start-up jobs – and that is ⁇ not the purpose of bringing young people back into unemployment after a year of work and remain because they do not have the required training. A demand-oriented approach therefore offers more prospects for sustainable and structural employment than a centralistic, dirigist approach. The Flemish Blok regrets that this bill does not pay sufficient attention to the possibilities of leaving the labour market for a longer period for the education of the children. The family’s freedom of choice is currently heavily limited by its large financial consequences. Most families cannot afford such a choice. A more family-friendly policy is urgently needed. The Vlaams Blok will submit the bill to introduce the educational salary. This proposal provides families with the opportunity to step out of the labour market for the education of their children. The financial loss remains limited. With our bill, we want to give families the absolute freedom to choose between work or raising their children. The Flemish Bloc is and continues to advocate a decentralized and flexible employment policy that is guided entirely by the Communities and the Regions. Such employment policies better respond to regional needs and resolutely opt for a demand-oriented approach rather than a conductive approach with mandatory training and recruitment that hampers free entrepreneurship. The Flemish Bloc will not approve the present bill.

Monsieur le président, madame la ministre, chers collègues, je voudrais m'inspirer des remarques que notre collègue du groupe Ecolo a formulées il y a quelques instants et par lesquelles il entendait considérer la brièveté ou la synthèse comme un handicap. Chers collègues, pour ma part, j'ai été éduqué dans un système dans lequel on cultivait cela comme un avantage. J'espère dès lors que nous pourrons peut-être dans un instant partager au moins cela, même si par ailleurs, les contraintes de la vie politique nous opposent sur le plan des idées. Je ne peux évidemment, au nom de mon groupe, que souscrire à une politique de l'emploi qui aurait pour fondement premier l'augmentation du taux de l'emploi dans notre société. Nous savons tous combien est bénéfique cette augmentation de l'emploi pour l'ensemble de la société, non seulement par la richesse qu'elle crée, par le statut social qu'elle confère à ses bénéficiaires, mais aussi par les conséquences qu'elle comporte sur l'augmentation du niveau de vie ou la répartition des revenus. De manière générale, l'on ne peut qu'affirmer que pareille politique poursuit évidemment un objectif louable; et ce dernier ne le sera d'ailleurs que d'autant plus - et là, je trouve que l'on en parle un peu trop peu dans les cénacles du gouvernement - pour l'avenir du système de la sécurité sociale lorsque nous devrons faire face aux conséquences des chocs démographiques dans les quelques décennies à venir. Néanmoins, ce plan, tant attendu, tellement annoncé, reconfirmé, discuté, rediscuté et finalement présenté aujourd'hui dans sa version finale, ne contient que des mesures - et je suis contraint de réitérer la remarque que notre groupe a déjà formulée à l'encontre d'autres politiques proposées par le gouvernement en d'autres domaines - qui s'inscrivent à nouveau dans une grande continuité avec des projets déjà amorcés par le gouvernement précédent, ce qui, du reste, est fort normal étant donné que chaque gouvernement souhaite mettre l'accent sur cette problématique particulière que constituent l'emploi des jeunes et le Maribel social. C'est par ailleurs sur ces deux seuls sujets que je désire faire porter mon intervention d'aujourd'hui. En ce qui concerne la convention de premier emploi pour les jeunes, cette mesure n'est, selon notre groupe, assurément point originale: elle s'inscrit dans la ligne d'action déjà mise en oeuvre par le passé à travers, notamment, le Plan d'action belge pour l'emploi, que le gouvernement précédent avait élaboré et dont mon parti défendait déjà les orientations principales, à savoir la priorité à accorder aux jeunes, et singulièrement aux moins qualifiés, à partir du sixième mois de chômage. D'un point de vue général, il apparaît en outre légitime de se demander s'il est réellement opportun de mettre fin à un système qui fonctionne actuellement sans atteinte au budget de la sécurité sociale, à savoir le système mis en vigueur par l'arrêté royal 230, et de le remplacer par un nouveau système qui se révélera plus coûteux, car accordant des réductions de cotisations sociales sans prévoir aucun financement alternatif. A cet égard, je m'associe à la remarque soulevée il y a quelques instants par notre collègue, par laquelle il manifestait sa crainte concernant l'avenir du financement de la sécurité sociale et affirmait la nécessité de prévoir un financement alternatif. Quoi qu'il en soit, force est de constater que nous sommes en tout cas aujourd'hui très loin des ambitions que semblait présenter le projet initial, à savoir une refonte complète de l'ensemble des dispositifs en faveur de l'emploi des jeunes dans un plan unique qui aurait prévu l'obligation d'embauche d'un jeune à concurrence de 25 travailleurs occupés. Cela m'amène à dire - en me permettant l'utilisation d'une formule du langage familier que le projet présenté aujourd'hui par le nouveau gouvernement apparaît davantage comme un lifting du régime du stage des jeunes. Pour preuve, ce nouveau projet a d'ailleurs repris les sanctions financières en cas de non-respect de l'obligation d'engager 3% de jeunes. Si l'objectif est louable et conforme à la première priorité dégagée en novembre 1997 au Sommet européen de Luxembourg sur l'emploi, ce qui me préoccupe, c'est que la formule adoptée risque de signifier, malgré sa continuité affichée, une rupture avec la politique antérieure. Car si les partenaires sociaux et Mme la ministre, ainsi qu'ils en ont exprimé le voeu, ne souhaitent pas détricoter les conventions conclues et aboutir à ce que le nouveau plan efface les bénéfices de l'ancien, il faut tenir compte des mesures existantes et assurer la cohérence avec ces mesures, ce qui est loin d'être assuré. J'en veux pour exemple - mais peut-être pourrons-nous justement obtenir à ce sujet des précisions du gouvernement - que l'articulation du Plan premier emploi avec le plan d'accompagnement , en amont, et les diverses mesures fédérales et communautaires ou régionales en faveur de l'emploi, en aval, est loin d'être claire. Ainsi, où en sont les accords de coopération avec les communautés et les régions? Quelles sont les formations prévues? A l'heure actuelle, les seules formations qui existent et qui fonctionnent sont celles prévues par l'arrêté royal n°495 (convention emploi-formation) et les contrats d'apprentissage. Plus fondamentalement, il nous paraît peu raisonnable de lancer la convention de premier emploi alors même que le nouveau plan d'accompagnement n'est pas encore tout à fait opérationnel et que, surtout, aucune évaluation n'en a encore été réalisée jusqu'à présent. Nous aimerions dès lors savoir quand aura lieu cette évaluation. Car, à mon sens, sans cette évaluation, il me paraît impossible d'estimer la pertinence réelle de la mesure coûteuse qui est lancée en lieu et place du stage des jeunes. Je serai en tout cas particulièrement attentif - et je ne serai pas le seul - à l'évaluation qui sera faite de la mesure convention de premier emploi par le Conseil national du travail et le Conseil central de l'économie, en ce qui concerne l'objectif global de 4% pour l'ensemble des entreprises. En effet, il s'agit à l'heure actuelle d'un objectif général d'embauche et non, alors qu'on l'avait annoncé, d'une obligation d'embauche individuelle. Je voudrais surtout mettre l'accent sur mon deuxième point qui est le Maribel social. Nous avons du mal à suivre les chiffres proposés par le gouvernement, qui nous paraissent