Mijnheer de voorzitter, mijnheer de minister, collega's, het probleem dat mensen in een schuldenspiraal terechtkomen is gekend. Heel terecht heeft de Actie Welzijnszorg haar adventscampagne van dit jaar helemaal in het teken van de schuldoverlast geplaatst. Zij gebruiken hiervoor de volgende titel: "Schulden? Wie wordt er beter van?". Het is interessant om weten dat vooral het consumentenkrediet een bijzonder groot aandeel heeft in de schuldoverlast. Die wetenschap is belangrijk als men dit probleem preventief wil aanpakken. Wij hebben een wet op de collectieve schuldenregeling, waarin de oprichting van een fonds ter bestrijding van de overmatige schuldenlast is voorgesteld. Dit fonds is er nog niet. Zeer tot onze spijt en ongenoegen, mijnheer de minister, zal dit fonds pas in 2003 operationeel worden. Wij moeten hier halsoverkop over zaken stemmen die niet goed zijn, maar het fonds wordt pas in 2003 operationeel! Volgens ons zou dat veel sneller moeten kunnen. Het gaat tenslotte over de uitvoering.
Met het wetsontwerp dat hier voorligt wil men vooral de werking van het fonds wijzigen en de financiering verbeteren of billijker maken ten aanzien van de kredietgevers die het fonds moeten stijven. In de voorgestelde oplossing dragen de ondernemingen bij in de financiering van het fonds op basis van de debetachterstand van de wanbetalingen. Met andere woorden, de ondernemingenkredietgevers die een groter aandeel hebben in die kredietachterstand zullen meer aan het fonds moeten bijdragen.
De regering stelt voor om een coëfficiënt toe te passen op het totaal bedrag van de betalingsachterstand van de kredietovereenkomsten. Wij hebben zelf voorgesteld om die coëfficiënt niet lineair maar exponentieel te maken. Voor ons is het zeer belangrijk dat agressieve kredietverschaffers worden gestraft. Dat is een wezenlijk punt.
Op deze wijze kan het fonds ook een preventief karakter krijgen, want kredietgevers die onvoorzichtig zijn en die agressieve reclame voeren, moeten weten dat als achteraf hun aandeel in de kredietachterstand stijgt, zij exponentieel meer in dit fonds zullen moeten bijdragen. De minister en de meerderheid vonden dit niet nodig, want volgens de minister is de bedoeling niet zozeer de kredietgevers te bestraffen, dan wel het fonds te stijven.
Inspelend op het belang van preventie en het voorkomen van schulden, wil onze fractie het fonds nog twee bijkomende opdrachten geven. Wij willen dat het fonds ook middelen ter beschikking kan stellen voor informatie- en sensibilisatiecampagnes van de overheid om de overmatige schuldenlast te bestrijden. Wij willen ook dat de instellingen die ressorteren onder de Gewesten en die erkend zijn om de overmatige schuldenlast te bestrijden, ook vanuit dit fonds worden gefinancierd. Ook de actie Welzijnszorg, die blijkbaar heel breed wordt gesteund, vraagt met aandrang om meer middelen in te zetten voor preventie, om meer te investeren in informatie- en sensibilisatiecampagnes.
Zoals mevrouw Brepoels daarnet heeft gezegd, had de minister geen bezwaar tegen ons amendement, maar tot onze verbazing heeft de meerderheid het weggestemd. Dat is onbegrijpelijk. Het is onbegrijpelijk dat de meerderheid er wel mee akkoord gaat dat de erelonen uit dit fonds worden betaald, maar dat zij niet wil dat het fonds wordt aangewend voor de financiering van preventieve campagnes. Het is onbegrijpelijk dat partijen als de SP.A, als Agalev en Ecolo dit amendement niet steunen, temeer daar de minister er geen enkel bezwaar tegen had. Daarom dien ik het amendement opnieuw in. Ik hoop dat de meerderheid zich bezint en haar mening wijzigt, zodat we meer aan sensibilisatie en informatieverspreiding in het kader van de overmatige schuldenlast kunnen doen.
Tenslotte, mijnheer de voorzitter, vraag ik uw bijzondere aandacht voor een incident in de commissie. Tijdens de bespreking van het wetsvoorstel, ontving de commissie een schrijven van de voorzitter van de rechtbank van eerste aanleg te Gent, de heer Beaucourt. Hij wees erop dat overheidsadministraties zoals de fiscus, de RSZ, maar ook instellingen als Electrabel, niet bereid zijn te werken aan een minnelijke aanzuiveringsregeling. De kern van de zaak is dat de fiscus in de minnelijke procedure systematisch weigert fiscale schulden kwijt te schelden en zodoende de hele procedure van collectieve schuldregeling op de helling zet.
Dit schrijven gaf uiteraard aanleiding tot een discussie en de commissievoorzitter vroeg de minister zijn collega van Financiën hierover te ondervragen. Terwijl de minister van Financiën om een antwoord werd gevraagd, besloot de commissie verder te werken. Op 27 november 2001 werd unaniem — meerderheid en oppositie — beslist dat over dit wetsontwerp niet zou worden gestemd in de openbare vergadering vooraleer het antwoord van de minister van Justitie te hebben ontvangen.
Op de commissievergadering van 4 december hebben we nog altijd geen antwoord van de minister van Financiën ontvangen en beslist de meerderheid plotseling dat er toch niet zal worden gewacht op het advies van de minister van Financiën om over het wetsontwerp te stemmen. De week daarvoor werd unaniem beslist dat er niet wordt gestemd, een week later wordt beslist dat er wel wordt gestemd. Ondertussen is er nog altijd geen antwoord van de minister van Financiën.
Mijnheer de voorzitter, ook wij wensen dat dit ontwerp snel wordt goedgekeurd, maar een wet goedkeuren die niet of moeilijk uitvoerbaar is, is geen daad van behoorlijk bestuur, te meer omdat ondertussen minister Verwilghen in het kader van de begrotingsbesprekingen, meedeelt dat hij dit probleem zal regelen in een afzonderlijk wetsontwerp. Ik kan niet meer volgen. Ik vind dat weer een zeer mooi voorbeeld van een snel en efficiënt bestuur. Er is in de commissie een probleem vastgesteld en door iedereen erkend. De minister geeft de oppositie gelijk; er wordt aan de minister van Financiën een vraag gesteld en er wordt afgesproken te wachten op zijn antwoord, maar nadien zegt men dat er toch niet meer wordt gewacht. Het antwoord is er ondertussen nog niet. Men zal dit wetsontwerp nu goedkeuren in het besef dat het ontoereikend is, maar ondertussen kondigt een andere minister een wetsontwerp aan om dit te regelen. Begrijpe wie begrijpe kan, maar ik begrijp het niet. Nogmaals, dit is allerminst een voorbeeld van efficiënt en behoorlijk bestuur.
We hebben in de commissie voor dit ontwerp gestemd, omdat wij dit ontwerp steunen. We hebben dit echter goedgekeurd onder de afgesproken voorwaarden, namelijk dat er een antwoord van de minister van Financiën zou komen alvorens we dit zouden goedkeuren in de openbare vergadering. De meerderheid ging hiermee akkoord. De voorwaarden zijn echter niet vervuld en tenzij de minister ons nu het antwoord van de minister van Financiën kan voorleggen, overwegen wij om ons in deze te onthouden. Ik heb ook aangekondigd dat wij ons amendement opnieuw indienen. Het is ondertussen op de banken rondgedeeld en we zullen het straks bespreken.

