Mijnheer de voorzitter, mijnheer de minister, collega's, ik heb met de heer Poncelet afgesproken dat ik eerst een algemene inleiding geef bij het ontwerp van bijzondere wet tot herfinanciering van de gemeenschappen en de uitbreiding van de fiscale bevoegdheden van de gewesten, waarna de heer Poncelet zal rapporteren over de voornaamste discussiepunten en argumenten die in de commissie te berde werden gebracht. Daarna zal ik verslag doen van de bespreking van het wetsvoorstel tot wijziging van de wet van 12 januari 1989 tot regeling van de wijze waarop de Brusselse Hoofdstedelijke Raad wordt verkozen en de gewone wet van 16 juli 1993 tot vervollediging van de federale staatsstructuur.
Wat het ontwerp van bijzondere wet betreft, werd in commissie eerst een toelichting gegeven door de vice-eerste minister en minister van Buitenlandse Zaken, de heer Louis Michel. Die lichtte toe dat het ontwerp tot doel had, enerzijds, te komen tot een herfinanciering van de gemeenschappen en de verruiming van de fiscale verantwoordelijkheid van de gewesten en, anderzijds, tot de afvlakking van de middelen toegewezen aan de deelgebieden. Met het ontwerp wil de regering de financiering van de Vlaamse en de Franse Gemeenschap structureel aanpassen met het oog op de verbetering van de dynamiek van de middelen van de gemeenschappen. Immers, in het definitief stelsel van de vigerende bijzondere financieringswet nemen de middelen van de gemeenschappen in het totaal van de overheidsfinanciering structureel af. De nieuwe wet beoogt precies de ontvangsten van de gemeenschappen aan de reële evolutie van de economische welvaart aan te passen, weliswaar geleidelijk om de regeringsdoelstellingen inzake de verdere afbouw van de rijksschuld niet in het gedrang te brengen. Dat betekent dat gedurende een periode van 10 jaar de bijkomende gemeenschapsmiddelen volgens een gemengd regime tussen de Vlaamse en de Franse Gemeenschap zullen worden verdeeld. Vanaf het begrotingsjaar 2012 zullen de nieuwe middelen, die dan ongeveer 100 miljard frank zullen bedragen, volledig verdeeld worden op basis van de in elke gemeenschap geïnde ontvangsten uit de personenbelastingen.
Daarnaast wil het ontwerp ruimere bevoegdheden toekennen aan de gewesten inzake gewestelijke belastingen en inzake enkele belastingen die hiermee verwant zijn. Dat lijkt een logische keuze, aangezien die belastingen nauw aansluiten bij de bevoegdheidsdomeinen waarover de gewesten in ons federaal staatsbestel beschikken. Het is aan te bevelen de gewesten meer beleidsmogelijkheden toe te meten inzake de personenbelastingen. In het vigerende financieringsstelsel wordt namelijk het overgrote deel van de middelen van de gewesten reeds gevormd door de toewijzing van een gedeelte van de opbrengsten van de personenbelastingen. Voor de verruiming van de fiscale autonomie van de regio's moet in het ontwerp worden gezorgd voor een omkadering door enkele noodzakelijke en duidelijk geformuleerde randvoorwaarden, wat nodig en wenselijk is in een federaal staatsbestel.
De zogenaamde gewestelijke belastingen worden in het onderhavig wetsontwerp geregionaliseerd. De bijkomende financiële ontvangsten worden geschat op ongeveer 110 miljard frank. Daarnaast wordt het kijk- en luistergeld, dat tot nu toe een gemeenschapsbelasting was, omgevormd tot een volwaardige gewestbelasting. In omgekeerde beweging worden de zogenaamde milieutaksen omgevormd en opnieuw aan de federale overheid toevertrouwd.
Bij de overheveling van de gewestelijke belastingen naar de gemeenschappen houdt dit wetsontwerp rekening met een aantal belangrijke randvoorwaarden. Een eerste voorwaarde is dat de federale overheid voor haar inkomstenverlies een compensatie moet krijgen. Een tweede voorwaarde is dat men probeert het risico van fiscale migratie te vermijden. Een derde voorwaarde is dat de afzonderlijke gewesten en de gemeenschappen onderling geen middelen verliezen ten opzichte van de huidige financiering.
In de vigerende financieringswet zijn de fiscale bevoegdheden van de gewesten inzake de personenbelasting voorwaardelijk en nogal onduidelijk. Nu kunnen de gewesten slechts na overleg tussen de federale regering en de gewestregeringen opcentiemen heffen of kortingen toestaan. Bovendien kan de federale overheid nog altijd ter vrijwaring van de Europese muntunie een maximumpercentage bepalen voor deze opcentiemen of kortingen. Met het onderhavig wetsontwerp pogen we de fiscale bevoegdheden in dit kader beter af te bakenen. Daarbij wordt ervan uitgegaan dat de fiscale autonomie van de gewesten niet afhankelijk mag worden gemaakt van procedureproblemen of inhoudelijke discussies tussen de verschillende regeringen. Daarom voeren wij een aantal beperkingen in wat de fiscale bevoegdheden van de gewesten betreft. Deze beperkingen zijn ondubbelzinnig en ze behoeven eigenlijk geen discussie.
Als eerste beperking wordt er een marge vastgelegd waarbinnen de gewesten, al dan niet gedifferentieerd per belastingsschijf, algemene procentuele opcentiemen en forfaitaire of procentuele kortingen kunnen toestaan, of algehele belastingverminderingen kunnen invoeren die gebonden zijn aan hun bevoegdheden. Als tweede beperking moet de uitoefening van de fiscale bevoegdheid van de gewesten voor de personenbelasting gebeuren zonder vermindering van de progressiviteit van de personenbelasting, en met uitsluiting van deloyale fiscale concurrentie.
Het derde luik van het onderhavig wetsontwerp betreft de afvlakking van de middelentoewijzing. Wij stellen immers vast dat in de huidige financieringswet de middelen van de gewesten en de gemeenschappen nog steeds schoksgewijze kunnen worden doorgestort. Dit kan de werking van de gewesten en de gemeenschappen natuurlijk in het gedrang brengen. Daarom voert het onderhavig wetsontwerp een nieuw mechanisme in om het schoksgewijze storten om te vormen, en zo te komen tot een zekere afvlakking van de middelentoewijzing. Die afvlakking gebeurt op basis van meer recente parameters dan de nu gebruikte. In afwachting van de definitieve vaststelling van het gemiddelde indexcijfer van de consumptieprijzen en van de reële groei van het bruto nationaal product, worden de bedragen aangepast aan de geraamde procentuele verandering van het gemiddelde indexcijfer van de consumptieprijzen en aan de geraamde reële groei van het bruto nationaal inkomen van het betrokken begrotingsjaar, zoals dit werd voorzien in de economische begroting.
Collega's, ik heb in grote lijnen en korte bewoordingen de essentie van het wetsontwerp toegelicht. Ik laat dus verder het woord aan de heer Poncelet voor het aanduiden van de voornaamste knelpunten en discussiepunten, zoals gebleken in de commissievergadering.

Mr. Speaker, Mr. Minister, Colleagues, I have agreed with Mr. Poncelet that I will first give a general introduction to the draft special law on the refinancing of communities and the expansion of the fiscal powers of the regions, after which Mr. Poncelet will report on the main points of discussion and arguments raised in the committee. I will subsequently report on the discussion of the bill amending the law of 12 January 1989 regulating the manner of election of the Brussels Capital Council and the ordinary law of 16 July 1993 completing the federal state structure.
As regards the draft special law, in the committee was first given an explanation by the Deputy Prime Minister and Minister of Foreign Affairs, Mr. Louis Michel. The proposal aimed, on the one hand, at refinancing the communities and expanding the tax liability of the regions and, on the other hand, at the leveling of the resources allocated to the subregions. With the draft, the Government aims to structurally adjust the financing of the Flemish and French Communities in order to improve the dynamics of the resources of the communities. After all, in the final system of the current Special Financing Act, the resources of the communities in the total amount of public financing are structurally reduced. The new law aims precisely to adjust the incomes of the communities to the actual evolution of economic prosperity, although gradually in order not to jeopardize the government’s objectives of further reduction of the government debt. This means that for a period of 10 years the additional Community resources will be distributed between the Flemish and the French Community according to a mixed scheme. Starting from the 2012 financial year, the new resources, which will then amount to approximately 100 billion francs, will be distributed fully on the basis of the income collected in each community from personal taxes.
In addition, the draft aims to give the regions wider powers in the area of regional taxes and in certain related taxes. That seems to be a logical choice, since those taxes are closely related to the jurisdictions of the regions in our federal state order. It is recommended to give the regions more policy options in the area of personal taxation. In fact, in the current financing system, the vast majority of the resources of the regions is already formed by the allocation of a part of the income from personal taxes. In order to expand the fiscal autonomy of the regions, the draft should provide for a rearrangement by some necessary and clearly formulated framework conditions, which is necessary and desirable in a federal state order.
The so-called regional taxes are regionalized in the present bill. The additional financial revenues are estimated at approximately 110 billion francs. In addition, the viewing and listening fee, which was previously a Community tax, is converted into a full-fledged district tax. In the reverse movement, the so-called environmental taxes are reformed and again entrusted to the federal government.
When transferring the regional taxes to the communities, this bill takes into account a number of important frame conditions. A first condition is that the federal government must receive compensation for its income loss. A second requirement is to try to avoid the risk of fiscal migration. A third condition is that the individual regions and communities do not lose resources from each other in relation to the current funding.
In the current Finance Act, the tax powers of the regions regarding the personal tax are conditional and rather vague. Now the regions can only impose or allow discounts after consultation between the federal government and the northern governments. Furthermore, in order to safeguard the European Monetary Union, the federal government may still set a maximum percentage for these opcents or discounts. With the present draft law, we seek to better define the tax powers in this context. It is assumed that the fiscal autonomy of the regions should not be made dependent on procedural problems or substantive discussions between the different governments. Therefore, we introduce a number of restrictions as regards the tax powers of the regions. These restrictions are unambiguous and they actually need no discussion.
As a first limit, a margin shall be established within which the regions, whether or not differentiated by tax scheme, may allow general percentage increases and flat-rate or percentage reductions, or introduce overall tax reductions bound by their competence. As a second limitation, the exercise of the tax competence of the regions for personal tax should take place without reducing the progressiveness of the personal tax, and with the exclusion of disloyal fiscal competition.
The third section of the present draft law concerns the leveling of the allocation of funds. In fact, we note that in the current funding law, the resources of the regions and communities can still be collapsed shockwise. This can naturally jeopardize the functioning of the regions and communities. Therefore, the present draft law introduces a new mechanism to transform the shock-like deposit, and thus to ⁇ a certain leveling of the asset allocation. This leveling takes place on the basis of more recent parameters than the currently used. Until the final determination of the average index rate of consumer prices and the real growth rate of gross domestic product, the amounts shall be adjusted to the estimated percentage change of the average index rate of consumer prices and to the estimated real growth rate of gross national income for the financial year concerned, as provided in the economic budget.
Colleagues, I have explained in broad lines and short terms the essence of the bill. Therefore, I leave the floor to Mr. Poncelet to identify the main difficulties and points of discussion, as demonstrated in the committee meeting.

Monsieur le président, je voudrais aussi adresser des remerciements au corapporteur qui a fait une synthèse du projet en tant que tel. Il n'était, en effet, pas opportun à ce stade de la discussion d'entrer dans trop de détails. Il était plus indiqué de vous faire part, comme il l'a fait, de l'essentiel du contenu. Vous savez que la discussion porte essentiellement sur les volets de l'autonomie fiscale et du refinancement des communautés. C'est bien entendu sur chacun de ces deux points que la plupart des groupes se sont exprimés, les uns estimant qu'on n'allait pas assez loin, les autres qu'on allait trop loin.
On peut résumer assez brièvement le contenu de ces discussions.
Le premier problème est celui de l'autonomie fiscale qui, pour certains, n'est pas suffisante, qui, pour les autres, permet, par ouverture, de créer des conditions de concurrence fiscale, voire de délocalisations.
Au cours d'une discussion générale qui a duré plusieurs jours puisque nous nous sommes rencontrés à diverses reprises, chacun a eu l'occasion de donner son point de vue. Le gouvernement a également précisé le sien en ne minimisant pas l'extension des compétences fiscales mais en rappelant qu'il y avait des limites et que les régions exerçaient leurs nouvelles compétences fiscales relatives aux impôts des personnes physiques dans le respect d'un certain nombre de principes. Le premier principe étant la non-diminution de la progressivité de l'impôt des personnes physique, le deuxième étant l'exclusion de la concurrence fiscale déloyale. Cela ouvre évidemment la porte à des questions portant sur la définition de la progressivité de l'impôt, sur la façon de garantir que cette dernière est respectée. Des thèses contradictoires ont évidemment été confrontées sur ce sujet.
La concurrence fiscale loyale étant le principe de base permettant de garder un minimum de solidarité, nous avons déterminé à partir de quel moment cette concurrence devient déloyale et qui jugera si elle est ou non déloyale. Dans ce cadre, le projet offre la possibilité à la Cour des comptes d'intervenir dans certains cas et envisage les possibles recours auprès de la Cour d'arbitrage.
En ce qui concerne le refinancement des communautés, l'adaptation des recettes des communautés est désormais liée à l'évolution de la prospérité économique, mais, et le gouvernement l'a rappelé, dans des limites fixées dans le souci du maintien du désendettement de notre pays. Tout n'est donc pas possible. Il a également été rappelé qu'il y a neutralité budgétaire des nouvelles mesures et donc que la perte de moyens de l'autorité fédérale sera compensée par la déduction des recettes régionales supplémentaires de la totalité des moyens attribués aux régions. Chacun des groupes s'est expliqué sur ce sujet.
Il a également été tenu compte du fait, point fondamental, que dans le passé, les communautés étaient financées sur la base du nombre d'élèves alors que les nouveaux moyens seront davantage liés, dans le cadre d'un système progressif, aux revenus de l'impôt des personnes physiques localisés dans chaque communauté.
Enfin, nous avons discuté du mécanisme des accords de coopération qui constitue un des volets importants de cet accord comme, notamment, la coordination de la politique fiscale dans des domaines qui dépendent de la compétence des régions.
Le dernier sujet traité — il n'est pas exhaustif - est celui du problème du financement de la Région bruxelloise. En effet, le principe de neutralité budgétaire pourrait peut-être remettre en question le financement structurel de la Région bruxelloise. Le gouvernement a expliqué pour quelles raisons il pensait que cela n'était pas le cas.
Nous avons également abordé, monsieur le président, la cinquantaine d'articles qui constituent le corps du dispositif.
Un certain nombre d'articles ont été modifiés d'un point de vue relativement technique. C'est notamment le cas de l'article 2 qui a fait l'objet d'une réécriture.
D'autres articles ont été modifiés de manière un peu plus fondamentale. C'est ainsi que je voudrais attirer l'attention sur l'article 9. Les membres de cette assemblée qui ont parcouru le rapport auront pu constater que cet article faisait l'objet d'un amendement — pardonnez-moi d'y faire référence, c'est votre rapporteur qui l'avait déposé - visant à compléter le dispositif. Un alinéa a été ajouté à l'article 9. Le dispositif parlait des réductions d'impôt en laissant de côté les majorations d'impôt. Le texte a été complété de manière à ce que soient évoquées non seulement les réductions d'impôt mais également les majorations d'impôt.
Vous verrez donc, à l'article 39, ancien article 38, un nouvel alinéa assez technique déposé à l'instigation du gouvernement.
Enfin, de longues minutes de débats, y compris au sein de la majorité, ont eu pour objet le transfert aux communautés du jardin botanique national et la manière dont on calculait la répartition des coûts du personnel. Le texte comportait, selon le gouvernement, une discordance entre la version néerlandaise et la version française. Mijnheer de voorzitter, aansluitend bij de discussie over het ontwerp van bijzondere wet, werd een discussie gevoerd over het wetsvoorstel tot wijziging van de wet van 12 januari 1989 tot regeling van de wijze waarop de Brusselse Hoofdstedelijke Raad wordt verkozen en tot wijziging van de gewone wet van 6 juli 1993 tot vervollediging van de federale staatsstructuur. Dit wetsvoorstel wordt ingediend door verscheidene parlementsleden met als hoofdindiener de heer Coveliers.
In zijn uiteenzetting vestigde de heer Coveliers er de aandacht op dat dit wetsvoorstel een uitvloeisel is van het zogenaamde Lombard-akkoord inzake de samenstelling van de bestuurslichamen in Brussel. Het voorstel heeft betrekking op de rechtstreekse verkiezing van de zes Brusselse leden van het Vlaamse Parlement en de aanwijzing van vijf bijkomende leden voor de Vlaamse Gemeenschapscommissie, indien er zich een blokkering zou voordoen bij de aanwijzing van de leden van de uitvoerende macht in het Brussels Hoofdstedelijk Gewest. Hij refereert ook aan het advies van de Raad van State om te wijzen op een aantal grondwettelijke tekortkomingen in dit wetsvoorstel. Hij zegt dat de Raad van State het heeft over een duidelijke schending van de Grondwet. Bovendien hoopt hij dat het Arbitragehof zich vrij spoedig zal uitspreken over die schendingen en deze akkoorden, het Lambermont- en het Lombardakkoord, nietig zal verklaren. Daarenboven denkt hij niet dat de bestrijding van ondemocratische partijen de schending van de Grondwet kan rechtvaardigen.

