Mijnheer de voorzitter, mijnheer de minister, onze fractie is tevreden en steunt de maatregelen die u zult nemen om de wet betreffende de Belgische Ontwikkelingssamenwerking te stroomlijnen met het beleid dat u wenst te voeren. U zet duidelijk stappen naar een meer geïntegreerde werking. Onder andere de GSK’s zijn volgens ons een nuttig instrument; zij kunnen de coördinatie en synergie binnen ontwikkelingssamenwerking bevorderen.
Ik heb in de commissie echter ook een aantal opmerkingen gemaakt en namens mijn fractie zal ik deze nog even naar voren brengen.
Ten eerste, het wetsontwerp maakt geen duidelijk onderscheid tussen de koepel en de federatie in de niet-gouvernementele samenwerking. Volgens artikel 11 hebben koepels een even belangrijke functie als spreekbuis voor de leden en als gesprekspartner voor het beleid, als de federaties. Zij zijn daarin dus gelijk. Nochtans wordt die taak in artikel 13 in de definitie van zowel koepel als federatie, niet omschreven voor de koepels. Het is dus niet heel duidelijk wat de functie is van beide organisaties. Er is een overlapping en eigenlijk worden beide daarvoor ook nog gesubsidieerd. Wij vinden het spijtig dat het wetsontwerp daarin niet meer duidelijkheid heeft gebracht.
Ten tweede, wij zijn zeer blij dat de institutionele actoren meer erkenning krijgen en de mogelijkheid krijgen om zich te organiseren in een federatie, waarvoor zij eventueel een beroep kunnen doen op de nodige middelen. Echter, gekoppeld aan mijn vorig punt, namelijk de onduidelijkheid over en de overlapping tussen koepel en federatie, leidt dit ertoe dat de institutionele actoren daar een beetje in een nadelige positie zitten qua communicatie naar u en het beleid. Dat geldt ook in de toekomst, wanneer tegen het jaareinde de programma’s moeten worden ingediend binnen de GSK’s. Zij zijn eigenlijk maar in één organisatie vertegenwoordigd, als zij die al zouden oprichten. Immers, in het verleden was er geen federatie of geen koepel voor de institutionele actoren. Nu is er de mogelijkheid dat zij een federatie oprichten, maar dan hebben zij nog maar één kanaal, terwijl de CMO’s twee kanalen hebben, namelijk de koepel en de federatie.

Mr. Speaker, Mr. Minister, our group is satisfied and supports the measures you will take to streamline the Belgian Development Cooperation Act with the policy you wish to pursue. You set clear steps toward a more integrated operation. Among other things, we consider the GSKs to be a useful tool; they can promote coordination and synergy within development cooperation.
However, I have also made a number of comments in the committee, and on behalf of my group I will bring them up for a moment.
First, the bill does not clearly distinguish between the dome and the federation in non-governmental cooperation. According to Article 11, the dome has an equally important function as the speech tube for the members and as the interlocutor for policy, as the federations. They are equal in it. However, this task is not defined in Article 13 in the definition of both dome and federation for the dome. Therefore, it is not very clear what the function of both organizations is. There is a overlap and in fact both are still subsidized for that. We regret that the draft law has not brought more clarity in this.
Second, we are very pleased that the institutional actors get more recognition and the opportunity to organize themselves into a federation, for which they may be able to resort to the necessary resources. However, linked to my previous point, namely the uncertainty about and the overlap between dome and federation, this leads to the institutional actors there being somewhat disadvantaged in terms of communication to you and the policy. This also applies in the future, when by the end of the year the programmes must be submitted within the GSKs. They are actually represented only in one organization, if they already set up them. After all, in the past there was no federation or no dome for the institutional actors. Now there is the possibility that they will establish a federation, but then they will only have one channel, while the CMOs have two channels, namely the dome and the federation.

