Monsieur le président, messieurs les ministres, chers collègues, le processus de libéralisation du secteur postal a démarré en 1992. Trois directives européennes ont introduit une ouverture progressive du marché. Durant les deux législatures précédentes, ce thème a été largement abordé au sein de la commission de l’Infrastructure. On a procédé à des échanges de vues avec les ministres concernés. Des auditions ont été organisées ainsi qu’un voyage en mars 2009 en Suède, pays où la libéralisation postale est en vigueur.
Les deux projets de loi à l’ordre du jour interviennent à la suite de la troisième directive qui prévoit la suppression du dernier monopole postal, les envois de moins de 50 g, qui doit être transposée pour le 1ᵉʳ janvier 2011. C’est pourquoi les deux projets sont soumis au vote ce jour et sont traités en urgence.
Une telle ouverture ne peut se réaliser sans être encadrée sur le plan social. Toutes les activités postales, de la collecte à la distribution, à l’exception du transport, devront être effectuées par des travailleurs et non des indépendants.
C’est une libéralisation qui doit aussi être strictement réglementée pour lutter contre la concurrence déloyale. C’est dans ce cadre que le régulateur, l’IBPT, se verra renforcé afin d’éviter toute dérive. Mais cette libéralisation doit aussi être une avancée pour tous les citoyens. Des conditions seront donc imposées aux nouveaux entrants: l’obligation de porter leur couverture à 80 % dans chacune des trois Régions, endéans les cinq ans, afin qu’un maximum de personnes puissent avoir accès à ces services et l’obligation de fréquence de deux distributions par semaine après deux ans. Ces opérateurs devront être interopérables, une tâche pouvant être effectuée par un autre lorsque cela s’impose.
Il y a une garantie au niveau des prix. Les tarifs seront imposés par l’IBPT et devront rester abordables pour tous les habitants. Le prix du timbre restera donc uniforme. Aucune modification n’est apportée à la définition de service universel. Pour garantir la couverture totale du territoire et la fréquence de cinq passages par semaine, bpost sera désigné comme prestataire de service universel jusque fin 2018.
Enfin, ces projets de loi portent aussi sur la modernisation de l’envoi recommandé classique. Un cadre juridique est créé pour assimiler la lettre recommandée classique à un envoi électronique effectué à partir d’une plate-forme certifiée.
Lors de la discussion générale, chaque groupe politique, tout en soulignant l’importance de remplir les exigences européennes, a exprimé ses sensibilités.

The process of liberalization of the postal sector began in 1992. Three European directives introduced a gradual opening of the market. During the previous two legislatures, this theme has been widely discussed in the Infrastructure Committee. There was an exchange of views with the relevant ministers. Hearing was held along with a trip in March 2009 to Sweden, a country where postal liberalization is in place.
The two bills on the agenda follow the third directive, which provides for the abolition of the last postal monopoly, sendings of less than 50 g, which must be transposed by 1 January 2011. Therefore, both projects are submitted to vote today and are dealt with urgently.
Such openness cannot be achieved without being framed on the social level. All postal activities, from collection to distribution, with the exception of transport, shall be carried out by workers and not by self-employed persons.
This is a liberalization that must also be strictly regulated to combat unfair competition. It is in this context that the regulator, the IBPT, will be strengthened in order to avoid any derivative. But this liberalization must also be an advance for all citizens. Conditions will therefore be imposed on new entrants: the obligation to increase their coverage to 80% in each of the three Regions, within five years, so that a maximum number of people can have access to these services and the obligation to frequent two distributions per week after two years. These operators must be interoperable, one task can be performed by another when necessary.
There is a price guarantee. The tariffs will be imposed by the IBPT and must remain affordable for all residents. The price of the stamp will therefore remain uniform. There are no changes to the definition of universal service. To ensure full coverage of the territory and the frequency of five passes per week, bpost will be designated as universal service provider until the end of 2018.
Finally, these bills also cover the modernization of the traditional recommended sending. A legal framework is created to assimilate the traditional recommended letter to an electronic sending from a certified platform.
During the general discussion, each political group, while emphasizing the importance of meeting European requirements, expressed its sensitivities.

Pour la N-VA, les objectifs de la libéralisation, à savoir l'amélioration des services prestés, la diminution des prix pour les consommateurs et la réduction du rôle des pouvoirs publics, ne seront pas atteints à cause du monopole du service universel accordé à bpost jusqu'en 2018 et des conditions d'accès qu'elle juge trop restrictives au niveau du marché.
Le Vlaams Belang estime également que le texte ne garantit pas la libéralisation totale du marché.
Le PS, quant à lui, reconnaît que la libéralisation du marché postal a été introduite de manière progressive, même s'il n'en a jamais été un partisan. Il souhaite que le Parlement puisse évaluer le processus de libéralisation. Cette proposition, relayée par le sp.a, a fait l'objet d'un amendement unanimement accepté.
Pour le MR – cette remarque a également été exprimée par le CD&V –, le cadre légal correspond à la directive. Le principal défi du secteur, comme l'enseigne le cas suédois, n'est pas tant la libéralisation mais la concurrence d'autres moyens de communication comme les sms et les communications électroniques.
Il me faut aussi relayer les inquiétudes de notre collègues Kattrin Jadin au sujet de la couverture et du risque du maintien d'un monopole sur le territoire de la Communauté germanophone.
Le CD&V a encore souligné l'importance d'avoir un régulateur fort pour le secteur postal.
Pour le groupe Ecolo-Groen!, la libéralisation entraîne des effets négatifs comme la dégradation des conditions de travail et la diminution du nombre de bureaux de poste. Il propose une couverture du marché de 100 % et aborde aussi le thème des sanctions.
Complémentairement, le sp.a estime que la libéralisation du secteur postal est une erreur, vu les hausses de prix qu'elle risque d'induire pour le consommateur. Il insiste aussi sur le risque de création de poor jobs. Il indique enfin qu'il n'était pas nécessaire d'intégrer la question de l'envoi recommandé électronique dans le projet de loi.
Tout en soutenant le texte, le cdH se demande si le client ordinaire pourra tirer profit de la libéralisation et ne partage pas l'optimisme du ministre.
Enfin, pour l'Open Vld et la présidente de la commission, le texte constitue un bon équilibre entre les conditions de libéralisation du marché, le maintien du statut du travailleur et le maintien du service universel. Pour elle, la hauteur du coût salarial en Belgique risque de dissuader de nouveaux entrants.

For the Ecolo-Groen!, the liberalization results in negative effects such as the deterioration of working conditions and the reduction of the number of post offices. It offers 100% market coverage and also addresses the subject of sanctions.
In addition, the sp.a considers that the liberalization of the postal sector is a mistake, given the risks of price increases for consumers. It also emphasizes the risk of creating poor jobs. Finally, it indicates that it was not necessary to incorporate the issue of electronic recommended sending into the bill.
While supporting the text, the CDH asks whether the ordinary customer can benefit from liberalization and does not share the optimism of the minister.
Finally, for Open Vld and the chairwoman of the commission, the text constitutes a good balance between the conditions of market liberalization, the maintenance of the status of the worker and the maintenance of universal service. For her, the high cost of wages in Belgium risks deterring new entrants.

Dans ses réponses, le ministre a précisé que les projets de loi à l'examen relevaient d'un compromis permettant à la fois la libéralisation avec la fin du monopole de bpost garantissant le service universel et renforçant le rôle de l'IBPT. C'est l'étude KPMG qui a abouti à une proposition d'un taux de couverture de 80 % pour éviter l'écrémage du marché. N'oublions pas qu'il s'agit d'un secteur spécifique avec un coefficient de main-d'œuvre élevé et dont une part importante du chiffre d'affaires provient d'un petit nombre de clients!
Il a également abordé les différents arrêtés royaux qui doivent encore être pris pour compléter le dispositif et notamment la charge inéquitable du service universel. Il est établi qu'une perte excédant 3 % du chiffre d'affaires entraînera une charge inéquitable. Il a également rappelé l'exemple suédois, selon lequel la satisfaction de la clientèle a augmenté avec les Points Poste et le prix du timbre diminué en huit ans.
Les services législatifs et l'avis complémentaire du Conseil d'État ont mis en évidence certaines imperfections légistiques. Compte tenu de ce qu'il y a deux textes de loi, toutes ces imperfections ont été corrigées par de nombreux amendements techniques.

In his responses, the Minister specified that the bills under consideration were compromised to allow both liberalization with the end of the bpost monopoly guaranteeing universal service and strengthening the role of the IBPT. As regards the discussion on the amendments, some of which were of a technical nature, while others gave rise to a substantial debate, I will give the floor to my co-rapporteur, Mr. and Maertens.

Mijnheer de voorzitter, mijnheer de minister, collega’s, ik had met mevrouw De Bue afgesproken dat zij het algemene gedeelte zou toelichten en dat ik mij tot de artikelsgewijze bespreking zou beperken. Ik heb gehoord dat zij al een en ander heeft toegelicht.
Er werden heel wat amendementen op dit wetsontwerp ingediend. Het gros daarvan gaat over taalkundige of juridisch-technische verbeteringen van de wet. Die amendementen werden ingediend door de meerderheidspartijen CD&V en Open Vld. Wat ook opvalt, is dat een aantal deadlines die in het oorspronkelijke wetsontwerp aan de regering werd opgelegd, zoals een deadline voor het uitvaardigen van koninklijke besluiten, een half jaar of een jaar wordt opgeschoven. Het gaat bijvoorbeeld over het KB dat de berekeningswijze voor de nettokosten voor de universele dienst zal bepalen en over de wijzigingen in de wet van 9 juli 2001 over een aantal aspecten betreffende de elektronische handtekening.
Ik ga nog kort in op een aantal opvallende amendementen die naar voren zijn gebracht. Ik begin met twee amendementen die onze fractie heeft ingediend, namelijk over de aanduiding van de volgende aanbieder van de universele dienst, na de overgangsperiode waarbij De Post instaat voor die universele dienstverlening, en, op artikel 28, over het taalgebruik van de vergunningsplichtige aanbieders van postdiensten. Ik zal straks, in mijn interventie namens onze fractie, dieper daarop ingaan.
De heer Balcaen van de fractie Ecolo-Groen! Heeft een opvallend amendement ingediend waarmee hij de vereisten die aan privéaanbieders van postdiensten worden opgelegd nog strenger wilde maken en ertoe strekte de territoriale dekkingsplicht, die 80 % moet bedragen in elk van de drie Gewesten na vijf jaar, te versterken en verstrengen tot 100 %. Dat amendement heeft het niet gehaald, na de uitleg van de minister, waarbij hij heeft toegelicht dat een volledige dekkingsplicht een onnodig duplicaat van de universele dienst zou zijn.

I will later, in my intervention on behalf of our group, go deeper into this.
Mr. Balcaen of the Ecolo-Green group! Submitted a striking amendment aiming to further strengthen the requirements imposed on private postal service providers and aimed to strengthen and strengthen the territorial coverage obligation, which must be 80 % in each of the three regions after five years, to 100 %. Met andere woorden, interim-arbeiders zijn nu ook toegelaten voor die postaanbieders, want het amendement van mevrouw De Bue werd aangenomen met 15 stemmen voor en 1 onthouding.
Ten slotte, is er het belangrijke aspect dat mevrouw De Bue daarnet al even aanhaalde. Een laatste amendement waarop ik speciaal de aandacht wil vestigen gaat over de evaluatie van het wetsontwerp dat voorligt. Zowel de afgevaardigden van sp.a als van de N-VA legden aan de commissie daarover een amendement ter goedkeuring voor. Op vraag van verschillende leden hebben wij de verschillende teksten samen gelegd en zo konden wij een gezamenlijk amendement indienen. Dit amendement kwam er – de getuigen van de commissievergadering zullen dat kunnen bevestigen – na enige partijpolitieke diplomatie en werd ondertekend door vrijwel alle aanwezige fracties. Het is heel belangrijk. Ik kom er straks nog summier op terug.
Het wetsontwerp werd uiteindelijk door de commissie aangenomen met 13 stemmen voor en 3 onthoudingen, zodat het hier ter goedkeuring kan worden voorgelegd.
Mijnheer de voorzitter, ik weet niet of het nuttig is om meteen voort te gaan met mijn eigen betoog.

“De Post wordt bpost, klaar voor morgen”. Die boodschap hebt u de jongste weken waarschijnlijk al verschillende keren gehoord op de radio en gezien op de televisie. Bpost bevestigde die boodschap gisteren nog eens tijdens een persconferentie. “Bpost gaat met vertrouwen de vrijmaking van de postmarkt op 1 januari volgend jaar tegemoet”, zo luidt het. “Bpost staat klaar om concurrenten van antwoord te dienen. Door de veranderingen die in de voorbije jaren werden doorgevoerd heeft het bedrijf zich goed voorbereid op de grote omwenteling. Het financieel evenwicht werd hersteld, de kwaliteit is fel verbeterd en de werkprocessen verlopen efficiënter.”, aldus bpost.
Ik bevestig namens de N-VA-fractie graag dat dat laatste helemaal klopt. De Post, nu bpost, heeft de voorbije jaren een grondige hervorming doorgemaakt en groeide uit tot een modern overheidsbedrijf.
Het is Johnny Thijs, ceo van het bedrijf sinds 2002, die daarin een onmiskenbare, grote en belangrijke rol heeft gespeeld. Hij maakte bpost efficiënter met onder meer een betere organisatie van de postrondes, de sluiting van verlieslatende postkantoren en de opening van de wat mij betreft toch heel klantvriendelijke – want ruimere openingsuren – postpunten.
Tegelijk blijkt hij in zijn bureau toch in het oog van de storm geregeld een sociale vredespijp te kunnen roken met de vakbonden, in vergelijking met sommige andere overheidsbedrijven in ons land. De verdiensten van Johnny Thijs en zijn ploeg tijdens de afgelopen acht jaar zijn dus zeker niet te onderschatten.
Johnny Thijs is niet alleen een goed manager, maar is tevens een uitstekend lobbyist. Zijn lobbywerk leverde hem niet alleen de titel van hofleverancier op, zoals u gisteren hebt vernomen, maar hij slaagde er ook in de regeringspartijen zover te krijgen dat zij de wet die hier vandaag ter goedkeuring voorligt en die de liberalisering van de postdiensten in ons land vanaf 1 januari 2011 moet invoeren, vrijwel volledig op maat van zijn bedrijf schreven.
Onderhavige wet gaat heel ver wanneer het gaat over het vrijwaren van de marktpositie van bpost. Ze legt de concurrentie dermate hoge voorwaarden en regels op, dat die bij voorbaat al wordt afgeschrikt. At the same time, he appears to be able to regularly smoke a social peace pipe with the trade unions in his office in the face of the storm, compared with some other government companies in our country. The achievements of Johnny Thijs and his team over the past eight years are therefore ⁇ not to be underestimated.
Johnny Thijs is not only a good manager, but also an excellent lobbyist. His lobbying not only gave him the title of courtyard supplier, as you heard yesterday, but he also managed to get in the government parties to the extent that they wrote the law which is presented here today for approval and which must introduce the liberalization of the postal services in our country from 1 January 2011, almost entirely tailored to his company.
This law goes a long way when it comes to safeguarding the market position of bpost. It imposes so high conditions and rules on competition that it is deterred in advance. If that competition has not yet been deterred, it will ⁇ find from 1 January 2011 that the new rules and conditions are so strict that private postal service providers will not be able to attract sufficient customers and volumes to operate profitably and economically responsibly.
Until then the full “liberalization” of the market of postal mail, although the liberal minister Van Quickenborne after the decision in the Council of Ministers made known in the press that new postal companies could enter the competition under flexible conditions. Het gaat volgens ons behoorlijk ver als de overheid de privésector beperkingen oplegt inzake het inzetten van medewerkers. Ik stel vast dat de houding van uw partij hierover in de loop van de besluitvorming kan wijzigen. Tijdens de gedachtewisseling in 2008 in de commissie pleitte uw toenmalige collega, de heer De Padt, overtuigd dat werken met zelfstandigen mogelijk moesten blijven. Niet alleen de vergunningsvoorwaarden zijn soepel, maar ook sommige liberale principes.
Ik heb er alle begrip voor dat de indieners van dit wetsontwerp geen schijnzelfstandigheid in de postmarkt willen toelaten. Die verzuchting is volkomen terecht. Schijnzelfstandigheid moet streng worden aangepakt. Alleen is het maar de vraag of je dat op sectorniveau moet oplossen door een verbod in de wet op de postmarkt in te schrijven. Het lijkt mij dat we schijnzelfstandigheid veel beter aanpakken via het arbeidsrecht en via het opvoeren van de sociale inspectie. Een specifiek verbod om in de postmarkt met zelfstandigen te werken lijkt mij enigszins overbodig en niet echt op zijn plaats. Het is een ernstige beperking van het vrije ondernemersschap.
Tijdens de bespreking in de commissie heb ik namens onze N-VA-fractie enkele concrete vragen gesteld over het wetsontwerp dat hier ter goedkeuring voorligt. Het ging bijvoorbeeld over een mogelijk plafond voor de staatstussenkomst aan de universele dienstverlener, over de mogelijke opsplitsing van de universele diensten op het niveau van de taken – het ophalen, sorteren, vervoeren en verdelen van post. Ik heb een aantal concrete vragen gesteld over de keuze voor directe staatssteun in plaats van een compensatiefonds of de bijdrage die privéaanbieders van postdiensten voortaan moeten betalen ter financiering van de ombudsdiensten.