Mr. Speaker, Mr. Minister, colleagues, the problem of people falling into a debt spiral is known. The Action Welzijnszorg rightly placed its advent campaign this year in the sign of debt loss. They use the following title: “Debt? Who will be better?” It is interesting to know that especially the consumer credit has a ⁇ large share of the debt loss. This science is important if one wants to address this problem preventively. We have a law on collective debt arrangement, which proposes the establishment of a fund to combat excessive debt burden. This fund has not yet existed. To our great regret and dissatisfaction, Mr. Minister, this fund will not be operational until 2003. We have to vote over the neck here on matters that are not good, but the fund will not be operational until 2003! In our opinion, this should be much faster. Finally, it is about implementation.
The draft law, which is presented here, aims mainly to change the functioning of the fund and to improve or make the financing more equitable with respect to the lenders who need to tighten the fund. In the proposed solution, the companies will contribute to the fund financing on the basis of the debit default of the defaults. In other words, the corporate creditors who have a greater share in that credit backfall will need to contribute more to the fund.
The Government proposes to apply a coefficient to the total amount of late payment of the credit agreements. We have proposed to make this coefficient not linear but exponential. For us, it is very important that aggressive lenders are punished. This is an essential point.
In this way, the fund can also gain a preventive character, as lenders who are careless and who carry out aggressive advertising should know that if their share of the credit backwardness subsequently increases, they will have to contribute exponentially more to the fund. The Minister and the majority did not find this necessary, because according to the Minister the intention is not so much to punish creditors, as to stiffen the fund.
Responding to the importance of prevention and debt prevention, our group wants to give the Fund two additional assignments. We want the Fund to also provide resources for public information and awareness campaigns to combat excessive debt burden. We also want the institutions that belong to the regions and are recognized to combat excessive debt burden to also be financed from this fund. Also the Action Welfare Care, which appears to be very widely supported, urges more resources to be used for prevention, to invest more in information and awareness-raising campaigns.
As Mrs. Brepoels just said, the Minister did not object to our amendment, but to our surprise the majority voted against it. That is incomprehensible. It is incomprehensible that the majority would agree to pay the honorary payments from this fund, but that they would not want the fund to be used for the financing of preventive campaigns. It is incomprehensible that parties such as SP.A, Agalev and Ecolo do not support this amendment, especially since the minister had no objections to it. That is why I re-introduce the amendment. I hope that the majority will reflect and change their minds so that we can do more to raise awareness and disseminate information in the context of the excessive debt burden.
Finally, Mr. Speaker, I ask your special attention to an incident in the committee. During the discussion of the bill, the committee received a letter from the President of the Court of First Instance in Gent, Mr. Beaucourt. He pointed out that government administrations such as the Fiscal Office, the RSZ, but also institutions such as Electrabel, are not willing to work on a friendly cleaning scheme. The essence of the case is that in the amicable procedure the tax authority systematically refuses to remove tax debts and thus puts the whole procedure of collective debt settlement on the slope.
This letter, of course, gave rise to a discussion and the chairman of the committee asked the minister to question his colleague of Finance about this. While the Minister of Finance was asked for a response, the committee decided to continue to work. On 27 November 2001, unanimously — majority and opposition — it was decided that this bill would not be voted in the public meeting until the Minister of Justice has received the answer.
At the committee meeting of 4 December we have still not received a response from the Minister of Finance and the majority suddenly decides that there will never be waiting for the advice of the Minister of Finance to vote on the bill. A week before that, it was unanimously decided that there would be no vote, a week later it was decided that there would be no vote. There is still no response from the Minister of Finance.
Mr. Speaker, we also wish that this draft will be approved quickly, but approving a law that is not or is difficult to implement is not an act of good governance, more so because meanwhile Minister Verwilghen, in the context of the budget talks, announces that he will resolve this issue in a separate draft law. I can no longer follow. I think this is another very good example of a quick and efficient administration. A problem was identified in the committee and recognized by everyone. The Minister gives the opposition the right; a question is asked to the Minister of Finance and it is agreed to wait for his answer, but then it is said that there is no longer waiting. The answer is not yet there. One will now approve this bill in the realization that it is inadequate, but in the meantime another minister announces a bill to regulate this. Understand who can understand, but I do not understand. Again, this is by no means an example of efficient and decent governance.
We voted in the committee for this draft because we support this draft. However, we approved this under the agreed conditions, namely that there would be a response from the Minister of Finance before we would approve it in the public meeting. The majority agreed to this. However, the conditions are not fulfilled and unless the Minister can present us with the Minister of Finance’s response now, we are considering refraining from it. I also announced that we will submit our amendment again. In the meantime, it has been distributed around the banks and we will discuss it later.