Dat is historisch zo gegroeid, maar wij hopen dat er daarin in de toekomst meer duidelijkheid komt. De institutionele actoren, het Tropisch Instituut en de universiteiten, zouden dezelfde mogelijkheid moeten krijgen als de CMO’s.
Tot slot, in uw toelichting bij de wet zegt u dat deze ook een verbredingsoperatie inhoudt. Zeker op het vlak van de institutionele actoren hebben wij dat al gemerkt, zoals ik al zei. Ook de definitie van organisatie van de civiele maatschappij is voldoende ruim. Verschillende actoren kunnen potentieel een erkenning krijgen. Niet iedereen kan automatisch subsidies aanvragen, maar dat vormt geen probleem. Niettemin vinden wij dat de verbreding niet ver genoeg gaat, zoals ik in de commissie ook al aanhaalde. U creëert geen ruimte voor samenwerkingsmodaliteiten met actoren die doelstellingen binnen de internationale samenwerking nastreven, maar die geen beroep wensen te doen op subsidies. Enkele vzw’s doen bijvoorbeeld bewust geen beroep op subsidies, uit principe, omdat zij op eigen benen willen staan, maar zij willen toch ontwikkelingsrelevant zijn. Ook de activiteit van de organisatie kan een reden zijn om geen subsidies aan te vragen, zoals ondernemingen en kmo’s, die geen subsidies kunnen genieten, maar die nu ook wel uitgesloten worden.
In uw repliek op mijn opmerkingen hebt u aangegeven dat u in de toekomst zoveel mogelijk wilt samenwerken met privéorganisaties. Welnu, ik ben benieuwd of en op welke wijze die samenwerking zal gebeuren, want er is daarvoor niet echt een wettelijke basis. Het lijkt mij dus logisch, in het kader van de hervormingen en de verbreding die u voorstaat, dat er een wettelijk kader komt of op zijn minst een procedure om de samenwerking tussen overheid en niet-gesubsidieerde ANGS vlot te laten verlopen. Uiteindelijk zijn het resultaat en de impact ter plaatse belangrijker dan wie dat gerealiseerd heeft.
Bij Ontwikkelingssamenwerking komen er nog enkele hervormingen aan. Wij zijn in blijde verwachting, als ik dat zo mag zeggen, om daaraan mee te werken. U kunt rekenen op onze steun om daaraan voort te werken.

The activity of the organization can also be a reason not to apply for grants, such as ⁇ and SMEs, which are not eligible for grants but are now excluded.
In your response to my comments, you indicated that you would like to work with as many private organisations as possible in the future. Well, I’m curious whether and how that cooperation will happen, because there’s not really a legal basis for it. Therefore, it seems to me logical, in the context of the reforms and enlargement you propose, that a legal framework, or at least a procedure, should be established to enable the cooperation between the government and non-subsidized ANGS to proceed smoothly. Ultimately, the outcome and the impact on the ground are more important than who realised it.
There are a number of reforms in development cooperation. I look forward, if I can say so, to working with you. You can count on our support to continue to work on this.