A specific ban on working with self-employed persons in the postal market seems to me somewhat superfluous and not really in place. It is a serious limitation of free entrepreneurship.
During the discussion in the committee, on behalf of our N-VA group, I asked some concrete questions about the bill that is presented here for approval. It was, for example, about a possible ceiling for state intervention to the universal service provider, about the possible division of the universal services at the level of tasks – picking up, sorting, transporting and distributing mail. Ten eerste, het wetsontwerp bepaalt dat de regering met het KB het open mechanisme bepaalt dat het BIPT bij de aanduiding van de universele dienstverlener na die overgangsperiode zal volgen. De gekozen term open mechanisme lijkt ons nog te vrijblijvend. Daarom dienden wij een amendement in. Wij willen de zekerheid dat elke privéonderneming met gelijke wapens als bpost aan de start komt en kan meedingen naar de opdracht van universele dienstverlener, en dat met een strikte procedure.
Ten tweede, wij hebben veel aandacht gevraagd voor de naleving van de taalwetgeving. Ik meen dat dit duidelijk is, dat dit essentiële basisregels zijn in onze democratie. Het zijn de essentiële en elementaire taalspelregels in ons land. Wij wilden met een amendement een mogelijke schending van die elementaire regels in dit land vermijden, dit met de bedoeling de ontvanger van poststukken te kunnen beschermen. Het is immers niet de bestemmeling die de post kiest, wel de verzender-betaler.
Ons amendement had ook de bedoeling om bpost te vrijwaren van een concurrentienadeel. Als dat niet in de vergunningsvoorwaarden voor privéondernemingen is opgenomen, betekent dat immers dat de privéconcurrenten volgens deze wet de taalwetgeving niet moeten volgen en bpost wel. Jammer genoeg vonden wij in de commissie echter geen meerderheid voor ons voorstel.
Gelukkig vonden wij in de commissie wel steun voor onze uitdrukkelijke vraag om deze wet ten laatste binnen twee jaar grondig te evalueren.

Mijnheer de voorzitter, ik kom tot mijn slotconclusie. Het is voor u wellicht duidelijk dat voor ons de vraag blijft of voorliggend wetsontwerp een eerlijke concurrentie op de postmarkt zal kunnen garanderen. Het feitelijke monopolie van bpost blijft alleszins nog wel een poos overeind en het is nog maar de vraag of dat precies de bedoeling was van Europa in de postrichtlijn.
Wij pleiten niet voor een blinde liberalisering, maar met dit wetsontwerp is er volgens mij toch veeleer sprake van een schijnliberalisering dan van het echt vrijmaken van de interne postmarkt.
Collega’s van de commissie, omdat u allen bereid bent geweest en hier straks ook allen bereid zou zijn om deze wet uiterlijk over twee jaar aan een grondig verslag van de regering en een uitgebreide evaluatie te onderwerpen, zijn wij bereid om dit wetsontwerp voorlopig te gedogen.

Mijnheer de minister, er zijn verschillende jaren overheen gegaan. U hebt drie jaar aan uw ontwerp gewerkt. De oorspronkelijke richtlijn van het Europees Parlement is al meer dan tien jaar oud.
Het resultaat dat op tafel ligt, is dan ook wat wij een goed, Belgisch compromis kunnen noemen. Het voldoet aan de Europese eisen inzake een geliberaliseerde markt. Het geeft ook de nodige aandacht aan de problematiek van ons ingewikkeld, Belgisch grondgebied.
Er werden in de commissie vergelijkingen gemaakt met andere sectoren waar de liberalisering werd doorgevoerd, zoals de telecomsector. Ik heb toen ook de opmerking gemaakt dat de liberalisering aldaar niet kan worden veralgemeend. De post heeft immers een speciaal karakter door de arbeidsintensiviteit van zijn diensten. Bpost is een heel groot bedrijf. Bijna veertigduizend werknemers in ons land werken bij bpost.
Waarom is de liberalisering nodig? Ze is nodig, omdat wij in Europa op het veld moeten kunnen meespelen. Ook moet er tegen 1 januari 2011 een wettelijk kader zijn voor de voorwaarden waaronder andere bedelers op de markt zouden kunnen komen.
Er zijn verschillende spelers op het veld. Om te beginnen, is er de consument. Wat zit er in het voorliggende ontwerp voor de consument? Voor de consument is er een betere dienstverlening, een grotere keuze en een strengere controle op de prijs van de postzegel. De prijs van een aantal verrichtingen, zoals van aangetekende zendingen, zal dalen. Dat is niet onbelangrijk. Terwijl een aangetekende zending nu meer dan vijf euro kost, zal ze in de toekomst nog een vijftigtal cent kosten.
Voor de bedrijven is er het heel belangrijke voordeel van scherpere prijzen. Er komt tot 50 % reductie op de huidige prijzen. Er zal meer keuze en flexibiliteit zijn. De post heeft de voorbije jaren een zekere herstructurering meegemaakt en is naar liberalisering toegegroeid. Bpost staat voor meer dan een nieuwe naam. Bpost is De Post van vroeger, die een hele evolutie heeft doorgemaakt.
Wat is belangrijk? Belangrijk is dat de universele dienstverlening blijft en zeker tot eind 2018 gevrijwaard is.

There are different players on the field. First, there is the consumer. What is in the present draft for the consumer? For the consumer there is a better service, a greater choice and a stricter control of the price of the stamp. The price of some transactions, such as registered shipments, will fall. That is not insignificant. While a registered shipment now costs more than 5 euros, it will cost 50 cents in the future.
For companies there is the very important advantage of sharper prices. There will be a 50% reduction on current prices. There will be more choice and flexibility. There will also be renewed services. There will no longer be absurd ways to send registered shipments. The present draft also means a very large improvement in the administrative burden. After all, one of the demands of our companies is the reduction of the inconvenience and it is addressed.
The post has undergone some restructuring in recent years and has grown towards liberalization. Bpost stands for more than a new name. Bpost is the Post of the past, which has undergone a whole evolution.
What is important? It is important that the universal service will remain free and ⁇ until the end of 2018.

Alles werd in de wet voorzien. Ik zal u de artikelen besparen want het was eigenlijk wel een heel technisch ontwerp.
De functie van de regulator, de BIPT, als stok achter de deur, werd versterkt. Bovendien krijgt de regulator een belangrijkere rol, in die zin dat er vanaf 2012 een ex-anteregeling kan worden getroffen voor de gebruikerstarieven. Ondertussen geldt een pricecap-regeling. Ter zake werd een zeer belangrijk compromis gevonden voor de consument.
Het versturen van de elektronische handtekening werd ontwikkeld. Dit is een heel belangrijke stap in onze geïnformatiseerde wereld. De gemailde versie van een aangetekende brief. Het is gedaan om naar de post te moeten lopen tussen bepaalde uren. Wie kan dat nog opbrengen? Ce n'est donc pas un texte anodin, loin de là, car il va conditionner l'avenir du secteur pour les décennies qui viennent. Plusieurs questions essentielles se posent. Quel futur pour les services postaux offerts aux citoyens? Quel futur pour le service universel? Quel futur pour les conditions de travail dans le secteur?
La libéralisation complète du secteur sera effective au 1ᵉʳ janvier prochain. Il était donc essentiel, et beaucoup d'acteurs, dont les organisations syndicales, l'ont rappelé, qu'un texte encadre cette libéralisation, au risque de voir l'entrée de nouveaux opérateurs démanteler complètement le secteur.
Nous devrions y parvenir in extremis, étant donné que les arrêtés royaux doivent encore être pris.
Cela dit, si nous sommes aujourd'hui en bout de course, le processus a déjà produit des effets. With the adoption of the text submitted to us today, a final touch is placed on the process of liberalization of the postal sector.
So this is not an anodin text, far from that, because it will condition the future of the sector for the coming decades. Several essential questions arise. What is the future for postal services offered to citizens? What is the future of universal service? What is the future for the working conditions in the sector?
The full liberalization of the sector will take effect on 1 January next year. It was therefore essential, and many actors, including trade union organizations, recalled it, that a text frames this liberalization, at the risk of seeing the entry of new operators completely dismantle the sector.
We should accomplish this in extremis, given that royal orders still have to be taken.
That said, if we are now at the end of the race, the process has already produced effects. It is well in the light of the liberalization of the sector that we must analyze the last years of rationalization in La Poste, which became bpost: modernization of the sorting, application of Georoute with its effects on the working conditions of the factors, disappearance of the shops in the neighborhoods and villages and replaced by Post Points, creation of a precarious status of auxiliary factor, bpost thereby consecrating the reign of the "small boulots" part-time and poorly paid.
Of course, bpost must modernize and take into account the significant decrease, for many years, in the number of letters to be processed, as postal mail is increasingly competing with the new possibilities of information technology.
The price to be paid is heavy, especially in terms of employment, and it is not over if one must believe the statements of Mr. Thijs this morning in the press about the need to still work on the wage mass.

J'en reviens au texte qui sera voté aujourd'hui. Je crois qu'il serait malhonnête, monsieur le ministre, de dire que le projet de loi ne cherche pas à encadrer les possibles dérives du secteur postal en imposant une série de conditions aux nouveaux entrants: obligation de fréquence de distribution, obligation de couverture à 80 % du territoire, obligation de travailler avec des salariés et non des indépendants.
Le texte prévoit une série d'efforts, mais cette régulation sera-t-elle suffisante pour éviter que les nouveaux entrants se concentrent sur les segments rentables du marché, capturant ainsi une partie des produits qui finançaient jusqu'ici le service universel moins rentable? Telle est toute la question. Il s'agit de l'écrémage dont fait mention la littérature.
Pour ma part, je remarque que bpost avait travaillé sur des scénarios d'obligation de couverture à 100 % du territoire et de trois distributions par semaine imposés pour les nouveaux entrants. Le projet du gouvernement est donc en deçà des scénarios qui avaient été étudiés notamment par KPMG.
Le scénario prévoyant une obligation de couverture à 100 % au sujet duquel nous avons déposé des amendements est-il déraisonnable? Non. Vous avez vous-même déposé, monsieur le ministre, un document en commission selon lequel, dans certains pays, cette couverture à 100 % peut être atteinte par certains opérateurs alternatifs. C'est le cas notamment aux Pays-Bas, situés non loin de chez nous.
En fait, les obligations telles qu'elles sont prévues dans le projet du gouvernement, c'est un peu la porte ouverte à ce que l'on appelle les opérateurs end-to-end qui ciblent le courrier industriel et non urgent, distribué deux à trois fois par semaine. Or, c'est justement ce type de marché qui contribuait jusqu'ici largement au chiffre d'affaires de bpost et, ce faisant, au financement du service universel.
Comme l'ont évoqué les rapporteurs, nous avons souhaité renforcer les conditions d'entrée des nouveaux opérateurs. Écolo-Groen! a déposé un amendement visant à porter à 100 % la couverture devant être assurée après cinq ans avec un minimum de trois distributions par semaine. Nous redéposons cet amendement en séance plénière car nous estimons qu'il y a, derrière cette question, plusieurs enjeux essentiels. J'en ai retenu deux que j'ai déjà évoqués. Il y a, tout d'abord, le financement du service universel. Il est vrai que plutôt que de faire contribuer l'ensemble des opérateurs privés à un financement, le gouvernement a choisi un financement public du service universel. On peut le comprendre, le financement du service universel dans le secteur des télécoms qui est assuré par les opérateurs – vous l'avez évoqué en commission, monsieur le ministre – n'est pas une réussite tant dans son application qu'au niveau de la sécurité juridique qui entoure le dispositif.

As the rapporteurs mentioned, we wanted to strengthen the entry conditions for new operators. It is green! has submitted an amendment aimed at raising to 100% the coverage to be secured after five years with a minimum of three distribution per week. We are submitting this amendment again to the plenary session because we believe that there are several key issues behind this issue. I have two that I have already mentioned. First, there is the financing of the universal service. It is true that instead of making all private operators contribute to financing, the government has chosen public financing of the universal service. It can be understood, the financing of the universal service in the telecommunications sector which is provided by the operators – you mentioned it in the commission, Mr. Minister – is not a success both in its application and at the level of the legal certainty surrounding the device.