Monsieur le président, monsieur le ministre, chers collègues, nous attendions ce projet de loi avec une impatience toute particulière, puisqu'il avait été déposé sur la table il y a plus d'un an. Certes, à l'époque, le mode de financement assuré par les organismes de prêt était différent de la formule retenue aujourd'hui.
La solution actuelle d'alimenter ce fonds en demandant désormais aux organismes de prêt de se baser sur la part de défaut de paiement responsabilise les organismes de paiement et pénalise ceux qui ont prêté sans prendre les précautions suffisantes. L'alimentation de ce fonds est indispensable pour compléter les outils existants, à savoir l'excusabilité du failli et la centrale positive de crédits.
Nous attendons avec impatience la modification de la loi relative au règlement collectif des dettes sur la base des évaluations réalisées par l'Observatoire du surendettement. En effet, techniquement et pratiquement, des mesures doivent encore être prises afin que l'ensemble des personnes concernées puissent profiter de ces médiations de dettes sans plus avoir à subir la perversité de certains effets secondaires actuels.
Dans la mesure où ce dossier se trouve sur la table depuis de nombreux mois, je pense qu'il est maintenant temps de se prononcer sans hésitation à son sujet, même s'il ne pourra entrer en application qu'en janvier 2003.
Il est vrai que dans la configuration du projet actuel, ce fonds ne servira qu'à payer les frais des médiateurs et les frais de fonctionnement dans la procédure de règlement collectif des dettes lorsque le débiteur est insolvable. Je rejoins les préoccupations de Mme Creyf relativement à la nécessité de mettre en oeuvre des campagnes de sensibilisation et d'information pour éviter les comportements qui conduisent au surendettement. Je rejoins également sa préoccupation quant au financement de centres régionaux agréés pour remplir ces missions de médiation de dettes. Je sais qu'avant l'introduction de ce projet, des négociations avaient eu lieu entre les régions et le niveau fédéral, à l'occasion desquelles avaient été soulevés des problèmes de répartition de compétences et d'ingérence du fédéral dans les compétences régionales, d'autant que les médiations peuvent être réalisées via des ASBL ou des CPAS.

It is true that in the configuration of the current project, this fund will only be used to pay the fees of mediators and the operating costs in the collective debt settlement procedure when the debtor is insolvent. I agree with Mrs. Creyf’s concerns about the need to implement awareness and information campaigns to avoid behaviors that lead to overindebtedness. I also agree with his concern regarding the financing of authorised regional centers to fulfill these debt mediation tasks. I know that before the introduction of this project, negotiations were held between the regions and the federal level, during which issues of competence distribution and federal interference in regional competences were raised, especially since mediation can be carried out through ASBLs or CPASs.

D'accord, mais il est important pour nous que le travail de médiation de dettes soit valorisé de la même manière, qu'il soit effectué par des associations ou par les CPAS. Nous voulons absolument éviter un accaparement et un monopole des CPAS dans ce domaine.
Les négociations visant à déterminer si le fédéral peut aider, si on peut conclure des accords de coopération, etc. risquent, à mon avis, de prendre encore beaucoup de temps. Pour moi, la véritable priorité aujourd'hui est que ce fonds soit installé sur une base légale, même si sa mise en application effective viendra plus tard. Par ailleurs, je sais que la Région wallonne travaille et négocie aussi avec le pouvoir fédéral pour arriver à mettre en place différents outils. Pour l'instant, et malgré les craintes que j'exprime ici, je préfère que les choses en restent là. D'autant que les régions mènent aussi des campagnes de sensibilisation. Je pense qu'il faut veiller à ce qu'un niveau de pouvoir n'en paralyse pas un autre.
Quant à cette réponse attendue du ministre Reynders, j'estime que cette problématique dépasse largement le cadre de ce projet de loi. Nous rencontrons cette difficulté tant au niveau de l'excusabilité qu'à celui des médiations des dettes. L'administration des impôts, la TVA, l'ONSS sont des organismes qui refusent en général les règlements à l'amiable. Dès lors, s'il y a effectivement une interpellation à adresser au ministre, l'application de ce projet ne dépend pas directement de ce problème, même s'il faut le régler. Pour nous, il est d'autant plus urgent de régler cette question du règlement à l'amiable avec ces organismes publics que les recettes générées par l'impôt et par la TVA sont inférieures à celles qui sont normalement prévues. Il est donc clair que le ministre des Finances — je pense qu'il a déjà été interpellé à plusieurs reprises à ce sujet — doit prendre des mesures pour que ces recettes rentrent d'une manière plus efficace. Je pense aussi que le règlement à l'amiable permettra de générer des recettes qui ne peuvent être attendues pour l'instant de la part des personnes qui rencontrent des difficultés de paiement.
Pour moi, le vote de ce projet ne dépend pas de la réponse du ministre. Par contre, nous devons absolument interpeller le ministre des Finances pour qu'il prenne des mesures allant beaucoup plus loin que le texte qui nous est proposé aujourd'hui.
Voilà les raisons pour lesquelles nous voterons favorablement sur ce projet de loi.

We encounter this difficulty both at the level of forgiveness and at the level of debt mediation. The tax administration, the VAT, the ONSS are bodies that generally refuse settlements amicably. Therefore, if there is indeed an interpellation to be addressed to the Minister, the implementation of this project does not directly depend on this problem, even if it needs to be resolved. For us, it is all the more urgent to settle this issue of settlement amicably with these public bodies that the revenues generated by tax and VAT are lower than those normally planned. It is therefore clear that the Minister of Finance — I think he has already been questioned several times about this — must take steps to make these revenues return in a more efficient way. I also think that the amicable settlement will generate revenues that cannot be expected at the moment from people who are experiencing payment difficulties.
For me, the vote on this bill does not depend on the response of the Minister. On the other hand, we must absolutely call on the Minister of Finance to take measures that go far beyond the text that is proposed to us today.
That is why we will vote in favour of this bill.

