                    Mijnheer de minister, tot 2006 konden militairen zich niet kandidaat stellen voor de verkiezingen, noch politieke activiteiten uitoefenen. Er was destijds redelijk wat terughoudendheid. De argumenten daarvoor waren de neutraliteit die in het gedrang zou komen en het risico dat de doeltreffendheid en de activiteiten van het leger zouden worden ondermijnd.

In 2006 was er al wat politieke druk en kwam er passief kiesrecht op lokale en provinciale niveaus, passief kiesrecht want in de praktijk was het onmogelijk. Militairen die een lokaal politiek mandaat wilden uitoefenen, moesten verplicht onbetaald verlof nemen, dus geen wedde, geen opbouw van anciënniteit of pensioenrechten gedurende dat politiek verlof. Die strikte regelgeving betekende zo'n grote financiële achteruitgang dat het onmogelijk werd om aan politiek te doen.

Heel weinig militairen zetten dan ook de stap. Militairen zijn verplicht hun intentie om zich kandidaat te stellen, te kennen te geven, dus wij beschikken over cijfers. Bij de vorige lokale verkiezingen waren er 141 kandidaten onder de militairen, van wie 20 werden verkozen. Slechts vijf van hen zetten uiteindelijk de stap en werden meteen in onbetaald politiek verlof geplaatst. In 2014 was er nog één militair over. Vandaag, in 2017, zijn de geesten gelukkig al wat meer gerijpt.

Het voorliggend wetsvoorstel vergemakkelijkt de deelname aan de lokale en provinciale verkiezingen en vergemakkelijkt het opnemen van de daaruit vloeiende mandaten. Het politiek verlof wordt afgestemd op dat van de federale ambtenaren. Het is een flinke stap voorwaarts en een wezenlijke verandering. Politieke rechten geven overigens geen vrijgeleide om te doen wat men wil. Wij moeten niet vrezen voor het verdwijnen van de neutraliteit van militairen. Wij moeten niet vrezen voor een rolverwarring. Militairen moeten zich onthouden van elke politieke activiteit tijdens de diensturen. Met andere woorden, geen verkiezingsborden, geen flyers, geen affiches binnen de muren van de kwartieren, net zoals dat trouwens ook taboe is in bijvoorbeeld scholen.

Until 2006, military personnel were not allowed to stand as candidates for elections, nor to engage in political activities. There was reasonable restraint at the time. The arguments for this were the neutrality that would be compromised and the risk that the effectiveness and activities of the military would be undermined.

In 2006, there was already some political pressure and passive voting rights at local and provincial levels, passive voting rights because in practice it was impossible. Military soldiers who wanted to exercise a local political mandate were obliged to take unpaid leave, thus no betting, no build-up of old age or pension rights during that political leave. That strict regulation meant such a major financial downturn that it became impossible to engage in politics.

Very few soldiers take the step. The military is obliged to disclose their intention to be a candidate, so we have numbers.                     Het wetsvoorstel is eindelijk een stevige stap voorwaarts, maar ik steek niet onder stoelen of banken dat het voor mij nog verder mocht gaan. In onder meer Frankrijk, Duitsland, Nederland, Italië, Spanje, Portugal en Denemarken kunnen militairen zich verkiesbaar stellen op alle niveaus, ook nationaal en Europees. Ik vind het eigenaardig dat dat bij ons niet kan. Op dit ogenblik krijg ik van de defensiestaf, noch van de vakbonden, noch van politieke fracties een overtuigend argument daarvoor. Ik hoop dus dat de geesten verder zullen rijpen.

Wij staan hoe dan ook op minder dan een jaar van de gemeenteraadsverkiezingen. Het is de hoogste tijd dat er vooruitgang komt. Ik hoop dat iedereen dit wetsvoorstel zal steunen omdat het een teken is van respect. Wie dit voorstel steunt, maakt duidelijk vertrouwen te hebben in de militair als mogelijk verkozene. Verder is het een meerwaarde en een verrijking voor de politiek, indien mensen met allerlei achtergronden niet alleen kunnen deelnemen aan de politiek, maar die ook voluit kunnen beoefenen.