confus: dans l'exposé général du budget des recettes et des dépenses pour l'année budgétaire 2000, on cite le chiffre de 11,2 milliards de francs de réductions de cotisations sociales mais nous trouvons un montant de 12,5 milliards de francs dans la note de politique générale Emploi. Nous aimerions mieux comprendre d'où vient cette différence entre les deux montants. L'évaluation du montant global des réductions obtenues sous le Maribel social 1, 2 et 3 est, en tout état de cause, sous-estimée par le gouvernement puisqu'elle ne tient pas compte de l'augmentation de deux secteurs: - le secteur public qui fait l'objet d'un régime distinct et dont les montants sont gérés directement par l'ONSSAPL; on sait que ce secteur a été en augmentation très forte depuis le 1er janvier 1999, le budget a pratiquement doublé; - le secteur des ateliers protégés qui bénéficie également d'un régime particulier. Si l'on tient compte du Maribel social, secteur privé, secteur public et ateliers protégés, le montant global des réductions avoisinerait les 13,5 milliards, dont il faudrait tenir compte pour le budget 2000. Nous notons que le gouvernement promet ensuite un accroissement de 1,5 milliard pour le budget 2000. S'agit-il d'un réel budget supplémentaire par rapport à la programmation initiale ou s'agit-il d'un supplément de budget 2000 par rapport à 1999, qui serait dû au fait que le montant du Maribel social a augmenté au 1er juillet 1999? Le montant des réductions de cotisations sociales est passé de 6 500 à 9 750 francs par trimestre à partir du 1er juillet 1999. En outre, le montant de 1,5 milliard prévu en sus par le gouvernement actuel ne respecte pas les engagements pris en 1998 par le gouvernement précédent qui avait assuré les secteurs concernés par le Maribel social d'une augmentation budgétaire de 2,2 milliards en 1999 et de 2,2 milliards également en 2000. Par ailleurs, le gouvernement actuel accorde, pour l'an 2000, une aide complémentaire dans le cadre des réductions de cotisations sociales patronales de l'ordre de 24,2 milliards. Si l'on fait de l'arithmétique, 12% de cet avantage complémentaire devrait revenir au secteur non marchand puisque cela correspond au pourcentage d'emplois occupés dans ce secteur par rapport à l'emploi total. Si l'on tient compte des besoins et des impératifs du secteur, au total 18,6 milliards devraient donc être consacrés au secteur non marchand dans le cadre du Maribel social, ce qui est très différent de ce qui est prévu actuellement. En conclusion, je réitère mon souci - déjà exprimé avant moi - d'éviter que toutes ces mesures ne se traduisent par des dérapages budgétaires en matière de financement de la sécurité sociale, ainsi que par un manque à gagner pour le secteur non marchand, pourtant premier promoteur d'emplois.

Dear colleagues, for my part, I was educated in a system in which this was cultivated as an advantage. I therefore hope that, ⁇ in a moment, we will be able to share at least this, even though, in other words, the constraints of political life oppose us on the plane of ideas. I can obviously, on behalf of my group, only subscribe to an employment policy that would have as its primary basis the increase in the employment rate in our society. We all know how beneficial this increase in employment is for society as a whole, not only by the wealth it creates, by the social status it confers to its beneficiaries, but also by the consequences it has on the increase in living standards or the distribution of income. In general, one can only say that such a policy obviously pursues a praiseworthy goal; and the latter will only be so much more — and there, I find that it is spoken a little too little in government cenacles — for the future of the social security system when we will have to face the consequences of demographic shocks in the next few decades. Nevertheless, this plan, long-awaited, so much announced, re-confirmed, discussed, re-discussed and finally presented today in its final version, contains only measures – and I am forced to reiterate the comment that our group has already formulated against other policies proposed by the government in other fields – which are once again in a great continuity with projects already initiated by the previous government, which, besides, is quite normal given that each government wants to emphasize this particular problem that constitutes youth employment and the social Maribel. It is on these two topics that I would like to address today’s speech. As regards the first employment agreement for young people, this measure is ⁇ not, according to our group, an original point: it is part of the line of action already implemented in the past through, in particular, the Belgian Action Plan for Employment, which the previous government had drawn up and of which my party already defended the main guidelines, namely the priority to be given to young people, and in particular to the least qualified, from the sixth month of unemployment. From a general point of view, it also appears legitimate to ask whether it is really appropriate to end a system that currently operates without infringing the social security budget, namely the system enacted by Royal Decree 230, and to replace it with a new system that will prove to be more costly, because granting reductions of social contributions without providing any alternative financing. In this regard, I join with the comment made a few moments ago by our colleague, in which he expressed his concerns about the future of social security financing and affirmed the need to provide for alternative financing. In any case, it should be noted that we are in any case now very far from the ambitions that seemed to present in the initial project, namely a complete redesign of all the arrangements for the employment of young people into a single plan that would have provided for the obligation of hiring a young person at the expense of 25 occupied workers. This leads me to say - by allowing me to use a formula of familiar language that the project presented today by the new government appears more like a lifting of the youth internship regime. As proof, this new project has also taken back financial sanctions in case of non-compliance with the obligation to employ 3% of young people. While the objective is praiseful and consistent with the first priority outlined in November 1997 at the European Summit on Employment in Luxembourg, what I worry about is that the formula adopted may mean, despite its displayed continuity, a break with the previous policy. For if the social partners and the Minister, as they have expressed their wish, do not wish to destroy the agreements concluded and result in the new plan erasing the benefits of the old, we must take into account existing measures and ensure coherence with these measures, which is far from being assured. I mean for example – but ⁇ we will just be able to get government clarifications about this – that the articulation of the First Employment Plan with the accompanying plan, up, and the various federal and community or regional measures for employment, down, is far from clear. So, where are the cooperation agreements with communities and regions? What are the planned training? Currently, the only formations that exist and operate are those provided for by Royal Decree No. 495 (employment-training convention) and learning contracts. More fundamentally, it seems unreasonable to launch the First Employment Agreement even though the new accompanying plan is not yet fully operational and, above all, no evaluation has been made so far. We would therefore like to know when this evaluation will take place. For, in my opinion, without this assessment, it seems to me impossible to estimate the actual relevance of the costly measure that is launched instead of the youth internship. In any case, I will be ⁇ attentive – and I will not be the only one – to the assessment that will be made of the measure of the first employment agreement by the National Labour Council and the Central Council of Economy, with regard to the overall target of 4% for all companies. In fact, it is currently a general target of hiring and not, as it was announced, an individual hiring obligation. I would like to emphasize my second point, which is the social Maribel. We find it difficult to follow the figures proposed by the government, which seem confusing to us: in the general report of the budget of revenue and expenditure for the financial year 2000, the figure of 11.2 billion francs of reductions of social contributions is cited, but we find an amount of 12.5 billion francs in the general policy note Employment. We would like to better understand where this difference between the two amounts comes from. The assessment of the total amount of the reductions obtained under the Social Maribel 1, 2 and 3 is, in any case, underestimated by the Government since it does not take into account the increase of two sectors: - the public sector which is subject to a separate scheme and whose amounts are managed directly by the ONSSAPL; it is known that this sector has been in very strong increase since 1 January 1999, the budget has virtually doubled; - the sector of protected workshops which also benefits from a particular scheme. If the social Maribel, private sector, public sector and protected workshops are taken into account, the total amount of the reductions would be approximately 13.5 billion, which should be taken into account for the 2000 budget. We note that the government then promises an increase of 1.5 billion for the 2000 budget. Is this a real additional budget compared to the initial programming or is it a 2000 budget supplement compared to 1999, which would be due to the fact that the amount of the Social Maribel increased on 1 July 1999? The amount of reductions in social contributions increased from 6,500 to 9 750 francs per quarter from 1 July 1999. Furthermore, the amount of 1.5 billion planned by the current government does not comply with the commitments made in 1998 by the previous government which had assured the sectors concerned by the Social Maribel of a budget increase of 2.2 billion in 1999 and 2.2 billion also in 2000. In addition, the current government provides, for the year 2000, a supplementary aid within the framework of the reductions of employee social contributions of the order of 24.2 billion. If we do the arithmetic, 12% of this additional benefit should return to the non-market sector as this corresponds to the percentage of jobs occupied in that sector compared to the total employment. If the needs and imperatives of the sector are taken into account, a total of 18.6 billion should therefore be devoted to the non-market sector under the Social Maribel, which is very different from what is currently planned. In conclusion, I reiterate my concern – already expressed before me – to prevent all these measures from resulting in budgetary deviations in the financing of social security, as well as in a lack of profit for the non-market sector, yet the main promoter of jobs.

Mijnheer de voorzitter, mevrouw de minister, net als collega D'Hondt heb ik kritiek op de wijze waarop wetsontwerpen door de Kamer worden gejaagd. Gedurende heel de maand oktober hebben de parlementsleden niets te doen gehad behalve de ministers in de diverse commissies vragen te stellen over hun intenties. Op 1 november werd het eerste wetsontwerp van de regering, namelijk de dioxinewet, ingediend. Vanaf dan werd de zweep erop gelegd. De leden van de betrokken commissie moesten zelfs het Allerheiligenverlof opofferen terwijl de ministers rustig op vakantie konden. Ze moesten het wetsontwerp die week in de commissie behandelen zodat de Kamer het een week later kon goedkeuren. We maken ons zorgen om het wetgevend werk dat hier wordt geleverd. In het laatste weekend nog kregen we teksten en verslagen die moesten worden gecorrigeerd en onmiddellijk moesten worden teruggestuurd. Ook dit wetsontwerp moest zo snel worden goedgekeurd dat de regering op een bepaald ogenblik vergeten was om over een idee als de startbanen de sociale partners te raadplegen. In België komt de reglementering inzake de werking van de arbeidsmarkt tot stand via een overleg tussen vertegenwoordigers van de werkgevers en de werknemers. De sociale partners steigerden aanvankelijk bij de eerste uittekening van het Rosetta-plan. Na diverse contacten hebben ze zich dan toch min of meer kunnen inschrijven in het tweede voorstel van de startbanen, wat volgens ons een opgekuiste versie van de stagereglementering is. We vragen ons dan ook af waarvoor deze haast nodig was. Het wetsontwerp bevat nu nog een aantal onvolmaaktheden. Wij zien ons dan ook verplicht nog twee amendementen op de artikelen 26 en 56 in te dienen omdat deze artikelen enkele onvolkomenheden op wetgevend vlak bevatten. Dergelijke argumenten over wetgevende juistheid zullen door de nieuwe coalitie wel worden afgedaan als oude politieke cultuur. Snelheid is het motto van deze regering, inhoud heeft minder belang en op een kritische, zelfs constructieve opstelling komt geen antwoord. Op inhoudelijk vlak sta ik even stil bij de structurele lastenvermindering. De onmiddellijke lastenverlaging ten belope van 200 miljard voor het bedrijfsleven, die in één keer zou worden uitgevoerd en een hoofdpunt van het VLD-verkiezingsprogramma was, komt er niet. Op dit ogenblik is er sprake van een lastenverlaging van maximum 130 miljard. Dit cijfer omvat de lastenverlagingen die in het verleden reeds jaarlijks werden toegekend via het doelgroepenbeleid, evenals de 108 miljard die tijdens de vorige regeerperiode werden vooropgesteld. Nu zijn er enkele tientallen miljarden bijgekomen zodat we niet hoger gaan dan 130 miljard in de plaats van 200 miljard. Het is ons nog altijd niet duidelijk hoe de regering dit allemaal gaat organiseren. We worden immers geconfronteerd met een terugvordering van het maribelgeld en een verhoging van de bijdragen. Voor de ondernemingen is het nog altijd niet duidelijk of provisies moeten worden aangelegd voor het eventueel terugbetalen van de bedragen die ze hebben ontvangen binnen het kader van de Maribel. De arbeidsduurvermindering - dat is het volgende punt is van oudsher een socialistische wens. Nu blijkt dat ook volgens de VLD arbeidsduurvermindering mogelijk moet zijn. Tijdens de vorige legislatuur was er een eerste offensief hoofdstuk met het plan-Vande Lanotte. In twintig bedrijven kon een arbeidsduurvermindering tot 32 uur worden toegepast, met compenserende aanwervingen. Eén bedrijf heeft op dit plan ingetekend en twee dossiers zijn lopende. Ik hoor dat ook andere coalitiepartners een algemene arbeidsduurvermindering genegen zijn. Toch moet ik u ervoor waarschuwen dat door het veralgemenen van de arbeidsduurvermindering de inspanningen in het kader van de afstemming van de loonkost op de andere Europese landen en de verbetering van onze concurrentie niet worden tenietgedaan. Er werd al heel wat gezegd over de startbanen. Tijdens de vorige legislatuur werd in het werkgelegenheidsbeleid een aanvang genomen met de eerste werkervaringsconctracten, maar ze werden afgevoerd omdat ze niet veel succes hadden. De stagewetgeving die er aankomt is een opgekuiste vorm van het koninklijk besluit nr. 123. Men focust zich nu enkel en alleen op jongeren, maar wij weten dat deze groep hoofdzakelijk voor Wallonië een probleem is. Ook Vlaanderen kampt nog met een restgroep van werklozen in die leeftijdsgroep. Die restgroep is echter arbeidsongeschikt, is niet aangepast aan de vraag van de arbeidsmarkt. Ik deel terzake de mening van mevrouw D'Hondt dat wanneer die restgroep niet individueel wordt begeleid, men met cijfers van jongere werklozen zal blijven zitten.

