                    Mijnheer de voorzitter, mijnheer de minister, collega's, het wetsontwerp betreffende de misleidende en vergelijkende reclame, de onrechtmatige bedingen en de op afstand gesloten overeenkomsten inzake vrije beroepen heeft een dubbele doelstelling. Enerzijds strekt het ontwerp ertoe de Belgische wetgeving inzake de vrije beroepen in overeenstemming te brengen met drie Europese richtlijnen. Anderzijds beoogt het ontwerp in eenzelfde wet verschillende bepalingen te groeperen die van toepassing zijn op de vrije beroepen. 

De drie richtlijnen zijn, ten eerste, de richtlijn van 1997 betreffende de bescherming van de consument bij op afstand gesloten overeenkomsten, ten tweede, de richtlijn van 6 oktober 1997 over de misleidende reclame teneinde vergelijkende reclame te regelen en, ten derde, de richtlijn van 19 mei 1998 betreffende het doen staken van inbreuken in het raam van de bescherming van de consumentenbelangen.

De wet van 21 oktober 1992 betreffende de misleidende reclame inzake de vrije beroepen en de wet van 3 april 1997 betreffende de oneerlijke bedingen en overeenkomsten gesloten tussen titularissen van vrije beroepen en hun cliënten werden in het ontwerp geïncorporeerd.

De commissie heeft 5 vergaderingen aan de bespreking van het ontwerp besteed. Zij heeft aan de minister bevoegd voor de Volksgezondheid, Economie, Middenstand, KMO en aan de minister van Justitie schriftelijk de adviezen opgevraagd die zij ontvangen hadden van de verschillende organisaties en instellingen die de onder hun bevoegdheid ressorterende vrije beroepen vertegenwoordigen. De orde des baraux francophones et germanophones en de nationale raad van de orde van apothekers hebben hun opmerkingen rechtstreeks en uit eigen beweging aan de commissie bezorgd. 

Tijdens de bespreking in commissie werd vooral aandacht besteed aan de volgende punten. Ik geef een opsomming. De nationale orde van apothekers had gevraagd geneesmiddelen en andere gezondheidsproducten voorwerp zouden zijn van een strengere regelgeving, vooral voor verkoop op afstand. De apothekers vroegen dat de verkoop op afstand van geneesmiddelen uitdrukkelijk zou worden verboden en dat vergelijkende reclame voor geneesmiddelen ongeoorloofd zou blijven, meer bepaald met het oog op de volksgezondheid. De vertegenwoordiger van de minister antwoordde dat dit een kaderontwerp is waarin steeds wordt verwezen naar mogelijke strengere wetten die reclame in zijn geheel alsook verkoop op afstand kunnen verbieden. Uiteindelijk werd evenwel een amendement aangenomen van mevrouw Gilkinet en de heer Tavernier dat bepaalt dat de Koning na advies van de beroepsregulerende overheden de vergelijkende reclame kan verbieden of beperken om de volksgezondheid te vrijwaren.

Een tweede discussie handelde over de definitie van een vrij beroep zoals omschreven in artikel 2 van de wet. De vraag werd gesteld of het ontwerp rekening hield met de realiteit dat vrije beroepen hun activiteit in een vennootschap uitoefenen. De heer Fournaux had terzake een amendement ingediend. Aangezien de vertegenwoordiger van de minister de argumentatie kon volgen, werd meteen geopteerd voor het regeringsamendement 17 waarbij een nieuw artikel 3 werd ingevoegd. Dit artikel stelt dat in het geval een vrij beroep wordt uitgeoefend in het kader van een rechtspersoon, zonder dat deze rechtspersoon titularis is van een vrij beroep, de rechtspersoon eveneens gebonden is door de bepalingen van de wet.

Een derde discussie betrof het amendement nr. 4 van mevrouw Barzin en de heer Van Overtvelt. Artikel 5, paragraaf 4 bepaalde dat in afwijking van paragraaf 2 de beroepsregulerende overheden bij een door de Koning bekrachtigde beslissing de vergelijkende reclame kunnen verbieden of beperken in de mate nodig om de waardigheid en de deontologie van het betrokken vrij beroep te vrijwaren. Evenwel hoeven de beroepsethische regels van bepaalde beroepen niet bij een koninklijk besluit te worden goedgekeurd, onder meer voor de advocatuur. Op die manier legde dit artikel een bijkomende verplichting op die niet te verantwoorden was en niet vereist was conform de richtlijn. Het amendement beoogde bepaalde beroepsregulerende overheden in staat te stellen vergelijkende reclame te verbieden of te beperken volgens de werkwijze die ze gewoonlijk hanteren als ze hun deontologische regels vaststellen en niet bij een door de Koning bekrachtigde beslissing. De heer Fournaux had een gelijkluidend amendement ingediend. Ondanks de argumentatie van de vertegenwoordiger van de minister dat het geenszins een opportuniteitsbeslissing van de Koning ging omdat Hij terzake geen initiatief kan nemen, werd het amendement van mevrouw Barzin en de heren Van Overtveldt en Fournaux aangenomen. De wet werd in die zin aangepast. 

Overeenkomstig amendement nr. 8 van de heer Fournaux en het gelijkluidend amendement nr. 5 van mevrouw Barzin en de heer Van Overveldt werd wel opgenomen dat de Koning die mogelijkheid behoudt voor de vrije beroepen die wel over een deontologisch normkader beschikken maar niet over een beroepsregulerende overheid. 

Het gehele wetsontwerp zoals geamendeerd werd eenparig aangenomen.

The draft law on misleading and comparative advertising, the unlawful clauses and the remote agreements on freelance professions has a dual objective. On the one hand, the draft aims to align Belgian legislation on freelance professions with three European directives. The committee held five meetings to discuss the draft. The Minister’s representative replied that this is a framework draft which always refers to possible stricter laws that may prohibit advertising in its entirety as well as distance sales. Ultimately, however, an amendment was adopted by Mrs. Gilkinet and Mr. Tavernier which provides that the King may, following the advice of the professional regulatory authorities, prohibit or restrict comparative advertising in order to safeguard public health.