Vervolgens stelde de heer Poncelet dat de door de indieners van het wetsvoorstel gemaakte keuze om bijkomende verkozenen aan te wijzen, niet op grond van het aantal verkregen stemmen maar op grond van het aantal verkozenen in een andere assemblee, een volstrekt ondemocratisch juridisch gedrocht is. De heer Maingain vestigde er in zijn uiteenzetting de aandacht op dat er in het kader van het Costaoverleg reeds in juni 1999 binnen de meerderheid in Brussel een politiek akkoord was bereikt over drie specifieke punten. Ten eerste, ging het om het voorkomen van een blokkering van de Brusselse instellingen. Ten tweede, was er de versterking van de Vlaamse partijen in de Brusselse Hoofdstedelijke Raad en ten derde, ging het om een herfinanciering van de gemeenschapscommissies. Volgens hem berust het mechanisme dat in dit wetsvoorstel wordt uitgewerkt op een wankele juridische basis. Het is naar zijn mening dan ook niet denkbeeldig dat het Arbitragehof de betrokken bepalingen zal vernietigen. Hij erkent dat de Vlaamse parlementsleden van de Brusselse Hoofdstedelijke Raad een vrij zware werklast hebben maar hij meent dat er andere constructies mogelijk waren. De constructie die in dit wetsvoorstel wordt uitgewerkt voldoet volgens hem niet. Hij zegt verder dat ook de Raad van State hierbij heel ernstige bedenkingen heeft. Volgens hem moet eraan worden herinnerd dat de herfinanciering van de gemeenschapscommissies niet alleen één enkele gemeenschap ten goede komt maar dat ze voor beide voordelig is.
De heer Laeremans hekelt onder andere het feit dat verscheidene ministers de bespreking in de commissie kwamen bijwonen en kwamen antwoorden. Hij had geen bezwaar tegen de rechtstreekse verkiezing van de Brusselse leden van het Vlaams Parlement. Hij wees er echter op dat door het aanwijzen van vijf bijkomende leden de band tussen Brussel en het Vlaamse Parlement volledig wordt doorgeknipt en dat men via dit systeem bovendien één partij van de macht af wil houden.
Dit is volgens hem een flagrante schending van de democratische beginselen. Ook deze spreker verwijst naar het advies van de Raad van State, waarin onder meer wordt gesteld dat deze zaken ongrondwettelijk zijn.
Bovendien herhaalt hij nogmaals de verschillende bezwaren inzake grondwettelijke principes. Hij stelt ook dat inzake de bijkomende leden en de regeling waarbij de verdeelsleutel van het Vlaams Parlement zou worden gehanteerd, het duidelijk de bedoeling is om de krachtsverhoudingen binnen de Brusselse Hoofdstedelijke Raad te wijzigen, iets waarmee hij zich helemaal niet akkoord kan verklaren. Hij merkt bovendien op dat dit niet alleen ten nadele zou kunnen zijn van zijn partij, het Vlaams Blok, maar evengoed van de CVP, de op dit moment twee grootste Vlaamse partijen in Brussel.
Hij wenst bovendien ook toelichting te krijgen bij artikel 4.
Bovendien stelt hij dat het voorstel tot gevolg heeft dat er in de toekomst maximum 17 Vlaamse raadsleden zouden zijn in de Brusselse Hoofdstedelijke Raad, tegenover 72 Franstalige raadsleden. Hij concludeert daaruit dat de Vlamingen hierdoor definitief gereduceerd worden tot een minderheid, aangezien ze nooit meer zetels kunnen behalen dan 17 van de 89, wat betekent dat de Brusselse Vlamingen volgens hem voorgoed in een gemarginaliseerde positie worden geplaatst. Bovendien krijgen de Vlamingen volgens hem wel meer mandaten, maar zijn het machteloze mandaten, aangezien door de opheffing van de dubbele meerderheid de Vlaamse blokkeringsmacht wordt tenietgedaan.

Mijnheer de voorzitter, geachte collega's, ik heb hiermee de bijzonderste aspecten weergegeven van de uiteenzettingen in de commissie. De betogen bij de artikelsgewijze bespreking waren zeer beperkt en verwezen naar de discussiepunten die reeds bij de algemene bespreking werden aangehaald.
Ten slotte rest mij alleen te vermelden dat dit wetsontwerp werd aangenomen met 10 stemmen tegen 5, bij 1 onthouding.

Mijnheer de voorzitter, mijnheer de minister, geachte collega's, bij het overdenken van wat ik hier zou zeggen namens onze Vlaamse christen-democraten, dacht ik mij in eerste instantie te kunnen beperken tot de klassieke rol, van een oppositiepartij die de democratische functie vervult, door de andere zijde van de medaille te belichten en de nietverhulde aspecten van een beleid naar voren te brengen. Dat is een eerbaar standpunt. Er is een ander gezichtspunt dat een oppositiepartij evenzeer kan aannemen en dat is de volgende vraag. Zouden de Vlaamse christendemocraten zo'n akkoord hebben aangebracht of onderschreven en, als wij kritiek hebben, ligt die in het verlengde van eerder door mijn politieke beweging ingenomen standpunten? Ik kies voor die laatste benadering. Trouwens, ze is op termijn de meest geloofwaardige.
Voor de dioxineverkiezingen van 1999 had de CVP op basis van de bekende resoluties van het Vlaams Parlement gekozen voor vijf prioriteiten voor de deelstaten: ten eerste, homogene bevoegdheidspakketten, ten tweede, uitbreiding van de bevoegdheden onder meer naar de gezondheidszorgen en de kinderbijslagen, ten derde, de overheveling van de gemeente- en provinciewet, ten vierde, fiscale autonomie en ten vijfde, waarborgen voor de Brusselse Vlamingen op alle niveaus van het bestuur.
Ik kies voor de werkwijze deze vijf punten te toetsen aan het te bespreken wetsontwerp en wetsvoorstel en in het algemeen aan de zogenaamde Lambermont-akkoorden.
Inzake bevoegdheden, punt één en twee van het vijfpuntenprogramma, is de oogst mager, zowel wat het homogeen maken als de omvang betreft. In totaal gaat het hier om 7 miljard frank van 700 miljard frank die in het vijfpuntenprogramma van het Vlaamse Parlement zijn vervat en is te vergelijken met de 1.100 miljard frank van de actuele bevoegdheden. Aan degenen die nu beweren dat het Vlaamse Parlement een langetermijnplanning had uitgetekend, zeg ik dat het over een zeer lange termijn, ik zou bijna zeggen in het licht van de eeuwigheid gaat. Bovendien is er van een toegenomen duidelijkheid bij de voorgenomen nieuwe regionale materies geen sprake. Tal van belangrijke landbouwbevoegdheden blijven federaal en versplinterd over diverse ministeries en agentschappen - indien het agentschap trouwens bestaat. Sommigen zegden zelfs dat er een splinterbom op Landbouw is gegooid. Hoogtepunt is de regeling voor de besluitvorming binnen de Europese Raad voor de Landbouw waardoor een regio België kan dwingen tot onthouding en dus tot het opgeven van de verdediging van de belangen van de landbouwers zelf.
Inzake buitenlandse handel wordt de bestaande BDBH vervangen door een nieuw op te richten agentschap met alles erop en eraan, wellicht ook nieuwe benoemingen, en blijft de onduidelijkheid bestaan. Voor de rest is er niets, tenzij de overheveling van de organieke wetgeving op de openbare besturen. Hoewel de burgers hiermee maar onrechtstreeks te maken hebben, keuren wij deze stap goed. Wij hadden echter ons akkoord hierover steeds ondergeschikt gemaakt aan het invoeren van een dubbele meerderheid in de Brusselse Raad en aan waarborgen voor de Vlamingen te Brussel. Het opgeven van deze dubbele meerderheid is een echte achteruitgang, want vandaag is het de federale overheid die de beste waarborg voor de Brusselse Vlamingen vormt en die de veiligste weg naar een verbetering van hun statuut is. De gemeentewet in Brussel aan de Franstalige meerderheid overlaten, had ik persoonlijk niet voor mogelijk geacht.
Over de zogenaamde waarborgen op het gewestelijk en het gemeentelijk vlak is er reeds veel gezegd. Op geen van de beide niveaus is er van enige machtsverschuiving sprake. Enkele parlementsleden meer en één eenzame schepen in elke gemeente - die er trouwens reeds in 12 gemeenten is - betekent niets in termen van macht. Dat kon alleen als men de politieke agenda had verruimd en een herverdeling van de bevoegdheden tussen de gemeenten en het Gewest had doorgevoerd ten voordele van het gewest. Dat zou én het bestuur doelmatiger hebben gemaakt én de Vlamingen door de pariteit in de Executieve meer macht hebben gegeven. Die agenda was echter onmogelijk vanaf het ogenblik dat men de onderhandeling over Brussel alleen aan de Brusselaars en de burgemeesters overliet. Het federale niveau kwam nagenoeg alleen als waterdrager, omwille van het federale geld, tussenbeide.
Ik heb het niet eens over de perfide — het woord is niet van mij — ruil tussen meer geld en een eenzame schepen. Tot de volgende gemeenteraadsverkiezingen zal 5 miljard frank worden uitgegeven voor de mogelijkheid van twee groene schepenen. Perfide, maar efficiënt, zei de voorzitter van de VLD. Het is zelfs niet efficiënt.
Ik ben reeds aan het vijfde punt; meer fiscale autonomie, toe. Natuurlijk zijn wij het eens met de volledige autonomie over de gewestbelastingen, hoofdzakelijk over het onroerend goed. Daarover was iedereen het al lang eens. Elke onderhandeling, wie ook aan de onderhandeling of de staatshervorming zou hebben deelgenomen, zou dat resultaat hebben gegeven. Ik zou zelfs zeggen: het zou er nog aan ontbreken. Als het om de personenbelasting gaat, worden allerhande hindernissen opgeworpen en wordt de bewegingsruimte beperkt. Nu de monetaire eenheid niet meer de Belgische frank maar de euro is, moet men de Gewesten de gelegenheid geven zich rechtstreeks en ongeremd af te stemmen op de Europese fiscaliteit. Men moet niet eerst wachten op de convergentie in eigen land, zeker niet als we sneller kunnen gaan. Dat is de nieuwe, Europese logica waarin we ons bevinden. We moeten durven die nieuwe werkelijkheid lucide onder ogen te nemen.
Waarom heeft men aan de Gewesten ook niet de mogelijkheid gegeven om kortingen toe te staan op de vennootschapsbelasting? Men zou dit geld beter kunnen besteden dan aan de klassieke overheidssubsidiëring wat een verouderd instrument is van micro-economisch beleid. Kortingen op de bedrijfsbelasting hebben het voordeel het markteconomisch beginsel van "back the winner" toe te passen.
De fiscale autonomie van het huidige ontwerp wordt bovendien uitgehold doordat de Gewesten daarnaast een hoop middelen toegestopt krijgen voor wier heffing ze niet verantwoordelijk worden gesteld ten opzichte van hun kiezers. Het is nu reeds een onhoudbare situatie voor de federale overheid aan de burgers dubbel zoveel belastingen op te leggen als ze zelf kan uitgeven. Hier is een echt democratisch deficit aanwezig. De geldstroom bedraagt 17 miljard frank in 2002, loopt op tot 100 miljard frank in 2010 en 200 miljard frank in 2020.
De Vlaamse regering heeft de indruk willen wekken dat ook zij vragende partij was voor federaal geld. Enerzijds, was dit een tactiek om de federale geldkraan richting Zuiden open te zetten maar anderzijds, was dit het gevolg van het gebrek aan keuzes in het eigen Vlaamse beleid waaruit men zich alleen kan redden door verse middelen. De uitgaven voor de Vlaamse overheid stijgen in 2001 met 4,5% in reële termen, het dubbel van het bruto binnenlands product.
Het vijfpuntenprogramma is dus op verre na niet uitgevoerd. Als ik het vergelijk met het tienpuntenprogramma van de Vlaamse regering in 1992 dan is het Sint-Michielsakkoord een heel groot succes. De Volksunie zal zich herinneren hoe wij dit programma verwezenlijkten terwijl ze zelfs in de laatste onderhandelingen, in september 1992, op hun vraag niet aanwezig waren. We hielden toen echter nauw contact met alle strekkingen in alle partijen, zeker de meest Vlaamsvoelende: de Vlaamse christendemocraten en de Volksunie. Daarom kan ik ook antwoorden op de vraag of de Vlaamse christendemocraten het beter zouden hebben gedaan. Liggen hun standpunten vandaag in het verlengde van deze van vóór juni 1999? Het antwoord is tweemaal ja. Hebben anderen hun Vlaamse engagementen verbroken? Helaas, ja.
Nochtans zat er veel meer in die onderhandelingen. Ze startten al met een farce: de Costa. Ik hoor nog het tromgeroffel bij de start over de definitieve oplossing van onze communautaire problemen. De intergouvernementele en interparlementaire onderhandelingen werden letterlijk na enkele seconden een doodgewone interpartijenconferentie. Nooit was er sprake van Vlaams intern overleg of een Vlaams front zoals bij alle vorige staatshervormingen. De Costa kwam nauwelijks bijeen en takelde vlug af in een meerderheidsberaad, liefst 's nachts.
De methode maar nog meer de ingesteldheid was verkeerd. Niet een verdere verdieping van het federalisme stond op de agenda maar wel het paaien van een partij om haar in de boot van de Vlaamse regering te houden. Het tweede doel was het verzekeren van voldoende geldstromen naar de Franse Gemeenschap. Hoe een minimale hervorming tot stand brengen om een maximaal politiek rendement te kunnen bereiken? Dat was en dat is het doel.
Na jaren van immobilisme zou de meerderheid nu belangrijke, aanslepende problemen hebben opgelost; wordt gezegd. Wat is evenwel de waarheid. In 1995 waren zowel de federale als de Vlaamse regeringen het erover eens tijdens de komende legislatuur geen staatshervorming door te voeren.
In de periode 1992-1995 was immers een heel belangrijke doorbraak gerealiseerd. Van 1995 tot 1999 zou men de toekomst voorbereiden. Dat vandaag voorstellen alsof men niets kon of niets wilde doen, is gewoon historisch niet juist en de zoveelste leugen. Maar de leugen is een politieke methode geworden! In 1999 verviel de overgangsregeling voor de financiering van het onderwijs en alle Vlaamse partijen hadden hieraan een nieuwe ronde in de staatshervorming gekoppeld. De Sint-Elooisakkoorden waren al een negatie van deze Vlaamse tactische afspraken die inhielden van deze gelegenheid — het stoppen van de overgangsregeling — gebruik te maken om verder te gaan met de Vlaamse autonomie. Toen na Sint-Elooi bleek dat er nog meer geld nodig was voor de gemeenschappen, kwam er een tweede kans om een Vlaamse doorbraak te verwezenlijken. Die liet men andermaal liggen door financiële middelen toe te kennen aan de deelstaten met het tempo van een Mercedes en nieuwe bevoegdheden met het tempo van een trotinette, om een beeldspraak van enkele dagen geleden op een andere materie toe te passen.
De middelenoverdracht is bovendien zo omvangrijk dat er in lengte van jaren van Franstalige kant geen behoeften meer zullen zijn aan een verdere staatshervorming, terwijl de Vlaamse agenda een aanzienlijk aantal left overs omvat. In Europa weten wij hoe moeilijk het was in Nice de left overs van Amsterdam in te vullen. Men heeft blijkbaar het nieuwe communautaire klimaat niet kunnen ombuigen in het Vlaamse voordeel. Trouwens, dat klimaat is een mythe. De interne communautaire disputen tussen de federale ministers zijn nu groter - dat erkent iedereen - dan in het recente verleden. Dat moet worden gecompenseerd door een externe vrede tussen de federale en de deelstatelijke regeringen, maar zelfs dat is een mythe: na twee jaar communautaire vrede is er zelfs nog geen enkel cultureel verdrag tussen de twee gemeenschappen. Maar men vergeet dat de grootste aanslag tegen de communautaire vrede tijdens de vorige legislatuur de poging tot blokkering van de Brusselse instellingen was vanwege VLD en VU na het ontslag van vader Anciaux. Alleen dankzij budgettaire creativiteit konden welzijns- en gezondheidsinstellingen en welzijns- en gezondheidswerkers blijven betaald worden. Alleen op het nippertje kon men de VLD overtuigen het verdrag van Amsterdam in de Gemeenschappelijke Gemeenschapscommissie goed te keuren. Ik weet dat het geen postmoderne gewoonte is een geheugen te hebben, maar zoals u weet ben ik geen postmodernist.
Dat brengt mij ertoe een andere toepassing van het postmodernisme te onderstrepen: het primaat van de politiek. De achteloosheid waarmee men het advies van de Raad van State over Brussel heeft behandeld is typisch voor deze mentaliteit. De strijdigheid met de essentiële beginselen van de democratie en met een aantal grondrechten, wordt weggewuifd. De Grondwet en het Europees Verdrag voor de rechten van de mens moeten wijken voor de politieke wil om Lambermont door te drukken. Men neemt er het risico bij dat en de overheveling van de Gemeentewet en het Brusselakkoord door het Arbitragehof vernietigd kunnen worden. Cynisch denkt men dat dit probleem zich zal voordoen voor de volgende legislatuur. Pluk de dag. Elke dag brengt zijn eigen leed mee. Zonder Lambermont is de federale meerderheid bedreigd, dat weet iedereen, ook al doet men alsof dat nu plots geen deel meer is van het regeerakkoord. Noteer dat als Lambermont er toch komt, de Vlaamse en federale meerderheid haar triomfalisme nauwelijks zal kunnen verbergen en een nieuwe vreugdedans zal uitvoeren op het Martelarenplein, zoals dat twee jaar geleden ooit nog eens het geval was. Maar als Lambermont faalt, dan zal men doen alsof er niets aan de hand is. Naast het hooghartig gebrek aan eerbied voor de Grondwet, doet de chantage op personen en partijen mij opnieuw denken aan Egmont en de sfeer die daarrond hing. Het Egmontpact werd nooit goedgekeurd door het Parlement. Zelfs de opvolger van het pact in 1980 kreeg geen voldoende bijzondere meerderheid.