                    Monsieur le ministre, chers collègues, l'objectif du texte proposé aujourd'hui était simple dans le chef de la N-VA: offrir aux militaires la possibilité de se présenter dorénavant aussi aux élections législatives (fédérales, régionales et européennes) et non plus uniquement aux élections provinciales et communales, comme c'est déjà le cas.

Ce débat avait déjà eu lieu lors de la précédente législature, il avait été rejeté par plusieurs partis qui sont pourtant cosignataires du présent texte.

Dans le texte amendé par la majorité elle-même, il n'en est plus rien. La N-VA a déposé des amendements en commission limitant l'application de cette proposition de loi au niveau local et provincial. En conclusion, nous revenons à la situation actuelle si ce n'est que ce texte, comme ma collègue l'a dit, aligne désormais pour ces niveaux de pouvoir, les militaires et les règles en vigueur pour les membres du personnel des services publics.

Il est vrai que lors des auditions, tant les syndicats que l'état-major ont été très critiques à l'égard de ce texte. On rejoint la position qui a toujours été défendue par mon groupe en la matière. Pour nous, il s'agit de respecter la stricte neutralité de la Défense nationale et des militaires mais aussi d'assurer la disponibilité inhérente à leur fonction. Ils jouissent déjà de la possibilité d'exercer leurs mandats locaux et provinciaux. Étendre cette possibilité aux autres niveaux de pouvoir peut potentiellement porter atteinte à cette neutralité.

Mon analyse et la position d'opposition au texte d'origine que j'ai défendues en commission avec ma collègue Julie Fernandez, n'ont, à aucun moment, remis en cause les compétences et aptitudes de nos militaires. Tous nos positionnements sur d'autres propositions ou projets peuvent en attester si besoin en est encore.

Au-delà du besoin de neutralité et d'éviter tout conflit d'intérêts, la volonté des auteurs pose également la question d'une différence de traitement inexplicable vis-à-vis des policiers notamment.

Mr. Minister, dear colleagues, the objective of the text proposed today was simple in the head of the N-VA: to offer the military the possibility to present themselves from now on also in the legislative elections (federal, regional and European) and not only in the provincial and municipal elections, as is already the case.

This debate had already taken place in the previous legislature, it had been rejected by several parties who are, however, co-signators of the present text.

In the text amended by the majority itself, there is no more. The N-VA submitted amendments in committee limiting the application of this bill to local and provincial levels. In conclusion, we return to the current situation if it is only this text, as my colleague said, now aligns for these levels of power, the military and the rules in force for members of the staff of public services.

It is true that during the hearings, both the trade unions and the staff were very critical of this text. I agree with the position that has always been defended by my group on this subject. For us, it is about respecting the strict neutrality of the National Defense and the military, but also to ensure the inherent availability of their function. They already enjoy the opportunity to exercise their local and provincial mandates. Extending this possibility to other levels of power can potentially undermine this neutrality.

My analysis and the position of opposition to the original text, which I defended in committee with my colleague Julie Fernandez, have, at no time, questioned the skills and aptitudes of our military. All our positions on other proposals or projects can testify if there is still need for them.

Beyond the need for neutrality and to avoid any conflict of interest, the will of the authors also raises the question of an unexplained difference of treatment towards police officers in particular.

                    Je rappellerai la déontologie policière: "Les membres du cadre opérationnel s'abstiennent en toutes circonstances de manifester publiquement leur opinion politique et de se livrer publiquement à des activités politiques. Dans l'exercice de leur fonction, tous les membres du personnel observent une stricte neutralité dans leurs rapports avec les mandataires politiques." Ces règles valent également pour les magistrats. Il est donc pleinement justifié de prévoir une approche uniforme des droits politiques dans les corps spéciaux que sont la magistrature, la police et l'armée.