A second discussion concerned the definition of a freelance as defined in Article 2 of the Act. The question was asked whether the draft took into account the reality that free professions carry out their activity in a company. Mr Fournaux had submitted an amendment in this regard. As the representative of the Minister could follow the argument, the Government Amendment 17 was immediately opted for, which added a new Article 3. Where a freelance profession is exercised within the framework of a legal person, without that legal person being the titularis of a freelance profession, the legal person is also bound by the provisions of the law.

The third discussion concerned the amendment no. 4 by Mrs. Barzin and Mr. Van Overtvelt. Article 5, paragraph 4, stipulated that, by way of derogation from paragraph 2, the professional regulatory authorities may, by a decision confirmed by the King, prohibit or restrict comparative advertising to the extent necessary to safeguard the dignity and deontology of the freelance in question. However, the rules of professional ethics of certain professions do not need to be approved by a royal decree, in particular for the legal profession. Thus, this article imposed an additional obligation which was not liable and not required under the Directive. The amendment was intended to enable certain professional regulatory authorities to prohibit or restrict comparative advertising in accordance with the practice they normally use when establishing their deontological rules and not by a decision ratified by the King. Mr Fournaux had submitted a similar amendment. Despite the argument of the representative of the minister that it was in no way an opportunity decision of the King because he cannot take initiative in this regard, the amendment of Mrs. Barzin and the gentlemen Van Overtveldt and Fournaux was adopted.                     Monsieur le président, monsieur le ministre, chers collègues, les directives européennes imposent à la Belgique d'adapter son cadre légal pour les professions libérales en ce qui concerne la publicité trompeuse et la publicité comparative, les clauses abusives et les contrats à distance. 

En commission, mon groupe a été particulièrement attentif aux conséquences du projet de loi pour les professions libérales travaillant dans le secteur de la santé. En effet, si nous pouvions nous inscrire dans un dispositif visant à rendre plus homogène les différentes législations nationales des pays qui s'inscrivent dans un processus européen et à réaliser aujourd'hui ce travail pour les professions libérales, nous avons également estimé que la santé publique relève d'un principe supérieur qui doit toujours être protégé. 

Nous avons donc demandé que les avis des ministres de la Santé et des ordres concernés par la santé puissent être communiqués aux membres de la commission. Nous tenons ici tout particulièrement à remercier les personnes qui ont apporté leur contribution à cette importante question, ainsi que les membres de la commission qui ont accédé à notre demande. Lors de l'examen du projet de loi, nous avons examiné chaque article à la loupe du principe supérieur de la santé publique. A chaque fois, la question que nous nous sommes posée était la suivante: le texte proposé entraîne-t-il une limitation des lois visant à protéger la santé publique ou une limite de la compétence du ministre de la Santé publique, compétence que le ministre doit pouvoir conserver afin d'exclure certaines activités du circuit commercial dans le but de protéger la santé de la population.

Lors de cet examen attentif, il nous est apparu que deux problèmes se posaient. Tous deux ont été rencontrés. En effet, il était important de prévoir dans le projet — et ceci a fait l'objet d'une importante discussion entre tous les membres de la commission et notre président, M. Grafé — que la personne morale, titulaire d'une profession libérale (par exemple, dans une pharmacie) ne puisse échapper à la législation en raison de sa qualité de personne morale. En d'autres termes, il fallait prévoir dans la loi que lorsqu'une profession libérale est exercée dans le cadre d'une personne morale sans que cette dernière soit titulaire d'une profession libérale, ladite personne morale soit également liée par les dispositions de la loi. L'amendement que le gouvernement a déposé à l'article 2 rencontre cette préoccupation.

L'autre point qui nous préoccupait avait trait à la publicité comparative. En effet, sur tous les autres points, les lois existantes limitent de facto, lorsque la santé publique est en cause, les nouveaux droits créés. Ainsi, par exemple, il n'est pas possible en Belgique d'établir un commerce de vente à distance de médicaments puisque la vente de médicaments est réglée chez nous par des lois très strictes qui continuent à exister indépendamment du projet qui nous occupe aujourd'hui.

Par contre, l'ouverture de la publicité comparative aux professions libérales nous tracassait d'autant que le projet initial ne prévoyait la limitation possible que pour "seulement protéger la dignité et la déontologie de la profession libérale concernée". 

Il nous est apparu qu'il était essentiel de prévoir la limitation également pour des raisons de santé publique. C'est pourquoi nous avons introduit — et obtenu — un amendement qui permet bien de respecter ce que d'aucuns appellent l'exception santé. Grâce à notre amendement, le Roi pourra interdire ou restreindre, après avis des autorités professionnelles, la publicité comparative pour préserver la santé publique. Nous sommes heureux de l'avoir obtenu.

Puisque, au terme de nos travaux, nos inquiétudes sont levées grâce, d'une part, à l'amendement du gouvernement et, d'autre part, à notre amendement pour l'exception santé, mon groupe votera le projet de loi qui nous est soumis.

We have therefore requested that the opinions of the Ministers of Health and the health orders concerned may be communicated to the members of the committee. We would like to especially thank the people who have contributed to this important issue, as well as the members of the committee who have accepted our request. During the review of the bill, we examined each article to the lump of the higher principle of public health. The other point that concerned us was related to comparative advertising. Indeed, on all other points, existing laws limit de facto, when public health is concerned, the new rights created. Thus, for example, it is not possible in Belgium to establish a business of distance sales of medicines since the sale of medicines is regulated in our country by very strict laws that continue to exist regardless of the project that occupies us today.