D'ailleurs, nous devrions entamer prochainement un débat sur le sujet en commission, notamment à la lumière de la récente consultation du secteur des télécoms, réalisée par l'IBPT. Des pistes nouvelles mériteraient d'être explorées.
Cela dit, avec le schéma adopté, le financement par l'État du service universel pourrait devenir de plus en plus lourd à supporter, au fil du temps. C'est un risque réel que nous tenions à souligner.
Le deuxième enjeu est celui de la couverture géographique, qui est aussi enjeu de l'aménagement du territoire et enjeu de mobilité. J'ai rappelé en commission la position de l'Union des villes et communes de Wallonie: elle craint pour le maintien du service postal dans les régions plus rurales. C'est aussi un élément important.
Enfin, les conditions sociales. Le projet de loi prévoit un recours obligatoire à la main-d'œuvre salariée. Cette contrainte est importante – et nous la saluons –, mais permettra-t-elle d'éviter le dumping social? Ne serons-nous pas obligés, à l'instar du Parlement allemand en 2007, de légiférer un jour sur le salaire minimal dans le secteur postal?
En tout cas, pour garantir au mieux les conditions de travail dans le secteur, nous restons favorables, madame la ministre, à la création d'une commission paritaire du secteur postal. Et il faudrait avancer rapidement en ce domaine.
S'il faut souligner les avancées du texte en matière d'encadrement de la libéralisation, les hypothèques restent nombreuses. L'amendement que nous avons cosigné, qui permettra une évaluation de la politique de libéralisation du secteur postal dans les deux ans de l'entrée en vigueur du texte, est donc fondamental.
En conclusion, nous avons examiné le texte avec lucidité. Lucidité, car nous sommes dans un contexte européen dont nous savons qu'il laisse peu de marge de manœuvre. Il était donc essentiel qu'un texte vienne réguler la libéralisation. Mais cette libéralisation peut aussi être mal régulée. Cela peut correspondre à des désastres en matière sociale, à la dégradation du service universel et à une désertification accrue des régions rurales.
C'est parce que nous ne sommes pas convaincus, monsieur le ministre, que le texte réponde à toutes ces questions que nous ne voterons pas en faveur de ce texte.

If we should emphasize the progress of the text in the framework of liberalization, mortgages remain numerous. The amendment that we co-signed, which will allow an evaluation of the postal sector liberalization policy within two years of the entry into force of the text, is therefore fundamental.
In conclusion, we examined the text with lucidity. Clearness, because we are in a European context that we know leaves little room for manoeuvre. It was therefore essential that a text came to regulate liberalization. But this liberalization can also be poorly regulated. This can correspond to social disasters, deterioration of universal service and increased desertification of rural areas.
It is because we are not convinced, Mr. Minister, that the text answers all these questions that we will not vote in favour of this text.

Mijnheer de voorzitter, mijnheer de minister, collega’s, wij zullen voorliggend wetsontwerp niet goedkeuren, niet zozeer omdat wij tegen de liberalisering van de postmarkt zijn, maar omdat wij een aantal fundamentele argumenten hebben om het ontwerp niet goed te keuren.
Eerst en vooral is er onze historische verantwoordelijkheid tegenover de huidige Belgische bpost. Het voorbije jaar, in de aanloop van de liberalisering van de markt, hebben wij al kunnen vaststellen dat een aantal nefaste gevolgen binnen de Belgische post waarneembaar was. Ik verwijs bijvoorbeeld naar het systeem van het aantal stakingen dat heeft plaatsgevonden. Ik denk dat u ze al niet meer kunt tellen, het aantal dat dit jaar in de diverse postkantoren heeft plaatsgevonden. De posterijen houden ook rekening met een verlies tussen 10 % en 30 %. Men mikt in het midden, op 20 %. Dit zal toch een aantal gevolgen hebben. Toen ik u daarover ondervroeg in de commissie bleef u op de vlakte en speelde u gemakshalve de bal door aan uw collega, minister Vervotte. Over de gevolgen van de liberalisering moesten wij niet u ondervragen, maar mevrouw Vervotte.
Anderzijds is er ook de problematiek van het absenteïsme bij het personeel van de post. Dat is toch dramatisch hoog, rond de 8 % tot 9 %. Dat cijfer is tekenend. Niet dat die mensen zich nogal gemakkelijk ziek laten noteren, maar het element werkdruk ligt bijvoorbeeld veel te hoog. Men probeert dat op te vangen met het systeem van hulppostbodes in een soort van statuut. Men kon daarstraks wel een boompje opzetten over de beperking die men wil invoeren inzake het werken met zelfstandigen, maar het statuut van hulppostbode is niet veel beter.
Ook op de kwaliteit van dienstverlening heeft men de voorbije jaren moeten inboeten. Ik verwijs naar het invoeren van de postpunten, naar de openingsuren, naar hoe men nog telefonisch zijn postkantoor kan bereiken, naar bijvoorbeeld hoe de pensioenen vandaag worden uitbetaald. De dienstverlening is er enorm op achteruitgegaan.

Ondanks die daling van de klassieke postvolumes – in 2009 min 4 procent – is De Post er toch nog in geslaagd om in 2009 een operationele winst van 240 miljoen euro te realiseren. Tijdens zijn persconferentie heeft de heer Thijs gisteren verklaard dat men gaat voor het principe van geen naakte ontslagen zolang het enigszins mogelijk is. Dat is reeds een beetje toegift. Men moet het lezen als “bereidt u maar voor, er zullen ontslagen volgen”. In deze moet de overheid haar rol spelen en moet ze haar historische verantwoordelijkheid tegenover De Post opnemen.
In verband met de bespreking zelf wil ik eerst voorzitter De Block loven voor de wijze waarop dit wetsontwerp in de commissie aan bod is gekomen. Zij heeft alle partijen de kans te geven om ten volle het debat te voeren. Ik heb ook woorden van lof voor de mensen die het verslag hebben opgesteld, mevrouw De Bue en de heer Maertens. Het is een correcte weergave en alle partijen kunnen zich herkennen in dit verslag.
Mijnheer de minister, een tweede punt van kritiek is de timing, het tijdskader waarbinnen wij dit wetsontwerp ter bespreking hebben gekregen. Er is een gedachtewisseling geweest in 2008. Dan is er een reisje geweest naar Zweden met enkele parlementsleden. In de loop van oktober van dit jaar bent u dan ineens bevallen van een wetsontwerp. Ineens moet dat wetsontwerp er komen, nog geen drie maanden voor die markt moet vrij zijn, ineens is dat daar en wordt de bespreking in de commissie aangevat. Dat gebeurt dan bij hoogdringendheid, dus ineens moet alles veel sneller gaan. Nochtans was er in uw eigen Ministerraad reeds einde 2009 een akkoord. Waarom hebt u zo lang gewacht? Ik denk toch dat u veel sneller met een concreet wetsontwerp naar de commissie had kunnen komen.
Een van de gevolgen van uw holderdebolder is dat er diverse opmerkingen zijn geweest van de Raad van State en ook nadien nog van de juridische dienst van de Kamer. Er zijn veel elementen aanwezig die erop wijzen dat men overhaast te werk is gegaan.
Wij hebben in de commissie natuurlijk het geluk gehad om over een aantal visionaire kamerleden te kunnen beschikken. Ik verwijs naar mevrouw Somers en de helaas afwezige heer Van den Bergh die in staat waren om amendementen op te stellen op basis van een niet-bestaand verslag van de juridische dienst van de Kamer. De juridische dienst van de Kamer heeft dit bezorgd aan de voorzitter van de commissie maar blijkbaar wisten er reeds kamerleden wat er in stond en die in staat waren om op basis van dat verslag amendementen op te stellen.

We, of course, have been lucky in the committee to have a number of visionary Chamber members. I refer to Ms. Somers and the unfortunately absent Mr. Van den Bergh who were able to draft amendments on the basis of a non-existent report from the Chamber’s Legal Service. The Chamber’s legal service provided this to the chairman of the committee but apparently the members of the Chamber already knew what was in it and who were able to draw up amendments on the basis of that report.

Een en ander heeft natuurlijk een doel. Waarom heeft men zo lang gewacht om met het ontwerp naar de commissie te komen? Hoe langer men wacht, hoe minder tijd potentiële spelers hebben om zich voor te bereiden. Vandaag pas zullen wij weten wat de voorwaarden zijn, want er kunnen nog altijd amendementen goedgekeurd worden. Pas morgen, of na de publicatie in het Staatsblad, zal men weten wat de precieze voorwaarden zijn.
Zo is het natuurlijk gemakkelijk op 1 januari te zeggen: wij voldoen aan alle formele voorwaarden; de liberalisering is er. Uiteindelijk weet u zelf wel dat geen enkele private speler in staat is op 1 januari met een eigen project klaar te staan.
Mijn derde punt van kritiek is of het wel om een echte liberalisering gaat. Ik hoopte op een minister, die niet alleen kwik is, snel in timing, maar die ook prat gaat op zijn liberale principes en die wel degelijk de wens van Europa inzake de liberalisering van de postmarkt zou naleven. Ik stel echter vast dat er in het voorliggende wetsontwerp tal van beperkingen zitten, bijvoorbeeld wat de tijd betreft. De termijnen gaan van 6 maanden tot zelfs 1 jaar, voor de markt volledig wordt opengegooid.
Er zitten nog andere beperkende elementen in, bijvoorbeeld op het vlak van de bedeling. De voorwaarde zal zijn dat men in alle drie de gewesten post bedeelt. Er zijn ook beperkingen op het vlak van de tarieven. Er is een verplichting te werken met uniforme tarieven. De dekkingsgraad moet bovendien 80 % bedragen in elk van de 3 gewesten. Zeer liberaal kan ik dat alvast niet noemen! Kortom, mijnheer de minister, op het vlak van uw liberale principes presteert u ondermaats.
Collega’s, ik sta niet alleen met mijn kritiek op de strenge voorwaarden. Ook door de sector van zelfstandige organisaties die mogelijk wensen te participeren, wordt die kritiek geuit, zowel inzake de bedeling als de dekkingsgraad en het principe te mogen werken met zelfstandigen. Het principe dat men mag werken met zelfstandigen, wordt wel in het buitenland toegestaan. In dit land hebt u er blijkbaar geen oren naar.
In ieder geval, men overweegt klacht in te dienen bij Europa. Wij zullen wel zien wat die brengt. Over klachten bij Europa gesproken, bij de Europese Commissie loopt nog altijd een onderzoek naar de steun door de Belgische overheid aan bpost. Ik verneem echter dat bpost nog altijd geen provisie heeft aangelegd voor het geval het bedrijf veroordeeld wordt, indien Europa beslist dat die steun ten onrechte was.

There are other restrictive elements, for example, in the area of the arrangement. The condition will be that in all three regions the post will be requested. There are also restrictions in terms of tariffs. There is an obligation to work with uniform rates. In addition, the coverage rate must be 80 % in each of the 3 regions. I can’t call it very liberal. In short, Mr. Minister, in terms of your liberal principles, you perform undermeasurably.
Colleagues, I am not alone with my criticism of the strict conditions. This criticism is also expressed by the sector of self-employed organisations that may wish to participate, both with regard to the distribution and the extent of coverage and the principle of being allowed to work with self-employed persons. The principle that one can work with self-employed persons is permitted abroad. In this country you obviously have no ears for it.
In any case, they are considering filing a complaint with Europe. We will see what it brings. Speaking of complaints in Europe, the European Commission is still undergoing an investigation into the support of the Belgian government to bpost. However, I hear that bpost has still not charged a commission in the event that the company is convicted if Europe decides that the aid was unjust.

In verband met de dekkingsplicht heb ik een heel belangrijke opmerking. Ik wil de collega’s vragen zich neer te leggen bij de politieke realiteit, bij de maatschappelijke realiteit. Door in elk van de drie gewesten de verplichting van 80 % op te leggen, creëert men als het ware de verplichting dat het Belgische organisaties moeten zijn. België zal nog worden gered dankzij de post.
Het is in de realiteit is nu eenmaal zo dat de meeste poststromen, zich afspelen tussen Brussel enVlaanderen en omgekeerd, en tussen Brussel en Wallonië en omgekeerd. Er is helaas, behalve tussen Elio Di Rupo en Bart De Wever, heel weinig briefwisseling tussen Vlaanderen en Wallonië.
Een tweede punt van kritiek betreft de rol die men bpost toebedeelt in verband met de ondersteuning voor de verspreiding van dagbladen en tijdschriften. Ook daar verwacht men dat men onder de prijs zal mogen werken. Er zal dus een bijkomende steun komen vanuit de overheid. Ook daarop is in het verleden al kritiek geuit vanuit de markt van de verkoop van dagbladen en tijdschriften, die duidelijk spreken van concurrentievervalsing. Ook daar, mijnheer de minister, waar zijn uw principes?
Een ander belangrijk aspect dat hier al werd aangehaald door de collega’s van N-VA, is dat van de taalwetgeving. Ook daar stellen wij vast dat in het huidig wetsontwerp er helemaal geen sprake is van de taalwetgeving waaraan de Belgische Post nog altijd moet voldoen. Blijkbaar is dat voor u geen bezwaar meer. Nochtans is het volgens mij heel belangrijk dat alle spelers die zich vanaf 1 januari 2011 zouden kunnen aanbieden op de markt, toch minstens de taal moeten respecteren.
In de commissie zei u dat die mogelijke potentiële spelers wel het gezond verstand zouden hanteren. Mijnheer de minister, ik moet helaas tot mijn ontgoocheling vaststellen dat heel wat commerciële firma’s die actief zijn in Vlaanderen en Brussel dat gezond verstand tot op vandaag helemaal niet hanteren. Ga gerust eens mee naar de Vlaamse rand, waar het Frans reeds heel manifest aanwezig is. Blijkbaar is daar toch geen plaats voor dit gezond verstand.
Collega’s, dit zijn de redenen waarom ik namens mijn fractie twee amendementen heb ingediend. In een amendement voorzien wij de optie om zich met betrekking tot de dekkingsgraad binnen die drie gewesten te beperken tot minstens twee gewesten. Ik pleit er zeker niet voor dat de post morgen zou stilvallen tussen Vlaanderen en Wallonië, maar ik meen dat men de keuze moet laten tot de groei van een mogelijk potentiële partner in Vlaanderen en Wallonië.

Another important aspect that has already been cited here by the colleagues of N-VA is that of the language legislation. We also note that in the current bill there is absolutely no mention of the language legislation to which the Belgian Post must still comply. This is no longer an objection to you. Nevertheless, I consider it very important that all players who could offer themselves on the market from 1 January 2011 must still respect at least the language.
In the committee you said that those potential players would use common sense. Unfortunately, to my disappointment, I must conclude that many commercial firms operating in Flanders and Brussels do not use this common sense at all to this day. Please go to the Flemish border, where French is already very manifestly present. There is no room for this common sense.
These are the reasons why I submitted two amendments on behalf of my group. In an amendment, we provide the option to limit itself to at least two regions with regard to the level of coverage within those three regions. I ⁇ do not advocate that the post should be stopped tomorrow between Flanders and Wallonia, but I think that one should leave the choice to the growth of a potential partner in Flanders and Wallonia.
Honour is worthy, it is N-VA who – quite rightly – proposed that in the committee. To my surprise, there are no N-VA amendments on the banks here today to defend the very important principle of respect for language legislation.

