                    Chers collègues, s'il est un domaine délicat et sensible, c'est bien celui de la fin de vie. Les décisions à prendre sont toujours difficiles, pour le patient, pour ses proches, mais aussi pour les professionnels de la santé qu'ils côtoient. En 2002, le législateur a apporté une réponse fondamentale à cette question de la fin de vie, en permettant à chaque patient, lorsque la douleur devient insupportable, lorsque l'espoir de guérison disparaît et que la dignité de la personne n'est plus garantie, de pouvoir dignement se poser les questions relatives à sa fin de vie, et de pouvoir être soutenu par des professionnels compétents qui, le moment venu, répondront à ses attentes.

Cet équilibre législatif repose aujourd'hui sur trois lois essentielles: celle relative aux soins palliatifs, celle relative à l'euthanasie et celle relative aux droits du patient. Mon groupe a toujours été ardemment présent pour préserver cet équilibre indispensable. Aujourd'hui, le texte qui est soumis à notre assemblée, et que nous avons cosigné, entend élargir la définition actuelle des soins palliatifs. Selon nous, ce texte doit cependant être considéré comme un premier pas dans la bonne direction. En effet, la détermination des différents types de patients palliatifs et de leurs besoins est une étape essentielle qu'il nous faudra franchir. Malheureusement, aujourd'hui, nous ne savons toujours pas si le gouvernement est prêt à dégager un budget spécifique dans ce cadre, mais nous soutiendrons évidemment ce texte.

Je dirai un mot également de la proposition de résolution relative à la légalité du transport et du stockage des médicaments à usage palliatif. Tout en reconnaissant la nécessité de trouver une solution à cette problématique, il était pour mon groupe indispensable que le cadre fixé permette à l'ensemble des parties de trouver une réponse adéquate et non contraignante, afin de tenir compte des besoins spécifiques et des disparités régionales, et cela dans le respect de la responsabilisation de l'ensemble des intervenants de la chaîne de soins.

Dear colleagues, if it is a delicate and sensitive area, it is the end of life. Decisions to be made are always difficult, for the patient, for his or her loved ones, but also for the healthcare professionals they meet. In 2002, the legislator provided a fundamental answer to this question of the end of life, by allowing every patient, when the pain becomes unbearable, when the hope of healing disappears and the dignity of the person is no longer guaranteed, to be able to dignifiedly ask questions concerning his end of life, and to be able to be supported by competent professionals who, when the time comes, will meet his expectations.

This legislative balance is now based on three key laws: the one on palliative care, the one on euthanasia and the one on patient rights. My group has always been fiercely present to preserve this indispensable balance. Today, the text that is submitted to our assembly, and which we have co-signed, aims to expand the current definition of palliative care. In our view, however, this text should be seen as a first step in the right direction. Indeed, determining the different types of palliative patients and their needs is an essential step that we will have to go through. Unfortunately, today, we still do not know whether the government is willing to issue a specific budget in this framework, but we will obviously support this text.

I will also say a word about the proposal for a resolution on the legality of the transport and storage of medicinal products for palliative use. While acknowledging the need to find a solution to this problem, it was indispensable for my group that the established framework enables all parties to find an adequate and non-binding response, in order to take into account specific needs and regional disparities, and this in respect of the accountability of all stakeholders in the care chain.

                    La résolution qui nous est soumise aujourd'hui semble partir d'un cadre prédéfini en faisant directement référence à un projet pilote en cours dans le réseau de soins palliatifs Westhoek-Ostende. Comme nous l'avons déjà dit en commission, nous déplorons que le texte de consensus proposé par la Federatie Palliatieve Zorg Vlaanderen, la Fédération bruxelloise pluraliste de Soins palliatifs et continus, la Fédération wallonne des Soins palliatifs, le Vlaams Apothekers Netwerk, l'Association des Unions de Pharmaciens, l'Algemene Pharmaceutisch Bond et l'Association pharmaceutique belge, c'est-à-dire tous les acteurs francophones et néerlandophones directement concernés, n'ait pas été pris pleinement en considération. Comme l'a dit Winston Churchill: "Il n'y a aucun mal à changer d'avis pourvu que ce soit dans le bon sens". Si ce n'est pas le cas, nous ne soutiendrons pas ce texte.

                    Mijnheer de voorzitter, mevrouw de minister, collega’s, de plenaire vergadering zal zo dadelijk overgaan tot de stemming van een wetsvoorstel dat tot doel heeft de definitie van palliatieve zorg te verruimen.

De centrale doelstelling van het wetsvoorstel is mensen tijdens de laatste fase van hun leven en op elke manier die zij verlangen, een zo maximaal mogelijke levenskwaliteit te bieden. De huidige wet inzake palliatieve zorg dateert van 2002. De voorbije jaren klonk de roep steeds luider om tot de algemeen gangbare benadering van palliatieve zorg over te gaan op basis van diverse studies van het KCE, de federale evaluatiecel Palliatieve Zorg en ook onlangs nog de FLIECE-studies. Ook de verschillende Federaties Palliatieve Zorg vroegen met hun suggesties rekening te houden. Het wetsvoorstel neemt de geformuleerde verzuchtingen ter harte om palliatieve zorg te verbreden en te verdiepen, met als doel beter voor mensen te kunnen zorgen op het moment dat zij het meest kwetsbaar zijn en ook om de definitie en de principes internationaal op de definitie en principes van de Wereldgezondheidsorganisatie af te stemmen.

Collega’s, inzake de verbreding van de palliatieve zorg maken wij palliatieve zorg toegankelijk voor elkeen die zich in een vergevorderd of terminaal stadium van een ongeneeslijke ziekte bevindt, ongeacht de levensverwachting.

Wij doorbreken daarbij de misvatting dat palliatieve zorg zich exclusief op kankerpatiënten tijdens de terminale fase van hun ziekte richt. Wij doen dat door de zorgnoden en niet de levensverwachting van de hulpvrager als leidraad te nemen.

Die levenskwaliteit willen wij via drie speerpunten zo hoog mogelijk krijgen: ten eerste, via vroegtijdige zorgplanning als aanzet tot palliatieve zorg; ten tweede, via het terugdringen van therapeutische hardnekkigheid met nutteloze behandelingen en, ten derde, via een palliatieve zorg die in functie staat van de zorgnoden en de behoeften van de hulpvrager.

Mr. Speaker, Mrs. Minister, colleagues, the plenary session will then immediately proceed to the vote of a bill aimed at extending the definition of palliative care.

The central goal of the bill is to provide people with the highest possible quality of life during the final phase of their lives and in any way they wish. The current law on palliative care dates from 2002. Over the past few years, the call for a general approach to palliative care has grown increasingly, based on various studies from the KCE, the federal assessment cell Palliative Care and also recently the FLIECE studies. The various Federations of Palliative Care also asked to take their suggestions into account. The bill takes the formulated aspirations to broaden and deepen palliative care, with the aim of better taking care of people at the time they are most vulnerable, and also to align the definition and principles internationally with the definition and principles of the World Health Organization.

On the expansion of palliative care, we make palliative care accessible to anyone who is in an advanced or terminal stage of an incurable disease, regardless of life expectancy.

We break the misconception that palliative care is exclusively aimed at cancer patients during the terminal phase of their disease. We do this by taking the care needs and not the life expectancy of the aid-seeking as a guide.

We want to ⁇  that quality of life as high as possible through three priorities: first, through early care planning as an incentive to palliative care; second, through reducing therapeutic persistence with useless treatments and, third, through palliative care that is in line with the care needs and the needs of the aid seekers.

                    Die drie speerpunten, in combinatie met het loslaten van de levensverwachting van de hulpvrager als criterium, hebben drie belangrijke gevolgen.

Ten eerste, wordt er veel sneller overgestapt van cure naar care. Onze laatste weken spenderen wij veel te vaak gekluisterd aan machines, onderworpen aan pijnlijke ingrepen om ons leven toch nog een beetje te rekken. Als iemand weet dat hij gaat sterven, wil hij dan niet de laatste dagen zo comfortabel mogelijk thuis doorbrengen? Belgisch onderzoek toont aan dat, als men de zorgnood van palliatieve patiënten als centraal criterium neemt, 19 % van alle patiënten in ziekenhuizen palliatieve zorg nodig heeft, maar die vandaag niet krijgt.

Een tweede effect is dat het financieel draaglijker wordt voor de patiënt. Het palliatief forfait wordt toegankelijker voor mensen die het nodig hebben. Uit cijfers opgevraagd bij minister De Block bleek dat in 2015 55 % van de aanvragers van een palliatief forfait overlijdt binnen 60 dagen na hun eerste aanvraag. Anders gezegd, 55 % van de aanvragers kan geen gebruikmaken van de ondersteuning waarvan zij aangeven dat zij ze nodig hebben.

Een derde verwacht effect waarop academici en medici inzetten, is dat de uitbreiding van de palliatieve zorg een daling van de kosten in de gezondheidszorg met zich meebrengt. Een studie van het KCE stelde in 2009 reeds dat de gemiddelde dagelijkse kosten tijdens de laatste 30 levensdagen van patiënten die overlijden op afdelingen geriatrie, cardiologie en oncologie lager zijn als in hun dossier vermeld staat dat zij palliatieve zorg krijgen.

Kort samengevat, wij maken een humane keuze voor betere zorg, die als positief neveneffect een vermindering van de kosten van het RIZIV met zich brengt.

Those three spearheads, combined with releasing the life expectancy of the aid applicant as a criterion, have three important consequences.

First, there is a much faster transition from cure to care. Our last few weeks we spend too often clinging to machines, subjected to painful interventions in order to stretch our lives a little more. If someone knows he is about to die, does he not want to spend the last days at home as comfortably as possible? Belgian research shows that, if one takes the need for care of palliative patients as the central criterion, 19% of all patients in hospitals need palliative care, but today do not receive it.

The second effect is that it becomes financially more sustainable for the patient. The palliative package becomes more accessible to those who need it. According to figures requested by Minister De Block, in 2015 55% of applicants for a palliative package died within 60 days of their first application. In other words, 55% of applicants are unable to take advantage of the support they declare they need.

A third expected effect for academics and doctors is that the expansion of palliative care leads to a decrease in healthcare costs. A study by the KCE found in 2009 that the average daily costs during the last 30 days of life of patients who die in departments of geriatrics, cardiology and oncology are lower if their records indicate that they are receiving palliative care.

In short, we make a humane choice for better care, which as a positive side effect implies a reduction in the costs of the RIZIV.

                    Naast de verbreding gaan wij ook voor een verdieping van de levenseindezorg. Palliatieve zorg heeft tot op heden nogal een bijklank dat zij dient voor de terminale fase en voor het lenigen van fysiek lijden. Daarmee bleven andere reële vormen van lijden tot dusver onbelicht. Het gaat hierbij om spiritueel en existentieel lijden en vragen rond identiteit en zingeving. Concreet, wat gaat er gebeuren met mijn naasten? Heb ik mijn kinderen alles kunnen zeggen wat ik hen wou meegeven? Is mijn leven met andere woorden op bevredigende wijze voltooid in al zijn facetten en heb ik daar vrede mee?

Ik stel met grote voldoening vast dat oppositie en meerderheid elkaar gevonden hebben rond de definitie en dat de debatten zeer sereen zijn verlopen. Ze zijn geëvolueerd naar een goede gemeenschappelijke tekst. Een dergelijke voldragen wet verdient een snelle uitvoering. Zowel voor de identificatie van de zieke als zijnde palliatief als voor het inschatten van de zorgwensen dienen wetenschappelijke instrumenten te worden aangewend en vastgelegd bij KB. De minister heeft met de Palliative Care Indicators Tool (PCIT) een goed instrument ontwikkeld. We roepen haar op om dit snel om te zetten in een KB, met ook het advies van de federale cel Palliatieve Zorg. Patiënten kunnen hierbij progressief in functie van hun zorgnoden zowel een officieel statuut krijgen als de adequate zorg waarom zij verzoeken.

Collega’s, deze wet zet nieuwe bakens uit om mensen in hun moeilijkste momenten bij te staan. Ik ben ervan overtuigd dat deze wet een mentaliteitomslag kan teweegbrengen in de gezondheidszorg van cure naar care, dit op tijdige basis, en van overbehandeling naar zorg. De patiënt zal er wel bij varen.

In addition to the expansion, we are also seeking to deepen life care. To date, palliative care has been used to serve as an adjective to the terminal phase and to relieve physical suffering. Thus far, other real forms of suffering have remained unexplained. These are spiritual and existential suffering and questions about identity and meaning. Specifically, what will happen to my neighbors? Can I tell my children everything I want to tell them? In other words, is my life satisfactorily completed in all its facets, and am I at peace with it?

