Mijnheer de voorzitter, mevrouw de vice-eerste minister, collega's, net als in de commissie voor de Justitie vat ik met gemengde gevoelens de behandeling van dit wetsontwerp in plenaire vergadering aan. Enerzijds ben ik verheugd dat ik nogmaals het standpunt van het Vlaams Blok kan uiteenzetten over wat voor onze partij nu eigenlijk de begrippen ras en racialiteit zijn en daarover een aantal misverstanden uit de weg mag ruimen. Anderzijds ben ik weinig opgetogen over de verdere insijpeling van het politiek correct denken dat door deze wetgeving wordt geconstitueerd. Meer nog gebeurt dit door de antidiscriminatiewetgeving, maar daar heb ik het later wel over.
Juridisch-technisch vind ik dat er geen goed wetgevend werk werd geleverd. Dit geldt zowel voor de inhoud als voor de wijze van codificering. Voor eenzelfde materie werden namelijk twee verschillende wetteksten opgesteld. Alles wat werd besproken in de antiracismewet en in de antidiscriminatiewet had men gerust in één wettekst kunnen gieten. Wat hebben wij nu gedaan? In de commissie hebben wij in de algemene bespreking overlappend gewerkt en de twee samen behandeld, terwijl wij bij de artikelsgewijze bespreking en de stemming de twee verschillend hebben behandeld. Daarbij komt nog dat wij met twee snelheden werken: vandaag wordt het wetsontwerp tegen het racisme behandeld in plenaire vergadering en later op de week wordt daar nog over gestemd, terwijl op een ander ogenblik de antidiscriminatiewetgeving zal worden behandeld en goedgekeurd. Er is dus blijkbaar geen rekening gehouden met de pertinente opmerkingen van de Raad van State dat men dit beter in één wettekst inzake antidiscriminatie had gegoten. Als jurist kan men puur neutraal en objectief, van welke politieke strekking men ook is, stellen dat men het beter zo had gedaan en het advies van de Raad van State had gevolgd. Wellicht speelt hier een politieke component: men wil kost wat kost de afschaffing van de antiracismewet vermijden. Dat moet als een fetisj, als een soort icoon blijven bestaan om het politiek correcte denken over de begrippen ras en racialiteit extra in de verf te zetten.
Ten gronde wil ik nogmaals kort samenvatten waarom dit wetsontwerp weinig zal bijdragen tot de harmonieuze samenleving die er ongetwijfeld mee wordt beoogd. In de commissie heb ik dat uitvoerig gedaan. Ik laat wel ter zijde dat er ook lage politieke motieven meespelen om partijen, om bepaalde vrije meningen te fnuiken. Zoals ik in de commissie reeds zei, wil ik aannemen dat men te goeder trouw bepaalde zaken in de samenleving wil voorkomen en dat men de problemen waarmee de multiraciale samenleving worstelt, wil oplossen. Wij hebben daar verschillende visies over, maar ik wil begrip opbrengen voor het standpunt van de andersdenkenden terzake.
Het is wel fout de problematiek op deze wijze, met dit wetsontwerp, aan te pakken. Op de eerste plaats gaat men spelen met terminologieën waarmee men op het terrein, in de maatschappij, niks verandert. Het verkeerde uitgangspunt volgens het Vlaams Blok is het feit dat men met een declaratie in de wet door het woord "zogenaamd" aan het woord "ras" toe te voegen, meent daarmee vermeend of werkelijk racisme tegen te kunnen gaan. Nogmaals, het Vlaams Blok is geen voorstander van rassentheorieën, het Vlaams Blok maakt geen onderscheid in rassen. Voor ons zijn alle Vlamingen gelijkwaardig, of zij nu zwart zijn of blank, rood of geel. De meerderheid is inderdaad blank, maar dat kan in de loop van de geschiedenis misschien ooit veranderen, wie weet. In elk geval moet men ervan uitgaan dat een ras niet wetenschappelijk kan worden gedefinieerd en dat rassenonderscheid ook niet wetenschappelijk kan worden gedefinieerd. Men mag de dagdagelijkse realiteit echter niet uit het oog verliezen. Men mag toch niet beweren dat er geen uiterlijke verschillen zijn tussen mensen. Men kan toch vaststellen dat iemand met een zwarte huidskleur er anders uitziet dan iemand met een blanke huidskleur, precies omwille van die huidskleur. Het begrip ras is dus een functioneel gegeven dat al zeer lang meegaat in de menselijke geschiedenis en dat nog zeer lang, wellicht eeuwig, zal meegaan in de menselijke geschiedenis. Ik begrijp dat men het wetenschappelijk gehalte van allerhande rassentheorieën wil counteren maar dat doet men niet door een soort toverwoord in de wet in te schrijven, waarmee alles dan opeens zou worden opgelost.
Bovendien is het volgens mij niet verwerpelijk een rassenonderscheid in te zien, tenminste indien men daarmee de menselijke waardigheid van bepaalde groepen van mensen of individuen niet in het gedrang brengt. Wanneer men de gelijkwaardigheid van de mensen aanvaardt is er niks verwerpelijks aan de erkenning dat de ene mens toevallig harder loopt dan de andere terwijl die ene toevallig zwart is en de andere blank. Daarom vind ik dat het wetsontwerp vertrekt van een verkeerd uitgangspunt.
Bovendien gaat men met de term "ras" voorbij aan internationale verdragen inzake mensenrechten, die wel degelijk verwijzen naar die term "ras". Dat is nu eenmaal zo. Men kan die internationale verdragen vanuit België niet wijzigen, ook niet op deze manier. Het is nu eenmaal een realiteit en men riskeert uit de bocht te gaan door dit wetsontwerp niet te aligneren op wat er in het internationaal recht bestaat. Wanneer men consequent doordenkt — ik zal dadelijk een voorbeeld uit de advocatuur aanhalen — dan verklaart u met de term "zogenaamd ras" uw eigen wetsontwerp misschien wel zonder voorwerp, want het is precies de bedoeling om racisme te bestrijden. Wanneer u zegt dat er geen rassen bestaan, dat er geen onderscheid kan worden gemaakt tussen rassen, hoe kan men dan een racist zijn? Een advocaat hoeft in dat geval maar naar de wet te verwijzen. Zijn cliënt kan niet van racisme worden beschuldigd aangezien er in de wet staat dat er geen rassen bestaan. Dat is een argument dat men à décharge kan gebruiken, hoewel het niet het enige argument zal zijn. De rechter zal de omstandigheden beoordelen. Als men zegt dat er geen rassen bestaan, dan haalt men al het argument uit de wet dat moet bewijzen dat racisme bestaat en dat het een misdrijf is dat kan worden begaan.
Het wetsontwerp is verder inconsequent op het vlak van de etnische afstamming. Er wordt niet gesproken over een "zogenaamde etnische afstamming". Etnische afstamming is ook voor het Vlaams Blok een louter functioneel gegeven, niet iets dat wetenschappelijk wordt vastgesteld of kan worden vastgesteld, of wetenschappelijk is gedefinieerd of zou kunnen worden gedefinieerd. Ook de etnische afstamming is een functioneel criterium dat mensen gebruiken om elkaar te begrijpen wanneer ze verwijzen naar hun cultuur of naar de geografische plek waar ze vandaan komen. Ik hoop dan ook, mevrouw de minister, dat u deze vraag — die u in de commissie niet hebt beantwoord — hier wel zult beantwoorden. Misschien is ze u toen ontgaan. Ik hoop dat u het respect voor de verkozenen des volks wilt opbrengen om uit te leggen waarom u niet consequent het adjectief "zogenaamd" hebt toegevoegd aan de term "etnische afstamming"? Dat laatste begrip is immers van precies dezelfde orde als de term "ras". Dit wetsontwerp staat dus bol van de inconsequenties.
Een laatste inconsequentie op het vlak van het zogenaamde ras is het verkeerde uitgangspunt dat zovele politiek correct denkenden en zoveel multiculturele profeten gebruiken, namelijk de argumenten die men gebruikt om de multiraciale, multiculturele en multi-etnische samenleving lof toe te zwaaien. Schrap uit uw woordenboek dan ook maar de begrippen "multiraciaal", "multi-etnisch" en misschien binnenkort zelfs het begrip "multicultureel". Ik stel alleen vast dat men die termen te pas en te onpas gebruikt om allerhande fenomenen in onze samenleving toe te juichen.
Stap naar de Koninklijke Belgische Voetbalbond en schaf de trofee van de Ebbenhouten Schoen af, want die is op een ras gebaseerd. Wesley Sonck zal die trofee nooit kunnen winnen, maar Moumouni Dagano wel. Ik gun Moumouni Dagano die titel, maar hij is gebaseerd op een ras. Volgens de regels van dit wetsontwerp zou dit niet meer kunnen en is dit ook niet politiek correct.
Spreek de banvloek uit over zovele Amerikaanse komieken, die ik zeer goed kan smaken om hun humor en satire. Zij drijven de spot met de multiraciale samenleving, de rassentegenstelling en het rassenonderscheid. Mevrouw de minister, zij vermogen veel meer dan u met dit wetsontwerp wilt bereiken. Met humor en satire zie ik afro-Amerikaanse komieken de spot drijven met allerhande tegenstellingen die we zien in een multiraciale samenleving. Soms gebeurt dat op een vrij grove manier, maar dat mag. Het is niet politiek correct.
Ik moet toegeven dat de blanke artiesten meer schroom hebben. Zij hebben natuurlijk meer schrik om de regels van politieke correctheid te overtreden. De zwarte Amerikanen doen dat niet, maar met dit wetsontwerp moet u komieken zoals Eddy Murphy van het scherm bannen, want zij verkopen absoluut politiek incorrecte praat. Zij doen dat volgens mij wel op een manier waardoor bepaalde geborneerden en gefrustreerden geen toegang krijgen tot de vrije gedachten van vele mensen om hun rassentheorieën te verspreiden. Deze komieken gaan met hun methode veel meer het rauwe racisme tegen dan u met dit wetsontwerp beoogt.
Tot hier mijn kritiek op die terminologische "kramerijen" die men in dit wetsontwerp wil inschrijven en waarmee men niets zal bereiken.
De term "zogenaamd ras" is nog onschuldig. Hopelijk mag daarmee nog gelachen worden, want het brengt niets bij. De bevoegdheidsuitbreiding op het terrein van het Centrum voor Gelijkheid van Kansen en Racismebestrijding is meer verontrustend. Men maakt nu van het centrum een soort van studiecentrum. Ik wil het met een politiek incorrecte term zelfs de grote schotelantenne noemen. Er zijn veel kleine schotelantennes en het worden er alsmaar meer, maar dit is de grote schotelantenne die inzake racisme alles gaat uitvissen. Waar racisme niet kan worden gezien, zal dit centrum het willen horen. Waar het niet kan worden gehoord, zal het centrum het willen ruiken. Waar het niet kan worden geroken, zal men het willen voelen. Waar het niet kan worden vastgesteld, zal men het wellicht vermoeden. Ik heb daarbij mijn bedenkingen, collega's.
Dat men een studieopdracht geeft aan het centrum van onze nieuwe Torquemada, pater-dominicaan Leman, daar aan toe. Als men tezelfdertijd het centrum de bevoegdheid niet afneemt om vervolgingen in te stellen — om rechtstreeks te dagvaarden — dan vrees ik dat men met dit wetsontwerp toch een zeer oppermachtig instrument heeft geconstitueerd eens het in handen van de regering valt.
Wij mogen niet vergeten dat het Centrum voor Gelijkheid van Kansen en Racismebestrijding nu ook een vinger in de pap krijgt in tuchtmateries. Langzaamaan legt het centrum de hand op heel wat maatschappelijke thema's die te maken hebben met de problemen in de multiculturele samenleving. Wellicht zal dat ook weer politieke uitlopers krijgen. Ik kan u meedelen — voor wie het nog niet wist — dat op 10 september opnieuw een rechtszaak van het centrum begint om onze politieke partij te verbieden door de ruggengraat van onze partij — de drie VZW's — aan te pakken. Dit zijn verontrustende ontwikkelingen, die door dit wetsontwerp worden versterkt.
Mijnheer de voorzitter, ik kom tot mijn besluit. Ondanks de zoveelste verregaande ingreep in de samenleving en de daaruit voortvloeiende bedreiging voor de vrijheid van meningsuiting — of wellicht door die bedreiging die nu wordt doorgetrokken — zal wat ik "multicultopia" noem, geen werkelijkheid worden.
Dit wetsontwerp, eenmaal wet geworden, zal noch het echte extreemrechtse gedachtegoed — wat een zeer marginale strekking is — noch het zogezegde extreemrechtse gedachtegoed — om de term `zogezegd' eens op zijn plaats te gebruiken — noch het echte noch het zogenaamde racisme indijken. Het zal daarentegen wel het democratisch deficit vergroten en de kloof tussen burger en politiek verbreden.
Bij deze rond ik definitief af. Indien de gekozenen van het Vlaams Blok werkelijk zo een slechteriken zouden zijn als wij altijd door bepaalde personen en instellingen worden voorgesteld, dan zouden wij voor stemmen. Wij zouden voor stemmen omdat het in eer en geweten mijn overtuiging is dat dit wetsontwerp de verzuring meer in de hand zal werken en dat het voor meer totalitaire neigingen zal zorgen. De overheid zal op deze manier haar greep vergroten op de vrije gedachten van de burgers. Ik zeg u in eer en geweten en in volle overtuiging dat het Vlaams Blok tegen dit juridisch gedrocht zal stemmen.