Il est en effet crucial de transposer cette directive avant le 31 décembre 2010. Autrement, la concurrence sera ouverte sans aucune condition et sans garantie de service minimum pour les clients car c’est cela qui est en effet le plus important: le maintien de la fourniture d’un service universel postal de façon durable et garantissant son financement.
Les obligations légales garantissent la distribution du courrier sur tout le territoire cinq fois par semaine et garantissent que le prestataire de service universel dispose au minimum d’un point de dépôt et de retrait du courrier n’ayant pas pu être distribué par commune fusionnée. C’est pourquoi nous sommes satisfaits de voir apparaître ces garanties pour nos concitoyens qui ont droit à ces services, peu importe l’endroit, même le plus reculé, où ils habitent. Le choix du gouvernement de désigner bpost comme fournisseur du service universel dès 2011 et ce, pour une période initiale de huit ans, paraît en effet le plus judicieux pour garantir la bonne réalisation de ce service.
Cette désignation assure également à bpost une source de revenus importante qui lui permettra de maintenir l’activité de son personnel. Il ne faut pas que cette libéralisation du secteur soit synonyme de pertes d’emplois. La libéralisation du secteur postal ne peut en effet se réaliser qu’au travers de conditions sociales humaines et décentes pour l’ensemble des travailleurs du secteur. Il est crucial de continuer à se battre pour une gestion humaine de la situation de bpost dans un marché postal de plus en plus ouvert. C’est pourquoi nous serons particulièrement attentifs aux prochaines décisions sur les conditions et procédures précises pour les désignations des futurs opérateurs de service universel par un mécanisme ouvert et dans le respect des principes d’objectivité, de transparence et de non-discrimination.

This designation also provides bpost with a significant source of income that will allow it to maintain the activity of its staff. This liberalization of the sector should not be synonymous with job losses. The liberalization of the postal sector can only be achieved through human and decent social conditions for all workers in the sector. It is crucial to continue to fight for human management of the bpost situation in an increasingly open postal market. Therefore, we will be ⁇ attentive to future decisions on the precise conditions and procedures for the designation of future universal service operators through an open mechanism and in compliance with the principles of objectivity, transparency and non-discrimination.

Le marché a ensuite été progressivement ouvert à la concurrence, obligeant les opérateurs postaux historiques à revoir leur organisation, leurs méthodes de travail, leur rapport à la clientèle. Nous sommes progressivement passés d'un secteur, de fait monopole d'État à, dès le 1ᵉʳ janvier prochain, un marché postal totalement ouvert, où les domaines réservés auront disparu.
Je voudrais rappeler toute l'importance du secteur postal pour notre économie. Il représente plusieurs dizaines de milliers de travailleurs rien que dans notre pays, de l'ordre de millions dans l'ensemble de l'Union européenne. Mais en plus, de très nombreuses entreprises, organisations et citoyens utilisent quotidiennement le courrier postal.

Il y a plus de dix ans maintenant que bpost a commencé sa transformation. Cela a nécessité d'importants efforts de la part du personnel. Pensons simplement aux efforts consentis dans le cadre de Géoroute ou la réorganisation des réseaux de distribution de bureaux, pour ne citer que deux exemples.
Le patron de bpost indiquait hier encore que l'entreprise se prépare à relever deux défis majeurs, bien sûr l'arrivée de nouveaux acteurs sur le marché, mais aussi l'évolution de nouvelles technologies qui poussent le public à utiliser de plus en plus les voies digitales. M. Thijs a affirmé que si l'on ne faisait rien, on risquait de perdre 400 millions d'euros en raison de cette concurrence.
Le projet de loi que nous avons approuvé en commission de l'Infrastructure moyennant un certain nombre d'amendements prévoit certains garde-fous de manière à ce que la concurrence soit la plus efficace possible. L'entreprise bpost verra le coût de ses obligations de service universel compensé par l'État de manière à ce que l'entreprise ne soit pas défavorisée par rapport à ses concurrents. Chaque nouvel opérateur aura des obligations de couverture géographique dans chacune des trois Régions du pays pour éviter l'écrémage qui consisterait à ne servir que les gros clients intéressants et laisser les petits clients moins rentables au prestataire de service universel, bpost. Enfin, les tarifs devront être transparents et non discriminatoires. Une autre mesure a été prévue pour éviter une concurrence qui aurait pu conduire à un certain dumping social, pour lutter contre les faux indépendants qui sont actifs dans certains domaines du secteur postal.
Le projet que vous aurez à approuver a interdit le recours à des travailleurs indépendants pour des tâches de levée, de tri et de distribution. On aurait pu s'interroger sur cette mesure. Il est vrai que la lutte contre les faux indépendants a été estimée prioritaire et on s'est inspiré de l'exemple suédois en la matière.

The head of bpost also indicated yesterday that the company is preparing to meet two major challenges, of course the arrival of new players on the market, but also the evolution of new technologies that drive the public to use more and more digital routes. by Mr. Thijs said that if we do nothing, we risk losing 400 million euros due to this competition.
The bill, which we approved in the Infrastructure Committee with a number of amendments, provides for certain barriers in such a way that competition is as effective as possible. The bpost undertaking will see the cost of its universal service obligations compensated by the state in such a way that the undertaking is not disadvantaged in relation to its competitors. Each new operator will have geographical coverage obligations in each of the three Regions of the country to avoid deflation that would consist of serving only the big customers of interest and leaving the small customers less profitable to the universal service provider, bpost. The tariffs must be transparent and non-discriminatory. Another measure was envisaged to avoid competition that could have led to a certain social dumping, to combat counterfeit independent workers who are active in certain areas of the postal sector.
The project you will have to approve has prohibited the use of self-employed workers for lifting, sorting and distribution tasks. We could have questioned this measure. It is true that the fight against false independent workers was considered a priority and it was inspired by the Swedish example in this matter.

Je souhaite attirer votre attention sur le fait qu'il ne suffit pas de voter des textes, aussi bons nous semblent-ils: encore faut-il qu'ils soient bien appliqués. Plusieurs arrêtés royaux – comme celui relatif aux exigences essentielles – doivent encore être pris pour une transposition pleinement efficace de la directive. Il faut éviter en effet que la Belgique soit prise en défaut de transposition.
Nous demandons également que le régulateur ait les moyens de contrôler le respect des règles par les différents acteurs, que ce soit en matière de couverture géographique, de fréquence, de tarification et du respect des règles sociales, de l'identification du personnel et des envois ou du traitement des plaintes. Il faudra également prévoir le renfort en personnel que ces nouvelles tâches exigent.
Je souhaite rappeler que nous soutenons la proposition avancée par nos collègues pour que les conséquences de l'ouverture du marché postal soient évaluées dans les deux ans de son entrée en vigueur et entraînent si nécessaire des adaptations de la législation.
En conclusion, monsieur le président, chers collègues, le texte qui nous est présenté aujourd'hui est un bon compromis et je vous propose de l'approuver pour que toutes les mesures puissent être prises dans les délais pour encadrer parfaitement le marché postal qui doit être totalement ouvert dès le 1ᵉʳ janvier prochain, c'est-à-dire dans quelque six semaines.

It will also be necessary to provide for the personnel reinforcement that these new tasks require.
I would like to remind you that we support the proposal made by our colleagues that the consequences of the opening of the postal market should be assessed within two years of its entry into force and involve adjustments of the legislation if necessary.
In conclusion, Mr. Speaker, dear colleagues, the text presented to us today is a good compromise and I propose you to approve it so that all measures can be taken in time to perfectly frame the postal market, which must be fully open from 1 January next year, that is, in about six weeks.

Ik moet altijd op een goed blaadje bij haar staan maar wij hebben in de commissie wel degelijk de tijd gekregen om hier terdege over te debatteren. Gelet op de hoogdringendheid van de behandeling vond ik het zeer goed dat wij de mogelijkheid hebben gekregen om ten gronde van mening te verschillen. Dat is de essentie van een Parlement, tussen meerderheid en oppositie. Mevrouw de voorzitter heeft ons die ruimte gelaten. Ik wil ook de rapporteurs danken voor hun verslag.
Het klopt inderdaad dat wat we vandaag bespreken eigenlijk de omzetting is van een Europese richtlijn. Dit betekent derhalve eigenlijk dat het kader vastligt en dat er nog een aantal spelregels moeten worden bepaald door de scheidsrechter. Net als in het voetbal wordt de scheidsrechter bijgestaan door twee grensrechters en tegenwoordig ook door een vierde scheidsrechter. In dit dossier is eigenlijk hetzelfde gebeurd.
De scheidsrechter in de liberalisering van de postale markt was minister Van Quickenborne, bijgestaan door een aantal andere ministers die assisteerden bij het bepalen van de spelregels. Dat was belangrijk om dat we gedurende de etappe van meer dan twee jaar die aan deze wetgeving is voorafgegaan bij de bespreking van beleidsnota’s in de commissie voor de Infrastructuur soms minister Vervotte aan de tand gevoeld hebben als minister van Overheidsbedrijven inzake De Post en mevrouw Milquet omtrent de arbeidsvoorwaarden. Zelf ben ik niet overtuigd van de meerwaarde voor sommige sectoren van een aantal wetgevingen inzake liberalisering.
Tijdens de commissievergadering heb ik degenen die de pen vasthielden bij de liberalisering van de postmarkt, vergeleken met de ayatollahs van de vrije markt. Ik heb er onmiddellijk aan toegevoegd dat mijn vergelijking overdreven was. Niettemin kan volgens mij een blinde liberalisering vast en zeker geen goed doen.
Collega’s, ik hoef hier niet te verhelen dat ik ideologisch niet geloof in de invisible hand van de vrije markt.
Dat waren mijn filosofische bedenkingen. Ik voeg er meteen aan toe dat ik niet de man ben om de oude dirigistische planeconomie te verdedigen. Ik ben echter wel de verdediger van moderne, transparante overheidsbedrijven die de burgers een goede dienstverlening bieden. Om een goede dienstverlening te kunnen bieden, is er een evenwicht nodig, zodat de geboekte inkomsten de niet-rendabele uitgaven kunnen dekken. Dat is, in een korte definitie, de essentie van een overheidsbedrijf.
Ik kijk naar Groot-Brittannië en pik er het voorbeeld van de spoorwegen uit. Bij de liberalisering van de spoorwegen aldaar werden de beste lijnen geprivatiseerd. Die lijnen kwamen in handen van privéondernemingen. De andere lijnen kwamen in handen van de overheid en zij werden verlieslatend. Voor onze partij moet er een sterk social level playing field komen, zodat aan de blinde liberalisering grenzen worden gesteld. Ik heb gelezen dat sommige bedrijven op 2 januari 2011 klacht zullen indienen tegen de maatregelen in het kader van de social level playing field. Dat is dan voor hun rekening. Volgens mij is een social level playing field immers heel belangrijk.
Bij de stemming over het voorliggende wetsontwerp hebben wij ons in de commissie onthouden. Wij zullen dat vandaag opnieuw doen. De voorliggende wetgeving bevat immers nog een groot aantal verwijzingen naar koninklijke uitvoeringsbesluiten. Er zijn nog een aantal vragen en onduidelijkheden waarop wij vanop de oppositiebanken op het moment van de onderhandelingen over de voorliggende wetgeving, geen zicht hadden. Daarom zullen wij ons opnieuw onthouden.

I look at Britain and take the example of railways. With the liberalization of the railways there, the best lines were privatized. These lines came into the hands of private companies. The other lines came into the hands of the government and they became losing. At some point, the losing lines and trains were deleted. The result was that the users of those lines could walk on foot or had to draw their plan. The same happened with the Royal Mail. Also there followed from liberalization a sort of cherry picking.
Therefore, it is incredibly important that the implementation of the liberalization legislation comes with rules of play, a level playing field. For our party, there must be a strong social level playing field, so that the blind liberalization is set boundaries. I have read that some companies will file a complaint on 2 January 2011 against the measures under the social level playing field. That is at their expense. A social level playing field is very important.
In the vote on the bill, we abstained in the committee. We will do it again today. Indeed, the legislation in question still contains a large number of references to royal enforcement orders. There are a number of questions and uncertainties that we did not see from the opposition banks at the time of the negotiations on the current legislation. Therefore, we will remember again.

Ik ga kort nog in op een aantal elementen. Een ervan is de geografische dekking. Andere collega’s hebben dat hier al aangehaald. Enerzijds geven wij, terecht, aan de historische operator, bpost, de verplichting om vijfmaal per week post aan te bieden. Anderzijds, private concurrenten dienen na twee jaar tweemaal per week post aan te bieden. In een aantal interviews heb ik gelezen dat ook bpost zich afvraagt in welke mate het nog vijfmaal per week aan de deur moet komen in de toekomst. Bpost vraagt zich ook af of dat haalbaar zal zijn. Ik hoop van wel, want anders zou het een achteruitgang betekenen. Als die vraag vandaag reeds wordt gesteld, dan duidt het erop dat de verplichting van tweemaal per week waarschijnlijk een ongeoorloofd concurrentieel voordeel biedt aan private concurrenten.
Inzake de dekkingsgraad staat in de wetgeving: een graduele versterking van 10 % geografische dekkingsgraad per gewest in het eerste jaar naar 80 % na twee jaar. Sommige groepen hebben amendementen ingediend om tot 100 % te komen. Bij de stemming daarover zullen wij die amendementen steunen. Aangaande dat amendement van 80 % stel ik mij vragen. Dat amendement hadden wij ingediend in de commissie en wij hebben het vandaag opnieuw ingediend. Als een bedrijf besluit om zich na twee jaar te laten overnemen door een andere kapitaalverschaffer, zal de teller van dat bedrijf dan opnieuw op nul staan, zodanig dat de verplichting van de geografische dekking niet meer geldt? In ons amendement is een percentage van kapitaalverschaffing vermeld.
Ik kom tot de organisatie van het postgebeuren. Uit een tabel die ik gekregen heb van bpost, blijkt dat ongeveer 85 % van de omzet gerealiseerd wordt door minder dan 1 % van de klanten. Dat wil dus eigenlijk zeggen dat een duizendtal bedrijven zorgt voor het overgrote deel van het postverkeer. Gelet op die cijfers spreekt het voor zich dat de concurrentie gevoerd zal worden bij die duizend klanten, want die zijn het meest interessant om concurrentie voor te voeren. Die bedrijven zullen dus waarschijnlijk een voordeel hebben aan de liberalisering. Zij zullen een betere prijs krijgen. Maar wanneer op het einde van de rit de balans weer in evenwicht gebracht moet worden, wil dat zeggen dat het concurrentieel voordeel en de nieuwe prijs voor de grote klanten, betaald zal moeten worden door particulieren, zelfstandigen, kmo’s, gemeentebesturen en dergelijke. Zij zullen de rekening moeten betalen van hetgeen anderen krijgen.
Ik kom tot het social level playing field. Ik erken dat in het wetsontwerp verschillende pogingen zijn ondernomen om een aantal beschermingsmechanismen in te voeren. Dat is belangrijk, omdat 70 % van de totale kosten bij de postale bedrijven loonkosten zijn. Wanneer de loonkosten 70 % uitmaken van de totaalkosten, dan kan een blinde zien dat daarop de concurrentie gevoerd zal worden, omdat het een af te romen percentage zal zijn. De concurrentie zal dus gevoerd worden op loonkosten, eigenlijk “op de klak van de gewone facteur”.
Ik moet vaststellen dat ook de historische operator enkele jaren geleden al een beweging heeft ingezet om zich concurrentieel voor te bereiden, onder andere door een nieuw soort van loon- en arbeidsvoorwaarden naar voren te schuiven.