Ik hoop dat dit opnieuw het geval is. Men moet echter goed weten dat degenen die zich laten afdreigen of paaien met kruimels, het belangrijkste verliezen wat men kan bezitten, met name zelfrespect of de eerbied van anderen. Wie respect verliest wordt meegesleurd van de ene vernedering naar de andere. Die partijen, personen of partij, maken zichzelf wijs dat zij constructief zijn, maar in de harde politiek tellen zij in de toekomst niet meer mee; zij werden eens gewogen, maar te licht bevonden.
Er is leven na Lambermont en er is zeker leven na deze regering. Het wetsontwerp en het wetsvoorstel die thans ter stemming worden gelegd zijn niet in hun inwerkingstelling gebonden aan het ontwerp van bevoegdheden dat in de Senaat aan de orde is. Het is dus zelfs mogelijk dat er een meerderheid is voor het geld, maar niet voor de bevoegdheden. Het kan ook zijn dat als er een meerderheid is voor het geld, het ontwerp over de luttele bevoegdheden en over Brussel door de strot van sommigen zal worden geramd. Het ene is gewoon bedrog, het andere is chantage; vakkundige, professionele chantage, maar niettemin chantage.
Wat een verschil met de politieke cultuur van enkele jaren geleden, toen een akkoord tussen vier federale meerderheidspartijen werd gesteund door drie oppositiepartijen. Die openheid mocht ik ditmaal niet waarnemen; integendeel, elke tegenstander van Lambermont is een extremist. De beschuldigingen zijn tekenend voor de slogandemocratie waarin wij zijn verzeild en paralyseren trouwens het extremisme.
Met overtuiging zal mijn fractie dit ontwerp verwerpen. Het aantal argumenten hiervoor vanuit een Vlaams standpunt en vanuit een goede werking van de instellingen, is indrukwekkend. Wij zijn bereid in het voorjaar van 2002 een volledig nieuwe onderhandeling te voeren om het federalisme in dit land werkelijk een kans te geven om zich te verdiepen. De voorwaarde daartoe is evenwel het eind van Lambermont. Daarvoor zijn de beroemde vijf minuten politieke moed nodig. Vijf minuten politieke moed! Hopelijk worden zij gevonden.

Mr. Speaker, Mr. Minister, Dear colleagues, thinking about what I would say here on behalf of our Flemish Christian Democrats, I thought I could initially limit myself to the classical role, of an opposition party that fulfils the democratic function, by highlighting the other side of the medal and bringing out the uncovered aspects of a policy. That is an honest position. There is another point of view that an opposition party can take equally, and that is the next question. Would the Flemish Christian Democrats have made or endorsed such an agreement and, if we have criticism, is it in the length of positions previously taken by my political movement? I choose this last approach. In the long run, it is the most credible.
For the dioxin elections of 1999, the CVP had chosen five priorities for the counties based on the well-known resolutions of the Flemish Parliament: first, homogeneous powers packages, second, extension of powers to include health care and child benefits, third, the abolition of the municipal and provincial law, fourth, fiscal autonomy and fifth, guarantee for the Brussels Flamings at all levels of administration.
I choose the method to test these five points on the draft law and the draft law to be discussed and in general on the so-called Lambermont agreements.
In terms of competence, points one and two of the five-point programme, the harvest is low, both in terms of homogeneity and size. In total, this is 7 billion francs of 700 billion francs contained in the five-point programme of the Flemish Parliament and is comparable to the 1,100 billion francs of the current powers. To those who now claim that the Flemish Parliament had drafted a long-term planning, I say that it is about a very long-term, I would almost say it is in the light of eternity. Furthermore, there is no increased clarity in the proposed new regional matters. Numerous important agricultural powers remain federal and scattered across various ministries and agencies - if the agency, by the way, exists. Some even said that a split-bomb was thrown on Agriculture. The highlight is the arrangement for decision-making within the European Council for Agriculture which allows a region of Belgium to force abstinence and thus to give up the defense of the interests of the farmers themselves.
With regard to foreign trade, the existing BDBH will be replaced by a new agency to be established with everything on and on, possibly new appointments, and the uncertainty remains. For the rest there is nothing, except the overthrow of organic legislation on public administrations. Although the citizens are only indirectly involved in this, we endorse this step. However, we had always subordinated our agreement on this to the introduction of a double majority in the Brussels Council and to guarantees for the Flamings in Brussels. Giving up this double majority is a real downturn, because today it is the federal government that is the best guarantee for the Brussels Flag and that is the safest way to improve their status. To leave the municipal law in Brussels to the French-speaking majority, I personally did not consider it possible.
Much has been said about the so-called guarantees at the regional and municipal level. At no one of the two levels there is any power shift. A few members of parliament more and one single ship in each municipality – which, by the way, already exists in 12 municipalities – means nothing in terms of power. This could only be achieved if the political agenda had been broadened and a redistribution of powers between the municipalities and the Region had been carried out for the benefit of the region. That would have both made the administration more efficient and given the Flamings more power through parity in the Executive. That agenda, however, was impossible from the moment when the negotiation on Brussels was left to the Brusselsers and the mayors alone. The federal level came almost only as a water carrier, for the sake of the federal money, intervention.
I do not agree about the perfide — the word is not mine — exchange between more money and a lonely ships. Until the next municipal council elections, 5 billion francs will be spent on the possibility of two green creatures. Perfide, but efficient, said the Chairman of the VLD. It is not even efficient.
The fifth point, more tax autonomy. Of course, we agree with full autonomy over regional taxes, mainly on real estate. Everyone has agreed on this for a long time. Any negotiation, whoever would have participated in the negotiation or the state reform, would have given that result. I would even say: it would still be missing. When it comes to personal taxation, all sorts of obstacles are raised and the space for movement is limited. Now that the monetary unit is no longer the Belgian franc but the euro, it is necessary to give the regions the opportunity to directly and unhinderedly align themselves with European fiscality. One should not wait for convergence in one’s own country first, ⁇ not if we can move faster. This is the new European logic in which we stand. We must dare to face this new reality lucid.
Why have the regions not also been given the possibility to allow discounts on corporate tax? One could spend this money better than on classical government subsidies, which is an outdated instrument of micro-economic policy. Reductions on corporate tax have the advantage of applying the market economy principle of "back the winner".
In addition, the fiscal autonomy of the current draft is undermined by the fact that the Regions are also given a lot of resources for the taxation of which they are not held accountable to their voters. It is already an unsustainable situation for the federal government to impose on citizens twice as many taxes as it can spend itself. There is a real democratic deficit. The cash flow amounts to 17 billion francs in 2002, to 100 billion francs in 2010 and 200 billion francs in 2020.
The Flemish government has wanted to create the impression that it was also the party asking for federal money. On the one hand, this was a tactic to open the federal money crane towards the South, but on the other hand, this was due to the lack of choices in the own Flemish policy, from which one can save only by fresh resources. The expenditure for the Flemish government increased in 2001 by 4.5% in real terms, twice the gross domestic product. Their

However, there was much more in those negotiations. They started with a farce: the Costa. I am still hearing the trumpet at the beginning about the definitive solution to our community problems. The inter-governmental and inter-parliamentary negotiations became literally, after a few seconds, an ordinary inter-party conference. There has never been a Flemish internal consultation or a Flemish front as in all previous state reforms. The Costa barely gathered and quickly settled in a majority council, preferably at night.
The method but even more the setting was wrong. Not a further deepening of federalism was on the agenda, but the stealing of a party to keep it in the boat of the Flemish government. The second goal was to ensure sufficient cash flows to the French Community. How can a minimum reform be achieved in order to ⁇ maximum political yield? That was, and that is the goal.
After years of immobilism, the majority would now have solved important, pressing problems; it is said. But what is the truth. In 1995, both the federal and Flemish governments agreed not to carry out state reform during the upcoming legislature.
In the period 1992-1995 a very important breakthrough was achieved. From 1995 to 1999, the future should be prepared. To present today as if one could do nothing or wanted to do nothing is simply historically incorrect and yet another lie. But the lie has become a political method! In 1999, the transitional arrangement for the financing of education was terminated and all Flemish parties had linked a new round in the state reform. The Saint-Elooisac Accords were already a negation of these Flemish tactical arrangements which included using this opportunity — the stop of the transitional arrangement — to continue with the Flemish autonomy. When after Sint-Elooi it turned out that more money was needed for the communities, there was a second chance to ⁇ a Flemish breakthrough. This was again neglected by granting financial resources to the states at the pace of a Mercedes and new powers at the pace of a trotinette, in order to apply an image of a few days ago to another matter. Without Lambermont, the federal majority is threatened, that everyone knows, even though one pretends that is now suddenly no longer part of the government agreement. Note that if Lambermont comes there anyway, the Flemish and federal majority will hardly be able to hide its triumphalism and perform a new joy dance on the Martyrs Square, as it was two years ago once again. But if Lambermont fails, one will act as if nothing is going on. In addition to the arrogant lack of respect for the Constitution, the blackmail of individuals and parties reminds me once again of Egmont and the atmosphere surrounding it. The Egmont Pact was never approved by Parliament. Even the successor to the 1980 pact did not obtain a sufficient special majority.
I hope this will be the case again. However, one should be well aware that those who let themselves be threatened or squeezed with crumbs lose the most important thing one can possess, especially self-respect or the respect of others. Those who lose respect are dragged from one humiliation to another. Those parties, individuals or parties, make themselves aware that they are constructive, but in hard politics they no longer count in the future; they were once weighed, but found too light.
There is life after Lambermont and there is surely life after this government. The draft law and the draft law which are now put to the vote are not, in their entry into force, bound by the draft of powers discussed in the Senate. So it is even possible that there is a majority for money, but not for the powers. It may also be that if there is a majority for the money, the draft on the luttle powers and on Brussels will be framed by the throat of some. One is simply deception, the other is blackmail; skilled, professional blackmail, but nevertheless blackmail.
What a difference with the political culture of a few years ago, when an agreement between four federal majority parties was supported by three opposition parties. I could not see that openness this time; on the contrary, every opponent of Lambermont is an extremist. The accusations are characteristic of the slogan democracy in which we are embroiled and paralyze, by the way, extremism.
With conviction, my group will reject this draft. The number of arguments for this from a Flemish point of view and from the proper functioning of the institutions is impressive. We are ready to conduct a completely new negotiation in the spring of 2002 in order to truly give the federalism in this country a chance to deepen itself. However, the prerequisite for this is the end of Lambermont. This requires the famous five minutes of political courage. Five minutes of political courage! Hopefully they will be found.

Monsieur le président, monsieur le ministre, chers collègues, cela fait à présent plusieurs mois que notre activité politique est mobilisée par la question des accords institutionnels et du refinancement des communautés. Il faut bien reconnaître que si ces questions nous préoccupent aujourd'hui, ce n'est sans doute pas parce que l'homme politique ni - moins encore - le citoyen ne sont passionnés par les thématiques communautaires. C'est tout simplement parce qu'il est vital d'assurer un financement récurrent et digne de ce nom de nos entités fédérées.
Pour bien comprendre l'enjeu du débat, il faut remonter à la loi du 16 janvier 1989 qui institua le financement des communautés et des régions. Cette loi, résultat de l'accord gouvernemental de 1988 auquel nous n'étions pas associés et suite logique de la loi spéciale du 8 août 1988, portait en elle les germes des difficultés que nous rencontrons aujourd'hui et la nécessité d'un refinancement ultérieur des entités fédérées.
En effet, les mécanismes de financement des entités fédérées prévus en 1989 étaient totalement insuffisants, notamment au regard des compétences qui ont été transférées à ce moment et des besoins que cela a entraînés. Ces mécanismes étaient déjà décrits à l'époque comme temporaires et transitoires.
Ceux qui ont négocié la loi de financement, qui en sont les pères même si certaines paternités ne sont parfois pas revendiquées, savaient assurément que le problème resurgirait et qu'il faudrait à nouveau renégocier pour obtenir des moyens supplémentaires. C'est pourquoi le projet de loi qui nous est soumis aujourd'hui traite de refinancement. Il tend à réaliser l'équilibre entre la responsabilité financière des entités fédérées et la solidarité au sein de l'Etat fédéral. C'est là l'essence même du fédéralisme et cela aurait dû être le fil conducteur des réformes institutionnelles des années 1980.
J'évoquerai brièvement la situation qui prévaut aujourd'hui et qui résulte précisément de cette loi de financement de 1989.
Pour les régions d'abord, la répartition des moyens est actuellement basée sur les montants des dépenses de l'Etat central, donc en fait sur les crédits budgétaires de 1989, et ce pour les nouvelles matières transférées aux régions. Comme pour le fonds des provinces et des communes, la répartition des moyens est aussi basée sur les montants des dotations attribuées par la loi du 9 août 1980. C'étaient là les trois masses financières qui constituaient les montants de base du financement des régions.
Notons que les montants de base pour les dépenses courantes, c'est-à-dire pour les nouvelles compétences ou pour le fonds des provinces et des communes, n'ont pas été transférés dans leur totalité en 1989. Ils ont été transférés à concurrence de 98 % seulement pour cause de participation des régions à l'austérité budgétaire. On partait déjà sur de mauvaises bases qui ne permettaient pas de faire face aux dépenses.
Sans compter le fait que les trois grandes masses budgétaires évoquées étaient simplement indexées et ce seulement à partir de 1990 et qu'elles n'étaient, en tout cas, pas liées à la croissance.
Par ailleurs, les régions, comme en 1980, disposent de recettes fiscales provenant de sept impôts régionaux, dont la recette leur était attribuée en tout ou en partie et sur lesquels elles pouvaient exercer une autonomie fiscale limitée. Les Régions — élément intéressant à souligner - sont depuis 1994 autorisées à percevoir des centimes additionnels, indépendamment du projet en cours et à accorder des remises sur la partie du produit de l'IPP qui leur était attribuée.
Selon le premier ministre de l'époque, M. Dehaene, plus de 90 % des moyens des régions étaient financés par le produit ristourné de l'impôt des personnes physiques. Donc, les régions disposent d'une large autonomie financière dans le sens où elles peuvent utiliser librement des moyens financiers qui leur sont accordés. En fait, il s'agit bien d'une autonomie fiscale limitée. En ce qui concerne les communautés, la source du financement résulte d'impôts partagés à l'heure actuelle (la partie attribuée du produit de la redevance radio/télévision qui dorénavant sera transférée aux régions, la TVA et l'IPP), de recettes non fiscales mais aussi d'emprunts.
La partie attribuée de la TVA correspond aux crédits pour l'enseignement. Dès 1989, le gouvernement a pris la décision, je le rappelle, d'amputer les montants de base de la partie attribuée de la TVA au détriment des communautés et donc de l'enseignement. Cela signifie à l'époque déjà une perte de près de 5 milliards de francs belges pour la Communauté française. Certes, il s'agissait d'une réduction exceptionnelle, non récurrente, visant entre autres à réaliser une économie en matière d'alimentation du Fonds des bâtiments scolaires. Mais, ce fut là aussi un mauvais départ pour la Communauté française.
Les montants de base TVA sont en fait simplement indexés et ce à partir de l'année budgétaire 1990 et adaptés à l'évolution du nombre d'habitants de moins de 18 ans. Concernant ce dernier point, qu'il me soit permis de regretter aujourd'hui encore la clef de répartition des habitants pour la Région de Bruxelles-Capitale, retenue par les partenaires au gouvernement à l'époque, c'est-à-dire 80 % de francophones et 20 % de néerlandophones. Ce financement de l'enseignement était organisé de la sorte jusqu'en 1999, date à laquelle il devait être revu sur la base de critères objectifs à fixer par la loi. Ce sont d'ailleurs les accords de la saint Eloi qui ont permis de rectifier le tir à cet égard.
La redevance radio/télévision est jusqu'à présent une autre source de financement des communautés. C'est la partie du produit de la redevance localisée dans la région de langue française ou flamande qui est prise en compte. Et il faut à nouveau de regretter la clef identique retenue pour la Région de Bruxelles-Capitale qui ne correspond pas aux réalités sociologiques bruxelloises et qui, depuis, est d'ailleurs considérée comme un acquis par les néerlandophones.
Aussi, les moyens accordés tant aux régions qu'aux communautés sont insuffisants. Ils ont été négociés sans véritable concertation avec les exécutifs des entités fédérées. Le mécanisme de base pour le transfert de la partie attribuée à l'impôt des personnes physiques aux communautés est fondé sur le même principe que pour les régions, c'est-à-dire le passage sur dix ans de la répartition des moyens selon les dépenses de 1989 à une répartition des moyens selon le produit localisé de l'impôt.
En ce qui concerne plus spécifiquement l'enseignement, l'échec du financement résulte incontestablement de l'absence de liaison des recettes TVA à la croissance du PNB. En 1989 déjà, les projections faites à partir de différentes hypothèses de travail laissaient présager sans aucun doute que le financement négocié menait à de graves difficultés pour la Communauté française.
Pour reprendre à nouveau le secteur de l'enseignement, une projection du rapport entre les dépenses d'enseignement simplement indexées et les moyens affectés de la TVA, permettait de prévoir une catastrophe certaine, puisque, à l'époque, un écart de 27 milliards de francs était déjà prévu en 2000, c'est-à-dire au bout de ces dix années de financement des communautés issu de cette loi de 1989.
D'un point de vue plus global, on pouvait aisément se rendre compte que les mécanismes de financement mis en place allaient aboutir à une réduction régulière des moyens affectés par l'Etat central aux communautés, obligeant ces dernières à des réductions drastiques de dépenses et à des sacrifices importants qui ne feraient jamais que limiter les dégâts.