Ce texte pose aussi la question du sens des priorités de la majorité quand on parle de notre armée et des conditions de travail des militaires à l'heure où l'attrition est très élevée. Était-ce vraiment une priorité dans le contexte humain et matériel que connaît notre Défense suite aux coupes budgétaires décidées par ce gouvernement?

Dans les modifications du texte, on évoque aussi le droit fondamental qu'est l'éligibilité dans une société démocratique. Mais alors, pourquoi ne pas modifier la loi qui interdit aux militaires de faire grève? Le droit de grève est aussi un droit fondamental dans une société démocratique. Pourtant, on ne le leur octroie pas.

Amendments to the text also refer to the fundamental right to be eligible in a democratic society. But then, why not change the law that prohibits the military from striking? The right to strike is also a fundamental right in a democratic society. However, it is not granted to them.

Avant d'être interrompu par ma collègue, je disais qu'on pourrait envisager, tant qu'on y est, d'accorder le droit de grève aux militaires. Pourquoi pas, finalement? Mais sur ce point, je crois que la N-VA ne serait pas tout à fait d'accord. En effet, si on leur accordait le droit de grève, vu les rythmes, le budget rogné, les conditions de travail que cette majorité leur impose avec sa vision du militaire "bon à tout faire", je suis certain que de nombreux militaires seraient contents de pouvoir faire grève. Ils l'ont, en tout cas, démontré, en novembre 2016, à l'occasion de leur manifestation contre les décisions de ce gouvernement, notamment en matière de pensions, qui prolongent leur carrière unilatéralement, comme vous le savez, de sept ans.

Je terminerai mon intervention en annonçant que nous nous abstiendrons sur le texte tel qu'amendé par la majorité qui nous est soumis aujourd'hui. En effet, il ne vise plus qu'à aligner le régime de congés politiques applicable aux militaires sur le régime qui s'applique aux fonctionnaires.

Si nous sommes bien loin des velléités présentes dans le texte d'origine, nous continuons à penser qu'il ne s'agit pas, même dans cette version amoindrie du texte, d'entretenir des différences en la matière entre les militaires et les policiers, par exemple.

Bij de bespreking in de commissie wilden wij eigenlijk verder gaan en ingaan op het oorspronkelijke voorstel. De indieners zwakten het voorstel echter zelf af met een amendement op het laatste ogenblik. Het resultaat is, om het met een spreekwoord te zeggen, dat de olifant een muis heeft gebaard.

Het voorliggende voorstel verandert weinig. Er is op lokaal vlak uiteraard meer mogelijkheid voor de militairen om deel te nemen aan het politieke debat en om politieke mandaten uit te oefenen, maar op hoger niveau verandert er niets. Wij zullen hier in het Halfrond dus nog steeds geen militairen als collega kunnen hebben.

Eigenlijk moet men de vraag stellen waarom zij niet het recht hebben ook op dit niveau deel te nemen. Wij wilden de discussie aangaan om hun rechten uit te breiden tot een hoger niveau. Ik stel vast dat, indien niet in dit Parlement, dan toch in de kranten, ook de Open Vld die vraag stelde. Europarlementslid Hilde Vautmans wees erop dat men tot twee weken geleden hoog van de toren blies alsof er wezenlijk iets zou veranderen, om dan op het laatste nippertje terug te krabbelen. Een gemiste kans, volgens mevrouw Vautmans.