Mijnheer de voorzitter, de rapporteur en de twee vorige collega's die het woord hebben gevoerd, verduidelijkten reeds dat het wetsontwerp beantwoordt aan een acute noodzaak. Het is inderdaad van belang dat het fonds, noodzakelijk voor de goede werking van de wettelijke regeling inzake de collectieve schuldenregeling, zo snel mogelijk in werking treedt. Vandaar dat onze fractie, zoals het ook al in de commissie is verwoord door collega Brepoels, dit ontwerp zal goedkeuren. Ik wil ook van de gelegenheid gebruikmaken om de aandacht te vestigen op twee aspecten.
In de eerste plaats is er het wetsvoorstel dat collega Bourgeois en ikzelf hebben ingediend naar aanleiding van het arrest van het Arbitragehof van 1 maart 2001, dat uiteindelijk via een amendement in het wetsontwerp werd ingevoegd. Ik ben de collega's dankbaar dat zij dit amendement hebben gesteund. Het amendement biedt een antwoord op de ongelijkheid die was ontstaan in het kader van deze wettelijke bepalingen, zoals het Arbitragehof ook al omschreef in zijn arrest van 1 maart 2001. Ik had dit graag even toegelicht, ook al is het een beetje technisch.
In de wet van 1998 wordt voor degenen die bankroet zijn gegaan op basis van de oude wet van 1851 een onderscheid gemaakt tussen degenen van wie het faillissement meer dan tien jaar geleden is afgesloten en degenen van wie het faillissement nog geen tien jaar geleden is afgesloten.
Volgens de wettelijke regeling van 1998 konden de schuldenaars van wie het faillissement nog geen 10 jaar geleden was afgesloten, maar op basis van de wet van 1851, geen beroep doen op de regeling inzake de overmatige schuldenlast. Op zich was dit reeds een ongelijkheid. Het Arbitragehof heeft in zijn arrest echter nog naar een bijkomende ongelijkheid verwezen ten aanzien van degenen die failliet zijn verklaard na de inwerkingtreding van de nieuwe faillissementswet van 1997. Ik verwijs dienaangaande naar het artikel 80 waarin de verschoonbaarheid werd mogelijk gemaakt en ook uitgebreid. Dit houdt in dat degenen die failliet worden verklaard na de faillissementswet van 1997, de mogelijkheid hebben om verschoonbaar te worden verklaard en aldus van hun overblijvende schulden worden ontheven.
Door dit in de nieuwe faillissementswet van 1997 op te nemen heeft de wetgever de gefailleerden die niet bankroet zijn verklaard en die geen criminele veroordeling hebben gekregen, een nieuwe kans gegeven. Dat was de ratio legis van het artikel 80 van de nieuwe faillissementswet van 1997. In de collectieve schuldenregeling werd dan in die ongelijkheid voorzien. Het Arbitragehof heeft geoordeeld dat, rekening houdend met artikel 80 van de nieuwe faillissementswet van 1997, het onderscheid tussen meer dan en minder dan tien jaar geleden niet wettelijk verantwoord is en in strijd is met de artikelen 10 en 11 van de Grondwet.
Om tegemoet te komen aan de bemerkingen van het Arbitragehof werd dit wetvoorstel ingediend dat op zijn beurt als amendement werd goedgekeurd. Op deze manier wordt een ongelijkheid rechtgezet.
Ik wil eveneens ingaan op de problematiek die de voorzitter van de rechtbank van eerste aanleg te Gent heeft aangebracht. We kunnen deze problematiek niet zo maar naast ons neerleggen omdat hetzelfde probleem zich hic et nunc voordoet in het kader van de nieuwe faillissementswet, in casu het aspect van de verschoonbaarheid. We moeten immers vaststellen dat de overheidsschuldeisers zoals Financiën, BTW, RSZ zich systematisch verzetten tegen de verschoonbaarheid. De rechtbank heeft de appreciatiebevoegdheid en kan het verzet van de overheidsinstellingen naast zich neerleggen en de verschoonbaarheid uitspreken. De voorzitter van de rechtbank van eerste aanleg te Gent heeft, mijns inziens, terecht deze problematiek aangekaart. Inzake de collectieve schuldenregeling moeten we een onderscheid maken tussen de twee procedureperiodes. Eerst gaat men over tot de minnelijke schuldenregeling. Lukt dit niet, dan gaat men over tot de gerechtelijke schuldenregeling waar de beslagrechter optreedt. Het grote voordeel van de minnelijke schuldenregeling via de schuldbemiddelaar is dat de schuldbemiddelaar over meer mogelijkheden beschikt, onder meer inzake de termijn. Wat de gerechtelijke schuldregeling betreft, heeft de wetgever immers duidelijk bepaald dat de maximale periode binnen dewelke de schuldenregeling moet gebeuren de 5 jaar niet mag overschrijden. In het kader van een minnelijke schuldenregeling wordt een overeenkomst bedongen tussen de schuldenaar, de schuldeiser en de schuldbemiddelaar en kan men de periode uitbreiden. De voorzitter van de rechtbank haalt aan dat hij statistieken kan voorleggen van minnelijke schuldenregelingen die de maximale termijn van 5 jaar overschrijden.
Het is bijzonder ergerlijk dat de overheidsschuldeisers zoals de BTW, Financiën, RSZ, Belastingen en ook Electrabel zich systematisch verzetten tegen een minnelijke schuldenregeling. Bij een gerechtelijke schuldenregeling kan de beslagrechter dit wel toestaan. Dit betekent dat de schuldenaar die zich reeds in een precaire financiële situatie bevindt — zo niet zou hij geen beroep doen op de procedure van collectieve schuldenregeling — verplicht wordt om over te stappen van een minnelijke regeling naar een gerechtelijke schuldenregeling over te gaan. Deze procedure is niet alleen langer en logger, maar verhoogt ook de financiële kosten voor de schuldenaar omdat de schuldbemiddelaar langer aan het werk en meer erelonen aanrekent.
Mijnheer de minister, tijdens het debat terzake in de commissie hebt u meegedeeld open te staan voor de kritiek die werd geleverd voor de veldwerkers. U hebt een reparatiewetgeving aangekondigd. Als ik me niet vergis hebt u eind januari 2002 als streefdatum vooropgesteld. Mijnheer de minister, het is, mijns inziens, belangrijk dat u ons terzake duidelijkheid verschaft en meedeelt wanneer de reparatiewet zal worden ingediend. We hebben reeds een reparatiewet goedgekeurd naar aanleiding van de faillissementswet.
Dan moeten wij ook duidelijkheid hebben over de punten die mevrouw Creyf noemde: zal het initiatief daaromtrent genomen worden door u of door de minister van Justitie? Ik hoop dat de discussie tussen u en de minister van Justitie niet zodanig lang zal duren dat de rechtsonderhorige daarvan uiteindelijk het slachtoffer zal worden.
Wij hebben van de minister van Financiën geen antwoord gekregen over de aangebrachte problematiek en die op het veld acuut is. Van u zouden wij graag vernemen wanneer die absoluut noodzakelijke reparatiewet eraan komt, zodat de wetgeving over de collectieve schuldenregeling de schuldenaar ten goede komt. Het probleem dat zich nu voordoet en door de overheidsschuldeisers in het leven is geroepen, gaat eigenlijk in tegen dat wat de wetgever bedoeld en beoogd heeft. Het gaat om gewone schuldenaars die om diverse redenen en meestal ter goeder trouw in zo'n grote schuldenlast zijn gekomen dat zij er niet meer zelfstandig uit geraken en een beroep moeten doen op tussenkomst door de rechtbank. In veel gevallen is dat niet gemakkelijk: door naar de rechtbank of een schuldbemiddelaar te gaan, geven zij eigenlijk net als een gefailleerde toe dat zij in hun leven mislukt zijn in de beheersing van hun schulden. Ik hoop dus dat uw reparatiewet voor dat punt een specifieke regeling zal uitwerken, evenals voor een aantal andere onduidelijkheden, zodat wij in de toekomst kunnen werken met een regeling voor de collectieve of de overmatige schuldenlast. Wie daarop een beroep doet, zou dan ook terecht moeten verkrijgen wat hij of zij vraagt.