The term "so-called race" is still innocent. Hopefully it can be laughed at, because it does not contribute. Monsieur le président, madame la vice- première ministre, chers collègues, il y a 21 ans, le Parlement votait la loi tendant à réprimer certains actes inspirés par le racisme ou la xénophobie, dite la loi Moureaux-Erdman, loi progressiste et avantgardiste. Une série d'instruments juridiques est venue compléter cette loi, M. Arens l'a rappelé tout à l'heure. Aujourd'hui, nous allons voter un projet qui renforce encore cet arsenal législatif et il faudra d'ailleurs le lire en parallèle et en complément du projet de loi que nous avons voté hier en commission de la Justice concernant la lutte contre toute forme de discrimination. Grâce à ce présent projet, le gouvernement tend à remédier à une série de causes de nonapplication de la loi Moureaux. S'il est vrai que ces dernières années, les acteurs judiciaires ont mis plus de bonne volonté à poursuivre ce type d'infractions, la loi Moureaux a été longtemps ignorée par nombre de policiers, de procureurs ou de juges.
Pourtant, dans son rapport annuel 2001 en mars 2002, le centre pour l'égalité des chances et la lutte contre le racisme a indiqué avoir ouvert encore 1246 dossiers de plaintes concernant la discrimination raciale, soit plus de 150 de plus qu'en 2000. Parmi ces plaintes, une sur cinq concerne les services publics, 14% portent sur des questions d'emploi et en particulier sur la discrimination à l'embauche, soit une augmentation de 3% en un an, enfin 7% des plaintes sont relatives aux services d'ordre, soit 1% de plus qu'en 2000. Le centre conclut qu'en cinq ans les deux principaux motifs de plaintes n'ont pas changé. Elles concernent d'une part les services publics et d'autre part les matières d'emploi et les matières de forces de l'ordre.
De ce rapport, il ressort clairement que le problème est toujours aigu et qu'il est donc important de renforcer encore la lutte contre les comportements racistes tout à fait inacceptables dans une société comme la nôtre. Incriminer l'injure raciste simple en érigeant le motif abject en circonstance aggravante, sanctionner les discriminations au travail envers un groupe et non plus seulement à l'égard d'une personne et donner la compétence à l'inspection du travail pour constater les infractions à la loi Moureaux-Erdman sont des avancées considérables et précieuses.
En effet, la discrimination à l'embauche par exemple est un phénomène courant et trop peu combattu qui pourtant entraîne d'une part un sentiment de rejet et de révolte bien légitime de la part de ceux qui en sont victimes et d `autre part une perception de mauvaise intégration ou de non-volonté de la part de la société. Il importe donc de tout mettre en oeuvre pour lutter contre ce genre de comportements inacceptables d'employeurs. Dans le même ordre d'idées, le fait que demain les autorités disciplinaires soient tenues d'informer de manière circonstanciée le centre lui permettra de réaliser une meilleure analyse du phénomène qui se passe dans les services publics et sans doute de combattre ce même phénomène. Par ailleurs, étendre les missions du centre pour l'égalité des chances en matière de politique d'immigration, l'analyse des flux migratoires, les études prospectives, l'analyse de la législation sur les étrangers, paraît aujourd'hui indispensable au regard des débats qui se développent dans toute l'Europe.
Enfin, j'en terminerai par là, l'ajout du qualificatif `'prétendue'' devant le terme `'race'', même s'il paraît anodin, est pour moi une avancée significative, tant d'un point de vue scientifique que symbolique et psychologique. En effet, nous devons tous affirmer haut et fort que la race ne correspond à aucune réalité scientifique et j'espère que ce terme disparaîtra un jour de nos dictionnaires et sera bientôt inconnu dans la bouche de nos enfants. Ce projet est une pierre en plus dans l'édification d'une société plus juste, plus égalitaire et plus respectueuse de chacun dans sa différence. Nous le voterons avec énormément de conviction.

Mijnheer de voorzitter, mevrouw de vice-eerste minister, collega's, ik houd deze uiteenzetting ook namens mevrouw Dardenne aangezien zij zich heeft laten verontschuldigen.
Collega's, het regeerakkoord van 1999 bepaalt dat de regering de strijd tegen racisme en xenofobie als een van haar prioriteiten beschouwt. Zij nam zich voor om naast een grondige evaluatie van de huidige antiracismewetgeving en het negationismeverbod, ook een algemene antidiscriminatiewetgeving tot stand te brengen, wetsontwerp dat we gisteren in de commissie voor de Justitie hebben goedgekeurd, dit conform de surpranationale verplichtingen, die we als lidstaat van de Europese Unie dienen na te komen.
Dit wetsontwerp tot versterking van de wetgeving tegen het racisme moest totstandkomen omdat de huidige wetgeving, van de wetMoureaux en de wijzigingen van onder meer de voorzitter van de commissie voor de Justitie tot de allerlaatste wijzigingen daarop, niet tot een efficiënte toepassing in de praktijk heeft geleid.
De politiediensten reageren niet voldoende adequaat op klachten van burgers, die gediscrimineerd worden omwille van hun huidskleur of origine. De machteloosheid van diezelfde burgers die met een onmogelijke bewijslast zijn geconfronteerd, verzaken daardoor een aanhangig gemaakte procedure tot het einde te volbrengen.
Ten slotte zijn er de parketten die wegens te weinig personeelskracht of wegens onvoldoende sensibilisatie van de ernst van het racisme- of xenofobiemisdrijf of wegens onvoldoende vorming in de antiracismewetgeving, geen gevolg geven aan de klachten die hen bereiken.
De statistieken tonen aan dat er sinds de wet-Moureaux te veel klachten worden geseponeerd en nog minder een rechtelijke uitspraak als resultaat kennen, hoewel de laatste jaren er wel een opmerkelijke verbetering merkbaar is, niet in het minst dank zij de oprichting van een Centrum voor Gelijkheid van Kansen en voor Racismebestrijding, die de slachtoffers van racisme of xenofobie mee ondersteunt in het formuleren van de klacht en de procedure voor de rechtbank. Maar, het kan beter. Immers, de discriminaties in het onderwijs, op de arbeidsmarkt, op de huisvestingsmarkt, op de vrijetijdsbestedingsmarkt — ik denk aan discotheken, aan sportclubs en aan het zich vrij bewegen in de publieke ruimten — blijven voortduren. Een samenleving waarin verschillende bevolkingsgroepen naast elkaar en tussen elkaar willen leven, kan zulk een gedrag niet tolereren. Het uitsluiten van groepen omwille van hun uiterlijk of afkomst, leidt tot spanningen die hoog kunnen oplopen en die een samenleving kan missen als kiespijn.
Inzake de verbeteringen in dit wetsontwerp van de wet van 1981 zal ik bondig een paar punten aangeven.
Ten eerste, de objectivering van het woord "ras". Ik zal het hier niet meer herhalen, maar wil er toch kort op wijzen dat de internationale verdragen en onze antiracismewetgeving, die op een bepaald ogenblik zijn totstandgekomen, niet die wetenschappelijke inzichten hadden om zich van het woord "ras" — er zijn geen verschillenden soorten mensenrassen, er is maar één mensenras — te ontdoen. Ik ben zelf niet voor 100% gelukkig met de verbetering; ik had verkozen dat het woordje "ras" helemaal zou zijn verdwenen, maar deze verbetering kan er net door.
Ten tweede, de uitbreiding van de straffen tot personen die zich schuldig maken aan discriminatie tegenover een groep, een gemeenschap of de leden ervan wegens het zogenaamde ras, huidskleur, origine, etnie en dergelijke. Mijns inziens is er ook op dat vlak een verbetering, want vroeger gold dit alleen maar ten aanzien van individuen, Door het feit dat men ook een groep an sich kan discrimineren en daarvoor ook kan worden gestraft, betekent ook een verbetering in dit ontwerp.
Ten derde, de arbeidsinspectie krijgt de bevoegdheid om daden van xenofobie of racisme scherp in het oog te houden en moet ervoor zorgen dat ze niet op de arbeidsvloer voorkomen.
Ik wil dieper ingaan op de bevoegdheidsuitbreiding van het Centrum voor Gelijkheid van Kansen en voor Racismebestrijding. Dat is een verbetering. Bovenop de bevoegdheid om mensenhandel te bestrijden en te analyseren krijgt het centrum eindelijk de taak om te waken over de grondrechten van vreemdelingen. Nog interessanter, mijns inziens, is de taak van observatorium dat het centrum krijgt inzake migratiestromen. Gelet op de migratiestromen van de voorbije jaren naar het Europees continent en België in het bijzonder is deze bevoegdheid niet onbelangrijk. Een goed inzicht in én analyse van asiel- en migratiestromen, ook in andere Europese landen, helpt de overheid te anticiperen op bepaalde fenomenen om op die manier een beter beleid uit te stippelen in plaats van à l'improviste maatregelen te nemen die beperkingen en ongemakken vertonen. Gelet op de ervaring en de expertise die het centrum in de loop der jaren heeft opgebouwd inzake integratie- en migratiebeleid is het, mijns inziens, de evidentie zelve dat het centrum deze bevoegdheid krijgt. Het is eveneens noodzakelijk dat het centrum de taak van go between krijgt tussen overheidsactoren en de privé-actoren die betrokken zijn bij het opvang- en integratiebeleid van migranten. Dit bevordert de samenwerking en de efficiëntie van het optreden van de verschillende actoren. Op dit ogenblik zijn er te veel initiatieven. Zij moeten op elkaar worden afgestemd en gecoördineerd. Heel veel actoren op het terrein doen verdienstelijk werk maar zijn niet op de hoogte van mekaars initiatieven zodat de resultaten niet duidelijk zichtbaar zijn of achterwege blijven. Het samenbrengen en het ontwikkelen van de dialoog tussen de actoren is onontbeerlijk. Wat de opvolging van de feiten, klachten en veroordelingen op het vlak van door racisme en xenofobie ingegeven daden betreft, is het bijhouden van statistische gegevens van cruciaal belang voor het beleid om alert te kunnen reageren op dergelijk kwalijk en ongewenst gedrag in de samenleving.
Dat het centrum van al de betrokken overheden zoals het departement van Justitie, de controlediensten en de politie de nodige informatie moet ontvangen om zijn taak tot een goed einde te brengen is eveneens een belangrijk onderdeel van dit ontwerp.
Mevrouw de vice-eerste minister, met dit ontwerp is de strijd nog niet afgelopen. We moeten eveneens werk maken van de bestrijding van racisme en racistische pamfletten op het internet. Meestal worden hiervoor buitenlandse providers gebruikt zodat we de mensen die hierachter zitten niet te pakken kunnen krijgen en bestraffen.
Mijnheer de voorzitter, collega's, racisme is een onduldbaar gegeven, zeker in de interculturele samenleving die we geworden zijn. Agalev-Ecolo zal dit ontwerp met volle overtuiging goedkeuren.