Monsieur le président, monsieur le ministre, chers collègues, par ce texte, on a déjà eu l'occasion de vous le dire en commission, vous avez décidé de jouer un double rôle. D'abord, celui d'un incendiaire, pour mieux jouer, ensuite, le rôle du pompier. L'incendie fut tel que la majorité a même dû demander l'urgence pour ce projet de loi.
Vous me demanderez pourquoi j'utilise cette métaphore. Car, avec vos réformes, monsieur le ministre, vous avez littéralement plongé dans un vide juridique de nombreux acteurs de la coopération non gouvernementale. Et vous-même, en commission, avez reconnu que la situation actuelle était inconfortable. En effet, vous avez entamé, en 2015, une réforme du financement de la coopération non gouvernementale et lancé, dès 2016, un screening pour actualiser les accréditations des ONG et autres acteurs de la coopération non gouvernementale ayant accès à un financement public. Dans ce cadre, ces acteurs doivent introduire leurs programmes pour septembre de cette année. Ces programmes doivent désormais se référer à des cadres stratégiques communs – un nouveau système introduit en avril 2016 – avant d'être in fine appréciés par votre administration en juin.
Le problème, mes chers collègues, est que l'ensemble de ce nouveau processus prend place sans qu'effectivement le cadre légal de la réforme n'ait été adopté. D'où la précipitation qui prévaut aujourd'hui. Une précipitation qui est loin d'être finie puisque les nouveaux arrêtés doivent encore aussi être adoptés. Cela signifie que les acteurs de la coopération non gouvernementale ont dû régler des cadres stratégiques communs qui devront être appréciés sans connaître le cadre légal exact.
Ma collègue Gwenaëlle Grovonius vous a déjà adressé de nombreuses questions à propos de ce vide juridique et le manque de précision du projet qui nous est soumis aujourd'hui. D'ailleurs, dans son avis, le Conseil d'État a pu souligner, à maintes reprises, le flou entourant plusieurs notions.
Ce vide juridique nous inquiète d'autant plus que l'on connaît les projets qui devront arriver prochainement sur nos bancs. Rappelons que, pourtant, l'accord de gouvernement et votre note de politique générale promettaient des réformes concertées avec les acteurs concernés et que le temps et les moyens leur seraient donnés afin de diriger les changements. Nous en sommes bien loin!
Rappelons enfin que le cadre précédent de la loi de 2013 avait été largement salué et que votre parti avait pris part à cette réforme. L'urgence avec laquelle cette majorité a décidé, une nouvelle fois, de chambouler le secteur est d'autant plus curieuse. Nous attendons d'ailleurs avec impatience la réponse à une question écrite de notre groupe pour voir quels acteurs garderont ou non leur accréditation suite au screening et leur rôle linguistique.

This means that non-governmental cooperation actors have had to settle common strategic frameworks that will have to be appreciated without knowing the exact legal framework.
My colleague Gwenaëlle Grovonius has already asked you many questions about this legal void and the lack of accuracy of the project that is submitted to us today. Furthermore, in its opinion, the State Council has been able to emphasize, repeatedly, the ambiguity surrounding several concepts.
This legal vacuum worries us all the more as we know the projects that will soon come to our banks. Remember, however, that the government agreement and your general policy note promised reforms coordinated with the stakeholders concerned and that time and resources would be given to them to direct the changes. We are very far away!
Finally, let us recall that the previous framework of the 2013 law had been widely welcomed and that your party had taken part in this reform. The urgency with which this majority has decided, once again, to chamboot the sector is all the more curious. We are also looking forward to the answer to a written question from our group to see which actors will retain their accreditation or not following the screening and their linguistic role.

Je tiens simplement à confirmer en quelques mots, monsieur le ministre, que le groupe MR votera, comme il l'a fait en commission, le projet de loi relatif à la Coopération belge au développement, plus particulièrement ce qui concerne la coopération non gouvernementale, laquelle, parallèlement à la coopération gouvernementale et multilatérale, représente quelque 250 millions d'euros annuels de la Coopération belge au développement. Cette coopération est mise en œuvre par des ONG, par des syndicats ou par des universités. C'est cette nature civile qui lui confère un droit d'initiative autonome qui s'est révélé tout à fait intéressant pour la coopération et pour ses partenaires.
Monsieur le ministre, notre groupe a particulièrement apprécié la longue réponse très précise que vous avez apportée en commission. Nous serons, nous aussi, attentifs – peut-être pourrez-vous donner quelques éléments d'information – à la question relative au calendrier des arrêtés royaux qui viendront compléter le cadre légal.
Chers collègues, en conclusion, il est vrai que, depuis plusieurs années, les gouvernements belges successifs, depuis Charles Michel à Jean-Pascal Labille, se sont efforcés de renforcer l'efficacité de la coopération non gouvernementale. C'est cette volonté que vous concrétisez et renforcez, monsieur le ministre, en réduisant le morcellement des interventions, en assurant la cohérence des politiques menées. Par ailleurs, vous poursuivez la simplification administrative qui est nécessaire au droit d'initiative autonome de la coopération non gouvernementale. Vous avez également veillé – élément extrêmement important à nos yeux – à la concertation avec le secteur. Ce texte qui a été quasiment adopté à l'unanimité en commission traduit l'engagement humanitaire de notre gouvernement, et donc nous le voterons.