The 1998 Act makes a distinction between those whose bankruptcy was concluded more than ten years ago and those whose bankruptcy was concluded less than ten years ago for those who went bankrupt under the old Act of 1851.
According to the 1998 legislation, debtors whose bankruptcy was closed not less than 10 years ago, but on the basis of the Act of 1851, could not invoke the over-debt scheme. In itself, this was already an inequality. However, the Court of Arbitration in its judgment still referred to an additional inequality with respect to those declared bankrupt after the entry into force of the new Bankruptcy Act of 1997. In this regard, I refer to Article 80, which enabled and extended decorability. This means that those who are declared bankrupt after the Bankruptcy Act of 1997 have the possibility to be declared dissolved and thus exempt from their remaining debts.
By incorporating this into the new Bankruptcy Act of 1997, the legislature has given a new chance to bankrupt persons who have not been declared bankrupt and who have not received a criminal conviction. That was the ratio legis of article 80 of the new Bankruptcy Act of 1997. The collective debt arrangement provided for this inequality. The Court of Arbitration has ruled that, taking into account Article 80 of the new Bankruptcy Act of 1997, the distinction between more than and less than ten years ago is not legally liable and is contrary to Articles 10 and 11 of the Constitution.
In response to the observations of the Arbitration Court, this bill was submitted, which in turn was approved as an amendment. This way the inequality is corrected.
I would also like to address the problem raised by the Chairman of the Court of First Instance in Gent. We cannot put this problem aside because the same problem arises hic et nunc within the framework of the new bankruptcy law, in this case the aspect of dischargeability. After all, we must note that the government creditors such as Finance, VAT, RSZ are systematically opposed to depreciability. The court has the power of appreciation and can lay aside the opposition of the public institutions and express the discretion. The Chairman of the Court of First Instance in Gent has, in my opinion, rightly addressed this problem. As regards collective debt arrangement, we must distinguish between the two procedural periods. First, we go to the friendly debt arrangement. If this does not succeed, it goes to the judicial debt settlement where the seizure judge acts. The major advantage of amicable debt settlement through the debt intermediary is that the debt intermediary has more options, including in terms of term. As regards the judicial debt settlement, the legislator has clearly provided that the maximum period within which the debt settlement must take place must not exceed 5 years. In the context of amicable debt settlement, an agreement is conditioned between the debtor, the creditor and the debt mediator and the period can be extended. The President of the Court claims that he can submit statistics of friendly debt arrangements that exceed the maximum period of 5 years.
It is ⁇ disturbing that government creditors such as VAT, Finance, RSZ, Taxations and also Electrabel systematically oppose a friendly debt arrangement. In the case of a judicial debt settlement, the seizure judge may allow this. This means that the debtor who is already in a precarious financial situation — otherwise he would not have resorted to the collective debt settlement procedure — is obliged to switch from a friendly settlement to a judicial debt settlement. This procedure is not only longer and logger, but also increases the financial costs for the debtor as the debt intermediary takes longer to work and more honorary payments.
Mr. Minister, during the debate on this matter in the committee you have communicated to be open to the criticism delivered to the field workers. You have announced a repair legislation. Le projet présente donc trois grands chapitres: - le refinancement de la Communauté germanophone; - l'élargissement de ses compétences; - la possibilité d'augmenter le nombre de membres du gouvernement de la communauté.
En ce qui concerne le refinancement, il est établi, par analogie à ce qui se fait dans les deux autres communautés, un système de financement qui tient compte du nombre d'élèves. A partir de 2002, la dotation de la Communauté germanophone inscrite au budget fédéral sera augmentée. De 2002 à 2011, des moyens forfaitaires seront octroyés. A partir de 2007, l'adaptation s'effectuera à concurrence de 91% de la croissance réelle du revenu national brut et les paramètres qui permettent de calculer cette dotation seront régulièrement actualisés.
La Communauté germanophone recevra également un pourcentage du bénéfice à distribuer de la Loterie nationale ainsi qu'une dotation spéciale compensant la perte subie en conséquence de la régionalisation de la redevance radio-TV.
Pour ce qui est de l'élargissement des compétences, la Communauté germanophone pourra, désormais, élaborer sa propre réglementation en matière de contrôle de dépenses électorales, de contrôle des communications gouvernementales ainsi qu'en matière de financement complémentaire des partis politiques.
En ce qui concerne la possibilité d'augmenter le nombre de membres du gouvernement, les tâches de ce gouvernement étant étendues à l'exercice de compétences régionales, la Communauté germanophone pourra faire passer de trois à maximum cinq le nombre de ses ministres.
Le Conseil de la Communauté germanophone s'est déclaré favorable au présent projet, qui a été adopté par notre commission par 11 voix contre 4.