Statistics show that since the Murreaux Act, too many complaints have been filed and even fewer have a legal ruling as a result, although in recent years there has been a noticeable improvement, not least thanks to the establishment of a Centre for Equality of Opportunities and for Combating Racism, which supports victims of racism or xenophobia in the formulation of the complaint and the procedure before the court. But, it can be better. After all, discrimination in education, in the labour market, in the housing market, in the leisure market — I think of discos, sports clubs and the freedom of movement in public spaces — continues. A society in which different populations want to live side by side and between each other cannot tolerate such behavior. Excluding groups because of their appearance or origin leads to tensions that can rise high and that a society can miss like chest pain.
Regarding the improvements in this draft law of the law of 1981, I will briefly point out a few points.
First, the objectification of the word "race". I will not repeat it here again, but would like to point out briefly that the international treaties and our anti-racism legislation, which came into being at a certain moment, did not have the scientific insights to get rid of the word "race" — there are no different types of human races, there is only one human race. Monsieur le président, madame le vice-premier ministre, chers collègues, l'accord de gouvernement de juillet 1999 stipule clairement que la majorité arc-en-ciel entend faire de la lutte contre le racisme et plus généralement contre toute forme de discrimination une priorité de son action.
Plus précisément, le gouvernement s'est donné pour objectif, d'une part, d'évaluer les législations actuelles contre le racisme et le négationnisme et, d'autre part, de développer la lutte contre toute forme de discrimination par l'adoption d'une loi générale.
Le premier point concerne le projet qui nous occupe aujourd'hui. Une analyse de la loi Moureaux a été réalisée. Les déficiences qui en sont ressorties trouvent un palliatif dans le nouveau texte. Le second point sera, quant à lui, servi par le projet en provenance du Sénat, déjà voté en commission à la Chambre et qui arrivera en plénière lors de la rentrée parlementaire. Ce dernier texte rassemble l'essentiel des innovations en termes de lutte contre le racisme et autres formes de traitement discriminatoire. Le projet examiné aujourd'hui présente quant à lui une réforme en deux points: la modernisation de la loi Moureaux et l'extension des prérogatives du Centre pour l'égalité des chances.
Il n'est pas inutile de rappeler que le législateur a adopté depuis près de vingt ans une série d'instruments qui répriment la haine raciale. Mme le vice-premier ministre Onkelinx en a fait une synthèse éclairante dans le rapport du présent projet. Il faut aussi remarquer que le droit international s'étoffe sur cette question et principalement au niveau européen. Les directives sont de plus en plus précises et contraignantes pour les Etats membres. C'est le cas de la récente directive du 29 juin 2000 relative à la mise en oeuvre du principe de l'égalité de traitement entre les personnes, sans distinction de race ou d'origine ethnique.
Ces avancées justifient le fait que l'on se penche aujourd'hui sur nos règles internes. Il faut, en outre, convenir que la loi Moureaux pèche par manque d'efficacité. Les chiffres avancés par Mme la ministre en commission sont clairs. Plus de 90% des affaires traitées dans le cadre de cette législation ont été classées sans suite. Je pense que Mme Talhaoui y a déjà fait allusion. Si le nombre de décisions judiciaires est en augmentation ces dernières années, il n'en demeure pas moins que les termes actuels de la loi ne permettent pas de lutter efficacement contre le fléau du racisme. Le problème méritait donc une solution.
J'ai entendu dire, a contrario, par ceux qui véhiculent le message de l'exclusion et du rejet de l'autre jusque dans cette assemblée que l'initiative gouvernementale était inutile parce que le racisme n'avait pas cours en Belgique. Il faut effectivement s'entendre sur la notion. On ne parle évidemment pas de racisme institutionnalisé ou généralisé. Par contre, il faut reconnaître qu'une certaine forme de xénophobie latente a toujours cours. Les mesures proposées par le gouvernement devraient désormais permettre d'envisager la loi Moureaux comme un outil efficace pour lutter contre ces formes sournoises de discrimination.
1. L'adjonction du qualificatif "prétentu" au terme race. L'aménagement est symbolique, mais nous souscrivons à cette idée de bannir de notre ordre juridique une notion qui ne correspond à aucune réalité scientifique. Ceci cadre du reste avec l'esprit de la directive du 29 juin 2000 déjà mentionné, qui prévoit dans ses développements que l'Union européenne rejette toute théorie tendant à déterminer l'existence de races humaines distinctes.
2 L'incrimination de l'injonction de discriminer ce qui respecte fidèlement le prescrit de la directive. Il est évident que celui qui se rend coupable d'une telle injonction doit répondre de ses actes au même titre que s'il avait lui-même pratiqué la discrimination.
3. La stigmatisation de la discrimination au travail à l'égard d'un groupe. La loi Moureaux ne visait que les discriminations à l'égard d'une personne dans ce cas de figure.
La modification proposée permettra de mieux prendre en compte d'éventuelles exactions, par exemple, en matière de licenciement.
Viennent ensuite les nouvelles prérogatives attribuées au Centre pour l'égalité des chances. Vous me permettrez de m'attarder davantage sur ce point.
L'article 8 du projet étend les missions du Centre en matière de définition et de mise en oeuvre de la politique d'immigration. Le but poursuivi est clairement de mettre en place un observatoire de migration qui centraliserait toutes les informations concernant cette problématique. Il est notamment prévu que le Centre veillera désormais au respect des droits fondamentaux des étrangers, qu'il éclairera les pouvoirs publics sur la nature et l'ampleur des flux migratoires et développera la concertation et le dialogue avec tous les acteurs publics et privés concernés par les politiques d'accueil et d'intégration des immigrés. Le groupe réformateur souscrit à ces objectifs. Mais nous sommes, par contre, plus circonspects quant aux modalités servant leur mise en oeuvre. Je songe aux articles 9, 10 et 11 du projet. Ces dispositions confient trois nouvelles prérogatives au Centre.
La première est qu'il pourra désormais recueillir et publier les données statistiques et jurisprudentielles communiquées par le ministre de la Justice, qui sont utiles à l'évaluation de la loi Moureaux et de la future loi en provenance du Sénat dont j'ai parlé tout à l'heure.
La modification proposée est raisonnable dans la mesure où les parties en causes dans ces procédures ne pourront être identifiées.
Je suis plus réservée, par contre, concernant la deuxième prérogative. A l'origine, le texte prévoyait que le centre pourrait demander à l'administration compétente de s'informer et de le tenir informer des résultats de l'analyse des faits qui présume l'existence d'un traitement discriminatoire par un fonctionnaire. En d'autres termes, il s'agit de pouvoir disposer des informations nécessaires sur la manière dont les autorités disciplinaires concernées abordent le phénomène de discrimination et si elles font, en connaissance de cause, une analyse de la discrimination supposée. Dire cela, il faut le savoir, c'est admettre qu'une autorité externe (le Centre pour l'égalité des chances) interfère dans des procédures disciplinaires.
En commission de la Justice, l'article a été profondément amendé sur proposition du gouvernement. Désormais, on parle d'autorité et non plus d'administration de manière à pouvoir viser des institutions comme les entreprises publiques autonomes et on ne fait plus référence aux notions de fonctionnaire et de procédure disciplinaire afin, d'une part, de s'assurer de l'application de la disposition en question, non seulement aux agents, mais aussi à tout utilisateur des services publics et, d'autre part, de faire en sorte que l'obligation d'information puisse concerner l'ensemble des démarches destinées à remédier à la discrimination avérée.
Nous avouons ne pas comprendre l'utilité pratique de ces ultimes aménagements. On peut prendre l'hypothèse des transports en commun. Un usager s'y rend coupable d'un comportement raciste. Le Centre en est informé. Aujourd'hui, comme tout citoyen, il peut alors porter plainte. Demain, il pourra, en outre, demander à l'autorité compétente — la SNCB, la STIB ou autre — de s'informer, de manière motivée, des suites qui ont été réservées à cette affaire. Est-ce bien utile? Une telle tâche doit-elle incomber à une entreprise telle que la SNCB? Ne risque-t-on pas de la noyer dans des procédures administratives et des enquêtes de toute nature? Il conviendra d'y être vigilant lorsque la nouvelle loi sera d'application.
Plus globalement, le groupe réformateur se montrera attentif à ce que le Centre use de cette nouvelle compétence avec les réserves et la retenue qui s'imposent. Je rappelle que le Conseil d'Etat parle de pouvoirs exorbitants. Je l'ai dit. Le Centre pourra, en effet, être informé des suites réservées aux procédures disciplinaires. Si le texte ne le mentionne plus, c'est parce que l'on a voulu aller au-delà de cette prérogative initiale. Nous convenons avec la ministre que le but n'est pas de s'immiscer dans les éventuelles procédures disciplinaires mais bien d'être pleinement informé de l'application réelle des législations en vigueur.
Madame la ministre, convenez avec nous que la distinction est ténue et reste théorique. Il importe que cet aspect de la réforme soit suivi et évalué avec la plus grande rigueur; nous y veillerons.
La même remarque peut sans doute être formulée à l'encontre de la dernière prérogative accordée au Centre par le projet. L'article 11 — lui aussi réécrit en commission par un amendement — prévoit en substance que le Centre pour l'égalité des chances pourra enjoindre le Comité P ou l'Inspection générale des services de police de mener une enquête à propos de faits laissant supposer un traitement discriminatoire de la part d'un fonctionnaire de police. Ici aussi le Centre devra, en outre, être tenu informé des suites disciplinaires éventuellement réservées à ces affaires. De ce fait, le Centre voit, en cette matière, ses compétences alignées sur celles du ministre de l'Intérieur ou du ministre de la Justice ou sur celles d'autorités comme le procureur général, le procureur du Roi ou le juge d'instruction ou encore le bourgmestre. Inutile d'étayer davantage pour convaincre que le Centre se voit, ici aussi, investi de compétences particulièrement importantes. Il s'agira donc de s'assurer qu'il en fera un juste et raisonnable usage.
En conclusion, monsieur le président, madame la vice-première ministre, chers collègues, je dirai que le groupe réformateur souscrit aux objectifs du projet. La lutte contre le racisme et contre toute autre forme de discrimination est, pour nous aussi, une priorité. J'ai mis en évidence, par contre, nos critiques, nos craintes peut-être que les modalités préconisées soient disproportionnées par rapport à ces mêmes objectifs. On parle de racisme, bien sûr, c'est un fléau, mais de l'autre côté de la balance, il y a les droits fondamentaux, le respect de la vie privée, par exemple, qu'il convient de préserver avec la même vigueur que celle qui sied à la lutte contre les discriminations.
Habituellement, lorsque l'on modifie l'équilibre dont je parle, lorsque l'on entend ménager une entorse à l'une ou l'autre de nos grandes libertés, il est fait confiance aux institutions ou aux autorités dont la légitimité ne souffre aucune contestation. Elles sont inscrites de longue date dans notre ordre juridique et un certain nombre de garde-fous ou de contre-mesures accompagnent leur action. Mais faire confiance sans cesse à ces mêmes autorités, à ces valeurs sûres, empêche le renouveau. Aujourd'hui, on veut lutter contre le racisme de manière coordonnée, centralisée et efficace. Une institution sortant du schéma administratif et judiciaire traditionnel est, sans doute, nécessaire à cette fin.
Le gouvernement a fait le choix du centre pour l'égalité des chances. Nous le soutenons dans cette initiative mais nous veillerons à évaluer, au quotidien, la pertinence de cette option.

The Government Agreement of July 1999 clearly stipulates that the rainbow majority intends to make the fight against racism and more generally against any form of discrimination a priority of its action.
More specifically, the government has set itself as its goal, on the one hand, to evaluate current legislation against racism and negationism and, on the other hand, to develop the fight against all forms of discrimination through the adoption of a general law.
The first point concerns the project we are currently dealing with. An analysis of the Moureaux law has been made. The disadvantages that have emerged from it find a palliative in the new text. The second point, on the other hand, will be served by the draft from the Senate, already voted in committee in the House and which will arrive in plenary at the parliamentary entrance. This latter text brings together most of the innovations in terms of combating racism and other forms of discriminatory treatment. The project discussed today presents a reform in two points: the modernization of the Moureaux Act and the extension of the prerogatives of the Centre for Equal Opportunities.
It is not unnecessary to recall that for almost twenty years the legislator has adopted a series of instruments that suppress racial hatred. Vice Prime Minister Onkelinx made an enlightening summary of this in the report of this project. It should also be noted that international law is extending on this issue and mainly at the European level. Directives are becoming increasingly precise and binding for Member States. Directive 2000/29/EC of the European Parliament and of the Council of 29 June 2000 on the implementation of the principle of equal treatment between persons without distinction of race or ethnic origin.
These advances justify the fact that we now look at our internal rules. Furthermore, it must be agreed that the Moureaux law sins for lack of effectiveness. The figures put forward by the Minister in commission are clear. More than 90% of cases handled under this legislation have been classified without follow-up. I think Ms. Talhaoui has already mentioned this. While the number of judicial decisions has been increasing in recent years, the current terms of the law do not allow to effectively combat the plague of racism. The problem deserves a solution.
I have heard, a contrario, from those who convey the message of exclusion and rejection of the other until in this assembly that the government initiative was useless because racism had not taken place in Belgium. We really need to agree on the concept. There is, of course, no talk of institutionalized or generalized racism. On the other hand, it must be acknowledged that a certain form of latent xenophobia is always going on. The measures proposed by the government should now allow to consider the Moureaux Act as an effective tool to combat these sublime forms of discrimination.