This text, which was approved almost unanimously in the committee, reflects the humanitarian commitment of our government, and we will therefore vote for it.

Geen enkel zinnig mens kan daar eigenlijk tegen zijn, zeker niet aangezien de wijziging in overleg met de betrokken sectoren wordt voorgesteld en ook hun steun geniet. Onze fractie is erover verheugd dat een en ander conform het regeerakkoord is en dat u, mijnheer de minister, maximaal de autonomie van de ngo’s erkent en daarmee ook hun specifieke meerwaarde in ontwikkelingslanden.
De wetswijziging heeft heel wat voeten in de aarde gehad. Er is een tijdje een juridische leemte geweest inzake de erkenning en subsidiëring van de ngo’s. U hebt vorig jaar in de zomer na een vruchtbaar overleg met de ngo's een gentlemen’s agreement kunnen sluiten. De overgang naar het wetsontwerp heeft iets te lang geduurd, waardoor de ngo’s in een juridisch vacuüm hebben moeten werken. We support the draft law because it aims to increase the efficiency of development cooperation on the ground and this is absolutely necessary, especially since it has been done in mutual consultation and with respect for the autonomy and specificity of non-governmental cooperation.

Mijnheer de minister, tot slot heb ik het over de uitvoering van het wetsontwerp. Er komen twee koninklijke uitvoeringsbesluiten, een over de financiering van de subsidiëring van de actoren van de niet-gouvernementele samenwerking, en een over het maximale aantal gemeenschappelijke strategische kaders. Wij zijn ongerust. U hebt wel met de ngo’s overleg gevoerd, maar ook bij die ngo’s klinken er ongeruste stemmen. Enfin, je voudrais simplement dire que vous avez reconnu que des délais importants avaient été imposés aux ONG pour la mise en œuvre de leurs projets dans le cadre du cycle des programmes 2017-2022. J'espère que nous pourrons rattraper ce retard. Nous nous interrogeons aussi sur le temps et les moyens que toutes ces réformes ont nécessités et sur la logique suivie du screening très coûteux des ONG par des bureaux d'étude privés comme Deloitte.
C'est la base de ce projet que de trouver des solutions boiteuses à la politique d'austérité. Dès lors, on ne peut que déplorer le niveau atteint par le budget de la Coopération au développement. Ce budget, au lieu de s'approcher de l'objectif des 0,7 %, s'en éloigne. En 2015, nous sommes à 0,42 % alors qu'en 2010, nous étions encore à 0,64 %. Par rapport à des pays comme le Danemark, le Luxembourg, les Pays-Bas, la Norvège, la Suède, le Royaume-Uni, qui se trouvent au-dessus des 0,7 %, la Belgique fait vraiment pâle figure en la matière.

Tout d'abord, concernant les affections pédiatriques et la possibilité qui est donnée au Roi de fixer une période particulière permettant d'étendre aux moins de dix-huit ans le remboursement d'une spécialité déjà reprise dans la liste des spécialités remboursables, si celle-ci est déjà remboursée chez les plus de dix-huit ans dans la même indication, donner un traitement plus rapide aux bénéficiaires de moins de dix-huit ans est évidemment intéressant. Mais, nous ne savons toujours pas quelles conditions devront être remplies dans le cadre de cette procédure et dans quel cadre elle pourrait être appliquée.
En effet, cette nouvelle indication pour les enfants devrait faire l'objet de la même attention qu'une autre extension d'indication. Ce n'est pas parce qu'un médicament est autorisé pour les enfants que c'est le meilleur choix de traitement disponible. Il peut exister d'autres traitements moins lourds pour l'enfant ou moins chers pour l'assurance maladie. Il ne faut d'ailleurs pas oublier l'importance d'inciter les firmes pharmaceutiques à mener davantage d'études sur des spécialités concernant les enfants en particulier.
Deuxièmement, par rapport aux modifications apportées à la loi assurance soins de santé et indemnités, afin de permettre la mise en place des trajets de soins buccaux prévus dans l'accord dento-mutualiste 2015-2016, la question première que nous nous posions et que nous nous posons toujours est de savoir si cette modification, c'est-à-dire le fait d'augmenter les quotes-parts personnelles en dentisterie, est de portée générale ou si elle aura seulement pour but de permettre la mise en place de ces trajets de soins.
Par ailleurs, si nous comprenons l'importance des trajets de soins buccaux, nous restons convaincus que cette différenciation du remboursement des prestations chez les personnes qui suivent ce trajet et chez celles qui ne le suivent pas ne sera pas efficace auprès des publics défavorisés, auprès des publics les plus fragiles.