Monsieur le président, monsieur le ministre, chers collègues, malheureuses sont les zones frontalières lorsqu'elles sont les premières victimes de la soif de pouvoir et de la folie guerrière des hommes. Mais heureuses sont-elles lorsque, la liberté et la paix assurées dans la dignité, les habitants ont comme projet commun d'assurer à leur pays et à leur région, sécurité civile, promotion socio-économique, valorisation de l'environnement et échanges culturels et linguistiques.
Situé au coeur du triangle Liège-Maastricht-Aachen, l'arrondissement de Verviers s'est toujours montré ouvert aux trois langues nationales et s'est rapidement et résolument engagé dans la construction européenne. C'est particulièrement le cas de la Communauté germanophone, fière de son identité, toujours soucieuse de dialogue permanent avec les Communautés francophone et néerlandophone, fidèle à la Belgique fédérale et partenaire d'une Europe nourrie d'échanges socio-économiques et culturels.
Le présent projet de loi, monsieur le président, rencontre plusieurs aspirations légitimes de la Communauté germanophone tant au point de vue institutionnel que financier; des aspirations qui réaffirment à la fois son identité et son souci d'ouverture et d'harmonie. C'est la raison pour laquelle le groupe PSC votera ce projet de loi.

This bill, Mr. Speaker, meets several legitimate aspirations of the German-speaking Community, both institutionally and financially; aspirations that reaffirm both its identity and its concern for openness and harmony. That is why the PSC group will vote on this bill.

Mijnheer de voorzitter, mijnheer de minister, collega's, de bespreking van onderhavig wetsontwerp heeft in de commissie aanleiding gegeven tot een interessante discussie die zich in positieve zin onderscheidde van het dovemansgesprek tijdens de besprekingen van het Lambermont-akkoord. Toen bleek een dialoog immers nauwelijks mogelijk te zijn. Wij voerden toen een dovemansgesprek met de regering die zich voor bijna elke commissievergadering liet vertegenwoordigen door weer een andere minister met een bijzondere expertise. Soms waren er zelfs ministers die bij de onderhandelingen over het Lambermont-akkoord niet of nauwelijks waren betrokken en wier kennis over het onderwerp recht evenredig was met hun al dan niet bestaande betrokkenheid bij de onderhandelingen.
Bij dit wetsontwerp kregen wij wel antwoorden op onze vragen. Ik wil hiermee echter niet gezegd hebben dat wij akkoord konden gaan met die antwoorden of met het wetsontwerp. Graag vermeld ik dat de levendige discussie met vooral leden van de oppositie — ik verwijs onder meer naar de betekenisvolle inbreng van collega Pieters — door de diensten van de Kamer op een uitstekende wijze is samengevat en door de rapporteurs correct verwoord. Collega's, met betrekking tot dit wetsontwerp hebben wij ons in de commissie kritisch opgesteld. Onze kritiek heeft eigenlijk drie krachtlijnen. Ten eerste, wij hebben kritiek op de financieringsregeling. Ten tweede, ook de uitbreiding van de regering van de Duitstalige Gemeenschap wordt door ons bekritiseerd. Ten derde, op de uitbreiding van de bevoegdheden van dezelfde Duitstalige Gemeenschap hebben wij eveneens kritiek geuit.
Wat de financiering betreft, kan ik het volgende zeggen. Aangezien wij tegen de financieringsregeling van het Lambermont-akkoord hebben gestemd en dezelfde beginselen van dat akkoord terug te vinden zijn in dit wetsontwerp, zou het uiteraard onlogisch zijn om thans een andere houding aan te nemen. Wij keuren de financieringsregeling af, omdat ze het consumptiefederalisme in ons land in de hand werkt. Het beginsel, dat wie een belasting heft, ook ter verantwoording kan worden geroepen voor de uitgaven van dat belastinggeld, wordt eens te meer genegeerd. Dotaties zijn uiteraard niet verzoenbaar met dat eeuwenoude basisprincipe van de democratie. Wie de belastingen betaalt, zal de bestuurders niet ter verantwoording kunnen roepen, aangezien het geld wordt overgeheveld naar een andere regio waar de burger geen greep heeft op de besteding van de middelen.
Bovendien moeten we vaststellen dat de fiscale bevoegdheid voor de Gemeenschappen wordt afgeschaft — dus ook voor de Duitstalige Gemeenschap —, en dit ondanks de fiscale autonomie. De Duitstalige Gemeenschap zal op geen enkele manier in staat zijn haar eigen inkomsten te genereren, wat uiteraard strijdig is met elke goed begrepen vorm van federalisme.
Een tweede punt van kritiek betreft de uitbreidingsmogelijkheid van de regering van de Duitstalige Gemeenschap van drie naar maximaal 5 leden. Collega Maingain, voorzitter van de commissie voor de Financiën en eminent lid van de commissie voor de Herziening van de Grondwet, heeft in de commissie terecht opgemerkt dat het in een federale staat aan ieder gewest en iedere gemeenschap toekomt om, weliswaar binnen de grenzen die worden bepaald door de Grondwet of door de bijzondere wet, te beslissen hoeveel ministers de eigen regering kan tellen. Wanneer de mogelijkheid wordt geboden om het aantal regeringsleden uit te breiden, moet hiervoor een verantwoording bestaan. Welnu, de reden die in het wetsontwerp wordt opgegeven, is dat de taken van de Duitstalige Gemeenschap worden verruimd. Uit de antwoorden van de minister in de commissie bleek dat die verruiming zeer beperkt blijft: het werkgelegenheidsbeleid, monumenten en landschappen en mogelijk ook de uitoefening van het toezicht op de ondergeschikte besturen.
Ik verwijs naar een uitspraak van minister Jaak Gabriels, die ons ondertussen heeft verlaten en nu een mandaat opneemt op het Vlaamse niveau.
Hij kwam daar trouwens vandaan voor zijn interim in ons midden. Welnu, minister Gabriels verklaarde bij de bespreking in de Senaat dat over die overheveling reeds een akkoord bestond. Het bleek dan om een principeakkoord te gaan. Over de uitwerking van dit akkoord waren de besprekingen tien dagen geleden nog altijd bezig, zo wist de vice-eerste minister en minister van Begroting Johan Vande Lanotte ons in de commissievergadering van 29 november 2001 te vertellen. Waarom de onderhandelingen zo lang aansleepten en er zoveel tijd was tussen de aankondiging van de federaal aflijvige minister Gabriels en het tijdstip van de bespreking in de commissie, kon de nochtans goed onderlegde en meestal goed geïnformeerde viceeerste minister ons niet zeggen.
Het feit dat die besprekingen zoveel tijd in beslag nemen, is op zich al merkwaardig. Wij durven niet te veronderstellen dat dit te maken zou kunnen hebben met de terughoudendheid van het Waalse Gewest om het toezicht op de gemeenten van het Duitse taalgebied aan de Duitstalige Gemeenschap over te dragen. Of zou het toch zo zijn dat het Waalse Gewest hierover moeilijk doet en dat wat minister Gabriels heeft verklaard naar traditie van de federale regering niet volledig overeenstemt met de realiteit?
Een derde punt van kritiek betreft de uitbreiding van bevoegdheden van de Duitstalige Gemeenschap. Het thans voorliggende wetsontwerp maakt het mogelijk dat de Duitstalige Gemeenschap straks zelf instaat voor de controle op de verkiezingsuitgaven, de regeringsmededelingen en de bijkomende financiering van de politieke partijen. De Raad van State heeft hierover opgemerkt dat in het ontwerp zelf de regeling voor die aangelegenheden moet worden uitgewerkt en dit om de eenvoudige reden dat de Duitstalige Gemeenschap niet eens over de zogenaamde constitutieve autonomie beschikt. De in dit wetsontwerp voorgestelde regeling is volgens de Raad van State dus in strijd met de Grondwet.
Tot besluit herhaal ik dat wij wegens die drie bezwaren dit ontwerp niet zullen goedkeuren, consequent met onze houding inzake de Lambermont-ontwerpen. Wij zijn immers van mening dat de leden van Duitstalige Gemeenschap recht hebben op goed werkende, democratische instellingen met verantwoordelijken die door de burgers zelf ter verantwoording kunnen worden geroepen. Een onduidelijke bevoegdheidsverschuiving en niet transparante besluitvorming zijn volkomen ongewenst. Met dergelijke instellingen zijn onze Duitstalige landgenoten helaas niet gediend.