Also this bill had to be approved so quickly that the government at some point had forgotten to consult the social partners on an idea such as the start-up jobs. In Belgium, the regulation on the functioning of the labour market is established through a consultation between representatives of employers and workers. Social partners initially increased at the first signing of the Rosetta plan. After several contacts, they were more or less able to enroll in the second proposal of the start-up jobs, which, in our opinion, is a broken version of the internship regulation. We ask ourselves why this hurry was needed. The bill still contains a number of imperfections. We are therefore obliged to submit two additional amendments to Articles 26 and 56 because these Articles contain some legislative deficiencies. Such arguments about legislative correctness will be rejected by the new coalition as old political culture. Speed is the motto of this government, content has less importance and there is no response to a critical, even constructive setting. On the substantive level, I remain silent about the structural burden reduction. The immediate reduction of the burden of 200 billion for business, which would be carried out in one time and was a key point of the VLD electoral program, will not come. Currently, there is a reduction in burden of a maximum of 130 billion. This figure includes the burden reductions already granted annually through the target group policy in the past, as well as the 108 billion predetermined during the previous governing period. Now, several tens of billions have been added so that we do not go above 130 billion instead of 200 billion. It is still unclear how the government will organize all this. After all, we are facing a recovery of the maritime fee and an increase in contributions. For the companies, it is still unclear whether commissions should be applied for the possible refund of the amounts received within the framework of the Maribel. The reduction of working hours - that is the next point is traditionally a socialist desire. Now it shows that also according to the VLD reduction of working hours should be possible. During the previous legislature there was a first offensive chapter with the plan-Vande Lanotte. In twenty companies, a reduction in working hours to 32 hours could be applied, with compensatory hiring. One company has signed this plan and two files are ongoing. I hear that other coalition partners are also pleased with a general reduction in working hours. Nevertheless, I must warn you that by increasing the reduction of working hours, the efforts to align the cost of wages in other European countries and to improve our competition will not be overturned. A lot has been said about the start-ups. In the previous legislature, the employment policy was initiated with the first employment experience contracts, but they were removed because they were not very successful. The internship legislation that comes up is a reckoned form of the Royal Decree no. and 123. We now focus only on young people, but we know that this group is a problem primarily for Wallonia. Flanders also struggle with a remaining group of unemployed in this age group. However, that remaining group is unemployable, not adapted to the demand of the labour market. I share in this regard Mrs D’Hondt’s view that if that residual group is not supervised individually, one will remain with figures of younger unemployed.

Ik hoor te veel mensen zeggen dat er geen problemen meer zijn inzake jeugdwerkloosheid, terwijl er nog wel een probleem is, ook in Vlaanderen. Ook in Vlaanderen komen nog duizenden jongeren zonder diploma of met een laag diploma op de arbeidsmarkt. Deze jongeren zijn veroordeeld om in de structurele werkloosheid verzeild te geraken, tenzij men er iets aan doet. Maar daarmee begrijp ik uw kritiek niet ten aanzien van het startbaanplan. Het federale en Vlaamse niveau proberen die jongeren op een zeer individuele en snelle manier te benaderen. Men gaat na waar de opleidingsproblemen zijn gesitueerd en men probeert er iets aan te doen. Het betekent ook het garanderen van werkgelegenheid via het reserveren van startbanen op de arbeidsmarkt. Ik zie niet in waar uw punt van kritiek ligt, als u de analyse maakt dat er inderdaad een grote groep schoolverlaters is waaraan individueel iets moet worden gedaan.

Mijnheer Bonte, ik was eigenlijk niet uitgesproken. Ik wou enkel zeggen dat er bij de jongeren een restgroep arbeidsongeschikt is. Deze groep wordt in Vlaanderen van jaar tot jaar kleiner. In 1999 kunnen wij een daling van 17% constateren in vergelijking met 1998. Het aantal laaggeschoolde werklozen in Vlaanderen is gedaald met 13,5%. Deze cijfers tonen aan dat dit geen Vlaams probleem is. Voorts wil ik nog opmerken dat er nog andere vormen van werkloosheid zijn. Ik verwijs in dit verband naar het hoge werkloosheidspercentage bij vrouwen in Limburg. In Vlaanderen en in heel België worden wij geconfronteerd met een hoog werkloosheidspercentage bij de vijftigplussers. Het startbaanplan spitst zich al te zeer toe op een probleem dat niet in eerste instantie een Vlaams probleem is. Het probleem van de vorming moet niet worden besproken op federaal niveau, maar op het niveau van de Gemeenschappen. De nieuwe regering heeft met veel rumoer aangekondigd dat de administratieve formaliteiten tijdens deze legislatuur met 25% zullen worden verminderd. Dit is een bijzonder nobele doelstelling. In de loop van het eerste jaar moet het aantal administratieve formaliteiten al met 10% dalen. Hoewel de leden van de regering het vooral hebben over administratieve formaliteiten, betekent administratieve vereenvoudiging veel meer dan het wegmoffelen van documenten en formulieren. Door dit wetsontwerp worden er echter tien nieuwe formulieren gecreëerd tussen werknemer, werkgever en de RSZ. De administratieve lasten verminderen dus niet, integendeel. Zo moet elke leerling in zijn school de nodige attesten aanvragen, de werkgever moet in de driemaandelijkse RSZ-aangifte de identiteit van de werknemers met startbaanovereenkomst opgeven en de werkgever moet een kopie van de startbaanovereenkomst bezorgen aan een door de Koning aan te wijzen ambtenaar. Een opsomming geven van alle administratieve eisen is eindeloos vervelend. De RSZ heeft er overigens zelf op gewezen dat zij door het ingebouwde cascadesysteem voor een onoverkomelijke opdracht wordt geplaatst. Bijna alle politieke partijen kunnen tevreden zijn met dit ontwerp. Zowel de PSC als de PS zijn tevreden met het opgepoetste startbaanplan. De VLD heeft misschien nog meer reden om tevreden te zijn want zij kan haar achterban meedelen dat er de facto niets verandert. Dat er een zeer schuchtere aanzet is gegeven tot een nieuw werkgelegenheidsplan, zal wellicht op een andere manier worden vertaald. Ook de groenen kunnen dit ont- werp als een heuse overwinning op hun palmares schrijven. De CVP is echter niet tevreden over de manier van werken. Er is inderdaad snel gewerkt, maar op een inefficiënte manier. De inhoud van het ontwerp is opgewarmde koek. De snelheid waarmee de hele zaak door de commissie en de plenaire vergadering wordt gejaagd, is voor ons onaanvaardbaar. Wie bij dit alles goed zal varen, zijn de sociale secretariaten omdat zij een hoop extra administratieve formaliteiten te vervullen zullen krijgen. Ook voor mevrouw André is dit een goede zaak omdat zij zich nog meer zal kunnen verdiepen in de administratieve rompslomp. Om te eindigen wil ik onderstrepen dat dit wetsontwerp geen brug is naar de eenentwintigste eeuw; het is hooguit een pijler die niet eens stevig is ingeplant en slechts partiële ondersteuning biedt. De CVP zal zich dan ook bij de stemming onthouden.

