                    Mijnheer de voorzitter, vandaag stemmen wij hier over een wet tot oprichting van een commissie voor de terugbetaling van farmaceutische producten en verstrekkingen.

Het gaat om een nieuw orgaan, dat moet beslissen over de terugbetalingsvoorwaarden voor bijvoorbeeld sondevoeding of materiaal voor diabetici.

Vandaag is de procedure erg complex en het doorlopen van de procedure duurt lang. Het is dus in het belang van de patiënten dat het systeem sneller en transparanter werkt.

Op het programma en in de wet stond ook de samenstelling van de commissie die de terugbetalingen zal vaststellen.

Het lijkt ons, ten eerste, erg belangrijk dat de paritaire samenstelling wordt behouden, met de aanwezigheid van de verzekeringsinstellingen die de belangen van de patiënten in de brede zin van het woord verdedigen.

Wij zijn ook erg blij dat het voorstel van de PVDA met een heel grote meerderheid werd goedgekeurd. Het strekte ertoe ook patiëntenverenigingen een plaats en een raadgevende stem in de commissie te geven. Waarom is dat belangrijk? Patiëntenverenigingen kennen heel goed de concrete behoeften en de moeilijkheden die de patiënten ervaren bij de terugbetalingsvoorwaarden. Ik geef u het voorbeeld van sondevoeding.

Vandaag zijn er zware tekortkomingen bij de terugbetaling van sondevoeding. Het Vlaams Patiëntenplatform kaartte aan dat patiënten grote bedragen moeten voorschieten en dat er geen derde-betalersregeling is. Dat maakte ik zelf mee met een kankerpatiënt. De firma weigerde de voeding te leveren omdat de patiënt geen geld had om het grote voorschot te betalen. Hij kwam dus letterlijk zonder eten te staan.

De Mucovereniging, zijnde de vereniging van mucopatiënten, schiet op dit ogenblik dat geld voor aan de patiënten zelf, om het achteraf terugbetaald te krijgen.

De patiëntenverenigingen hekelen ook de grote administratieve overlast en het ontbreken van de opname van de sondevoeding voor volwassenen, bijvoorbeeld in de maximumfactuur.

Met dat voorbeeld wil ik aangeven dat de kennis van de patiëntenorganisaties groot is. Ik hoop dan ook dat hun stem en hun aanwezigheid in de commissie ertoe kan bijdragen dat naar de bekommernissen echt wordt geluisterd.

It is a new body, which must decide on the terms of reimbursement for, for example, probe feed or material for diabetics.

Today, the procedure is very complex and passing through the procedure takes a long time. It is therefore in the patient’s interest that the system works faster and more transparent.

On the program and in the law was also stated the composition of the committee that will determine the refunds.

It seems to us, first of all, very important that the parity composition is ⁇ ined, with the presence of insurance institutions defending the interests of patients in the broad sense of the word.

We are also very pleased that the PVDA proposal was approved by a very large majority. It also aimed to give patient associations a place and an advisory voice in the committee. Why is this important? Patient associations are well aware of the concrete needs and the difficulties experienced by patients with respect to the conditions of reimbursement. Let me give you the example of probe nutrition.

Today, there are serious shortcomings in reimbursement of probe feed. The Flemish Patients Platform pointed out that patients must pay large amounts and that there is no third-party payer scheme. I did this with a cancer patient. The firm refused to deliver the nutrition because the patient had no money to pay the large advance. He literally stood without food.

The Muco Association, which is the association of mucopatients, is currently sending that money to the patients themselves, in order to get the money back afterwards.

The patient associations also resent the large administrative burden and the absence of the inclusion of sonde feeding for adults, for example, in the maximum invoice.

With that example, I would like to indicate that the knowledge of the patient organisations is large. I therefore hope that their voice and their presence in the committee can contribute to making the concerns really heard.

                    Un autre problème qui se pose dans la composition de la commission, c'est que l'industrie y est présente et qu'elle a un droit de vote consultatif. Cette présence et la participation de l'industrie dans un organe décisionnel est inacceptable pour le PTB. Nous avons le même problème en parallèle à la Commission de remboursement des médicaments où la présence de l'industrie pèse lourdement sur les décisions. C'est une pression directe et indirecte qui est mise sur les participants et dans leurs prises de décision. Ceci est décrié par de nombreuses personnes.