The arrangement is symbolic, but we subscribe to this idea of banishing from our legal order a notion that does not correspond to any scientific reality. This remains in line with the spirit of the aforementioned Directive of 29 June 2000, which provides in its developments that the European Union rejects any theory tending to determine the existence of separate human races.

It is obvious that the person who makes himself guilty of such an injunction must be held accountable for his acts in the same manner as if he himself had practiced the discrimination.

The proposed amendment will better take into account possible misconduct, for example, in terms of dismissal.
Then came the new prerogatives assigned to the Centre for Equal Opportunities. You will allow me to delay more on this point.
Article 8 of the project extends the Centre’s tasks in terms of defining and implementing the immigration policy. The aim is clearly to set up a migration observatory that would centralize all information on this issue. The Centre will now ensure that the fundamental rights of foreigners are respected, inform public authorities about the nature and extent of migration flows and develop consultation and dialogue with all public and private actors involved in immigrant reception and integration policies. The reform group supports these objectives. But we are, on the other hand, more circonspective as to the modalities serving their implementation. I am referring to Articles 9, 10 and 11 of the project. These provisions confer three new prerogatives on the Centre. by
The first is that it will now be able to collect and publish the statistical and jurisprudential data communicated by the Minister of Justice, which are useful for the evaluation of the Moureaux Act and the future law from the Senate of which I spoke recently.

To say this, to know it, is to admit that an external authority (the Centre for Equal Opportunities) interferes in disciplinary proceedings.
In the Justice Committee, the article was profoundly amended on the proposal of the government. It is now spoken of authority and not more administration in such a way that it can target institutions such as autonomous public undertakings and it is no longer referred to the concepts of official and disciplinary procedure in order, on the one hand, to ensure the application of the provision in question, not only to employees, but also to any user of public services, and, on the other hand, to ensure that the obligation of information can cover all the measures aimed at remedying the proven discrimination.
We acknowledge not understanding the practical usefulness of these ultimate arrangements. We can take the assumption of public transport. Users are accused of racist behavior. The Centre is informed. Today, like any citizen, he can then file a complaint. Tomorrow, he may, in addition, request the competent authority — the SNCB, the STIB or another — to inform himself, in a reasoned manner, of the follow-up that has been reserved for this case. Is it useful? Should such a task be incumbent on a company such as the SNCB? Are we not at risk of drowning in administrative proceedings and investigations of all kinds? We will need to be careful when the new law comes into effect.
More generally, the reform group will be attentive to the Centre’s use of this new competence with the necessary reservations and retention. I am reminded that the State Council speaks of exorbitant powers. I said it. The Centre may, in fact, be informed of the consequences reserved for disciplinary proceedings. If the text no longer mentions it, it is because we wanted to go beyond this initial prerogative. We agree with the Minister that the aim is not to interfere in possible disciplinary proceedings but rather to be fully informed of the actual application of the legislation in force.
Mr. Minister, agree with us that the distinction is tender and remains theoretical. It is important that this aspect of the reform is monitored and evaluated with the utmost rigor; we will ensure this.
The same observation may ⁇ be made against the last prerogative granted to the Centre by the project. Article 11 – also re-written in a committee by an amendment – provides in essence that the Centre for Equal Opportunities may order Committee P or the General Inspection of Police Services to conduct an investigation into facts suggesting discriminatory treatment by a police officer. Here too, the Centre must, in addition, be kept informed of the disciplinary consequences possibly reserved for these cases. Therefore, the Centre sees, in this matter, its competences aligned with those of the Minister of the Interior or the Minister of Justice or those of authorities such as the Attorney General, the Attorney of the King or the judge of instruction or even the mayor. There is no need for further support to convince that the Centre is, here too, invested in ⁇ important skills. It will therefore be about ensuring that it will make a fair and reasonable use.
In conclusion, Mr. Speaker, Mrs. Deputy Prime Minister, dear colleagues, I would say that the Reforming Group supports the objectives of the project. The fight against racism and all other forms of discrimination is also a priority for us. I have highlighted, on the other hand, our criticisms, our fears ⁇ that the recommended modalities are disproportionate to these same objectives. We talk about racism, of course, it is a plague, but on the other side of the balance, there are fundamental rights, respect for privacy, for example, which should be preserved with the same vigor as the one that suits the fight against discrimination. by

La lutte contre le racisme et la xénophobie est l'affaire de tous. Par conséquent, il convient que tous les acteurs de la justice soient vigilants. Je pense non seulement au parquet et à la magistrature assise, mais également à d'autres acteurs dont le rôle ne doit pas être sous-estimé, car c'est souvent le cas en ce qui concerne le centre pour l'égalité des chances et la lutte contre le racisme.
Dans le cadre des nouvelles compétences octroyées par le projet de loi, nous pensons que le travail du centre peut s'avérer fort utile. Les missions d'expertise des phénomènes que sont le racisme et la xénophobie et des veilles quant à la propagation d'actes racistes sont essentielles.
Une approche générale du phénomène migratoire est, en tous les cas, requise si l'on veut mieux appréhender le problème du racisme et de la xénophobie dans notre pays.

Mijnheer de voorzitter, mevrouw de minister, ik kan dit debat toch niet laten voorbijgaan zonder de rapporteur te danken voor het werk en in het bijzonder de minister te feliciteren voor haar initiatief. U weet dat ik een speciale binding heb met de wet van 1981. Destijds heb ik reeds getracht daaraan verbeteringen aan te brengen. Het is natuurlijk nutteloos wetgeving uit te vaardigen die niet efficiënt kan worden toegepast. Rekening houdend met de ervaringen op het terrein, is de poging van de minister gericht op een efficiënte toepassing van de wet. Dat is mijn eerste vaststelling.
Ik doe nog een tweede vaststelling. Men heeft er al op gewezen dat de werking en de knowhow van het Centrum moeten worden uitgebouwd. Ik stel vast dat degenen die op de een of andere manier worden geconfronteerd met de werking ervan, blijkbaar niet zo enthousiast zijn en telkens opnieuw het Centrum beschuldigen, terwijl juist bepaalde zaken worden blootgelegd door acties van het Centrum, ook op het politieke vlak.
Ik kom tot een derde bedenking gericht aan de minister. Men mag zich natuurlijk niet vastpinnen op de patronen van discriminatie en racisme zoals we ze kennen. Spijtig genoeg evolueert dat zeer snel en doet het minste buitenlandse conflict, dat op welke manier ook bindingen heeft met de gemeenschap waarin wij leven, andere, nieuwe en heroplevende vormen van racisme ontstaan die mogelijkerwijze een nieuw conflict veroorzaken of een nieuwe aanpak vereisen. Iedereen zal begrijpen dat ik het specifiek heb over het conflict in het Midden-Oosten, dat vandaag blijkbaar effecten begint te krijgen. Bepaalde gemeenschappen die vreedzaam naast elkaar zouden kunnen leven en in overeenstemming met elkaar beslissingen zouden kunnen nemen, worden nu door buitenlandse conflicten tegenover elkaar gesteld. Daardoor ontstaan nieuwe vormen van semitisme, antisemitisme en de daaraan gekoppelde gewelddaden.
Ik wil de minister vragen binnen het kader van de globale politiek van deze regering, ook binnen het kader van het buitenlands beleid en de toenadering van de gemeenschappen hier, dit onder ogen te houden. Dat past immers in de doelstellingen van de wet van 1981.

I have a third question addressed to the Minister. Of course, one should not get stuck with the patterns of discrimination and racism as we know them. Unfortunately, this is evolving very quickly, causing the slightest foreign conflict, which in any way has links to the community in which we live, other, new and reviving forms of racism that may potentially cause a new conflict or require a new approach. Everyone will understand that I am speaking specifically about the conflict in the Middle East, which apparently is beginning to have effects today. Certain communities that could live peacefully side by side and make decisions in accordance with each other are now confronted by foreign conflicts. As a result, new forms of semitism, anti-Semitism and the violent acts associated with them arise.
I would like to ask the Minister to take this into account within the framework of this government’s global policy, also within the framework of foreign policy and the approximation of the communities here. This is in line with the objectives of the 1981 Act.

Monsieur le président, je m'associe à la satisfaction affichée par presque tous ceux qui se sont exprimés jusqu'à présent. Je félicite le gouvernement de cette initiative.
Je voulais tout de même attirer votre attention sur un point qui — je le précise d'emblée — n'est pas du tout inacceptable à mes yeux, mais qui posera tout de même un problème de fond à terme. Il s'agit du point qui, dans l'attribution de nouvelles compétences au Centre pour l'égalité des chances, a trait à l'examen des plaintes introduites par des citoyens. Vu le courant actuel qui promeut la médiation en tant que mode de résolution non judiciaire des conflits, il est bien sûr utile de promouvoir, pour des questions aussi importantes que le racisme, des possibilités de médiation ou de plainte. Mais pour moi, la question qui se pose en la matière a trait à l'organe qui sera chargé d'examiner ces plaintes.
Autant je ne trouve pas problématique que dans le cas, par exemple, d'un boulanger qui ferait preuve de racisme vis-à-vis d'un client, ce soit le pouvoir exécutif ou une instance qui en dépend directement, qui soit chargé d'examiner cette plainte, autant je suis perplexe à propos du contexte évoqué par Mme Lalieux.
Ainsi, 20% des plaintes touchent à des comportements repérables auprès de fonctionnaires de services publics, tandis que 3% concerneraient des fonctionnaires chargés du maintien de l'ordre.
Je me demande — il ne s'agit nullement d'une mise en cause du Centre pour l'égalité des chances ni encore moins du gouvernement ou de la ministre qui promeut le projet — si l'exécutif, à travers ce centre, reste bien tout à fait habilité à traiter ces plaintes, non seulement avec indépendance mais en plus avec toute l'apparence de l'indépendance. Il me paraît problématique de voir germer et fleurir, à côté de chaque département ministériel, des actions particulières inhérentes à divers départements. Je crois que le département de la Santé est occupé à examiner un projet similaire autour de la question des droits des patients. Il me paraît problématique de voir graviter dans l'orbe de l'exécutif, des instances de médiation qui sont censées remettre des avis par rapport à des plaintes qui concernent, parfois, des agents de ces administrations elles-mêmes.
Il serait plus intéressant qu'une institution, qui est un organe collatéral de la Chambre et qui me paraît bénéficier d'une apparente indépendance et d'une indépendance réelle plus sûre, soit chargée de l'ensemble de ces plaintes plutôt que de concourir, probablement sans nous en rendre compte, à une espèce de saucissonnage systématique qui concentre au sein de chaque département ou dans une zone trop proche de lui l'examen de plaintes qui devraient, à mon avis, être examinées par des organes plus indépendants.
Il s'agit d'une considération générale qui ne met, selon moi, pas en cause le fond des objectifs du projet, certainement pas, mais elle me paraît devoir être relevée, surtout dans la mesure où il s'agit d'une matière structurelle et qui a des implications non seulement dans le département dont Mme Onkelinx est responsable mais dans plusieurs autres départements et ce, depuis plusieurs mois.

It would be more interesting that an institution, which is a collateral organ of the House and which I think enjoys a seeming independence and a more secure actual independence, be charged with all these complaints rather than participating, probably without us realizing it, in a kind of systematic saucissonage that concentrates within each department or in an area too close to it the examination of complaints which, in my opinion, should be examined by more independent bodies. by
This is a general consideration which, in my opinion, does not question the substance of the objectives of the project, ⁇ not, but it seems to me to have to be highlighted, especially since it is a structural matter and has implications not only in the department for which Ms. Onkelinx is responsible but in several other departments and this, for several months.