In 1999 we can see a decrease of 17% compared to 1998. The number of low-skilled unemployed in Flanders has fallen by 13.5%. These figures show that this is not a Flemish problem. There are also other forms of unemployment. In this context, I refer to the high unemployment rate among women in Limburg. In Flanders and throughout Belgium we are facing a high unemployment rate among those over 50. The start-up plan focuses too much on a problem that is not initially a Flemish problem. The new government has announced with much rumor that administrative formalities will be reduced by 25% during this legislature. This is a ⁇ noble goal. Monsieur le président, chers collègues, je souhaiterais tout d'abord remercier Mme Yerna de son excellent rapport sur les travaux de la commission des Affaires sociales et de l'Emploi concernant le projet de loi-programme consacré à la promotion de l'emploi. Je tiens à souligner la haute tenue de ces travaux. Je remercie le président de la commission ainsi que les commissaires qui sont intervenus au cours des réunions. Het federale regeerakkoord besteedt bijzondere aandacht aan de ontwikkeling van de werkgelegenheid. Deze regering heeft de vaste wil België uit te bouwen tot een actieve welvaartsstaat, waarin verhoogde werkgelegenheid en sociale bescherming hand in hand gaan. Concreet wil de regering een actief opleidings- en werkgelegenheidsbeleid voeren, dat er is op gericht de werkgelegenheidsgraad te doen stijgen. De recente evolutie van de werkgelegenheidsgraad stemt ons hoopvol. Onze achterstand ten opzichte van het gemiddelde van de EU bedroeg in 1990 nog 7,9%. Ondertussen werd dat herleid tot ongeveer 3%. Er blijft echter een achterstand. Tegen het einde van deze legislatuur willen wij die omvormen tot een voorsprong en dit door meer mensen tussen 18 en 65 jaar te integreren op de arbeidsmarkt. Het thans voorliggende wetsontwerp draagt daartoe bij: het gaat om de uitvoering van een aantal hoofddoelstellingen van het regeerakkoord, zoals ingeschreven in de begrotingsbeslissingen voor 2000. Bien que M. Poncelet ne soit plus présent parmi nous, je souhaiterais lui préciser que l'équilibre de la sécurité sociale figure parmi les priorités que le gouvernement s'est fixées. Dès lors, nous veillerons à ce que les moyens nouveaux accordés à la promotion de l'emploi ne puissent en aucun cas grever les comptes de la sécurité sociale. En matière de diminution structurelle des charges, l'effort proposé par le gouvernement est exceptionnel. Mme Van der Hooft l'a rappelé. Les diminutions supplémentaires de charges proposées permettront de réduire le coût salarial annuel d'un travailleur de 32 000 francs. Le cadre législatif s'inscrit dans le suivi de la loi du 26 mars 1999. Cette loi prévoyait déjà une augmentation de la diminution des cotisations pour le 1er avril 2000. Grâce à l'enveloppe supplémentaire de 32,4 milliards par an, cette augmentation pourra être considérablement renforcée. Het gaat dus om aanpassingen aan de bestaande wet, die het mogelijk maken om de verhoging van de bijdrageverminderingen te kunnen realiseren binnen deze bestaande wetgeving. Er komt dus geen nieuw systeem van lastenverlaging; het gaat om een versterking van het huidige. Er is trouwens geen reden om dit, ondertussen gekende, stelsel te vervangen. De RSZ liet mij weten dat het aantal foute aangiftes van werkgevers sinds deze nieuwe wetgeving aanzienlijk is verminderd. Bovendien, mijnheer Timmermans, werd in het ontwerp het belang van de inbreng van de sociale partners onderstreept. Elk jaar zullen zij een globale evaluatie maken van de ontwikkeling van de lonen, de vormingsinspanningen en de ontwikkeling van de werkgelegenheid. Indien deze globale evaluatie niet positief is, dan kan voor ondernemingen en/of sectoren die onvoldoende inspanningen deden, de geldende bijdragevermindering worden verlaagd. Bovendien voorziet het wetsontwerp uitdrukkelijk in de mogelijkheid om het stelsel van de structurele lastenverlaging aan te passen, rekening gehouden met de toepassingsmodaliteiten die de sociale gesprekspartners eventueel hebben vastgesteld in het tweejaarlijks interprofessioneel akkoord. Via deze inbreng van de sociale gesprekspartners kan er worden over gewaakt dat de vruchten van de loonlastenverlaging maximaal worden benut ten voordele van nieuwe tewerkstelling en het verhogen van de inspanningen voor vorming en opleiding. M. Poncelet m'a demandé quelques précisions en ce qui concerne le Maribel social. Je lui demanderai de relire le rapport car les questions qu'il m'a posées l'ont déjà été en commission des Affaires sociales. Nous y avions répondu très précisément. Toutefois, je tiens à vous communiquer quelques compléments d'information. En ce qui concerne le non-marchand, tant public que privé, le gouvernement souhaite augmenter les moyens consacrés au développement de l'emploi, notamment par l'accroissement net du Maribel social à raison de 3 milliards par an et de 1,5 milliard pour 2000. C'est un premier effort. Mais je suis d'accord avec celles et ceux qui ont demandé à cette tribune de poursuivre dans cette voie. Le dispositif du Maribel social est fondé sur une réduction des cotisations patronales de sécurité sociale qui s'élève, depuis le troisième trimestre 1999, à 9 750 francs par travailleur. Avec l'augmentation projetée, cette réduction avoisinera les 12 000 francs. Pour le secteur privé, ces réductions sont globalisées pour l'ensemble des employeurs relevant de la même commission paritaire. Ce montant global est ensuite reconverti en emplois supplémentaires. C'est ce qu'on a appelé la mutualisation. Pour le secteur public, le mécanisme est identique, si ce n'est que pour les hôpitaux, le produit de la réduction peut être affecté à chaque institution. Le Maribel social a ainsi permis jusqu'à présent la création de près de 4 700 nouveaux emplois dans le cadre des deux premières phases mises en oeuvre en 1997 et 1998. La troisième phase est en cours de réalisation et devrait être terminée pour janvier 2000. Le nombre total d'emplois créés devrait alors s'élever à 8 000 emplois équivalents temps plein, auxquels viendront s'ajouter, à partir du second semestre 2000, 2 500 emplois supplémentaires. On ne peut que se réjouir du rendement de ce dispositif, d'une part, au niveau de la politique de l'emploi et d'autre part, parce qu'il contribue au renforcement de la qualité des services rendus par les entreprises du secteur non marchand à leurs bénéficiaires et à la diminution de la pénibilité du travail, dont on sait combien il peut être exigeant dans les différents services du secteur non marchand. Force est toutefois de constater que les procédures administratives permettant l'application du Maribel social sont lourdes et contraignantes, entravant parfois la rentabilité des dispositifs. C'est