I will briefly refer to a few elements. One is the geographical coverage. Other colleagues have already mentioned this here. On the one hand, we rightly give the historical operator, bpost, the obligation to offer post five times a week. On the other hand, private competitors must offer post twice a week after two years. As regards the coverage level, the legislation provides: a gradual increase from 10 % geographical coverage per region in the first year to 80 % after two years. Some groups have submitted amendments to reach 100%. We will vote in favour of these amendments. I am asking about this 80% amendment. That amendment we had submitted in the committee and we have submitted it again today. If a company decides to be taken over by another capital provider after two years, will the counter of that company then again be zero, so that the obligation of geographical coverage no longer applies? Our amendment states a percentage of capital provision.
I come to the organization of the postal events. A table I received from bpost shows that approximately 85% of sales are generated by less than 1% of customers. This means that a thousand companies account for the vast majority of the postal traffic. Given these numbers, it is obvious that the competition will be carried out with those thousand customers, because they are the most interesting to drive competition. Those companies are likely to benefit from liberalization. They will get a better price. But when at the end of the journey the balance sheet needs to be balanced again, that means that the competitive advantage and the new price for the big customers, will have to be paid by individuals, self-employed, SMEs, municipal governments and the like. They will have to pay the bill for what others get.
I come to the social level playing field. I acknowledge that in the bill several attempts have been made to introduce a number of protective mechanisms. This is important because 70 % of the total costs of the postal companies are wage costs. When the wage costs are 70% of the total costs, then a blind can see that there will be competition on it, because it will be a percentage to be reduced. The competition will therefore be carried out on wage costs, in fact “on the clock of the ordinary factor”.
I must note that even the historical operator has already launched a movement several years ago to prepare itself competitively, including by pushing forward a new type of wage and working conditions.

In de commissie vorig jaar is er een discussie gevoerd over het statuut van de wijkpostbodes die aan 8,43 euro bruto per uur moesten werken. Na syndicale acties is dat plan ingetrokken. Wij hebben nu hulppostbodes die in een iets beter, maar wat mij betreft nog steeds precair statuut zitten. Die loon- en arbeidsvoorwaarden moeten bij bpost worden verbeterd via syndicale onderhandelingen, maar zij zullen ook een belangrijk element worden in de gesprekken met de nieuwe spelers.
Ik kom dan tot de vraag tot welk paritair comité die nieuwe spelers zullen behoren. In de vorige legislatuur heb ik vragen gesteld aan de minister van Arbeid en zij antwoordde mij dat dit onder het comité 100 zou vallen. Voor mij is dit nog onduidelijk. Ik hoop dat hierover alsnog duidelijkheid kan worden gegeven.
Wat betreft de arbeidsplaatsen hebben wij deze morgen in een kranteninterview kunnen lezen dat de ceo van de post aankondigt dat er per jaar 1 000 mensen het bedrijf zullen verlaten. Het gaat dan niet over naakte ontslagen, maar toch betekent dit dat de tewerkstelling tussen 2003 en nu van iets meer dan 40 000 naar minder dan 33 000 is gedaald. De facto is er in die sector een enorm netto jobverlies.
In het interview stond dat dit niet alleen te wijten is aan de liberalisering, maar ook aan een daling van de postvolumes. Mijnheer de voorzitter, liefdesbrieven worden waarschijnlijk niet meer geschreven. Vandaag vraagt men het aan via sms, twitter of mail. Dit zal natuurlijk wel een impact hebben op het volume van de post, maar het staat buiten kijf dat de post voor enorme uitdagingen staat. Wij zijn er niet van overtuigd dat de liberalisering ter zake een meerwaarde kan bieden.
Wat de artikelen betreft in verband met de elektronische verzending. Wij hebben ter zake gezegd dat dit nieuwe mogelijkheden biedt. Op het moment van de bespreking van de artikelen van dat wetsontwerp was het voor ons echter nog onduidelijk hoe dit in concreto zal worden georganiseerd.
Mijnheer de voorzitter, als u het mij toestaat, zal ik ineens ook mijn amendementen toelichten. Het eerste amendement betreft de overname in de kapitaalsverschaffing. Als er een nieuwe speler komt via een overname dient deze speler minimaal 25 % van het kapitaal over te nemen, zo niet moet de teller terug op nul worden gezet.
Ten tweede, de dekkingsgraad van 10 tot 80 % dient men zelf te bereiken en niet via onderaanneming omdat men anders volgens ons drie verschillende bedrijfseenheden zal krijgen in de verschillende gewesten. Een aantal collega’s kunnen dan hun post in hun taal krijgen, maar ik denk niet dat dit de bedoeling was van het wetsontwerp.
Een derde amendement dat wij in de commissie hadden ingediend heeft betrekking op een evaluatie van deze wetgeving. De rapporteur had eigenlijk zo correct moeten zijn om dit te vermelden. Andere sprekers hebben zich hierbij aangesloten. Het amendement werd goedgekeurd in de commissie. Ik hoop dat deze wetgeving achteraf zal kunnen worden geëvalueerd en wat ons betreft ook verbeterd.

In the committee last year there was a discussion on the status of the district post officers who had to work at 8.43 euros gross per hour. Following trade union action, this plan was withdrawn. In the interview, it was stated that this is not only due to liberalization, but also to a decline in postal volumes. Love letters are no longer written. Today, it is asked by SMS, Twitter or mail. This will, of course, have an impact on the volume of the post, but there is no doubt that the post is facing huge challenges. We are not convinced that liberalization in this area can provide added value.
As regards the articles in connection with electronic transmission. We have said that this offers new possibilities. At the time of the discussion of the articles of that bill, however, it was still unclear for us how this will be organized in concrete.
Mr. Speaker, if you allow me, I will suddenly explain my amendments. The first amendment concerns the acquisition in the capital provision. If a new player comes through an acquisition, that player must take over at least 25% of the capital, otherwise the counter must be set back to zero.
Secondly, the coverage rate of 10 to 80 % must be achieved on its own and not through subcontracting, because otherwise we believe that three different business units in the different regions will be obtained. Some colleagues can then get their post in their own language, but I don’t think that was the purpose of the bill.
A third amendment that we had submitted in the committee concerns an evaluation of this legislation. In fact, the rapporteur should have been so correct to mention this. Other speakers joined. The amendment was approved in the committee. I hope that this legislation will be able to be evaluated and improved in our case.

Monsieur le président, monsieur le ministre, chers collègues, dix-huit ans nous séparent aujourd'hui du Livre vert adopté par la Commission européenne sur le développement du marché unique des services postaux; dix-huit ans pour déconstruire le monopole postal et imposer le grand marché libéralisé des services postaux; dix-huit ans pour imposer un modèle idéologique qui ne résiste pas à l'épreuve des faits, mais qui pourtant s'est imposé.
Je ne referai pas ici l'historique de la libéralisation du secteur postal, libéralisation voulue et imposée par l'Europe, libéralisation totale que nous, socialistes belges, avons toujours combattue depuis le début, que ce soit dans l'enceinte de ce parlement ou au niveau européen.
Je ne relèverai pas non plus toutes les craintes et critiques qui ont accompagné ces trois directives: libéralisation trop rapide et irréfléchie, manque de garde-fous, mise en danger du service public, risque de dumping social; la liste est encore longue.
Je rappellerai néanmoins que, face à cette libéralisation imposée, les socialistes ont fait le choix d'une attitude constructive en veillant à l'encadrer au maximum afin de maintenir, pour l'ensemble de nos concitoyens, un service postal de qualité.
Cela ne signifie par pour autant que le groupe socialiste de la Chambre considère l'avenir du secteur postal, de ses usagers et de ses travailleurs comme un long fleuve tranquille. Nos inquiétudes demeurent réelles. Quid du maintien à long terme de la qualité du service postal sur l'ensemble du territoire? Quid du maintien de l'emploi de qualité pour l'ensemble des travailleurs de ce secteur? Quid du maintien et du renforcement du rôle social du facteur? Quid du maintien du renforcement du réseau postal s'appuyant, madame la ministre, sur de vrais bureaux de poste et non sur des Points Poste?
Enfin, la théorie est toujours belle et remplie de promesses. Selon celles et ceux qui défendent depuis toujours cette libéralisation: "L'ouverture complète des marchés postaux favorisera l'augmentation de leur taille globale. Elle contribuera également au maintien d'emplois pérennes et de qualité dans les entreprises prestataires du service universel."
Voilà, chers collègues, les théories européennes de la libéralisation du secteur postal. Une opération profitable à tous: simples citoyens, petites, moyennes ou grandes entreprises clientes, opérateurs historiques ou opérateurs privés actuels et futurs, travailleurs d'aujourd'hui et de demain.
Malheureusement, cet optimisme textuel se heurte aux effets déjà ressentis dans notre pays par La Poste, opérateur historique qui, en s'adaptant au futur marché libéralisé, fait, de nos jours, de nombreuses victimes collatérales. J'ai nommé les travailleurs du secteur postal et les simples clients. On a déjà pu constater le nombre de pertes d'emploi. Ces dernières ont été évoquées par mon collègue. En effet, la création de facteurs de quartiers ou de facteurs auxiliaires constitue-t-elle une avancée sociale? L'explosion du nombre d'intérimaires déjà employés par La Poste constitue-t-elle un modèle de recrutement pour une entreprise publique? Non.

Today, eighteen years separate us from the Green Paper adopted by the European Commission on the development of the single market for postal services; eighteen years to deconstruct the postal monopoly and impose the large liberalized market for postal services; eighteen years to impose an ideological model that does not resist the test of facts, but has yet imposed itself.
I did not refer here to the history of the liberalization of the postal sector, the liberalization wanted and imposed by Europe, the total liberalization that we, Belgian socialists, have always fought from the beginning, whether in this parliament or at the European level.
I will also not highlight all the fears and criticisms that accompanied these three directives: too rapid and unthinkable liberalization, lack of warnings, endangering the public service, risk of social dumping; the list is still long.
I will, however, recall that, in the face of this imposed liberalization, the Socialists have chosen a constructive attitude by making sure to frame it as much as possible in order to maintain, for all our fellow citizens, a quality postal service.
This does not mean, however, that the Socialist Group of the House considers the future of the postal sector, its users and its workers as a long, quiet river. Our concerns remain real. What about the long-term maintenance of the quality of the postal service across the whole territory? What about ⁇ ining quality employment for all workers in this sector? What about ⁇ ining and strengthening the social role of the factor? What about ⁇ ining the strengthening of the postal network based, Mrs. Minister, on real post offices and not on Post Points?
Finally, the theory is always beautiful and full of promises. According to those who have always defended this liberalization: “The complete opening of the postal markets will promote the increase of their overall size. It will also contribute to the maintenance of long-term and quality jobs in the companies providing universal service.”
Here, dear colleagues, are the European theories of the liberalization of the postal sector. A profitable operation for all: simple citizens, small, medium or large enterprise clients, historical operators or current and future private operators, workers of today and tomorrow.
Unfortunately, this textual optimism collides with the effects already felt in our country by La Poste, a historic operator who, by adapting to the future liberalized market, makes, today, many collateral victims. I appointed postal workers and ordinary customers. The number of job losses has already been seen. This was mentioned by my colleague. In fact, is the creation of neighborhood factors or auxiliary factors a social advance? Does the explosion in the number of temporary workers already employed by La Poste constitute a recruitment model for a public company? and no.

La libéralisation du secteur n'est pas une opération neutre au niveau social.
Évidemment, vous me rétorquerez qu'il était impératif que La Poste évolue, en même temps d'ailleurs que la société; que, devant l'évolution technologique et l'éclosion du courrier électronique, l'opérateur postal historique devait s'adapter. J'en suis bien consciente, mais je continue à regretter certaines orientations, certaines radicalisations qui nient en partie ce qui, pourtant, n'a jamais été nié, même par l'Europe.
Je citerai M. Barnier en date du 29 avril dernier: "Le service postal a une vraie dimension humaine, sociale et territoriale". Malheureusement, les mots ne sont pas tout.
Hier, lors d'une conférence de presse, il a été rappelé que l'administrateur délégué, M. Thijs, se fendait déjà d'un discours qui, à mon sens, est peu rassurant; d'autres l'ont entendu rassurant. Pour moi, ce discours était bien inquiétant. En substance, M. Thijs a averti: "Après le 1ᵉʳ janvier 2011 et durant les années suivantes, nous devons poursuivre notre processus de changement afin d'observer les effets de la baisse continue de volume et de la perte des deniers du monopole".
Si je partage évidemment les inquiétudes de M. Thijs face à l'arrivée des nouveaux opérateurs, ce n'est en tout cas pas toujours pour les mêmes raisons. Ce qui m'inquiète déjà aujourd'hui, ce sont les témoignages, de plus en plus nombreux, que je reçois. Hier encore, j'ai rencontré deux personnes, des intérimaires bénéficiant de contrats journaliers: chaque jour, un nouveau contrat doit être signé pour se rendre au centre de tri de Bruxelles. C'est totalement inacceptable pour une entreprise publique.
Sans pour autant libéraliser, monsieur le ministre, il fallait certes moderniser l'entreprise postale, mais en aucun cas, sur le dos des travailleurs. Il est regrettable d'observer que l'évolution des conditions de travail et des conditions d'embauche à La Poste sont aujourd'hui totalement dégradées.
Monsieur le ministre, il a souvent été question, avec humour, de la ménagère hollandaise qui, en Hollande, aujourd'hui, par le fait de la libéralisation, distribue le courrier après s'être occupée de ses enfants; cela peut concerner aussi le pensionné qui se charge de transmettre les lettres dans son quartier. J'ai l'impression que le détricotage social réalisé aujourd'hui dans notre entreprise publique nous amène petit à petit à cette ménagère hollandaise.
Les travailleurs ne sont pas et ne seront pas les seules victimes de la libéralisation du secteur postal: les clients pourront en être d'autres. Certains usagers seront sans doute gagnants: les gros clients, ceux qui envoient énormément de courrier, qui pourront solliciter un opérateur privé et obtenir des prix intéressants.
Mais faut-il vraiment s'étendre sur la hausse du prix du timbre qui anticipe la libéralisation du secteur postal? Dois-je reparler de la fermeture des bureaux? Depuis quatre ans, chaque semaine dans ce parlement, des questions concernent ce problème.

