Mijnheer de voorzitter, ik heb vorige week inderdaad gevraagd om dit ontwerp te verdagen omdat ik nog enkele punten ernstig wou nakijken. In het verslag dat vorige week op mijn bank lag, wees de heer Coveliers er reeds op dat niemand wist over welke bedragen wij hier spraken. De minister had in de commissie duidelijk gezegd dat het prijskaartje volledig door het Vlaamse Gewest zou worden betaald. Dat scheen mij toen onlogisch. Ik heb dat nagekeken en het blijft onlogisch. Het wordt nog meer onlogisch als men weet dat niemand de financiële weerslag van dit geheel kent. Ik denk niet dat het een goed teken is als we deze wet nog maar eens, voor de vierde of vijfde keer, wijzigen. Behalve enkele Antwerpse specialisten weet niemand nog waarover het gaat. Het gaat over enkele miljarden franken — maar niemand weet over hoeveel — schulden uit het verleden. Zoals iedereen weet is deze Staat sinds 1993 hervormd. Ik zie dan ook niet in waarom Vlaanderen voor de hele staatshervorming moet opdraaien. Deze wet gaat terug tot 1958.
Ik denk dat dit een slechte manier van werken is. De heer Coveliers wenst daarop te reageren, maar ik heb mij goed geïnformeerd en weet dat mensen uit de bedrijfswereld in dezelfde richting denken. Als het Vlaamse Gewest de lasten draagt, zal er ergens moeten worden bespaard, want men kan dat geld toch niet zomaar uit een hoge hoed toveren? Deze zaak zou zeker geen weerslag mogen krijgen op de activiteiten van de Antwerpse haven. Deze coalitie — ik richt mij daarbij zeker tot de heer Coveliers — heeft reeds in het verleden, ter gelegenheid van de behandeling van het NMBS-dossier, duidelijk gesteld dat de Antwerpse haven niet meer van nationaal belang is en dat is blijkbaar ook in dit dossier niet het geval.

De wet van 3 november 1967 regelt het loodsen van zeevaartuigen. Op basis van deze wet gingen de rechtbanken en hoven ervan uit dat, rekening houdende met de theorie van de aangestelden, de aansteller, zijnde de Belgische Staat, aansprakelijk was voor de fouten van de loodsen. In 1988 heeft de wetgever gezegd — de voorzitter zal zich dat zeker herinneren, want de minister van Verkeer was toen nog een zekere Herman De Croo — dat de aansprakelijkheid van de loodsen werd opgeheven op basis van een in het zeerecht algemeen aanvaard principe dat de kapitein altijd meester blijft van zijn schip. Men heeft een juridische fictie gecreëerd, die stelde dat wanneer er een loods aan boord wordt genomen — ook al wordt men daartoe verplicht door het land op wiens wateren men vaart — de loods aansprakelijk blijft. Daarover bestaat geen enkele betwisting, maar de toenmalige wetgever heeft, op voorstel van de toenmalige minister van Verkeer, een terugwerkende kracht van 30 jaar ingevoerd. Door deze verjaring vervielen alle hangende procedures bij hoven en rechtbanken. Minstens één partij stapte daarop naar het Europees Hof voor de Rechten van de Mens en de zaak Pressos Compania Naviera werd aanhangig gemaakt. Het Hof heeft gezegd dat de Belgische Staat het recht had om de verantwoordelijkheid niet langer op zich te nemen en ze conform het zeerecht over te dragen op de kapitein of de eigenaar van het schip. Toch had de Belgische Staat, conform het Europees Verdrag, niet het recht om een terugwerkende kracht van 30 jaar in te voeren. Het arrest dateert van 1995. De minister van Justitie heeft toen zeer terecht gezegd, handelend als een goede democraat en gelovend in de rechtsstaat, dat dit arrest in onze wetgeving diende te worden geïmplementeerd en dat de terugwerkende kracht uit de wet van 1988 moest worden gelicht. Dat is wat nu gebeurt. Het is volledig conform de rechtsprincipes en wij moeten dat doen.
Tijdens de behandeling van het ontwerp heb ik aan de minister van Justitie gevraagd, gelet op de toebedeling van de bevoegdheid over de zeehavens aan de gewesten — nu geldt dat alleen voor het Vlaamse Gewest, omdat het Waalse Gewest geen zeehavens heeft, tenzij Brussel, maar dat laten wij even buiten beschouwing —, of de gevolgen alleen gelden voor het Vlaamse Gewest. De minister heeft daarop bevestigd dat het Vlaams Gewest bij de bevoegdheidsoverdracht niet alleen de baten, maar ook de schulden en vorderingen heeft overgenomen. De minister heeft verzekerd dat daarover in de commissies overleg werd gepleegd met het Vlaamse Gewest en met de minister-president. Niemand weet hoeveel vorderingen er nog zullen worden gerealiseerd, omdat er nog uitspraken moeten worden gedaan en omdat de verantwoordelijkheid soms ten onrechte bij de loods zou kunnen worden gelegd.
Het kan dus dat de kapitein toch aansprakelijk is. De vordering wordt dan afgewezen. Niemand kent dat bedrag. Indien men niet tot een akkoord zou komen tussen de Vlaamse en de federale regering, dan heeft de eisende partij in deze de Belgische Staat gedaagd. Ofwel komt het Vlaamse Gewest vrijwillig tussen in de procedure, ofwel doet het dat niet. In het tweede geval zal de Belgische Staat het Vlaamse Gewest in vrijwaring en tussenkomst moeten dagen en zal de rechtbank of het hof dit moeten uitmaken. Dat is alles. Het is evident dat dit niet op kosten van de Antwerpse haven mag gebeuren is evident. Het is echter een zaak van de Vlaamse regering. Als zij veroordeeld wordt, moet zij beslissen op welke post ze dit gaat aanrekenen. Wij hebben daar in een goed federalisme niets over te zeggen. Degene die veroordeeld wordt, zal het moeten aanrekenen. Ik zie het probleem zoals het door de heer Sevenhans wordt aangehaald dan ook niet. Voor mij is het zo klaar als pompwater.

The Minister confirmed that the Flemish Region has taken over not only the profits, but also the debts and claims. The Minister has assured that this was discussed in the committees with the Flemish Region and with the Prime Minister-President. No one knows how much progress will still be made, because there are still statements to be made and because the responsibility could sometimes be misleading.
Therefore, the captain may be liable. The claim will then be rejected. No one knows that amount. If an agreement is not reached between the Flemish and the Federal Government, the claiming party has sued the Belgian State. Either the Flemish Region voluntarily intervenes in the procedure, or it does not.