I note with great satisfaction that the opposition and the majority have met each other around the definition and that the debates have been very serene. They have evolved into a good common text. Such a law deserves prompt implementation. Both for the identification of the sick as being palliative and for the assessment of the needs of care, scientific instruments should be used and recorded with KB. The Minister has developed a good tool with the Palliative Care Indicators Tool (PCIT). We urge her to quickly convert this into a KB, with the advice of the Federal Paliative Care Cell. In this way, patients can progressively obtain both an official status and the adequate care they are requesting according to their care needs.

Colleagues, this law opens new beacons to assist people in their most difficult times. I am convinced that this law can bring about a mental shift in healthcare from cure to care, on a timely basis, and from overtreatment to care. The patient will go with it.

                    Mijnheer de voorzitter, collega’s, reeds tijdens de vorige legislatuur pleitte het kenniscentrum in zijn rapport van 2009 voor een verruiming van de definitie van de palliatieve patiënt. Het pleitte voor palliatieve zorg wanneer de patiënt zich in een vergevorderde fase van een ernstige, progressieve en levensbedreigende ziekte bevindt, ongeacht de levensverwachting. Meer specifiek wees het kenniscentrum op de noodzaak om een ruimere groep van patiënten als palliatief te kunnen identificeren, ruimer dan de vaak oncologische patiënten die vandaag onder de noemer van palliatieve patiënt vallen.

Het evaluatierapport “Palliatieve Zorg 2014” onderschreef die doelstelling en verwees zeer specifiek naar de dementerenden als een groep die bijzondere aandacht verdient. Het voorstel van collega Els Van Hoof gaat in op die verzuchting. De nieuwe definitie voorziet in een ruimere definitie van palliatieve patiënten en zorgt er ook voor dat ze vroeger een beroep kunnen doen op palliatieve zorg. Enkele weken geleden bleek uit de evaluatie van de PCIT ook heel duidelijk dat er al een instrument bestaat om die ruimere doelgroep op een vroeger tijdstip te kunnen identificeren als palliatief patiënt.

Samen met de minister stelden we vast dat er nog wat bijsturingen moeten gebeuren voor kinderen en voor de groep van patiënten die niet als palliatief worden gedetecteerd maar wel overlijden binnen het jaar. Eens het advies van de federale evaluatiecel Palliatieve Zorg met betrekking tot de statuten en de rechten die daaraan moeten worden verbonden, klaar is, zal de minister onderhavige wettekst kunnen uitvoeren en de verschillende palliatieve statuten introduceren, die zullen toelaten de palliatieve zorg gradueel op te bouwen, naarmate de zorgnood toeneemt.

Kortom, er is een zeer goede samenwerking tot stand gekomen tussen het Parlement, dat de wetgeving heeft aangepast, en de minister, die tegelijkertijd reeds de nodige voorbereidingen heeft getroffen om snel uitvoering te kunnen geven aan de wetsbepalingen.

Tegelijkertijd met het wetsvoorstel werd ook mijn voorstel van resolutie goedgekeurd. Met het voorstel van resolutie buigen we ons over het probleem van de beschikbaarheid van palliatieve geneesmiddelen voor palliatieve patiënten die thuis worden verzorgd.

Mr. Speaker, colleagues, already during the previous legislature, the Knowledge Centre in its 2009 report called for a broader definition of the palliative patient. It advocated palliative care when the patient is in an advanced stage of a serious, progressive and life-threatening disease, regardless of life expectancy. More specifically, the Knowledge Centre pointed out the need to identify a wider group of patients as palliative, wider than the often oncological patients that today fall under the denominator of palliative patient.

The evaluation report “Palliative Care 2014” endorsed this goal and referred very specifically to the dementia as a group that deserves special attention. The proposal of colleague Els Van Hoof addresses this suspicion. The new definition provides for a broader definition of palliative patients and also allows them to resort to palliative care earlier. A few weeks ago, the evaluation of the PCIT also showed very clearly that there is already an instrument to identify that wider target group as a palliative patient at an earlier time.

Together with the Minister, we determined that there should be some additional adjustments for children and for the group of patients who are not detected as palliative but die within the year. Once the opinion of the Federal Assessment Cell Palliative Care regarding the statutes and the rights to be attached to them is completed, the Minister will be able to implement this legislation and introduce the various palliative statutes, which will allow the palliative care to gradually build up as the need for care increases.

In short, a very good cooperation has been established between the Parliament, which has amended the legislation, and the Minister, who at the same time has already made the necessary preparations to be able to quickly implement the legislative provisions.

At the same time as the bill, my motion of resolution was also approved. With the proposal for a resolution, we address the problem of the availability of palliative medicines for palliative patients receiving home care.

                    De ervaring van de palliatieve netwerken leert ons dat er soms in urgente situaties onmiddellijk palliatieve geneesmiddelen moeten kunnen worden toegediend aan de patiënt. Vandaag moet de familie of de verpleegkundige die geneesmiddelen nog gaan halen bij de apotheek of de apotheek van wacht, die dan vaak niet over de benodigde hoeveelheden beschikt. Uit een masterproef van 2012 was gebleken dat de wachtkoffers met palliatieve geneesmiddelen bij de apotheken nog slechts in vier van de twaalf netwerken in gebruik waren. Netwerken ontwikkelden dan eigen alternatieven. Een daarvan is dat de verpleegkundige van de multidisciplinaire begeleidingequipes overschotten van palliatieve patiënten die ondertussen overleden zijn, bijhouden en ze gebruiken om de noden te lenigen van andere palliatieve patiënten. Dat is onwettig. Ook het rondrijden met die geneesmiddelen mag niet volgens onze wetgeving.

Met het voorstel van resolutie vragen wij de minister een oplossing uit te werken om, enerzijds, de palliatieve patiënt die thuis wordt verzorgd eenzelfde kwalitatieve palliatieve zorg te kunnen bieden als de palliatieve patiënt in het rustoord of ziekenhuis en, anderzijds, de verpleegkundigen wettelijk te beschermen. Ten slotte is ook de ontwikkeling van een veiligheidssysteem gewenst voor de bescherming van de maatschappij. Palliatieve geneesmiddelen zijn immers niet onschuldig.

Het voorstel vraagt de minister twee sporen te volgen.

Enerzijds, vragen wij de minister om een lijst van palliatieve geneesmiddelen vast te stellen die de apotheken in voldoende hoeveelheden in huis moeten hebben. Op die manier wordt het mogelijk voor de familie en voor de verpleegkundigen van de multidisciplinaire begeleidingequipes om maximaal de betreffende geneesmiddelen te verkrijgen bij de huisapotheker.

Anderzijds, vragen wij de minister om een wettelijke regeling uit te werken waarbij verpleegkundigen in het bezit mogen zijn van palliatieve geneesmiddelen en die vervoeren, zodat in urgente gevallen de verpleegkundigen steeds in staat zijn na het order van een geneesheer, onmiddellijk de nood van de palliatieve patiënt te lenigen. Dat moet de kwaliteit van de zorg voor de palliatieve patiënt verbeteren evenals de rechtspositie van de verpleegkundige.

Tegelijkertijd vragen wij de minister een veiligheidssysteem op te zetten, zodat de overheid steeds kan nagaan wie bij welke patiënt hoeveel van welk palliatief geneesmiddel heeft toegediend en wat is gebeurd met de overschotten.

The experience of palliative networks teaches us that sometimes in urgent situations palliative medicines need to be given immediately to the patient. Today, the family or nurse who is still taking medicines must wait at the pharmacy or pharmacy, which often does not have the necessary amounts. A master trial in 2012 found that the waiting bags for palliative medicines in the pharmacies were only in use in four of the twelve networks. The companies developed their own alternatives. One is that the nurse of the multidisciplinary supervisory teams tracks surpluses of palliative patients who have died in the meantime and uses them to cater for the needs of other palliative patients. That is illegal. The use of these medicines is not permitted according to our legislation.

With the proposal for a resolution, we call on the Minister to work out a solution to ensure that, on the one hand, the palliative patient receiving care at home can receive the same quality palliative care as the palliative patient in the resting room or hospital and, on the other hand, that nurses are legally protected. Finally, the development of a safety system is also desirable for the protection of society. Palliative medicines are not innocent.

The proposal asks the Minister to follow two paths.

On the one hand, we ask the Minister to establish a list of palliative medicines that pharmacies should have at home in sufficient quantities. This makes it possible for the family and the nurses of the multidisciplinary supervisory teams to obtain as much as possible the relevant medicines from the home pharmacist.

On the other hand, we ask the Minister to draw up a legal regulation allowing nurses to possess and transport palliative medicines, so that in urgent cases nurses will always be able, upon the order of a physician, to immediately borrow the need of the palliative patient. This should improve the quality of care for the palliative patient as well as the legal status of the nurse.

At the same time, we ask the Minister to set up a safety system, so that the government can always check who to which patient has administered how much of which palliative medicine and what happened to the surpluses.

                    Dat is een kwaliteitselement van goede zorg. De minister kan hierbij zeker inspiratie opdoen bij het proefproject dat vandaag loopt in het netwerk palliatieve zorg Westhoek-Oostende, dat gebeurt in samenwerking met de Federatie Palliatieve Zorgen Vlaanderen en het Vlaams apothekersnetwerk.

De minister zal zeker bij de uitwerking ook rekening houden met de randvoorwaarden zoals geformuleerd in het gezamenlijke standpunt van de palliatieve netwerken en de apothekersnetwerken. Op die manier kunnen we komen tot een regeling die haalbaar is in elke Gemeenschap, rekening houdt met de bevoegdheidsverdeling en de specifieke eigenschappen van elke Gemeenschap en, belangrijk, die ook werkbaar is in de praktijk. Ik wil onderstrepen dat in beide pistes voor ons de rol van de apotheker, de gezondheidswerker met expertise op het vlak van geneesmiddelen, belangrijk is.

Het dossier heeft mij ook geleerd dat palliatieve zorg anders wordt benaderd in de verschillende Gemeenschappen en Gewesten. Het voorstel van resolutie met zijn twee sporen is dan ook het resultaat van een gezamenlijk gedragen voorstel door de drie federaties Palliatieve Zorg en de verschillende apothekersnetwerken in ons land. Terecht hebben ook zij het belang onderstreept van een goede communicatie tussen de verschillende actoren: de arts, de multidisciplinaire begeleidingsequipe en de apotheker. Een goede communicatie kan ervoor zorgen dat heel wat problemen worden opgevangen.

This is a quality element of good care. The Minister is sure to be inspired by the pilot project that is underway today in the Westhoek-Oostende palliative care network, which takes place in cooperation with the Flemish Federation of Palliative Care and the Flemish Pharmacist Network.

The Minister will ⁇  also take into account the framework conditions as formulated in the joint position of the palliative networks and the pharmacy networks. In this way, we can come to an arrangement that is feasible in every Community, that takes into account the division of powers and the specific characteristics of each Community and, importantly, that is also feasible in practice. I would like to emphasize that in both tracks the role of the pharmacist, the healthcare professional with expertise in the field of medicines, is important for us.

The dossier also taught me that palliative care is approached differently in different communities and regions. The proposal for a resolution with its two tracks is therefore the result of a proposal jointly carried out by the three federations of Palliative Care and the various pharmacy networks in our country. They also rightly emphasized the importance of good communication between the various actors: the doctor, the multidisciplinary counselling team and the pharmacist. Good communication can solve a lot of problems.

                    Madame la ministre, chers collègues, tout d'abord, j'aborderai la proposition de loi de notre collègue Els Van Hoof concernant la modification de la définition des soins palliatifs. Ce texte, qui a recueilli une large adhésion au sein de notre commission, vise à élargir cette définition afin que ces soins soient mieux intégrés dans les soins de santé. On rencontre ainsi les définitions établies au niveau international, en particulier par l'OMS.

La proposition constitue un signal important vers la population, les patients et les prestataires de soins. En se focalisant sur l'accompagnement de la fin de vie, l'ancienne définition n'était plus adaptée à la philosophie actuelle des soins palliatifs. En effet, au quotidien, les acteurs nous rapportaient que cette conception était réductrice. Chaque patient a, quelle que soit son espérance de vie, le droit de bénéficier des soins palliatifs lorsqu'il se trouve au stade avancé ou terminal d'une grave maladie évolutive qui met en péril son pronostic vital.