Dans ce cadre-là, un projet tel que celui soumis à votre approbation ne suffit pas. Une démarche beaucoup plus vaste est nécessaire. C'est pourquoi j'ai lancé l'initiative avec l'ensemble des ministres chargés de l'égalité des chances dans les régions et les communautés d'apporter une réponse beaucoup plus large en ce qui concerne l'enseignement, la formation, le dialogue, le travail des associations et des institutions les plus diverses.
Je pense que là effectivement, la mobilisation doit être beaucoup plus large, beaucoup plus plurielle, beaucoup plus multiple. Je profite aussi de ce projet pour saluer le travail réalisé par le Centre pour l'égalité des chances et la lutte contre le racisme. En fait, les compétences qui lui sont données par les lois, il les a déjà intégrées de facto. Je veux dire à M. Decroly que le Centre n'est pas un lieu de passage obligé mais il est pour le moment, dans le cadre de la lutte contre le racisme, l'organe de référence que les victimes connaissent bien. Car depuis toutes ces années, il a pu développer une politique qui a permis véritablement à notre pays d'être leader en la matière. Je le vois dans tous les débats internationaux, le rôle du Centre, la politique du Centre sont mis en évidence.
Pour un centre comme celui-là, qui sert de référence, je pense qu'il était utile de lui donner cette mission d'aider les victimes en traitant les plaintes à leurs côtés et qu'il puisse également, quand cela concerne des autorités publiques, constituer là aussi une référence pour que les autorités concernées par une plainte ne restent pas les bras croisés, et qu'il y ait un véritable suivi. On constate trop souvent par exemple dans les forces de l'ordre ou dans certaines administrations que lorsqu'il y a une plainte concernant un fonctionnaire, la plainte est faite et puis, plus rien du tout ne se passe. Au moins, on oblige par cette loi à donner une information au Centre qui pourra ainsi visualiser si oui ou non il y a un suivi.
Monsieur le président, je terminerai en disant ce qui a été constaté par plusieurs intervenants: ce projet est une pièce d'un puzzle. On a cité toute une série d'autres législations en vigueur mais il y aura aussi la loi contre l'ensemble des discriminations qui traversent encore notre société, qui vient, comme l'a dit le président de la commission de la Justice, d'être votée hier en commission et qui sera l'occasion d'un large débat à la rentrée parlementaire. Ce sera avant tout un débat sur les valeurs et sur le profil de la société que nous voulons.

Onbegrijpelijkerwijze heeft hij enorm bezwaar gemaakt tegen de wet op de anonieme getuigen. Tot mijn verrassing heb ik hem niet gehoord tijdens de bespreking van dit ontwerp dat veel verder gaat en veel delicater is, om niet te zeggen meer gevaren inhoudt dan de voorafgaande wetgeving.
De N-VA is vragende partij voor een wetgeving met betrekking tot bijzondere opsporingsmethoden. Mijnheer de minister, in deze zittingsperiode ben ik waarschijnlijk de eerste interpellant terzake geweest. Herhaaldelijk heb ik gevraagd naar een wetgevende regeling, zowel in de proactieve als in de reactieve fase. Sinds Franchimont hadden wij wel één en ander in de wet ingeschreven, maar intussen moesten we het wel verder blijven stellen met omzendbrieven. Het is niet onbelangrijk om even te herinneren aan de wet-Franchimont. Sinds de wet-Franchimont staat in artikel 28bis van het Wetboek van Strafvordering het volgende. Ten eerste, het opsporingsonderzoek wordt gevoerd onder de leiding en het gezag van de bevoegde procureur des konings. Ten tweede, de proactieve recherche, met betrekking dus tot gepleegde maar niet aan het licht gebrachte feiten of nog niet gepleegde feiten waaromtrent een redelijk vermoeden bestaat, valt onder het opsporingsonderzoek. Ten derde, het instellen van proactieve recherche kan niet zonder voorafgaande schriftelijke toestemming van het openbaar ministerie. Ten vierde, dit geldt onverminderd de naleving van de specifieke wettelijke bepalingen die de bijzondere opsporingsmethodes regelen. Dit laatste is nu precies datgene wat met het voorliggende ontwerp wordt beoogd. Ten vijfde, opsporingshandelingen mogen geen enkele dwangmaatregel met schending van individuele rechten van vrijheden inhouden behoudens de wettelijke uitzonderingen. Die wettelijke uitzonderingen werden in de wet-Franchimont niet ingevuld maar maken eveneens specifiek het voorwerp van dit wetsontwerp uit. De wet-Franchimont dateert van 12 maart 1998 zodat dit wetsontwerp niets te vroeg komt. Bijzondere opsporingstechnieken en —methoden worden tot het voorliggende ontwerp van kracht wordt nog altijd geregeld door omzendbrieven. De N-VA is dus tevreden dat er eindelijk een wettelijke regeling komt zodat de grijze zone verlaten wordt. Grijze zones zijn uit rechtstatelijk oogpunt niet echt toe te juichen.
Ook het werkveld is sterk vragende partij, zoals is gebleken uit de hoorzittingen. Dat is normaal en terecht. Wie elke dag bezig is met die praktijken, heeft liever wettelijke rugdekking.
Hoe beoordeelt de N-VA de wettekst die ter stemming ligt?
Zoals ik reeds bij de bespreking van vorige wetsontwerpen ter bestrijding van de zware en de georganiseerde criminaliteit benadrukte, heeft men als democraat een dubbel gevoel bij dat soort wetsontwerpen. Democratie is er ter bescherming van de fundamentele rechten en vrijheden. Elke dag werken we voort aan de verfijning daarvan. Anderzijds heeft een rechtstaat de verplichting om op te treden tegen degenen die de rechten en vrijheden van anderen op misdadige wijze schenden.
Geconfronteerd met de moderne, zware criminaliteit komt men tot de conclusie dat politie en gerecht niet meer zonder bijzondere opsporingsmethodes kunnen, willen zij met enige kans op succes de toch al ongelijke strijd met de criminaliteit aangaan.
We moeten nochtans ook een en ander relativeren. Ik verwijs terzake naar de cijfers die de minister in de commissie voor de Justitie heeft verstrekt. Uit die cijfers blijkt dat van de 1.149 aanvragen voor bijzondere opsporingstechnieken in het jaar 2001 een groot aantal betrekking had op wat ik "middenklasse" misdrijven zou durven te noemen. Er was weliswaar ook sprake van een aantal zware criminele feiten, maar het valt toch op dat echt zware feiten niet aan de orde komen. Ik heb in de cijfers niets teruggevonden dat betrekking had op criminele organisaties, hormonenmaffia, BTWcarroussel, wapenhandel, terrorisme enzovoort. Laten we de cijfers dan ook enigszins relativeren.
Het lijkt mij inderdaad interessant om kennis te krijgen van de doctoraalscriptie die volgens collega Talhaoui aan de universiteit van Antwerpen blijkbaar wordt voorbereid. Op die manier zullen we een wetenschappelijke visie krijgen op de bijzondere opsporingsmethodes. Ik herinner mij dat in de Verenigde Staten op een totaal van 1 miljoen telefoontaps slechts 5% effectief betrekking had op criminele feiten. Dat moet ons er toch toe aanzetten een en ander te relativeren en grote voorzichtigheid en terughoudendheid bij het wettelijk regelen van dergelijke bijzondere methodes en technieken aan de dag te leggen.
Voor de N-VA moeten daarbij de fundamentele principes van de rechtstaat worden gehandhaafd: elkeen heeft recht op een eerlijk proces en op bescherming van de fundamentele rechten en vrijheden. Schending van een aantal vrijheden kan alleen gebeuren op rechterlijk bevel.
Daarnaast staan wij zeer terughoudend tegenover het plegen van misdrijven door de overheid, door de politie.
Wij willen de principes vervat in artikel 28bis over de strafvordering maximaal gegarandeerd zien.
Ten slotte moet uiteraard de fysieke integriteit van de politiemensen, de informanten en de meewerkende burgers worden gegarandeerd.
Al die doelstellingen verzekeren is voorwaar een heikele opdracht, een moeilijke klus op het vlak van de legistiek.
Het wetsontwerp is in grote mate verdienstelijk waar het de principes van proportionaliteit en subsidiariteit vooropstelt. Daarstraks is in bepaalde discussies andermaal duidelijk geworden dat die nooit uit het oog mogen worden verloren. We kunnen dat niet genoeg herhalen, vooral ook voor de mensen uit de praktijk die, meegesleept door hun enthousiasme, de grote principes wel eens uit het oog zouden kunnen verliezen. Het is ook belangrijk dat het openbaar ministerie in principe belast is met de leiding en het gezag en dat er maximale garanties worden ingebouwd voor de fysieke integriteit van de politieambtenaren.
Het ontwerp werd ook op tal van punten verbeterd tijdens de behandeling in de commissie. Ik denk onder andere aan de betere bescherming van het beroepsgeheim van medici en advocaten. Op dit vlak ging het aanvankelijke ontwerp veel te ver. Ik heb daaromtrent van meet af aan voorbehoud gemaakt en ben blij dat wij daarin met voldoende medestanders waren om het ontwerp om te buigen tot een aanvaardbare bepaling terzake.
Ik denk verder aan de beperking en de proportionaliteit van de strafbare feiten die politiemensen mogen plegen. Deze verbetering werd aangebracht in de commissie. Ik denk bijvoorbeeld aan het wegwerken van de onduidelijkheid met betrekking tot de toepassingsdrempel van de bijzondere opsporingsmethoden aangaande proactieve recherche. Aanvankelijk konden de teksten op twee manieren worden gelezen. Dit werd geëxpliciteerd en verduidelijkt. De hogere drempel met betrekking tot proactieve recherche, vervat in het Wetboek van Strafvordering ingevolge de wet-Franchimont, blijft gelden en kan dus niet onderuit worden gehaald. Naast deze belangrijke principes, verdiensten en verbeteringen, blijven er niettemin volgens ons een aantal belangrijke minpunten uit rechtstatelijk oogpunt.
Ten eerste, er zijn volgens ons onvoldoende garanties voor de leiding en de controle door het openbaar ministerie op de informantenwerking. Zoals het jaarlijks rapport van het Comité P aantoont, is gelukkig het overgrote deel van de politiemensen integer, loyaal en correct. Jammer genoeg is een beperkt aantal dat niet en zijn er zelfs een aantal corrupt. In die omstandigheden, en al was het maar omdat ik niet in een politiestaat wens te leven, is een efficiënte leiding en controle door het openbaar ministerie absoluut noodzakelijk, zeker wanneer het gaat over bijzondere opsporingsmethoden en -technieken zoals observatie, infiltratie, informantenwerking, het onderscheppen van post, inkijkoperaties en direct afluisteren. Precies op een van de domeinen waar het gevaar op osmose, uitlokking, valse bewijsvoering enzovoort zeer groot is, zo niet het grootst is, en waar bepaalde politiemensen makkelijk zouden kunnen worden verleid om bepaalde grenzen te overschrijden omdat zij permanent moeten bewegen in een wereld waarin geen grenzen bestaan, precies daar is het toch wel jammer dat de leiding van het openbaar ministerie in dit domein niet is vooropgesteld. Het is de politie die de informantenwerking opzet, uitvoert en regelt zonder al te veel pottenkijkers. Informanten worden ingeschakeld zonder dat tussenkomst van het openbaar ministerie noodzakelijk is. Het openbaar ministerie krijgt slechts een algemeen verslag over de informantenwerking.
Ik begrijp moeilijk de hele heisa over amendement 11, aangezien het openbaar ministerie zelf strikt gezien in zijn opsporingsonderzoek geen toepassing maakt van informantenwerking. Het openbaar ministerie treedt slechts op nadat er met informanten is gewerkt. Bovendien maakt het hiervan slechts proces-verbaal op als dit de veiligheid van de informant niet in het gedrang brengt. Since Franchimont, we had entered a number of things in the law, but in the meantime we had to continue to do so with sending letters. It is not unimportant to remember for a moment the law-Franchimont. Since the Act-Franchimont, Article 28bis of the Code of Criminal Procedure states the following. First, the investigation is conducted under the direction and authority of the competent prosecutor of the king. Second, proactive investigation, i.e. in relation to facts committed but not disclosed or facts not yet committed of which there is a reasonable suspicion, falls within the scope of the investigation. Third, the establishment of proactive investigation cannot be done without the prior written consent of the Prosecutor’s Office. Fourth, this shall be without prejudice to compliance with the specific legal provisions governing the special detection methods. This is exactly what is intended with the present draft. Fifth, investigative acts should not contain any coercive measure in violation of individual rights of freedoms, subject to the statutory exceptions. These legal exceptions were not included in the Franchimont Act but also specifically constitute the object of this draft law. The law-Franchimont dates from March 12, 1998, so this bill does not come too early. Special detection techniques and methods are being developed until the present draft is still regulated by sending letters. The N-VA is therefore satisfied that there is finally a legal arrangement so that the grey zone is left. Grey zones are not really welcome from a legal state point of view.