On the other hand, the opening of comparative advertising to liberal professions bothered us as much as the initial project provided for the possible limitation only to "only protect the dignity and deontology of the liberal profession concerned". by

It appeared to us that it was essential to provide for the limitation also for public health reasons. That is why we have introduced — and obtained — an amendment that makes it possible to respect what some call the health exception.                     De verkoop op afstand van geneesmiddelen is niet expliciet in het ontwerp opgenomen. Het ontwerp bepaalt duidelijk dat het principieel toegelaten is, behoudens strengere wetten. Het komt eigenlijk hierop neer: de cliënt kan elektronisch bestellen, kan met de apotheker communiceren, maar moet zelf de producten komen ophalen. Wat de arts betreft, kan er natuurlijk nooit sprake zijn van consultatie op afstand. Enfin, monsieur le président, quelques exceptions ont été prévues pour les services financiers qui sont rendus.                     Mijnheer de voorzitter, mijnheer de minister, collega's, het ontwerp van bijzondere wet tot waarborging van gelijke vertegenwoordiging van mannen en vrouwen op de kandidatenlijsten voor de verkiezingen van de Brusselse Hoofdstedelijke Raad, de Waalse Gewestraad en de Vlaamse Raad werd door de Senaat overgezonden. Dit ontwerp steunt op dezelfde principes als de wet die wij eerder hebben goedgekeurd en die op de Europese verkiezingen van toepassing is. Het komt erop neer dat bij de samenstelling van de lijsten de helft van de kandidaten van het andere geslacht moet zijn en dat de eerste twee kandidaten van een verschillend geslacht moeten zijn. Voor de volgende verkiezingen is er evenwel in een overgangsregeling voorzien die bepaalt dat één van de eerste drie kandidaten van het andere geslacht moet zijn. Mevrouw de minister wijst erop dat experts zeggen dat de doelstelling die wij hiermee willen bereiken, namelijk paritaire democratie, het best wordt bereikt door het toepassen van het ritsprincipe op de hele lijst of door het ritsprincipe zeker toe te passen op de plaatsen bovenaan de lijst. De experts zeggen evenzeer dat de halvering of de volledige afzwakking van de waarde van de lijststem bijna geen positief effect heeft op het aantal vrouwen dat zal worden verkozen.

Ook de Raad van de gelijke kansen voor mannen en vrouwen stelt in zijn advies, dat hij naar aanleiding de resultaten van de gemeente- en provincieraadsverkiezingen naar buiten heeft gebracht, dat de halvering of de verdwijning van de lijststem slechts 3% verschil maakt. Het bevoordeelt vooral de vrouwen in de vrouwvriendelijke partijen. De Raad wijst er voorts op dat, indien het voorstel bij de vorige verkiezingen van toepassing was geweest, er 33% meer vrouwelijke verkozenen zouden zijn geweest. Nu was er slechts een stijging van 22%.

De indieners van de aansluitende wetsvoorstellen, de Agalev/Ecolofractie en de PS-fractie, oordelen dat het ontwerp van de minister hun doelstellingen overneemt.

Bij de bespreking stelt CD&V dat de regeling beter zou zijn opgenomen in de komende hervorming van de kieswetgeving. CD&V denkt dat het beoogde effect verloren zal gaan bij de vorming van provinciale kieslijsten. CD&V wil in de nieuwe regeling de pariteit eveneens op de voorziene opvolgersplaatsen van toepassing maken. Ook wijst de fractie erop dat het om een bijzondere wet gaat, die een gewone wet, het kieswetboek, regelt. Ze geeft echter wel toe dat het gebeurde op advies van de Raad van State.

Het Vlaams Blok wil de bespreking uitstellen tot de hervorming van de kieswetgeving er is.

De Mouvement Réformateur, gaat bij monde van de heer D'hondt, akkoord met pariteit, maar niet met de voorliggende regeling. Hij vindt dat België het niet zo slecht doet op het vlak van de vertegenwoordiging van vrouwen. De Mouvement Réformateur wil de regeling tot één keer beperken en betreurt dat zoiets niet in de tekst is ingeschreven.

Mevrouw Cahay benadrukt daarentegen de noodzaak om in een overgangsmaatregel te voorzien, omdat anders de partij de pariteit op de lijst niet zal kunnen realiseren.

Spirit staat achter het principe, maar wil het opgenomen zien in de aangekondigde hervorming van de kieswetgeving. De partij wil het principe trouwens ook toepassen op de opvolgersplaatsen. De Agalev/Ecolo-fractie zegt dat onderhavig ontwerp het logische gevolg is van de eerder goedgekeurde wet. Ze stelt dat vrouwen in het maatschappelijke leven en de politiek goed op weg zijn om de pariteit te halen, maar dat die trage beweging een duwtje nodig heeft. De wet zal in de toekomst ook mannen beschermen. Als de pariteit een vanzelfsprekendheid is geworden, mogen die regeltjes best worden afgeschaft.

De PSC rekent op de steun van de vrouwen om de pariteit op de lijsten te behouden om, indien nodig, de vertegenwoordiging van mannen te beschermen.

Er werden bij de bespreking nog enkele tekstverbeteringen voorgesteld. Ze werden ook aanvaard. Er werden verschillende amendementen ingediend door de PS-fractie die ertoe strekten om de sancties waarin wordt voorzien voor de ingediende lijsten die niet aan de voorwaarden voldoen ook in de bijzondere wet op te nemen. Ook deze amendementen werden aanvaard. Het geamendeerde ontwerp werd aanvaard met 12 stemmen en 2 onthoudingen.

At the discussion, CD&V stated that the arrangement would have been better incorporated in the upcoming reform of the electoral legislation. The Flemish Bloc wants to postpone the discussion until the reform of the electoral legislation is in place.

The Mouvement Réformateur, according to Mr. D'Hondt, agrees with parity, but not with the prevailing arrangement. He believes that Belgium does not do so badly in terms of the representation of women. The Mouvement Réformateur wants to limit the regulation to one time and regrets that such a thing is not recorded in the text.

Cahay, on the other hand, stresses the need to provide for a transitional measure, otherwise the party will not be able to ⁇  parity on the list.