pourquoi des dispositions fixées dans la loi-programme permettront d'alléger ces procédures, notamment en évitant un recours systématique au Conseil des ministres pour décider des modalités pratiques permettant la création des emplois, dès lors que le cadre général aura été fixé par celui-ci. Ces modifications, madame Pieters, constituent une première étape dans le programme de simplification administrative que le gouvernement souhaite mener au niveau du Maribel social. C'est ainsi également que, dans le souci d'améliorer le dispositif, les délais permettant le recrutement effectif des travailleurs supplémentaires attribués aux entreprises ont été raccourcis, de manière à autoriser ce recrutement dès le premier jour qui suit l'accord donné à l'employeur. Par le passé, ce recrutement n'était autorisé qu'à partir du premier jour du trimestre qui suivait la décision, ce qui pouvait entraîner le report jusqu'à trois mois des embauches réelles. Une autre amélioration apportée à la réglementation vise à organiser un meilleur contrôle de l'application du dispositif. Zo zou de werkgever bijvoorbeeld personeelsleden kunnen ontslaan om ze 's anderendaags opnieuw aan te werven in het kader van de sociale Maribel. Het is ook mogelijk dat de bijkomende arbeidsplaatsen niet in de onderneming zelf gecreëerd zouden worden. Een in de commissie voor de Sociale Zaken aangenomen amendement laat in de toekomst een controle toe door de inspectiediensten van het ministerie van Tewerkstelling en Arbeid. Bovendien bepaalt de reglementering inzake de sociale Maribel dat de ten onrechte toegekende bijdrageverminderingen teruggevorderd worden bij de werkgevers of bij de beheerscomités van de sectorale fondsen. Deze teruggevorderde bedragen dienen gestort te worden in een bij het ministerie van Tewerkstelling en Arbeid opgericht Terugvorderingsfonds enerzijds, voor de private nonprofitsector en anderzijds, voor de openbare ziekenhuizen die aangesloten zijn bij de RSZ. Deze bepaling kon tot op heden niet worden uitgevoerd. Daarom werd een amendement aanvaard dat in de oprichting van deze twee begrotingsfondsen voorziet. De oprichting van deze fondsen zal een grotere transparantie toelaten in het gebruik van de teruggevorderde bedragen, die integraal zullen worden omgezet in nieuwe tewerkstelling. Il était nécessaire qu'une législation coordonne et amplifie les mesures existantes, à la fois en matière d'aménagement et de réduction du temps de travail. Ce projet est manifestement très attendu et afin de le rendre le plus efficace possible, il convient de préparer au mieux le terrain et d'établir une comparaison avec les lois en vigueur dans les autres pays de l'Union européenne et d'adapter les modèles à notre système de concertation sociale. Il importe de soutenir l'organisation du travail la plus apte à répondre aux besoins des entreprises, mais il importe également de soutenir le système de redistribution du travail. Ainsi, l'Etat jouera le rôle qui lui revient de régulateur de l'économie, visant à associer croissance économique et amélioration sociale, au travers d'une création d'emplois plus importante. Bien entendu, il doit être possible d'arriver à des organisations du travail permettant la semaine de quatre jours. Le système actuel a le mérite d'exister, mais n'est certainement pas assez incitatif puisque, comme d'aucuns l'ont déjà exposé, à l'heure actuelle, une seule entreprise bénéficie du système mis en place au début de l'année. Dois-je rappeler que le système actuel ne touche qu'à l'organisation du travail, mais n'a pas de lien avec une réduction du temps de travail? Il y a donc lieu de rendre plus simple, plus cohérent l'ensemble des législations existantes et d'augmenter les effets positifs pour les travailleurs, pour les entreprises et aussi pour la réduction du nombre de chômeurs. En attendant de vous présenter un projet de loi, le présent projet prolonge, à titre provisoire, jusqu'à la fin de l'an 2000, les réglementations existantes qui prenaient fin. Het plus-één-, plus-twee-, plus-drie-plan kent aan de beginnende werkgever een belangrijke bijdrage- vermindering toe indien hij overgaat tot de aanwerving van een eerste, een tweede of een derde werknemer. De aangeworvenen moeten vergoede werklozen of daarmee gelijkgestelden zijn. Sinds einde 1998 wordt met een vergoede werkloze gelijkgesteld de uitzendkracht, die bij die werkgever wordt in dienst genomen met een gewone arbeidsovereenkomst. Die werknemer moet dan wel vóór zijn aanwerving minstens drie maanden als uitzendkracht bij deze werkgever hebben gewerkt. In het huidige wetsontwerp wordt verduidelijkt dat die drie maanden dienen te liggen in de periode van twaalf maanden vóór de aanwerving. Het moet daarbij niet noodzakelijk gaan om een ononderbroken periode van drie maanden, zoals ik reeds toelichtte in de commissie voor de Sociale Zaken. De Europese Commissie onderkende dit probleem en vaardigde regels uit die een verregaande staatssteun aan deze sector toelaat. België maakte daarvan reeds gebruik voor de koopvaardij en de baggersector. Beide genieten reeds vrijstelling van patronale bijdragen voor de werknemers tewerkgesteld op schepen met een zeebrief die varen onder de vlag van een van de lidstaten van de Europese Unie. Toch blijft er een belangrijke concurrentiehandicap inzake baggerwerken, vooral tegenover Nederland, samen met België wereldleider. Nederland maakt immers maximaal gebruik van de specifieke richtlijnen van Europa. Om de werkgelegenheid in de baggersector verder te vrijwaren wordt in het voorliggende voorwerp bepaald dat de Koning ook gedeeltelijk vrijstelling van persoonlijke bijdragen voor de sociale zekerheid kan verlenen, waarbij het vrijgestelde deel in het bedrijf wordt gehouden en de loonkosten dus worden verlicht. Wat de sleepvaart betreft bestond tot op heden geen steunmaatregel. Ook hier geldt evenwel een toenemende internationale concurrentie. Duitse en OostEuropese sleepboten zijn reeds actief op de Wester- schelde. Daarom wordt in het voorliggende wetsontwerp de mogelijkheid gecreëerd om via een in Ministerraad overlegd besluit aan de sleepvaart dezelfde voordelen toe te kennen als degene die gelden voor de baggersector en de koopvaardij. Enfin, j'en viens à la convention de premier emploi, dont tous les intervenants ont parlé. Je voudrais tout d'abord évoquer le contexte du plan jeunes, ses grandes lignes, la concertation avec les partenaires sociaux, l'implication des régions et des communautés et enfin les modifications découlant des amendements votés en commission. Le contexte, c'est d'abord le constat du taux d'emploi des jeunes, qui est inférieur en Belgique au taux moyen européen. Mme Yerna y a fait allusion. C'est aussi la volonté annoncée par le gouvernement qui, dans l'accord gouvernemental, prévoit l'introduction