Cette modification de la définition impliquera évidemment une nouvelle identification des patients pouvant bénéficier d'une approche palliative. Celle-ci devra se faire dans un deuxième temps. La ministre de la Santé publique s'est engagée à trouver une solution pragmatique en concertation avec la cellule d'évaluation fédérale des soins palliatifs. Cette solution pourra reposer sur le Palliative Care Indicators Tool, le PICT, instrument ayant démontré qu'il pouvait prendre en compte les patients dont le pronostic vital dépasse trois mois, indépendamment de la pathologie dont ils souffrent. Il vise aussi à allouer des ressources proportionnelles à la complexité des situations. Le PICT propose donc une méthode concrète. Il peut être le point de départ pour identifier les patients palliatifs et leurs besoins.

Permettez-moi de dire un mot sur la proposition de résolution relative à la légalité du stockage et du transport des médicaments pour l'usage palliatif.

First of all, I will address the bill of our colleague Els Van Hoof concerning the amendment of the definition of palliative care. This text, which has gained widespread support within our committee, aims to broaden this definition so that this care is better integrated into health care. These are defined internationally, ⁇  by the WHO.

The proposal is an important signal to the public, patients and healthcare providers. By focusing on accompanying the end of life, the old definition was no longer suited to the current philosophy of palliative care. In fact, every day, the actors ⁇  to us that this design was reductive. Every patient, regardless of life expectancy, has the right to receive palliative care when he or she is at an advanced or terminal stage of a serious progressive illness that threatens life prognosis.

This change in the definition will obviously involve a new identification of patients who can benefit from a palliative approach. This must be done in a second time. The Minister of Public Health has pledged to find a pragmatic solution in consultation with the Federal Assessment Cell for Palliative Care. This solution will be able to rely on the Palliative Care Indicators Tool, the PICT, which has demonstrated that it can take into account patients whose life prognosis exceeds three months, regardless of the pathology they suffer from. It also aims to allocate resources proportionate to the complexity of situations. Therefore, the PICT proposes a concrete method. It can be the starting point for identifying palliative patients and their needs.

Let me say a word on the proposal for a resolution on the legality of the storage and transport of medicines for palliative use.

                    Cette proposition vise à trouver une solution pour que les équipes de soins palliatifs puissent disposer de médicaments dans des kits d'urgence ou de sédation et de les transporter sous la supervision d'un pharmacien désigné à cet effet.

Parallèlement à nos travaux, une initiative avec les acteurs de terrain a vu le jour. L'Association pharmaceutique belge (APB) et le secteur pharmaceutique ainsi que les différentes fédérations de soins palliatifs, se sont mis d'accord sur un texte de consensus pour s'inscrire dans la recherche de cette solution en tenant compte des spécificités du terrain. Ce texte de consensus sera bien évidemment sans équivoque la base de la solution qui devra émerger.

Je mettrai en évidence les points suivants qui devront se retrouver dans la solution dégagée: une réponse non contraignante, une responsabilisation de l'ensemble des intervenants de la chaîne, la supervision d'un pharmacien détaché à cette fonction, la sécurisation des kits, la nécessaire évaluation du système.

Monsieur le président, madame la ministre, chers collègues, voilà les différentes remarques que nous souhaitions apporter au cours de ce débat. Je vous remercie.

In januari diende onze fractie een wetsvoorstel in met een definitie ter verruiming van het begrip palliatieve zorgen die is afgestemd op de Wereldgezondheidsorganisatie, de Europese en Belgische federaties Palliatieve Zorg. De meerderheid werd hier duidelijk door geïnspireerd en kwam dan ook, onder het goede initiatief van mevrouw Van Hoof, in april 2015 met een analoog wetsvoorstel.

Zoals mijn collega al heeft gezegd, heeft goede palliatieve zorg te maken met de kwaliteit van de zorg. Goede palliatieve zorg heeft ook aandacht voor de naasten, waaronder mantelzorgers. Het voorstel zal zeker therapeutische hardnekkigheid voorkomen en zeker geen meerkosten met zich brengen, integendeel.

In de commissie hebben wij goed samengewerkt rond dit onderwerp. Het zou er nog aan ontbreken, wanneer het over het einde van het leven gaat, of toch over een periode die dicht bij het einde van het leven staat. Meerderheid en oppositie mogen dan geen obstakels vormen. Wij hebben ook samen een aantal amendementen besproken, waarmee wij de formulering verfijnd hebben en onder andere – ik heb daarstraks al een pleidooi voor de mantelzorgers gehouden – de mantelzorgers in de definitie hebben opgenomen. Dat amendement werd door iedereen, over de partijgrenzen heen, ondertekend en goedgekeurd.

Wij zullen met onze fractie absoluut voor het voorstel goedkeuren, aangezien het helemaal strookt met het wetsvoorstel dat wij zelf hadden ingediend.

We have worked well together on this issue. It would still be missing, when it is about the end of life, or even about a period that is close to the end of life. Majority and opposition should not be obstacles. We have also discussed a number of amendments together, with which we have refined the wording and, among other things – I have since held a plea for the mantel caregivers – have included the mantel caregivers in the definition. That amendment was signed and approved by everyone, across party boundaries.

We will with our group absolutely approve the proposal, as it is fully consistent with the bill we had submitted ourselves.

                    Madame la ministre, chers collègues, j'aborderai ici deux textes différents. Le premier porte sur la définition du patient palliatif, où l'enjeu est, comme toujours en médecine, de partir des besoins spécifiques du patient et pas de la notion de fin de vie ou d'un aspect plus administratif. Pouvoir faire bénéficier un patient d'une prise en charge adaptée à ses besoins uniquement sur la base d'une règle qui fait référence à trois mois, ce qui était le cas jusqu'aujourd'hui, ce n'est pas ce qui est le plus adapté à la situation des patients.

Rappelons que l'initiative de ce texte date de la précédente législature. J'avais en effet déposé un texte qui reprenait exactement cette modification de définition. Je l'ai déposée à nouveau ici. Tant mieux si, ainsi, j'ai pu convaincre d'autres partis d'avancer en la matière afin que nous puissions enfin aboutir sur ce dossier. Je voudrais saluer le président de la Cellule d'évaluation des soins palliatifs et les fédérations régionales des soins palliatifs, qui ont plaidé dans le même sens. C'est à eux qu'il faut dédicacer ce travail qui a pu aboutir à ce type de texte.

Madame la ministre, il reste des étapes. La première, c'est de pouvoir transposer l'instrument d'identification du patient palliatif et surtout d'évaluation de la sévérité de ses besoins et de pouvoir convertir cette échelle du statut palliatif simple, majoré et complet puisque tout ce travail a été réalisé par le docteur Desmedt de l'UCL, avec les trois fédérations de soins palliatifs et la Cellule d'évaluation fédérale. La priorité pour demain est de pouvoir transposer cet outil qu'ils ont mis en place.

Une autre étape qui vous attend, madame la ministre, c'est de régler la question des moyens. Quand j'entends votre représentant en commission dire qu'il n'est pas possible de trouver des moyens budgétaires supplémentaires pour les soins palliatifs, cela m'interpelle à deux titres. Premièrement, je trouve que c'est vraiment méconnaître la réalité des équipes qui aujourd'hui acceptent toutes les demandes, alors même qu'elles ne sont plus financées en termes de forfait et qu'elles acceptent donc de prendre en charge des patients qui sont bien au-delà du quota pour lequel elles sont financées.

The first concerns the definition of the palliative patient, where the challenge is, as always in medicine, to start from the specific needs of the patient and not from the notion of end of life or a more administrative aspect. To be able to provide a patient with a care tailored to his needs only on the basis of a rule that refers to three months, as was the case until now, is not what is most suited to the patient’s situation.

The initiative of this text dates from the previous legislature. In fact, I had submitted a text that repeated exactly this change of definition. I put it here again. The first is to be able to transpose the instrument of identifying the palliative patient and above all of assessing the severity of his needs and to be able to convert this scale of the simple, increased and complete palliative status since all this work was carried out by Dr. Desmedt of the UCL, with the three federations of palliative care and the Federal Assessment Cell. Another step that awaits you, Mrs. Minister, is to resolve the issue of the means. First, I find that it is really ignoring the reality of the teams that today accept all requests, even though they are no longer funded in terms of package and that they therefore agree to take care of patients who are well beyond the quota for which they are funded.

                    La deuxième chose, il est aussi interpellant d'entendre votre représentant dire cela en votre nom en commission car, si ces patients ne sont pas pris en charge en soins palliatifs, c'est faire croire qu'ils le seront ailleurs. Où seront-ils alors pris en charge? Le plus souvent, c'est en hospitalisation. Or la prise en charge en hospitalisation, hors soins palliatifs, coûtera au moins aussi cher, si pas plus cher. Madame la ministre, l'argument utilisé par votre cabinet est donc particulièrement inapproprié.

Pour ce qui est de la légalité du stockage et du transport des médicaments pour l'usage palliatif, dans le fond, le titre ne révèle pas bien l'enjeu. Quel est-il? C'est de ne plus se retrouver dans une situation où il n'est pas possible d'administrer des soins palliatifs – je parle ici des médicaments – pour des raisons qui ne sont évidemment pas valables même si elles sont compréhensibles étant donné l'organisation actuelle. Il est important de rappeler ici – j'ose espérer que mes collègues sont dans le même état d'esprit – qu'il ne s'agit pas d'un défaut, en quoi que ce soit, des équipes. Celles-ci étant soumises à certaines lois, il n'était pas possible, jusqu'ici, de fonctionner autrement dans des conditions de sécurité optimale.

M. Gustin n'est plus là. Peu importe. Chers collègues du MR, bien avant qu'on se penche sur cette question, les acteurs de terrain, à savoir les fédérations de soins palliatifs et les représentants des pharmaciens, travaillaient en vue d'aboutir à un consensus. Chers collègues de la majorité, la manière dont vous avez procédé est interpellante. Vous êtes partis d'une expérience pilote, certes intéressante, en décidant de l'imposer de la même manière partout. Or il y a des pratiques différentes et, surtout, vous aviez explicitement été mis au courant que ces groupes de travail existaient au niveau des acteurs de terrain. Je pointe ici particulièrement le CD&V et le MR. En commission, vous avez été jusqu'à dire que vous n'étiez pas au courant que ce travail se réalisait. Même le cabinet l'a dit.

Dear colleagues of the MR, long before this issue was addressed, the field actors, namely palliative care federations and pharmacists, were working to reach a consensus. Dear colleagues, the way you have done this is challenging. You came from an interesting pilot experience, and decided to impose it the same way everywhere. But there are different practices and, most importantly, you were explicitly informed that these working groups existed at the level of the field actors. I would like to point out the CD&V. In the committee, you have been to say that you weren’t aware that this work was being carried out. Even the cabinet said it.

C'est dommage de toujours, en la matière, ne pas vouloir être à l'écoute et travailler, surtout, à partir des réalités du terrain en faisant du bottom-up. Vous êtes des fervents partisans en la matière de top-down. Ils sont arrivés à un texte de consensus et comme si ça ne suffisait pas, vous avez décidé que vous préfériez vous accrocher à votre texte de la transposition d'un projet pilote qu'on transpose de la même manière partout, plutôt que de suivre les acteurs de terrain, le consensus qui réunissait vraiment tous les partenaires, tous les acteurs impliqués sur l'ensemble de la Belgique.

Je ne peux en la matière que regretter et dénoncer – j'irai jusque-là – que la majorité ne soit pas à l'écoute des acteurs de terrain, de cette position de consensus.

Bien sûr aujourd'hui, dans l'expression, tout à coup, on voit bien que vous êtes gêné aux entournures. Vous essayez de nous faire croire que votre texte représente la même chose, et qu'il sera appliqué sur base du consensus du terrain. La réalité est tout autre. Le texte que vous faites voter ici vous permettra de faire clairement un travail et une approche basés sur cette expérience pilote, et en même temps sans tenir compte de la diversité des réalités de terrain. Je le regrette, c'est vraiment dommage et c'est un manque de respect flagrant par rapport aux acteurs de terrain.

Je terminerai, monsieur le président, en redonnant un cap, pas nécessairement ciblé sur les soins palliatifs parce que je pense que j'ai dit tout ce que j'avais à dire ici. Je rappelle, madame la ministre, la question des moyens. Les équipes sont vraiment surchargées aujourd'hui. Je veux rappeler qu'en la matière, ce qui devrait être votre priorité, votre cap, c'est d'avoir une politique concertée qui vise la qualité des soins apportés aux patients, la juste allocation des ressources et le respect des équipes. Sur le dossier concernant les kits, les médicaments palliatifs, vous avez cruellement manqué de respect vis-à-vis des équipes de terrain.

Raison pour laquelle, monsieur le président, nous voterons la proposition de loi sur la définition du patient palliatif puisque c'est exactement la même que celle que j'ai déposée sous la précédente législature et au début de cette législature; par contre, nous nous abstiendrons sur la résolution sur les kits et les médicaments palliatifs. Le signal que vous avez donné aux acteurs de terrain témoigne d'un manque de respect. Et je peux vous assurer que je serai extrêmement vigilante pour ne pas que vous appliquiez votre proposition unique et qu'au contraire, à l'avenir, madame la ministre, vous puissiez avoir une approche respectant cette position de consensus du terrain.