Ik ben ervan overtuigd dat als vrouwen posities verwerven, ook in de politiek, ze daadwerkelijk de belangen van vrouwen kunnen behartigen en wij erop vooruitgaan. De overheid maakt met dit ontwerp een duidelijke keuze voor een evenredige vertegenwoordiging van mannen en vrouwen in de politiek. Spijtig genoeg gebeurt dat met een overgangsmaatregel en met een veeleer beperkt ritssysteem. De verplichte vertegenwoordiging van vrouwen op verkiesbare plaatsen werkt. Onze partij past dit systeem al jaren toe met als resultaat dat vrouwen zeer goed vertegenwoordigd zijn. Het is natuurlijk niet het enige en zaligmakende instrument, er is voor de rest nog heel wat te doen. Waarom dringen wij zo aan op die pariteit? De huidige oververtegenwoordiging van mannen is niet meer normaal. Niet alleen onder de leden van deze assemblee maar ook in de regering zijn vrouwen nog steeds in de minderheid. Ook in de sleutelposities van de verschillende politieke fracties zijn mannen nog oververtegenwoordigd. Het is dus een kwestie van rechtvaardigheid. De helft van de bevolking is man of vrouw. Vrouwen zijn dus helemaal geen minderheid of geen bepaalde doelgroep; ze maken de helft uit van de bevolking. Het Parlement moet een afspiegeling van die bevolking zijn. Maken vrouwen dan het verschil? Als een groep voldoende vertegenwoordigd is, dan kan zij wegen op de besluitvorming. Zij maken dan het verschil. Vrouwen brengen immers andere thema's aan of leggen andere accenten. Dat komt omdat mannen- en vrouwenlevens in het dagelijks leven nog altijd verschillend zijn.

Vrouwen nemen nog steeds — alle emancipatie en alle gelijkheid ten spijt — meer zorgtaken op zich en zetten nog steeds eerder dan mannen een stapje terug op de arbeidsmarkt. Wat vrouwen bekommert vanuit hun andere beleving moet ook aan bod komen in het Parlement. Dit maakt het Parlement en de politiek meer compleet. Op termijn zal de groep vrouwen ook de politieke mentaliteit en cultuur kunnen en moeten veranderen. De evaluatie van de wet — waarop men heeft geïnsisteerd — zal aantonen dat de complete pariteit nog niet werd bereikt. Ik meen dat er slechts sprake zal zijn van een evolutie. U kunt er niet omheen, mevrouw de minister, dat beide politieke akkoorden, namelijk de vergroting van de districten en de wederinvoering van het systeem van de opvolger, haaks staan op het doel dat u nastreeft in uw ontwerp.

Ik stel vast dat bij de jongste parlementsverkiezingen op de CVP-lijst verhoudingsgewijs de meeste vrouwen op verkiesbare plaatsen stonden. Ik zal dat aan de hand van cijfers aantonen. Dat is mij meer waard dan het gegrom dat u voortbrengt. In het wetenschappelijk tijdschrift Res Publica werd een artikel gepubliceerd waarin werd vastgesteld dat op de CVP-lijsten bij de verkiezingen van 13 juni 1999 36% van de verkiesbare plaatsen door dames werden ingenomen. Het gaat om de lijsten voor het federaal Parlement, de gewest- en de gemeenschapsassemblees en het Europees Parlement. Op de tweede plaats, mevrouw Grauwels, komt Agalev met 33%. Vervolgens krijgen we Ecolo met 29%, de PSC met 23%, de PRL-FDF-MCC met 22% en de VLD met 21%.

                    Mijnheer de voorzitter, in feite neemt de heer Vanhoutte mij de woorden uit de mond, maar ik wens er nogmaals de nadruk op te leggen dat het systematisch jarenlang toepassen van een ritssysteem op de lijsten heeft gewerkt. De Agalev-Ecolo-fractie is daarvan een voorbeeld. U ziet tot welke vertegenwoordiging dit leidt. Het ritsprincipe werkt! Maar, vanzelfsprekend moeten de vrouwen op de verkiesbare plaatsen staan. Het is niet voldoende een lijst op te stellen bestaande uit de helft mannen en de helft vrouwen, bovenaan voor de make-up bij voorbeeld een vrouw en achteraan voor het overige. Het is belangrijk dat ze op verkiesbare plaatsen staan om daadwerkelijk ook te kunnen worden verkozen.

Ik wens te beklemtonen dat we legistiek gezien in een bijzondere situatie terechtkomen. Eerst wordt de afzonderlijke lijst van de opvolgers afgeschaft. De betreffende wetten werden reeds in het Belgisch Staatsblad gepubliceerd. Vervolgens zullen de voorliggende ontwerpen worden goedgekeurd en eveneens in het Staatsblad gepubliceerd. Nog later zullen eventueel de wetten die de meer algemene hervorming van de kieswet tot stand brengen, worden goedgekeurd en gepubliceerd in het Belgisch Staatsblad. Binnen de tijdspanne van een paar maanden wordt eerst het systeem van de opvolgers afgeschaft. Daarna volgt een regeling om de dames beter aan de bak te laten komen voor de eerste plaatsen. Vervolgens wordt heel het systeem opnieuw door elkaar gehaald. Dat is het politiek systeem waarin wij draaien! Soms vraagt men zich af waarom de politiek ongeloofwaardig is geworden. Dit is daar een voorbeeld van! Men springt voortdurend van het ene been op het andere, zodat ten langen leste de situatie voor niemand nog duidelijk is.

Mijnheer Tant, dat er om de haverklap nieuwe wetten worden gepubliceerd inzake de kieswetgeving om ze vervolgens opnieuw op te heffen toont mooi aan dat de aanpak van de meerderheid gestoeld is op de verkeerde inschatting dat het beleid bij de bevolking niet aanslaat omdat er te veel procedures zouden zijn. Dat is een misvatting. De mensen vragen beter beleid. De paars-groene meerderheid denkt dat te kunnen oplossen met transfers en rommelen aan de kieswetgeving. Dat is een fundamentele misvatting die bij de volgende verkiezingen zal blijken. Dat is de reden waarom in het Staatsblad een soort roman wordt gepubliceerd met afleveringen van nieuwe wijzigingen van fundamentele wetgeving. De meerderheid denkt dat de aversie van de publieke opinie ten opzichte van de politiek te maken heeft met procedures en kieswetgeving. De aversie heeft echter alles van doen met het slechte beleid en een beleid dat niet ingaat op de verzuchtingen van de bevolking. Dat is de reden van de onvrede bij de bevolking.