Certains ont parlé d'un équilibre. Du fait qu'on introduisait les patients, il fallait conserver l'industrie. Mais il n'y a là aucune comparaison possible. Le poids financier, le poids du lobbying de l'industrie ne peut bien évidemment pas être comparé au poids et à la voix des patients. Pour cette raison, par notre amendement, nous proposons de simplement supprimer la présence de l'industrie dans cette commission. Cela permettra aux membres de cette commission de prendre leurs décisions en toute objectivité, sans pression de l'industrie et dans le seul intérêt des patients et de notre sécurité sociale.

This presence and industry participation in a decision-making body is unacceptable for PTB. We have the same problem in parallel with the Drug Refund Commission where the presence of the industry weighs heavily on decisions. It is a direct and indirect pressure that is put on the participants and in their decision-making. This is denounced by many people.

Some have spoken of balance. As patients were introduced, the industry had to be preserved. There is no possible comparison. The financial weight, the weight of industry lobbying, obviously cannot be compared to the weight and voice of patients. For this reason, with our amendment, we propose to simply remove the presence of the industry in this committee. This will enable members of this committee to make their decisions objectively, without pressure from the industry and in the sole interest of patients and our social security.

                    Met de afschaffing van de Technische farmaceutische raad, de Technische raad voor diagnostische middelen en verzorgingsmiddelen, die voorstellen indienden voor de terugbetaling van de medische middelen, alsook van de Werkgroep medische voeding, die de terugbetaling van medische voeding voorstelde, wordt niet alleen een administratieve vereenvoudiging maar ook een snellere procedure beoogd. Dat kunnen wij alleen maar toejuichen.

Ondanks het feit dat het wetsvoorstel reeds veertien maanden klaarlag, kwam het toch holderdebolder bij de commissie terecht. Dat maakte het wat moeilijk werken.

Omdat het wetsvoorstel de organisatie werkbaarder en de werking efficiënter maakt en het ten goede komt aan onze mensen, zullen wij het steunen.

                    Beste collega's, als een regering in lopende zaken is, heeft het Parlement veel vrijheden. Het is goed dat het Parlement die vrijheden benut en initiatieven neemt.

Het Parlement heeft in die periode echter ook verantwoordelijkheden. Een minimale verantwoordelijkheid is ervoor te zorgen dat de overheidsinstellingen voort kunnen werken.

Het voorstel dat hier voorligt, is vooral een technisch voorstel dat een blokkering in de ziekteverzekeringswet wil opheffen. Het wetsvoorstel richt de Commissie voor Terugbetaling van Farmaceutische Producten en Verstrekkingen op om op die manier verwarring, gelet op het verschil in bevoegdheden, met de bestaande Technische farmaceutische raad te voorkomen.

De wet houdende diverse bepalingen van 22 juni 2016 voorzag in de samenvoeging van de Technische farmaceutische raad, de raad die de nomenclatuur van de geneeskundige verstrekkingen of, in vaktermen de magistrale bereidingen, voorstelt, en de Technische raad voor diagnostische middelen en verzorgingsmiddelen, die de terugbetaling van medische hulpmiddelen voorstelt, en de Werkgroep medische voeding, die de terugbetaling van medische voeding voorstelt. De reden om de drie diensten samen te voegen is vooral administratieve vereenvoudiging. Elke beslissing van de drie organen moest worden uitgevoerd via een koninklijk besluit. Dear colleagues, if a government is in ongoing business, Parliament has a lot of freedoms. It is good that Parliament takes advantage of those freedoms and takes initiatives.

However, the Parliament also has responsibilities during this period. A minimum responsibility is to ensure that the public institutions can continue to work.

The proposal presented here is primarily a technical proposal that aims to remove a block in the Health Insurance Act. The legislative proposal establishes the Committee for the Reimbursement of Pharmaceutical Products and Benefits in order to avoid confusion with the existing Technical Pharmaceutical Board, given the differences in powers.