During a press conference, it was recalled that the delegated administrator, Mr. Thijs, he was already distracted by a speech that, in my opinion, is not reassuring; others have heard it reassuring. I agree with the concerns of Mr. Thijs facing the arrival of new operators, it is not always for the same reasons. What worries me already today are the testimonies, increasingly numerous, which I receive. Yesterday again, I met two people, interim workers benefiting from day-to-day contracts: every day, a new contract must be signed to go to the sorting center in Brussels. This is completely unacceptable for a public company.
Without, however, liberalizing, Mr. Minister, the post company should ⁇ be modernized, but in no case, on the back of the workers. It is regrettable to observe that the evolution of the working conditions and the conditions of employment at La Poste are now totally deteriorated.
Mr. Minister, it has often been discussed, with humor, about the Dutch housewife who, in Holland, today, by the fact of liberalization, distributes the mail after having taken care of her children; this can also concern the pensioner who is in charge of sending the letters in his neighborhood. I have the impression that the social detricotage carried out today in our public enterprise leads us gradually to this Dutch housewife.
Workers are not and will not be the only victims of the liberalization of the postal sector: customers may be others. Some users will probably be winners: big customers, those who send a huge amount of mail, who will be able to request a private operator and get interesting prices.
But should we really extend on the rise in the price of stamp that anticipates the liberalization of the postal sector? Should I talk about the closing of the offices? For four years, every week in this parliament, questions concern this issue.

Dois-je évoquer la disparition des boîtes postales dans nos quartiers, la qualité du service proposé à Monsieur et Madame Tout-le-monde ou encore le service de base qui ne s'est pas amélioré en raison de l'ouverture totale du marché?
Et que l'on ne vienne pas me dire, monsieur le ministre, que cela n'a rien à voir avec la libéralisation! Évidemment, cela n'est pas écrit noir sur blanc dans les textes de la directive. Mais c'est parce qu'on allait ouvrir totalement le secteur à la concurrence que l'on a pris des mesures, parce que l'on retire un monopole, l'on retire des parts de marché et donc de l'argent à La Poste, afin qu'elle puisse offrir tous ses services et toutes ses missions de services.
En ma qualité de socialiste, je l'ai déjà dit et je le répéterai, nous sommes opposés à cette libéralisation dogmatique. Mais nous ne nous sommes jamais contentés de dire "non", monsieur le ministre. En effet, d'importants débats ont eu lieu au sein de cette commission avec l'un de vos prédécesseurs, M. Daems, et grâce à ce parlement, l'ouverture n'a pas eu lieu en 2007 et a été reportée à 2011.
Nous avons donc gagné quelques combats, puisque le gouvernement a choisi d'encadrer cette libéralisation avec un certain nombre de garde-fous aujourd'hui, tant au niveau des conditions de travail, de la couverture du territoire que de l'étendue du service universel. Ce texte évite la jungle et apporte une certaine sécurité juridique, qui est absolument nécessaire à quelques semaines de la date fatidique du 1ᵉʳ janvier 2011.
Mon groupe votera, certes, ce texte, car nous connaissons l'urgence et l'importance de voir un texte, même imparfait, encadrer cette libéralisation qui sera effective dans quelques semaines. Ce ne sera pas un vote heureux de la part du groupe socialiste, seulement un vote nécessaire, sans joie mais responsable.
Sachez, cependant, monsieur le ministre, que le processus législatif, s'il se termine, les effets de la libéralisation ne sont, eux, pas arrivés à leur terme! Nous resterons donc actifs pour garantir un véritable service public et éviter au maximum les conséquences néfastes pour nos concitoyens, mais aussi et surtout pour les travailleurs du secteur postal.
À cet égard, je cite à nouveau M. Barnier, commissaire européen, qui paraît sensible à toutes ces situations, étant donné que, le 9 septembre dernier, il faisait appel, au niveau du Parlement européen, à la création d'un groupe d'utilisateurs pour évaluer précisément les effets de cette libéralisation.
Le groupe socialiste a saisi la balle au bond, en déposant une résolution visant à renforcer le Comité consultatif des usagers, afin que cet organe dispose réellement de moyens suffisants pour évaluer les effets concrets de cette libéralisation.

Should I mention the disappearance of postal boxes in our neighborhoods, the quality of the service offered to Mr. and Mrs. All-le-Monde or the basic service that has not improved due to the total opening of the market?

As a socialist, I have already said and will repeat, we are opposed to this dogmatic liberalization. But we never merely said “no,” Mr. Minister. There have been significant discussions within this committee with one of your predecessors, Mr. Daems, and thanks to this parliament, the opening did not take place in 2007 and was postponed to 2011.
We have thus won a few battles, since the government has chosen to frame this liberalization with a number of shutdowns today, both in terms of working conditions, territory coverage and the extent of universal service. This text avoids the jungle and brings some legal certainty, which is absolutely necessary a few weeks before the fateful date of January 1, 2011.
My group will, of course, vote on this text, because we know the urgency and importance of seeing a text, even imperfect, frame this liberalization that will be effective in a few weeks. This will not be a happy vote on the part of the Socialist group, only a necessary vote, without joy but responsible.
Know, however, Mr. Minister, that the legislative process, if it ends, the effects of liberalization have not yet reached their end! We will therefore remain active to guarantee a true public service and avoid as much as possible the adverse consequences for our fellow citizens, but also and above all for postal workers.

Nous avons souvent dénoncé le modèle hollandais, ce modèle tant loué par les adorateurs de la libéralisation, ce modèle faisant la part belle à l’emploi précaire avec un modèle de distribution du courrier par des pensionnés et des femmes au foyer. Bref, un modèle qui sacrifie le service public en économisant un maximum de richesses humaines sur son personnel pour maximiser les profits.
Voici quelques jours, le 16 novembre dernier, les facteurs hollandais partaient en grève pour protester contre les projets de l’entreprise TNT, à savoir une suppression de 3 000 emplois. Voilà l’effet de la libéralisation hollandaise qui a généré une nouvelle perte de 3 000 emplois! Là aussi, je suppose que l’entreprise parle de se préparer au mieux au marché libéralisé et que les dirigeants expliquent, comme M. Thijs, qu’il est nécessaire de continuer le changement et la libéralisation.
Chers collègues, j’ai peut-être été longue mais c’est un processus de dix-huit ans. Je signale que, derrière ce discours, il n’y a que 40 000 travailleurs et tous les citoyens qui, aujourd’hui ou demain, auront peut-être encore leur courrier! Pourtant, je n’ai pas l’impression que cela intéresse beaucoup de monde. Sachez que tout ce processus a ses limites et ce, tout particulièrement, dans une entreprise publique!
N’oublions pas l’importance du prochain contrat de gestion entre La Poste et l’État, ce contrat de gestion que nous espérons voir aboutir rapidement et qui, par la faute de la situation politique, reste actuellement en suspens. Ce nouveau contrat de gestion aura un rôle majeur pour l’avenir du secteur qui revêt une dimension humaine et sociale de premier plan dans nos villes et villages. Je peux vous assurer que le groupe socialiste y sera attentif.
Nous voterons donc ce texte aujourd’hui pour que notre pays tienne ses engagements au niveau européen, afin que La Poste dispose d’une sécurité juridique totale pour assumer son rôle et assurer sa survie dans un marché libéralisé. Nous resterons, plus que jamais, vigilants et attentifs aux effets de cette libéralisation pour nos concitoyens et les travailleurs du secteur postal.
Monsieur le ministre, nous aurons encore de nombreux débats et, je l’espère, des évaluations régulières, puisque nous avons aussi voté un amendement du sp.a qui demande une évaluation de ce parlement par rapport à la libéralisation de ce secteur postal.

This new management contract will play a major role for the future of the sector, which has a leading human and social dimension in our cities and villages. I can assure you that the Socialist Party will pay attention to this.
So we will vote on this text today so that our country keeps its commitments at the European level, so that La Poste has complete legal certainty to assume its role and ensure its survival in a liberalized market. More than ever, we will remain vigilant and attentive to the effects of this liberalization on our fellow citizens and postal workers.
Mr. Minister, we will still have many debates and, I hope, regular evaluations, since we also voted for an amendment of the sp.a which requires an evaluation by this parliament in relation to the liberalization of this postal sector.

Ik wil op een punt nogmaals ingaan. Dit is een belangrijk debat. Het gaat over tien miljoen Belgen die dikwijls van De Post gebruikmaken, over een bedrijf bpost met iets minder dan 30 000 werknemers, een van de grootste bedrijven van ons land. Het gaat over een sector die in volle beweging is.
In de uiteenzettingen zeggen velen dat de liberalisering veel te ver gaat. Enkelen zeggen dat het een liberalisering is die niet ver genoeg gaat. Daaruit kan ik alleen maar concluderen dat dit een goede liberalisering is.

Dan vraag ik mij af hoe het komt dat het bedrijf dat in de post actief is, haar rendabiliteit de voorbije jaren grondig heeft verhoogd van een verlies van ongeveer 50 miljoen euro naar een winst van 240 miljoen euro en haar aantal personeelsleden van 40 000 naar 30 000 heeft teruggebracht. De reden was dat men was gewaarschuwd en dat men wist dat de liberalisering er aan komt.

Er was dus twee keer een negatief effect. Die cruciale factor hebben wij dus zeker mee in rekening gebracht.

De resultaten zijn duidelijk. De parameters en de indicatoren staan op positief, zowel op financieel niveau, op het niveau van klantvriendelijkheid als op het niveau van de kwaliteit van de dienstverlening. In de dalende markt hebben wij dus geen afbouwoperatie gedaan, maar precies voor differentiatie gezorgd. Dat is positief en een verdienste van bpost zelf.
Hetgeen wel juist is, en dat wil ik absoluut niet onder stoelen of banken steken, is dat dit natuurlijk alleen maar kon gebeuren door de constante inspanningen van het personeel. Ja, wij hebben aan hen heel wat gevraagd. Het is correct dat het voor de werknemers van bpost niet gemakkelijker is geworden. Wij hebben echter wel een operatie doorgevoerd van constante kostenbesparing zonder ontslagen, zonder inleveringen van personeel en op een zachte manier.
Collega’s, spelregels afspreken is de beste garantie dat onder andere ook de kostprijs voor de burger niet stijgt. Het lijkt een contradictie, maar door de specificiteit van het product in combinatie met de markt, ik denk dan vooral aan de geografische gebieden en ook de productenmix, zou het wel eens kunnen gebeuren dat de prijs voor de consument zou stijgen.

What is right, and I absolutely don’t want to put it under chairs or benches, is that this, of course, could only happen through the constant efforts of the staff. Yes, we have asked them a lot. It is correct that it has not become easier for the employees of bpost. However, we have carried out an operation of constant cost savings without dismissals, without staff submissions and in a gentle way.
Colleagues, agreeing on the rules of the game is the best guarantee that, among other things, the cost for the citizen will not increase. It seems to be a contradiction, but due to the specificity of the product in combination with the market, I think especially the geographical areas and also the product mix, it could happen that the price for the consumer would rise.

Aangezien wij nog geen zicht hebben op de uitkomst van het dossier, hebben wij beslist om dat momenteel nog niet te doen. Wij zitten nog in een fase waarin er enkel vragen gesteld worden. Ik wil er ook aan toevoegen dat de revisoren de jaarrekeningen hebben goedgekeurd. Zeggen dat bpost niet vooruitziend is, is totaal in contradictie met het beleid en de strategie van de voorbije jaren. Ik denk dat die strategie en het beleid het beste bewijs zijn dat bpost zeer vooruitziend is. Het heeft er ook voor gezorgd dat men zich op de liberalisering van de markt voorbereid heeft en dat men met vertrouwen de toekomst tegemoet kan zien.

Furthermore, we must not lose sight of the fact that the instrument of the management agreement, which we will decide on together, still exists. Then it will also become clear what importance the Parliament and the Government will attach to the provision of postal services. That instrument remains. So we can handle it.

Monsieur le président, madame la ministre, messieurs les ministres, chers collègues, la commission des Affaires sociales a examiné ce projet de loi lors de la réunion du 27 octobre dernier.
Dans son exposé introductif, la ministre de l'Emploi a tout d'abord rappelé que les médecins, dentistes, vétérinaires et étudiants stagiaires se préparant à l'exercice de ces professions ont toujours été exclus des dispositions de la loi du 16 mars 1971 sur le travail en ce qui concerne la durée du travail et les temps de repos, de sorte qu'aucune limite ne s'appliquait.
À la suite des observations de la Commission européenne concernant la transposition de la directive 93/104 et la nécessité d'inclure également les médecins spécialistes en formation dans le champ d'application des dispositions en matière de durée du travail (directive 2000/34), une base légale fut introduite dans la loi de 1971. Elle permettait au Roi de prévoir des conditions d'application particulières en matière de durée de travail, conditions adaptées à la profession médicale.
Après de nombreuses difficultés, un arrêté d'exécution a pu être adopté le 16 juin 2003, mais d'autres arrêtés, notamment sur la problématique des périodes de garde, n'ont pu être pris, les arrêts Jaeger et Simap de la Cour de justice ayant empêché la concrétisation d'un accord, ceux-ci estimant que les temps de garde devaient faire partie du temps de travail.
Faisant suite à cette impossibilité de tenir les engagements pris avec les représentants du secteur médical, une requête en annulation de l'arrêté royal du 16 juin 2003 a été introduite à la demande des hôpitaux universitaires. Le 9 février 2004, le Conseil d'État a annulé l'arrêté royal pour des questions de forme.
Un espoir avait été placé dans la proposition de révision de la directive européenne 2003/88 concernant certains aspects de l'aménagement du temps de travail, mais cette proposition ne fut jamais adoptée à cause d'un désaccord entre le Parlement et le Conseil, désaccord qui sera entériné par l'échec du comité de conciliation en mai 2009.
Comme suite à cet échec, la négociation était relancée dans notre pays à l'initiative du ministre de l'Emploi et de la ministre de la Santé publique. La nécessité d'aboutir à une solution a été renforcée par la mise en demeure, en date du 23 novembre 2009, de la Commission européenne concernant la non-transposition des dispositions en matière de durée du travail pour ces catégories de travailleurs.
De manière synthétique, la durée hebdomadaire de travail des travailleurs concernés ne pourra pas dépasser 48 heures en moyenne sur une période de référence de treize semaines et est introduite une limite absolue par jour (24 heures) et par semaine (60 heures), sauf pour les cas de force majeure.
Chaque prestation de travail comprenant au minimum 12 heures et 24 heures maximum devra comporter un intervalle de repos de minimum 12 heures consécutives.

Following the observations of the European Commission on the transposition of Directive 93/104 and the need to include specialized physicians in training within the scope of the provisions on working hours (Directive 2000/34), a legal basis was introduced in the Act of 1971. It allowed the King to provide special conditions of application in terms of working hours, conditions suitable for the medical profession.
After many difficulties, an enforcement order could be adopted on 16 June 2003, but other decisions, in particular on the problem of custody periods, could not be adopted, as the judgments Jaeger and Simap of the Court of Justice prevented the realization of an agreement, which found that custody time should be part of working time.
Following this inability to fulfill the commitments made with the representatives of the medical sector, a request for annulment of the Royal Decree of 16 June 2003 was lodged at the request of the university hospitals. On 9 February 2004, the Council of State annulled the royal decree for formal issues.
Hope had been placed in the proposal for the revision of European Directive 2003/88 concerning certain aspects of the organisation of working time, but this proposal was never adopted due to a disagreement between Parliament and Council, which will be confirmed by the failure of the Conciliation Committee in May 2009.
Following this failure, negotiations were resumed in our country at the initiative of the Minister of Employment and the Minister of Public Health. The need for a solution has been reinforced by the Commission’s complaint, dated 23 November 2009, regarding the non-transposition of the provisions on working hours for these categories of workers.
The average weekly working time of the workers concerned shall not exceed 48 hours on average over a reference period of thirteen weeks and an absolute limit is introduced per day (24 hours) and per week (60 hours), except for cases of force majeure.
Each work service consisting of at least 12 hours and maximum 24 hours shall include a rest interval of at least 12 consecutive hours.