                    Iedereen weet dat Vlaams Belang al jaren vragende partij is om de politieke rechten van militairen buiten dienstverband zo ruim mogelijk te maken. Ik heb de verslagen van de hoorzittingen gelezen en gezien dat de legertop geen voorstander is van uitbreiding naar de parlementen. Ik heb echter ook gelezen dat de meeste vakorganisaties bij Defensie dat wel zijn. Dat hebben ze ook duidelijk laten blijken in die hoorzittingen. Als we de argumenten lezen die de legertop aanhaalt, dan vindt mijn fractie toch dat die maar heel licht wegen. Ze wegen zeker niet op tegen het democratisch recht om als burger dergelijke mandaten te ambiëren. Ik heb reacties van verschillende partijen gelezen die er net, zoals wijzelf, voorstander zijn om dat recht uit te breiden tot nationale parlementen, zoals dat in Nederland en andere landen vandaag al het geval is.

Ik geef u vandaag de kans om kleur te bekennen, want wij hebben een amendement ingediend voor die uitbreiding, zoals het initiële wetsvoorstel eigenlijk ook ambieerde. Ik reken straks uiteraard op de steun bij de stemming over dat amendement van al degenen die zich grote voorstanders hiervan tonen.

                    Mijnheer de voorzitter, collega's, ik kan alleen maar de kamerleden opnieuw feliciteren met het geleverde werk. Ik meen dat we hiermee effectief een stap vooruit zetten.

Ik zou toch willen onderstrepen dat er ergens iets niet klopt in het verhaal dat de PS hier zojuist is komen vertellen. De partij geeft toe mee te hebben gediscussieerd en akkoord te gaan met het feit dat militairen – die zij altijd als een klasse apart heeft beschouwd en die in een kooi moeten worden bewaard – wel op lijsten mogen staan, stemmen verzamelen en eventueel zelfs verkozen mogen worden. Als ze dan echter verkozen worden, zijn de stemmen wel voor de partij, maar het mandaat dat daarmee samenhangt, geeft de partij aan haar traditionele vrienden. Kortom, ze bedankt de dames en heren militairen; zij hebben hun best gedaan, maar voor de rest gaat de partij daarmee aan de slag. Ik begrijp dat niet. Dat is wel een heel erg vreemde visie.

Ik ben ervan overtuigd dat nu de logica wordt doorgetrokken, waardoor wie kandideert op het niveau waarop dat vandaag mogelijk is, ook effectief dat mandaat kan opnemen. Wat heeft het immers voor zin om de mogelijkheid tot kandideren te scheppen, om het vervolgens voor de desgevallend verkozen kandidaat praktisch onmogelijk te maken om dat mandaat uit te oefenen, om te doen waarvoor de kiezer hem verkozen heeft?

Geachte Kamerleden, nogmaals wens ik u proficiat met deze stap vooruit. We zullen wel zien wat de toekomst brengt.

                    Monsieur le président, je suis quand même surpris par les remarques du ministre, parce qu'il semble penser qu'on va avoir des dizaines de militaires sur nos listes, mais on n'en a pas, monsieur le ministre!

Le plus militaire chez nous, c'est peut-être André Flahaut mais il n'est pas militaire. C'est un amateur de l'armée! C'est un connaisseur! Mais il n'y a pas de militaires chez nous! Vous nous dites: "C'est incroyable, on va mettre des militaires sur nos listes et ils ne pourront pas siéger! Quel scandale!"

Il est un autre cas bien plus fréquent que celui que vous citez là: des dizaines de fonctionnaires communaux, candidats sur des listes aux élections communales ne peuvent pas siéger. Ce cas-là est bien plus fréquent que celui de l'armée que vous évoquez. Il y a des tas de cas similaires!

Ce que vous dites, c'est qu'on a voté par le passé la possibilité pour un militaire d'être candidat, alors que l'exercice du mandat n'est pas possible. Aujourd'hui, on permet à une personne qui a été élue d'exercer effectivement son mandat. Tel est l'objet de la proposition de loi de la majorité. On rend possible le fait qu'un candidat élu exerce son mandat au même niveau que celui où il peut être élu aujourd'hui. On rend cela possible! Ces candidats ne sont pas seulement là pour vous apporter des votes mais aussi pour exercer leur mandat. C'est l'objet de la décision d'aujourd'hui.