Mag ik u even herinneren aan de werkzaamheden in de commissie: bijna elk artikel is, indien niet geamendeerd, dan toch gecorrigeerd. Daartoe hebben wij in belangrijke mate bijgedragen. Het feit dat men achter een doelstelling staat, moet niet betekenen dat elk middel goed is, nietwaar. Wees toch eerlijk: eerst schaft men een aantal bepalingen af, nadien weigert men de concrete toepassing ervan en daarna voert men ze opnieuw in. Men kan toch niet zeggen dat dit ernstig wetgevend werk is!

Collega's, er is echter meer, als ik u daarmee even mag vermoeien. Men kan inderdaad een aantal opmerkingen van legistieke aard maken, mevrouw de minister. Bij dit ontwerp kan men zich afvragen of het opzet via een afzonderlijke wet moet worden gerealiseerd en waarom de bepalingen niet in de betrokken kieswet worden ingevoerd. Dat zou tenminste ordentelijk werk zijn. De werkwijze van de minister heeft tot gevolg dat bepalingen in de kieswet worden opgeheven en daarna, met dit ontwerp en met de amendementen die in de commissie zijn ingediend en aangenomen, in een afzonderlijke wet opnieuw worden ingevoerd. Vanuit wetgevend-technisch oogpunt is dat ons inziens zeker niet de best manier van werken.

Voor wie het even in de teksten wil verifiëren: artikel 2 van het ontwerp van bijzondere wet bepaalt dat op de lijsten voor de verkiezing van de Brusselse Hoofdstedelijke Raad het verschil tussen het aantal kandidaten niet groter mag zijn dan één, en dat de eerste twee kandidaten van de lijsten van een verschillend geslacht moeten zijn. Ik denk dat het voor iedereen duidelijk is dat het meer aangewezen ware geweest dit artikel in te voeren in de bijzondere wet van 12 januari 1989 met betrekking tot de Brusselse instelling, meer bepaald in artikel 16bis over de voordracht van kandidaten. 

Daar hoort het thuis, maar daar is het niet ingeschreven. Met die werkwijze had het volstaan in artikel 12, § 3, 2°bis te verwijzen naar 16bis van de bijzondere wet. In dat geval hadden wij artikel 12, § 3, 2°bis van de gewone wet ook niet moeten opheffen. Dat artikel kon gewoon gewijzigd worden door te verwijzen naar de bijzondere wet. Die werkwijze zou ook de coherentie van de wetgeving ten goede zijn gekomen.

From a legislative-technical point of view, this is ⁇  not the best way to work.

Article 2 of the draft special law stipulates that on the lists for the election of the Brussels Capital Council the difference between the number of candidates may not be greater than one, and that the first two candidates must be from the lists of a different gender. I think it is clear to everyone that it would have been more appropriate to include this article in the special law of 12 January 1989 concerning the Brussels institution, more specifically in Article 16bis concerning the nomination of candidates. It belongs to home, but it is not registered there. With that method, it would have been sufficient to refer in Article 12, § 3, 2°bis, to 16bis of the Special Act. Heeft het maken van kaduke en onsamenhangende wetgeving geen enkel belang, mits het na te streven doel behartigenswaardig is? Het spijt mij, maar op dat punt hebben wij een andere opvatting over wetgevend werk. Dat zijn wij aan het doen. Wij maken teksten die in een bestaande wetgeving moeten passen, in een bijzondere wet en in kieswetgeving. U vindt dat blijkbaar allemaal niet belangrijk, zolang de wet het doel maar dient. Welnu, daarover verschillen wij fundamenteel van mening.

Mevrouw Drion, sta me toe een ander voorbeeld te geven dat u nog zuur zou kunnen opbreken in de komende jaren. In de commissievergadering zei ik aan de minister al dat zelfs technische bepalingen in de kieswetgeving nu voor sommige assemblees bij bijzondere wet worden geregeld. Artikelen van een gewone wet worden door middel van een bijzondere wet aangepast. Weet u wel wat de consequenties daarvan zijn? Als u die technische bepalingen in de toekomst opnieuw wilt bijsturen, dan zult u over een bijzondere meerderheid moeten beschikken. Dan zal blijken dat u die bijsturing er niet door krijgt.

Dat is de voor de hand liggende manier van werken. Hoe kunnen mensen weten hoe verkiezingen worden georganiseerd? Als kiezer of als potentiële kandidaat zullen ze de kieswetgeving raadplegen. Vandaag moeten ze andere bronnen gaan opsporen. Ik kan dat alleen maar betreuren. Dit komt de samenhang van de wetgeving in elk geval niet ten goede.

Mevrouw de minister, daarnet heb ik het gehad over de inspanningen die de ene en de andere partij hebben gedaan op vraag van mevrouw Grauwels — of was het de heer Vanhoutte? Ik heb aangetoond dat mijn partij een meer dan behoorlijke inspanning heeft geleverd. Dat kan zeker niet gezegd worden van de PS-lijsten. Slechts 17% van de verkiesbare plaatsen waren voor dames voorbehouden. Op de SP-lijst was dat trouwens nog minder, namelijk 15%. Dan maakt u hier het intentieproces van de een en de ander!

Je remercie l'ensemble des partis démocratiques qui, notamment lors des dernières élections communales, on fait un effort sensible. Il faut poursuivre cet effort. L'histoire ne s'est pas arrêtée à un moment donné. Il y a eu, à une certaine période, au sein de mon parti, des problèmes concernant la présence des femmes sur les listes électorales. Mais cela a changé. Nous voulons accentuer, solidifier ce mouvement qui est en train de se développer, par le biais des projets qui nous sont proposés.