Je rappelle une étude réalisée par le CRISP en 1989, qui mettait en évidence des difficultés pour la Région wallonne entre 1989 et 1996 et d'importants problèmes pour la Communauté française dès 1989, s'intensifiant dans les années qui allaient suivre. Cette étude se concluait par ces termes édifiants, que je rappelle: "le contexte des restrictions budgétaires qui sous-tend les mécanismes de financement prévus pour l'enseignement, c'est-à-dire non-liaison à la richesse nationale et liaison avec une réduction démographique, risque de privilégier les aspects financiers au détriment de la mise en oeuvre de politiques axées sur la qualité de l'enseignement et la recherche de solutions à des problèmes comme les échecs scolaires ou l'insertion professionnelle."
Il est important, me semble-t-il, de voir d'où l'on vient, pour mieux comprendre où nous espérons aller. Se tourner vers le passé et faire de l'introspection, en particulier au niveau de tous les groupes francophones, sont des choses utiles. Mais ce qui est fondamental, tout en assumant les erreurs du passé — pour ceux qui doivent les assumer -, c'est de prendre ses responsabilités, de saisir les opportunités d'assurer l'avenir, cette fois de manière durable.
Je souhaiterais aborder quelques éléments essentiels des accords du Lambermont et mettre en avant les points qui, à nos yeux, justifient que notre assemblée approuve le présent projet de loi.
D'abord, le financement des communautés. J'ai évoqué les raisons qui expliquent la situation financière catastrophique de la Communauté française et d'ailleurs de l'ensemble des communautés en matière d'enseignement, et l'absolue nécessité de son refinancement. Les accords institutionnels du Lambermont assurent un refinancement durable, c'est-à-dire récurrent, des communautés. Je rappelle que dès 2002, les moyens financiers supplémentaires vont être accordés aux entités fédérées: 8 milliards en 2002, 6 en 2003 et en 2004, 15 en 2005, 5 en 2006 et de 2007 à 2011, un milliard de francs supplémentaire par année. Ces montants sont cumulatifs. Ils permettent de se rendre compte de l'effort particulier opéré par le fédéral pour assurer la viabilité de nos entités fédérées, puisqu'ils viennent s'ajouter aux moyens et dotations habituels.
Il est particulièrement important de souligner que les accords prévoient la liaison de l'ensemble des moyens financiers — donc des moyens nouveaux, mais aussi de la dotation classique — à la croissance à partir de 2007. Et si l'on regarde les chiffres de plus près, on peut affirmer que les moyens des communautés sont liés à la croissance dès 2002, puisque les moyens supplémentaires qui sont accordés correspondent grosso modo à la croissance pour les années 2002 à 2006. Un parallélisme entre l'évolution des moyens de l'Etat fédéral et celle des moyens des communautés est ainsi atteint. C'est, comme je l'ai déjà expliqué, cette absence totale de liaison jusqu'en 1993, et puis très partielle à partir de 1994 (puisque seulement 30% de la dotation IPP était à cette époque liée à la croissance), qui a causé la situation de fait que la Communauté française connaît aujourd'hui.
Certes, les moyens nouveaux seront répartis entre les communautés sur la base du principe du juste retour. Mais le projet de loi prévoit une période de transition jusqu'en 2012. Et l'on notera que seuls les moyens nouveaux — c'est-à-dire 100 milliards de francs pour cette date — seront répartis selon ce principe. Président: Jean-Pol Henry, premier vice-président. Les moyens de base, c'est-à-dire la dotation TVA restent répartis selon la clé issue des accords de la Saint-Eloi, c'est-à-dire le principe: "un élève égale un élève". Pour la seule Communauté française, le refinancement est estimé à plus de 3 milliards en 2002 et à 33 milliards à l'horizon 2010. Ce refinancement est, comme l'a souligné le gouvernement à l'occasion des travaux en commission, une nécessité objective pour les deux grandes communautés de ce pays puisque la loi de financement de 1989 a fait constamment décroître les moyens attribués, alors qu'une pression à la hausse sur les dépenses était sans cesse exercée.
Une dotation complémentaire sera attribuée aux communautés en remplacement de la redevance radio télévision. Ainsi, le montant de cette taxe leur est définitivement garanti, même si cette taxe venait à disparaître sous l'effet d'une décision des régions. Cela représente 10 à 12 milliards de francs pour la Communauté française. Même si les communautés n'auront pas leur sort fiscal entre les mains, la liaison des recettes à la croissance devrait enfin leur permettre de garder le cap financièrement.
En ce qui concerne les régions et l'extension de leurs responsabilités fiscales, elles disposent déjà du produit d'une série d'impôts et parfois d'une autonomie fiscale limitée relative à certains d'entre eux. Les accords institutionnels prévoient le transfert financier d'une série d'impôts vers la région dans le respect du principe de neutralité budgétaire. La régionalisation ainsi opérée répond à une logique: accorder à ces entités davantage de compétences en ce qui concerne les impôts régionaux et les autres impôts apparentés. Ce n'est pas un non-sens dans un Etat fédéral accompli. Les régions sont actuellement compétentes en matière d'urbanisme et de mobilité. Le transfert aux régions de compétences en matière de fiscalité automobile ou de fiscalité immobilière en est donc la suite logique.
Nous n'avons pas hésité non plus à être cohérents dans l'autre sens, puisque le projet de loi confie l'exercice exclusif de toutes les compétences relatives aux écotaxes à l'autorité fédérale. Cette attribution était indiquée compte tenu du caractère extrêmement mobile de ces impôts. Dans l'optique d'un fédéralisme achevé et responsable, le projet de loi opère le transfert de la pleine autonomie vis-à-vis de ces impôts aux régions. Les régions pourront dès lors déterminer la base d'imposition mais aussi les exonérations ainsi que les taux.
Dans la même logique, les régions qui le souhaitent pourront procéder elles-mêmes à la perception de ces impôts à dater de 2005 et, dans ce cas, une dotation spécifique sera prévue ainsi qu'un transfert de personnel. Les accords prévoient cependant des garanties que je souhaiterais mettre en évidence parce qu'elles me semblent importantes.
- Le système d'échange d'informations qui est mis en place, la circulation de l'information bien nécessaire, utile non seulement lorsque les régions souhaitent que le fédéral continue à percevoir les impôts pour leur compte mais également lorsqu'elles souhaitent procéder ellemêmes à cette perception. Cet échange d'informations est effectivement prévu dans un accord de coopération.
- Le revenu cadastral reste fédéral, même si les régions peuvent s'en servir comme base d'imposition. Une agence de la documentation patrimoniale est créée qui sera financée par le fédéral et comprendra du personnel mis à sa disposition. Elle gérera les aspects de droit de propriété et les aspects fiscaux.
- En ce qui concerne les droits de succession, une nouvelle garantie a été introduite. Il s'agit d'une disposition anti-concurrence entre régions puisqu'elle prévoit que l'entité qui perçoit les droits de succession n'est plus automatiquement celle où le contribuable était domicilié mais bien celle où il a eu son domicile le plus longtemps durant les cinq dernières années.
Un volet de l'accord institutionnel prévoit de clarifier et préciser les conditions dans lesquelles les régions peuvent exercer leurs compétences en matière d'impôts des personnes physiques. Il ne faut guère s'en cacher, cet élément était une revendication importante de la région flamande du pays. On pourra toujours dire que cet élément a été cédé en contrepartie du refinancement de la Communauté française exigé par les francophones. Cela étant dit, en entendant les propos du CVP en commission de la révision de la Constitution, je pense que les francophones peuvent se rassurer au regard des garanties prévues et des limites imposées puisqu'en effet, M. Van Rompuy en commission a été jusqu'à regretter cet aspect-là de l'accord, tant il serait en retrait par rapport à la situation actuelle, et restrictif pour les régions. S'il est vrai que les régions sont autorisées, dans la situation actuelle, à accorder des soustractionnels ou à prélever des additionnels à l'IPP, il faut reconnaître que la procédure prévue est peu transparente et dépend du bon vouloir de l'Etat fédéral. L'option prise et défendue dans le présent projet est de clarifier les règles du jeu, de les fixer dans la loi spéciale et de définir les limites de l'acceptable dans un Etat fédéral tout en reconnaissant l'autonomie aux régions et leur droit à mieux définir leurs besoins sans devoir perpétuellement dépendre de ce qui peut être accordé par le niveau fédéral.
J'évoquais les garanties, les limites prévues par le projet de loi. Je reprends celles qui nous paraissent les plus essentielles.
Première garantie: les mesures que prendrait une région ne peuvent avoir pour effet de diminuer la progressivité de l'impôt sinon la région courrait le risque d'une migration et d'une délocalisation fiscale. Clairement, cela signifie qu'à mesure que le revenu imposable augmente, le rapport entre le montant de la réduction et celui de l'impôt dû avant réduction ne peut pas augmenter. Une région ne pourrait dès lors faire en sorte que les personnes qui gagnent plus paient de moins en moins d'impôts proportionnellement.
Deuxième garantie: les régions doivent exercer leurs compétences en la matière sans concurrence fiscale déloyale.
Troisième garantie: la fixation de marges, ce qui n'existait pas préalablement, permettant aux régions de prévoir des centimes additionnels ou soustractionnels généraux forfaitaires ou proportionnels, différenciés ou non par tranche d'impôt ou introduire des déductions générales d'impôts liées à leurs compétences. Ces marges sont toujours exprimées par rapport au produit de l'IPP localisé dans chaque région et sont fixées à 3,25 et 6,75. Ces marges concernent bien l'ensemble des mesures prises par une région.
Quatrième garantie : les mesures envisagées doivent impérativement être communiquées au préalable au ministre fédéral des Finances, son administration étant en charge de l'application de la mesure. Le ministre fédéral des Finances est donc amené à donner son avis quant à la faisabilité technique de la mesure envisagée. L'échange d'information, la communication sont également prévus entre les régions pour les décrets fiscaux, cet élément étant réglé par des accords de coopération. Le contrôle des marges et des principes de la progressivité de l'impôt, comme celui du principe de la non-concurrence fiscale déloyale est assurée a priori par la Cour des comptes et un recours en annulation ou en suspension est ouvert devant la Cour d'arbitrage au titre des règles de répartition des compétences. Il est clair que le concept de concurrence fiscale déloyale devra être mieux défini et précisé par la jurisprudence de la Cour d'arbitrage.
La base d'imposition restera uniforme quelles que soient les mesures prises, puisque les réductions ne pourront être appliquées que sur le montant de l'impôt dû et non pas sur la base d'imposition, ce qui est important. Les mesures régionales en matière de fiscalité à l'IPP seront donc neutres pour les communes — on parle beaucoup des finances communales — et pour le calcul du mécanisme de solidarité entre les régions c'est-àdire l'intervention de solidarités nationales.
Il est intéressant de constater que les mesures envisagées vont permettre aux régions d'obtenir plus de 50% de leurs moyens grâce au prélèvement de leurs propres impôts. C'est un changement par rapport à la situation actuelle puisque la grande partie des moyens octroyés le sont directement par l'Etat fédéral via la dotation IPP. Cette dernière sera réduite à due concurrence des montants résultant des transferts opérés par les accords. C'est là le respect du principe de la neutralité budgétaire.
En conclusion, monsieur le président, mes chers collègues, je dirais que les modes de financement prévus en 1989 n'ont pas permis - il faut se rendre à l'évidence et savoir reconnaître, mesdames et messieurs, les faiblesses des engagements pris - d'assurer un bon fonctionnement des entités fédérées et en particulier des communautés. Même faire face aux dépenses prévisibles indexées, à politique inchangée, était chose impossible pour les communautés.
Ce manque de moyens s'est fait cruellement sentir au niveau de l'enseignement. Non seulement, la qualité de l'enseignement en Communauté française en a souffert mais il a été quasi impossible de faire face aux nombreux problèmes et besoins nouveaux de la population scolaire. Les enseignants eux-mêmes ont subi et subissent encore les conséquences de ce manque de moyens.
Notre pays s'est engagé, à une certaine époque, dans la voie du fédéralisme, en transférant aux entités fédérées des compétences autrefois gérées par l'Etat central. Même si la fédéralisation de l'Etat belge n'a pas été appelée des voeux de tous car les opinions étaient variées, il faut reconnaître qu'avec le temps, les choses se sont imposées et que les structures institutionnelles que nous connaissons aujourd'hui sont un fait, une réalité. Notre rôle aujourd'hui est simplement de mieux faire fonctionner les institutions et le fédéralisme.
Cela signifie d'abord donner aux entités fédérées les moyens dont elles ne disposaient pas jusqu'à présent, pour faire face aux compétences qui sont les leurs.
Mieux faire fonctionner le fédéralisme, c'est aussi reconnaître, comme dans tout Etat démocratique fédéral, la nécessaire autonomie financière des entités fédérées, obtenir des moyens autrement qu'en allant mendier auprès de l'Etat fédéral, permettre d'alimenter ces moyens ou de les réduire par le biais de sa propre fiscalité, tout en imposant des limites dictées par le cadre dans lequel les entités vivent, c'est-à-dire l'espace fédéral.
Mieux faire fonctionner le fédéralisme, c'est encore reconnaître que les moyens des entités fédérées doivent croître dans les mêmes conditions que les moyens de l'Etat fédéral. En période de croissance, il est logique que la redistribution des fruits puisse se faire à tous les niveaux de la structure institutionnelle. Lorsque les moyens financiers de l'Etat fédéral augmentent, lorsque les marges budgétaires se dégagent, il n'est pas insensé de permettre aux communautés d'investir dans l'avenir, c'est-à-dire notamment dans l'enseignement. Ne pas le permettre est au contraire absurde et indigne d'un Etat qui, en principe, fonde son devenir sur la formation des jeunes, ce qui nécessite des moyens importants.
Certes, des concessions ont été faites, de part et d'autre, dans ces accords, pour assurer cet objectif de refinancement, plus urgent dans l'immédiat pour la Communauté française, c'est exact.
Certes, les accords institutionnels constituent un compromis. Il y a des éléments qui nous conviennent mieux que d'autres, il faut le reconnaître. Certains aspects sont même parfois difficiles à digérer. Mais un accord s'évalue dans sa globalité et au regard de l'objectif poursuivi et, dans le cas présent, de l'objectif que nous devions atteindre, à savoir obtenir des moyens supplémentaires pour les communautés pour l'enseignement, notamment de la Communauté française.
Cet objectif s'impose à nous tous, tous les francophones de ce pays. Que nous ayons ou non participé aux précédentes réformes institutionnelles, que nous soyons ou non au pouvoir aujourd'hui, atteindre l'objectif est en l'espèce une impérieuse nécessité. Ne pas saisir cette opportunité serait une grave erreur. Ce serait se rendre responsable d'énormes difficultés pour la Communauté française. Ce serait aussi se placer dans une position encore plus difficile s'il fallait renégocier.
On ouvre enfin pour les communautés de véritables perspectives d'avenir, la possibilité de s'inscrire dans la société de la connaissance, celle aussi de mener concrètement des actions utiles à l'émancipation des personnes et au bien-être des gens. Cette occasion ne se représentera plus de sitôt, c'est un fait, et les conditions de négociation et le climat ne seront plus jamais les mêmes. Mais au-delà, j'ose affirmer que ces accords sont équilibrés, en ce sens qu'ils répondent aux aspirations légitimes de chacune des entités fédérées. S'il est faux de croire et de dire que seule la Communauté française a besoin d'argent, il est tout aussi faux de croire et de dire que, dans l'avenir, les compétences fiscales des régions en matière d'IPP ne serviront jamais les francophones de ce pays. J'ai l'ambition de croire que, dans la foulée de la réforme fiscale, toutes les régions de ce pays auront pour objectif de pouvoir un jour concourir elles-mêmes à la diminution de la pression fiscale dans ce pays.
C'est la raison pour laquelle je pense que l'ensemble des volets de cet accord concerne toutes les entités fédérées.

Mr. Speaker, Mr. Minister, dear colleagues, for several months now our political activity has been mobilized by the question of institutional agreements and the refinancing of communities. It must be acknowledged that if these issues concern us today, it is probably not because the politician and – even less – the citizen are not passionate about community themes. This is simply because it is vital to ensure a recurring and worthy funding of that name of our federated entities.
In order to understand the subject of the debate, we must go back to the law of 16 January 1989 which instituted the financing of communities and regions. This law, result of the 1988 government agreement to which we were not associated and logical follow-up to the special law of 8 August 1988, carried in it the germs of the difficulties we face today and the need for a further refinancing of the federated entities.
Indeed, the mechanisms for the financing of federated entities envisaged in 1989 were completely insufficient, in particular given the competences that were transferred at that time and the needs that this resulted. These mechanisms were already described at the time as temporary and transitory.
Those who negotiated the funding law, who are the fathers of it even though certain paternities are sometimes not claimed, knew for sure that the problem would reappear and that it would be necessary to renegotiate again to obtain additional resources. That is why the bill that is presented to us today deals with refinancing. It tends to ⁇ the balance between the financial responsibility of the federated entities and the solidarity within the federal state. This is the very essence of federalism, and it should have been the conductive thread of the institutional reforms of the 1980s. by
I will briefly address the situation that prevails today and that results precisely from this 1989 funding law.
For the regions first, the allocation of resources is currently based on the amounts of the central state expenditure, so in fact on the 1989 budget appropriations, and this for the new materials transferred to the regions. As with the provincial and municipal fund, the allocation of funds is also based on the amounts of allocations granted by the law of 9 August 1980. These were the three financial masses that constituted the basic amounts of the financing of the regions.
Note that the basic amounts for current expenditure, i.e. for new competences or for the fund of provinces and municipalities, were not transferred in full in 1989. They were transferred at a rate of only 98% due to the participation of the regions in fiscal austerity. We already started on bad bases that did not allow us to cope with the expenses.