La priorité des priorités, ce sont les patients. La priorité des priorités, ce sont les acteurs qui s'y investissent et pas simplement un politique qui veut mettre une fleur à son chapeau. Je vous remercie.

On the case concerning kits, palliative drugs, you have cruelly lacked respect for field teams.

That is why, Mr. Speaker, we will vote on the bill on the definition of the palliative patient since it is exactly the same as the one I filed during the previous legislature and at the beginning of this legislature; on the other hand, we will abstain from the resolution on kits and palliative medicines. The signal you gave to the field actors indicates a lack of respect. And I can assure you that I will be extremely vigilant so that you do not apply your unique proposal and that on the contrary, in the future, Mrs. Minister, you can have an approach that respects this ground consensus position.

Our priority is patients. The priority of the priorities is the actors who invest in it and not just a politician who wants to put a flower in his hat. I thank you.

                    Monsieur le président, madame la ministre, chers collègues, comme mes collègues, je tiens à faire référence – c'est important – aux travaux qui ont été effectués à l'occasion de l'examen des projets de loi de 2002 (droits des patients, soins palliatifs, euthanasie, et affirmation du droit des patients à refuser des traitements et d'interdire l'acharnement thérapeutique).

Nous nous inscrivons dans cette prolongation et la combinaison de préoccupations visant à permettre à chacun de bénéficier des soins dont il a besoin de la manière la plus adaptée. Lorsqu'on sait qu'un patient est atteint d'une maladie que l'on sait incurable, et qu'à un moment donné, on abandonne les soins curatifs pour passer à des soins qui permettront d'accompagner le malade de façon à ce qu'il souffre le moins possible, à ce qu'il puisse bénéficier de la meilleure qualité de vie possible en essayant de lui permettre de garder un maximum d'autonomie, nous savions qu'il fallait impérativement modifier la loi relative au statut du patient palliatif puisque cette dernière faisait référence à une durée de vie estimée de trois mois renouvelable une fois.

Avec ma collègue Anne Dedry, nous avons déposé, en octobre 2014, une résolution et, en janvier 2015, une proposition de loi, à l'issue de toute une série de rencontres. Je tiens d'ailleurs ici à me joindre aux remerciements adressés aux fédérations flamande, bruxelloise et francophone, mais aussi à toute une série d'acteurs, dont les médecins généralistes, les maisons médicales qui se sont associés à nos réflexions pour essayer de déterminer une définition la plus adéquate possible pour rencontrer les différents besoins et permettre l'accompagnement de la personne à partir du constat de sa maladie incurable jusqu'à sa fin de vie, tout en préservant son droit à refuser, à un moment donné, tout traitement, mais aussi en respectant son choix de demander l'euthanasie.

Lorsque nous avons présenté ces deux textes en commission de la Santé, les membres de ladite commission n'ont pas manqué de se mobiliser. Des auditions ont été organisées et les membres de la majorité ont déposé un texte, auquel nous avons apporté notre soutien, puisque l'important était d'aboutir à une solution et non de revendiquer les droits de maternité ou de paternité du texte en question.

C'est la dynamique parlementaire majorité-opposition qui est toujours omniprésente sur ces sujets.

Un élément manque dans le texte que nous avons adopté et devra être affiné d'ici la fin de l'année. La cellule d'évaluation va poursuivre ses travaux et évaluer l'impact budgétaire d'une amélioration que nous avions incluse dans nos textes, Mme Dedry et moi-même, sur ces trois stades de soins palliatifs avec des natures et des intensités différentes, grâce à cette nouvelle échelle d'évaluation des besoins qui est en cours de finalisation. Dans les mois qui viennent, il sera important, sur la base de cette évaluation, de se doter d'un complément des dispositifs existants pour pouvoir être encore plus fin dans le suivi des patients.

J'en viens à la résolution relative au stockage et au transport des médicaments. Je dois vous faire part de mon étonnement, non pas sur la nécessité de veiller à prendre des dispositions mais de permettre, lorsque les équipes pluridisciplinaires de soins palliatifs l'estiment nécessaire, le transport par une personne qui n'est pas un pharmacien et qui ne se trouve pas dans l'illégalité. Cette personne pourra avoir ce kit de transport à sa disposition puisqu'on a trop souvent constaté un manque de disponibilité de ces médicaments dans les pharmacies.

Lors des discussions sur cette résolution, il est apparu que les parlementaires qui en étaient signataires ne semblaient pas être au courant que la problématique était perçue différemment en Flandre, à Bruxelles et en Wallonie et que les solutions à amener étaient également envisagées d'une tout autre manière. Je peux admettre que des parlementaires n'étaient pas au courant.

We join in this extension and the combination of concerns aimed at enabling everyone to benefit from the care they need in the most appropriate way. When we know that a patient has a disease that is known to be incurable, and that at some point, we abandon curative care to move to care that will allow to accompany the sick so that he suffers as little as possible, so that he can enjoy the best quality of life possible by trying to allow him to keep the maximum of autonomy, we knew that it was imperative to change the law on the status of the palliative patient since the latter referred to an estimated life span of three months renewable once.

Together with my colleague Anne Dedry, we submitted, in October 2014, a resolution and, in January 2015, a bill, following a series of meetings. I would like to join the thanks addressed to the Flemish, Brussels and French-speaking federations, but also to a whole series of actors, including general physicians, the medical houses who have associated with our reflections to try to determine the most appropriate definition possible to meet the different needs and allow the accompaniment of the person from the finding of his incurable disease until the end of his life, while preserving his right to refuse, at a given moment, any treatment, but also respecting his choice to request euthanasia.

When we presented these two texts in the Health Committee, the members of the said committee did not fail to mobilize. Hearing was held and members of the majority submitted a text, which we supported, since the important thing was to reach a solution and not to claim the maternity or paternity rights of the text in question.

It is the parliamentary majority-opposition dynamics that is always ubiquitous on these topics.

One element is missing in the text we have adopted and will need to be refined by the end of the year. The evaluation cell will continue its work and evaluate the budget impact of an improvement that we had included in our texts, Mrs. Dedry and myself, on these three stages of palliative care with different nature and intensity, thanks to this new needs assessment scale that is under completion. In the coming months, it will be important, on the basis of this evaluation, to supplement existing devices in order to be even more finely in the follow-up of patients.

I come to the resolution on the storage and transport of medicines. I must express my amazement, not about the need to make arrangements, but to allow, when the multidisciplinary teams of palliative care consider it necessary, transportation by a person who is not a pharmacist and who is not in the illicit. This person will be able to have this transport kit at their disposal because too often there has been a lack of availability of these medicines in pharmacies.

During discussions on this resolution, it appeared that parliamentarians who signed it did not seem to be aware that the problem was perceived differently in Flanders, Brussels and Wallonia and that the solutions to be brought were also considered in a completely different way. I can admit that some members were not aware of it.

Elle ne nous a pas non plus dit être au courant qu'un travail se faisait avec l'ensemble des fédérations et des associations de pharmaciens, pour venir avec une proposition collective.

C'est parce que vous avez accepté, à la demande de l'opposition, qu'il y ait une sollicitation d'avis et qu'on a reçu cet avis cosigné par l'ensemble des fédérations et des pharmaciens, que vous avez introduit des amendements à votre résolution. Tant mieux!

Ces amendements ne sont, à mon avis, pas suffisants. C'est pour cela que nous avons cosigné un amendement que nous redéposons ici pour encore ajouter des éléments qui, de manière très claire, ne préconisent pas seulement une concertation avec les fédérations. En effet, cette concertation a eu lieu puisqu'elles ont remis un avis commun.

Notre amendement  stipule en outre dans la proposition de résolution qu'il est important de tenir compte des besoins et de solutions différenciées selon les Régions et qu'il est important qu'au-delà d'inscrire dans la légalité le transport d'un médicament, via une équipe de soins palliatifs, il fallait également prévoir la possibilité que les pharmacies soient organisées autrement dans le stockage des médicaments, pour que ceux-ci soient, de manière optimale, à disposition des équipes et ce, avec une communication des besoins et de l'identification des patients entre les équipes, les médecins traitants et les pharmaciens.

Vous avez fait semblant, vous n'avez pas voulu dans un premier temps imaginer qu'une autre approche était possible, et surtout, une approche commune à tous les acteurs.

Par ailleurs, vous avez l'air de dire que vous êtes maintenant d'accord avec les acteurs de terrain. Si c'est le cas, je vous prends au mot. Je rappelle que j'ai déposé un amendement, cosigné par Mmes Muriel Gerkens et Véronique Caprasse, pour que la ministre puisse avancer sur base du consensus qui est intervenu entre les acteurs de terrain concernés. Ce consensus ne va pas vous mettre en difficulté en quoi que ce soit. Il ne va pas rendre la vie de la ministre impossible, la mettre dans une impossibilité pratique ou lui demander des moyens budgétaires complètement démesurés. Non!

                    En conclusion, madame Somers, chers collègues, nous avons bien travaillé sur la proposition de loi relative à la définition du statut du patient en soins palliatifs. Si nous avons réussi à bien travailler, c'est parce que nous avons autorisé et organisé des auditions, et parce que les structures qui organisent les plates-formes de soins palliatifs rassemblent les plates-formes de l'ensemble du territoire. Tout le monde s'est préoccupé du respect et du bien-être du patient. Comment améliorer ces soins palliatifs pour qu'ils correspondent aux besoins? Nous avons abouti à un texte, majorité et opposition.

Si nous avons un problème avec la résolution relative au transport des médicaments, c'est parce qu'à ce moment, le jeu parlementaire et la position des travaux du cabinet n'ont pas permis de tenir compte de ce rassemblement d'opinions et de ce travail collectif. Celui-ci était pourtant accompli par les acteurs de terrain. C'est cela que je reproche. C'est dommage, les gens se sont rassemblés pour essayer de trouver une solution qui convienne partout sur le territoire. Ils disaient qu'il y avait des spécificités, et qu'il fallait en tenir compte, mais que nous atteindrions le même objectif, le même respect des besoins des patients, la même rencontre des demandes et des besoins des professionnels. En suivant les dix orientations qu'ils proposaient, on rencontrait les objectifs poursuivis par la résolution, les spécificités et les besoins des patients.

Je n'interviens pas pour créer un problème communautaire supplémentaire, puisque les acteurs se mettent ensemble et vous proposent quelque chose. Mais voilà, l'orgueil du parlementaire fait parfois qu'on n'arrive pas à tenir compte du travail commun, alors qu'on charge ces acteurs de travailler ensemble, de nous donner des avis et de nous faire des recommandations. Quand le travail est fait, on se permet parfois de ne pas suffisamment en tenir compte.

Ceci dit, madame Somers, nous allons voter pour la proposition de loi, puisque, comme ma collègue Dedry l'a dit, il s'agit d'un copier-coller de la proposition de loi Ecolo-Groen et qu'elle satisfait les besoins. Nous allons voter pour l'amendement que nous avons toutes deux cosigné, parce qu'il tient compte des propositions des trois fédérations, des pharmaciens et des médecins généralistes.

Que cet amendement soit accepté ou non, nous soutiendrons également la résolution, uniquement pour permettre aux acteurs flamands de garantir aux personnes qui transportent un kit, c'est-à-dire des Flamands essentiellement, qu'elles ne seront pas dans l'illégalité. En espérant que le premier paragraphe de notre résolution, qui a été écrit en concertation avec les fédérations, tiendra compte de la proposition qu'ils ont faite. En considérant également que les questions parlementaires seront fréquentes, dans le but de vérifier que la diversité est bien présente dans les faits et dans les dispositions fournies aux plates-formes pour organiser, de manière spécifique et adaptée à chaque Région, la disponibilité des médicaments ainsi que leur transport et leur stockage.

Following the ten guidelines they proposed, the objectives pursued by the resolution, the specifics and needs of patients were met.

I am not intervening to create an additional community problem, as the actors come together and offer you something. But here, the pride of the parliamentary sometimes makes it impossible to take into account the joint work, while we charge these actors to work together, to give us opinions and to make us recommendations. When the work is done, we sometimes allow ourselves not to consider it sufficiently.

That being said, Mrs. Somers, we will vote for the bill, since, as my colleague Dedry said, it is a copy-paste of the Ecolo-Groen bill and it meets the needs. We will vote for the amendment that we both co-signed, because it takes into account the proposals of the three federations, pharmacists and general physicians.