J'insiste sur le fait que je me situe dans une continuité. J'ai toujours dit, où que je sois, que le travail réalisé par Mme Smet en la matière, avec la contribution de M. Tobback, était tout à fait remarquable dans un climat politique peut-être plus difficile. En effet, il suffit de regarder ce qui s'est passé en France... Nous avons un environnement qui pousse davantage à des prises de décisions législatives pour assumer cette parité. Je remercie toutes celles qui m'ont précédée comme l'ensemble des mouvements et des femmes précurseurs en la matière. Nous poursuivons, ceci étant un mouvement.

                    Mevrouw de minister, ik stel enkel vast dat bij uitstek de politieke partijen in deze problematiek hun invloed kunnen laten gelden. Bij de laatste parlementsverkiezingen constateer ik dat de ene partij een grotere inspanning heeft geleverd dan de andere. Het is geen behoorlijke discussie meer wanneer u stelt dat wij over de legistieke kwaliteit niet mogen spreken omwille van het feit dat wij het politiek niet hebben waargemaakt. Ik blijf erbij dat onze partij in het verleden een behoorlijke inspanning heeft geleverd. Historisch heeft die inspanning haar vruchten afgeworpen. Wij zijn het eens dat een volgende stap noodzakelijk is, maar dan in legistiek behoorlijke omstandigheden.

Ik vind het bedroevend dat het Parlement tot dit niveau is afgegleden: men is zelfs niet meer bereid om over de kwaliteit van de wetgeving met elkaar van gedachten te wisselen, zonder elkaar met vooroordelen te lijf te gaan. Ik vind dat het Parlement beter verdient. Ik zou liever zien dat men zich anders gedraagt. Dat is mijn persoonlijke visie en de visie van mijn partij. Principieel zijn wij de zaak genegen. Wij betreuren echter dat het geheel in dergelijke omstandigheden moet totstandkomen. Overigens zijn wij er nog niet. De bedenkelijke legistieke kwaliteit heeft ervoor gezorgd dat een aantal amendementen noodgedwongen moest worden aanvaard. Bijgevolg kan de tekst opnieuw naar de Senaat worden gestuurd. Dat is het feitelijke gevolg van wat hier gebeurt. Het gebrek aan kwaliteit krijgt meer en meer de bovenhand in dit Parlement en in het bijzonder bij deze regering.

Parliament deserves better. I would rather see people behave differently. That is my personal vision and the vision of my party. In principle, we are pleased with the matter. We regret, however, that the whole must be created under such circumstances. By the way, we are not there yet. The questionable legislative quality has caused a number of amendments to be forced to be accepted. Consequently, the text can be sent back to the Senate. That is the actual consequence of what is happening here. The lack of quality is becoming increasingly prevalent in this Parliament and in particular in this government.

                    Comme ma collègue Christine Grauwels l'a dit, nous sommes satisfaits de ce projet de loi car il nous semble qu'au niveau de notre assemblée, depuis le mois de janvier et depuis le vote de la réforme de la Constitution intégrant l'égalité entre les femmes et les hommes au sein même de notre charte fondamentale, nous faisons en sorte qu'il y ait une réelle et égale représentation des femmes et des hommes dans les lieux de décision et de représentation.

Toutefois, nous regrettons de n'avoir pu aller plus loin à ce stade-ci et que cette période transitoire ait dû être inscrite. Car aux prochaines élections déjà, des candidats des deux sexes auraient pu accéder de manière égale aux deux premières places. Le principe me semble avoir été bradé.

Néanmoins, il faut rester réaliste: au sein du monde politique, une série de nos collègues sont encore réticents à ces principes reconnus unanimement maintenant.

Lorsque nos assemblées représentatives — pour le moment, à la Chambre, nous en sommes à 17 ou 18%...

D'autres mesures sont aussi importantes que celles sur lesquelles nos collègues travaillent en matière de renouveau politique 

Enfin, pour ceux qui ont à coeur de concrétiser cette égalité entre les hommes et les femmes dans les faits et dans la vie de tous les jours, certains dossiers doivent avancer.

Il ne suffit pas que des femmes soient élues, il faut que les dossiers réellement relatifs à l'égalité quotidienne entre les femmes et les hommes soient pris en main par le pouvoir législatif et exécutif. Citons par exemple le dossier sur le fonds de créances alimentaires qui avance très bien mais aussi ceux sur l'individualisation des droits en matière de sécurité sociale et la suppression de l'article 80 de la législation sur le chômage, qui frappent injustement les femmes qui sont donc victimes de discrimination.

Il est nécessaire de bien prendre conscience, au risque de refroidir certains de nos collègues, qu'en votant ce projet de loi, il y aura plus de femmes et que la pression, lors de la prochaine législature, s'accroîtra pour que ces dossiers essentiels en matière de sécurité sociale progressent et que cette égalité se marque dans les faits et dans le quotidien.

Ik meen dat niemand van mijn vrouwelijke collega's die hier zitten dat kan zeggen. Natuurlijk is er in alle fracties een beetje gemor. Men vraagt een wetgeving die niets anders wil dan de kiezer verzekeren dat hij of zij in de toekomst een daadwerkelijke keuze heeft. Dat beogen deze ontwerpen. Op de lijsten moeten namelijk mensen figureren van beide geslachten in een ongeveer gelijke hoeveelheid en niet in een willekeurige volgorde. We weten dat het vooral in de volgorde van belang is dat er een verschillende vertegenwoordiging is naar geslacht. Dat ligt in de ene partij al wat moeilijker dan in de andere. Hoewel men het misschien niet zo openlijk zegt — hoewel men dat vanmorgen in de commissie wel deed — komt men in discussies steeds terug op één argument. Het is de bekwaamheid die de doorslag moet geven. Wij leven in een parlementaire democratie. In een parlementaire democratie is er één soort bekwaamheid, namelijk verkozen worden. De kiezer beslist wie hier zal zitten. Iemand moet voor mij maar eens definiëren wat bekwaamheid is in termen van politiek. Is het een hoog opleidingsniveau? Dan zouden hier veel meer vrouwen dan mannen moeten zitten want gemiddeld zijn de vrouwen in ons land nu hoger opgeleid dan de mannen. Is het soms het vermogen om goed te kunnen praten? Historisch heeft men vrouwen steeds verweten dat ze te veel en te goed konden praten. Dat kan het dus niet zijn. Is het talenkennis? Dan stel ik voor om in de regering dringend enkele maatregelen te nemen want er zijn ministers die misschien wel in de twee landstalen kunnen lezen maar zeker niet spreken. Het begrip bekwaamheid is dus een heel relatief begrip. Men moet verkozen geraken. Net zoals in elke andere maatschappelijke organisatie, of het nu een sociale, een politieke of een economische is, proberen zij die op een bepaald moment — zoals we het wat "colloquial" kunnen zeggen — het spul in handen hebben de macht te behouden. Wanneer men als bedrijf op een markt dominant is, dan zal men proberen om daar een monopoliepositie te gaan verstevigen en verdedigen en eventueel met twee of drie concurrenten een afspraakje te maken over de prijs of over verticale integratie en niemand anders binnen te laten.