Furthermore, if we understand the importance of oral care tracks, we remain convinced that this differentiation in the reimbursement of benefits among those who follow this route and those who do not follow it will not be effective among disadvantaged audiences, among the most fragile audiences.

Voordat ik specifiek de nadruk leg op de dossiers die in het kader van onderhavig wetsontwerp houdende diverse bepalingen voor onze fractie belangrijk zijn, wil ik toch nog iets rechtzetten wat de vorige spreker totaal verkeerd heeft geïnterpreteerd of begrepen, met name over de uitbreiding in verband met de indicatie pediatrie. De minister heeft dat punt trouwens in de commissie ook verduidelijkt. De vorige spreker beweerde dat er zomaar, zonder studies, een uitbreiding van de doelgroep zou komen, wat uiteraard niet het geval is. Dat is nooit het geval. Waar het om gaat, is dat de procedure, die nu zeven tot dertien maanden duurt, ingekort zal worden, uiteraard op basis van studies. Dat is altijd het geval.
U pleit ervoor dat de firma’s meer gestimuleerd zouden moeten worden om hun indicatiestelling voor kinderen te onderzoeken. Dat is precies het doel van het wetsontwerp, dat bijvoorbeeld ook afspraken inhoudt over prijsdalingen, die er op dit moment zijn wanneer de indicatie wordt uitgebreid naar kinderen. Daardoor is het voor firma’s vaak minder interessant om daarin te investeren, ook gelet op de lange procedure. Het is net de combinatie van de verkorting van de procedure en de schrapping van de prijsdalingen bij een indicatie voor kinderen die de toegang tot belangrijke geneesmiddelen, onder andere tegen kanker en psoriasis, zal vergemakkelijken.
In het voorgelegd wetsontwerp houdende diverse bepalingen vindt onze fractie voorts de dossiers over mondzorg, over tekorten aan geneesmiddelen en over het antibioticagebruik bij dieren heel belangrijk. Wij zijn uiteraard ook heel tevreden over de uitvoering van enkele overeenkomsten uit het pact met de farmasector, zoals de versnelde toegang tot geneesmiddelen, ook voor kinderen, zoals ik al verduidelijkte. Die komt uiteraard de patiënt ten goede.
De maatregel in verband met het mondzorgtraject is omstreden, ook al is die bedoeld om personen aan te moedigen hun gebit regelmatig te laten controleren. Er werden ter zake vanuit bepaalde hoeken verschillende wanberichten de wereld ingestuurd, maar alleen al door de aankondiging van de maatregel werden burgers aangemoedigd om hun gebit te laten controleren. Dat toont mooi aan hoe positief die maatregel is en waarom wij ervoor pleiten dat die zo snel mogelijk in de praktijk wordt gebracht.

We are of course also very satisfied with the implementation of some of the agreements of the pact with the pharmaceutical sector, such as the accelerated access to medicines, including for children, as I have already clarified. This is of course beneficial to the patient.
The measure related to the oral care pathway is controversial, even though it is intended to encourage individuals to have their teeth checked regularly. Various misinformation was sent to the world from certain angles, but only by the announcement of the measure were citizens encouraged to have their teeth checked. This shows how positive that measure is and why we advocate that it be put into practice as soon as possible.