d'un premier emploi pour les jeunes dans le but de permettre à chaque jeune d'entrer sur le marché de l'emploi dans les six mois de sa sortie de l'école. C'est enfin la conformité du plan jeunes à la première ligne directrice européenne, puisqu'elle recommande d'offrir un nouveau départ à tout jeune avant qu'il atteigne six mois de chômage, sous forme de reconversion, d'expérience professionnelle, d'emploi ou de toute autre mesure propre à favoriser son insertion professionnelle. M. Bonte a aussi rappelé ce contexte. C'est donc une action préventive de l'enlisement des jeunes dans le chômage qui est prônée et c'est cette prévention que le plan jeunes réalise, notamment à l'égard des moins qualifiés. En effet, ce sont les jeunes qui n'ont pas de diplôme de l'enseignement secondaire supérieur, malgré l'obligation scolaire jusqu'à 18 ans, qui font l'objet de la plus grande attention du plan jeunes parce que sans cela, ils risquent bien, plus que les autres, de rester sans emploi. Pour les inciter à engager ces jeunes moins qualifiés, les employeurs recevront un avantage important sous forme de réduction des cotisations patronales de sécurité sociale. Bien sûr, pour obtenir cet avantage, les employeurs devront remplir leur obligation. Ils recevront alors 20 000 francs par personne et par trimestre d'allégement social. S'ils vont au-delà de leur obligation, ils recevront un allégement de 45 000 francs par personne et par trimestre. Laten wij ons niet vergissen. Het is voor de werkgevers mogelijk om andere jongeren in dienst te nemen dan de laaggeschoolden. In dat geval wordt hen geen enkel voordeel toegekend. Men heeft het vaak gehad over de verplichting jongeren tewerk te stellen. Sommigen hebben gedaan alsof dit een nieuwigheid was. In werkelijkheid bestaat de jongerenstage sedert 22 jaar en die verplichting bestaat sedert de start ervan. Mevrouw D'Hondt, mijnheer Poncelet, mevrouw Pieters, als de verplichting niets nieuws is, dan is de vermindering van de sociale bijdragen dat wel. Het is een vernieuwing ten overstaan van de jongerenstages. Sommigen zullen misschien zeggen dat het koppelen van een verplichting aan een voordeel een cadeau is en dat dit een voordeeleffect met zich brengt. Ik zie de dingen niet zo. Een voordeel wordt terecht verdiend als het wordt toegekend aan hen die jongeren in dienst nemen die het moeilijkst aan een baan geraken. Het voordeeleffect wordt verminderd vanaf het ogenblik dat de categorie van begunstigden strikt beperkt is. Une autre particularité du plan jeunes réside dans la multiplicité des formes que peut prendre la convention de premier emploi. Là aussi, madame D'Hondt, le projet regorge de différences avec le stage. Quelles formes peut-il prendre? D'abord, un emploi à mi-temps, au moins dans les liens d'un contrat de travail normal dont la première année constituera la convention de premier emploi. Ensuite, un emploi à temps partiel d'au moins un mi-temps dans les liens d'un contrat de travail, dont au moins la première année et au maximum les trois premières années constitueront la convention de premier emploi, à condition que cet emploi soit complété par une formation, un apprentissage ou des cours. Ou enfin, toute forme d'apprentissage ou d'insertion, dont au moins la première année et au maximum les trois premières années constitueront la convention de premier emploi. Cette troisième forme concerne, comme la deuxième, l'alternance qui apparaît bien adaptée aux jeunes peu ou moyennement qualifiés, mais se distinguera de la deuxième par l'absence de contrat de travail. Par ailleurs, le plan jeunes utilise des outils existants et ne modifie pas les règles fondamentales du droit du travail. Ainsi, les jeunes occupés dans les liens d'un contrat bénéficieront d'une rémunération normale. Cependant - et j'en viens à la concertation avec les partenaires sociaux -, si les employeurs affectent 10% de la rémunération du jeune à leur formation, le salaire peut être abaissé à 90% sans toutefois être inférieur au revenu minimum mensuel moyen garanti. J'insiste, ces 10% doivent être investis par l'employeur au profit d'une action de formation individuelle qui doit être inscrite dans le contrat de premier emploi du jeune. Cette disposition a été prévue à la demande des partenaires sociaux et, comme on va le voir, ce n'est pas la seule. Je voudrais maintenant répondre à l'interpellation dont j'ai été l'objet en ce qui concerne ma méthode de travail avec les partenaires sociaux. Je les ai avertis: je continuerai cette méthode comme je l'ai commencée, à savoir dire clairement, et conformément à l'accord de gouvernement, quels sont mes objectifs en matière d'emploi. Ensuite, après le feu vert du gouvernement, discuter avec les partenaires sociaux et accepter que cette discussion soit porteuse d'évolutions, parfois fort importantes. Je crois que cela clarifie le débat, l'objectif et le rôle de chacun. Mocht ook een tekort worden vastgesteld in de tweede categorie, dan kunnen eveneens jongeren van minder dan 30 jaar in overweging worden genomen. Deze cascade van begunstigden kan zelfs slaan op andere rechthebbenden die door de Koning worden bepaald, zo er onvoldoende personen zouden zijn in de eerste drie categorieën. Aan de bezorgdheid van de sociale partners wordt niet alleen tegemoetgekomen via dit cascadesysteem, maar ook door de rol die de Koning zal kunnen toevertrouwen aan de subregionale tewerkstellingscomités bij het vaststellen van een eventueel tekort. Deze paritaire instanties in elke subregio zijn inderdaad goed geplaatst om na te gaan of de constante evolutie van de arbeidsmarkt de overgang impliceert naar een andere categorie begunstigden ingeval er een tekort is in de voorgaande categorie. Mais il est vrai que, toute proportion gardée, les catégories de jeunes au chômage et leur nombre ne sont pas les mêmes dans chaque région. Il fallait donc tenir compte de ces différences pour que la politique d'emploi rencontre les différentes spécificités de notre Etat fédéral. Nous avons dès lors tenté de répondre à ces problèmes en élaborant, avec votre aide, toute une série de mesures que je viens d'évoquer. Le projet actuel n'impose d'obligation que si 50 travailleurs étaient occupés à la date de référence dans les entreprises. Toutefois, les entreprises de moins de 50 travailleurs peuvent aussi occuper des jeunes. Ce faisant, elles contribueront à ce que l'objectif global d'occupation d'un quatrième pour cent de jeunes assigné à l'ensemble des entreprises soit atteint. Les employeurs privés seront tenus individuellement d'occuper des jeunes travailleurs à concurrence de 3% de leur personnel propre. Mais en outre, 1% supplémentaire est assigné à l'ensemble des employeurs privés quelle que soit la taille de leur entreprise. Ce pour cent supplémentaire sera déterminé par rapport