Daaraan hebben we gedacht. Wat dat betreft, hebben we zowel in België als in Europa als op wereldniveau regels en wetten die bepalen dat dergelijke zaken niet kunnen. In de politiek is het niet anders. Wanneer een aantal mensen disproportioneel veel macht heeft en een andere groep — niet altijd bewust maar toch in de feiten — uitsluit dan moet daarop worden toegekeken. Daarvoor is een gelijke vertegenwoordiging op de lijsten belangrijk want de kiezer beslist nog altijd net zoals vroeger. Wil de kiezer hier in 2003 geen vrouwen dan moet men niet voor vrouwen stemmen. In de toekomst krijgt de kiezer evenwel de keuze en dat is belangrijk.

Mevrouw Drion heeft gelijk. Bij een democratie zit de macht in het aantal. Zo lang hier niet genoeg mensen zitten die ook de andere helft van de maatschappij vertegenwoordigen, zullen bepaalde thema's die op de agenda staan niet ter sprake komen. Zij heeft er een aantal opgenoemd maar er zijn er nog andere. Ik kan u de beschamende vertoning laten herlezen die in de commissie voor de Justitie werd opgevoerd toen wij het hadden over de naamgeving van kinderen. Ik heb toen de meest groteske argumenten gehoord die niets met justitie of goed wetgevend werk te maken hadden maar alles met behoud van een machtspositie en met frustraties.

Om die reden, dames en heren, omdat we op alle vlakken een evenwichtige maatschappij willen, moeten hier meer personen komen van beide geslachten. Ik en mijn fractie zullen deze wetgeving dan ook steunen.

One demands legislation that wants nothing but to assure the voter that he or she has a real choice in the future. This is the purpose of these designs. In fact, the lists should include people of both sexes in an approximately equal number and not in an arbitrary order. We know that it is especially in the order of importance that there is a different representation by gender. This is much more difficult in one party than in the other. Even though it may not be said so openly — even though it was done this morning in the committee — in discussions one always comes back to one argument. It is the capacity that must give the decision. We live in a parliamentary democracy. In a parliamentary democracy, there is one kind of competence: to be elected. The voters decide who will sit here. Someone needs to define for me what competence is in terms of politics. Is it a high level of education? Then there would be a lot more women than men here because, on average, women in our country are now higher educated than men. Is it the ability to speak well? Historically, women have always been accused of being able to talk too much and too well. Therefore, it cannot be. Is it language knowledge? Then I propose to take some urgent measures in the government because there are ministers who may be able to read in the two national languages but ⁇  do not speak. The concept of competence is therefore a very relative concept. They must be elected. As in every other social organization, whether social, political, or economic, they try to retain power at a given moment—as we can call it something “colloquial”—who have the thing in their hands. When one as a company is dominant in a market, then one will try to start consolidating and defending a monopoly position there and possibly with two or three competitors to make an agreement on price or on vertical integration and let no one else enter.

We thought about that. In this regard, we have rules and laws both in Belgium and in Europe and worldwide that stipulate that such matters cannot be done. In politics it is no different. When a number of people has disproportionately much power and another group — not always consciously but nevertheless in the facts — excludes, then it must be looked at. For this, equal representation on the lists is important because the voter still decides as before. If the voters here in 2003 do not want women, then you should not vote for women. In the future, however, voters will be given a choice and that is important.

Mrs. Drion is right. In a democracy, power is in numbers. As long as there are not enough people here who also represent the other half of society, certain topics on the agenda will not be discussed. He mentioned some of them, but there are others. I can let you re-read the shameful display that was raised in the Justice Committee when we talked about the naming of children. I then heard the most grotesque arguments that had nothing to do with justice or good legislative work but all with ⁇ ining a power position and with frustrations.

                    Monsieur le président, je voudrais dire quelques mots et formuler trois remarques après la discussion générale sur ces deux projets (1680 et1681).

Premièrement, l'égalité des chances entre les hommes et les femmes est un combat permanent. Les projets qui vous sont proposés sont importants mais ils ne couvrent évidemment pas tout le champ des inégalités. Vous aurez à connaître d'autres projets qui, en matière d'égalité hommes/femmes, ont leur importance. Je pense par exemple à la loi anti-discrimination qui est à l'examen en commission de la Justice, à la création de l'Institut du genre qui doit revenir du Conseil d'Etat ou au projet de loi sur la violence intra-conjugale qui est également à l'ordre du jour de la commission de la Justice.

Vous avez cité, madame Drion, quelques combats à venir, que ce soit l'article 80 de la législation sur le chômage ou le débat si difficile de l'individualisation des droits à la sécurité sociale. On pourrait en citer beaucoup d'autres. Je pense par exemple à tous les moyens utilisés pour revoir la classification de fonctions puisque la situation actuelle aboutit à avoir des différences de salaires de quelque 20% pour un même travail entre les hommes et les femmes, ce qui est totalement inadmissible.

Ce qui vous est proposé est effectivement important. Avec plus de femmes dans les enceintes parlementaires, ce genre de combat à mener sera peut-être pris en charge différemment mais, je le répète, ce n'est qu'une parcelle de réponse aux problèmes que nous connaissons encore dans notre démocratie.