Wij zien ook heil in een ultieme stok achter de deur. Er moet een duidelijke en kordate aanpak van stockbreuken worden uitgewerkt, zeker wanneer ze geregeld plaatsvinden.
De wettelijke basis om het antibioticagebruik bij dieren te inventariseren, vinden wij een prima stap naar een oplossing van de problematiek, die veelvuldig de media haalt.
Wij hebben heel duidelijk gezegd dat het voor ons een eerste stap is. Voor ons mag het nog veel verdergaan met bijvoorbeeld de invoering van de verplichte indicatieregistratie. Bovendien mag de dierenarts, die een centrale rol zou moeten spelen bij de registratie en niet de landbouwer, niet langer meer ingegeven data corrigeren.
Ten slotte wil ik het hebben over de procedure voor medische hulpmiddelen. Wij juichen de initiatieven toe om de evidence-based-medicineaanpak in het hele beleid in te bedden. Wij vinden dat een goede stap. Uiteraard zal onze fractie het wetsontwerp volmondig steunen.

Mijnheer de voorzitter, collega’s, tijdens de algemene bespreking in de commissie heb ik reeds mijn appreciatie uitgedrukt voor het feit dat onderhavig ontwerp heel wat bepalingen bevat tot uitvoering van het pact met de farmaceutische sector. Ons land is kampioen in het klinisch onderzoek op Europees vlak en op wereldvlak behoren we tot de besten. MSD en Janssen Pharmaceutica realiseren 90 procent van de klinische proeven fase 1 in ons land. Pfizer heeft in ons land daarvoor een eigen labo. Die klinische onderzoeken zijn niet alleen belangrijk om farmaceutische bedrijven als economische actor in ons land te houden of om farmaceutische bedrijven te bedienen, zoals in de commissie werd gesuggereerd. Nee, klinische proeven in eigen land zijn bijzonder belangrijk voor patiënten. Het betekent immers ook dat onze patiënten vlugger toegang krijgen tot innovatieve geneesmiddelen.

Door collega Yoleen Van Camp werd reeds gesteld dat de onbeschikbaarheid van geneesmiddelen een probleem is in ons land. Ik heb daar enige tijd geleden een vraag over gesteld aan de minister en zij heeft mij toen geantwoord dat er reeds een meldpunt voor onbeschikbaarheden bestond. Met het ontwerp verscherpt onze minister ook de verplichte aanmeldingen, want ook een tijdelijke onbeschikbaarheid moet gemeld worden. Ik ben blij dat ook groothandelaars een meldplicht zullen krijgen, omdat een deel van het probleem zich natuurlijk voordoet bij de parallelhandel. Alleen als we een goed zicht hebben op de onbeschikbaarheden, kunnen we werken aan de remediëring. Vanuit onze fractie kijken we natuurlijk uit naar de maatregelen om het probleem ten gronde te remediëren en, niet onbelangrijk, naar de resultaten die zullen worden geboekt bij de taskforce op Europees niveau.
Met onderhavige wettekst creëren we ook een wettelijke basis voor een opvolgsysteem bij het FAGG voor het antibioticagebruik bij dieren. Ofschoon dat aspect behoort tot de bevoegdheid Landbouw, is het in belangrijke mate ook een zaak van Volksgezondheid.

With this legislation, we also create a legal basis for a follow-up system at the FAGG for antibiotic use in animals. Although this is a matter of agriculture, it is also a matter of public health.