Whether this amendment is accepted or not, we will also support the resolution, only to enable the Flemish actors to guarantee the people who carry a kit, i.e. essentially Flemish, that they will not be in illegality. Hoping that the first paragraph of our resolution, which was written in consultation with the federations, will take into account the proposal they have made. Considering also that parliamentary questions will be frequent, in order to verify that the diversity is well present in the facts and in the arrangements provided to the platforms to organize, in a specific and appropriate manner for each Region, the availability of medicines as well as their transport and storage.

                    Monsieur le président, je serai brève, car tout a déjà été dit.

Mon parti considère qu'il est temps d'étendre la définition des soins palliatifs remboursés par l'INAMI. Ces soins ne pouvaient pas continuer à se limiter à un simple accompagnement vers une fin de vie diagnostiquée inéluctable à brève échéance.

Il faut intégrer les soins palliatifs dans les soins de santé à un stade précoce; reconnaître l'importance des aspects psychiques, sociaux, spirituels et existentiels des patients dont le pronostic vital est engagé; ne plus se baser sur l'espérance de vie, mais bien sur les besoins propres à chaque patient; mieux tenir compte de sa douleur, de sa dignité et de ses préoccupations émotives. Ces démarches qui nécessitent une approche multidisciplinaire sont essentielles pour les quelque 10 000 à 20 000 patients qui, chaque jour dans notre pays, se trouvent à un stade avancé ou terminal d'une maladie grave ou évolutive, ainsi que pour leurs proches.

Nous nous réjouissons donc de l'unanimité qui a pu se dégager autour de cette proposition de loi à forte valeur ajoutée sur le plan humain. C'est avec une grande satisfaction que je voterai en faveur de ce texte. Mais, bien entendu, je reviens à tout ce qui a été dit par Mmes Fonck et Gerkens: il était essentiel d'écouter les différentes fédérations et les associations pharmaceutiques et de tenir compte de leurs avis, puisque ce sont des acteurs de terrain. Nous sommes leurs intermédiaires, mais nous n'avons pas tenu le bon rôle.

Je voudrais aussi ajouter une remarque à titre personnel. J'ai travaillé pendant plusieurs années dans une association de soins palliatifs à domicile. Pour revenir aux propos de Mme Fonck sur le plan financier, nous devons en effet produire une analyse financière du soutien que nous pouvons apporter. Nous devons travailler avec l'INAMI en ce domaine. Ensuite, il y a les forfaits pleins et les forfaits réduits. Ce sont ces derniers qui font vivre les associations. Quand l'argent vient à manquer, il faut courir derrière les subsides et les dons. C'est épuisant. My party considers it time to extend the definition of INAMI-refunded palliative care. Such care could not continue to be limited to merely accompanying the inevitable diagnosed end of life in the near future.

It is necessary to integrate palliative care into healthcare at an early stage; to recognize the importance of the psychological, social, spiritual and existential aspects of patients whose life outlook is committed; not to rely on life expectancy, but on the needs of each individual patient; to take better into account their pain, dignity and emotional concerns. These approaches, which require a multidisciplinary approach, are essential for the approximately 10,000 to 20,000 patients who, every day in our country, are in an advanced or terminal stage of a serious or progressive disease, as well as for their relatives.

Therefore, we welcome the unanimity that has emerged around this high-human value-added bill. I am very pleased to vote in favour of this proposal. But, of course, I return to all that Ms. Fonck and Gerkens said: it was essential to listen to the different federations and pharmaceutical associations and to take into account their opinions, as they are field actors. We are their intermediaries, but we have not played the right role.

I would also like to add a personal comment. I worked for several years in a home palliative care association. To return to Ms Fonck’s financial statements, we need to produce a financial analysis of the support we can provide. We need to work with INAMI in this area. Then there are the full packages and the small packages. They are the ones that make the associations live. When the money is missing, you have to run behind the subsidies and donations. It is exhausting. You should know that nurses who work in palliative care at home are extremely courageous people, who constantly face death. It is, by the way, very difficult to recruit them, because their mission requires a lot of experience. We need to financially support these organizations. As Ms. Fonck said, this is a way to save money. When a patient has to end his life in a hospital, it involves a cost.

Er kan trouwens vroeger dan drie maanden voor het levenseinde nood zijn aan palliatieve verzorging. Op dat vlak brengt het wetsvoorstel verduidelijking voor zowel de patiënten als de zorgverleners. De materie is gevoelig, maar ik ben blij dat er over een groot deel van de maatregelen en voorstellen een consensus gevonden is. Is het de laatste stap? Nee, er zullen nog meer stappen gezet moeten worden. Zo gaat dat altijd.

Vanuit het kabinet denk ik dat wij ons hebben geïnformeerd over en de nodige belangstelling hebben getoond voor de werkzaamheden van de leden van de commissie. Ik zal dan ook uitvoeren wat er hier straks zal worden goedgekeurd.

La signature conjointe de députés représentant les divers paysages politiques et linguistiques montre, s'il en était besoin, tout à la fois la communauté de vues dans notre pays – et c'est heureux, nous sommes un pays phare sur le sujet des droits des LGBTQI – mais aussi la conscience que si en Belgique ces droits ont force de loi, il n'en est hélas pas de même partout. Même là où ces droits sont reconnus sur le plan législatif, il est nécessaire d'avancer encore dans une reconnaissance et un respect de ceux-ci par tout le corps social.

En effet, comme je viens de le dire, y compris dans les pays où les droits sont reconnus, les LGBTQI sont encore trop souvent victimes de rejet, d'insultes, d'agressions et de meurtres.

The joint signature of deputies representing the various political and linguistic landscapes shows, if needed, both the community of views in our country – and it is happy, we are a flagship country on the subject of LGBTQI rights – but also the awareness that if in Belgium these rights have force of law, it is unfortunately not the same everywhere. Even where these rights are recognised on the legislative level, it is necessary to make further progress in the recognition and respect of them by the whole social body.

Indeed, as I just said, even in countries where rights are recognized, LGBTQI people are still too often victims of rejection, insults, assaults and murders.

                    Nous l'avons vu chez nous, avec l'assassinat d'Ihsane Jarfi voici quelques années, qui nous a amenés à durcir les peines encourues pour les crimes à caractère homophobe. Nous le voyons encore avec des agressions, jusque dans la rue, de transgenres qui se font poignarder, comme ce fut le cas encore récemment à Etterbeek, ou avec d'autres agressions allant jusqu'au meurtre, comme à Bruxelles voici à peine quelques semaines.

Nous l'avons aussi, hélas, constaté, terrifiés, à Orlando où quarante-neuf personnes ont été tuées par un homme dont l'enquête nous dira si c'est son rejet personnel des LGBTQI ou bien son adhésion aux idées des nazislamistes qui lui a armé le bras. Nous avons également vu, lors des obsèques, des groupes anti-gays, venir manifester leur rejet.

Il ne faut pas se voiler la face, les droits des gays sont acquis aux États-Unis, mais depuis peu et ils sont loin d'être exercés dans leur plénitude. Au demeurant, ils sont encore l'objet d'un combat de la part des néo-conservateurs américains qui se retrouvent dans le Tea Party et qui voudraient faire reculer les législations en la matière.

Dans d'autres régions du monde, si les droits des LGBTQI ont pu connaître une amélioration puisque, voici une quinzaine d'années, environ septante et un pays avaient dépénalisé l'homosexualité et que nous en sommes aujourd'hui à cent quatorze, je vous rappelle néanmoins qu'il y a à peu près deux cents pays dans le monde. Cela signifie qu'il reste encore bien du chemin à parcourir, non pas nécessairement sur le plan de l'acceptation de l'homosexualité, mais tout simplement sur celui de sa dépénalisation.

Dans certains pays, des lois héritées de l'époque coloniale, tombées en désuétude chez nous, sont remises en application et plongent les LGBTQI dans la clandestinité et la peur, les confrontant à la violence verbale et physique, les conduisant en prison, les condamnant à mort. Je rappelle l'événement qui s'est déroulé il y a peu au Maroc. Deux homosexuels qui se trouvaient dans leur appartement ont vu plusieurs jeunes arriver chez eux, qui les ont extraits de leur logement, les ont tabassés et lynchés en rue. In fine, le tribunal marocain a condamné les victimes, et pas les agresseurs. C'est vous dire à quel point le chemin est encore long.

We saw it at home, with the assassination of Ihsane Jarfi a few years ago, which led us to tighten the penalties incurred for homophobic crimes. The rights of gays are acquired in the United States, but recently and they are far from being exercised in their fullness. By the way, they are still the subject of a struggle on the part of the American neo-conservatives who find themselves in the Tea Party and who would like to push back the legislation on the matter.

In other parts of the world, although the rights of LGBTQI have improved since, about fifteen years ago, about seventy-one countries had decriminalized homosexuality and that we are now one hundred and fourteen, I remind you nevertheless that there are about two hundred countries in the world. This means that there is still a long way to go, not necessarily in terms of acceptance of homosexuality, but simply in terms of its decriminalization.

In some countries, laws inherited from the colonial era, which have become obsolete in our country, are put into effect and plunge LGBTQI into clandestinity and fear, confronting them with verbal and physical violence, leading them to prison, sentencing them to death. I am reminded of the event that took place recently in Morocco. Two gay men who were in their apartment saw several young people coming home, who took them out of their homes, beat them and lynched them on the streets. In the end, the Moroccan court condemned the victims, not the aggressors. It shows how long the road is still.

                    Aussi est-il nécessaire d'avancer dans la lutte pour la dépénalisation de l'homosexualité, dans la suite des premières avancées de 2008, où l'ONU a, pour la première fois, abordé la question en ces termes. À cette occasion, et ceci nous surprend en tant que Belges, une contre-déclaration a été adoptée par 57 États, qui associaient homosexualité, bestialité, inceste et zoophilie, ce qui montre encore le chemin à parcourir pour une véritable égalité de droit entre tous les êtres humains.

Notre proposition demande donc au gouvernement d'agir activement pour une dépénalisation de l'homosexualité, non pas en Belgique où c'est chose faite, mais partout dans le monde, et de lutter contre la discrimination envers les LGBTQI sous toutes ses formes. Par cette proposition, nous demandons à la Belgique d'agir dans ce sens dans le cadre de sa politique de coopération au développement, à l'égard des pays partenaires, dans le cadre de la politique étrangère bilatérale et au sein de l'Union européenne.

La Belgique, dans le § 2 de l'article 11 de la loi du 19 mars 2013 sur la coopération au développement, met en avant la dimension du genre et de l'égalité de droit des hommes et des femmes dans la société. La politique étrangère belge promeut les même valeurs. Aussi, la présente résolution demande à ce que la politique de coopération et de développement et la politique étrangère belge poursuivent d'abord le dialogue sur l'identité de genre et l'orientation sexuelle, afin de mettre fin aux discriminations; ensuite, qu'elles fassent de la lutte contre toutes les discriminations envers les LGBTQI une priorité dans toutes les relations bilatérales avec tous les pays et au sein de toutes les instances internationales; invitent les autres États membres du l'Union européenne à intégrer la question des droits des LGBTQI dans leurs rapports avec leurs partenaires; et enfin inscrivent ce sujet à l'ordre du jour des réunions des différentes instances européennes et autres institutions internationales compétentes, et veillent à ce que les personnes en charge du contrôle du respect des droits de l'homme fassent respecter ces droits pour les LGBTQI. Il faut enfin qu'elles intègrent des actions pour les droits des LGBTQI dans le plan d'action genre et développement.

Il faut aussi bien sûr que des programmes d'éducation sensibilisent les populations des pays partenaires sur cette question de lutte contre les stéréotypes dans l'éducation, la culture, le sport, la recherche, et aident les pays partenaires à mettre en oeuvre une politique active de sauvegarde de tous les droits des LGBTQI.

It is therefore necessary to make progress in the struggle for the decriminalization of homosexuality, following the first advances in 2008, when the UN for the first time addressed the issue in these terms. On this occasion, and this surprises us as Belgians, a counter-declaration was adopted by 57 states, which associated homosexuality, bestiality, incest and zoophilia, which still shows the way to go for a true equality of rights among all human beings.

Our proposal therefore calls on the government to act actively for a decriminalization of homosexuality, not in Belgium where it is done, but everywhere in the world, and to fight against discrimination against LGBTQI in all its forms. With this proposal, we call on Belgium to act in this direction within its policy of development cooperation, with respect to partner countries, within the framework of bilateral foreign policy and within the European Union.