Deuxièmement, un des deux projets, celui qui concerne les conseils régionaux, doit repartir vers le Sénat. C'est une très bonne chose. Il y a eu un excellent travail juridique. La Chambre a modifié le projet qui doit donc être renvoyé au Sénat. Par contre, demain, il y aura, je l'espère, un vote définitif pour ce qui concerne les chambres législatives fédérales et le Conseil de la Communauté germanophone. Il aura fallu deux ans de travail pour y arriver, deux ans! La première fois que le gouvernement a accepté des projets de loi que j'avais déposés, c'était le 19 mai 2000, monsieur le président. Comme vous le voyez, ce n'est pas simple, il aura fallu franchir bon nombre d'étapes. En aucun cas, il ne faut retarder les travaux. Je sais que les propositions de loi spécifiques concernant notamment les circonscriptions électorales et la réintroduction des suppléants provoqueront de nouveaux débats. Mais n'attendons pas pour déjà prendre une décision. Une étape sera ainsi franchie. Vous reprendrez le flambeau lors de la discussion de ces nouvelles propositions de loi et vous proposerez éventuellement des modifications permettant aux femmes d'être mieux représentées grâce aux modifications qui s'annoncent. Mais "un tiens vaut mieux que deux tu l'auras". Nous sommes dans une situation donnée au niveau de la législation électorale. Imposons, dès maintenant, de franchir ce cap de la parité sur les listes électorales et de la présence des deux sexes aux premières places.

Enfin, je voudrais attirer l'attention sur le fait qu'il n'y a jamais de droit acquis en la matière. Je ne vois donc pas d'inconvénient à ce que l'on "bétonne" certaines dispositions dans les lois spéciales. Regardez ce qui s'est passé en France où, après le vote d'une législation, il y a un peu plus d'un an, et à l'approche des élections législatives, d'aucuns ont déjà signalé qu'ils préféraient payer l'amende que de respecter la législation sur la parité en matière électorale.

Pour notre part, nous avons procédé différemment. Il n'est pas question d'amende. Si la liste ne correspond pas aux critères que vous allez décider, elle ne sera pas recevable. 

Il s'agit bien entendu d'un combat comportant de multiples facettes. Nous n'aurons pas terminé notre oeuvre avec le vote de ce projet. Même si nous avons déjà gagné plusieurs combats, nous devons rester vigilants. Les forces conservatrices sont là aussi pour parfois remettre en cause des acquis aussi fondamentaux que celui-ci. 

Monsieur le président, je voudrais remercier toutes celles et tous ceux qui, depuis le départ, ont soutenu la démarche initiée par le gouvernement.

Mr. Speaker, I would like to say a few words and make three remarks after the general discussion on these two projects (1680 and 1681).

First, equal opportunities between men and women are a constant struggle. The projects that are proposed to you are important but they obviously do not cover the entire scope of inequalities. You will have to know other projects that, in terms of gender/gender equality, have their importance. I think for example of the anti-discrimination law that is being examined in the Justice Committee, the creation of the Gender Institute that should come back from the State Council or the draft law on intra-marital violence that is also on the agenda of the Justice Committee.

You have cited, Mrs. Drion, some upcoming struggles, whether it be Article 80 of the unemployment legislation or the so difficult debate of the individualization of the rights to social security. Many others could be cited. I think, for example, of all the means used to revise the classification of functions since the current situation results in salary differences of about 20% for equal work between men and women, which is totally unacceptable.

What is offered to you is really important. With more women in parliamentary offices, this type of struggle to be conducted may be handled differently but, I repeat, this is only a fraction of the answer to the problems we still know in our democracy.

Secondly, one of the two projects, the one concerning the regional councils, must go back to the Senate. This is a very good thing. There was excellent legal work. The House has amended the draft which must therefore be returned to the Senate. On the other hand, tomorrow, I hope, there will be a final vote for the federal legislative chambers and the Council of the German-speaking Community. It would have taken two years of work to get there, two years! The first time the government accepted the bills I had submitted was on 19 May 2000, Mr. President. As you can see, it is not easy, it has taken a lot of steps. Under no circumstances should work be delayed. I know that specific bills concerning, in particular, electoral districts and the reintroduction of replacement members will trigger further debate. But let’s not wait to make a decision. One step will be passed. You will take the flame back when discussing these new bills and you will eventually propose changes that allow women to be better represented through the changes that are being announced. “One of yours is better than two you will have.” We are in a given situation in terms of electoral legislation. Let us impose, from now on, to cross this line of parity on electoral lists and the presence of both genders in the first places.

Finally, I would like to draw attention to the fact that there is never a right acquired in this matter. Therefore, I do not see any inconvenience in the fact that certain provisions in special laws are "betoned". Look at what happened in France where, after the vote of a legislation, a little more than a year ago, and as the parliamentary elections approach, some have already ⁇  that they prefer to pay the fine than to respect the legislation on parity in electoral matters.

For our part, we acted differently. There is no question of a fine. If the list does not meet the criteria you will decide, it will not be accepted. by

This is, of course, a battle with multiple facets. We will not finish our work with the vote on this project. Even though we have already won several battles, we must remain vigilant. Conservative forces are also there to sometimes question such fundamental achievements as this. by

                    Mijnheer de voorzitter, voor dit wetsontwerp werd de spoedbehandeling gevraagd en het is besproken in de commissie voor het Bedrijfsleven op 22 mei 2002. Dit wetsontwerp beoogt in hoofdzaak het golden share-aandeel van de overheid te regelen in Distrigas NV en in Fluxys NV, twee vennootschappen die zijn ontstaan uit het oude Distrigas als gevolg van de wet op de liberalisering van de gasmarkt. Tegelijkertijd dient dit wetsontwerp als vehikel om het koninklijk besluit tot voorlopige dekking van de werkingskosten van de CREG wettelijk te bekrachtigen. Het wetsontwerp werd met eenparigheid van stemmen in de commissie aangenomen.