De antibioticaresistentie, die in ons land zeer hoog is en een gevaar vormt voor de volksgezondheid, heeft te maken met het overdreven menselijk gebruik van antibiotica, maar evenzeer met een te royaal gebruik van antibiotica bij dieren. De maatregel komt dan ook niets te vroeg en ik ben blij dat de regering er werk van maakt. Monsieur le président, monsieur le ministre, chers collègues, je ferai une intervention générale relativement courte, dans la mesure où les débats ont déjà eu lieu en commission. Je voudrais simplement signaler que le projet qui nous est soumis rassemble, comme traditionnellement, différentes mesures variées mais indispensables dans le domaine des soins de santé. Ce projet concrétise aussi des simplifications administratives. À cet égard, je rejoins M. Senesael qui a également parlé de l'aspect technique. Ce projet concrétise aussi des accélérations de procédures au bénéfice du patient. On songe par exemple, comme cela a été dit, à la réduction du délai entre le moment de la décision de rembourser un médicament et la concrétisation de la mesure.
Je pointe aussi, évidemment avec satisfaction, la nouvelle procédure qui vise la réduction de la période d'attente entre l'octroi de l'autorisation dans le cadre d'une affection pédiatrique et le remboursement de médicaments qui ont déjà été remboursés pour les adultes. Il est vrai qu'actuellement, une firme qui souhaite commercialiser une spécialité pharmaceutique doit d'abord la développer pour des patients adultes, et ce n'est qu'ensuite qu'elle pourra éventuellement l'adapter. Certains médecins prescrivaient déjà d'ailleurs ce médicament aux enfants avec la conséquence d'une absence de remboursement et de la responsabilité de la prescription. L'ensemble de nos citoyens mérite de bénéficier de soins de qualité au bon moment et surtout au bon endroit.
Les articles 19 et 20 concernent l'augmentation des tickets modérateurs des soins dentaires. Il s'agit d'une mesure de responsabilisation du patient qui vise à inciter les gens à faire un contrôle dentaire chaque année. Il s'agit d'une mesure issue de la Commission nationale dento-mutualiste dans l'accord tarifaire 2015-2016. Bien entendu, nous ne pouvons qu'y souscrire.
L'article 31, quant à lui, prévoit l'obligation de notifier l'indisponibilité des médicaments, même temporaire. Cette mesure positive permettra d'anticiper des problèmes éventuels sur le terrain, lorsqu'un médicament risque d'être épuisé. J'avais donné un exemple bien spécifique en commission. I also support the introduction of a system of comprehensive financing for the reimbursement of the costs of care in the legal psychiatric centres and I recall in this regard, as I said in the committee, that the lack of adequate reception for interned persons who are currently in prison must be stopped. All our citizens deserve to receive quality care at the right time and above all at the right place.
Articles 19 and 20 relate to the increase of moderator tickets for dental care. This is a patient accountability measure that aims to encourage people to undergo dental checks each year. This is a measure from the National Dento-Mutualist Commission in the Tariff Agreement 2015-2016. We can only subscribe to it.
Article 31 provides for the obligation to notify the unavailability of medicines, even temporarily. This positive measure will anticipate possible problems in the field, when a drug may be exhausted. I gave a very specific example in the committee. It is true that in some cases there may be abuses. Ondanks dit goede nieuws zijn er toch twee grote punten in dit wetsontwerp waarover wij het fundamenteel oneens zijn.
Het eerste betreft de aanpassing van de remgeldplafonds voor tandzorg. Dit sluit aan bij de vastgelegde maatregel in het akkoord tussen tandartsen en ziekenfondsen. Ik ben het er helemaal mee eens, onze fractie is het er helemaal mee eens dat wij moeten proberen mensen aan te zetten om naar de tandarts te gaan en op regelmatige basis hun gebit te laten onderzoeken, maar dat doet men echt niet door hen te straffen.
Voor heel wat mensen is de drempel vandaag reeds hoog om naar de tandarts te gaan, niet zozeer vanwege de eerste kosten voor dat eerste bezoek, maar vanwege de angst voor de kosten als er iets mis is. Wij weten allemaal dat mondverzorging niet echt goedkoop is. Als daar nu ook nog die financiële drempel voor het eerste bezoek bovenop komt, dan zullen de meest kwetsbaren in onze samenleving het eerst afhaken. De maatregel houdt immers in dat iemand die in het voorbije jaar zijn tandarts niet bezocht heeft of vergat te bezoeken, het jaar daarop 14 euro remgeld betaalt in plaats van 7 euro. Wij zijn er vast van overtuigd dat men met deze maatregel net die mensen straft die reeds zeer moeilijk toegang hebben tot de tandzorg.