Not to mention the fact that the three major budget masses mentioned were simply indexed and only from 1990 and that they were, in any case, not linked to growth. by
In addition, the regions, as in 1980, have tax revenues from seven regional taxes, the revenues of which were allocated to them in whole or in part and over which they could exercise limited tax autonomy. According to the then Prime Minister, Mr. In Dehaene, more than 90 percent of the resources of the regions were financed by the returned income from the natural persons tax. Therefore, regions have broad financial autonomy in the sense that they can freely use the financial resources that are granted to them. This is a limited tax autonomy. For communities, the source of funding comes from taxes currently shared (the allocated portion of the outcome of the radio/television fee which will now be transferred to the regions, VAT and IPP), non-tax revenues, as well as loans.
The allocated part of the VAT corresponds to the credits for education. Since 1989, the government has taken the decision, I recall, to amputate the basic amounts of the part of VAT allocated to the detriment of communities and therefore of education. This means at the time already a loss of ⁇ 5 billion Belgian francs for the French Community. Certainly, it was an exceptional, non-recurrent reduction, aiming, among other things, to ⁇ an economy in terms of power of the School Building Fund. But this was also a bad start for the French Community.
Basic VAT amounts are in fact simply indexed from the fiscal year 1990 and adapted to the evolution of the number of inhabitants under the age of 18. Regarding this latter point, let me be permitted to regret even today the key for the distribution of inhabitants for the Brussels-Capital Region, held by the government partners at the time, i.e. 80 % of French-speaking and 20 % of Dutch-speaking. This financing of education was organized in this way until 1999, when it was to be reviewed on the basis of objective criteria to be established by law. In addition, it was the agreements of St. Eloi that allowed to correct the shot in this regard.
Radio/TV taxes are now another source of funding for communities. It is the part of the product of the fee located in the French or Flemish-speaking region that is taken into account. And we must again regret the identical key retained for the Brussels-Capital Region which does not correspond to the sociological realities of Brussels and which, since then, is regarded as an acquisition by Dutch speakers.
Therefore, the resources allocated to both regions and communities are insufficient. They were negotiated without real concertation with the executives of the federal entities. The basic mechanism for the transfer of the part assigned to the tax of natural persons to the communities is based on the same principle as for the regions, i.e. the transition over ten years from the distribution of resources according to the expenditure of 1989 to a distribution of resources according to the localized income of the tax.
Specifically for education, the failure of financing is undoubtedly the result of the absence of a link between VAT revenues and GDP growth. Already in 1989, the projections made from different work assumptions let no doubt predict that the negotiated financing led to serious difficulties for the French Community.
In order to take the education sector back again, a projection of the ratio between the education expenditure simply indexed and the resources allocated from VAT, allowed to predict a certain catastrophe, since, at the time, a gap of 27 billion francs was already planned in 2000, that is, at the end of those ten years of community financing arising from this law of 1989.
From a more comprehensive perspective, one could easily see that the funding mechanisms set up would result in a regular reduction of the resources allocated by the central state to communities, forcing communities to drastically reduce spending and to make significant sacrifices that would never do but limit the damage. by
I recall a study conducted by the CRISP in 1989, which highlighted difficulties for the Walloon Region between 1989 and 1996 and important problems for the French Community since 1989, intensified in the years that followed. This study concluded with these edifying terms, which I recall: “The context of budgetary restrictions underlying the mechanisms of financing provided for for teaching, i.e. non-link to national wealth and link with a demographic reduction, risks to favor financial aspects at the expense of the implementation of policies focused on the quality of teaching and the search for solutions to problems such as school failure or occupational inclusion.”
It is important, I think, to see where we come from, in order to better understand where we hope to go. Looking back to the past and making introspection, especially at the level of all French-speaking groups, are useful things. But what is fundamental, while assuming the mistakes of the past – for those who must assume them – is to take responsibility, to seize the opportunities to secure the future, this time in a sustainable way. by
I would like to address some essential elements of the Lambermont agreements and highlight the points that, in our view, justify that our assembly approves this bill. by
First, the financing of communities. I talked about the reasons that explain the catastrophic financial situation of the French Community and other communities in terms of education, and the absolute need for its refinancing. Lambermont’s institutional agreements ensure sustainable, i.e. recurring, refinancing of communities. I would like to remind you that from 2002 the additional financial resources will be granted to the federated entities: 8 billion in 2002, 6 billion in 2003 and 2004, 15 in 2005, 5 in 2006 and 2007 to 2011, an additional billion francs per year. These amounts are cumulative. They provide an insight into the particular effort made by the federal to ensure the viability of our federated entities, since they are added to the usual means and allocations. by
It is ⁇ important to emphasize that the agreements provide for the linking of all financial resources — thus new resources, but also of the conventional allocation — to growth from 2007. And if we look at the figures closer, we can say that the resources of the communities are linked to growth as early as 2002, since the additional resources that are granted correspond largely to the growth for the years 2002 to 2006. A parallelism is thus achieved between the evolution of the means of the federal state and that of the means of the communities. It is, as I have already explained, this total absence of connection until 1993, and then very partial from 1994 (since only 30% of the IPP allocation was at that time linked to growth), which caused the situation of fact that the French Community knows today.
Certainly, the new resources will be distributed among the communities on the basis of the principle of fair return. But the bill provides for a transitional period until 2012. And it will be noted that only the new means — i.e. 100 billion francs for that date — will be distributed according to this principle. President: Jean-Pol Henry, First Vice-President Voorzitter: Jean-Pol Henry, first undervoorzitter. The basic means, i.e. the VAT allocation, remain distributed according to the key derived from the Agreements of Saint-Eloi, i.e. the principle: "one student equals a student". A supplementary allocation will be allocated to communities in place of the radio and television fee. Thus, the amount of this tax is definitively guaranteed to them, even if this tax would disappear under the effect of a decision of the regions. This represents 10 to 12 billion francs for the French Community. Even if communities don’t have their fiscal fate in their hands, linking income to growth should finally allow them to keep the way financially.
With regard to regions and the extension of their tax responsibilities, they already have the product of a series of taxes and sometimes limited tax autonomy relative to some of them. Institutional agreements provide for the financial transfer of a series of taxes to the region in compliance with the principle of budgetary neutrality. The regionalization thus carried out follows a logic: to give these entities more powers with regard to regional taxes and other related taxes. This is not a nonsense in an accomplished federal state. Regions are currently responsible for urban planning and mobility. The transfer to the regions of competence in the area of automobile taxation or real estate taxation is therefore the logical follow-up.
We also did not hesitate to be consistent in the opposite direction, since the bill entrusts the exclusive exercise of all competences related to ecotaxes to the federal authority. This assignment was indicated given the extremely mobile nature of these taxes. In the perspective of a complete and responsible federalism, the bill operates the transfer of full autonomy over these taxes to the regions. Regions will then be able to determine the tax base but also the exemptions and rates. by
In the same logic, the regions who wish to do so will be able to collect these taxes themselves from 2005 and, in this case, a specific allocation and a transfer of personnel will be provided. However, the agreements provide for guarantees that I would like to highlight because I think they are important.
- The system of information exchange that is established, the circulation of information very necessary, useful not only when the regions want the federal to continue to collect taxes on their behalf but also when they want to carry out this collection themselves. This exchange of information is actually provided for in a cooperation agreement.
The cadastral income remains federal, although regions can use it as a tax base. A property documentation agency is created which will be funded by the federal and will include staff made available to it. It will handle property rights aspects and tax aspects.
With regard to succession rights, a new guarantee has been introduced. This is an anti-regional competition provision because it provides that the entity that receives succession rights is no longer automatically the entity where the taxpayer was domiciled, but rather the entity where he had his domicile for the longest time during the last five years. by
A part of the institutional agreement provides for clarification and clarification of the conditions under which regions can exercise their competence in the field of natural persons tax. It is hard to hide from it, this element was an important claim of the Flemish region of the country. It can still be said that this element was ceded in exchange for the refinancing of the French Community demanded by the French speakers. That being said, listening to the CVP’s remarks in the commission on the revision of the Constitution, I think that French speakers can reassure themselves with regard to the guarantees provided and the limits imposed since indeed, Mr. Van Rompuy in commission was up to regret this aspect of the agreement, as it would be in retreat from the current situation, and restrictive for the regions. While it is true that regions are allowed, in the current situation, to grant subtractals or to collect additional fees to the IPP, it must be acknowledged that the planned procedure is poorly transparent and depends on the good will of the federal state. The option taken and defended in this project is to clarify the rules of the game, to fix them in the special law and to define the limits of what is acceptable in a federal state while recognizing the autonomy of the regions and their right to better define their needs without having to perpetually depend on what can be granted by the federal level.
I mentioned the guarantees, the limits provided by the bill. I am referring to those that we think are the most important. by
First guarantee: measures taken by a region cannot have the effect of decreasing the progressivity of the tax, otherwise the region would be at risk of tax migration and tax relocation. Clearly, this means that as taxable income increases, the ratio between the amount of the reduction and that of the tax due before the reduction cannot increase. A region could therefore not ensure that people who earn more pay less and less taxes proportionally.
Second guarantee: Regions must exercise their competence in this area without unfair tax competition.
Third guarantee: the fixing of margins, which did not exist previously, allowing the regions to provide for flat-rate or proportional general additional or subtracted general cents, whether or not differentiated by tax fraction, or to introduce general tax deductions related to their competence. These margins are always expressed in relation to the IPP product localized in each region and are set at 3.25 and 6.75. These margins apply to all measures taken by a region.
Fourth guarantee: the measures envisaged must be notified in advance to the Federal Minister of Finance, whose administration is responsible for the implementation of the measure. The Federal Minister of Finance is therefore required to give his opinion on the technical feasibility of the proposed measure. Information exchange, communication are also provided between regions for tax decrees, this element being regulated by cooperation agreements. The control of the margins and the principles of tax progressiveness, such as that of the principle of unfair tax competition, is provided a priori by the Court of Auditors and an appeal for cancellation or suspension is opened before the Court of Arbitration under the rules of allocation of powers. It is clear that the concept of unfair tax competition will need to be better defined and clarified by the case-law of the Arbitration Court.
The tax base will remain uniform regardless of the measures taken, as reductions can only be applied to the amount of tax due and not to the tax base, which is important. The regional measures on taxation at the IPP will therefore be neutral for municipalities — we talk a lot about municipal finances — and for the calculation of the mechanism of solidarity between regions, i.e. the intervention of national solidarities.
It is interesting to note that the measures envisaged will allow regions to obtain more than 50% of their resources through the collection of their own taxes. This is a change from the current situation as most of the funds granted are directly from the federal state through the IPP allocation. The latter shall be reduced in proportion to the amounts resulting from transfers carried out by the agreements. This is in accordance with the principle of budget neutrality.
In conclusion, Mr. Speaker, my dear colleagues, I would say that the modes of financing planned in 1989 did not allow – we must make it clear and know how to recognize, ladies and gentlemen, the weaknesses of the commitments made – to ensure the proper functioning of the federated entities and in particular the communities. Even dealing with indexed predictable spending, with unchanged policy, was impossible for communities.
This lack of resources has been severely felt at the level of education. Not only did the quality of teaching in the French Community suffer, but it was almost impossible to cope with the many problems and new needs of the school population. The teachers themselves have suffered and still suffer the consequences of this lack of resources.
At one time, our country embarked on the path of federalism, transferring to the federated entities the powers formerly managed by the central state. Even if the federalization of the Belgian state was not called the wishes of all because the opinions were varied, it must be acknowledged that over time, things have imposed themselves and that the institutional structures that we know today are a fact, a reality. Our role today is simply to make institutions and federalism work better.
This means, first of all, giving the federated entities the means that they did not have so far, to cope with the competencies that are theirs. by
Better functioning of federalism also means recognizing, as in any federal democratic state, the necessary financial autonomy of the federated entities, obtaining means other than by going to the federal state begging, allowing to feed these means or reduce them through its own taxation, while imposing limits dictated by the framework in which the entities live, that is, the federal space.
To make federalism work better is to recognize that the means of the federated entities must grow under the same conditions as the means of the federal state. In the period of growth, it is logical that the redistribution of fruit can be done at all levels of the institutional structure. When the federal state’s financial resources increase, when the budget margins unfold, it is not absurd to allow communities to invest in the future, i.e. especially in education. Not allowing it is, on the contrary, absurd and unworthy of a State which, in principle, bases its future on the formation of young people, which requires significant means.
Certainly, concessions have been made, on both sides, in these agreements, to ensure this refinancing objective, more urgent in the immediate for the French Community, that is true.
Institutional agreements are a compromise. There are things that are better for us than others, we must recognize this. Some aspects are sometimes even difficult to digest. But an agreement is assessed in its entirety and in view of the objective pursued and, in the present case, of the objective that we were to ⁇ , namely to obtain additional resources for the communities for teaching, in particular of the French Community.
This objective is imposed on all of us, all French speakers of this country. Whether or not we have participated in previous institutional reforms, whether or not we are in power today, achieving the goal is in this case an imperative necessity. Not taking advantage of this opportunity would be a serious mistake. This would be responsible for enormous difficulties for the French Community. It would also be putting itself in an even more difficult position if it was necessary to renegotiate.
Finally, real future prospects are opened for communities, the possibility of enrolling in the knowledge society, as well as the possibility of conducting concrete actions useful to the emancipation of persons and the well-being of people. This opportunity will no longer be present soon, it is a fact, and the conditions of negotiation and the climate will never be the same again. But beyond that, I dare to say that these agreements are balanced, in the sense that they meet the legitimate aspirations of each of the federated entities. If it is false to believe and say that only the French Community needs money, it is equally false to believe and say that, in the future, the tax competences of the regions in terms of IPP will never serve the French speakers of that country. I have the ambition to believe that, in the wake of the tax reform, all regions of this country will have the goal of one day being able to compete themselves in reducing the tax pressure in this country.
That is why I think that all the parts of this agreement concern all federated entities.

J'ai encore la faiblesse de croire que ce sont les communes qui, durant ces années difficiles de crise financière de cette fin du vingtième siècle, ont évité de nombreux drames socio-économiques et humains.
Dans le cadre de l'enseignement, par exemple, les communes ont assumé de façon extraordinaire leurs responsabilités. Sur le plan social, les CPAS ont évité que de nombreuses personnes se retrouvent le long de la route, abandonnées, complètement isolées. On pourrait également donner comme exemple les aides accordées dans le cadre de l'enseignement, la plupart du temps tous réseaux confondus, ainsi que celles intervenues dans le cadre des engagements économiques.
Mon intervention ne vise aucune polémique. Je veux simplement dire que s'il y a une responsabilité financière certaine, le gouvernement a trop donné l'impression, en 1999, que tout était possible et permis. Durant de nombreuses années, l'Etat a connu des difficultés financières.

Mijnheer de voorzitter, mijnheer de minister, collega's, op 3 mei konden wij in dit halfrond allen vaststellen hoe de eerste minister het Parlement schaamteloos voorloog over de gevolgen van het Lombard-akkoord voor Brussel, meer bepaald inzake de aanstelling van Vlaamse schepenen in Brussel, die zogezegd zou worden verplicht, maar die thans facultatief is.
Wij maakten het bijzonder onparlementaire gedrag van de eerste minister al vaker mee, zoals bij het aantreden van deze regering, meer bepaald inzake de financiering van het Franstalig onderwijs; bij de gevolgen van de politiehervorming in Halle-Vilvoorde; bij de haatcampagne die Verhofstadt tegen onze partij inzette en waar de leugens werden ontmaskerd door de Blok-watchers van De Morgen en, zoals reeds gezegd, bij dit Brussel-akkoord. De leugen is stilaan het handelsmerk aan het worden van deze eerste minister. De aanzet op 3 mei was hoe dan ook buitengewoon illustratief voor het Lambermont-akkoord in zijn geheel, omdat dit akkoord is omgeven door en verpakt in leugen en bedrog.
In feite, collega's, zou men de Franstalige onderhandelaars moeten feliciteren, want zij zijn erin geslaagd om een situatie die voor hen uiterst nadelig was, waarbij zij regelrecht op het bankroet afstevenden, in een totale overwinning om te buigen. Al wat zij vroegen, hebben zij binnengerijfd, zowel de financiering van hun onderwijs als de langdurige handhaving van de Vlaamse geldstroom naar Wallonië en de volwaardige drieledigheid. Al die zaken zijn verzekerd, terwijl de Vlamingen op hun honger blijven zitten.
Ik kom eerst tot de financieringswet.
Al jaren was duidelijk dat geen van de Franstalige partijen bereid was tot enige bezuiniging in het onderwijs, het duurste en één van de slechtste van Europa. Bijgevolg zaten zij voor een keer in het defensief en smeekten ze om een nieuwe geldstroom, om pakken bijkomende middelen om hun luxepaard te blijven voeden. Tien jaar lang hebben de Vlamingen zich op deze situatie kunnen voorbereiden en toch hebben zij zich op een onvoorstelbare wijze laten rollen. De Franstaligen bekwamen zonder enig probleem de extra financiering van de Franse Gemeenschap met vele miljarden. Op termijn spreken wij zelfs over tientallen miljarden extra per jaar, met jarenlang behoud van de voor Vlaanderen nadelige, gemanipuleerde leerlingencijfers als verdeelsleutel.
Vlaanderen krijgt in ruil zaken waar het reeds in het verleden voor had betaald. De overheveling van de gemeentewetgeving was reeds in 1993 gepland en Landbouw en Buitenlandse Handel werden vorig jaar al afgekocht. Het enige nieuwe in dit verhaal was wat fiscale autonomie voor de gewesten, maar die werd zodanig ingeperkt en aan Belgische voorwaarden en loyauteitsverplichtingen gekluisterd, dat van echte autonomie geen sprake is. Vlaanderen blijft voor driekwart van zijn inkomsten uit de hand van België eten en blijft dus aan handen en voeten gebonden. Hoogstens kan in de marge wat worden geprutst, kan een cafétaks worden afgeschaft, kunnen de kansspelen zwaarder of minder zwaar worden belast en mag de simpele Steve Stevaert — in 2007 of zo — sinterklaas spelen met het kijk- en luistergeld.