Cette mesure est une application limitée de la clause de renonciation. Elle présente un caractère exceptionnel vu les impératifs de santé publique et le caractère spécifique des activités et des travailleurs concernés. L'accord écrit qui est distinct de la convention conclue lors de l'engagement devra être constaté avant le début de la prestation des heures additionnelles. Il devra être conservé cinq ans et pourra être résilié moyennant un préavis d'un mois. Il est entendu que ces heures de travail additionnel doivent faire l'objet d'une rémunération indépendante de celle fixant la rémunération de base.
Ce projet de loi est le fruit d'un consensus équilibré et délicat entre les intérêts parfois difficilement conciliables. Il tient compte des impératifs qui découlent des besoins, de la continuité des soins et des traitements médicaux.
Lors de la discussion générale et des articles, Mme Gerkens a surtout mis en exergue le rapport de force entre les gestionnaires d'hôpitaux, les maîtres de stage et les stagiaires. Ce rapport de force implique la nécessité de réglementer le temps de travail et d'autoriser les inspections des lois sociales. Elle a toutefois émis des craintes concernant le libre choix des stagiaires quant aux heures de travail additionnel et sur le fait que les médecins indépendants n'entraient pas dans le champ d'application de la loi.
Tout en faisant remarquer qu'une durée de travail hebdomadaire moyenne de 48 heures, plafonnée à 60 heures, est relativement élevée, M. Vercamer estime néanmoins que le projet de loi réunit trois principes fondamentaux: la réglementation du temps de travail, qui répond à une nécessité dans l'intérêt tant des prestataires que des patients, le souci d'une flexibilité suffisante et le caractère volontaire de la durée de travail complémentaire.
M. Clarinval et Mme Rutten ont partagé les craintes de Mme Gerkens sur les possibles abus en matière de temps de travail additionnel. Sur la base de l'avis du Conseil d'État, un amendement a donc été déposé. Il prévoit la possibilité de fixer les modalités d'établissement de l'accord individuel. Mme Demir a exprimé quelques réserves sur ce point, estimant qu'il aurait été préférable que les modalités soient inscrites dans le projet lui-même plutôt que dans un arrêté royal.
Mme Fonck s'est réjouie de ce que le gouvernement ait pu parvenir à un accord qui recueille l'assentiment de toutes les parties concernées, en ce compris les organisations représentatives des candidats stagiaires. Elle a présenté quatre amendements dont l'objet est de tenir compte de la prochaine entrée en vigueur du Code pénal social.
En ce qui concerne les réponses de la ministre aux questions posées par les différents intervenants, je vais donc me référer au rapport écrit.
Tous les articles, les quatre amendements et l'ensemble du texte ont été adoptés à l'unanimité. La proposition de loi jointe de Mme Gerkens est devenue sans objet.

This strength ratio implies the need to regulate working time and allow inspections of social laws. However, it expressed concerns about the free choice of interns as regards additional hours and the fact that independent physicians are not covered by the law.
While pointing out that an average weekly working time of 48 hours, ceiling to 60 hours, is relatively high, Mr. Vercamer, however, believes that the bill brings together three fundamental principles: the regulation of working time, which responds to a necessity in the interests of both service providers and patients, the concern for sufficient flexibility and the voluntary nature of supplementary working hours.
by Mr. Clarinval and Ms. Rutten shared Ms. Gerkens’ concerns about possible abuses of additional working hours. Based on the opinion of the State Council, an amendment was submitted. It provides for the possibility of fixing the modalities for the establishment of the individual agreement. Ms Demir expressed some reservations on this point, believing that it would have been better for the terms to be included in the project itself rather than in a royal decree.
Ms Fonck welcomed that the government has been able to reach an agreement that requires the consent of all stakeholders, including the organisations representing candidate trainees. It submitted four amendments aimed at taking into account the next entry into force of the Social Criminal Code.
As regards the Minister’s responses to the questions asked by the various speakers, I will therefore refer to the written report.
All articles, four amendments and the entire text were adopted unanimously. The joint bill proposed by Ms. Gerkens has become pointless.

Je ne reviendrai pas sur les péripéties houleuses qui ont émaillé l’année 2008 quant à la proposition de révision de la directive européenne sur l’aménagement du temps de travail mais il faut rappeler qu’un nombre croissant d’États membres, la Grande-Bretagne en tête, ont usé et abusé, ces dernières années, de la fameuse clause dite de renonciation, afin de contourner les limites en matière de temps de travail dans des secteurs très divers dont, par exemple, les services de santé. Ces recours non encadrés collectivement ont contribué à des baisses de productivité. C’est l’évidence même mais ils perpétuent aussi la division traditionnelle du travail entre les hommes et les femmes. C’est inacceptable par rapport à ce que doit être une Europe sociale.
Ce projet de loi propose également une possibilité de temps de travail additionnel en raison des impératifs de santé publique et du caractère spécifique des activités des travailleurs concernés. En tout état de cause, il s’agit d’une application limitée de la clause de renonciation et des balises importantes sont prévues pour éviter le libre choix forcé et pour permettre l’effectivité du travail de l’Inspection sociale. À cet égard, nous partageons pleinement l’amendement déposé et voté en commission qui permet de fixer les modalités d’établissement de l’accord individuel du travailleur. These non-collectively-framed remedies contributed to reduced productivity. This is obvious, but they also perpetuate the traditional division of labour between men and women. This is unacceptable compared to what a social Europe should be.
This bill also provides for the possibility of additional working hours due to public health imperatives and the specific nature of the activities of the workers concerned. In any case, it is a limited application of the waiver clause and important tags are provided to avoid forced free choice and to enable the effectiveness of the work of the Social Inspection. In this regard, we fully agree with the amendment submitted and voted in the committee that allows to fix the modalities for establishing the individual employee agreement. It is clear that this law will need to be assessed in consultation with representatives of doctors, trainees and hospitals. If necessary, it will need to be adjusted according to the problems encountered on the ground.

Belgische artsen en specialisten in opleiding kloppen vaak extreem lange werkdagen. Hoewel geen enkele arts de operatietafel zal verlaten als zijn formele werktijd is afgelopen, is het geen goede zaak om in dit soort praktijken heldendaden te zien, integendeel. De uitputting door lange en ononderbroken werkdagen is uiteindelijk ronduit schadelijk, zowel voor de patiënten als de artsen zelf.
In andere Europese landen was het onder impuls van de Europese regelgever al langer duidelijk. Dit soort arbeidsomstandigheden is gewoon niet meer van deze tijd. Met het voorstel dat vandaag ter stemming voorligt, treden eindelijk de Belgische artsen en specialisten, maar ook veeartsen, tandartsen, stagiairs en studenten in loondienst, eindelijk de 21ˢᵗᵉ eeuw binnen.
Met dit voorstel wordt de gemiddelde arbeidsduur beperkt tot 48 uur per week over een referentieperiode, mevrouw de minister, van 13 weken. Er wordt ook een absolute maximumduur van 60 uur per week bepaald, alhoewel. Absoluut is in de context van deze wet iets minder absoluut dan het woord doet vermoeden. Van de maximumduur kan namelijk vrijwillig worden afgeweken. Mits de instemming van de werknemer is er boven op de 60 uur nog een bijkomende arbeidstijd van 12 uur mogelijk. Dat brengt de totale, formele werkduur nog steeds op 72 uur per week.
Op dat punt situeert zich onze grootste bekommernis. In theorie gaat het om een geschreven individueel akkoord op basis van vrijwilligheid, maar in de praktijk dreigen die 12 extra uren eerder de regel dan de uitzondering te worden. Dat heeft bijvoorbeeld te maken met de morele druk, de concurrentie, de leerling-meesterverhouding tussen stagemeesters en artsen in opleiding.
Open Vld houdt niet van hypocriete regelgeving en hecht daarom bijzonder belang aan de bepalingen van dat individuele akkoord. Als wij de arbeidssituatie van artsen en andere categorieën die onder dit wetsvoorstel vallen echt willen veranderen, is het ontzettend belangrijk dat die 12 extra uren daadwerkelijk optioneel zijn en niet dwangmatig. Voor ons staat de vrije keuze centraal.

This assumption is not fiction. This is a reality for many doctors, especially in training.
Belgian doctors and training specialists often strike extremely long working days. Although no doctor will leave the operating table after his formal working hours have ended, it is not a good thing to see heroic acts in this type of practice, on the contrary. The exhaustion from long and uninterrupted working days is ultimately completely harmful, both for the patients and the doctors themselves.
In other European countries, this has long been evident under the impetus of the European regulator. Such working conditions are simply no longer of this time. With the proposal presented for voting today, Belgian doctors and specialists, as well as veterinarians, dentists, trainees and students in wage service, finally enter the 21st century.
This proposal limits the average working time to 48 hours per week over a reference period of 13 weeks. There is also an absolute maximum length of 60 hours per week, though. In the context of this law, absolute is something less absolute than the word suggests. The maximum duration can be voluntarily deviated. With the consent of the employee, an additional working time of 12 hours is possible beyond the 60 hours. That brings the total, formal working time still to 72 hours per week.
This is where our biggest concern is situated. In theory it is a written individual agreement based on voluntary, but in practice those 12 extra hours threaten to become the rule rather than the exception. This has to do, for example, with the moral pressure, the competition, the student-master ratio between trainees and doctors in training.
Open Vld does not like hypocritical regulations and therefore attaches special importance to the provisions of that individual agreement. If we really want to change the working situation of doctors and other categories covered by this bill, it is extremely important that those 12 extra hours are actually optional and not compulsory. For us, free choice is central.

Hoewel wij alle begrip hebben voor de continuïteit van de zorg, willen wij in het belang van artsen en patiënten mogelijke excessen op dat vlak tegengaan.
Dat is de reden waarom wij bij de behandeling in de commissie een amendement hebben ingediend waarmee wij voor de toekomst de mogelijkheid openlaten om de uitvoering van dat individueel akkoord nader te bepalen in een door de Ministerraad overlegd koninklijk besluit. Op die manier voorziet het wetsontwerp nu wel in de mogelijkheid om op te treden indien blijkt dat de bepalingen over de opstelling van het geschrift in de praktijk voor problemen, voor dwang of voor misbruiken zouden zorgen. Het amendement maakt het mogelijk om sneller dan de geplande evaluatie in te grijpen.
Ik wil dan ook graag van de gelegenheid gebruikmaken om de mensen op het terrein te wijzen op die relatief flexibele mogelijkheid tot verdere verfijning van de modaliteiten van het individueel akkoord. Het zal iedereen vanaf de inwerkingtreding alert doen blijven voor het vrijwillig karakter van die bepaling.
Natuurlijk lost ook de mogelijkheid tot verdere verfijning met een amendement niet alles op. Het succes van de wetgeving staat of valt met de verantwoordelijke houding van actoren op het terrein. Wij kunnen als wetgever sturen en corrigeren, maar de veranderingen in arbeidsethos en de informele geplogenheden zullen in de eerste plaats uiteraard op de werkvloer moeten gebeuren. Zoiets heeft tijd nodig, maar als er een wil is, en met de consensus rond dit voorstel, moet dat lukken.
Voor wie niettemin hardleers blijft geloven in de pseudo-heilzaamheid van al te lange werkdagen en weinig slaap, voorziet de wet ook sancties. Dankzij een aantal amendementen die in de commissie werden goedgekeurd, zullen de sociale inspecteurs kunnen beschikken over de verschillende in het Sociaal Strafwetboek vernoemde bevoegdheden.
U hebt begrepen dat onze bekommernis als liberalen ligt bij de gezondheid van patiënten en artsen, bij een betere dienstverlening en een vrije keuze. Dat zijn de uitgangspunten voor ons wetgevend handelen. Dat wil echter niet zeggen dat wij het eens zijn met de vaak al te populistische beeldvorming die alleen uitbuiting of misbruiken vooropstelt. Niets is minder waar. Er is ook echt begrip nodig voor zowel de artsen als de ziekenhuizen, die de continuïteit van de zorg willen en moeten waarborgen. Wie, met andere woorden, de indruk wil wekken dat er in de ziekenhuizen alleen maar wantoestanden bestaan waarbij het medisch personeel wordt uitgebuit, neemt echt een loopje met de waarheid.
Met het voorliggend voorstel regelen wij, onder druk van Europa, maar beter laat dan nooit, een delicate materie die al tien jaar tot verhitte discussies leidt. Eindelijk wordt er voldoende rusttijd voorzien voor mensen die lange dagen kloppen en van wie verwacht wordt dat zij steevast alert en deskundig hun job uitoefenen. Er hangen immers mensenlevens van af.
Wij zijn van mening dat dit wetsvoorstel een evenwicht vindt tussen een modern arbeidsregime in het belang van patiënten en zorgverstrekkers en de continuïteit van de zorg. Wij hechten bijzonder belang aan het vrijwillig karakter om extra uren te presteren, en aan het amendement om de modaliteiten te bepalen.
Met die redenen in het achterhoofd zal de fractie van Open Vld dit wetsontwerp straks goedkeuren. Moge het alvast de grootste helden inzake slaaptekort en onzinnig lange arbeidsuren onder ons, politici, inspireren.

That is why we submitted an amendment during the examination in the committee, allowing us to provide for the future the possibility to further determine the implementation of that individual agreement in a royal decree submitted by the Council of Ministers. In this way, the draft law now provides for the possibility to take action if it turns out that the provisions on the drafting of the writing in practice would cause problems, coercion or abuse. The amendment makes it possible to intervene faster than the planned evaluation.
I would therefore like to take the opportunity to point out to the people on the ground that relatively flexible possibility for further refinement of the modalities of the individual agreement. From the date of its entry into force, it shall keep everyone aware of the voluntary nature of that provision.
Of course, even the possibility of further refinement with an amendment does not solve everything. The success of legislation stands or falls with the responsible attitude of actors in the field. We, as legislators, can direct and correct, but the changes in the work ethos and the informal plugs will, of course, first and foremost have to happen in the workplace. Such a thing takes time, but if there is a will, and with the consensus around this proposal, it must succeed.
For those who, nevertheless, continue to hardly believe in the pseudo-healing of too long working days and little sleep, the law also provides for sanctions. Thanks to a number of amendments approved in the committee, the social inspectors will be able to have the various powers listed in the Social Criminal Code.
You have understood that our concern as liberals lies with the health of patients and doctors, with better services and free choice. These are the principles for our legislative action. That does not mean, however, that we agree with the often too populist imagery that presupposes only exploitation or abuse. Nothing is less true. True understanding is also needed for both doctors and hospitals, who want and must ensure the continuity of care. In other words, whoever wants to give the impression that in hospitals there are only disadvantages in which the medical staff is exploited, really takes a walk with the truth.
With this proposal, under pressure from Europe, but better late than never, we settle a delicate matter that has led to heated discussions for ten years. Finally, sufficient rest time is provided for people who struggle long days and who are expected to be constantly alert and expert in performing their job. Human lives depend on it.
We believe that this bill balances between a modern working regime in the interests of patients and care providers and the continuity of care. We attach particular importance to the voluntary nature of supplementary hours, and to the amendment to determine the modalities.
With those reasons in mind, the Open Vld group will approve this bill later. May it inspire the greatest heroes of sleep deprivation and absurd long hours of work among us politicians.