How does the N-VA assess the bill that is under vote?
As I have already emphasized in the discussion of previous draft laws to combat heavy and organized crime, one as a Democrat has a double feeling about this type of draft laws. Democracy is there to protect fundamental rights and freedoms. Every day we continue to work on its refinement. On the other hand, a rule of law has the obligation to act against those who violate the rights and freedoms of others in a criminal manner.
Faced with modern, heavy crime, one comes to the conclusion that police and justice can no longer do without special methods of investigation, if they want to engage with some chance of success in the already unequal struggle with crime.
However, we must also relativize some things. I refer in this regard to the figures provided by the Minister in the Committee on Justice. These figures show that of the 1,149 requests for special detection techniques in 2001, a large number were related to what I would dare to call “middle class” crimes. Although there were also a number of serious criminal acts, it is clear that really serious facts are not discussed. I found nothing in the figures that related to criminal organizations, hormone mafia, VAT carousel, arms trade, terrorism and so on. Let’s relativize the figures somewhat.
I find it really interesting to learn about the doctoral thesis that, according to colleague Talhaoui, is apparently being prepared at the University of Antwerp. In this way, we will get a scientific view of the special detection methods. I remember that in the United States, out of a total of 1 million phone calls, only 5% effectively related to criminal acts. This must, however, encourage us to relativise some things and to demonstrate great caution and restraint in the legal regulation of such special methods and techniques.
For the N-VA, the fundamental principles of the rule of law must be ⁇ ined: everyone has the right to a fair trial and to the protection of fundamental rights and freedoms. Violation of certain freedoms can only occur upon court order.
In addition, we are very reluctant to commit crimes by the government, by the police.
We want to ensure that the principles contained in Article 28a on criminal proceedings are guaranteed as far as possible.
Finally, of course, the physical integrity of police officers, informants and cooperating citizens must be guaranteed.
Ensuring all these objectives is indeed a delicate task, a difficult task in the field of legistics.
The draft law is largely profitable where it presents the principles of proportionality and subsidiarity. Since then, in certain discussions, it has again become clear that they should never be lost from the eye. We cannot repeat this enough, especially also for the people of practice who, dragged by their enthusiasm, might sometimes lose sight of the great principles. It is also important that the Prosecutor’s Office is in principle charged with the leadership and authority and that maximum guarantees for the physical integrity of the police officers are incorporated.
The design was also improved on many points during the hearing in the committee. I think, among other things, of better protection of the professional secrecy of doctors and lawyers. In this regard, the initial design went too far. I have made reservations on this subject from the very beginning and am pleased that we were there with sufficient support to turn the draft into an acceptable provision on this subject. Their
I also think of the limitation and proportionality of the criminal offences that police officers can commit. This improvement was made in the committee. First, we believe that there are insufficient guarantees for the direction and control of the prosecutor’s office on the informant’s work. As the annual report of Committee P shows, fortunately, the vast majority of police officers are honest, loyal and correct. Unfortunately, a limited number does not and there are even some corrupt. In those circumstances, and even if it was only because I do not want to live in a police state, an efficient direction and control by the prosecutor’s office is absolutely necessary, especially when it comes to special detection methods and techniques such as observation, infiltration, informant work, post interception, search operations and direct interception. Precisely in one of the domains where the danger of osmosis, provokation, false evidence and so on is very large, if not the greatest, and where certain police officers could easily be tempted to cross certain boundaries because they must permanently move in a world where there are no boundaries, precisely there it is still a pity that the leadership of the prosecutor’s office in this domain is not intended. It is the police that designs, executes and regulates the informant work without too many pot watchers. Informants are activated without the intervention of the public prosecutor. Dat was de objectie: men wist automatisch dat er een informant was gebruikt zodra de zaak na het opsporingsonderzoek voor de raadkamer kwam. Dat was het probleem. Daarom was dit levensbedreigend voor de informant, ook volgens het college van procureurs-generaal.

Niettemin is het aan bod gekomen tijdens de hoorzittingen. Ik denk dat wij nu eenmaal zijn geconfronteerd met een uitspraak van het Arbitragehof in de zaak Vercauteren. Ik citeer nog eens de uitspraak van het Arbitragehof omdat zulks belangrijk is in het licht van mijn verdere betoog. Ik citeer: " De absolute onmogelijkheid om voor de rechter ten gronde nietigverklaarde handelingen aan te wenden staat niet in verhouding tot het doel rechtsonzekerheid te vermijden. Mijns inziens is het voorliggende ontwerp een uitgelezen kans om de nietigverklaarde bepalingen van de wet Franchimont te vervangen. Zoals u weet gaat het om een zin in de artikelen 131, paragraaf 2 en artikel 235bis, paragraaf 6 van het Wetboek van Strafvordering, met name en ik citeer: "De ter griffie neergelegde stukken mogen niet worden ingezien en mogen niet in de strafprocedure worden aangewend.". Ik meen dat dit ontwerp uitermate delicate aangelegenheden regelt omdat de debatten, de discussies over nietigheden precies ook met deze nog zullen toenemen.

Ik weet dat mijn opmerkingen weggewuifd werden. Dat is daarstraks ook weer gebeurd. Ik heb genoteerd dat collega Giet sprak van het paard van Troje in verband met het vertrouwelijke dossier. Ik ben er niet zo zeker van — ik heb daarstraks ook naar de dialogen geluisterd — dat dit alles geen repercussies heeft. Ter staving citeer ik uit de toelichting van de minister op bladzijde 8 van het verslag: "De permanente controle over de uitvoering van bijzondere opsporingsmethoden ligt bij de procureur des Konings, ook als deze werden bevolen door de onderzoeksrechter. Het is evident dat in geval van gerechtelijk onderzoek de onderzoeksrechter zelf beslist welke methoden hij beveelt, wijzigt of stopzet. Niettemin blijft ook in dat geval de procureur des Konings zijn controlebevoegdheid uitoefenen. De machtigingen in dit verband verleend door de onderzoeksrechter, worden door de procureur des Konings ten uitvoer gelegd. Het vertrouwelijk dossier berust immers bij het openbaar ministerie. In my view, the present draft constitute an excellent opportunity to replace the annulled provisions of the Franchimont Act. As you know, this is a sentence in Articles 131, paragraph 2, and 235bis, paragraph 6, of the Code of Criminal Procedure, in particular, and I quote: "The documents deposited at the office shall not be viewed and shall not be used in the criminal proceedings." I think that this draft regulates extremely delicate matters because the debates, the discussions about invalidities will increase precisely with these.
My great criticism at the time on the design-Franchimont was related to the purification. I have always found it bad that the purification took place in respect of certain parties in a non-contradictory manner, that before the judge in essence the debate on this subject could no longer be conducted. There may be situations where purification has occurred before certain parties have access. In my view, from the perspective of the rule of law and of the citizen’s confidence in the judiciary, it is important that there is a different arrangement for the purification of the nullities.
My second consideration concerning that contradictory review, which was also cited by other colleagues, relates to the confidential file. I know that my comments have been wiped away. This has happened again afterwards. I noted that colleague Giet spoke of the Trojan horse in connection with the confidential file. I am not so sure — I have also listened to the dialogues thereafter — that all this has no repercussions. One can, of course, assume a very simple example, as the Minister subsequently formulated. Indeed, it can be argued that the evidence must be contained in that file and that the burden of proof must be thus secured. What happened outside the confidential file is not in the face of the judge in substance. All kinds of possible situations can naturally be imagined — I refer mutatis mutandis to the case-Vercauteren — in which people, witnesses, accused, accused say that their innocence can be proved by means of. It is not always so that it is stated that the public prosecutor can only invoke what the file contains. There are also various discussions with various parties in this process.

Evidence collection in criminal cases affects fundamental rights of defence. Monsieur le président, monsieur le ministre, je voudrais commencer par indiquer deux points de convergence entre l'analyse que je voudrais développer du projet qui nous est soumis et des points de vue qui ont été exprimés avant moi à cette tribune.
Selon le premier point, il est effectivement des domaines où la lutte contre la criminalité organisée doit admettre un certain nombre de dérogations à des droits fondamentaux. Au parlement, nous devons considérer le fait que des risques réels soient pris par rapport à des actes qui peuvent mettre en danger les institutions de notre pays ou même la démocratie.
Au regard de ce genre de risques, on doit considérer qu'il y a aussi de la part de certains milieux de la criminalité organisée des menées qui portent atteinte aux droits de l'homme, à la démocratie, qui sont de nature à discréditer ces institutions. C'est à l'aune de ces risques que doivent être appréciés les risques pris lors du recours à des méthodes particulières de recherche comme celles-ci. C'est donc un premier point sur lequel je crois pouvoir partager le point de vue nuancé développé de façon équilibrée par plusieurs orateurs.
Il est un deuxième point sur lequel je suis parfaitement d'accord avec la plupart de mes prédécesseurs. C'est l'idée qu'il faut une législation. Cette idée tire sa légitimité de l'article 8 de la Convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales, qui commande de respecter la vie privée, la vie familiale, le domicile et la correspondance tout en précisant explicitement la possibilité que certaines dérogations à ce principe fondamental soient apportées par une loi.
Le même principe se trouve dans les articles 22 ou même 29 de notre Constitution qui concernent le respect de la vie privée et familiale ou le secret de la correspondance. Là aussi, les constituants belges avaient, dès le départ, indiqué que des exceptions pouvaient se trouver énoncées dans des lois. A cet égard, je partage les points de vue exprimés avant moi, mais le bout de chemin que je peux parcourir avec mes collègues s'arrête déjà ici, en particulier le bout de chemin que je peux parcourir avec la majorité arc-en-ciel. En effet, après trois ans de législature, on peut commencer à dresser le bilan. J'ai le sentiment qu'avec cette majorité, chaque fois qu'on reconnaît l'existence d'un problème dans le domaine de la criminalité ou du pénal on se retrouve, en vertu d'une espèce de dynamique idéologique et politique, emballé dans une spirale dont nombre d'entre nous éprouvent des difficultés à sortir.
C'est ainsi que l'on retrouve des socialistes, des chrétiens démocrates flamands, des libéraux et même des verts côte à côte sur des positions non seulement sécuritaires, mais qui peuvent finalement même s'avérer contre-productives, inefficaces en tout cas, par rapport aux objectifs affichés de lutte contre la criminalité organisée.
Par exemple, en matière de procédure de comparution immédiate, en matière de droits des jeunes, en matière de témoignage anonyme, en matière — M. Erdman le reconnaissait tout à l'heure — d'extension à plusieurs reprises depuis le début de cette législature du champ d'application de l'article 90ter du Code pénal, on est chaque fois parti d'un accord intellectuel honnête que j'ai pu partager à certains moments, avec des libéraux ou des socialistes au sein de la majorité. On part ainsi d'un débat correct sur le fond et, par une espèce d'emballement qu'on pourrait qualifier de magique s'il n'était pas aussi dramatique dans ses effets potentiels, on se retrouve sur des propositions gravement dérogatoires par rapport à des procédures de droit commun et à des principes fondamentaux.
Ainsi, par exemple, quand M. Coveliers, en 1993 ou 1994, dépose à la Chambre ou au Sénat, je ne sais plus, une proposition de loi légalisant en quelque sorte l'essentiel des deux circulaires qui régissaient la matière dont nous débattons aujourd'hui, j'ai applaudi évidemment. Je trouvais important que l'on fasse sortir de l'ombre des techniques qui, jusqu'alors, étaient laissées dans une certaine clandestinité et mettaient ceux qui étaient censés les appliquer dans une situation d'insécurité juridique permanente.
Le texte que nous examinons ici va plus loin, trop loin, d'autant que dans un certain nombre de cas, l'emballement législatif dont je viens de parler risque de s'avérer contre-productif dans ses effets par rapport à la lutte contre la criminalité organisée et contre la criminalité ordinaire.
Par rapport à la lutte contre la criminalité organisée, je crains qu'à cet excès d'excitation législative frénétique va malheureusement répondre une excitation comparable, si pas des milieux judiciaires, certainement des milieux policiers que nous connaissons bien. Je crois que ce genre de climat va finalement s'avérer nettement préjudiciable à la recevabilité des preuves, par exemple, si les conditions essentielles de nécessité, de subsidiarité et de proportionnalité que tout le monde rappelle ici sont à ce point si mal assurées, si mal ancrées dans la réalité du texte qui nous est soumis.
Contre-productivité ou risque de contre-productivité importante aussi dans la lutte contre la criminalité ordinaire. Le recours inutile ou disproportionné à de telles méthodes particulières de recherche pour recueillir des preuves qui auraient pu être rapportées autrement pourra conduire à l'annulation pure et simple de ces preuves.
Un exemple à la page 17 de l'exposé des motifs: "La ruse susceptible de favoriser la commission d'une infraction est permise s'il y avait intention délictueuse préexistante, lorsque c'est un policier qui incite quelqu'un à infiltrer un milieu criminel". Je crois que c'est clairement le genre de disposition qui amènera tôt ou tard une condamnation de Strasbourg. Le plus tôt possible, mais je crains que pour aller jusqu'à Strasbourg, on doive attendre quelques années et c'est là le problème. Parce que la jurisprudence de la Cour européenne des droits de l'Homme, dans un arrêt par exemple du 9 juin 1998, condamne tout à fait clairement en son paragraphe 39 toute influence policière de nature à inciter un individu à commettre une infraction. Là, je reviens sur ce petit débat que nous avons eu tout à l'heure. Pourquoi bon sang n'avoir pas accepté d'inscrire explicitement au 47quater la notion de provocation policière qui paraît tout à fait finement définie par la jurisprudence existante? Je sais qu'il y a une espèce de circonlocution approximativement similaire dans le texte actuel du 47quater mais je pense que cette circonlocution n'est pas tout à fait superposable à la notion de provocation policière et à la jurisprudence qui s'est dégagée au fil du temps dans nos juridictions.
D'autre part, et c'est une autre lacune de ce 47quater, l'irrecevabilité des poursuites y est bien indiquée mais pas de façon suffisamment claire car ce que la jurisprudence, la Cour européenne des droits de l'Homme précise, c'est qu'il y a non seulement irrecevabilité des poursuites dans un contexte comme celui-là, mais aussi irrecevabilité ab initio et définitive car, je cite l'arrêt du 9 juin, on considère que la ruse en question a privé " ab initio et définitivement le requérant d'un procès équitable".
À cause de ces lacunes, à cause de ces défauts, je pense qu'on se trouvera réellement à un moment donné face à des situations où des preuves seront considérées comme inutilisables et où éventuellement des décisions de justice belges seront condamnées par la juridiction de Strasbourg. Je trouve aussi significatif (et c'est aussi une tare de la manière de travailler de la majorité depuis trois ans) qu'il n'y ait pas eu d'études sérieuses sur la rentabilité de ces mesures de lutte contre la criminalité organisée. Les éléments les plus précis que j'ai entendu avancer jusqu'à présent portent sur quelques articles de presse récents, et notamment sur une opération qui a été menée à Thuin, je crois, après un vol d'armes dans une caserne militaire. On nous indique que sans les méthodes particulières de recherche, cette victoire n'aurait pas pu être engrangée. Je demande à voir.
C'est vrai que dans cette affaire-là, il semble que les méthodes particulières de recherche aient bien été utilisées, mais a-t-on une indication précise, moi en tout cas je ne connais pas le dossier, de ce qui se serait passé si on avait recouru non pas à des méthodes particulières mais à des méthodes classiques de recherche? Par ailleurs, je voudrais me référer à un dossier que je connais bien. Je veux parler de celui de l'affaire Dutroux et de la période qui a précédé le 17 août 1996. Je tiens à vous rappeler un élément qui me semble susceptible de réduire l'enthousiasme de certains pour les méthodes particulières de recherche à la lumière de l'expérience thudinienne. A Charleroi, pendant plusieurs mois, des méthodes particulières de recherche ont été mises en oeuvre avec le fameux dossier Othello pour aboutir à la catastrophe que l'on sait. Je pense donc qu'il aurait été utile de procéder à une étude approfondie autre que simplement événementielle de la réelle rentabilité de ces mesures dans la lutte contre la criminalité organisée.
J'en arrive au deuxième problème.
Réglementer et le faire sur des questions comme celles-là, c'est sans doute permettre un certain nombre de comportements, notamment à des policiers. C'est aussi rendre obligatoires d'autres mesures, notamment de contrôle et de précaution. Mais cela devrait être également interdire un certain nombre de choses. J'ai l'impression — j'y reviendrai — que dans ce dossier, on permet énormément de choses. On prévoit — c'est vrai — un certain nombres de dispositions et de garde-fous. Mais il ne s'agit de rien d'autres que de garde-fous de façade. Et dans les faits, on n'interdit pas grand-chose.