Wie zoiets fiscale autonomie durft te noemen, bedriegt de Vlamingen. Dit resultaat staat in elk geval lichtjaren ver verwijderd van de quasi unaniem goedgekeurde resoluties van het Vlaams Parlement, waarin de overdracht van de gehele personenbelasting en delen van de vennootschapsbelasting werd vooropgesteld.
Bovendien kan dit akkoord onmogelijk als een schakel in een stap-voor-stap-methode worden bestempeld. Bij een volgende onderhandeling zal niet automatisch over delen van de sociale zekerheid worden gesproken. De essentie van Lambermont bestaat er immers in dat er geen volgende keer meer komt. De Franstaligen hebben alles wat zij moeten hebben en bevinden zich nu in een positie waarin zij elk gesprek kunnen en zullen blokkeren. Vanaf nu hebben zij geen enkel belang meer bij nieuwe onderhandelingen, maar wel bij een status quo, bij het unitair houden van alles wat vandaag Belgisch blijft en bij het onveranderd laten van de gigantische Vlaamse miljardenstroom naar het zuiden.
Er is dus de komende tien tot vijftien jaar geen sprake meer van een eigen Vlaams gezondheids- en gezinsbeleid, een geïntegreerd Vlaams wetenschaps- en technologiebeleid, een samenhangend mobiliteitsbeleid of een ordentelijk sociaal en efficiënt economisch beleid. Nochtans zijn dat allemaal prioriteiten die volgens de Vlaamse regering in deze staatshervorming, in de eerste helft van deze legislatuur, tot een oplossing moesten komen. Dat lees ik het Vlaams regeerakkoord onder het hoofdstuk Institutionele Vernieuwing. Ik citeer: "In de eerste helft van deze legislatuur moet in het kader van de nieuwe dialoog van Gemeenschap tot Gemeenschap een definitieve oplossing gevonden worden voor al deze knelpunten". Niets kan daarvan nu nog in huis komen. De Vlaamse staatsvorming wordt voor onbeperkte tijd geblokkeerd. De hefbomen om in Vlaanderen werkelijk wat verandering te brengen en tot een gestroomlijnd beleid te komen, blijven allemaal Belgisch. Bijgevolg blijft ook de onmetelijke miljardenstroom richting Wallonië gebetonneerd en blijft deze even ondoorzichtig als vandaag. Ook om die reden is Lambermont niets anders dan bedrog en een verloochening van dure verkiezingsbeloften.
Vlaanderen had tijd en kon gerust wachten maar heeft met het Lambermont-akkoord zijn strategische onderhandelingspositie op een verbijsterende manier totaal verspeeld. In de FET van het voorbije weekend stelt professor Dewachter, ik citeer: "De Vlamingen hebben de druk van de Franstalige onderhandelaars zonder meer aanvaard. De Franstaligen eisten geld en zegden er bovendien meteen bij welke dingen voor hen in de onderhandelingen daarover onbespreekbaar waren: sociale zekerheid, gezondheidszorg en kinderbijslag en financiële solidariteit. De Franse Gemeenschap was de vragende partij maar zij stelde de voorwaarden. En de Vlamingen hebben dat aanvaard. Knappe onderhandelaars zijn dat, die Franstaligen".
Een bijkomend element dat de blokkering in de hand werkt is de zeer bewuste betrachting van de onderhandelaars om dit Lambermont-akkoord en de samenwerkingsakkoorden zodanig ingewikkeld, complex, ondoorzichtig en hopeloos technisch in mekaar te steken dat haast niemand, tenzij een paar maniakken en masochisten, nog bereid is deze teksten te bestuderen. Met dit kluwen, met deze inspiratieloze mechanismen wordt elke verdere interesse bij de bevolking voor de staatshervorming verstikt.
In heel dit verhaal is de verantwoordelijkheid van de Volksunie verpletterend. We hebben hiervoor gewaarschuwd bij het aantreden van de regeringVerhofstadt. Van in het begin was duidelijk dat deze regering gedomineerd wordt door Michel en Di Rupo en slechts in naam geleid wordt door Verhofstadt en, bijgevolg, in de eerste plaats Franstalige belangen dient. Dit is de voorbije twee jaar zo overduidelijk zichtbaar geworden dat het voor velen verbazing wekte dat een partij als de Volksunie via de Vlaamse regeringsdeelname het paarsgroene kaartenhuis van Verhofstadt maar bleef overeind houden. Met de interne oorlog in die partij is de voorbije maanden voor wie het nog niet doorhad duidelijk geworden waarom. De Volksunie is meer dan ooit in handen van enkele noodlottige figuren voor wie het Vlaamse belang al lang niet meer voorop staat en die naast hun persoonlijke ambitie een heel andere politieke agenda centraal stellen. Vankrunkelsven en Anciaux, de echte zetbazen van de Volksunie, weten maar al te goed dat de Vlaamse staatsvorming nu voor zeer lange tijd zal stilliggen. Dat is echter al lang hun zorg niet meer. Slechts 3% van de bevolking ligt immers wakker van de Vlaamse autonomie.
Bert Anciaux evolueerde van een voorzitterskandidaat met een redelijk Vlaamsgezind imago tot een tragische en zielige labiele minister die de voorbije jaren zelfs het belang van de solidariteit met Wallonië in de sociale zekerheid ging beklemtonen. Een week voor de gemeenteraadsverkiezingen kreeg hij een podium op het feest van 50 jaar Brusselse Post waar hij een waslijst van goede voornemens voor de Brusselse Vlamingen opsomde. Nauwelijks 14 dagen later had hij de kans dit hard te maken op de eerste Lambermont-onderhandelingen. Het werd een dramatische en totale afgang. Hij slaagde erin in één klap het lot van de Brusselse Vlamingen te koppelen aan dat van de Franstaligen in Halle-Vilvoorde, de Brusselse Vlamingen zonder enige garantie uit te leveren aan de Franstalige machthebbers in de Brusselse gemeenten en zijn eigen achterban wijs te maken dat met het behoud van de bestaande waarborgen in Brussel een status-quo werd bereikt. Dit was regelrecht bedrog. De zogenaamde waarborgen zijn niet meer dan een lege doos. Drie maand lang heeft Anciaux elkeen in zijn partij die Lambermont precies omwille van het Brussel-gedeelte wou heronderhandelen, bestreden en tegengewerkt. Vandaag roept hij dat de dissidenten in zijn partij de geloofwaardigheid van de Volksunie als onderhandelaar ondermijnen. De man staat blijkbaar niet stil bij zijn eigen geloofwaardigheid ten aanzien van de kiezers, die zeker bij de Brusselse kiezers helemaal van de kaart is geveegd. Woordbreuk tegenover de kiezer is voor die man blijkbaar de meest doodgewone zaak. De kwade trouw van Bert Anciaux is in elk geval meer dan duidelijk en meer dan bewezen. Maar er zijn nog andere mensen in de Volksunie die wel van enige sérieux kunnen worden verdacht en van wie ik absoluut niet begrijp dat ze Lambermont blijven steunen. Annemie Van de Casteele bijvoorbeeld, die net als ik in HalleVilvoorde woont en beter dan wie ook beseft dat de handhaving van het kiesarrondissement en gerechtelijk arrondissement Brussel-HalleVilvoorde vandaag onvermijdelijk betekent dat onze regio nog voor zeer lange tijd vastgekluisterd zal blijven aan Brussel, met verdere verfransing en imperialistisch francofoon gedrag tot gevolg. Ook dit was een prioriteit voor de Vlaamse Regering, die tijdens de eerste helft van deze legistratuur moest opgelost worden. Hoe kan u, mevrouw Van de Casteele, bij de volgende verkiezingen in uw pamfletten nog geloofwaardig beweren dat Brussel-Halle-Vilvoorde moet gesplitst worden, nu u alle kansen om dit te forceren definitief verkeken hebt?
De derde grote Franstalige overwinning, naast de verzekerde miljarden voor het Franstalig onderwijs en de blokkering van de Vlaamse staatsvorming, is uiteraard de definitieve versterking van de drieledigheid van België en de gedetailleerde uitwerking daarvan in het Sint-Hugo-akkoord van 29 april 2001. Hugo Coveliers had in de commissie de indruk dat ik hem viseerde met dat Sint-Hugo-akkoord, maar het ging natuurlijk in de eerste plaats over iemand die nog veel ijdeler is dan Hugo Coveliers, de onvermijdelijke Hugo Schiltz, die binnenkort het zilveren jubileum van zijn Egmont-afgang mag vieren en zo gefrustreerd was door zijn smadelijke nederlaag van toen, dat hij blijkbaar gezworen heeft zich tot het eind van zijn dagen in te spannen - en u kan ervan meespreken, mijnheer Borginon - om Brussel alsnog te doen promoveren tot een volwaardig derde gewest.
De versterking van Brussel hangt natuurlijk in de eerste plaats samen met de herziening van de financieringswet, waarbij definitief gekozen wordt voor de gewestelijke fiscaliteit en waarbij de enige aanzet voor een fiscaliteit van de gemeenschappen, het kijk- en luistergeld, voorgoed geëlimineerd wordt. Ook dit gaat regelrecht in tegen de resoluties van het Vlaams Parlement, waarbij de tweeledigheid van dit land werd beklemtoond, evenals een apart statuut voor Brussel. Met Lambermont wordt resoluut de andere weg gekozen, waarbij het Brussels gewest op alle mogelijke terreinen gelijkgeschakeld wordt met de beide andere gewesten en waarbij geen enkele concurrentie tussen de Vlaamse en de Franse Gemeenschap geduld wordt op Brussels grondgebied. Brussel was al een supergewest, omdat het naast de gewestelijke bevoegdheden tegelijk ook de provinciale bevoegdheden en de agglomeratiebevoegdheden uitoefende. Met de gewestelijke fiscaliteit en de algehele voogdij over de gemeenten wordt Brussel meer dan ooit gelijkgeschakeld met Vlaanderen en Wallonië, met alle gevolgen van dien voor de positie van de Vlamingen in België.
Van meet af aan, collega's, van bij het aantreden van de regering Verhofstadt was het duidelijk dat het deze richting zou uitgaan doordat alles wat Brussel betrof werd uit de Costa-besprekingen werd gelicht en werd toebedeeld aan de Brusselse Costa of mini-Costa. Op federaal vlak zou er pas een akkoord tot stand komen nadat er reeds een akkoord zou uitgewerkt zijn in die mini-Costa. Op zich was dit al een schandelijke toegeving aan de Franstaligen, want dit betekende meteen dat Brussel aan de Vlaamse controle van dit Parlement werd onttrokken, dat het lot van de Brusselse Vlamingen zou afhangen van de goodwill van de Franstalige partijen in Brussel. De sterke Vlaamse onderhandelingspositie op federaal vlak werd prijsgegeven voor een voor de Vlamingen zeer nadelig Brussels onderhandelingskader, waar de Franstaligen een verpletterende meerderheid hebben. En dit uitgerekend in het delicate dossier Brussel, waar het nu al zo slecht gesteld is met de rechten van de Nederlandstaligen.
Van in de kiem, van bij de prilste aanvang zat het dus fout en was het voorspelbaar dat het daar tot een zeer negatief resultaat zou uitlopen. En in die mini-Costa, nog lang voor de Sint-Hugoonderhandelingen, deed zich een perfide verglijding voor in het debat van de gewaarborgde vertegenwoordiging.
De Vlamingen waren in de eerste plaats vragende partij voor waarborgen op gemeentelijk vlak, zeker in het kader van de overheveling van het toezicht op de gemeenten. De Brusselse CVP was zo geniaal en zo strategisch om precies het debat terzake van de Brusselse agenda te voeren, in de hoop dat Verhofstadt dat wel zou regelen. Dat was natuurlijk niet het geval. Op onze herhaalde interpellaties — we zijn de enigen die de regering de afgelopen twee jaar daarover ondervroegen maakte de regering telkens weer duidelijk dat een gewaarborgde vertegenwoordiging in de Brusselse gemeenten niet aan de orde was, tenzij daarover een akkoord in Brussel zelf bestond. Het debat in de mini-Costa ging dus niet over de gewaarborgde vertegenwoordiging in de gemeenten, maar wel over die op gewestelijk vlak, waar het veel minder noodzakelijk was gelet op de bestaande Vlaamse macht in de Brusselse regering en de dubbele meerderheid in de gewestraad.
Toch moest hieraan mordicus worden gesleuteld, omdat niet alleen enkele Vlaamse partijen aandrongen op enkele bijkomende posten, maar zeker de Franstalige partijen geïnteresseerd waren in een debat over een gewaarborgd aantal Vlamingen op gewestniveau en wel om de volgende drie redenen. Ten eerste, in ruil daarvoor konden ze de positie van het Vlaams Blok verzwakken, de enige partij in Brussel die geen compromissen wil sluiten over de naleving van de taalwetgeving. Ten tweede, konden ze in ruil daarvoor de dubbele meerderheid afschaffen en een 12 jaar lang gekoesterde eis realiseren. Ten derde, konden zij hierdoor Brussel als derde gewest in stand houden, wat ze te allen prijze willen, want die instelling bedient hen nu eenmaal bijzonder goed. Om al die redenen wilden de Franstaligen vermijden dat hun gewest door de demografische achteruitgang van de Brusselse Vlamingen onbestuurbaar zou worden.
Zo geschiedde: na gezwaai met miljarden en intensief optreden van Verhofstadt werd het Sint- Hugo-akkoord geboren, met verzekerde vertegenwoordiging van de Vlamingen in het gewest, akkoord dat perfect tegemoetkomt aan de Franstalige desiderata. Het Brussel-akkoord wordt op die manier het meest nefaste en schandelijke deel van het Lambermont-dossier.
Ten eerste, het Vlaams Blok wordt bestreden op een manier die het wezen zelf van de democratie onderuithaalt. Wat is immers een van de kernelementen van de democratie? Dat is de gelijkwaardigheid van elke partij of kandidaat ten aanzien van de kiezer. Dat principe wordt vanaf nu doorbroken. Partijen kunnen voortaan naar eigen goeddunken lijstverbindingen met wie ze willen en tegen het Vlaams Blok overeenkomen naar analogie van de bestaande apparentering tussen de arrondissementen. Het Vlaams Blok moet hierdoor in een ondergeschikte positie naar de kiezer trekken als een paria met minder rechten dan de andere partijen. Een stem voor het Vlaams Blok weegt dan automatisch minder zwaar in Brussel dan een stem voor een andere Vlaamse partij.
Ten tweede, voor de verkiezing van de Vlaamse ministers in het Brussels Gewest staan niet alleen de rechtstreeks Vlaamse verkozenen in, maar ook de vijf niet-verkozenen, de vijf gebuisde kandidaten. Het gaat inderdaad om de vijf eerste niet-gekozen kandidaten die desondanks een parlementair zitje krijgen, met als enige bedoeling te vermijden dat er een politiek niet correcte meerderheid zou ontstaan. Ik heb in de commissie aan de hand van een prognose aangetoond dat die hervorming in de eerste plaats bedoeld is om het Vlaams Blok in Brussel van de macht te houden, maar dat het systeem gemakkelijk als neveneffect kan hebben dat naast het Vlaams Blok een partij als de CVP in de oppositie kan worden gedrongen en dat de bruine coalitie van paars-groen-geel die op het ogenblik in Vlaanderen de lakens uitdeelt, met een minderheid aan kiezers in Brussel toch aan de macht komt, met name door de twee grootste Vlaamse partijen in Brussel bewust zeer zwaar te benadelen.
Het systeem zorgt er bovendien voor dat de Franstaligen en niemand anders scheidsrechter mogen spelen bij de benoeming van de Vlaamse ministers. Dat wordt aan hun willekeur overgelaten. Zij en zij alleen beslissen welke parlementaire assemblee de Vlaamse ministers mag aanstellen.
Ik had in dit halfrond al gewezen op het fundamentele antidemocratisch karakter van deze constructie bij het verwijzen van dit wetsvoorstel naar de Raad van State. Die eerbiedwaardige instelling, die niet verdacht kan worden van enige sympathie voor het Vlaams Blok, omdat ze door alle partijen behalve de onze werd aangeduid, heeft onze fractie volkomen gelijk gegeven. In de meest duidelijke en tegelijk meest vernietigende bewoordingen heeft de Raad van State de vloer aangeveegd met uw anti-Vlaams-Blok-constructie. De Raad van State heeft gezegd dat het wetsvoorstel niet alleen in strijd is met de Grondwet, maar vooral met de beginselen van de democratie zelf. Het kan immers niet dat ministers niet verkozen worden door het orgaan waarvoor ze verantwoordelijk zijn. Het kan ook niet dat de samenstelling van een parlementair orgaan afhangt van een vreemd lichaam, namelijk van een ander parlementair orgaan, dat bevoegd is voor een ander grondgebied.
In zijn advies dringt de Raad van State door tot de kern van de zaak. Man en paard worden genoemd. Ik citeer: "Dit systeem lijkt als impliciete maar zekere bedoeling te hebben de uitslag van de gewestverkiezingen, wat de Nederlandse taalgroep betreft, te corrigeren". Collega Borginon, elk fatsoenlijk politicus die deze kritiek op zijn bord krijgt, moet zijn teksten spontaan naar de prullenmand gooien. De Raad van State beschuldigt hem er immers van een verkiezingsuitslag te willen vervalsen, en de democratie te willen vervalsen. Wat is immers het verschil tussen het "corrigeren" van een verkiezingsuitslag en het vervalsen ervan? Ik vind het daarom bijzonder cynisch dat de Lambermontpartijen dit soort institutionele waanzin durven in te leiden met de woorden: "Om de democratie in het Brussels Hoofdstedelijk Gewest te versterken." Een grover staaltje van hypocrisie is niet denkbaar. De zogenaamde democratische partijen versterken hier niet de democratie, ze verkrachten ze openlijk en publiek.