Belgium, in paragraph 2 of article 11 of the law of 19 March 2013 on development cooperation, highlights the gender dimension and the equality of rights of men and women in society. The Belgian foreign policy promotes the same values. Therefore, this resolution calls for the cooperation and development policy and Belgian foreign policy to continue dialogue on gender identity and sexual orientation in order to end discrimination; to make the fight against all discrimination against LGBTQI a priority in all bilateral relations with all countries and within all international bodies; to invite the other Member States of the European Union to incorporate the issue of LGBTQI rights in their relations with their partners; and finally to include this issue on the agenda of meetings of the various European bodies and other relevant international institutions, and to ensure that persons in charge of human rights monitoring respect these rights for LGBTQI. Finally, they must integrate actions for LGBTQI rights into the Gender and Development Action Plan.

Educational programmes should also, of course, raise awareness among the peoples of partner countries on this issue of combating stereotypes in education, culture, sport, research, and help partner countries implement an active policy to safeguard all rights of LGBTQI.

Il est clair que même au sein des LGBTQI, il y a le secteur particulier des transgenres. Dans ce domaine, même la Belgique est encore en train de travailler à un projet. Dans beaucoup de pays, même ceux qui ont déjà dépénalisé l'homosexualité, il y a encore beaucoup de travail, au point que, encore aujourd'hui, le transsexualisme figure dans la liste des maladies mentales de l'Organisation mondiale de la Santé.

Il faut que chacun des députés qui sont membres de l'Assemblée parlementaire du Conseil de l'Europe puisse porter, à titre individuel, les droits des LGBTQI comme priorité transversale de défense des droits de l'homme et de défendre ces droits en cas d'atteinte avérée dans des pays membres. On l'a encore vu récemment à Istanbul, la répression a été particulièrement violente lors d'une pride.

Lors des débats en commission, comme l'a dit M. Hellings très justement, je souligne le grand consensus dans lequel nous avons pu travailler. Une série d'amendements de la majorité et de l'opposition ont été discutés et très largement adoptés. C'est une grande fierté d'avoir pu aboutir en commission à un vote unanime sur cette résolution. Au-delà du vote de cette résolution, il est important que nous puissions prendre cette résolution comme feuille de route tant pour les députés que les ministres fédéraux, régionaux et communautaires.

We also need to protect human rights defenders and NGOs, and whenever there are judicial decisions based on sexual orientation and gender identity, those who do not respect this sexual orientation must be highlighted and condemned.

It is also necessary to call for work within the Human Rights Council of which Belgium is once again a member to decriminalize homosexuality universally.

It is clear that even within LGBTQIs, there is the particular sector of transgender. In this area, even Belgium is still working on a project. In many countries, even those that have already decriminalized homosexuality, there is still a lot of work to be done, to the point that, even today, transgenderism is on the World Health Organization’s list of mental illnesses.

Each member of the Parliamentary Assembly of the Council of Europe must be able, individually, to take the rights of LGBTQI as a transversal priority in defence of human rights and to defend these rights in the event of proven violations in member countries. It was again seen recently in Istanbul, the repression was ⁇  violent during a pride.

At the meeting, as Mr. Hellings very rightly, I emphasize the great consensus in which we have been able to work. A number of majority and opposition amendments were discussed and widely adopted. We are very pleased that this resolution was unanimously voted by the European Parliament. Beyond voting on this resolution, it is important that we can take this resolution as a roadmap for both MEPs and federal, regional and community ministers.

De resolutie strekt ertoe homoseksualiteit overal ter wereld uit het strafrecht te halen. Het is vooral een verzoek aan de regering om in het kader van ontwikkelingssamenwerking onze partnerlanden te sensibiliseren en bijstand te verlenen. Het is tevens een verzoek om in het kader van ons buitenlands beleid een internationaal verdrag uit te werken dat de discriminatie op basis van seksuele geaardheid, voorkeur of identiteit verbiedt.

De tekst van collega Flahaux was een zeer goede startbasis en is door constructieve amendementen van zowel meerderheid als oppositie aangevuld tot de tekst die nu voorligt. Zoals de rapporteur, de heer Hellings, zonet zei, werd de tekst in de commissie unaniem goedgekeurd.

De N-VA-fractie zal deze resolutie vandaag dan ook opnieuw steunen. Ook al is het nu een beetje later dan de symbolische dag tegen homofobie en transfobie, het blijft een belangrijk signaal dat wij deze resolutie vandaag zullen goedkeuren.

The resolution aims to remove homosexuality from criminal law all over the world. It is primarily a call to the government to raise awareness and provide assistance to our partner countries in the context of development cooperation. It is also a call to develop an international treaty within the framework of our foreign policy that prohibits discrimination on the basis of sexual orientation, preference or identity.

The text of colleague Flahaux was a very good starting point and has been supplemented by constructive amendments of both the majority and the opposition to the text that now prevails. As the rapporteur, Mr. Hellings, recently said, the text was unanimously approved in the committee.

The N-VA Group will therefore again support this resolution today. Even though it is now a little later than the symbolic day against homophobia and transfobia, it remains an important signal that we will adopt this resolution today.

                    Monsieur le président, mes chers collègues, la Gay Pride est interdite à Istanbul pour des raisons de sécurité, elle est menacée d'un bain de sang à Kiev par des mouvements ultra-nationalistes; il y a eu récemment cet attentat dans ce club LGBTQI de Orlando, qui a fait 49 morts et 53 blessés. L'Ouganda, la Russie se dotent de loi anti-gays, etc. L'emprisonnement pour homosexualité est pratiqué dans de nombreux pays. Il ne faut pas oublier, tout simplement, l'homophobie ordinaire qui sévit dans la rue ou sur les réseaux sociaux. La liste des atteintes aux droits à l'intégrité morale et physique des LGBTQI en Belgique, en Europe et dans le monde pourrait, hélas, être plus longue. Pourquoi? Par refus du simple droit d'aimer, quelle que soit son orientation sexuelle!

La lutte contre l'homophobie, dans ses expressions quotidiennes ou légales, doit rester une priorité politique de notre pays, y compris dans notre diplomatie et nos politiques de coopération au développement. Soyons clairs: la résolution dont nous discutons aujourd'hui ne pourra pas constituer la réponse miracle aux faits que je viens d'énoncer! Mais pareil texte pourrait-il seulement être discuté en séance plénière de la Douma russe? Nous connaissons la réponse! Je suis donc fière de vivre dans un pays où la Chambre des représentants s'empare d'un sujet d'une cruelle actualité. Car l'homosexualité est restée un tabou dans bien des pays; il ne faut pas aller loin pour voir à quel point ce tabou reste entier au sein même de l'Union européenne. Pensons, par exemple, à la mairie de Vilnius qui, en 2008, a refusé que le camion de la campagne européenne "Pour la diversité, contre les discriminations" fasse halte dans sa ville. En 2005, Lech Kacsynski, alors maire de Varsovie, interdisait la Gay Pride dans sa ville. Les conservatismes exacerbés de nombreux pays européens sont un danger pour notre projet commun.

Nous nous souvenons également des débats en France autour du mariage pour tous, que notre pays, par contre, avait adopté sous le gouvernement arc-en-ciel de manière beaucoup plus sereine.

Pour mon groupe, avant de se pencher sur la problématique à l'international, il revenait également aux membres belges de l'Assemblée parlementaire du Conseil de l'Europe de porter ce débat au sein de cette institution gardienne de la Charte européenne des droits de l'homme. En adoptant l'amendement de mon groupe en ce sens, le texte demande aujourd'hui à nos collègues de porter à titre individuel les droits des LGBTQI comme une priorité transversale en matière de défense des droits de l'homme, mais aussi à la délégation belge de mener les actions requises au sein de cette assemblée en cas d'atteinte avérée aux droits des LGBTQI dans un de ses pays membres.

Bien loin des 47 États membres du Conseil de l'Europe, de manière générale, le long chemin vers la fin de toutes les discriminations n'est pas terminé, et ce notamment dans des pays partenaires de la coopération belge au développement. Je citerai ici notamment le cas de l'Ouganda, qui est particulièrement préoccupant.

Ce texte demande donc, et j'y serai particulièrement attentive, d'intégrer dans le plan d'action relatif à l'intégration de la dimension de genre dans la coopération belge au développement une série d'actions relatives aux droits des LGBTQI.

Il en va de même pour la priorité à donner par la diplomatie belge, tant dans nos relations bilatérales que multilatérales. Il s'agit d'intégrer pleinement ce volet au thème "droits de l'homme" du dialogue politique entretenu par la diplomatie belge dans ses relations diplomatiques avec ses partenaires, mais aussi dans les forums internationaux, pour que la dépénalisation de l'homosexualité soit un fait partout dans le monde.

La Belgique, en tant qu'un des rares pays dans lesquels les homosexuels jouissent de droits identiques aux hétérosexuels, se doit d'être active, d'être un moteur dans la défense des droits des LGBTQI. Au XXIᵉ̀ᵐᵉ siècle, de telles discriminations basées sur l'orientation sexuelle sont inacceptables.

The fight against homophobia, in its everyday and legal forms, must remain a political priority of our country, including in our diplomacy and development cooperation policies. Let’s be clear: the resolution we are discussing today will not be the miraculous answer to the facts I have just outlined! But could such a text only be discussed in a plenary session of the Russian Duma? We know the answer! So I’m proud to live in a country where the House of Representatives takes hold of a topic of cruel currentity. For homosexuality has remained a taboo in many countries; we do not have to go far to see how far this taboo remains within the European Union itself. Consider, for example, the municipality of Vilnius, which in 2008 refused to allow the truck of the European campaign “For Diversity, Against Discrimination” to stop in its city. In 2005, Lech Kaczynski, then mayor of Warsaw, banned Gay Pride in his city. The exacerbated conservatisms of many European countries are a danger to our common project.

We also remember the debates in France around marriage for all, which our country, on the other hand, had adopted under the rainbow government in a much more serene way.

For my group, it was also up to the Belgian members of the Parliamentary Assembly of the Council of Europe, before looking at the problem internationally, to carry this debate within this guardian institution of the European Charter of Human Rights. By adopting my group’s amendment in this regard, the text today calls on our colleagues to put LGBTQI rights as a cross-priority priority in defence of human rights individually, but also to the Belgian delegation to carry out the required actions in this assembly in the event of a proven violation of LGBTQI rights in one of its member countries.

Far from the 47 member states of the Council of Europe, in general, the long way to end all discrimination is not over, especially in the partner countries of Belgian development cooperation. I would like to mention Uganda, which is ⁇  concerned.

This text therefore calls for, and I will pay particular attention to, the inclusion in the Action Plan on Gender Integration in Belgian Development Cooperation of a series of actions related to the rights of LGBTQI persons.

The same applies to the priority to be given by the Belgian diplomacy, both in our bilateral and multilateral relations. The aim is to fully integrate this aspect into the "human rights" theme of the political dialogue ⁇ ined by the Belgian diplomacy in its diplomatic relations with its partners, but also in international forums, so that the decriminalization of homosexuality becomes a fact everywhere in the world.

Belgium, as one of the few countries where homosexuals enjoy the same rights as heterosexuals, must be active, be a driver in the defense of LGBTQI rights. In the 21st century, such discrimination on the basis of sexual orientation is unacceptable.

Je crois sincèrement en l'internationalisme de cette lutte contre les discriminations. On ne peut pas se contenter de penser que des droits sont acquis en Belgique et que cela suffit.

Ce combat, puisqu'il s'agit bien d'un combat, n'est donc pas terminé, vu l'absence, à ce jour, d'un traité interdisant toute forme de discrimination fondée sur l'orientation, la préférence ou l'identité sexuelle.

La N-VA s'est opposée en commission à un tel traité spécifique aux LGBTQI que le PS  estime pourtant essentiel. Le débat en Belgique n'est donc pas clos non plus.

Enfin, je terminerai mon intervention en remerciant – une fois n'est pas coutume – mon collègue, Jean-Jacques Flahaux, qui m'a proposé de cosigner ce texte. Et je salue le fait que plusieurs amendements socialistes visant à renforcer son dispositif aient pu être adoptés par la majorité en commission et figurent aujourd'hui dans le texte à l'examen.

Dat werd aangetoond door de vreselijke gebeurtenissen in Orlando en, daaropvolgend, in Istanbul, waar de gaypride niet georganiseerd mocht worden en de participanten die alsnog kwamen opdagen hardhandig werden aangepakt door de veiligheidsdiensten.

Internationaal is homoseksualiteit strafbaar in 80 landen, waaronder Oeganda, een partnerland van de Belgische Ontwikkelingssamenwerking. In Rusland verbiedt men homoseksuele propaganda. Het is dan ook nodig dat deze resolutie de strafbaarheid in die 80 landen aan de kaak stelt en vraagt dat ons buitenlands beleid de gelijkheid van rechten voor de lgbtqi’s vooropstelt.