We are firmly convinced that this measure punishes just those people who already have very difficult access to dental care.

Het venijn zit hier echter eens te meer in de staart, namelijk in het allerlaatste artikel van voorliggend ontwerp, waarin de etikettering van de tabaksproducten wordt aangepast om ze met de Europese richtlijn in overeenstemming te brengen.
Mijnheer de minister, ik hoop dat u aan uw collega overbrengt dat het echt een gemiste kans is. Het was dé kans om met de zogenaamde plain packaging te starten, waarbij de sigarettenpakjes worden ontdaan van alle reclame en hippe beeldvorming van sigaretten waarvoor juist jongeren zo gevoelig zijn. Wij weten ook allen dat het die jongeren zijn die wij van de sigaret moeten proberen af te houden omdat bij hen de kans het grootst is dat zij verslaafd worden en blijven.
Het systeem van het neutrale pakje heeft ondertussen op een aantal plaatsen al zijn nut bewezen.

It was the opportunity to start with the so-called plain packaging, in which the cigarette packages are removed from all advertising and hippe imagery of cigarettes to which young people are so sensitive. We also all know that it is those young people that we should try to stop smoking because they are the most likely to become addicted and remain.
Meanwhile, the system of the neutral package has proven its usefulness in several places.

Il est vrai que l'objectif des dispositions qui nous sont présentées est de faciliter, d'accélérer l'accès à certains médicaments, à certains remboursements. Cependant, les procédés utilisés posent parfois question. Ainsi, changer une liste de médicaments autorisés ou non et publier, a posteriori, par le biais d'un arrêté, la modification de ladite liste plutôt que de la rendre conforme à un arrêté constitue une première qui ouvre des portes quant à la manière d'autoriser et de négocier directement avec les firmes pharmaceutiques sans s'assurer que le rôle de régulation et d'encadrement sera effectivement rempli par les instances de l'INAMI. Se pose également la question de la prise d'arrêtés ou de la prise de dispositifs législatifs au parlement, lorsque cela s'avère obligatoire.
Ce texte sacralise également les négociations non transparentes entre la ministre, le SPF Santé publique et les firmes pharmaceutiques, ce dans le cadre du pacte passé entre l'industrie pharmaceutique et la ministre de la Santé "au profit des patients" – en tout cas, c'est ce qui est stipulé dans ce pacte – mais aussi et surtout au profit des acteurs pharmaceutiques qui développent des produits innovants et de nouvelles molécules. On sait que les soins bucco-dentaires sont ce qu'il y a de plus difficile en matière de santé. La personne appauvrie, celle qui a une pauvre image d'elle-même, qui n'a pas confiance en elle, qui n'a pas confiance en les autres, fait souvent partie des personnes les plus pauvres. Nous l'avons constaté. Ces personnes ne se rendent pas suffisamment chez le dentiste. Elles sont issues de milieux socioculturels défavorisés. Ce sont ces personnes-là qui seront pénalisées, parce qu'elles ne se rendent pas chez le dentiste.
Que faut-il faire? En tout cas, prendre des mesures de pro-action vis-à-vis de ces personnes. Il faut jouer un rôle proactif et adopter des comportements qui "iront les chercher". Il faut pouvoir mieux les informer et faire en sorte qu'elles se sentent en confiance pour rendre visite au dentiste. Il ne faut, certes, pas les pénaliser ni renforcer l'image qu'elles se font du prix des soins dentaires: ils coûtent cher. Ils coûtent cher d'une manière générale, mais ces personnes bénéficient de tarifs parfois adaptés à leurs revenus. Elles sont pourtant persuadées que ces soins coûtent trop cher et grâce à votre projet, nous renforçons encore cette idée.