Het regelt eindelijk een zeer heikel punt, waarover na zeer veel en intens overleg een consensus met alle betrokkenen is bereikt. Zeer veel en intens overleg heeft zijn voor- en nadelen. Het voordeel is dat men een groot draagvlak met alle betrokkenen heeft. Het nadeel is dat dat veel tijd vraagt en dat wij inderdaad een jaar te laat zijn met de omzetting van de Europese richtlijn. Daarom is het echt wel goed dat wij hierover vandaag kunnen stemmen.
Onze fractie zal het wetsontwerp, zoals het door de commissie na amendering is aangenomen, goedkeuren omdat wij vinden dat het een goed evenwicht tussen drie belangrijke principes hanteert. Ten eerste, de arbeidstijd wordt concreet geregeld. Ten tweede, voldoende flexibiliteit wordt ingebouwd. Ten derde, het beginsel van de vrijwilligheid inzake het presteren van bijkomende arbeidstijd wordt gerespecteerd.
Die regeling van de arbeidstijd, gemiddeld 48 uur per week met een maximum van 60 uur per week, is niet niets. Daarbij is in verplichte rustpauzes voorzien. Dat is in het belang van zowel de patiënt als de zorgverlener. Dat moet de waarborg voor de kwaliteit van de zorg zijn.
Het wetsontwerp voorziet ook in voldoende flexibiliteit en houdt tegelijkertijd ook waarborgen in, opdat misbruik van de flexibiliteit zou worden vermeden. Als men immers de grenzen van de arbeidstijd wil overschrijden, kan dat alleen maar in beperkte en welomschreven gevallen.

That arrangement of working time, an average of 48 hours per week with a maximum of 60 hours per week, is nothing. There are mandatory rest breaks. This is in the interests of both the patient and the healthcare provider. This should be the guarantee for the quality of care.
The draft legislation also provides for sufficient flexibility and at the same time includes safeguards to avoid abuse of flexibility. In fact, if one wishes to exceed the limits of working time, this can only be done in limited and well-defined cases.
Finally, our group emphasizes that the principle of voluntariness in the performance of additional work is guaranteed in the bill. The amendment also provided for the possibility of strengthening this guarantee.
All in all, there is a good balance, which should enable healthcare institutions to continue to organize good services, with respect for the healthcare provider, and guarantees for quality care for patients.

Monsieur le président, madame la ministre, chers collègues, comme nous l'avons déjà souligné en commission, le sujet présenté à notre attention aujourd'hui est très sensible. De nombreuses concertations ont été organisées dans ce dossier et le compromis fut difficile à obtenir. Il y a en cette matière de nombreuses divisions, entre les hôpitaux qui recherchent parfois de la main-d'œuvre très bon marché et les médecins en formation qui souhaitent quant à eux bénéficier d'heures de prestations décentes. Il peut y avoir aussi des divergences d'intérêts entre les maîtres de stage et les médecins en formation.
Il s'agit d'un dossier difficile qui concerne l'organisation de la continuité des soins, la sécurité des patients. Cela peut entraîner des problèmes budgétaires en matière d'engagement de personnel dans les hôpitaux. La presse se fait l'écho régulièrement de l'exploitation des médecins candidats spécialistes et des dangers que cela génère, notamment en termes de sécurité pour le patient. De leur côté, les hôpitaux et surtout les hôpitaux universitaires seraient confrontés à de très importants problèmes d'organisation pour assurer la continuité des soins dans les services si le temps de travail des médecins en formation était réduit drastiquement. Quoi qu'on en pense, on doit s'attendre à des conflits sur cette question. Malgré l'article 7, paragraphe 5 qui prévoit que le travailleur ne peut subir de la part de l'employeur aucun préjudice, le candidat spécialiste va craindre inévitablement un rapport défavorable de son maître de stage. Des contrôles et sanctions sont bien prévus mais dans la pratique, il s'agira de s'assurer de l'effectivité du contrôle. À cet égard, nous serons particulièrement attentifs à l'évaluation annoncée par Mme la ministre.

Ce projet constitue un progrès certain par rapport au vide juridique actuel qui a pour conséquence que des médecins candidats spécialistes en formation ne sont absolument pas protégés. En effet, il concerne une catégorie de travailleurs soumis à des conditions de travail et de formation déséquilibrées, vu le rapport de force qui existe inévitablement entre un maître de stage et un candidat médecin en formation. Auparavant, ces derniers étaient soumis – nous le savons tous – à des horaires particulièrement difficiles. En effet, ils devaient travailler durant de longues heures sans récupération possible, avec le risque que cela représentait pour eux, mais aussi en termes de qualité des prestations et de sécurité des patients.
Déjà en 2008, j'avais déposé une proposition de loi visant à demander que le temps de travail des candidats médecins stagiaires soit intégré dans la loi sur le temps de travail. En commission de la Santé publique, toute une série d'auditions avait été réalisée. C'est ainsi que nous avions entendu des gestionnaires d'hôpitaux, des représentants des maîtres de stage, des représentants des doyens d'universités, de manière à avoir une vision large et globale de la situation.
En commission de la Santé, les membres d'Ecolo-Groen! ont accepté d'adhérer au projet de loi présenté par la ministre en considérant que notre proposition de loi devenait caduque, même si ledit projet comprend un certain nombre de compromis. Je ne pense pas que nous pouvions faire plus en la matière.
Le projet de loi à l'examen présente des éléments particulièrement positifs: l'inscription des candidats stagiaires (médecins, dentistes, vétérinaires, etc.) dans la loi sur le temps de travail, la possibilité et même l'obligation de récupérer des heures via des heures de repos lorsque les heures de prestation dépassent un certain temps. Tous ces éléments constituent un gage de garantie et de sécurité.
Ce texte comprend également – disais-je – un certain nombre de compromis dont certains nécessiteront que nous fassions preuve de vigilance. Ainsi, comme cela a déjà été souligné, le candidat stagiaire pourra prester, sur une base volontaire, douze heures en plus du temps de travail réglementé par le projet. Cette prestation supplémentaire devra faire l'objet d'un accord signé par le stagiaire et son maître de stage et ce, indépendamment du contrat de stage négocié au préalable. Mais, comme cela a déjà été évoqué, chacun connaît le rapport de force qui existe entre le maître de stage et son stagiaire et chacun sait que le choix volontaire sera tout relatif. Il est clair que le stagiaire s'apercevra assez vite s'il a intérêt à signer ou non l'accord précité.

The bill under consideration presents ⁇ positive elements: the inclusion of candidates for internship (doctors, dentists, veterinarians, etc.) in the law on working time, the possibility and even the obligation to recover hours through rest hours when the hours of service exceed a certain time. All these elements constitute a guarantee of guarantee and security.
This text also includes – I said – a number of compromises, some of which will require us to be vigilant. Thus, as already underlined, the trainee candidate will be able to provide, on a voluntary basis, twelve hours in addition to the working time regulated by the project. This additional benefit must be the subject of an agreement signed by the trainee and his master of the internship and this, regardless of the internship contract negotiated in advance. But, as it has already been mentioned, everyone knows the strength ratio that exists between the master of the internship and his trainee and everyone knows that the voluntary choice will be all relative. It is clear that the trainee will notice quite quickly whether he has an interest in signing or not the aforementioned agreement.

Néanmoins, les étudiants et les candidats stagiaires sont conscients de la nécessité du nombre d'heures à prester, mais aussi des pénuries de médecins spécialistes dans les hôpitaux. C'est pourquoi ils acceptent de prester toutes ces heures.
L'élément qui devra retenir notre vigilance dans le suivi et l'évaluation de cette mesure, c'est que les maîtres de stage ne puissent abuser de leur position dans l'évaluation, la longueur et la qualité de la formation du candidat stagiaire. Madame la ministre, comme en commission, j'attire votre attention: parmi les critères d'évaluation sur l'ensemble des candidats, il s'agira d'examiner la durée, l'étalement, la qualité de la formation, ainsi que leur relation avec leur maître de stage.
Autre compromis, ce sont les quatre heures à réserver au travail de recherche exigé des candidats en formation. Quatre heures constituent une durée insuffisante, mais il a bien fallu trouver un compromis. Là aussi, il conviendra d'évaluer afin d'observer si les candidats stagiaires conservent l'opportunité d'augmenter ce temps consacré à la recherche. En effet, ce ne sont pas des travailleurs, mais des étudiants en formation; c’est pourquoi on exige d'eux cette capacité de recherche.
J'aborde un dernier élément pour notre discussion.
Madame la ministre, je sors du champ de vos compétences, car, à un moment, nous nous trouvons au croisement des compétences d'un ministre de la Santé et de celles d'un ministre des Affaires sociales.
Pour améliorer la qualité de la formation de ces candidats, une réflexion devra être menée sur la présence en nombre suffisant de médecins spécialistes dans les hôpitaux afin de pouvoir encadrer tous ces stagiaires au cours de leur formation. De fait, ces stagiaires ne remplacent pas les médecins spécialistes absents, mais doivent bénéficier de leur accompagnement.
De plus, il conviendra d'harmoniser le mode d'évaluation de la formation: quand correspond-elle aux compétences et aux capacités attendues?
Certaines universités, pour certaines disciplines, réalisent un réel effort pour y parvenir. Ainsi, en chirurgie, une étude est réalisée pour déterminer les opérations à pouvoir réaliser, le nombre d'heures à prester dans les divers contextes possibles.
Une objectivation de cette évaluation de la progression de la formation et de sa finalité sera indispensable afin de lui attribuer une valeur correcte, satisfaisante pour tous et pour permettre aux candidats stagiaires de bénéficier d'un apprentissage de qualité, équilibré et formateur de spécialistes de qualité, et ce, évidemment au bénéfice des patients.
Ecolo-Groen! se positionnera en faveur de ce projet de loi, mais restera vigilant à l'égard des éléments de compromis qu'il a fallu accepter.

In order to improve the quality of the training of these candidates, a reflection will need to be carried out on the presence of sufficient number of specialized doctors in the hospitals in order to be able to frame all these trainees during their training. In fact, these trainees do not replace the absent medical specialists, but must benefit from their accompaniment.
Furthermore, the method of evaluation of training should be harmonised: when does it correspond to the expected skills and capabilities?
Some universities, for some disciplines, make a real effort to ⁇ this. Thus, in surgery, a study is conducted to determine the operations to be performed, the number of hours to be performed in the various possible contexts.
An objectivation of this evaluation of the progress of the training and its purpose will be indispensable in order to attribute to it a correct value, satisfying for all and to enable candidate interns to benefit from a quality, balanced and training of quality specialists, and this, of course, to the benefit of patients.
Ecologically green! He will stand in favour of this bill, but will remain vigilant with regard to the elements of compromise that have had to be accepted.

Bij het wetsontwerp hebben wij twee bedenkingen die ik in de commissie voor de Sociale Zaken naar voor heb geschoven.
Ten eerste, ik stel vast dat met het wetsontwerp het in de praktijk nog altijd mogelijk is dat artsen of kandidaat-artsen 72 uur werken in ziekenhuizen. Dat lijkt mij aan de hoge kant, wetende dat de wettelijke arbeidsduur in dit land 38 uur is voor werknemers in loondienst.
Ten tweede, ik ben ook bezorgd over het vrijwillige karakter van de 12 bijkomende uren die een arts of een stagiair-arts moet bijpresteren. Ik vraag mij af in hoeverre een stagiair-arts die van een diensthoofd de vraag krijgt om bijkomend 12 uur te werken, dat kan weigeren. Gwendolyn Rutten heeft daarover een amendement ingediend. Ik hoop dat de modaliteiten snel bij KB zullen komen.
Ondanks deze bedenkingen zal onze fractie dit wetsontwerp wel goedkeuren, mevrouw de minister.
Toch ben ik zeer ontevreden over de manier waarop dit dossier werd aangepakt. U krijgt op 20 november 2009 een tik van de Europese Commissie dat de richtlijn moet worden omgezet in nationale wetgeving. Dinsdagavond moest ik vaststellen dat de agenda van de commissie voor de Sociale Zaken opeens wordt gewijzigd. Woensdagochtend moeten wij dan op een drafje beslissen over het wetsontwerp. Ik vind dit getuigen van weinig parlementaire democratie.
Mevrouw de minister, uw wetsontwerp heeft het met de hakken over de sloot gehaald. U weet dat in deze tijd er veel water in de sloot kan staan. Mij lijkt het dan ook gevaarlijk om op die manier over de sloot te springen. De volgende keer als u met een wetsontwerp komt, mevrouw de minister, hoop ik dat dit iets vroeger kan worden geagendeerd zodat elk parlementslid zijn werk kan doen.

J'ai moi-même vécu cette situation. Je parle d'une équation impossible parce qu'elle était à multiples composantes: les positionnements, les enjeux, la réalité des hôpitaux et celle des prestataires étaient très différents.
Madame la ministre, le gouvernement a pu résoudre cette équation impossible grâce à des avancées sur le plan humain et sur le plan de la santé publique. Mes collègues en ont parlé et je pense que c'est singulièrement vrai en termes de qualité des soins, de plus-value pour les patients et de diminution des risques d'accidents tout en garantissant la continuité des soins.
En ce qui concerne cette équation que je disais impossible, il faut souligner la conscience professionnelle de l'ensemble de ceux qui ont représenté les hôpitaux et les prestataires de soins. Sans la conscience professionnelle dont ils ont fait preuve dans les négociations, il aurait été difficile de résoudre l'équation. Qu'elles qu'aient pu être leur positionnement et leur réalité, ils ont suivi ce double objectif de ne pas mettre à mal l'organisation des soins et de tenir compte de la réalité du travail des prestataires.
Bien sûr, l'histoire ne s'arrêtera pas là car les implications pour le futur sont nombreuses. D'abord, au sein des hôpitaux, il y aura la question de la réorganisation du travail. Ensuite, pour le fédéral et pour les Communautés, la question du nombre de médecins et de médecins assistants devra être reposée pour assurer la continuité des soins et pour que les hôpitaux puissent continuer à travailler à la qualité des soins administrés aux patients.

Of course, history will not stop there because the implications for the future are many. First, within the hospitals, there will be the question of the reorganization of work. Then, for the federal and for the Communities, the question of the number of doctors and assistant doctors will have to be restored to ensure continuity of care and so that hospitals can continue to work on the quality of care given to patients.
I will not be surprised to tell you that the CDH group will support this text.