België moet een voorloper blijven. Wij zijn vandaag een voorloper, want wij hebben de tweede plaats op de rainbowindex van 2016. Een studie van de universiteit van Gent toont aan dat wij op de vierde plaats staan op het vlak van niet-discriminerende wetgeving. Ook vandaag is onze regering aan het werk. Samen met de minister van Justitie en de staatssecretaris voor Armoedebestrijding wordt er vandaag gewerkt aan wetgeving over transseksualiteit. Om onze sterke positie ook naar het buitenland uit te dragen, is deze resolutie nodig. Wij kunnen daarin een vooraanstaande rol spelen. Daarom ondersteunt mijn fractie volmondig deze resolutie.

The resolution on the depenalization of homosexuality is urgently needed. This was demonstrated by the terrible events in Orlando and, subsequently, in Istanbul, where the gaypride was not allowed to be organized and the participants who had yet to appear were hardhanded by the security services.

Internationally, homosexuality is criminalized in 80 countries, including Uganda, a partner country of the Belgian Development Cooperation. Homosexual propaganda is banned in Russia. It is therefore necessary that this resolution challenge the criminality in those 80 countries and calls for our foreign policy to prioritize the equality of rights for LGBTQs.

Belgium must remain a precursor. We are a precursor today, as we have the second place on the rainbow index of 2016. A study from the University of Gent shows that we are ranked fourth in terms of non-discriminatory legislation. Our government is also working today. Together with the Minister of Justice and the State Secretary for Poverty Reduction, legislation on transsexuality is being worked today. In order to expand our strong position abroad, this resolution is needed. We can play a leading role in this. Therefore, my group fully supports this resolution.

De vraag om wereldwijd de dialoog over seksuele identiteit, geaardheid en voorkeur aan te gaan en versterkt voort te zetten, draagt dan ook onze volle medewerking.

Over de hele wereld zijn homoseksuele mannen en vrouwen het slachtoffer van schendingen van hun mensenrechten. Die schendingen lopen uiteen van subtiele discriminatie tot gevangenschap en marteling. In bijna de helft van alle landen ter wereld is homoseksualiteit strafbaar. In 2009 bracht de internationale organisatie voor homorechten ILGA een rapport uit dat meldde dat homoseksualiteit in 80 landen illegaal is. In vijf landen staat er zelfs de doodstraf op, namelijk in Iran, Mauritanië, Soedan, Saoedi-Arabië en Jemen. Dat geldt ook nog voor delen van Nigeria en Somalië. Over de vervolging en discriminatie van homoseksuelen buiten het Westen is vaak heel weinig bekend. In veel landen in Afrika, Azië en het Midden-Oosten is homoseksualiteit nauwelijks geaccepteerd en wordt vervolging ervan niet als een schending van de mensenrechten ervaren. Daarom is het voor ons van groot belang dat de rechten van holebi’s en gendervariante personen opgenomen worden in onderhandelingen en contacten met landen waar holebiseksualiteit nog strafbaar is of waar lgbtqi’s nog worden vervolgd.

België beschikt over verschillende instrumenten om geweld jegens homoseksuelen tegen te gaan. Via onze ontwikkelingssamenwerking kunnen wij programma’s uitwerken in Algerije, Benin, Burundi, Marokko, Mozambique, Oeganda, Peru, Senegal of Tanzania. Dat zijn allemaal landen waar homoseksualiteit in het strafwetboek is opgenomen en inderdaad ook wordt bestraft. Samen met onze EU-partners kunnen wij tevens in een bi- of een multilateraal kader een duidelijk boodschap sturen aan landen zoals Saudi-Arabië, China, India, Iran, Mauritanië, Nigeria en Pakistan, opdat zij op zijn minst het debat aangaan over de plaats die in hun samenleving aan homoseksualiteit wordt toebedeeld.

Homoseksualiteit is geen keuze. Men leert het niet op school en men wordt het niet door discotheken te bezoeken, zoals wij recent nog hoorden beweren, zelfs in ons land, collega’s. Men wordt zo geboren. Wij moeten die boodschap niet alleen in eigen land blijven bevestigen, wij moeten onze inspanningen opvoeren om die boodschap verder te integreren in ons buitenlands beleid en tegenover onze partnerlanden in het kader van de ontwikkelingssamenwerking.

Wij zullen deze resolutie dus met overtuiging goedkeuren.

Not only our domestic, but also our foreign policy must be aimed at ending discrimination against LGBTQs. The need to engage and strengthen the global dialogue on sexual identity, orientation and preference is therefore our full cooperation.

Homosexual men and women around the world are victims of violations of their human rights. These violations range from subtle discrimination to imprisonment and torture. In almost half of the world’s countries, homosexuality is criminalized. In 2009, the international gay rights organization ILGA released a report that ⁇  that homosexuality is illegal in 80 countries. Five countries even impose the death penalty, namely Iran, Mauritania, Sudan, Saudi Arabia and Yemen. The same applies to parts of Nigeria and Somalia. Of the persecution and discrimination of homosexuals outside the West is often known very little. In many countries in Africa, Asia and the Middle East, homosexuality is barely accepted and persecution is not perceived as a violation of human rights. Therefore, it is of great importance for us that the rights of holebies and gender variants are included in negotiations and contacts with countries where holebiesexuality is still criminalized or where LGBTQs are still being prosecuted.

Belgium has various instruments to combat violence against homosexuals. Through our development cooperation we can develop programs in Algeria, Benin, Burundi, Morocco, Mozambique, Uganda, Peru, Senegal or Tanzania. These are all countries where homosexuality is included in the criminal code and indeed is also punished. Together with our EU partners, we can also, in a bilateral or multilateral framework, send a clear message to countries such as Saudi Arabia, China, India, Iran, Mauritania, Nigeria and Pakistan, so that they at least engage in the debate about the place homosexuality takes in their societies.

Homosexuality is not a choice. One does not learn it in school and one does not get it by visiting discos, as we have recently heard claiming, even in our country, colleagues. You are born so. We must not only continue to confirm this message in our own country, we must increase our efforts to further integrate that message into our foreign policy and towards our partner countries in the framework of development cooperation.

We will therefore approve this resolution with conviction.

                    Monsieur le président, qu'il est loin le temps où, en janvier 2003, cette Chambre votait le mariage et où, en avril 2006, cette même Chambre votait l'adoption rendue possible pour les couples homosexuels; qu'il est loin le temps où il fallait se battre sur un sujet aussi essentiel!

Aujourd'hui, la question de l'homosexualité, en Belgique, est devenue mainstream. Et l'on peut s'en réjouir. Aujourd'hui, au vu des noms des signataires de la résolution originale, ainsi que du contenu de cette même résolution, nous pouvons dire que les lois ont non seulement modifié la société belge, et son acceptation, mais aussi très certainement modifié le monde politique lui-même. Et nous pouvons nous en réjouir.

Pour les Verts, les 29 principes de Jogjakarta qui sont mobilisés par la résolution de M. Flahaux sont des droits humains. Le droit des homosexuels, des gays, des lesbiennes, des bisexuels, transsexuels, queers and intersex (LGBTQI) sont des droits humains comme les autres. Comme l'est le droit à la liberté d'expression, le droit de pouvoir se syndiquer, s'associer, etc. Les principes ne sont pas différents pour ces droits-là que pour tous les autres droits humains qui font de nous des humains capables de pouvoir interagir dans le monde.

La Belgique, par cette résolution, et la Chambre en particulier, veut donner des leçons au monde. Et c'est juste, parce qu'il est vrai que, sur le classement mondial des droits des LGBTQI, la Belgique est particulièrement bien placée. Il n'en demeure pas moins que trois points noirs persistent, des dossiers sur lesquels nous devons travailler à l'avenir en tant qu'organe législatif.

Le premier, c'est la loi, nécessaire, sur laquelle travaillent Mme Sleurs et M. Geens, à savoir la loi sur les transgenres, qui était déjà sur le métier du gouvernement précédent et qui, malheureusement, n'a pas pu aboutir lors de la législature précédente. Il s'agira de pouvoir aboutir de façon concrète aujourd'hui et viser à démédicaliser, dépsychologiser le phénomène de changement de genre. Nous faisons confiance à M. Geens et à Mme Sleurs pour ce faire. Les écologistes seront extrêmement attentifs au processus législatif en cours.

Le deuxième concerne la règle extrêmement discriminatoire qui touche très fort, d'un point de vue symbolique en tout cas, les homosexuels masculins qui ne peuvent pas donner leur sang. Mme la ministre de la Santé, qui est présente et qui participe à nos débats, s'est engagée à modifier cette règle. Là aussi, il s'agira d'être attentifs à sa concrétisation.

J'en viens au troisième point, pour lequel la plus grande difficulté se pose dans cette résolution, à savoir l'asile.

Mr. Speaker, how far away is the time when, in January 2003, this Chamber voted for marriage and where, in April 2006, this same Chamber voted for adoption made possible for homosexual couples; how far away is the time when it was necessary to fight on such an essential issue!

Today, the issue of homosexuality in Belgium has become mainstream. And we can rejoice. Today, given the names of the signatories of the original resolution, as well as the content of that same resolution, we can say that the laws have not only modified the Belgian society, and its acceptance, but also very ⁇  modified the political world itself. And we can rejoice.

For the Greens, the 29 principles of Jogjakarta, which are mobilized by the resolution of Mr. Flahors are human rights. The rights of gay, gay, lesbian, bisexual, transgender, queer and intersex (LGBTQI) are human rights like any other. Like the right to freedom of expression, the right to be able to syndicate, associate, etc. The principles are not different for these rights than for all other human rights that make us human beings capable of interacting in the world.

Belgium, with this resolution, and the House in particular, wants to give lessons to the world. And that’s right, because it’s true that, on the global ranking of LGBTQI rights, Belgium is ⁇  well placed. Nevertheless, three black points persist, matters that we must work on in the future as a legislative body.

The first is the law, necessary, on which Ms. Sleurs and Mr. Sleurs work. Geens, namely the transgender law, which was already on the occupation of the previous government and which, unfortunately, could not result in the previous legislature. It will be about being able to ⁇  a concrete outcome today and aiming at demedicalizing, de-psychologizing the phenomenon of gender change. We trust Mr. Geens and Mrs. Sleurs to do this. Environmentalists will be extremely attentive to the ongoing legislative process.

The second concerns the extremely discriminatory rule that affects very strongly, from a symbolic point of view in any case, male homosexuals who cannot donate their blood. The Minister of Health, who is present and participates in our discussions, has pledged to change this rule. It will also be a matter of being attentive to its implementation.

I come to the third point, for which the greatest difficulty arises in this resolution, namely asylum.

                    Il est incontestable aujourd'hui que, dans un certain nombre de pays du monde, les droits des LGBTQI ne sont pas respectés, ce qui les poussent parfois à prendre la route de l'asile.

Le considérant K qui a été ajouté lors de nos travaux a recueilli l'unanimité et ne remet en rien en cause le soutien que le groupe des Verts apportera à la résolution. Il précise: "considérant la prise en compte par la Belgique de la situation des LGBTQI dans la politique d'asile." Je pense que c'est une vision extrêmement optimiste de ce que fait  l'Office des Étrangers qui, aujourd'hui, interroge plus que de raison les personnes qui demandent l'asile pour des raisons d'homosexualité.

J'en veux pour preuve l'extrêmement faible application de l'article 9 ter de la loi de 1980 portant sur le droit de séjour. L'article 9 ter octroie à des personnes malades ...  De fait, il est aujourd'hui incontestable que de nombreux malades du sida dans notre pays, en particulier à Bruxelles, sont homosexuels. Ceux-ci n'ont pratiquement plus jamais la possibilité d'obtenir un droit de séjour en fonction de leur état de santé. Aujourd'hui, des personnes malades du sida qui en outre sont homosexuelles sont renvoyées dans des pays où elles sont doublement en danger, d'une part, pour des questions de santé car elles ne pourront pas se soigner – ce n'est pas l'objet de la résolution – et, d'autre part, pour des questions d'orientation sexuelle. Ce sera le troisième point d'attention sur lequel les Verts continueront à travailler et "tiendront à la culotte", si je peux me permettre, le secrétaire d'État en charge de l'Asile et de la Migration qui, en la matière, n'a pas pris les initiatives qui s'avèrent nécessaires.

Enfin, il existe une résolution qui a été adoptée le 3 mars 2011 dans cette même Chambre et qui portait exactement le même titre. Je pense que nous devons veiller, dès aujourd'hui, à ce que cette résolution-ci, qui fait l'objet d'un vote unanime dans notre Chambre, ne reste pas lettre morte pour que ce qui s'est vu à Istanbul ou à Orlando, ce qui se voit aujourd'hui en Ouganda, en Russie, en Somalie, en Arabie Saoudite, en Iran ou ailleurs ne soit plus possible. Nous voterons donc cette résolution avec enthousiasme et détermination.