With this bill we got answers to our questions. However, I do not mean that we could agree with those answers or with the draft law. I would like to point out that the lively discussion with mainly members of the opposition — I refer, among other things, to the meaningful contribution of Mr. Pieters — has been summarized in an excellent manner by the services of the House and correctly formulated by the rapporteurs. We have been critical of this bill in the committee. Our criticism actually has three strength lines. First, we criticize the funding system. Second, the expansion of the government of the German-speaking Community is also criticized by us. Third, we also criticized the extension of the powers of the same German-speaking Community.
As for funding, I can say the following. Since we voted against the financing arrangement of the Lambermont Agreement and the same principles of that agreement are reflected in this bill, it would obviously be illogical to take a different stance now. We reject the funding scheme because it works in the hand of consumer deregulation in our country. The principle that the taxpayer can also be held accountable for the expenditure of that tax money is once again ignored. Of course, grants are not compatible with that centuries-old basic principle of democracy. Whoever pays the taxes will not be able to hold the managers accountable, as the money is transferred to another region where the citizen has no control over the spending of the resources.
Furthermore, it must be noted that the tax competence for the Communities — thus also for the German-speaking Community — is abolished, and this despite the tax autonomy. The German-speaking Community will in no way be able to generate its own income, which is obviously contrary to any well-understood form of federalism.
A second point of criticism concerns the possibility of extending the government of the German-speaking Community from three to a maximum of five members. Collega Maingain, chairman of the Committee on Finance and eminent member of the Committee on the Revision of the Constitution, has rightly noted in the committee that in a federal state it is up to each district and every community to decide, though within the limits determined by the Constitution or by the special law, how many ministers a government can count. Where the possibility is offered to increase the number of government members, there must be accountability for this. Well, the reason given in the bill is that the tasks of the German-speaking Community are expanded. The Minister’s responses in the committee showed that this enlargement remains very limited: the employment policy, monuments and landscapes and possibly also the exercise of the supervision of the subordinate administrations.
I refer to a statement by Minister Jaak Gabriels, who has left us in the meantime and is now taking up a mandate at the Flemish level.
He, by the way, came from there for his interim among us. Now, Minister Gabriels stated at the discussion in the Senate that there was already an agreement on that removal. It turned out to be a principle agreement. On the elaboration of this agreement the discussions were still underway ten days ago, as the Deputy Prime Minister and Minister of Budget Johan Vande Lanotte was able to tell us in the committee meeting of 29 November 2001. Why the negotiations took so long and there was so much time between the announcement of the federal minister Gabriels and the time of the discussion in the committee, the yet well-informed and usually well-informed Deputy Prime Minister could not tell us.
The fact that these discussions take so much time is strange in itself. We do not dare to assume that this may have to do with the reluctance of the Wallish Region to transfer the supervision of the municipalities of the German-speaking area to the German-speaking Community. Or would it be that the Wallish Region is struggling with this and that what Minister Gabriels has declared in accordance with the tradition of the federal government does not fully correspond to the reality?
A third point of criticism concerns the expansion of the powers of the German-speaking Community. The current draft law enables the German-speaking Community to take control of election spending, government communications and the additional financing of political parties. In this regard, the State Council has noted that in the draft itself the arrangement for those matters should be drawn up, and this for the simple reason that the German-speaking Community does not even have the so-called constitutive autonomy. The regulation proposed in this draft law is therefore, according to the Council of State, contrary to the Constitution.
In conclusion, I repeat that because of these three objections, we will not approve this draft, consistent with our attitude regarding the Lambermont designs. In fact, we believe that the members of the German-speaking Community have the right to well-functioning, democratic institutions with responsible persons who can be held accountable by the citizens themselves. Unclear shift of powers and non-transparent decision-making are completely undesirable. Unfortunately, with such institutions, our German-speaking countrymen are not served.