                    De patiënten weten dat het op de markt is en zitten te wachten op hun terugbetaling. Daarom is het RIZIV aan het slag gegaan om een procedure uit te werken die gelijkaardig is aan de procedure van de CTG en de Commissie tegemoetkoming implantaten en invasieve medische hulpmiddelen.

De wet van 22 juni 2016 sprak van een uitbreiding van de bevoegdheden van de Technische farmaceutische raad. Maar de werkgroep van het RIZIV vond dat het gebruik van dezelfde benaming tot verwarring zou kunnen leiden. Om de verwarring over bevoegdheden te vermijden, stellen zij voor om deze nieuwe commissie te herdopen tot de Commissie voor de terugbetaling van farmaceutische producten en verstrekkingen. Deze naam sluit beter aan bij de andere commissies.

Het gaat dus om een eenvoudige naamsverandering, die toch al wat vragen heeft doen rijzen. Maar dat is eigenlijk onterecht. Zolang deze wet niet goedgekeurd is, kan het KB niet gepubliceerd worden en blijven dossiers bij het RIZIV liggen. De Raad van State aanvaardt de oude procedure immers niet meer omdat de wet voorzag dat deze in werking zou treden op 1 januari 2020. Ik hoop dus dat iedereen in deze plenaire vergadering dit voorstel kan steunen.

                    Mijnheer de voorzitter, dat laatste is inderdaad het allerbelangrijkst. Sinds 1 januari 2020 bestaat er nu immers een lacune en kunnen nieuwe middelen niet meer terugbetaald worden. Voor een heel aantal patiënten is dit toch heel belangrijk. Het gaat hier om medische hulpmiddelen, medische voeding, magistrale bereidingen die voor heel veel patiënten moeten gemaakt worden, over capillaire protheses. Het is belangrijk dat patiënten die hier nood aan hebben deze hulpmiddelen ook kunnen krijgen. De markt is overigens erg innovatief en sterk in beweging. Sinds 1 januari 2020 kan dit dus niet meer voor wat de nieuwe middelen betreft.

Het is technisch, maar erg belangrijk voor patiënten. Daarom zijn we blij dat we hieraan kunnen meewerken en dat we de vertegenwoordigers van de patiënten hebben kunnen toevoegen, met hun raadgevende stem. Dat hebben we als sp.a samen met de collega's van de PS gedaan.

Ik heb nog één vraag voor mevrouw de minister. Het is van fundamenteel belang dat we deze wet goedkeuren, maar ook dat de KB tot uitvoering ervan snel behandeld worden. Deze KB's gaan over het huishoudelijk reglement en de samenstelling. De kabinetsmedewerkster van de minister heeft gezegd dat de KB's klaarliggen. Ik hoop dat dit ook het geval is en dat ze bij wijze van spreken morgen ondertekend kunnen worden. Zo kan de Technische farmaceutische raad, het equivalent van de CTG – de Commissie Tegemoetkoming Geneesmiddelen – snel van start gaan en kunnen de patiënten de middelen krijgen die ze nodig hebben en die deel uitmaken van een toegankelijke gezondheidszorg.

I hope that this is also the case and that they can be signed in the form of speech tomorrow. For example, the Technical Pharmaceutical Board, the equivalent of the CTG – the Pharmaceutical Compliance Commission – can start quickly and can provide patients with the resources they need and that are part of an accessible health care.

Door de samensmelting van drie organen in één adviserende raad zal er efficiënter met mensen en middelen kunnen worden omgegaan, des te meer omdat wij vaak dezelfde mensen in verschillende hoedanigheden weerzien.

Met de toevoeging van de patiëntenorganisaties wordt de beweging voortgezet waarbij zij in een vroeger stadium bij het beleid worden betrokken, want zij zijn ook al in het geneesmiddelenagentschap en andere organen ingebracht.

De koninklijke besluiten liggen inderdaad klaar, mijnheer Bertels. Wij zullen die met haastige spoed publiceren, want de dossiers liggen te wachten. De Raad van State aanvaardt die welke ingediend werden met de vorige benamingen, niet meer.
