                    Mijnheer de voorzitter, wij hebben dat wetsontwerp in zeer korte tijd in de commissie kunnen bespreken. Wij zijn gisteren overeengekomen dat het hier behandeld zou worden. De heer Dehu was inderdaad rapporteur, maar hij zal waarschijnlijk nog niet weten dat het nu besproken wordt. Het wetsontwerp is pas uitgedeeld. Ik denk wel dat iedereen het kan steunen, zoals dat gisteren in de commissie het geval was. Men ging ook eenparig akkoord dat het vandaag hier behandeld werd.

                    Mijnheer de voorzitter, ik zal kort, van op mijn bank, mijn uiteenzetting geven.

Wij kunnen dit wetsontwerp, dat van de Senaat komt, met volle overtuiging steunen. Dit maakt een einde aan een discriminatie die wij al een tijdje aanklagen en waarover ik de minister van Pensioenen, de heer Vandenbroucke, al diverse keren vragen heb gesteld. Ik heb aangedrongen dat dit zou worden geregeld. Als dit ontwerp vandaag wordt goedgekeurd, waaraan ik niet twijfel, zullen mensen niet alleen — zoals tot nu toe het geval was — het voordeligste stelsel van pensioenen kunnen kiezen, maar zal ook een nog bestaande discriminatie van de zelfstandigen worden rechtgezet. Er stond nog in onze pensioenwet — denkende dat in alle gevallen het werknemersstelsel voordeliger was — dat het werknemersstelsel altijd primeerde op het stelsel voor zelfstandigen. Dit is niet in alle gevallen zo. Er zijn uitzonderingen waar het stelsel voor zelfstandigen voordeliger kan zijn.

Ik geef een voorbeeld, mijnheer de voorzitter. Voor iemand die werknemer is, zelfstandige wil worden en "uitbolt" in het ene terwijl hij zich inwerkt in het zelfstandigenstatuut, kunnen de verdiensten in het werknemersstatuut wel eens zo laag zijn geworden dat het beter is om in het zelfstandigenstatuut een jaar pensioen te krijgen. Het gebeurt. Wij discrimineerden daar mensen op de algemene regel dat iedere pensioengerechtigde het interessantste stelsel mocht kiezen. Dat was hier niet het geval, maar dat wordt door deze wet — als ze vandaag wordt goedgekeurd — rechtgezet. Ik denk dat dit billijk is. Zeker in een periode waarin wij pleiten voor flexibiliteit in de loopbaan, mag die flexibiliteit in geen enkel geval worden afgestraft. Wij helpen hiermee geen honderdduizenden mensen, maar we heffen wel enkele schrijnende voorbeelden van pensioenbenadeling op.

There was still in our pension law—thinking that in all cases the employee system was more advantageous—that the employee system always prevailed over the self-employed system. This is not so in all cases. There are exceptions where the system for self-employed may be more advantageous.

Let me give you an example, Mr. President. For someone who is an employee, wants to become self-employed and "blows out" in one while engaging in the self-employed statute, the earnings in the employee statute may sometimes have become so low that it is better to get a year's pension in the self-employed statute. It happens . We there discriminated against people on the general rule that every pensioner could choose the most interesting system. This was not the case here, but this will be corrected by this law — if it is adopted today. I think this is fair. Especially in a time when we advocate flexibility in the career, that flexibility should in no case be punished. We are not helping hundreds of thousands of people, but we are bringing up some striking examples of retirement disadvantage.

                    Mijnheer de voorzitter, in de commissievergadering werd beslist dat ik mondeling verslag zou uitbrengen.

Het gaat over de implementering van een verdrag van New York van 4 december 1989 in het Belgisch recht. Dat verdrag voorziet in een beteugeling van de aanwerving van huurlingen voor gewapende conflicten of conflicten die in derde landen plaatsvinden, waarbij die aanwerving strafbaar wordt gesteld. Daarop is er een uitzondering.

De enige discussie die plaatsvond is de volgende. In het artikel 3 van deze tekst, dat artikel 2 wordt van de wet, staat dat dit gebeurt in de gevallen, bepaald in een met redenen omkleed en in de Ministerraad overlegd koninklijk besluit. Daarop staat een gevangenisstraf van drie maanden tot twee jaar, wanneer men in die gevallen mensen aanwerft. Die aanwerving is trouwens niet alleen tegen geld, maar kan ook louter een indienstneming zijn om andere redenen.

De Raad van State stelde dat daardoor de wet niet volledig zou overeenstemmen met het verdrag, omdat bepaalde gebieden daardoor natuurlijk uitgesloten zouden kunnen worden, vermits de Ministerraad bepaalt voor welk conflict er geen huurlingen mogen worden aangeworven. Daarop is door de regering geantwoord dat dit niet juist is. Het verdrag bepaalt namelijk dat de aanwerving van huurlingen voor bepaalde conflicten strafbaar wordt gesteld, met uitzondering van bijvoorbeeld de internationale politieoperaties.

Dat was het enige discussiepunt dat in de commissievergadering werd gevoerd.

Voor de meer technische uitleg daarover verwijs ik naar het schriftelijk verslag, dat nog op komst is en dat ieder lid zal krijgen. In dat schriftelijk verslag wordt ook de volledige technische argumentatie gegeven in het kader van het internationaal publiekrecht. Ik denk dat het beter is dat ik verwijs naar de geschreven versie, eerder dan hier voor een beperkt aantal collega's, die daardoor toch maar verveeld zouden worden, dat allemaal nog eens uiteen te zetten. Uiteindelijk is de tekst dan ook aanvaard, mits, dacht ik, een aantal onthoudingen van de CD&V-fractie en de Vlaams Blok-fractie. Mocht ik mij daarover vergissen, dan mogen de collega's dat rechtzetten, want ik vernoem dat nu uit het hoofd.

At the meeting of the committee, it was decided that I would submit an oral report.

It is about the implementation of a New York Convention of 4 December 1989 in Belgian law. That Convention provides for a restriction on the recruitment of mercenaries for armed conflicts or conflicts taking place in third countries, where such recruitment is punishable. There is an exception to this.

The only discussion that took place was the following. In Article 3 of this text, which becomes Article 2 of the law, it is stated that this is done in the cases, determined in a royal decree clothed with reasons and consulted in the Council of Ministers. There is a sentence of imprisonment from three months to two years, when people are recruited in those cases. That recruitment, by the way, is not only for money, but can also be merely an employment for other reasons.

The Council of State stated that the law would not be fully consistent with the Convention, because certain areas could naturally be excluded, since the Council of Ministers determines for which conflict mercenaries should not be recruited. The government responded that this is not correct. The Convention provides that the recruitment of mercenaries for certain conflicts is punishable, with the exception, for example, of international police operations.

That was the only topic discussed at the committee meeting.

For a more technical explanation, I refer to the written report, which is still in the process and which each member will receive. That written report shall also provide the full technical reasoning within the framework of international public law. I think it is better that I refer to the written version, rather than here to a limited number of colleagues, who would therefore be bored, to explain all that again. In the end, the text was accepted, provided, I thought, some abstentions from the CD&V faction and the Vlaams Blok faction. If I am mistaken about this, then the colleagues can correct it, because I am now mentioning it out of mind.