Mr. Speaker, Mr. Minister, I would like to begin by pointing out two points of convergence between the analysis that I would like to develop of the project that is submitted to us and the views that were expressed before me in this tribune.
According to the first point, there are indeed areas where the fight against organized crime must admit a number of derogations from fundamental rights. In parliament, we must consider the fact that real risks are taken in relation to acts that can endanger our country’s institutions or even democracy.
In view of this kind of risks, it must be considered that there are also activities on the part of certain environments of organized crime that undermine human rights, democracy, which are in a way to discredit these institutions. It is on the basis of these risks that the risks taken when using specific research methods such as these must be assessed. This is therefore a first point on which I believe I can share the nuanced point of view developed in a balanced way by several speakers.
There is a second point on which I totally agree with most of my predecessors. It is the idea that legislation is needed. This idea draws its legitimacy from Article 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, which orders respect for privacy, family life, home and correspondence, while explicitly specifying the possibility that certain derogations from this fundamental principle are made by a law. by
The same principle is found in Articles 22 or even 29 of our Constitution which concern respect for private and family life or the secret of correspondence. Here too, the Belgian constituents had, from the outset, indicated that exceptions could be enunciated in laws. In this regard, I share the views expressed before me, but the end of the road I can go with my colleagues already stops here, in particular the end of the road I can go with the majority rainbow. This is how socialists, Flemish Christian Democrats, liberals and even Greens are found side by side in positions not only security, but which can eventually even prove counterproductive, ineffective in any case, in relation to the stated objectives of the fight against organized crime.
For example, in the case of immediate appearance procedure, in the case of youth rights, in the case of anonymous testimony, in the case — Mr. Erdman had acknowledged it just recently — extending repeatedly since the beginning of this legislature the scope of Article 90ter of the Criminal Code, each time we started from an honest intellectual agreement that I was able to share at certain times, with liberals or socialists within the majority. Thus we start from a correct debate on the substance and, through a kind of packaging that could be called magical if it was not so dramatic in its potential effects, we find ourselves on proposals severely derogatory from common law procedures and fundamental principles.
For example, when Mr. Coveliers, in 1993 or 1994, deposits in the House or in the Senate, I do not know more, a proposal of law legalizing in some way the essence of the two circles that regulated the matter we are debating today, I applauded obviously. I found it important to bring out the shadow of the techniques that, until then, were left in a certain clandestinity and put those who were supposed to apply them in a situation of permanent legal insecurity.
The text that we are examining here goes further, too far, especially since in a number of cases, the legislative package that I have just talked about may prove counterproductive in its effects compared to the fight against organised crime and against ordinary crime.
In relation to the fight against organised crime, I fear that this excess of frenetic legislative excitement will unfortunately respond to a comparable excitement, if not the judicial circles, ⁇ the police circles that we know well. I believe that this kind of climate will eventually prove to be clearly detrimental to the admissibility of evidence, for example, if the essential conditions of necessity, subsidiarity and proportionality that everyone recalls here are so poorly assured, so poorly anchored in the reality of the text submitted to us.
Counter-productivity or risk of counter-productivity is also significant in the fight against ordinary crime. The unnecessary or disproportionate use of such particular methods of investigation to collect evidence that could have been ⁇ otherwise may lead to the pure annulment of such evidence.
An example on page 17 of the explanation of the motives: "Curse that may favor the commission of an offence is permitted if there was pre-existing criminal intent, when it is a police officer who incites someone to infiltrate a criminal environment." I think it is clearly the kind of disposition that will sooner or later lead to a Strasbourg condemnation. As soon as possible, but I fear that to get to Strasbourg, we have to wait a few years and that is the problem. Because the case-law of the European Court of Human Rights, in a judgment, for example, of 9 June 1998, quite clearly condemns in its paragraph 39 any police influence capable of inciting an individual to commit an offence. I would like to come back to the discussion we had just recently. Why has Bon Sang not agreed to explicitly include in the 47quater the notion of police provocation which seems quite finely defined by the existing jurisprudence? On the other hand, and this is another gap of this 47quater, the inadmissibility of prosecutions is well indicated there, but not clearly enough because what the case-law, the European Court of Human Rights, specifies is that there is not only inadmissibility of prosecutions in a context like this, but also inadmissibility ab initio and definitive because, I quote the judgment of June 9, it is considered that the deceit in question has deprived "ab initio and definitively the applicant of a fair trial".
Because of these shortcomings, because of these shortcomings, I think that we will actually find ourselves at a given time facing situations where evidence will be considered unusable and where eventually Belgian judicial decisions will be condemned by the court of Strasbourg. I find it also significant (and it is also a big deal of how the majority has worked for three years) that there have been no serious studies on the cost-effectiveness of these measures to combat organized crime. The most precise details I have heard so far refer to some recent press articles, and in particular to an operation that was conducted in Thuin, I think, after a gun theft in a military barracks. It is true that in this case, it seems that the particular methods of research have been used, but do we have a precise indication, I in any case do not know the dossier, of what would have happened if we had resorted not to particular methods but to traditional methods of research? Vous avez raison, mais j'observe quand même que sous la précédente législature, sur des questions comme celles-là, il arrivait assez fréquemment que l'on puisse disposer, par exemple, de notes et parfois d'études substantielles d'un service dont on n'entend plus parler, monsieur le ministre. Je veux parler du service de politique criminelle.
Je pense également qu'une étude comme celle-là n'inverserait pas les choses. Je n'ai d'ailleurs pas dit qu'il ne fallait pas de méthodes particulières de recherche.
Je conteste que le changement de méthode — passer de méthodes classiques à des méthodes particulières — soit le seul moyen de lutter plus efficacement contre la criminalité organisée. Il existe d'autres moyens comme tout ce qui touche à la formation des policiers et aux moyens classiques dont on les dote, y compris sur le plan budgétaire. Encore une fois, ce que je disais là n'allait pas dans le sens d'un refus de principe de toute méthode particulière mais venait plutôt en appui à une critique sur l'étendue du champ d'application et le peu de clarté des limites posées sur certains points par ce projet de loi. Par ailleurs, je pense qu'il y aurait des alternatives non directement répressives à la lutte contre la criminalité organisée que notre gouvernement et la majorité qui le soutient au parlement ont pris l'habitude de dédaigner. Je pense particulièrement à une association plus forte des victimes à la procédure pénale. A chaque débat de ce style-là, je vous rappelle une proposition de loi que j'ai déposée il y a maintenant deux ans et qui fait écho à l'engagement de procéder, au-delà de la petite réforme Franchimont de mars 1998, à une réforme Franchimont plus importante, engagement qui fut pris par tout le monde ici à cette tribune et dans les programmes électoraux sur lesquels beaucoup d'entre nous ont été élus.
Une meilleure lutte contre la criminalité organisée suppose à mon avis le renforcement des droits de la défense de la partie civile et la consécration de droits réels pour la victime d'être associée plus systématiquement à certaines phases de la procédure pénale. En tout cas, dans cette lutte, il ne faut pas négliger l'apport possible des victimes et d'une législation qui, en matière de procédure pénale, irait un peu plus loin dans l'idée d'égalité des armes et d'association des parties civiles au travail de la justice pour arriver à neutraliser certains auteurs ou à faire émerger certaines vérités.
Au lieu de cela, j'ai l'impression que cette majorité a mis non seulement les droits des détenus au placard mais aussi les droits de la partie civile entre parenthèses depuis son avènement alors que, pour beaucoup d'entre nous, monsieur le ministre, ce genre de thématique a été à l'origine de notre élection, de notre réélection ou du succès de nos partis.
J'en viens à la question du champ d'application du projet de loi qui me paraît tout à fait contredire les beaux discours que l'on entend ici et à l'extérieur du parlement sur le caractère strictement exceptionnel que doit avoir le recours aux méthodes particulières de recherche. C'est bien de le dire mais ce serait mieux de le faire, de l'écrire dans les textes! C'est ainsi que quand M. Giet indique qu'il "espère" — il l'a dit pratiquement comme cela — qu'une directive du Collège des procureurs généraux permettra dans les faits de restreindre le champ d'application au seul seuil fixé par l'article 90ter du Code pénal et par l'article 324bis du Code d'instruction criminelle, je pense qu'il aurait été très utile d'apporter dans le texte même de la loi ce genre de limitation plus précise.
En effet, pour moi, le fait qu'il n'y ait aucun seuil infractionnel requis, soit pour procéder à une observation simple, comme une filature, où l'on ne recourt pas à des moyens techniques particuliers, soit pour recourir aux indicateurs ou à une intervention différée, pose question sur le type de régime que l'on prend le risque d'induire.
Trop bas aussi, le seuil infractionnel fixé à des infractions passibles de minimum un an de prison, pour des observations avec moyens techniques, l'interception du courrier ou la récolte de données bancaires.
Pour moi, ces deux chapitres du projet sont de trop. Je pense vraiment qu'avec le troisième, celui que j'ai cité tout à l'heure à la suite de M. Giet, nous avions largement de quoi contrer la véritable criminalité organisée et la véritable criminalité grave. A la lumière de ce qui existe dans le texte du projet, le principe de proportionnalité, dont beaucoup se gargarisent, me paraît en réalité bafoué. Selon moi, il n'y a pas de réelle volonté législative de limiter l'engagement de méthodes particulières de recherche à la lutte contre la criminalité organisée. Vu en outre le fait que depuis l'avènement de la majorité dite arc-en-ciel, le champ d'application de l'article 90ter a été "gonflé" à plusieurs reprises, nous aboutissons à quelque chose de relativement inquiétant, d'autant que la notion de proactivité instaurée légalement par la loi de mars 1998, cumulée avec cette législation sur les méthodes particulières de recherche, risque d'accoucher d'une sorte de "Dracula" législatif.
Quand on combine tout cela avec le fait que des infractions, qui ne sont pas encore commises mais seraient susceptibles d'être commises, puissent faire l'objet de telles méthodes particulières, on peut se demander ce qui échappera au champ d'application de ces législations et ce qu'il restera concrètement du droit qu'ont tous les citoyens de ne pas être soupçonnés injustement d'actes qu'ils n'ont pas commis.
Je note aussi un glissement dans la manière dont les termes sont utilisés. Entre l'article 28bis datant de l'époque Franchimont, où l'on parlait de faits punissables qui vont être commis, et les discours qui sont tenus aujourd'hui — on parle désormais de faits punissables qui seront commis ou d'auteurs qui commettraient ces faits —, on passe donc du futur immédiat à un futur simple ou à un conditionnel présent. Cela montre que l'on s'éloigne d'une logique de proactivité au sens le plus strict et que l'on prend doucement le chemin d'une proactivité dans un sens beaucoup plus large.
Toujours à propos du principe de proportionnalité, je ferai référence à un article d'un homme de terrain, M. Christian De Valkeneer. Il s'intitule "La tromperie dans l'administration de la preuve pénale". Il a été publié en 2000. Il reprend donc des considérations tout à fait contemporaines, émises par un acteur qui ne peut pas être considéré comme un observateur présentant des considérations strictement abstraites et académiques. Que dit l'auteur?
Il dit qu'il faut des limites à la commission autorisée d'infractions et même des exclusions. Je les cite: "Il faut que soient exclues les atteintes à l'intégrité psychique ou physique des personnes, que ce soit directement ou indirectement." Par exemple, la fourniture d'armes devrait aussi être proscrite. Si un magistrat se prononce en la matière, cela devrait retenir l'attention. Je trouve particulier que sur la question des faits de moeurs, à laquelle M. le ministre semble très sensible, on semble avoir oublié ces faits assez croquignolesques mais quand même inquiétants.
Souvenons-nous de magistrats et de certains policiers de la mouvance Nihoul à Bruxelles, qui fréquentèrent assidûment les parties fines de la rue des Atrébates au nom de leur volonté d'infiltrer les milieux criminels. Je considère que ce genre de procédé pose une série de questions. Ne pas les exclure du champ d'application de cette loi risque de renforcer encore ceux qui sont tombés dans ce panneau hier, avec la conviction qu'ils peuvent continuer à le faire.
Le Conseil d'Etat, d'ailleurs, dans son avis sur ce projet opère une distinction claire entre les infractions sans victimes et les infractions qui causent des dommages à autrui. Je regrette que cette distinction n'ait pu être retenue. Il ne peut suffire de dire que des infractions sont nécessaires et qu'elles doivent être commises à tout prix pour rassurer le milieu infiltré sur le caractère loyal de l'infiltrant.
M. De Valkeneer dit encore qu'il faudrait exclure la commission répétée d'infractions. Autant on peut imaginer une aide occasionnelle apportée à un acte délictueux ou criminel pour commettre une infraction par une personne infiltrée dans le milieu, autant, à partir du moment où ce type d'aide devient un acte récurrent, les problèmes concrets se posent. Il propose aussi d'exclure les actes donnant les moyens à la criminalité de prospérer sans garantie suffisante d'atteindre les objectifs poursuivis par l'opération mettant en oeuvre des méthodes particulières de recherche. Idem pour des situations qui présentent un risque trop grand de ne pas atteindre ces objectifs, voire de catalyser ceux de la criminalité.
Ce type d'exclusion aurait dû être plus explicitement, plus nettement formulé dans le texte qui nous est soumis. J'ajoute qu'il aurait été utile d'exclure du champ d'application les infractions commises lors de l'observation ou du contact avec les indicateurs. Je ne vois pas pourquoi, lors de l'observation ou lors du contact avec les indicateurs, on doit être autorisé à commettre des infractions. Je me souviens de M. Je suis étonné qu'une majorité qui a manifesté son soutien aux opérations de M. Bush dans sa grande campagne anti-terroriste en Afghanistan, ne pense même pas aujourd'hui à interdire explicitement des comportements risquant de mettre en danger la Sûreté de l'Etat dans une législation comme celle-ci. Dans le texte actuel, ce genre d'infraction peut éventuellement être autorisée. A la lumière d'événements du début des années 80, par exemple, et de menaces qui à mon avis guettent encore l'ordre démocratique de notre pays, je trouve assez dangereuse la porte ainsi ouverte.
Sur le contrôle exercé sur les policiers, je reconnais qu'un amendement à l'article 47quinquies, §2, en projet, instaure une forme de proportionnalité interne entre l'acte commis et l'acte que le policier est censé éviter, mais ma satisfaction ne peut malheureusement être que partielle. En effet, il est indiqué que ces infractions ne peuvent être plus graves que les infractions pour lesquelles les méthodes sont mises en oeuvre. Elles doivent être proportionnelles à l'objectif visé. J'en déduis que ces infractions peuvent être aussi graves que l'acte contre lequel elles sont mises en oeuvre. A cet égard, je pense que les questions éthiques de base se posent à nouveau dans la manière dont on doit soupeser l'opportunité ou non de recourir à ces méthodes.
De même, on peut lire que le procureur du Roi doit mentionner au préalable et par écrit la liste des infractions qu'il autorise aux policiers. Je pense que c'est une bonne disposition mais elle est pratiquement neutralisée quelques lignes plus loin, où il est indiqué que les policiers doivent avertir formellement le procureur du Roi dès qu'ils commettent une infraction. Cela veut dire en fait qu'ils peuvent le faire sans autorisation préalable mais avec une simple autorisation a posteriori. Sur ce plan, je pense qu'après avoir tenté de cadrer quelque peu les choses, on rouvre un véritable boulevard à des abus.
Je vous vois vous impatienter, Mme Herzet, mais n'ayez crainte, toutes les mesures ont été prises pour que les choses aillent vite et fassent le moins mal possible, Mme Dardenne.
Le principe du recours au juge d'instruction chaque fois qu'une méthode particulière de recherche est utilisée n'est pas repris. Je pense qu'en ce qui concerne le contrôle à exercer sur les policiers, c'est un moins. Autre moins, le fait que, même pendant l'instruction, le parquet gardera, dans les faits, la haute main sur ces méthodes et leur utilisation. Et de plus en plus — c'est une malheureuse lame de fond qui anime également la coalition arc-en-ciel —, le juge est réduit progressivement à un rôle de contrôle de régularité, même dans des contextes aussi délicats que la préservation et la protection des libertés fondamentales.
C'est le ministère public qui est finalement chargé à la fois de l'exécution des méthodes particulières de recherche et de leur contrôle permanent. Je pense qu'il va être difficile pour un certain nombre de magistrats du ministère public d'exercer ce contrôle, tout en étant aussi en charge de l'exécution de ces méthodes, avec toute la sérénité et l'impartialité voulues.
Je terminerai en disant que l'article 6 de la Convention européenne des droits de l'homme et tout ce qui touche au procès équitable pose aussi question. Je me souviens que nous en avons beaucoup débattu il y a un an, à propos du projet de loi sur le témoignage anonyme et de la force probante que des témoignages anonymes peuvent avoir. Je pense que mutatis mutandis , il aurait été utile également d'expliciter qu'un dossier répressif ne peut pas se limiter à des éléments recueillis au moyen de méthodes particulières de recherche ou qu'à tout le moins, une condamnation ne peut se fonder ni exclusivement ni de manière déterminante sur pareils éléments. Je crois que par analogie avec la jurisprudence européenne en matière de témoignages anonymes, cela aurait été un apport significatif à la limitation des dégâts que cette loi risque d'occasionner.
Pour terminer, je constate que nous voilà, après seulement quelques semaines de débat en commission, en présence d'un projet prêt à voter, probablement dans quelques heures, moins de 24 heures après la distribution du rapport, et peut-être sans même la possibilité d'une évocation sénatoriale puisque je perçois comme un consensus assez large. En dépit d'un certain nombre de reproches, de griefs et de grincements de dents qui se font entendre, j'ai l'impression qu'au moment venu, même les plus frustrés et les plus tristes d'entre vous feront le bon geste de soutenir encore et encore le gouvernement dont ils sont si peu contents dans les faits.
Je constate qu'à part l'amendement qui prévoit des garde-fous particuliers en matière de protection du secret professionnel de l'avocat ou du médecin objets d'une enquête avec méthodes particulières de recherche, les véritables améliorations apportées à ce projet depuis sa sortie du Conseil des ministres sont vraiment rares et superficielles. Les choix politiques ne se font pas vraiment au parlement. Ils sont remplacés, comme M. Giet semblait l'indiquer tout à l'heure, par des choix de politique criminelle qui se font, rappelons-le, sous l'égide de l'exécutif. Je constate qu'en commission, finalement, on fait du travail technique et juridique parfois utile. Mais les vrais choix politiques auraient dû se faire là et devraient peut-être encore se faire ici et non au Collège des procureurs généraux.