Ten derde - het is nog niet gedaan -, doen de Lambermont-partijen er nog een schep bovenop. De enige waarborg die de Vlamingen in het Brusselse Parlement hebben, althans voor gemeenschapsaangelegenheden, namelijk de vereiste dubbele meerderheid, hun enige blokkeringmiddel, wordt door dit akkoord onderuit gehaald. Voortaan kan Brussel op alle terreinen worden geregeerd met de steun van amper één derde van de Vlaamse gekozenen. Zelfs in de huidige samenstelling van het Brussels Parlement kan dit ertoe leiden dat Brussel verder geregeerd wordt door de paars-groen-gele coalitie, met amper 4 op 11, en straks 6 op 17 zetels. Een dergelijk systeem doet me denken aan een clubje Sovjets van de oude stempel die onder elkaar regelen hoe zij, desnoods met hulp van buitenaf, altijd aan de macht kunnen blijven, wat er ook gebeurt, en wat de kiezer ook moge beslissen.
Dit alles komt neer op een totale capitulatie voor de jaren oude eisen van het FDF, en op een zeer groot machtsverlies voor de Brusselse Vlamingen. In 1988 werd in dit Parlement de drieledige gewestvorming aan de bevolking "verkocht" door Vic Anciaux met het adagium dat Brussel niet langer tegen de wil van de Vlamingen kon worden bestuurd. Echter, het enige machtsmiddel waarover de Brusselse Vlamingen sindsdien beschikken, de vereiste dubbele meerderheid, wordt nu helemaal onderuit gehaald. Waar men tot nu toe de Vlamingen in Brussel nog enigszins beschouwde als een gelijkwaardige partner, die op hetzelfde niveau stonden als de Franstaligen, worden wij nu herleid tot een gedoogde minderheid. Dat is de essentie van het Brusselakkoord over de staatshervorming.
Er komen nu zes mandaten bij voor de Brusselse Vlamingen in de Brusselse Gewestraad. Dat zou de grote Vlaamse overwinning moeten zijn. Het aantal Vlamingen is nu eindelijk gewaarborgd, zegt men. Sterker nog: zes ervan worden naar het Vlaams Parlement gestuurd. Ook vijf gebuisde kandidaten krijgen nu een parlementszetel onder zich geschoven. Men gooit dus als het ware met mandaten. Toch deert dit de Franstaligen niet, want ook zij krijgen er een pak mandaten bij. De Vlamingen krijgen vooral machteloze mandaten. Zij kunnen nu onder elkaar inderdaad parlementje spelen, tot groot jolijt van Annemie Neyts, die daar afgelopen zondag in het televisieprogramma De Zevende Dag nog wild enthousiast over deed. Het gaat echter over niet meer dan een schijnparlement. De Vlaamse macht in Brussel is nu gebroken. Het gaat nu om een puur illusoire macht. Het gaat bijgevolg om bedrog, collega Borginon.
In die omstandigheden kan het Vlaams Blok niet anders dan met alle mogelijke legale middelen dit Brussel-akkoord bestrijden. Mocht dit voor de Vlamingen bijzonder nefaste Brussel-akkoord inderdaad wet worden, beloven wij dat wij onverwijld naar het Arbitragehof zullen stappen om de vernietiging ervan te vragen. De Raad van State heeft ons in ieder geval zeer sterke troeven in de hand gespeeld.
Het laatste onderdeel van het Brussel-akkoord is werkelijk het summum van leugens en bedrog. Ik heb het dan over de zogenaamde gewaarborgde vertegenwoordiging op gemeentelijk vlak. Daar was het oorspronkelijk immers allemaal om te doen. De noodzaak hiervan kwam, onder impuls van het Vlaams Blok en van de Vlaamse Beweging, aan het licht tijdens het debat over het Europese stemrecht, toen meer dan ooit duidelijk werd dat de Vlamingen in Brussel door de internationalisering en de demografische situatie helemaal van de politieke kaart dreigden te worden geveegd.
Ook om deze reden had men Brussel nooit mogen beschouwen als een volwaardig derde Gewest met volledige autonomie over zijn ondergeschikte besturen, evenwaardig aan Vlaanderen en Wallonië. De werkelijke macht in Brussel bevindt zich immers nog altijd bij de gemeenten, de Fransdolle baronieën. Dit blijkt ten overvloede uit het schandelijke benoemingsbeleid in de gemeenten en in de OCMW-besturen, waar vandaag nog altijd, manifest tegen de taalwet in, honderden aanstellingen gebeuren van eentalig Franstaligen, zonder dat de voogdijoverheid — zijnde de vice-gouverneur en het Gewest — iets wil of kan ondernemen.
Dit anti-Vlaamse benoemingsbeleid had een les moeten zijn, collega's van de Volksunie. Het zou een zeer wettige reden zijn geweest om de gewestelijke voogdij, die Brussel nu reeds bezit, aan Brussel te ontnemen en terug naar het federale niveau over te hevelen, waar de Vlamingen een meerderheid hebben en wel kunnen zorgen voor de nodige rechtsbescherming. Vandaag doet men evenwel precies het tegenovergestelde en maakt men het allemaal nog veel erger. Het laatste controlerecht van dit Parlement verdwijnt.
Dit Parlement, de Vlaams meerderheid in dit land, heeft voortaan over het beleid en de structuren van zijn eigen hoofdstad niets meer te zeggen, want wat men vandaag met het Lambermontakkoord uitricht, komt zonder meer neer op het uitleveren van de Brusselse Vlamingen aan de goodwill van de Fransdolle gemeentebesturen en aan de verpletterende Franstalige meerderheid in het Brusselse Gewest. Het is de ultieme dolksteek in de rug van de Brusselse Vlamingen.
Wie zou denken dat zeker in zulk een situatie, op het moment van deze onomkeerbare uitlevering, zou worden gestreden voor waarborgen in die gemeenten, is vandaag een illusie rijker. Het Vlaamse regeerakkoord spreekt over een gewaarborgde vertegenwoordiging. Ik citeer: "effectieve en evenwichtige participatie van beide taalgroepen op alle beleidsniveaus. Helaas, ondanks alle resoluties van het Vlaams Parlement en van de Brusselse Vlamingen, ondanks het Vlaamse regeerakkoord komt er van dat alles niets in huis. Er komt in Brussel geen gewaarborgde vertegenwoordiging op gemeentelijk vlak. In die gemeenten waar er geen Vlaamse verkozene is, wordt er ook niemand in overtal aangeduid, ondanks het weinig democratische gemeentelijk kiessysteem dat de kleine en dus Vlaamse partijen benadeeld. Er komt evenmin een gewaarborgde vertegenwoordiging in de OCMW-raden en besturen. Er komt ook geen Vlaamse vertegenwoordiging in de schepencolleges. Alleen neemt de kans toe dat er in sommige gemeenten één - en niet meer - Vlaamse schepen zal bijkomen. Deze moet dan wel op een tweetalige lijst hebben gestaan óf braaf genoeg bevonden zijn om de meerderheidspartijen te steunen. Het moet dus om iemand gaan die de Franstalige meerderheid in zijn gemeente zeer gunstig gezind is. Alle poorten voor misbruik staan hier dus open. Zonder enig probleem kan die schepen een nepVlaming zijn, een Flamand de service, een zogenaamde FDF-Vlaming, die geen enkele binding heeft met een Vlaamse partij, maar die zichzelf doorgewoon uitroept tot Vlaming.
Er is dus geen enkele garantie, mijnheer Borginon, dat er een Vlaamse schepen komt. Als er dan toch één komt, is er bovendien niet eens de zekerheid dat het om een echte Vlaming gaat, die reële bevoegdheden zal uitoefenen en die zich met meer zal mogen bezighouden dan met kermiskoersen en kerkhoven.
Voor dit formidabele resultaat, deze historische doorbraak die u in Brussel hebt kunnen bereiken, wordt met zware munt betaald. De Brusselse gemeenten krijgen liefst één miljard frank per jaar cadeau van de in hoofdzaak Vlaamse belastingbetaler, zonder ook maar één bijkomende voorwaarde, wat automatisch zal leiden tot een bijkomende versterking van de Franstalige machthebbers. Hiermee is het overduidelijk geworden dat Lambermont geen volwaardige erkenning van de Vlamingen als gelijkwaardige gemeenschap in Brussel inhoudt. De Vlamingen worden integendeel op een ontluisterende wijze herleid tot ordinaire koopwaar. Het is helemaal een leugen dat dit een eerste stap zou zijn naar een betere erkenning op lange termijn. Wat nu gebeurt is definitief; definitiever kan niet. Men schijnt zich dit niet te realiseren. Eens de bevoegdheid overgeheveld naar het Brussels gewest, is elke hoop op verbetering van de Vlaamse positie in de Brusselse gemeenten definitief verloren. Het paradoxale aan heel het Brussel-akkoord is dan ook dat de Vlamingen gegarandeerde mandaten en bijkomende mandaten krijgen op die plaatsen waar dit geen bijkomende macht oplevert en waar de Vlaamse macht integendeel wordt gebroken. Op die plaatsen waar de werkelijke macht zit in Brussel, namelijk de gemeenten, de schepencolleges en de OCMW-besturen, krijgen de Vlamingen zo goed als niets. Het is duidelijk wie er hier aan de onderhandelingstafel heeft gezeten: Vanhengel, Gatz, Delathouwer en Bijttebier hebben voor zichzelf alleen en niemand anders gezorgd, zij hebben voor zichzelf en hun vrienden een levenslang mandaat uit de brand gesleept en de kleine Vlamingen op het terrein, in de gemeenten waar het zoveel moeilijker werken is, royaal in de steek gelaten.
Ik wil eindigen met drie bedenkingen bij heel dit nefaste gedoe. Mijnheer Verherstraeten, u geniet de trieste eer hier nog als enige lid van de CVP aanwezig te zijn. Ik had mij tot de heer Van Rompuy willen richten omdat hij in het verleden betrokken was bij de vorige fases van de staatshervorming. Ik heb de CVP tot op heden gespaard, maar ik hoop dat die partij beseft dat zij een zeer grote historische verantwoordelijkheid draagt in dit dossier. Zij ligt aan de basis van de drieledigheid van dit land en moet nu tot haar schade en schande vaststellen dat het cordon in Brussel ook rond haar gesloten kan worden. Indien Lambermont wordt goedgekeurd, dan is alleen uw partij nog in de mogelijkheid het tij te keren. U hebt met Chabert de troef in handen om het hele kaartenhuis van Louis Michel en Verhofstadt onderuit te halen. U zult hem dan wel uit de vitrine moeten halen en duidelijk maken dat het gedaan is met het leven van de verwende Lamme Goedzak en eeuwige pantoffelheld. Niet alleen zijn maar ook uw geloofwaardigheid als CVP — voor zover die er nog zou zijn — staat op het spel.
Mijnheer Borginon, uw partij zal de geschiedenis ingaan als de partij die zichzelf betitelde al behoedster van het democratisch nationalisme, maar die de democratie in dit land opzij schoof en de Brusselse Vlamingen voorgoed uitleverde aan de Franstaligen en de weg naar Vlaamse ontvoogding blokkeerde. Ik heb op verschillende plaatsen gelezen dat u met de gedachte speelt om de Vlaamse leeuw in uw partijvlag te voorzien van een rode tong en rode klauwen. U mag ze voor mijn part groen verven, roze of paars, maar één ding moet duidelijk zijn: denk niet dat uw partij of wat er nog van overblijft na het goedkeuren van deze rampzalige teksten ooit nog zal kunnen rekenen op de clementie van de Vlaams-nationale kiezer.
Het Lambermont-akkoord is het zoveelste bewijs dat de keuze voor het federalisme in dit land een valstrik is geweest, een fuik waarin Vlaanderen gekluisterd blijft aan België en waarin de Vlaamse meerderheid wordt herleid tot een minderheid. De recente demarche van Dewael bij Guy Verhofstadt, zijn smeekbede om de regio's een beetje meer inspraak te geven in Europa, illustreert op zeer overtuigende wijze dat Vlaanderen in Europa het statuut heeft van een bedelaar. Tegelijkertijd was het voorheen nooit zo duidelijk dat België een bijzonder kunstmatige staat is die slechts kan voortbestaan door ondemocratische, ondoorzichtige compromissen en onleesbare, bedrieglijke akkoorden.
Meer dan ooit overtuigt dit nefaste akkoord ons zo snel mogelijk een einde te doen stellen aan deze zielige vertoning, aan dit land van de leugen, aan dit koninkrijk van de kitsch, aan deze staat van de schone schijn, aan dit Belgisch bedrog, aan dit Belgisch boerenbedrog.
Wij zullen meer dan ooit ijveren voor een onafhankelijke Vlaamse Staat, met Brussel als hoofdstad uiteraard, niet om aan kleinstaterij te doen of om een muur rond Vlaanderen te trekken, maar om Vlaanderen eindelijk een echte stem te geven in Europa en om de Vlamingen te geven waar zij al zolang recht op hebben: een eigen vaderland.

Mr. Speaker, Mr. Minister, colleagues, on 3 May, in this half-course, we were all able to establish how the Prime Minister deceived Parliament without shame about the consequences of the Lombard Agreement for Brussels, more specifically regarding the appointment of Flemish creatures in Brussels, which would be so-called mandatory, but which is now optional.
We have seen the particularly non-parliamentary behavior of the prime minister more often, such as during the administration of this government, more specifically regarding the financing of the French-speaking education; in the consequences of the police reform in Halle-Vilvoorde; in the hatred campaign that Verhofstadt instigated against our party and where the lies were unmasked by the Blok-watchers of De Morgen and, as already said, in this Brussels agreement. The lies are gradually becoming the trademark of this Prime Minister. The launch on May 3 was in any case extremely illustrative for the Lambermont agreement as a whole, as this agreement is surrounded by and packed in lies and deceit.
In fact, colleagues, one should congratulate the French-speaking negotiators, for they have managed to bend a situation that was extremely detrimental to them, in which they stood straight at the bankruptcy, in a total victory to bend. Everything they asked for, they inserted, both the financing of their education as well as the long-term maintenance of the Flemish money flow to Wallonia and the full trial. All these things are insured, while the Flammers remain hungry.
Let me start with the Finance Act.
For years it was clear that none of the French-speaking parties was willing to make any cuts in education, the most expensive and one of the worst in Europe. Consequently, they sat for once in the defensive and begged for a new cash flow, to pick up additional resources to continue feeding their luxury horse. For ten years, the Flammers have been able to prepare themselves for this situation, and yet they have been rolled in an unimaginable way. The French-speaking people, without any problem, enabled the additional financing of the French Community of many billions. In the long run, we are even talking about tens of billions extra per year, with years of preservation of the disadvantageous, manipulated pupil numbers for Flanders as the distribution key.
In exchange, Flanders receive things they had already paid for in the past. The removal of the municipal legislation was already planned in 1993 and Agriculture and Foreign Trade were already purchased last year. The only new thing in this story was some fiscal autonomy for the regions, but it was so limited and attached to Belgian conditions and loyalty obligations that there is no real autonomy. Flanders continue to eat for three-quarters of their income from the hands of Belgium and thus remain tied to hands and feet. At most, in the margin, something can be pricked, a coffee tax can be abolished, the gambling games can be taxed heavier or less heavier, and the simple Steve Stevaert — in 2007 or so — can play sinterklaas with the watch and listen money.
Those who dare to call such a thing tax autonomy are deceiving the Flamings. This result is, in any case, light years away from the almost unanimously adopted resolutions of the Flemish Parliament, in which the transfer of the entire personal tax and parts of the corporate tax was anticipated.
Furthermore, this agreement cannot be marked as a link in a step-by-step method. In the next negotiation, parts of social security will not be automatically discussed. The essence of Lambermont is that there is no next time. The French speakers have everything they need and are now in a position where they can and will block any conversation. From now on, they no longer have any interest in new negotiations, but in a status quo, in keeping united everything that today remains Belgian and in leaving unchanged the gigantic Flemish billions flow to the south.
Thus, in the next ten to fifteen years, there will no longer be a Flemish health and family policy, an integrated Flemish science and technology policy, a coherent mobility policy or an orderly social and efficient economic policy. However, these are all priorities that, according to the Flemish government, in this state reform, in the first half of this legislature, had to come to a solution. This is read in the Flemish Government Agreement under the Chapter Institutional Renewal. “In the first half of this legislature, within the framework of the new dialogue between the Community and the Community, a definitive solution to all these difficulties must be found.” Nothing can come home now. The Flemish state formation is blocked for an unlimited time. The leverage to truly bring some change in Flanders and to come to a streamlined policy remains all Belgian. As a result, the immeasurable flow of billions towards Wallonia remains steady and remains as opaque as it is today. Also for that reason, Lambermont is nothing but a fraud and a denial of expensive election promises.
Flanders had time and could wait, but with the Lambermont agreement it has completely wasted its strategic negotiating position in a staggering way. In the FET of the past weekend, Professor Dewachter says, I quote, “The Flamings have accepted the pressure of the French-speaking negotiators. The French-speaking people demanded money and also immediately told them what things were undisputed for them in the negotiations: social security, health care and child allowance and financial solidarity. The French Community was the requesting party but set the conditions. And the flames accepted it. Good negotiators are those, those French speakers.”
An additional element that works the blocking hand in hand is the very conscious consideration of the negotiators to put this Lambermont agreement and the cooperation agreements together so complicated, complex, opaque and hopelessly technically that hardly anyone, except a few maniacs and masochists, is still willing to study these texts. With this clutter, with these uninspired mechanisms, any further interest in the public in state reform is stifled.