It is unquestionable today that, in a number of countries around the world, the rights of LGBTQI are not respected, which sometimes drives them to take the path of asylum.

Recital K, which was added during our work, was unanimous and does not question the Green Group’s support for the resolution. He adds: “Considering Belgium’s taking into account the situation of LGBTQI in asylum policy,” I think it is an extremely optimistic view of what the Foreign Office is doing, which, today, more than reasonably interrogates people who apply for asylum for reasons of homosexuality.

I mean as proof the extremely low application of Article 9b of the 1980 Act on the right of residence. Article 9b grants to sick persons ... In fact, it is now undisputed that many AIDS patients in our country, especially in Brussels, are homosexual. They almost never have the opportunity to obtain a right of residence based on their health status. Today, people with AIDS who are also homosexual are sent back to countries where they are twice at risk, on the one hand, for health issues because they will not be able to get care – this is not the subject of the resolution – and, on the other hand, for issues of sexual orientation. This will be the third point of attention on which the Greens will continue to work and will "take the shirt," if I can afford, the Secretary of State in charge of Asylum and Migration, who, in this matter, has not taken the necessary initiatives.

Finally, there is a resolution that was adopted on 3 March 2011 in that same Chamber and which was entitled exactly the same title. I think that we must take care, from today, that this resolution, which is the subject of unanimous vote in our House, does not remain a dead letter, so that what was seen in Istanbul or Orlando, what is seen today in Uganda, Russia, Somalia, Saudi Arabia, Iran or elsewhere is no longer possible. We will therefore vote on this resolution with enthusiasm and determination.

                    Monsieur le président, mesdames et messieurs les ministres, chers collègues, ce n'est pas sans émotion que je m'exprime au nom de mon groupe sur cette proposition de résolution près de deux semaines après le terrible attentat dans un club gay d'Orlando. Ce dramatique événement nous a rappelé, une fois de plus, à quel point la communauté LGBTQI est une cible de choix pour les ennemis de la démocratie et de la liberté. Les victimes de cet acte de barbarie ont été visées uniquement pour ce qu'elles étaient et pour ce qu'elles exprimaient.

La situation de cette communauté est encore plus grave dans d'autres pays. Faut-il en effet rappeler que, dans près de quatre-vingts pays, des lois discriminatoires criminalisent des rapports consentants et privés entre personnes de même sexe? Ces lois exposent des citoyens à des arrestations, à des poursuites, à des peines d'emprisonnement et même, dans cinq pays au moins, à la peine de mort. Dans certains d'entre eux, ces peines sont appliquées avec la plus grande sévérité. Dans d'autres, elles ne le sont que très peu, mais encouragent la police à discriminer, harceler, voire agresser la communauté des gays, faisant peser sur ses membres une crainte perpétuelle du rejet et de la violence.

Par conséquent, quelle que soit la situation concrète qui découle d'une législation pénalisant l'homosexualité, la dépénalisation de celle-ci n'a rien de symbolique. Elle est indispensable pour le respect des droits et libertés des LGBTQI.

Fort heureusement, des progrès sont enregistrés. En Inde, la Cour suprême enjoint le parlement d'examiner la dépénalisation de l'homosexualité, déclarant que le Code pénal indien dénie le droit d'une personne homosexuelle à sa pleine personnalité. Aux Seychelles, la dépénalisation a été votée ce 17 mai de sorte que l'homosexualité ne sera enfin plus considérée comme un acte "contre-nature".

Dans d'autres pays, tel le Cameroun, le tableau semble, au contraire, se noircir, puisque la récente révision du Code pénal vise à consolider la pénalisation de l'homosexualité, faisant fi des revendications du monde judiciaire et de la société civile. Le gouvernement camerounais décrète en effet qu'aussi bien l'opposition que la majorité étaient farouchement opposées à la dépénalisation.

Le drame d'Orlando nous a également démontré qu'un pays dont la législation est plus ou moins favorable à l'émancipation des LGBTQI n'est pas pour autant à l'abri d'attaques contre cette communauté. Le travail que nous devons accomplir est une tâche quotidienne et de longue haleine. Nous ne pouvons accepter qu'un individu choqué par deux hommes qui s'embrassent décide, pour cette raison, de passer à l'acte.

On le dit souvent, et je le répète encore, la clef est la concrétisation de l'éducation à la vie relationnelle, affective et sexuelle dans toutes nos écoles, dès la maternelle.

Mr. Speaker, ladies and gentlemen ministers, dear colleagues, it is not without emotion that I speak on behalf of my group on this resolution proposal ⁇  two weeks after the terrible attack on a gay club in Orlando. This dramatic event has reminded us, once again, how the LGBTQI community is a choice target for the enemies of democracy and freedom. The victims of this act of barbarism were targeted only for what they were and for what they expressed.

The situation in this community is even worse in other countries. In ⁇  80 countries, discriminatory laws criminalize consent and private relations between persons of the same sex. These laws expose citizens to arrests, prosecution, imprisonment and even, in at least five countries, to the death penalty. In some of them, these penalties are applied with the greatest severity. In others, they are only very few, but encourage the police to discriminate, harass, or even assault the gay community, causing its members to burden a perpetual fear of rejection and violence.

Therefore, regardless of the concrete situation that arises from legislation criminalizing homosexuality, its decriminalization has nothing symbolic. It is essential for respecting the rights and freedoms of LGBTQI.

Fortunately, progress has been made. In India, the Supreme Court ordered parliament to consider the decriminalization of homosexuality, stating that the Indian Criminal Code denies the right of a gay person to his full personality. In the Seychelles, the decriminalization was voted on May 17, so that homosexuality will finally no longer be considered an act "contra-nature".

In other countries, such as Cameroon, the picture seems, on the contrary, to blacken, since the recent revision of the Criminal Code aims to consolidate the penalization of homosexuality, ignoring the demands of the judiciary and civil society. The Cameroonian government decrees that both the opposition and the majority were fiercely opposed to decriminalization.

The drama of Orlando also demonstrated to us that a country whose legislation is more or less favourable to the emancipation of LGBTQI is nevertheless not safe from attacks against that community. The work we have to do is a daily and long-lasting task. We cannot accept that an individual shocked by two men kissing each other decides, for this reason, to move on to the act.

It is often said, and I repeat it again, the key is the realization of the education to the relationship, affective and sexual life in all our schools, from the preschool.

                    Nos manuels sont encore trop souvent hétéronormés. Les discours homophobes sont une réalité dans nos écoles. Or, il existe un continuum entre les discours et les actes.

Par conséquent, mon groupe soutient pleinement cette proposition et ses objectifs de sensibilisation au niveau de la politique de coopération au développement et de la politique extérieure. Notre pays a un rôle fondamental à jouer par sa place au sein de l'Union européenne, du Conseil de l'Europe mais aussi du Conseil des droits de l'homme des Nations unies où nous devons saisir ces trois années de représentation comme une opportunité de faire véritablement bouger les lignes. J'en profite pour vous inviter, chers collègues, à proposer ensemble une initiative similaire appelant nos gouvernements fédéral et régionaux à prendre également toutes les mesures nécessaires pour permettre le respect et l'émancipation de la communauté LGBTQI en Belgique.

Bien sûr, notre pays peut se vanter d'avoir une législation éminemment progressiste en la matière mais, comme mes collègues l'ont rappelé en commission, des progrès restent à réaliser pour remédier aux difficultés que rencontrent les demandeurs d'asile victimes d'actes homophobes pour prouver leur homosexualité et se voir protéger contre de nouvelles intimidations, pour remédier à la difficulté pour les transsexuels de se voir reconnaître homme ou femme en dehors de leur enveloppe corporelle, pour remédier au faible taux de poursuites et de condamnations pour homophobie ou encore à l'impossibilité systématique pour les homosexuels de donner leur sang quand bien même leur comportement ne serait pas à risques.

Sur ce dernier point, je tiens à rappeler qu'une proposition de résolution a été déposée en ce sens et que nous suivrons de près les résultats de la table ronde convoquée par Mme la ministre de la Santé. Comme je l'ai dit en commission, lorsqu'on donne son sang, c'est qu'on est responsable, que l'on soit homosexuel ou hétérosexuel; les personnes qui font ce geste le font vis-à-vis de la société et il est devenu urgent d'en tenir compte. De telles propositions doivent être d'autant plus soutenues qu'il s'agit également de soutenir activement les ONG et associations LGBTQI et de droit civil dont je salue le travail et le courage et qu'il convient d'accompagner dans leur combat pour que chacun puisse être libre, sans aucune contrainte ni intimidation, d'être soi-même.

Our manuals are still too often heteronormated. Homophobic discourse is a reality in our schools. There is a continuum between words and actions.

Therefore, my group fully supports this proposal and its awareness-raising objectives at the level of development cooperation policy and foreign policy. Our country has a fundamental role to play by its place within the European Union, the Council of Europe but also the Human Rights Council of the United Nations where we must seize these three years of representation as an opportunity to truly move the lines. I take this advantage to invite you, dear colleagues, to propose together a similar initiative calling on our federal and regional governments to also take all necessary measures to enable the respect and emancipation of the LGBTQI community in Belgium.

Of course, our country can boast of having an eminently progressive legislation in the matter, but, as my colleagues have recalled in the committee, progress remains to be made to address the difficulties facing homophobic asylum seekers to prove their homosexuality and be protected from new intimidations, to address the difficulty for transgender people to be recognized as a man or woman outside their body envelope, to address the low rate of prosecutions and convictions for homophobia or even to the systematic impossibility for homosexuals to give their blood even though their behavior would not be at risk.

On this last point, I would like to remind you that a proposal for a resolution has been submitted in this regard and that we will closely follow the results of the round table convened by Ms. Minister of Health. As I said in the committee, when you donate your blood, it is that you are responsible, whether you are gay or heterosexual; the people who do this gesture do it to the society and it has become urgent to take this into account. Such proposals must be so much more supported as it is also about actively supporting NGOs and associations LGBTQI and civil law whose work and courage I welcome and should be accompanied in their struggle so that everyone can be free, without any coercion or intimidation, to be themselves.

C'est un signal fort qu'il nous faut donner sur cette lutte qui reste d'actualité dans le monde, y compris dans notre pays, pour cette égalité des droits et cette lutte contre la discrimination. Il est important de donner ce signal quand on voit les derniers événements qui se sont produits dans différents pays.

En ce qui concerne la coopération au développement, je crois aussi qu'il y aura un lien à faire non seulement par la dépénalisation mais aussi par des combats à travers l'éducation dans ces pays. Des moyens matériels pourraient leur être donnés pour mener un combat à travers l'éducation, à travers un enseignement de qualité. Il ne suffira donc pas juste d'une évolution législative et pénale mais aussi d'une évolution au niveau de l'éducation.

Il me paraît important, à l'occasion des signaux internationaux que nous donnons, que nous fassions preuve d'humilité en ayant conscience que de nombreux combats ont été menés en Belgique. Ces combats ne sont d'ailleurs malheureusement pas encore terminés. L'assassinat d'Ihsane, en 2012, auquel a fait référence M. Flahaux tout à l'heure, prouve bien que la question de l'homophobie n'est pas close dans notre pays. Il s'agit d'un combat quotidien qu'il faut poursuivre.

Au niveau international, chacun doit aussi faire preuve d'humilité. Il convient de rappeler que, par le  passé, les pays occidentaux ont introduit – je pense ici en particulier à la période coloniale britannique – dans leur Code pénal la criminalisation de l'homosexualité. À cette époque, les pays occidentaux ne donnaient pas vraiment l'exemple.

Quoi qu'il en soit, il est important, pour nous, que ce signal soit envoyé, même si nous n'étions pas présents lors de l'examen de cette proposition en commission puisque nous ne pouvons pas assister à toutes les réunions de commission. C'est la raison pour laquelle le PTB votera cette proposition de résolution.

It seems to me important, on the occasion of the international signals we give, that we demonstrate humility being aware that many battles have been fought in Belgium. Unfortunately, these battles are not yet over. The assassination of Ihsane, in 2012, to which Mr. Flahaux just recently proves well that the issue of homophobia is not closed in our country. This is a daily struggle that needs to be continued.

At the international level, everyone must also demonstrate humility. It should be remembered that in the past, Western countries have introduced – I think here in particular of the British colonial period – in their Criminal Code the criminalization of homosexuality. At that time, the Western countries did not really give the example.

In any case, it is important for us that this signal is sent, even if we were not present when we were examining this proposal in committee since we cannot attend all committee meetings. That is why the PTB will vote on this resolution.