à l'ensemble du personnel des entreprises qui occupent au moins 50 travailleurs. Cependant, les entreprises qui en occupent moins pourront, par l'engagement volontaire de nouveaux travailleurs, participer à atteindre cet objectif global. Cette disposition découle également de la concertation avec les partenaires sociaux. Et je tiens à souligner que ces derniers seront chargés, un an après l'entrée en vigueur de la loi, d'évaluer dans quelle mesure cet objectif global d'occuper un quatrième pour cent a été atteint et si les employeurs ont effectivement consacré 10% de la rémunération des nouveaux travailleurs à leur formation. Je voudrais également ajouter que, dans le cadre de cette évaluation, au niveau du Conseil central de l'économie, au sein du Conseil national du travail, un exercice nouveau est prévu, à savoir que nous avons l'introduit des dispositifs de genre. Autrement dit, ces instances devront dire si oui ou non, dans le cadre d'une politique d'égalité des chances, les propositions auront été aussi bénéfiques pour les hommes que pour les femmes. C'est là une nouveauté qui devrait être étendue à l'ensemble des politiques. Si l'évaluation n'est pas positive, après avis ou sur proposition du CNT, le Roi a la possibilité de modifier l'obligation imposée aux employeurs. On peut notamment songer à une obligation individuelle pour chaque employeur d'occuper 4% si l'objectif relatif au quatrième pour cent global n'était pas atteint. Enfin, rencontrant une autre préoccupation des partenaires sociaux, le projet de loi reproduit les dispositions du stage des jeunes qui permettent de dispenser de leurs obligations les employeurs qui connaissent des difficultés mais également les dispositions qui les exemptent de cette obligation lorsqu'ils s'engagent individuellement à créer des emplois supplémentaires à temps plein ou lorsqu'ils consentent, au sein d'un secteur professionnel, à un effort en faveur de l'emploi. J'ajoute que le projet prévoit dans ses dispositions transitoires que les dispenses et les exemptions, accordées dans le cadre du stage des jeunes, continueront à produire leurs effets jusqu'à leur échéance tout comme les stages en cours afin d'assurer précisément une transition parfaite entre le stage des jeunes et la convention de premier emploi. Bien sûr, j'estime que la conclusion d'un contrat de travail constitue la forme d'insertion par excellence. Mais je pense aussi que les formes d'alternance entre travail et formation ou apprentissage sont particulièrement bien adaptées à certaines catégories de jeunes. Ainsi, je suis du même avis que Mme Yerna et Mme Cahay sur l'importance de cette formation qui, de toute fac¸on, devra s'épanouir tout au long de leur vie. Dans cette perspective, la formation en langues devra être amplifiée comme le souhaite Mme Van der Hooft. Par conséquent, les trois formules de convention de premier emploi sont offertes par la loi. J'espère qu'elles pourront être inscrites prochainement, puisque certaines de ces formes dépendent de l'action des régions et de la Communauté germanophone, dans un accord de coopération avec les régions et les communautés actuellement en cours de négociation, qui devrait se terminer au plus tard en janvier prochain. Il est également important de donner la possibilité aux jeunes, à l'issue de leur occupation dans une convention de premier emploi, de bénéficier des autres mesures en faveur de l'emploi. Il faut leur assurer un suivi dans l'emploi. Je songe aux mesures fédérales comme le plan d'embauche, et aux mesures régionales, comme le programme de résorption du chômage et le programme de transition professionnelle. A cette fin, la période d'occupation dans une convention de premier emploi est assimilée à une période de chômage ou d'inscription comme demandeur d'emploi exigée par ces mesures. Un accord de coopération avec les régions et les communautés est également nécessaire pour les mesures relevant de leurs attributions. Elles en ont déjà accepté le principe. Ik ben ervan overtuigd dat zij een model zal zijn van de gemeenschappelijke werking niettegenstaande de moeilijkheden die deze manier van handelen met zich brengt. Je signale aussi qu'un amendement a permis d'améliorer la rédaction de la disposition déterminant la rémunération de nouveaux travailleurs et que le parlement sera informé de l'évaluation réalisée par le Conseil national du travail et le Conseil central de l'économie. Enfin, comme l'a gentiment rappelé Mme D'Hondt, il est prévu que la loi entre en vigueur le 1er avril 2000. Dans l'intervalle, non seulement les arrêtés royaux d'exécution auront été pris, mais les employeurs et les jeunes auront été informés du plan jeunes. Avec l'administration, nous mettons au point une campagne d'information; je pense qu'elle est indispensable pour que le plan soit efficace au profit des entreprises et des jeunes travailleurs. Evidemment, la politique de l'emploi ne se limitera pas à cette loi-programme, aussi ambitieuse soit-elle. Je suis notamment d'accord avec celles et ceux qui sont intervenus pour dire que le taux d'activité des plus de cinquante ans est beaucoup trop faible dans notre pays; c'est du reste une remarque que l'Europe formula aussi à l'encontre de la Belgique dans le cadre du rapport et des recommandations européennes adoptés lors du dernier Conseil des Affaires sociales. Mercredi prochain, une réunion sera organisée entre le gouvernement et les différents partenaires sociaux, auxquels nous avons demandé de réfléchir notamment aux moyens permettant une augmentation de ce taux d'activité des personnes plus âgées. A partir des conclusions qui ressortiront de cette réunion, nous pourrons alors prochainement - je l'espère en tout cas - vous apporter des propositions relatives à cette catégorie d'hommes et de femmes qui méritent évidemment aussi toute l'attention du gouvernement. Quant au statut à temps partiel, monsieur Bonte, assurément, c'est également l'une de mes grandes préoccupations, non seulement en tant que ministre de l'Emploi mais aussi en tant que ministre de l'Egalité des chances. Ainsi, pour preuve, j'en ai longuement débattu lors de la commission traitant de l'égalité entre les hommes et les femmes. Sur ce point aussi, nous attendons les propositions des partenaires sociaux pour mercredi prochain. A la suite de cette réunion, des dispositions, tant pour améliorer le statut des travailleurs à temps partiel que pour éliminer les pièges à l'emploi, seront alors proposées dans le sens que vous avez indiqué. J'espère surtout, au-delà même de cette loi, que les nouvelles dispositions, quelles qu'elles soient - et cette loiprogramme présente l'avantage de comporter un dispositif multiple aux différentes facettes -, profiteront en priorité à celles et ceux qui n'ont pour le moment d'autre espoir que le chômage.
