                    Mijnheer de voorzitter, collega's, nu ligt het wetsvoorstel voor tot wijziging van de wetten van 18 juli 1966 op het gebruik van de talen in bestuurszaken wat betreft het toezicht op de uitvoering van deze wetten. Zoals de voorzitter meedeelde, werd dit voorstel al behandeld in de commissie, welk verloop ik niet zal herhalen, maar wel kort wil samenvatten. Iedereen weet dat wie in dienst treedt bij het Brussels plaatselijk bestuur, de kennis van beide landstalen moet hebben, uitgezonderd vakwerklieden die niet met het publiek in aanraking komen. Om hun kennis van de tweede landstaal te bewijzen, moeten de kandidaten een examen afleggen bij Selor. De vice-gouverneur is belast met de controle en het toezicht op de geldende bepalingen en bij overtreding van de bepalingen mag hij overgaan tot een schorsing.

Na een schorsing zijn er twee mogelijkheden: ofwel trekt de gemeente het geschorst besluit in, ofwel, indien de gemeente dat niet doet, moet het besluit vernietigd worden door de plaatselijke voogdijoverheid. Inzake de Brusselse gemeenten valt de voogdij onder de daarmee belaste minister van de Brusselse regering, inzake de OCMW's onder twee collegeleden van de Gemeenschappelijke Gemeenschapscommissie.

Het probleem is, wanneer de vernietiging door de toezichthoudende overheid niet binnen bepaalde termijnen gebeurt, dat er een situatie met een onwettige aanwerving ontstaat, terwijl de betrokken personen wel gewoon aan het werk mogen blijven. Dat zet natuurlijk de deur open voor misbruiken, ondanks het feit dat de Raad van State de vernietiging nochtans bevolen heeft.

In het wetsvoorstel zitten heel veel cijfers, die allemaal besproken werden, maar ik beperk mij nu tot de cijfers van 2019, de recentste cijfers. Bij de gemeenten was 70 % van de benoemingen onwettig en bij de OCMW's is het nog veel erger, want 89 % van de benoemingen was er onwettig. Die cijfers illustreren wat wij eigenlijk al lang weten. Het is algemeen bekend dat sinds de voogdij van de Brusselse gemeenten naar de Brusselse gewestelijke instanties is overgegaan, de vernietiging van de onwettige benoemingen dode letter is gebleven. Sterker nog, als wij het taalhoffelijkheidsakkoord bekijken dat binnen de Brusselse regering is afgesloten, wat eigenlijk een taalovertredingsakkoord is, kunnen wij besluiten dat de Brusselse gewestelijke voogdijinstanties gewoon lak hebben aan de geldende taalwetten.

Het wetsvoorstel komt erop neer dat naast de schorsingsbevoegdheid ook de vernietigingsbevoegdheid direct bij de vice-gouverneur wordt neergelegd. Om twee redenen is dit wetsvoorstel heel belangrijk. Ten eerste, bestaande misbruiken, in de praktijk verfransing in de Brusselse besturen, worden een halt toegeroepen. Ten tweede, het voorstel voorkomt dat het in de toekomst nog erger wordt.

The proposal amends the laws of 18 July 1966 on the use of languages in administrative matters with regard to the supervision of the implementation of these laws. As the Chairman informed, this proposal has already been discussed in the committee, which I will not repeat, but will briefly summarize. Everyone knows that those who enter the Brussels local government must have knowledge of both national languages, except for professionals who do not come into contact with the public. To prove their knowledge of the second national language, candidates must take an exam at Selor. The Deputy Governor is charged with the control and supervision of the applicable provisions and in case of breach of the provisions he may proceed to a suspension.

After a suspension, there are two possibilities: either the municipality withdraws the suspended decision, or, if the municipality does not, the decision must be destroyed by the local custodial authority. In the case of the Brussels municipalities, the custody falls under the Minister of the Brussels Government, in the case of the OCMWs, under two colleagues of the Joint Community Commission.

The problem is, if the destruction by the supervisory authority does not take place within certain time limits, that a situation of unlawful hiring arises while the persons concerned are simply allowed to continue working. This, of course, opens the door to abuse, despite the fact that the Council of State has yet ordered the destruction.

The bill contains a lot of figures, all of which have been discussed, but I will now limit myself to the figures of 2019, the most recent figures. In the municipalities 70 % of the appointments were illegal and in the OCMWs the situation is much worse, as 89 % of the appointments were illegal. These figures illustrate what we have known for a long time. It is well known that since the custody of the Brussels municipalities has passed to the Brussels regional authorities, the destruction of the illegal appointments has remained a dead letter. In fact, if we look at the linguistic fairness agreement concluded within the Brussels government, which is actually a linguistic breach agreement, we can conclude that the Brussels regional custody authorities simply lack the applicable language laws.

In addition to the suspension power, the destruction power is deposited directly with the deputy governor. For two reasons, this bill is very important. First, the existing abuses, in practice the fracking in the Brussels administrations, are being stopped. Second, the proposal prevents it from getting worse in the future.

                    De voorbereidende nota van de preformateur Egbert Lachaert laat de toekomst voor de Nederlandstaligen in Brussel er niet echt goed uit zien.

"In de zogenaamde voorbereidende nota van Egbert Lachaert staan wel degelijk voorstellen over Brussel. Dat is dan ook het enige goede nieuws voor de Nederlandstalige Brusselaars. De onderhandelaars hebben toch enige interesse voor hun stad. Wie de Brusselse ideetjes van Lachaert leest, vergaat het enthousiasme snel. Je zou kunnen verwachten dat een Vlaamse preformateur eens en voor altijd een einde zou willen maken aan die onwettige toestand en zou voorstellen om de schorsing van de vice-gouverneur bindend te maken."

Dat is eigenlijk waar ons wetsvoorstel op neerkomt.

"Helaas. Lachaert wilt net het tegenovergestelde. Hij schuift zelfs een aloude Franstalige eis naar voren, die voor Brusselse Vlamingen altijd onaanvaardbaar is geweest: tweetalige diensten, eentalige ambtenaren. In de praktijk komt het erop neer dat de Vlamingen bijna paria's worden in Brussel en een apart loket zullen krijgen. Dit als voorsmaakje voor de anti-Vlaamse Vivaldi-coalitie van Egbert Lachaert."

Daarom dienen wij dit wetsvoorstel in. We willen de vernietigingsbevoegdheid leggen bij de vice-gouverneur, conform de technische bepalingen in het document. Ik vraag aan iedereen die een beetje Vlaamse of Nederlandstalige reflex heeft om dit voorstel te steunen.

In the so-called preparatory note of Egbert Lachaert, there are proposals about Brussels. This is the only good news for the Dutch-speaking Brussels. The negotiators have some interest in their city. Those who read the Brussels ideas of Lachaert, the enthusiasm quickly disappears. You could expect that a Flemish preformator would once and for all want to end that illegal state and would propose to make the suspension of the deputy governor binding."

This is exactly what our bill is about.

“Unfortunately . Lachaert wants the opposite. He even puts forward an old French-speaking requirement, which has always been unacceptable for Brussels Flamings: bilingual services, single-speaking officials. In practice, it comes down to the fact that the Flamings almost become paria in Brussels and will get a separate lock. This as a taste for the anti-Flemish Vivaldi coalition of Egbert Lachaert.”

That is why we submit this bill. We would like to transfer the destruction power to the Deputy Governor, in accordance with the technical provisions in the document. I ask anyone who has a little Flemish or Dutch-speaking reflex to support this proposal.