In all this story, the responsibility of the People’s Union is crushing. We warned about this at the entrance of the government of Verhofstadt. From the beginning it was clear that this government is dominated by Michel and Di Rupo and is only in name led by Verhofstadt and, consequently, primarily serves French-speaking interests. This has become so clearly visible in the past two years that it surprised many that a party such as the Volksunion through the participation of the Flemish government kept the purple green card house of Verhofstadt standing. With the internal war in that party, the past months have made it clear to those who have not yet understood why. The People’s Union is more than ever in the hands of some fateful figures for whom the Flemish interest has long been out of the forefront and who, in addition to their personal ambition, put a very different political agenda at the center. Vankrunkelsven and Anciaux, the real head of the People’s Union, know too well that the Flemish state formation will now be silenced for a very long time. However, this has long been no longer their concern. Only 3% of the population is awake from Flemish autonomy.
Bert Anciaux evolved from a presidential candidate with a fairly Flemish image to a tragic and sadly labial minister who in recent years even began to emphasize the importance of solidarity with Wallonia in social security. A week before the municipal council elections he was given a stage at the celebration of 50 years Brussels Post where he summed up a washlist of good intentions for the Brussels Flamings. Hardly 14 days later, he had the chance to make this hard at the first Lambermont negotiations. It was a dramatic and total departure. He managed in one blow to link the fate of the Brussels Flamings to that of the French speakers in Halle-Vilvoorde, to deliver the Brussels Flamings without any guarantee to the French-speaking rulers in the Brussels municipalities and to make his own backbone know that with the preservation of the existing guarantees in Brussels a status quo was achieved. This was truly fraud. The so-called guarantees are nothing more than an empty box. For three months, Anciaux has fought and countered every one in his party that Lambermont wanted to renegotiate precisely for the sake of the Brussels section. Today he calls on the dissidents in his party to undermine the credibility of the People’s Union as a negotiator. The man apparently does not stand still with his own credibility with respect to the voters, which is ⁇ with the Brussels voters completely wiped out of the card. Breaking words against the voter is apparently the most deadly thing for that man. The evil faith of Bert Anciaux is in any case more than clear and more than proven. But there are other people in the People’s Union who can be suspected of some serious, and of whom I absolutely do not understand that they continue to support Lambermont. Annemie Van de Casteele, for example, who, like me, lives in HalleVilvoorde and better than anyone realizes that the maintenance of the electoral district and judicial district Brussels-HalleVilvoorde today inevitably means that our region will remain attached to Brussels for a very long time, resulting in further frenchization and imperialist francophone behavior. This was also a priority for the Flemish Government, which had to be resolved during the first half of this legislature. How can you, Mrs. Van de Casteele, in your pamphlets at the next elections still credibly claim that Brussels-Halle-Vilvoorde must be split, now that you have finally wiped out all the opportunities to force this?
The third major French-speaking victory, in addition to the billions insured for the French-speaking education and the blocking of the Flemish state formation, is of course the definitive strengthening of the three-party of Belgium and the detailed elaboration thereof in the Saint-Hugo Agreement of 29 April 2001. Hugo Coveliers had in the committee the impression that I targeted him with that Saint-Hugo Agreement, but it was, of course, first and foremost about someone who is much more vanity than Hugo Coveliers, the inevitable Hugo Schiltz, who could soon celebrate the silver anniversary of his departure from Egmont and was so frustrated by his damaging defeat at that time, that he apparently swore to endeavor until the end of his days - and you can talk about it, Mr. Borginon - to make Brussels still promote to a full-fledged third region.
The strengthening of Brussels is, of course, first and foremost connected with the revision of the Finance Act, in which the final choice is made for the regional taxation and in which the only incentive for a taxation of the communities, the viewing and listening money, is permanently eliminated. This is also directly contrary to the resolutions of the Flemish Parliament, which emphasized the duality of this country, as well as a separate statute for Brussels. With Lambermont, the other path is resolutely chosen, in which the Brussels region is equalized in all possible areas with the two other regions and in which no competition between the Flemish and French Communities is tolerated on the territory of Brussels. Brussels was already a supergouvernement, as it also exercised provincial and agglomeration powers in addition to the regional powers. With the regional taxation and the overall guardianship over the municipalities, Brussels is more than ever equated with Flanders and Wallonia, with all the consequences thereof for the position of the Flanders in Belgium.
From the very beginning, colleagues, from the time the government of Verhofstadt took office, it was clear that it would go in this direction because everything that concerned Brussels was lightened from the Costa talks and was assigned to the Brussels Costa or mini-Costa. At the federal level, an agreement would be reached only after an agreement had already been drawn up in that mini-Costa. In itself, this was already a shameful concession to the French speakers, because it immediately meant that Brussels was removed from the Flemish control of this Parliament, that the fate of the Brussels Flamings would depend on the goodwill of the French-speaking parties in Brussels. The strong Flemish negotiating position at the federal level was rewarded for a Brussels negotiation framework very detrimental to the Flemish, where the French speakers have a crushing majority. And this is counted in the delicate case Brussels, where it is already so bad with the rights of the Dutch speakers.
From the germ, from the very beginning, it was wrong, and it was predictable that it would result in a very negative outcome. And in that mini-Costa, long before the Saint-Hugon Negotiations, a perfidious slide occurred in the debate of guaranteed representation.
The Flamingen were primarily the party asking for guarantees at the municipal level, ⁇ in the context of the overthrow of the supervision of the municipalities. The Brussels CVP was so brilliant and so strategic to conduct precisely the debate on the Brussels agenda, in the hope that Verhofstadt would arrange it. This was of course not the case. On our repeated interpellations — we are the only ones who questioned the government over the past two years, the government made it clear again and again that a guaranteed representation in the Brussels municipalities was not in question, unless there was an agreement in Brussels itself. The debate in the mini-Costa was therefore not about the guaranteed representation in the municipalities, but about those at the regional level, where it was much less necessary given the existing Flemish power in the Brussels government and the double majority in the western square.
Nevertheless, this had to be mordically encrypted, because not only some Flemish parties insisted on some additional posts, but ⁇ the French-speaking parties were interested in a debate about a guaranteed number of Flemish people at the regional level and for the following three reasons. First, in return, they could weaken the position of the Flemish Bloc, the only party in Brussels that does not want to compromise on compliance with the language legislation. Second, in exchange, they were able to abolish the double majority and realize a claim cherished for 12 years. Thirdly, they were able to maintain Brussels as a third region, which they want at all costs, because that institution serves them ⁇ well. For all these reasons, the French speakers wanted to avoid their region becoming unmanageable due to the demographic decline of the Brussels Flamings.
Thus it happened: after a swing of billions and intense action from Verhofstadt, the Saint-Hugo Agreement was born, with assured representation of the Flamingos in the region, an agreement that perfectly meets the French-speaking desiderata. The Brussels Agreement thus becomes the most nefaste and shameful part of the Lambermont dossier.
First, the Flemish Bloc is being fought in a way that undermines the very essence of democracy. What is one of the core elements of democracy? That is the equivalence of each party or candidate with respect to the voter. That principle is broken from now on. The parties can now, at their own discretion, agree on listing connections with whom they want and against the Flemish Bloc by analogy of the existing association between the arrondissements. The Flemish Bloc must thus attract the voter in a subordinate position as a paria with fewer rights than the other parties. A vote for the Flemish Bloc then automatically weighs less in Brussels than a vote for another Flemish party.
Second, for the election of the Flemish ministers in the Brussels Region are not only the directly elected Flemish candidates, but also the five unelected, the five built candidates. In fact, it is the first five unelected candidates who nevertheless get a parliamentary seat, with the sole intention of avoiding the formation of a politically incorrect majority. I have demonstrated in the committee by means of a forecast that this reform is primarily intended to keep the Flemish Bloc in Brussels from power, but that the system can easily have as a side effect that in addition to the Flemish Bloc a party such as the CVP can be pushed into the opposition and that the brown coalition of purple-green-yellow that currently in Flanders shares the sheets, with a minority of voters in Brussels, still comes to power, in particular by consciously harming the two largest Flemish parties in Brussels very heavily.
The system also ensures that the French speakers and no one else can play the arbitrator in the appointment of the Flemish ministers. This is left to their arbitrariness. They and only they decide which parliamentary assembly may appoint the Flemish ministers.
I had already pointed out the fundamental antidemocratic nature of this construction in referring this bill to the State Council. That respectable institution, which cannot be suspected of any sympathy for the Flemish Bloc, because it was designated by all parties except our own, has given our group absolutely right. In the most clear and at the same time most destructive terms, the State Council has weighed the floor with your anti-Flame Block construction. The State Council has said that the bill is not only contrary to the Constitution, but above all to the principles of democracy itself. It is not possible that ministers are not elected by the body for which they are responsible. It is also not possible that the composition of a parliamentary body depends on a foreign body, namely, on another parliamentary body, which is competent for another territory.
In its opinion, the State Council pushes into the core of the matter. Man and horse are called. “This system seems to have an implicit but certain intention to correct the outcome of the regional elections, as far as the Dutch language group is concerned.” Collega Borginon, every decent politician who gets this criticism on his board, should spontaneously throw his texts into the trash. The State Council accuses him of trying to falsify an election outcome, and of trying to falsify democracy. After all, what is the difference between "correcting" an election result and falsifying it? I therefore find it ⁇ cynical that the Lambermont parties dare to initiate this kind of institutional madness with the words: "To strengthen democracy in the Brussels Capital Region." The so-called democratic parties do not strengthen democracy here, they rape it openly and publicly.
Thirdly – it has not yet been done – the Lambermont parties are making another barrel on top of it. The only guarantee that the Flemish have in the Brussels Parliament, at least for community affairs, namely the required double majority, their only means of blocking, is removed by this agreement. From now on, Brussels can be ruled in all areas with the support of just one-third of the Flemish elected. Even in the current composition of the Brussels Parliament, this could lead to Brussels being further ruled by the purple-green-yellow coalition, with barely 4 out of 11, and later 6 out of 17 seats. Such a system reminds me of a club of Soviets of the old stamp that regulate among themselves how, if necessary with external help, they can always remain in power, whatever happens, and whatever the voter may decide.
All this comes down to a total capitulation for the years-old demands of the FDF, and a very great loss of power for the Brussels Flamings. In 1988, in this Parliament, the tripartite formation was "sold" to the population by Vic Anciaux with the adagium that Brussels could no longer be governed against the will of the Flamings. However, the only means of power the Brussels Flamings have since, the required double majority, is now completely overthrown. Where so far the Flamings in Brussels were still somewhat regarded as an equal partner, who stood at the same level as the French speakers, we are now reduced to a dogged minority. This is the essence of the Brussels Agreement on State Reform.
There are now six mandates for the Brussels Flamings in the Brussels Gewestraad. That should be the great Flemish victory. The number of flames is now finally guaranteed, they say. In fact, six of them are sent to the Flemish Parliament. Five elected candidates will now have a seat in parliament. They are throwing mandates. However, this does not affect the French speakers, because they also get a bunch of mandates. The Flammers get mainly powerless mandates. They can now actually play parliament together, to the great joy of Annemie Neyts, who did it wildly enthusiastically last Sunday in the television program The Seventh Day. It is nothing more than a false parliament. The Flemish power in Brussels is now broken. It is a purely illusory power. Therefore, it is a fraud, colleague Borginon.
In those circumstances, the Flemish Bloc cannot otherwise than by all possible legal means contest this Brussels Agreement. Should this indeed become law for the Flemish ⁇ nefaste Brussels Agreement, we promise that we will immediately go to the Arbitration Court to request its destruction. In any case, the State Council has played us very strong assets in hand.
The final part of the Brussels Agreement is truly the summum of lies and deceit. I am talking about the so-called guaranteed representation at municipal level. It was originally all to do. The necessity of this came to light, under the impetus of the Flemish Bloc and the Flemish Movement, during the debate on the European voting right, when more than ever became clear that the Flemish in Brussels threatened to be wiped out of the political map by the internationalization and the demographic situation.
For this reason, Brussels should never have been considered a full-fledged third region with full autonomy over its subordinate governments, equivalent to Flanders and Wallonia. The real power in Brussels lies, after all, still with the municipalities, the Fransdolle baronies. This is shown in abundance by the shameful appointment policy in the municipalities and in the OCMW governments, where today still, manifestly against the language law, hundreds of appointments are made of single-speaking French speakers, without the guardianship — which is the deputy governor and the Region — want or can do anything. Their
This anti-Flemish appointment policy should have been a lesson, colleagues of the People’s Union. It would have been a very legitimate reason to take the regional custody, which Brussels already owns, from Brussels and to move back to the federal level, where the Flemish have a majority and can provide the necessary legal protection. Today, however, they do exactly the opposite and they make everything much worse. The last control right of this Parliament disappears.
This Parliament, the Flemish majority in this country, now has nothing more to say about the policies and structures of its own capital, because what is being done today with the Lambermont Agreement is undoubtedly the surrender of the Brussels Flamings to the goodwill of the Fransdolle municipal governments and to the crushing French-speaking majority in the Brussels Region. It is the ultimate dolksteek in the back of the Brussels Flamings.
Who would think that ⁇ in such a situation, at the time of this irreversible extradition, would be fought for guarantees in those communities, is today an illusion richer. The Flemish Government Agreement speaks of guaranteed representation. Effective and balanced participation of both language groups at all policy levels. Unfortunately, despite all the resolutions of the Flemish Parliament and of the Brussels Flamings, despite the Flemish government agreement, nothing comes into the house from all this. There is no guaranteed representation at the municipal level in Brussels. In those municipalities where there is no Flemish elected, no one is also referred to in general, despite the little democratic municipal electoral system that harms the small and therefore Flemish parties. There will also be no guaranteed representation in the OCMW boards and boards. There will also be no Flemish representation in the ship colleges. Only increases the likelihood that in some municipalities one – and no more – Flemish ships will be added. They must either have been on a bilingual list or have been found good enough to support the majority parties. Therefore, it must be a person who is very favorable to the French-speaking majority in his municipality. All the gates of abuse are open here. Without any problem, those ships can be a fake Flaming, a Flamand de service, a so-called FDF-Flaming, who has no bond with a Flemish party, but who frequently proclaims himself to be Flaming.
There is no guarantee, Mr. Borginon, that there will be a Flemish ship. Furthermore, if there is one, there is not even the certainty that it is a real Flaming, who will exercise real powers and who will be allowed to engage in more than ceremonial courses and church courts.
For this formidable outcome, this historic breakthrough that you have been able to ⁇ in Brussels, is paid with heavy currency. The Brussels municipalities receive as much as one billion francs per year from the mainly Flemish taxpayer, without even one additional condition, which will automatically lead to an additional reinforcement of the French-speaking rulers. This has made it clear that Lambermont does not imply a full recognition of the Flamings as an equivalent community in Brussels. On the contrary, the Flammers are in a disheartening manner reduced to ordinary merchandise. It is entirely a lie that this would be a first step towards better long-term recognition. What is happening now is definitive; more definitive cannot be. It does not seem to realize this. Once the powers have been transferred to the Brussels region, any hope of improving the Flemish position in the Brussels municipalities has been definitively lost. The paradox of the entire Brussels Agreement is therefore that the Flemish receive guaranteed mandates and additional mandates in those places where this does not provide additional power and where the Flemish power is, on the contrary, broken. In those places where the real power lies in Brussels, namely the municipalities, the ship colleges and the OCMW governments, the Flamings get almost nothing. It is clear who sits here at the negotiating table: Vanhengel, Gatz, Delathouwer and Bijttebier have taken care of themselves alone and no one else, they have pulled a lifetime mandate out of fire for themselves and their friends and have generously abandoned the small Flamings on the ground, in the municipalities where it is so much more difficult to work.
I would like to conclude with three concerns about all this nefarious trouble. Mr. Verherstraeten, you enjoy the sad honour to be present here as the only member of the CVP. I would have wanted to address Mr Van Rompuy because he was in the past involved in the previous stages of state reform. I have saved the CVP so far, but I hope that party realizes that it carries a very large historical responsibility in this file. She lies at the foundation of this country’s triple freedom and must now, to her damage and shame, establish that the cordon in Brussels can also be closed around her. If Lambermont is approved, only your party will be able to reverse the tide. With Chabert, you have the treasure in your hands to bring down the entire card house of Louis Michel and Verhofstadt. You will either have to get him out of the vitrine and make it clear that it is done with the life of the ruined Lamme Goedzak and eternal pants. Not only being, but also your credibility as a CVP — in so far as there would be — is at stake.
Mr. Borginon, your party will go into history as the party that called itself already a guardian of democratic nationalism, but which shattered the democracy in this country aside and handed out the Brussels Flamings forever to the French speakers and blocked the way to Flemish deprivation. I have read in several places that you are playing with the thought of providing the Flemish lion in your party flag with a red tongue and red claws. For my part, you can paint them green, pink or purple, but one thing must be clear: do not think that your party or what remains of it after the approval of these disastrous texts will ever be able to count on the clemency of the Flemish national voter.
The Lambermont Agreement is another proof that the choice for federalism in this country has been a trap, a fake in which Flanders remains tied to Belgium and in which the Flemish majority is reduced to a minority. Dewael’s recent demarche at Guy Verhofstadt, his plea to give the regions a little more participation in Europe, illustrates very convincingly that Flanders in Europe has the status of a beggar. At the same time, it was never so clear that Belgium is a ⁇ artificial state that can only survive through undemocratic, opaque compromises and unreadable, fraudulent agreements.
More than ever, this nefaste agreement persuades us to put an end as soon as possible to this sad display, to this land of lies, to this kingdom of the kitsch, to this state of pure appearance, to this Belgian deception, to this Belgian peasant deception.
More than ever, we will strive for an independent Flemish state, with Brussels as its capital, of course, not to do small-scale construction or to draw a wall around Flanders, but to finally give Flanders a real voice in Europe and to give the Flemish people what they have so long been entitled to: their own fatherland.