I remember Mr. Zicot and how in the end, by means of contact with indicators or infiltration, some police officers find themselves — with their body defending or not, we may one day learn — on the other side of the barrier.
Similarly, police provocation should have explicitly appeared in the exclusions, as well as the offences against the State Security. I am surprised that a majority of those who have expressed their support for Mr. Bush, in his major anti-terrorist campaign in Afghanistan, does not even think today of explicitly prohibiting behaviors that could endanger State Security in legislation like this. In the current text, this type of infringement may possibly be permitted. In the light of events of the early 1980s, for example, and of threats that, in my opinion, still guard the democratic order of our country, I find quite dangerous the door so opened.
Regarding the control exercised over police officers, I acknowledge that an amendment to Article 47quinquies, §2, in the draft, establishes a form of internal proportionality between the act committed and the act the police officer is supposed to avoid, but my satisfaction can unfortunately be only partial. These offences cannot be more serious than the offences for which the methods are applied. They must be proportionate to the target. Similarly, it can be read that the Prosecutor of the King must mention in advance and in writing the list of offences he authorizes to police officers. I think this is a good disposition but it is practically neutralized a few lines further, where it is stated that police officers must formally warn the King’s Attorney as soon as they commit an offence. This means in fact that they can do so without prior authorization but with a simple a posteriori authorization. On this level, I think that after trying to frame things somewhat, we reopen a real boulevard to abuse.

The principle of recourse to the investigative judge whenever a particular method of investigation is used is not repeated. Met uitzondering van het Verenigd Koninkrijk dat daar geen belangstelling voor had, is België de enige lidstaat van de Europese Unie die nog niet is toegetreden. Canada treedt voorlopig niet toe, omdat het niet gewenste aantal stemmen kreeg. Dat is de weergave van de bespreking.