Mijnheer de voorzitter, collega's, ik ga uit van het principe dat de Duitstalige Gemeenschap alle rechten heeft van een volwaardige gemeenschap, ondanks haar numerieke grootte. Om die reden heb ik hier destijds de eed afgelegd in het Nederlands en in het Duits, heb ik samen met Danny Pieters een voorstel ingediend voor een eigen provincie en heb ik met de heer Poncelet die ons intussen heeft verlaten, een motie ingediend om een Duitstalige legereenheid te krijgen.
De balans van dit gegeven overloop ik even. Ons lijkt ze positief, in de eerste plaats wat de herfinanciering betreft. Het staat vast — en mensen in de Duitstalige Gemeenschap die dit project niet zo genegen zijn zeggen dit ook — dat zonder dit besluit de Duitstalige Gemeenschap financieel niet werkbaar is. Ons lijkt dat fundamenteel. De uitbreiding van de bevoegdheden telt heel wat schoonheidsfoutjes waarvoor ik niet blind ben, maar toch blijft het een stap vooruit. Ik heb de vorige sprekers gehoord en de volgende zal waarschijnlijk hetzelfde vertellen en bovendien heb ik het verslag gelezen, maar zij haalden een aantal negatieve deelaspecten aan. Wij gaan echter uit van het geheel en wegen dat af, en dan is de balans positief. Dan is er de uitbreiding van drie ministers naar vijf. Daarop kwam de nogal absurde kritiek dat Vlaanderen met zes miljoen mensen elf ministers telt, terwijl de Duitstalige Gemeenschap er nu vijf krijgt voor tachtigduizend. Die vergelijking lijkt logisch, maar is feitelijk absurd.
Wij respecteren een andere gemeenschap en voor ons is dan fundamenteel beslissend wat die gemeenschap zelf zegt. Ik heb in het verslag gelezen dat de Duitstalige Gemeenschap dit project heeft goedgekeurd. Voor ons is dit de federale logica. Als elk federalist besef ik dat de federale ontwikkeling van een staat stapsgewijze gebeurt. Hier zitten nog heel wat schoonheidsvlekjes aan.
Wachten tot alles is gerealiseerd en ondertussen geen verdere stappen doen, is echter niet onze houding. Het argument dat voor hetzelfde geld kan worden tegengestemd omdat er toch geen tweederde meerderheid nodig is, gaat ook niet op. Wij hebben het project op zijn verdiensten beoordeeld en de voor- en nadelen afgewogen. Naar onze smaak wegen de voordelen zwaarder door. Wij zullen het ontwerp bijgevolg goedkeuren.

We respect another community and for us then fundamental determination is what that community itself says. I read in the report that the German-speaking Community has approved this project. For us, this is the federal logic. Like every federalist, I realize that the federal development of a state takes place step by step. There are a lot of beauty spots here.
Waiting until everything is realized and not taking any further steps in the meantime, however, is not our attitude. The argument that the same money can be opposed because there is no need for a two-thirds majority is also not valid. We assessed the project on its merits and weighed the advantages and disadvantages. According to our taste, the benefits weigh more. We will therefore approve the draft.

Mijnheer de voorzitter, ik heb een gevoel van déjà vu bij deze bespreking. Ze doet mij herinneren aan de Lambermont-besprekingen en de afwegingen die toen werden gemaakt. Soms leidt dat tot andere conclusies. Inderdaad, zonder dit geld zouden er problemen voor de Duitstalige gemeenschap ontstaan. Het is waar: het ontwerp is verre van volmaakt. Daarover is iedereen het eens.
De vraag is echter of wij het ontwerp daarom moeten goedkeuren? Daarvoor zijn er mijns inziens een aantal doorslaggevende argumenten. Er is de problematiek van de constitutieve autonomie. Als het aan ons ligt, krijgt de Duitstalige Gemeenschap dezelfde constitutieve autonomie als de andere gemeenschappen. Nu is dat jammer genoeg, constitutioneel, niet zo. Dat de Duitstalige Gemeenschapsraad wel één aspect van constitutieve autonomie mag uitoefenen, met name het bepalen van het aantal ministers, lijkt mij merkwaardig.
Wat het aantal ministers betreft, er wordt niet beslist om hun aantal op vijf te brengen, maar er wordt de mogelijkheid gecreëerd om hun aantal op vijf te brengen, niet afhankelijk van, maar wellicht enigszins in relatie tot de nieuwe bevoegdheden die het Waals Gewest aan de Duitstalige Gemeenschap overdraagt. Zoals ik al zei, heb ik een gevoel van déjà vu. Bij de stemmingen zullen sommigen dat ongetwijfeld ook ervaren.

It seems strange to me that the German-speaking Community Council may exercise one aspect of constitutive autonomy, in particular the determination of the number of ministers.
As regards the number of ministers, it is not decided to increase their number to five, but it is created the possibility to increase their number to five, not dependent on, but ⁇ somewhat in relation to the new powers that the Waals Region transfers to the German-speaking Community. This is an evolution that we have already denounced following the Lambermont discussions. We are sliding more and more down to a situation where the German-speaking Community becomes a branch of the Waals Region. This is a bad thing for our federalism.
Finally, important in our considerations was also that by using a logic other than the logic for the Flemish and French-speaking Community regarding the counts in education, it becomes impossible to determine with certainty the number of pupils in the French-speaking and Dutch-speaking education if we also do not simultaneously organize counts every year in the German-speaking Community.
As I said, I have a sense of déjà vu. In the polls, some will undoubtedly experience that too.
